29. Judgements (2/3)
٢٩۔ كِتَابُ الْقَضَاءِ ص ٢
[Machine] About a debtor who was in need, so he mentioned it to the Prophet ﷺ who called him and said, "Have you freed your servant?" He replied, "Yes." Then the Prophet ﷺ said, "You are the one who is in need of him." Then he said, "Who will buy him?" He said, "Nuaim bin Abdullah, it's me." So the Prophet ﷺ bought him and paid his price to his owner.
عَنْ دُبُرٍ وَكَانَ مُحْتَاجًا فَذَكَرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَدَعَاهُ فَقَالَ «أَعْتَقْتَ غُلَامَكَ؟» قَالَ نَعَمْ فَقَالَ النَّبِيُّ ﷺ «أَنْتَ أَحْوَجُ إِلَيْهِ» ثُمَّ قَالَ «مَنْ يَشْتَرِيهِ؟» قَالَ نُعَيْمُ بْنُ عَبْدِ اللهِ أَنَا فَاشْتَرَاهُ فَأَخَذَ النَّبِيُّ ﷺ ثَمَنَهُ فَدَفَعَهُ إِلَى صَاحِبِهِ
29.33 [Machine] Judgment in scarcity and abundance of water.
٢٩۔٣٣ الْقَضَاءُ فِي قَلِيلِ الْمَاءِ وَكَثِيرِهِ
He who appropriated the right of a Muslim by (swearing a false) oath, Allah would make Hell-fire necessary for him and would declare Paradise forbidden for him. A person said to him: Messenger of Allah, even if it is something insignificant? He (the Holy Prophet) replied: (Yes) even if it is the twig of the arak tree. (Using translation from Muslim 137a)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنِ اقْتَطَعَ حَقَّ امْرِئٍ مُسْلِمٍ بِيَمِينِهِ فَقَدْ أَوْجَبَ اللهُ لَهُ النَّارَ وَحَرَّمَ عَلَيْهِ الْجَنَّةَ» فَقَالَ لَهُ رَجُلٌ وَإِنْ كَانَ شَيْئًا يَسِيرًا يَا رَسُولَ اللهِ؟ قَالَ «وَإِنْ كَانَ قَضِيبًا مِنْ أَرَاكٍ»
“No man seizes the wealth of a Muslim unlawfully by means of his (false) oath, but Allah will deny Paradise to him and will doom him to Hell.” A man among the people said: “O Messenger of Allah, even if it is something small?” He said: “Even if it is a twig of an Arak tree.” (Using translation from Ibn Mājah 2324)
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ «لَا يَقْتَطِعُ رَجُلٌ حَقَّ امْرِئٍ مُسْلِمٍ بِيَمِينِهِ إِلَّا حَرَّمَ اللهُ عَلَيْهِ الْجَنَّةَ وَأَوْجَبَ لَهُ النَّارَ» فَقَالَ رَجُلٌ مِنَ الْقَوْمِ يَا رَسُولَ اللهِ وَإِنْ كَانَ شَيْئًا يَسِيرًا؟ قَالَ «وَإِنْ كَانَ سِوَاكًا مِنْ أَرَاكٍ»
29.34 [Machine] The ruling of the judge on the absent when he knows him.
٢٩۔٣٤ قَضَاءُ الْحَاكِمِ عَلَى الْغَائِبِ إِذَا عَرَفَهُ
[Machine] Indeed, my husband, Abu Sufyan, is a tight-fisted and stingy man who does not give me enough and my children. Shall I take from his wealth without his knowledge? So the Messenger of Allah ﷺ said, "Take what is sufficient for you and your children with kindness."
إِنَّ زَوْجِي أَبَا سُفْيَانَ رَجُلٌ مُمْسِكٌ شَحِيحٌ لَا يُعْطِينِي مَا يَكْفِينِي وَبَنِيَّ أَفَآخُذُ مِنْ مَالِهِ وَهُوَ لَا يَعْلَمُ؟ فَقَالَ رَسُولُ اللهِ ﷺ «خُذِي مَا يَكْفِيكِ وَبَنِيكِ بِالْمَعْرُوفِ»
29.35 [Machine] Prohibition of Judging in Two Different Courts
٢٩۔٣٥ النَّهْيُ عَنْ أَنْ يَقْضِيَ فِي قَضَاءٍ بِقَضَاءَيْنِ
"Abu Bakrah wrote to me, saying: 'I heard the Messenger of Allah [SAW] say: No one should pass two judgments on one issue, and no one should pass judgment between two disputing parties while he is angry.'" (Using translation from Nasāʾī 5421)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «لَا يَقْضِيَنَّ أَحَدٌ فِي قَضَاءٍ بِقَضَاءَيْنِ وَلَا يَقْضِي أَحَدٌ بَيْنَ خَصْمَيْنِ وَهُوَ غَضْبَانُ»
29.36 [Machine] What does not break the decision
٢٩۔٣٦ مَا يَقْطَعُ الْقَضَاءَ
[Machine] The Messenger of Allah, ﷺ , heard the argument of two disputants at the door of Um Salama. He went out to them and said, "You are arguing in front of me, but I am only a human being. It is possible that some of you may have a stronger argument than others. So I will judge based on what I hear and believe to be truthful. Whoever I give the right to, it is only a piece from the fire, so let him take it or leave it."
سَمِعَ رَسُولُ اللهِ ﷺ لَجَبَةَ خَصْمٍ عِنْدَ بَابِ أُمِّ سَلَمَةَ فَخَرَجَ إِلَيْهِمْ فَقَالَ «إِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ وَإِنَّمَا أَنَا بَشَرٌ وَلَعَلَّ بَعْضَكُمْ أَنْ يَكُونَ أَعْلَمَ بِحُجَّتِهِ مِنْ بَعْضٍ فَأَقْضِي لَهُ بِمَا أَسْمَعُ وَأَظُنُّهُ صَادِقًا فَمَنْ قَضَيْتُ لَهُ مِنْ حَقِّ أَخِيهِ فَإِنَّمَا هِيَ قِطْعَةٌ مِنَ النَّارِ فَلْيَأْخُذْهَا أَوْ لِيَدَعْهَا»
29.37 [Machine] The fierce competitor
٢٩۔٣٧ الْأَلَدِّ الْخَصِمِ
Messenger of Allah ﷺ said, "The most hated person in the sight of Allah, is the most quarrelsome person." (Using translation from Bukhārī 7188)
قَالَ رَسُولُ اللهِ ﷺ «أَبْغَضُ الرِّجَالِ إِلَى اللهِ الْأَلَدُّ الْخَصِمُ»
29.38 [Machine] Listening to the ruler from someone other than the person who has the right to be in the presence of the person who has the right if he is small or weak
٢٩۔٣٨ اسْتِمَاعُ الْحَاكِمِ مِنْ غَيْرِ مَنْ لَهُ الْحَقُّ بِحَضْرَةِ مَنْ لَهُ الْحَقُّ إِذَا كَانَ صَغِيرًا أَوْ ضَعِيفًا
'Abdullah bin Sahl and Muhayysah set out for Khaibar because of some problem that had arisen. Someone came to Muhayysah and he told him that 'Abdullah bin Sahl had been Killed and thrown into a pit, or a well. He came to the Jews and said: "By Allah, you killed him. " They said: "By Allah, we did not kill him."Then he went back to the Messenger of Allah and told him about that. Then he and Huwayysah - his brother who was older than him - and 'Abdur-Rahman bin Sahl, came (to the Prophet). Muhayysah, who was the one who had been at Khaibar, began to speak, but the messenger of Allah said: "Let the elder speak first," So Huwayysah elder speaks first." So Huwayysah spoke, then Muhayysah spoke. The Messenger of Allah said: "Either (the Jews) will pay the Diyah for your comanion, or war will be declared on them." The Messenger of Allah sent a letter to that effect (to the Jews) and they wrote back saying: "By Allah, we did not kill him." The Messenger of Allah said to Huwayysah. Muhayysah and 'Abdur-Rahman: "Will you swear an oath establishing your claim to the blood money of your companion?" They said: "No." He said: "Should the jews swear an oath for you? They said: "They are not Muslims." So the Messenger of Allah paid (the Diyah) himself, and he sent one hundred she-camels to their abodes. Sahl said: "A red she-camel from among them kicked me." أَنْتُمْ وَاللهِ قَتَلْتُمُوهُ فَقَالُوا وَاللهِ مَا قَتَلْنَاهُ ثُمَّ أَقْبَلَ مَنْ قَدِمَ عَلَى رَسُولِ اللهِ ﷺ فَذَكَرَ ذَلِكَ لَهُ ثُمَّ أَقْبَلَ هُوَ وَحُوَيِّصَةُ وَهُوَ أَخُوهُ أَكْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ فَذَهَبَ مُحَيِّصَةُ لِيَتَكَلَّمَ وَهُوَ الَّذِي كَانَ بِخَيْبَرَ فَقَالَ رَسُولُ اللهِ ﷺ «كَبِّرْ كَبِّرْ وَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ» فَقَالَ رَسُولُ اللهِ ﷺ «إِمَّا أَنْ يَدُوا صَاحِبَكُمْ أَوْ يُؤْذَنُوا بِحَرْبٍ» وَكَتَبَ النَّبِيُّ ﷺ فِي ذَلِكَ فَكَتَبُوا أَمَا وَاللهِ مَا قَتَلْنَاهُ فَقَالَ رَسُولُ اللهِ ﷺ لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ «تَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِكُمْ؟» قَالُوا لَا قَالَ «فَتَحْلِفُ لَكُمْ يَهُودُ» قَالُوا لَيْسُوا بِمُسْلِمِينَ فَوَدَاهُ رَسُولُ اللهِ ﷺ مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ بِمِائَةِ نَاقَةٍ حَتَّى أُدْخِلَتْ عَلَيْهِمُ الدَّارَ قَالَ سَهْلٌ لَقَدْ رَكَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَاءُ
29.39 [Machine] Expansion for the ruler not to reprimand the claimant for what he utters about his opponent in his presence.
