29. Book of Defendents
٢٩۔ كِتَابُ الدَّعْوَى
“Whoever demands his rights let him do so in a decent manner as much as he can.” (Using translation from Ibn Mājah 2421)
أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ «مَنْ طَلَبَ حَقًّا فَلْيَطْلُبْهُ فِي عَفَافٍ وَافٍ أَوْ غَيْرَ وَافٍ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا أُمِرَ بِهَذَا الْأَمْرِ
(the slave of Ibn ʿAbbas) Messenger of Allah ﷺ said to Muʿadh when he sent him to Yemen, "You will go to the people of the Scripture. So, when you reach there, invite them to testify that none has the right to be worshipped but Allah, and that Muhammad is His Apostle. And if they obey you in that, tell them that Allah has enjoined on them five prayers in each day and night. And if they obey you in that tell them that Allah has made it obligatory on them to pay the Zakat which will be taken from the rich among them and given to the poor among them. If they obey you in that, then avoid taking the best of their possessions, and be afraid of the curse of an oppressed person because there is no screen between his invocation and Allah." لَمَّا بَعَثَ رَسُولُ اللَّهِ ﷺ مُعَاذًا إِلَى الْيَمَنِ فَقَالَ «إِنَّكَ سَتَأْتِي قَوْمًا أَهْلَ كِتَابٍ فَإِذَا جِئْتَهُمْ فَادْعُهُمْ إِلَى أَنْ يَشْهَدُوا أَنَّ لَا إِلَهَ إِلَّا اللَّهُ وَأَنَّ مُحَمَّدًا رَسُولُ اللَّهِ فَإِذَا أَطَاعُوا لَكَ بِذَلِكَ فَأَخْبِرْهُمْ أَنَّ اللَّهَ فَرَضَ عَلَيْهِمْ صَلَوَاتٍ خَمْسًا فِي كُلِّ يَوْمٍ وَلَيْلَةٍ فَإِنْ هُمْ أَطَاعُوا لَكَ بِذَلِكَ فَأَخْبِرْهُمْ أَنَّ اللَّهَ جَلَّ وَعَلَا فَرَضَ عَلَيْهِمْ صَدَقَةً تُؤْخَذُ مِنْ أَغْنِيَائِهِمْ فَتُرَدُّ عَلَى فُقَرَائِهِمْ فَإِنْ أَطَاعُوا لَكَ بِذَلِكَ فَإِيَّاكَ وَكَرَائِمَ أَمْوَالِهِمْ وَاتَّقِ دَعْوَةَ الْمَظْلُومِ فَإِنَّهُ لَيْسَ بَيْنَ اللَّهِ وَبَيْنَهُ حِجَابٌ»
ذِكْرُ مَا يَجِبُ لِلْمُدَّعِي عِنْدَمَا يَدَّعِي مِنَ الْحُقُوقِ عَلَى غَيْرِهِ
[Machine] "That two women who were staying in the house together, other than them, went out. One of them came back with a stab wound on her stomach, and blood was coming out from the back of her hand. She said her companion stabbed her, while the other denied it. So, they sent a message to Ibn Abbas about the incident, and they informed him of the matter. He said, 'Do not give anything unless there is evidence, for the Messenger of Allah ﷺ said, "If people were given what they claimed, people would falsely claim the wealth and blood of others. But the burden of proof is upon the claimant, so make her swear an oath and recite Surah Al-Imran: 'Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price...'" So, I did that, and she confessed.'"
