ذِكْرُ مَا يَجِبُ لِلْمُدَّعِي عِنْدَمَا يَدَّعِي مِنَ الْحُقُوقِ عَلَى غَيْرِهِ

[Machine] "That two women who were staying in the house together, other than them, went out. One of them came back with a stab wound on her stomach, and blood was coming out from the back of her hand. She said her companion stabbed her, while the other denied it. So, they sent a message to Ibn Abbas about the incident, and they informed him of the matter. He said, 'Do not give anything unless there is evidence, for the Messenger of Allah ﷺ said, "If people were given what they claimed, people would falsely claim the wealth and blood of others. But the burden of proof is upon the claimant, so make her swear an oath and recite Surah Al-Imran: 'Indeed, those who exchange the covenant of Allah and their [own] oaths for a small price...'" So, I did that, and she confessed.'"  

ابن حبّان:٥٠٨٢أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُنْذِرِ بْنِ سَعِيدٍ حَدَّثَنَا يُوسُفُ بْنُ سَعِيدٍ حَدَّثَنَا حَجَّاجُ بْنُ مُحَمَّدٍ عَنِ ابْنِ جُرَيْجٍ أَخْبَرَنِي ابْنُ أَبِي مُلَيْكَةَ

أَنَّ امْرَأَتَيْنِ كَانَتَا تَخْرُزَانِ لَيْسَ مَعَهُمَا فِي الْبَيْتِ غَيْرَهُمَا فَخَرَجَتْ إِحْدَاهُمَا قَدْ طُعِنَ فِي بَطْنِ كَفِّهَا بِإِشْفَى خَرَجَ مِنْ ظَهْرِ كَفِّهَا تَقُولُ طَعَنَتْهَا صَاحِبَتُهَا وَتُنْكِرُ الْأُخْرَى فَأَرْسَلَتْ إِلَى ابْنِ عَبَّاسٍ فِيهِمَا فَأَخْبَرَتْهُ الْخَبَرَ فَقَالَ لَا تُعْطِي شَيْئًا إِلَّا بِالْبَيِّنَةِ فَإِنَّ رَسُولَ اللَّهِ ﷺ قَالَ «لَوْ يُعْطَى النَّاسُ بِدَعْوَاهُمْ لَادَّعَى رِجَالٌ أَمْوَالَ رِجَالٍ وَدِمَاءَهُمْ وَلَكِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ فَادْعُهَا فَاقْرَأْ عَلَيْهَا الْقُرْآنَ وَاقْرَأْ {إِنَّ الَّذِينَ يَشْتَرُونَ بِعَهْدِ اللَّهِ وَأَيْمَانِهِمْ ثَمَنًا قَلِيلًا} فَفَعَلْتُ فَاعْتَرَفَتْ»

[Machine] About two women who had a dispute, one of them went out and claimed that her companion had hit her with a whip, while the other denied it. So Ibn Abbas wrote to me saying that the Messenger of Allah ﷺ decided, "Verily, the right lies with the accused, and even if people were given to claim their oaths, then some among the people would claim the wealth and blood of others, but let her make an oath." So I recited to her: "Indeed, those who exchange the covenant of Allah and their own oaths for a small price - those will have no share in the Hereafter." She confessed, and he was pleased with that.