٢٩۔٣٩ التَّوْسِعَةُ لِلْحَاكِمِ أَنْ لَا يَزْجُرَ الْمُدَّعِيَ عَمَّا يَلْفِظُ بِهِ فِي خَصْمِهِ بِحَضْرَتِهِ
On the Authority of his father: A man from Hadramawt and a man of Kindah came to the Messenger of Allah ﷺ. Al-Hadrami said: Messenger of Allah, this (man) took away forcibly from me the land which belongs to my father. Al-Kindi said: It is my land in my possession, and I cultivate it, he has no right to it. The Prophet ﷺ then said to al-Hadrami: Have you any proof ? He said: No. He then said: So for you is his oath. He said: Messenger of Allah, he is liar, he does not care for which he is taking the oath. He does not refrain himself from anything. The Prophet ﷺ said: You will have nothing from him except that. He went to take an oath for him. When he turned his back, the Messenger of Allah ﷺ said: If he takes an oath on the property to take it away by unfair means, he will meet Allah while He is unmindful of him. جَاءَ رَجُلٌ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كِنْدَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللهِ إِنَّ هَذَا غَلَبَنِي عَلَى أَرْضٍ كَانَتْ لِأَبِي فَقَالَ الْكِنْدِيُّ هِيَ أَرْضِي فِي يَدِي أَزْرَعُهَا لَيْسَ لَهُ فِيهَا حَقٌّ فَقَالَ النَّبِيُّ ﷺ «أَلَكَ بَيِّنَةٌ؟» قَالَ لَا قَالَ «عَلَيْكَ يَمِينُهُ» قَالَ يَا رَسُولَ اللهِ إِنَّ الرَّجُلَ فَاجِرٌ لَا يُبَالِي عَلَى مَا حَلَفَ عَلَيْهِ لَيْسَ يَتَوَرَّعُ مِنْ شَيْءٍ قَالَ «لَيْسَ لَكَ مِنْهُ إِلَّا ذَلِكَ» فَانْطَلَقَ لِيَحْلِفَ فَقَالَ رَسُولُ اللهِ ﷺ لَمَّا أَدْبَرَ «أَمَا إِنْ حَلَفَ عَلَى مَالِهِ لِيَأْكُلَهُ ظُلْمًا لَيَلْقَيَنَّ اللهَ وَهُوَ عَنْهُ مُعْرِضٌ»
29.40 [Machine] Who has the burden of proof?
٢٩۔٤٠ عَلَى مَنِ الْبَيِّنَةُ؟
I was with the Messenger of Allah ﷺ that two men came there disputing over a piece of land. One of them said: Messenger of Allah, this man appropriated my land without justification in the days of ignorance. The (claimant) was Imru'l-Qais b. 'Abis al-Kindi and his opponent was Rabi'a b. 'Iban He (the Holy Prophet) said (to the claimant): Have you evidence (to substantiate your claim)? He replied: I have no evidence. Upon this he (the Messenger of Allah) remarked: Then his (that is of the defendant) is the oath. He (the claimant) said: In this case he (the defendant) would appropriate this (the property). He (the Holy Prophet) said: There is than no other way left for you but this. He (the narrator) said: When he (the defendant) stood up to take oath, the Messenger of Allah ﷺ said: He who appropriated the land wrongfully would meet Allah in a state that He would be angry with him. Ishaq in his narration mentions Rabi'a b. 'Aidan (instead of Rabi'a b. 'Ibdan). (Using translation from Muslim 139b)
كُنَّا عِنْدَ رَسُولِ اللهِ ﷺ فَأَتَاهُ رَجُلَانِ يَخْتَصِمَانِ فِي أَرْضٍ فَقَالَ أَحَدُهُمَا يَا رَسُولَ اللهِ إِنَّ هَذَا انْتَزَى عَلَى أَرْضِي فِي الْجَاهِلِيَّةِ وَهُوَ امْرُؤُ الْقَيْسِ الْكِنْدِيُّ وَخَصْمُهُ رَبِيعَةُ بْنُ عَبْدَانَ قَالَ بَيِّنَتُكَ قَالَ لَيْسَ لِي بَيِّنَةٌ قَالَ يَمِينُهُ قَالَ إِذًا يَذْهَبُ بِهَا قَالَ لَيْسَ إِلَّا ذَلِكَ فَلَمَّا قَامَ لِيَحْلِفَ قَالَ رَسُولُ اللهِ ﷺ «مَنِ اقْتَطَعَ أَرْضًا ظُلْمًا لَقِيَ اللهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ»
29.41 [Machine] Permitting the ruler to command the accused to swear an oath before being questioned by the claimant, and the mentioning of the discrepancies in the words of the transmitters of the news of Al-Ash'ath ibn Qays in that matter.