أَنَّ امْرَأَتَيْنِ كَانَتَا تَخْرُزَانِ لَيْسَ مَعَهُمَا فِي الْبَيْتِ غَيْرَهُمَا فَخَرَجَتْ إِحْدَاهُمَا قَدْ طُعِنَ فِي بَطْنِ كَفِّهَا بِإِشْفَى خَرَجَ مِنْ ظَهْرِ كَفِّهَا تَقُولُ طَعَنَتْهَا صَاحِبَتُهَا وَتُنْكِرُ الْأُخْرَى فَأَرْسَلَتْ إِلَى ابْنِ عَبَّاسٍ فِيهِمَا فَأَخْبَرَتْهُ الْخَبَرَ فَقَالَ لَا تُعْطِي شَيْئًا إِلَّا بِالْبَيِّنَةِ فَإِنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَى رِجَالٌ أَمْوَالَ رِجَالٍ وَدِمَاءَهُمْ وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ فَادْعُهَا فَاقْرَأْ عَلَيْهَا الْقُرْآنَ وَاقْرَأْ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} فَفَعَلْتُ فَاعْتَرَفَتْ»
ذِكْرُ مَا يَجِبُ عَلَى الْمُدَّعَى عَلَيْهِ عِنْدَ عَدَمِ بَيِّنَةِ الْمُدَّعِي بِمَا يَدَّعِي
“If the people were given what they claimed, some would have claimed the lives and property of men. But the one the claim is made against is obliged to swear an oath.” (Using translation from Ibn Mājah 2321)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ «لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَى النَّاسُ دِمَاءَ رِجَالٍ وَأَمْوَالَهُمْ وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ»
ذِكْرُ الْإِخْبَارِ عَنْ إِيجَابِ غَضِبِ اللَّهِ جَلَّ وَعَلَا لِمَنْ أَخَذَ مَالَ أَخِيهِ الْمُسْلِمِ بِالْيَمِينِ الْفَاجِرَةِ
[Machine] The Prophet ﷺ said, "Whoever swears an oath on a matter in which he is lying, in order to unlawfully take someone's property, then he has met Allah while He is angry with him." The confirmation of this was revealed in the Qur'an in the verse {Indeed, those who exchange the covenant of Allah}. Al-Ash'ath ibn Qays passed by them while they were discussing this hadith in the mosque and he asked, "What does Ibn Umm 'Abd say?" They informed him, so he said, "He spoke the truth, indeed this verse was revealed concerning me and my companion in a well that I claimed and none of us had any proof, so he swore an oath on it. The Prophet ﷺ mentioned this at that time."
قَالَ النَّبِيُّ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ هُوَ فِيهَا فَاجِرٌ لِيَقْتَطِعَ بِهَا مَالًا لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ» وَنَزَلَ تَصْدِيقُ ذَلِكَ فِي كِتَابِ اللَّهِ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ} الْآيَةَ فَمَرَّ الْأَشْعَثُ بْنُ قَيْسٍ وَهُمْ يَتَحَدَّثُونَ بِهَذَا الْحَدِيثِ فِي الْمَسْجِدِ فَقَالَ مَا يَقُولُ ابْنُ أُمِّ عَبْدٍ؟ فَأَخْبَرُوهُ فَقَالَ صَدَقَ إِنَّمَا نَزَلَتْ هَذِهِ الْآيَةُ فِيَّ وَفِي صَاحِبِي فِي بِئْرٍ ادَّعَيْتُهَا وَلَمْ يَكُنْ لِأَحَدٍ مِنَّا بَيِّنَةٌ فَحَلَفَ عَلَيْهَا فَذَكَرَ نَبِيُّ اللَّهِ ﷺ هَذَا عِنْدَ ذَلِكَ

٢٩۔٢ بَابُ الِاسْتِحْلَافِ
ذِكْرُ إِيجَابِ غَضِبِ اللَّهِ جَلَّ وَعَلَا لِلْمُقْتَطِعِ شَيْئًا مِنْ مَالِ أَخِيهِ الْمُسْلِمِ بِالْيَمِينِ الْفَاجِرَةِ
[Machine] The Messenger of Allahﷺ said, "Whoever swears falsely by a pact of patience in order to usurp his brother's wealth, he will meet Allah while He is angry with him." This is because Allah says, "Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price..." until the end of the verse.
