[Machine] I wrote to Ibn Abbas, and he wrote back to me stating, "Indeed, the Messenger of Allah ﷺ said, 'Verily, the right of the defendant is upon the claimant, even if people were given according to their claims, some people would claim the property and blood of others.'"  

أحمد:٣٤٢٧حَدَّثَنَا أَبُو كَامِلٍ حَدَّثَنَا نَافِعٌ عَنِ ابْنِ أَبِي مُلَيْكَةَ قَالَ

كَتَبْتُ إِلَى ابْنِ عَبَّاسٍ فَكَتَبَ إِلَيَّ إِنَّ رَسُولَ اللهِ ﷺ قَالَ إِنَّ الْيَمِينَ عَلَى الْمُدَّعَى عَلَيْهِ وَلَوْ أُعْطِيَ النَّاسُ بِدَعْوَاهُمْ لَادَّعَى أُنَاسٌ أَمْوَالَ النَّاسِ وَدِمَاءَهُمْ

The oath must be taken by the defendant

that the Prophet ﷺ said, "If the people were given according to their claims, they would claim the lives of persons and their properties, but the oath must be taken by the defendant."