٢٩۔٤١ الْإِبَاحَةُ لِلْحَاكِمِ أَنْ يَقُولَ لِلْمُدَّعَى عَلَيْهِ احْلِفْ قَبْلَ أَنْ يَسْأَلَهُ ذَلِكَ الْمُدَّعِي، وَذِكْرُ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرِ الْأَشْعَثَ بْنِ قَيْسٍ فِي ذَلِكَ
The Messenger of Allah ﷺ said: He who swears an oath in which he tells a lie to take the property of a Muslim by unfair means, will meet Allah while He is angry with him. Al-Ash'ath said: I swear by Allah, he said this about me. There was some land between me and a Jew, but he denied it to me; so I presented him to the Prophet ﷺ. The Prophet ﷺ asked me: Have you any evidence? I replied: No. He said to the Jew: Take an oath. I said: Messenger of Allah, now he will take an oath and take my property. So Allah, the Exalted, revealed the verse, "As for those who sell the faith they owe to Allah and their own plighted word for a small price, they shall have no portion in the hereafter." (Using translation from Abū Dāʾūd 3243)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ هُوَ فِيهَا فَاجِرٌ لِيَقْطَعَ بِهَا مَالَ امْرِئٍ مُسْلِمٍ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ» فَقَالَ الْأَشْعَثُ بْنُ قَيْسٍ فِيَّ وَاللهِ كَانَ ذَلِكَ كَانَ بَيْنِي وَبَيْنَ رَجُلٍ مِنَ الْيَهُودِ أَرْضٌ فَجَحَدَنِي فَقَدَّمْتُهُ إِلَى النَّبِيِّ ﷺ فَقَالَ لِي رَسُولُ اللهِ ﷺ «أَلَكَ بَيِّنَةٌ؟» فَقُلْتُ لَا فَقَالَ لِلْيَهُودِيِّ «احْلِفْ» فَقُلْتُ وَاللهِ إِذًا يَحْلِفُ فَيَذْهَبُ حَقِّي فَأَنْزَلَ اللهُ تَعَالَى {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} [آل عمران 77] إِلَى آخِرِ الْآيَةِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ فَاتَنِي مِنْ هَذَا الْحَدِيثِ حَرْفٌ فِيمَا أَعْلَمُ وَلَا أَقِفُ عَلَيْهِ وَلَا نَعْلَمُ أَحَدًا تَابَعَ أَبَا مُعَاوِيَةَ عَلَى قَوْلِهِ فَقَالَ لِلْيَهُودِيِّ احْلِفْ
29.42 [Machine] The mention of the disagreement about Sulaiman Al-A'mashi bin Mihran in the wording of this tradition.
٢٩۔٤٢ ذِكْرُ الِاخْتِلَافِ عَلَى سُلَيْمَانَ الْأَعْمَشِ بْنِ مِهْرَانَ فِي لَفْظِ هَذَا الْحَدِيثِ
[Machine] The Messenger of Allah ﷺ said, "Whoever swears an oath to take something unlawfully while lying, he will meet Allah while He is angry with him." This is confirmed in the Book of Allah (Quran), "Indeed, those who exchange the covenant of Allah and their own oaths for a small price will have no share in the Hereafter" [Surah Al-Imran 77]. Ash'ath ibn Qays came and asked, "What is Abu Abdur Rahman talking to you about?" We said, "He said such and such." Ash'ath said, "By Allah, he is telling the truth. Allah revealed a verse about me and another person with whom I had a dispute." The Messenger of Allah ﷺ asked, "Are you his witness or do you have any oath?" I said, "In that case, he will swear an oath." The Messenger of Allah ﷺ said, "Whoever swears an oath to take something unlawfully while lying, he will meet Allah while He is angry with him." Then Allah revealed this verse. Abu Abdur Rahman was followed by Mansur ibn Al-Mu'tamir.
قَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ يَقْتَطِعُ بِهَا مَالًا وَهُوَ فِيهَا كَاذِبٌ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ» وَتَصْدِيقُهُ فِي كِتَابِ اللهِ ﷻ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا أُولَئِكَ لَا خَلَاقَ لَهُمْ فِي الْآخِرَةِ} [آل عمران 77] قَالَ فَجَاءَ الْأَشْعَثُ بْنُ قَيْسٍ فَقَالَ مَا يُحَدِّثُكُمْ أَبُو عَبْدِ الرَّحْمَنِ؟ قُلْنَا كَذَا وَكَذَا قَالَ صَدَقَ وَاللهِ لَأُنْزِلَتْ فِيَّ وَفِي فُلَانٍ كَانَتْ بَيْنِي وَبَيْنَهُ خُصُومَةٌ فَقَالَ رَسُولُ اللهِ ﷺ شُهُودُكَ أَوْ يَمِينُهُ قُلْتُ إِذًا يَحْلِفُ قَالَ «مَنْ حَلَفَ عَلَى يَمِينٍ يَقْتَطِعُ بِهَا مَالًا وَهُوَ فِيهَا كَاذِبٌ لَقِيَ اللهَ وَهُوَ غَضْبَانُ» فَأَنْزَلَ اللهُ هَذِهِ الْآيَةَ قَالَ أَبُو عَبْدِ الرَّحْمَنِ تَابَعَهُ مَنْصُورُ بْنُ الْمُعْتَمِرِ
[Machine] There was a dispute between me and a group, so we brought our case to the Messenger of Allah ﷺ . He said, "Provide witnesses or take an oath." I said, "Then he will take an oath and not care." The Messenger of Allah ﷺ said, "Whoever takes an oath to acquire what is rightfully someone else's and he is lying, will meet Allah while He is angry with him." Then Allah, the Most High, revealed the confirmation of this, "Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price" [Quran 3:77].
كَانَ بَيْنِي وَبَيْنَ قَوْمٍ خُصُومَةٌ فَاخْتَصَمْنَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ شَاهِدَاكَ أَوْ يَمِينُهُ فَقُلْتُ إِذًا يَحْلِفُ وَلَا يُبَالِي فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ لِيَسْتَحِقَّ فِيهَا مَالًا وَهُوَ فِيهَا فَاجِرٌ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ» فَأَنْزَلَ اللهُ تَعَالَى تَصْدِيقَ ذَلِكَ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} [آل عمران 77] الْآيَةَ
29.43 [Machine] To whom does the right side belong?
٢٩۔٤٣ عَلَى مَنِ الْيَمِينُ
“If the people were given what they claimed, some would have claimed the lives and property of men. But the one the claim is made against is obliged to swear an oath.” (Using translation from Ibn Mājah 2321)
قَالَ رَسُولُ اللهِ ﷺ «لَوْ أُعْطِيَ النَّاسُ بِدَعْوَاهُمْ لَادَّعَى نَاسٌ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ» هَذَا قَوْلُ النَّبِيِّ ﷺ
29.44 Section
٢٩۔٤٤ ذِكْرُ الِاخْتِلَافِ عَلَى عَدِيِّ بْنِ عَدِيٍّ فِيمَنْ حَلَفَ عَلَى مَالِ امْرِئٍ مُسْلِمٍ
[Machine] Two men came to the Prophet ﷺ arguing over a piece of land. One of them said, "It belongs to me," and the other one said, "No, it belongs to me. I have surveyed it and claimed it." When they asked the Prophet ﷺ to decide, he said, "Whoever swears an oath over the property of a Muslim, he will meet Allah while He is angry with him." The man who had initially claimed the land gave it up and said, "Paradise is his reward." However, Abu Abdur Rahman disagreed with him, so Jarir ibn Hazim intervened and settled the dispute between him and his father, Raja'a ibn Haywah, and Ursa ibn Amira.
أَتَى رَجُلَانِ يَخْتَصِمَانِ إِلَى النَّبِيِّ ﷺ فِي أَرْضٍ فَقَالَ أَحَدُهُمَا هِيَ لِي وَقَالَ الْآخَرُ هِيَ لِي قَدْ حُزْتُهَا وَقَبَضْتُهَا فَلَمَّا تَفَوَّهَ لِيَحْلِفَ قَالَ لَهُ رَسُولُ اللهِ ﷺ «أَمَا إِنَّهُ مَنْ حَلَفَ عَلَى مَالِ امْرِئٍ مُسْلِمٍ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ» قَالَ فَمَنْ تَرَكَهَا قَالَ الْجَنَّةُ قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ جَرِيرُ بْنُ حَازِمٍ فَأَدْخَلَ بَيْنَ عَدِيٍّ وَبَيْنَ أَبِيهِ رَجَاءَ بْنَ حَيْوَةَ وَالْعُرْسَ بْنَ عَمِيرَةَ
[Machine] There was a dispute between a man from the tribe of Qays and a man from Hadramaut, so they went to the Messenger of Allah ﷺ . The Messenger of Allah ﷺ said to the man from Hadramaut, "Provide evidence or swear an oath." The man said, "O Messenger of Allah, if I swear falsely, my land will be taken away." The Messenger of Allah ﷺ said, "Whoever swears a false oath to usurp his brother's rights, he will meet Allah while He is angry with him." The man from Qays said, "O Messenger of Allah, what is the reward for the one who refrains from doing it even though he knows he is right?" The Messenger of Allah ﷺ said, "Paradise." The man from Qays said, "I bear witness that I have refrained from doing it." Jarir said, "I was with Ayub Al-Sakhtiyani when we heard this narration from Adi. Ayub said, 'Adi mentioned this in the narration of Al-Arsi bin Amira. And then this verse was revealed, "Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price..." (Quran 3:77).' Jarir said, 'I did not remember that day from Adi's narration.'"