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينِ صَبْرٍ كَاذِبًا لِيَقْتَطِعَ بِهَا مَالَ أَخِيهِ لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ» وَذَلِكَ بِأَنَّ اللَّهَ يَقُولُ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} إِلَى آخِرِ الْآيَةِ
ذِكْرُ السَّبَبِ الَّذِي مِنْ أَجْلِهِ أَنْزَلَ اللَّهُ جَلَّ وَعَلَا هَذِهِ الْآيَةَ
The Messenger of Allah ﷺ said: He who swears an oath in which he tells a lie to take the property of a Muslim by unfair means, will meet Allah while He is angry with him. Al-Ash'ath said: I swear by Allah, he said this about me. There was some land between me and a Jew, but he denied it to me; so I presented him to the Prophet ﷺ. The Prophet ﷺ asked me: Have you any evidence? I replied: No. He said to the Jew: Take an oath. I said: Messenger of Allah, now he will take an oath and take my property. So Allah, the Exalted, revealed the verse, "As for those who sell the faith they owe to Allah and their own plighted word for a small price, they shall have no portion in the hereafter." قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ وَهُوَ فِيهَا فَاجِرٌ لَقِيَ اللَّهَ وَهُوَ عَلَيْهِ غَضْبَانُ» فَقَالَ الْأَشْعَثُ فِيَّ وَاللَّهِ كَانَ ذَلِكَ كَانَ بَيْنِي وَبَيْنَ رَجُلٍ مِنَ الْيَهُودِ أَرْضٌ فَجَحَدَنِي فَقَدَّمْتُهُ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ رَسُولُ اللَّهِ ﷺ «أَلَكَ بَيِّنَةٌ؟ » قُلْتُ لَا قَالَ لِلْيَهُودِيِّ «احْلِفْ» قَالَ قُلْتُ يَا رَسُولَ اللَّهِ إِذًا يَحْلِفُ فَيَذْهَبُ بِمَالِي فَأَنْزَلَ اللَّهُ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} إِلَى آخِرِ الْآيَةِ
ذِكْرُ تَحْرِيمِ اللَّهِ جَلَّ وَعَلَا الْجَنَّةَ مَعَ إِيجَابِ النَّارِ لِلْفَاعِلِ الْفِعْلَ الَّذِي ذَكَرْنَاهُ وَإِنْ كَانَ الْقَصْدُ فِيهِ الشَّيْءَ الْيَسِيرَ مِنَ الْأَمْوَالِ
[Machine] The Messenger of Allah ﷺ said: "Whoever takes a false oath in order to illegally seize the wealth of a Muslim, Allah has made Paradise forbidden for him and has made Hellfire obligatory for him." It was said, "O Messenger of Allah, even if it is something insignificant?" He replied, "Even if it is a stick from a date palm."
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينٍ فَاجِرَةٍ يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ بِغَيْرِ حَقٍّ حَرَّمَ اللَّهُ عَلَيْهِ الْجَنَّةَ وَأَوْجَبَ لَهُ النَّارَ» قِيلَ يَا رَسُولَ اللَّهِ وَإِنْ كَانَ شَيْئًا يَسِيرًا؟ قَالَ «وَإِنْ كَانَ قَضِيبًا مِنْ أَرَاكٍ»
ذِكْرُ الْبَيَانِ بِأَنَّ مَنْ فَعَلَ هَذَا الْفِعْلَ لِيُذْهِبَ بِهِ مَالَ أَخِيهِ يَلْقَى رَبَّهُ يَوْمَ الْقِيَامَةِ وَهُوَ أَجْذَمُ
“Whoever swears a false oath in order to seize the wealth of a Muslim unlawfully, he will meet Allah when He is angry with him.” (Using translation from Ibn Mājah 2323)
قَالَ رَسُولُ اللَّهِ ﷺ «مَنْ حَلَفَ عَلَى يَمِينِ صَبْرٍ لِيَقْتَطِعَ بِهَا مَالَ امْرِئٍ مُسْلِمٍ وَهُوَ فِيهَا فَاجِرٌ لَقِيَ اللَّهَ أَجْذَمَ»
29.3 [Machine] The punishment of procrastination
٢٩۔٣ بَابُ عُقُوبَةِ الْمَاطِلِ
ذِكْرُ اسْتِحْقَاقِ الْمَاطِلِ إِذَا كَانَ غَنِيًّا لِلْعُقُوبَةِ فِي النَّفْسِ وَالْعَرَضِ لِمَطْلِهِ
"If one who can afford it delays repayment, his honor and punishment become permissible." (Using translation from Nasāʾī 4690)
عَنْ رَسُولِ اللَّهِ ﷺ قَالَ لِي «الْوَاجِدُ يُحِلُّ عِرْضُهُ وَعُقُوبَتُهُ»
ذِكْرُ الْعِلَّةِ الَّتِي مِنْ أَجْلِهَا اسْتَحَقَّ مَنْ وَصَفْنَا مَا ذَكَرْتُ
The Messenger of Allah ﷺ as saying: Delay in payment (of debt) by a rich man is injunctive, but when one of you is referred to a wealthy man, he should accept the reference. (Using translation from Abū Dāʾūd 3345)
قَالَ رَسُولُ اللَّهِ ﷺ «مَطْلُ الْغَنِيِّ ظُلْمٌ وَإِذَا أُتْبِعَ أَحَدُكُمْ عَلَى مَلِيءٍ فَلْيَتْبَعْ»
