that the Prophet ﷺ said, "If the people were given according to their claims, they would claim the lives of persons and their properties, but the oath must be taken by the defendant."

أَنَّ النَّبِيَّ ﷺ قَالَ: «لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لاَدَّعَى نَاسٌ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ۔»

“If the people were given what they claimed, some would have claimed the lives and property of men. But the one the claim is made against is obliged to swear an oath.”

أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمُ ادَّعَى نَاسٌ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ وَلَكِنِ الْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ

[Machine] I wrote to Ibn Abbas, and he wrote back to me stating, "Indeed, the Messenger of Allah ﷺ said, 'Verily, the right of the defendant is upon the claimant, even if people were given according to their claims, some people would claim the property and blood of others.'"

كَتَبْتُ إِلَى ابْنِ عَبَّاسٍ فَكَتَبَ إِلَيَّ إِنَّ رَسُولَ اللهِ ﷺ قَالَ إِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ وَلَوْ أُعْطِيَ النَّاسُ بِدَعْوَاهُمْ لَادَّعَى أُنَاسٌ أَمْوَالَ النَّاسِ وَدِمَاءَهُمْ

“If the people were given what they claimed, some would have claimed the lives and property of men. But the one the claim is made against is obliged to swear an oath.” (Using translation from Ibn Mājah 2321)

عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَى النَّاسُ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ»

[Machine] The Messenger of Allah ﷺ said:

"If people were granted what they claim, some men would claim the wealth and blood of other men, but oaths are upon the claimant."

قَالَ رَسُولُ اللهِ ﷺ «لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَى رِجَالٌ أَمْوَالَ رِجَالٍ وَدِمَاءَهُمْ وَلَكِنِ الْيَمِينُ عَلَى الْمُدَّعَى عَلَيْهِ»

[Machine] Indeed, the Messenger of Allah ﷺ said, "If people were given what they claimed, then some men would claim the lives and wealth of others. However, the burden of proof is upon the plaintiff, and the oath is upon the defendant."

إِنَّ رَسُولَ اللهِ ﷺ قَالَ لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَى رِجَالٌ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ وَلَكِنَّ الْبَيِّنَةَ عَلَى الطَّالِبِ وَالْيَمِينَ عَلَى الْمَطْلُوبِ

"لَوْ يُعْطَى النَّاسُ بدَعْوَاهُم لادَّعَى نَاس دمَاءَ رجَال وَأُمْوالهم، وَلَكِنِ الْيَمينُ عَلَى المُدَّعَى عَلَيه".

"لَوْ يُعْطَى النَّاسُ بدَعْوَاهُم لادَّعَى رِجَالٌ، دِمَاءَ رِجَالٍ وَأَمْوالهُم، وَلكِنَّ الْبَيِّنَةَ عَلَى الْمُطَالِبِ، وَالْيَمِينَ عَلَى الْمَطلُوبِ".

"لَوْ يُعْطَى النَّاسُ بَدعْوَاهُم لادَّعَى رِجَالٌ أَمْوَال قَوْمٍ وَدِمَاءَهُم، وَلَكِنِ الْبَيِّنَةُ عَلَى المُدَّعِي، وَالْيَمِينُ عَلَى مَنْ أَنْكَرَ".