كَانَ بَيْنَ امْرِئِ الْقَيْسِ وَرَجُلٍ مِنْ حَضْرَمَوْتَ خُصُومَةٌ فَارْتَفَعَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ لِلْحَضْرَمِيِّ «بَيِّنَتُكَ وَإِلَّا فَيَمِينُهُ» قَالَ يَا رَسُولَ اللهِ إِنْ حَلَفَ ذَهَبَ بِأَرْضِي فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ كَاذِبَةٍ لِيَقْتَطِعَ بِهَا حَقَّ أَخِيهِ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ» قَالَ امْرُؤُ الْقَيْسِ يَا رَسُولَ اللهِ فَمَا لِمَنْ تَرَكَهَا وَهُوَ يَعْلَمُ أَنَّهَا حَقٌّ قَالَ «الْجَنَّةُ» قَالَ فَإِنِّي أُشْهِدُكَ أَنِّي قَدْ تَرَكْتُهَا قَالَ جَرِيرٌ كُنْتُ مَعَ أَيُّوبَ السَّخْتِيَانِيِّ حِينَ سَمِعْنَا هَذَا الْحَدِيثَ مِنْ عَدِيٍّ فَقَالَ أَيُّوبُ إِنَّ عَدِيًّا قَالَ فِي حَدِيثِ الْعُرْسِ بْنِ عَمِيرَةَ فَنَزَلَتْ هَذِهِ الْآيَةُ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} [آل عمران 77] قَالَ جَرِيرٌ وَلَمْ أَحْفَظْ يَوْمَئِذٍ مِنْ عَدِيٍّ
29.45 [Machine] The thing that the two men claim and each one of them has shown his evidence for it
٢٩۔٤٥ الشَّيْءُ يَدَّعِيهِ الرَّجُلَانِ وَلِكُلِّ وَاحِدٍ مِنْهُمَا بَيَّنَتُهُ
[Machine] Two men claimed ownership of a camel and they found it with another man. Each of them brought two witnesses that it was their camel. The Prophet ﷺ ruled that the camel should be divided in two halves between the two men. Abu Abdullah al-Misri said that this hadith is weak, and Muhammad ibn Kathir said that this is al-Masseyasiyya, who is trustworthy but prone to mistakes. Abdu Abdur Rahman disagreed with him, and Saeed ibn Abi Arooba disagreed with him in both the chain of narration and the text.
أَنَّ رَجُلَيْنِ ادَّعَيَا دَابَّةً وَجَدَاهَا عِنْدَ رَجُلٍ فَأَقَامَ كُلُّ وَاحِدٍ مِنْهُمَا شَاهِدَيْنِ أَنَّهَا دَابَّتُهُ «فَقَضَى بِهَا النَّبِيُّ ﷺ بَيْنَهُمَا نِصْفَيْنِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَطَأٌ وَمُحَمَّدُ بْنُ كَثِيرٍ هَذَا هُوَ الْمِصِّيصِيُّ وَهُوَ صَدُوقٌ إِلَّا أَنَّهُ كَثِيرُ الْخَطَإِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ سَعِيدُ بْنُ أَبِي عَرُوبَةَ فِي إِسْنَادِهِ وَفِي مَتْنِهِ
That two men referred a dispute to the Prophet [SAW] concerning an animal, and neither of them had any evidence, so he ruled that it be shared equally between them. (Using translation from Nasāʾī 5424)
أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى النَّبِيِّ ﷺ فِي دَابَّةٍ لَيْسَ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ «فَقَضَى بِهَا بَيْنَهُمَا نِصْفَيْنِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ إِسْنَادُ هَذَا الْحَدِيثِ جَيِّدٌ

٢٩۔٤٦ الِاسْتِهَامُ عَلَى الْيَمِينِ
he said that two men laid claim to an animal, and neither of them had any proof, so the Prophet ﷺ commanded them to cast lots as to which of them should swear an oath. (Using translation from Ibn Mājah 2329)
أَنَّ رَجُلَيْنِ ادَّعَيَا دَابَّةً وَلَمْ تَكُنْ لَهُمَا بَيِّنَةٌ «فَأَمَرَهُمَا النَّبِيُّ ﷺ أَنْ يَسْتَهِمَا عَلَى الْيَمِينِ»
two men disputed concerning a transaction, and neither of them had proof. The Messenger of Allah commanded them to draw lots as to which of them should swear an oath, whether they liked it or not. (Using translation from Ibn Mājah 2346)
أَنَّ رَجُلَيْنِ تَدَارَءَا فِي بَيْعٍ وَلَيْسَتْ بَيْنَهُمَا بَيِّنَةٌ «فَأَمَرَهُمَا رَسُولُ اللهِ ﷺ أَنْ يَسْتَهِمَا عَلَى الْيَمِينِ أَحَبَّا أَوْ كَرِهَا»
The Prophet ﷺ asked some people to take an oath, and they hurried for it. The Prophet ﷺ ordered that lots should be drawn amongst them as to who would take an oath first. (Using translation from Bukhārī 2674)
أَنَّ النَّبِيَّ ﷺ عَرَضَ عَلَى قَوْمٍ الْيَمِينَ فَأَسْرَعَ الْفَرِيقَانِ جَمِيعًا عَلَى الْيَمِينِ «فَأَمَرَ النَّبِيُّ ﷺ أَنْ يُسْهَمَ بَيْنَهُمْ فِي الْيَمِينِ أَيُّهُمْ يَحْلِفُ»

٢٩۔٤٧ كَيْفَ يَمِينُ الْوَارِثِ
[Machine] A man from Hadramaut and a man from Kindah disputed in front of the Prophet ﷺ. The man from Hadramaut said, "O Messenger of Allah, I am pleased if this land is in the hand of its father who wrongfully took it from me." The man from Kindah said, "I am pleased if this land is in my hand as I inherited it from my father." The Prophet ﷺ asked the man from Hadramaut, "Do you have any proof, O brother of Hadramaut?" He replied, "No, O Messenger of Allah, but take from him with his right hand what he knows is rightfully mine, as his father wrongfully took it from me." The man from Kindah prepared to take an oath, but the Prophet ﷺ said, "Whoever seizes property with his right hand, he will meet Allah empty-handed." Upon hearing this, the man from Kindah withdrew his hand and returned the land to the man from Hadramaut.
اخْتَصَمَ رَجُلٌ مِنْ حَضْرَمَوْتَ وَرَجُلٌ مِنْ كِنْدَةَ إِلَى النَّبِيِّ ﷺ فَقَالَ الْحَضْرَمِيُّ يَا رَسُولَ اللهِ أَرْضِي فِي يَدِ هَذَا اغْتَصَبَنِيهَا أَبُوهُ فَقَالَ الْكِنْدِيُّ أَرْضِي فِي يَدِي وَرِثْتُهَا عَنْ أَبِي فَقَالَ رَسُولُ اللهِ ﷺ «أَلَكَ بَيِّنَةٌ يَا أَخَا حَضْرَمَوْتَ؟» قَالَ لَا يَا رَسُولَ اللهِ وَلَكِنْ خُذْ لِي بِيَمِينِهِ مَا يَعْلَمُ أَنَّهَا أَرْضِي اغْتَصَبَنِيهَا أَبُوهُ فَتَهَيَّأَ الْكِنْدِيُّ لِيَحْلِفَ قَالَ رَسُولُ اللهِ ﷺ «مَنِ اقْتَطَعَ مَالًا بِيَمِينِهِ لَقِيَ اللهَ أَجْدَعَ» فَلَمَّا سَمِعَهَا الْكِنْدِيُّ كَفَّ عَنِ الْيَمِينِ وَأَعْطَاهُ الْأَرْضَ

٢٩۔٤٨ كَيْفَ الْيَمِينُ وَذِكْرُ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِلْخَبَرِ فِيهِ
The Prophet ﷺ said, "Jesus, seeing a man stealing, asked him, 'Did you steal?, He said, 'No, by Allah, besides Whom there is none who has the right to be worshipped' Jesus said, 'I believe in Allah and suspect my eyes." (Using translation from Bukhārī 3444)
قَالَ رَسُولُ اللهِ ﷺ رَأَى عِيسَى ابْنُ مَرْيَمَ رَجُلًا يَسْرِقُ فَقَالَ لَهُ أَسَرَقْتَ؟ قَالَ لَا وَاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ فَقَالَ عِيسَى آمَنْتُ بِاللهِ وَكَذَّبْتُ بَصَرِي
[Machine] "And with me was a sword, so I struck with it but it did not cut. And with him was a sword, so I struck his hand and the sword fell, and I took it. Then, I uncovered the helmet from his head and struck his neck. Then, I went to the Messenger of Allah ﷺ and informed him. He said, 'By Allah, there is no God but Him.' I said, 'By Allah, there is no God but Him.' He said, 'By Allah, there is no God but Him.' I said, 'By Allah, there is no God but Him.' He said, 'Go forth and stand firm.' So, I went forth and stood firm. Then I came while I was rushing like a bird, laughing. I informed him, so he said, 'If he comes to you hastening as if he is a bird, laughing, then he has told the truth.' So, I went forth and stood firm. Then I came while I was rushing like a bird, laughing. I informed him, so he said, 'Go forth and show me the place.' So, I went with him and showed him. When the Messenger of Allah ﷺ stood over him, he praised Allah and said, 'This is Pharaoh, and this is his nation.' Abu Abdullah Ibn Abi Umayyah disagreed. Sufyan Al-Thawri narrated it from Abu Ishaq from Abu Ubaidah from Abdullah, and Abu Ubaidah did not hear from his father. And the narration of Sufyan is correct."
وَمَعِي سَيْفٌ لِي فَجَعَلْتُ أَضْرِبُهُ وَلَا يُحَيِّكُ فِيهِ وَمَعَهُ سَيْفٌ لَهُ فَضَرَبْتُ يَدَهُ فَوَقَعَ السَّيْفُ فَأَخَذْتُهُ ثُمَّ كَشَفْتُ الْمِغْفَرَ عَنْ رَأْسِهِ فَضَرَبْتُ عُنُقَهُ ثُمَّ أَتَيْتُ رَسُولَ اللهِ ﷺ فَأَخْبَرْتُهُ فَقَالَ «آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ» قُلْتُ آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ قَالَ «آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ» قُلْتُ آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ قَالَ انْطَلِقْ فَاسْتَثْبِتْ فَانْطَلَقْتُ فَقَالَ رَسُولُ اللهِ ﷺ «إِنْ جَاءَكُمْ يَسْعَى مِثْلَ الطَّيْرِ يَضْحَكُ فَقَدْ صَدَقَ» فَانْطَلَقْتُ فَاسْتَثْبَتُّ ثُمَّ جِئْتُ وَأَنَا أَسْعَى مِثْلَ الطَّائِرِ أَضْحَكُ أَخْبَرْتُهُ فَقَالَ انْطَلِقْ فَأَرِنِي مَكَانَهُ فَانْطَلَقْتُ مَعَهُ فَأَرَيْتُهُ إِيَّاهُ فَلَمَّا وَقَفَ عَلَيْهِ رَسُولُ اللهِ ﷺ حَمِدَ اللهَ ثُمَّ قَالَ «هَذَا فِرْعَوْنُ هَذِهِ الْأُمَّةُ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ سُفْيَانُ الثَّوْرِيُّ فَرَوَاهُ عَنْ أَبِي إِسْحَاقَ عَنْ أَبِي عُبَيْدَةَ عَنْ عَبْدِ اللهِ وَأَبُو عُبَيْدَةَ لَمْ يَسْمَعْ مِنْ أَبِيهِ وَرِوَايَةُ سُفْيَانَ هِيَ الصَّوَابُ
[Machine] Narrated by the Prophet ﷺ : "A man swore by Allah, who there is no deity except Him, falsely, yet he was forgiven." Shu'bah asked, "Was this before or after the concept of Tawhid (monotheism)?" Abu 'Abdur-Rahman said that Sufyan contradicted him and said that it was narrated by 'Ata ibn As-Sa'ib from Abu Yahya, who was known as Al-A'raj.
عَنِ النَّبِيِّ ﷺ أَنَّ «رَجُلًا حَلَفَ بِاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ كَاذِبًا فَغُفِرَ لَهُ» قَالَ شُعْبَةُ مِنْ قَبْلِ التَّوْحِيدِ؟ قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ سُفْيَانُ فَقَالَ عَنْ عَطَاءِ بْنِ السَّائِبِ عَنْ أَبِي يَحْيَى وَهُوَ الْأَعْرَجُ
[Machine] "Two men came to the Prophet ﷺ disputing about something. He said to the plaintiff, 'Present your evidence,' but he did not. Then he said to the other, 'Take an oath,' so he swore by Allah, the One besides whom there is no deity. The Prophet ﷺ said, 'Give him his right, and (by doing so) you will be absolved by saying, 'There is no deity but Allah.' Abu 'Abdul-Rahman said, 'This is the correct verdict, and I do not know anyone who followed Shu'bah on this issue, except for Abu Al-Ahwas, in his chain of narration, and he differed with him in the wording.'"
جَاءَ رَجُلَانِ يَخْتَصِمَانِ إِلَى النَّبِيِّ ﷺ فِي شَيْءٍ فَقَالَ لِلْمُدَّعِي أَقِمِ الْبَيِّنَةَ فَلَمْ يُقِمْ وَقَالَ لِلْآخَرِ احْلِفْ فَحَلَفَ آللَّهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ فَقَالَ النَّبِيُّ ﷺ «ادْفَعْ حَقَّهُ وَسَتُكَفِّرُ عَنْكَ لَا إِلَهَ إِلَّا اللهُ مَا صَنَعْتَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الصَّوَابُ وَلَا أَعْلَمُ أَحَدًا تَابَعَ شُعْبَةَ عَلَى قَوْلِهِ عَنْ أَبِي الْبَخْتَرِيِّ عَنْ عُبَيْدَةَ عَنِ ابْنِ الزُّبَيْرِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ تَابَعَهُ أَبُو الْأَحْوَصِ عَلَى إِسْنَادِهِ وَخَالَفَهُ فِي لَفْظِهِ
[Machine] Two opponents came to the Prophet ﷺ and one of them accused the other with a valid claim. The Prophet ﷺ told the accuser, "Present your evidence." He replied, "O Messenger of Allah, I have no evidence." So the Prophet ﷺ said to the other person, "Swear by Allah, the One besides whom there is no god, if you have anything against him or with you." So he swore.
جَاءَ خَصْمَانِ إِلَى النَّبِيِّ ﷺ فَادَّعَى أَحَدُهُمَا عَلَى الْآخَرِ حَقًّا فَقَالَ النَّبِيُّ ﷺ لِلْمُدَّعِي «أَقِمْ بَيِّنَتَكَ» فَقَالَ يَا رَسُولَ اللهِ لَيْسَ لِي بَيِّنَةٌ فَقَالَ لِلْآخَرِ «احْلِفْ بِاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ مَا لَهُ عَلَيْكَ أَوْ عِنْدَكَ شَيْءٌ فَحَلَفَ»

٢٩۔٤٩ رَدُّ الْيَمِينِ وَذِكْرُ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرِ سَهْلٍ فِيهِ
'Abdullah bin SAahi and Nubayysah bin Mas'ud bin Zaid went o Khaibar, and at that time there was peace treaty. They went their separate ways to about their business, then Muhayysah came upon 'Abdullah in Sahl lying dead in a pool of blood. He buried him, then he came to AL-Madinah. 'Abdur-Rahman bin Sahi. Huwayysah, and Muhayysah came to the Messenger of Allah, and 'Abdur-Rehman started to speak, but he was the youngest of them, so the Messenger of Allah said: "Let the elders speak first." So he fell silent and they (the other two) spoke. The Messenger of Allah said: "Will you swear fifty oaths, then you will receive compensation or be entitled to retaliate?" They said: "O Messenger of Allah, how can we swear an oath when we did not witness, and did not see (what happened)?" He said: "The n can the Jews swear fifty oaths declaring their innocence?" They said: "O Messenger of Allah, how can we accept the oath of a disbelieving people?" So the Messenger of Allah paid the blood money himself. (Using translation from Nasāʾī 4714)
عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ وَمُحَيِّصَةَ بْنِ مَسْعُودِ بْنِ زَيْدٍ أَنَّهُمَا أَتَيَا خَيْبَرَ وَهِيَ يَوْمَئِذٍ صَلَحٌ فَتَفَرَّقَا لِحَوَائِجِهِمْ فَأَتَى مُحَيِّصَةُ عَلَى عَبْدِ اللهِ بْنِ سَهْلٍ وَهُوَ يَتَشَحَّطُ فِي دَمِهِ قَتِيلًا فَدَفَنَهُ ثُمَّ قَدِمَ الْمَدِينَةَ وَانْطَلَقَ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَحُوَيِّصَةُ وَمُحَيِّصَةُ إِلَى رَسُولِ اللهِ ﷺ فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَكَلَّمُ وَهُوَ أَحْدَثُ الْقَوْمِ سِنًّا فَقَالَ رَسُولُ اللهِ ﷺ «كَبِّرِ الْكُبْرَ» فَسَكَتُّ فَتَكَلَّمَا فَقَالَ رَسُولُ اللهِ ﷺ «أَتَحْلِفُونَ بِخَمْسِينَ مِنْكُمْ فَتَسْتَحِقُّونَ صَاحِبَكُمْ أَوْ قَاتَلَكُمْ» قَالُوا يَا رَسُولَ اللهِ كَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ وَلَمْ نَرَ؟ قَالَ أَتُبْرِئُكُمْ يَهُودُ بِخَمْسِينَ؟ قَالُوا يَا رَسُولَ اللهِ كَيْفَ نَأْخُذُ أَيْمَانَ قَوْمٍ كُفَّارٍ فَعَقَلَهُ رَسُولُ اللهِ ﷺ مِنْ عِنْدِهِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَالَفَهُ سَعِيدُ بْنُ عُبَيْدٍ فِي مَعْنَى الْحَدِيثِ
(a man from the Ansar) that a number of people from his tribe went to Khaibar and dispersed, and then they found one of them murdered. They said to the people with whom the corpse had been found, "You have killed our companion!" Those people said, "Neither have we killed him, nor do we know his killer." The bereaved group went to the Prophet ﷺ and said, "O Messenger of Allah ﷺ! We went to Khaibar and found one of us murdered." The Prophet ﷺ said, "Let the older among you come forward and speak." Then the Prophet ﷺ said, to them, "Bring your proof against the killer." They said "We have no proof." The Prophet ﷺ said, "Then they (the defendants) will take an oath." They said, "We do not accept the oaths of the Jews." Messenger of Allah ﷺ did not like that the Blood-money of the killed one be lost without compensation, so he paid one-hundred camels out of the camels of Zakat (to the relatives of the deceased) as Diya (Blood-money). أَخْبَرَهُ أَنَّ نَفَرًا مِنْ قَوْمِهِ انْطَلَقُوا إِلَى خَيْبَرَ فَتَفَرَّقُوا فِيهَا فَوَجَدُوا أَحَدَهُمْ قَتِيلًا فَقَالُوا لِلَّذِينَ وَجَدُوهُ عِنْدَهُمْ قَتَلْتُمْ صَاحِبَنَا قَالُوا مَا قَتَلْنَا وَلَا عَلِمْنَا فَانْطَلَقُوا إِلَى نَبِيِّ اللهِ ﷺ فَقَالُوا يَا نَبِيَّ اللهِ انْطَلَقْنَا إِلَى خَيْبَرَ فَوَجَدْنَا أَحَدَنَا قَتِيلًا فَقَالَ رَسُولُ اللهِ ﷺ «الْكِبَرُ الْكِبَرُ» فَقَالَ لَهُمْ «تَأْتُونَ بِالْبَيِّنَةِ عَلَى مَنْ قَتَلَ» قَالُوا مَا لَنَا بَيِّنَةٌ قَالَ «فَيَحْلِفُونَ لَكُمْ» قَالُوا لَا نَرْضَى بِأَيْمَانِ الْيَهُودِ فَكَرِهَ رَسُولُ اللهِ ﷺ أَنْ يُبْطِلَ دَمَهُ فَوَدَاهُ مِائَةً مِنْ إِبِلِ الصَّدَقَةِ

٢٩۔٥٠ الْحُكْمُ بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ
[Machine] The Prophet ﷺ said, "He settled the matter with an oath and a witness." Abu Abdur-Rahman said to us, "This is a good chain of narration, and Saif is trustworthy, and Qays is trustworthy." Yahya Ibn Sa'id al-Qattan said, "Saif is trustworthy." Muhammad Ibn Muslim al-Tayifi narrated this hadith from Amr Ibn Dinar, from Ibn Abbas, from the Prophet ﷺ , "He settled the matter with an oath and a witness." And Muhammad Ibn Muslim is not strong in that, and a weak person narrated it, so he said about Amr Ibn Dinar that Muhammad Ibn Ali transmitted it, and he is a Mursa, and the hadith is abandoned, and the weak narrators are not relied upon over the trustworthy ones.
أَنَّ النَّبِيَّ ﷺ «قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ هَذَا إِسْنَادٌ جَيِّدٌ وَسَيْفٌ ثِقَةٌ وَقَيْسٌ ثِقَةٌ وَقَالَ يَحْيَى بْنُ سَعِيدٍ الْقَطَّانُ سَيْفٌ ثِقَةٌ وَرَوَى هَذَا الْحَدِيثَ مُحَمَّدُ بْنُ مُسْلِمٍ الطَّائِفِيُّ عَنْ عَمْرِو بْنِ دِينَارٍ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيَّ ﷺ «قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ» وَمُحَمَّدُ بْنُ مُسْلِمٍ لَيْسَ بِذَلِكَ الْقَوِيِّ وَرَوَاهُ إِنْسَانٌ ضَعِيفٌ فَقَالَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ مُحَمَّدِ بْنِ عَلِيٍّ مُرْسَلٌ وَهُوَ مَتْرُوكُ الْحَدِيثِ وَلَا يُحْكَمُ بِالضُّعَفَاءِ عَلَى الثِّقَاتِ
“Whoever finds lost property, let him ask one or two men of good character to witness it, then he should not alter it nor conceal it. If its owner comes along, then he has more right to it, otherwise it belongs to Allah (SWT), Who gives it to whomsoever He wills.” (Using translation from Ibn Mājah 2505)
أَنَّ النَّبِيَّ ﷺ قَالَ «مَنْ وَجَدَ لُقُطَةً فَلْيُشْهِدْ ذَا عَدْلٍ أَوْ ذَوِي عَدْلٍ ثُمَّ لَا يُغَيِّرْ وَلَا يَكْتُمْ فَإِنْ جَاءَ رَبُّهُمْ فَهُوَ أَحَقُّ بِهَا وَإِلَّا فَإِنَّمَا هُوَ مَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ»
The Prophet ﷺ gave a decision on the basis of an oath and a single witness. Abu Dawud said: Al-Rabi' bin Sulaiman al-Mu'adhdhin told me some additional words in this tradition: Al-Shafi'i told me from 'Abd al-'Aziz. I then mentioned it fo Suhail who said: Rabi'ah told me - and he is reliable in my opinion - that I told him this (tradition) and I do not remember it. 'Abd al-'Aziz said: Suhail suffered from some disease which caused him to lose a little of his intelligence, and he forgot some of his traditions. Thereafter Suhail would narrate traditions from Rabi'ah on the authority of his father. (Using translation from Abū Dāʾūd 3610)
أَنَّ النَّبِيَّ ﷺ «قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ»
[Machine] "He attended a dispute in the mosque of Kufa and ruled by taking an oath with one witness."

29.51 [Machine] The Right side of the Prophet's Pulpit
٢٩۔٥١ الْيَمِينُ عَلَى مِنْبَرِ النَّبِيِّ ﷺ
[Machine] The Messenger of Allah, ﷺ , said, "Whoever swears falsely upon my pulpit will occupy a place in Hellfire."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ حَلَفَ عَلَى مِنْبَرِي هَذَا بِيَمِينٍ آثِمَةٍ تَبَوَّأَ مَقْعَدَهُ مِنَ النَّارِ»
[Machine] The Messenger of Allah ﷺ said, "Whoever takes a false oath at my pulpit, and thereby allows himself to unlawfully acquire the wealth of a Muslim, then upon him is the curse of Allah, the angels, and all the people. Allah will not accept any compensation or repentance from him."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ حَلَفَ عِنْدَ مِنْبَرِي هَذَا بِيَمِينٍ كَاذِبَةٍ يَسْتَحِلُّ بِهَا مَالَ امْرِئٍ مُسْلِمٍ فَعَلَيْهِ لَعْنَةُ اللهِ وَالْمَلَائِكَةِ وَالنَّاسِ أَجْمَعِينَ لَا يَقْبَلُ اللهُ مِنْهُ عَدْلًا وَلَا صَرْفًا»
29.52 [Machine] The right after Asr.
٢٩۔٥٢ الْيَمِينُ بَعْدَ الْعَصْرِ
"There are three to whom Allah will not speak on the Day of Resurrection, or will He look at them, or sanctify them and theirs will be a painful torment: A man who has surplus water when traveling but he withholds it form a wayfarer; a man who swears allegiance to an imam for worldly gains, and if he gives him what he wants he is loyal to him but if he does not give him anything he is not loyal to him: and a man who sells a man his product after 'Asr, swerving by Allah that he bought it for such and such a price, and the other believes him." عَنْ رَسُولِ اللهِ ﷺ قَالَ «ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللهُ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ رَجُلٌ عَلَى فَضْلَ مَاءٍ بِالطَّرِيقِ يَمْنَعُ ابْنَ السَّبِيلِ مِنْهُ وَرَجُلٌ بَايَعَ إِمَامًا لِلدُّنْيَا إِنْ أَعْطَاهُ مَا يُرِيدُ وَفَّى لَهُ وَإِنْ لَمْ يُعْطِهِ لَمْ يَفِ لَهُ وَرَجُلٌ سَاوَمَ رَجُلًا عَلَى سِلْعَتِهِ بَعْدَ الْعَصْرِ فَحَلَفَ بِاللهِ لَقَدْ أُعْطِيَ بِهَا كَذَا وَكَذَا فَصَدَّقَهُ الْآخَرُ»
29.53 [Machine] Who withholds the property of a Muslim by his right hand?
٢٩۔٥٣ مَنِ اقْتَطَعَ مَالَ امْرِئٍ مُسْلِمٍ بِيَمِينِهِ
The Prophet ﷺ said, "Whoever takes a (false) oath in order to grab (others) property, then Allah will be angry with him when he will meet Him." (Using translation from Bukhārī 2673)
قَالَ رَسُولُ اللهِ ﷺ وَقَالَ يَحْيَى سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنْ حَلَفَ عَلَى يَمِينٍ يَقْتَطِعُ بِهَا مَالَ رَجُلٍ لَقِيَ اللهَ وَهُوَ عَلَيْهِ غَضْبَانُ»
29.54 [Machine] Acceptance of evidence after swearing
٢٩۔٥٤ قَبُولُ الْبَيِّنَةِ بَعْدِ الْيَمِينِ
"I am only a human being, and you bring your disputes to me, some perhaps being more eloquent in their plea than others, so that I give judgement on their behalf according to what I hear from them. Therefore, whatever I decide for anyone which by right belongs to his brother, he must not take anything, for I am granting him only a portion of Hell. (Using translation from Abū Dāʾūd 3583)
أن رَسُولُ اللهِ ﷺ قال «وَإِنَّمَا أَنَا بَشَرٌ وإِنَّكُمْ تَخْتَصِمُونَ إِلَيَّ وَلَعَلَّ بَعْضَكُمْ أن يكون أَلْحَنُ بِحُجَّتِهِ مِنْ بَعْضٍ فَأَقْضِي له عَلَى نَحْوِ مَا أَسْمَعُ منه فَمَنْ قَضَيْتُ لَهُ بشيء مِنْ حَقِّ أَخِيهِ شَيْئًا فلا يأخذ منه شيئاً فَإِنَّمَا أَقْطَعُ لَهُ قِطْعَةً مِنَ النَّارِ»
29.55 [Machine] The lying testimony
٢٩۔٥٥ شَهَادَةُ الزُّورِ
The Prophet ﷺ was asked about the great sins He said, "They are:-- (1 ) To join others in worship with Allah, (2) To be undutiful to one's parents. (3) To kill a person (which Allah has forbidden to kill) (i.e. to commit the crime of murdering). (4) And to give a false witness." (Using translation from Bukhārī 2653)
قَالَ رَسُولُ اللهِ ﷺ «الْكَبَائِرُ الْإِشْرَاكُ بِاللهِ وَعُقُوقُ الْوَالِدَيْنِ وَقَتْلُ النَّفْسِ وَقَوْلُ الزُّورِ»
29.56 [Machine] The mention of prohibition from accepting testimony, except upon a right
٢٩۔٥٦ ذِكْرُ النَّهْيِ عَنْ قَبُولِ الشَّهَادَةِ، إِلَّا عَلَى حَقٍّ
[Machine] My father took me with him to the Messenger of Allah ﷺ and said, "Indeed, Umrah bint Rawahah has requested from me that I release my son from my wealth, and I refused. But then it appeared to me that I should release him to her. She said, 'I will not accept until you come with him to the Messenger of Allah ﷺ as a witness for me.' He said, 'Do you have any other children?' I said, 'Yes.' He said, 'Have you treated all of them like you have treated this one?' I said, 'No.' He said, 'Then I will not bear witness to this, as this is injustice.'"
انْطَلَقَ بِي أَبِي إِلَى رَسُولِ اللهِ ﷺ فَقَالَ إِنَّ عَمْرَةَ بِنْتَ رَوَاحَةَ طَلَبَتْ إِلَيَّ أَنْ أَنْحَلَ يَعْنِي ابْنِي مِنْ مَالِي وَإِنِّي أَبَيْتُ ثُمَّ بَدَا لِي أَنْ أَنْحَلَهُ إِيَّاهُ فَقَالَتْ لَا أَرْضَى حَتَّى تَنْطَلِقَ بِهِ إِلَى رَسُولِ اللهِ ﷺ تُشْهِدُهُ قَالَ «هَلْ لَكَ وَلَدٌ غَيْرَهُ؟» قَالَ نَعَمْ قَالَ «هَلْ أَتَيْتَ كُلَّ وَاحِدٍ مِثْلَ الَّذِي أَتَيْتَ بهِ هَذَا؟» قَالَ لَا قَالَ «فَإِنِّي لَا أَشْهَدُ عَلَى هَذَا هَذَا جَوْرٌ»
29.57 [Machine] The poet's certificate.
٢٩۔٥٧ شَهَادَةُ الشَّاعِرِ
The Prophet ﷺ said to Hassan, "Lampoon them (i.e. the pagans) and Gabriel is with you." (Using translation from Bukhārī 3213)
نَبِيُّ اللهِ ﷺ لِحَسَّانَ «اهْجُهُمْ وَجِبْرِيلُ مَعَكَ»
[Machine] To me, the Messenger of Allah ﷺ said: "Fight them or subdue them, meaning the polytheists and Jibril is with you."
لِي رَسُولُ اللهِ ﷺ «اهْجُهُمْ أَوْ هَاجِهِمْ يَعْنِي الْمُشْرِكِينَ وَجِبْرِيلُ مَعَكَ»
29.58 [Machine] What is permissible in the testimony of the nation
٢٩۔٥٨ مَا يَجُوزُ مِنْ شَهَادَةِ الْأَمَةِ
[Machine] "I breastfed both of you, then I went to the Messenger of Allah ﷺ and mentioned it to him, but he turned away from me. So I moved away and mentioned it to him again, and he said, 'How can you say that when it has been claimed that you breastfed both of them?' So he forbade me from doing so." Abu 'Abd al-Rahman said: "I do not know anyone from the black community who narrated this hadith from Ibn Abu Mulaikah except Ibn Juraij."
قَدْ أَرْضَعْتُكُمَا فَجِئْتُ رَسُولَ اللهِ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَأَعْرَضَ فَتَنَحَّيْتُ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «كَيْفَ وَقَدْ زَعَمَتْ أَنْ قَدْ أَرْضَعَتْكُمَا» فَنَهَاهُ عَنْهَا قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا أَعْلَمُ أَحَدًا ذَكَرَ أَمَةً سَوْدَاءَ مِمَّنْ رَوَى هَذَا الْحَدِيثَ عَنِ ابْنِ أَبِي مُلَيْكَةَ غَيْرَ ابْنِ جُرَيْجٍ
29.59 [Machine] The testimony of a woman regarding her own action
٢٩۔٥٩ شَهَادَةُ الْمَرْأَةِ عَلَى فِعْلِ نَفْسِهَا
[Machine] He married the daughter of Abu Ihab Al-Tamimi, and a nurse from the people of Mecca came to her carrying her milk. She said, "I have breastfed both of you." So I asked the people of the girl, and they denied it. So I rode to the Messenger of Allah ﷺ while he was in Medina, and I mentioned that to him. I said, "O Messenger of Allah, I asked the people of the girl, and they denied it." The Messenger of Allah ﷺ said, "How can it be when it has already been said 'So it has been said'?" So he separated from her and married someone else.
أَنَّهُ تَزَوَّجَ ابْنَةَ أَبِي إِهَابٍ التَّمِيمِيِّ فَجَاءَتْ مَوْلَاةٌ مِنْ أَهْلِ مَكَّةَ صَبِيحَةَ مَلَكَهَا فَقَالَتْ قَدْ أَرْضَعْتُكُمَا فَسَأَلْتُ أَهْلَ الْجَارِيَةِ فَأَنْكَرُوا ذَلِكَ فَرَكِبْتُ إِلَى رَسُولِ اللهِ ﷺ وَهُوَ بِالْمَدِينَةِ فَذَكَرْتُ ذَلِكَ لَهُ فَقُلْتُ يَا رَسُولَ اللهِ قَدْ سَأَلْتُ أَهْلَ الْجَارِيَةِ فَأَنْكَرُوا ذَلِكَ قَالَ رَسُولُ اللهِ ﷺ «كَيْفَ وَقَدْ قِيلَ كَيْفَ وَقِيلَ؟» فَفَارَقَهَا وَنَكَحَتْ غَيْرَهُ
I married a woman, then a black woman came to us and said: I breast-fed you both. I went to the Prophet and said: I married so and so and a black woman came to me and said: I breast-fed you both. He turned away from me so I came to him from the other side and said: She is lying. He said: "How can you be intimate with your wife when she says that she breast-fed you both? Leave her (divorce her)." (Using translation from Nasāʾī 3330)
إِنِّي قَدْ أَرْضَعْتُكُمَا فَأَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ إِنِّي قَدْ تَزَوَّجْتُ فُلَانَةَ بِنْتَ فُلَانٍ فَجَاءَتِ امْرَأَةٌ سَوْدَاءُ فَقَالَتْ إِنِّي قَدْ أَرْضَعْتُكُمَا وَهِيَ كَاذِبَةٌ فَأَعْرَضَ عَنِّي فَأَتَيْتُهُ مِنْ قِبَلِ وَجْهِهِ فَقُلْتُ إِنَّهَا كَاذِبَةٌ فَقَالَ «كَيْفَ بِهَا وَقَدْ زَعَمَتْ أَنَّهَا قَدْ أَرْضَعَتْكُمَا دَعْهَا عَنْكَ»
29.60 [Machine] Who is the best of the martyrs?
٢٩۔٦٠ مَنْ خَيْرُ الشُّهَدَاءِ
Should I not tell you of the best witnesses? He is the one who produces his evidence before he is asked for it. (Using translation from Muslim 1719)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أَلَا أُخْبِرُكُمْ بِخَيْرِ الشُّهَدَاءِ الَّذِي يَأْتِي بِشَهَادَتِهِ قَبْلَ أَنْ يُسْأَلَهَا أَوْ يُخْبِرُ بِشَهَادَتِهِ قَبْلَ أَنْ يُسْأَلَهَا»
29.61 [Machine] Who gives the testimony without being asked about it
٢٩۔٦١ مَنْ يُعْطِي الشَّهَادَةَ وَلَا يُسْأَلُهَا
[Machine] I arrived in Basra and there, I found a man from the companions of the Prophet ﷺ , not Anas ibn Malik, who said that the Messenger of Allah ﷺ said: "The best of people are my generation, then those who follow them, then those who follow them, then there will come a people whose testimony will be accepted without being asked for."
قَدِمْتُ الْبَصْرَةَ فَإِذَا رَجُلٌ مِنْ أَصْحَابِ النَّبِيِّ ﷺ لَيْسَ أَنَسَ بْنَ مَالِكٍ قَالَ قَالَ رَسُولُ اللهِ ﷺ «خَيْرُ النَّاسِ قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ يَجِيءُ قَوْمٌ سِمَانٌ يُعْطُونَ الشَّهَادَةَ وَلَا يُسْأَلُونَهَا»
29.62 [Machine] Who will testify on his behalf with his right hand?
٢٩۔٦٢ مَنْ تَبْدُرُ شَهَادَتَهُ يَمِينُهُ
“The Messenger of Allah ﷺ was asked, 'Which of the people are best?' He said: 'My generation, then those that follow them, then those that follow them. Then there will come people whose testimony precedes their oath and whose oath precedes their testimony.” (Using translation from Ibn Mājah 2362)
سُئِلَ رَسُولُ اللهِ ﷺ أَيُّ النَّاسِ خَيْرٌ؟ قَالَ «قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ يَجِيءُ قَوْمٌ تَبْدُرُ شَهَادَةُ أَحَدِهِمْ يَمِينَهُ وَتَبْدُرُ يَمِينُهُ شَهَادَتَهُ»
