29. Judgements (3/3)
٢٩۔ كِتَابُ الْقَضَاءِ ص ٣
The best among people are of my generation, then those next to them. (The narrator said): I do not know whether (he said) it three times or four times. Then there would fellow after them such persons whose evidence would precede the oath, and in case of some others, the oath (would precede) the evidence. (Using translation from Muslim 2533d)
قَالَ رَسُولُ اللهِ ﷺ خَيْرُ النَّاسِ قَرْنِي ثُمَّ الَّذِينَ يَلُونَهُمْ ثُمَّ الَّذِينَ يَلُونَهُمْ فَلَا أَدْرِي فِي الرَّابِعَةِ أَوِ الثَّالِثَةِ قَالَ ثُمَّ يَخْلُفُ بَعْدَهُمْ خَلْفٌ تَسْبِقُ شَهَادَةُ أَحَدِهِمْ يَمِينَهُ وَيَمِينُهُ شَهَادَتَهُ
29.63 [Machine] Tadiil and Al-Jarh in the matter
٢٩۔٦٣ التَّعْدِيلُ وَالْجَرْحُ عِنْدَ الْمَسْأَلَةِ
I swear by Allah that you have no claim on us. she went to Messenger of Allah ﷺ and mentioned that to him. He said: There is no maintenance due to you from him, and he commanded her to spend the 'Idda in the house of Umm Sharik, but then said: That is a woman whom my companions visit. So better spend this period in the house of Ibn Umm Maktum, for he is a blind man and yon can put off your garments. And when the 'Idda is over, inform me. She said: When my period of 'Idda was over, I mentioned to him that Mu'awiya b. Abu Sufyan and Jahm had sent proposal of marriage to me, whereupon Messenger of Allah ﷺ said: As for Abu Jahm, he does not put down his staff from his shoulder, and as for Mu'awiya, he is a poor man having no property; marry Usama b. Zaid. I objected to him, but he again said: Marry Usama; so I married him. Allah blessed there in and I was envied (by others). (Using translation from Muslim 1480a)
وَاللهِ مَا لَكَ عَلَيْنَا مِنْ شَيْءٍ فَجَاءَتْ رَسُولَ اللهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ «لَيْسَ لَكِ نَفَقَةٌ» فَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ ثُمَّ قَالَ «تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي فَاعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى تَضَعِينَ ثِيَابَكِ فَإِذَا حَلَلْتِ فَآذِنِينِي» فَلَمَّا حَلَلْتُ ذَكَرْتُ لَهُ أَنَّ مُعَاوِيَةَ بْنَ أَبِي سُفْيَانَ وَأَبَا جَهْمٍ خَطَبَانِي فَقَالَ رَسُولُ اللهِ ﷺ «أَمَّا أَبُو جَهْمٍ فَلَا يَضَعُ عَصَاهُ عَنْ عَاتِقِهِ وَأَمَّا مُعَاوِيَةُ فَصُعْلُوكٌ لَا مَالَ لَهُ وَلَكِنِ انْكِحِي أُسَامَةَ» فَنَكَحْتُهُ فَجَعَلَ اللهُ فِيهِ خَيْرًا وَاغْتَبَطْتُ بِهِ
29.64 [Machine] Evaluating and harming women.
٢٩۔٦٤ تَعْدِيلُ النِّسَاءِ وَجَرْحُهُنَّ
[Machine] "Praise be to Allah. Many people narrated to me hadiths, even though some of them were not as watchful as others. They claimed that Aisha, the wife of the Prophet ﷺ , said that the Messenger of Allah ﷺ called upon Ali ibn Abi Talib and Usama ibn Zaid when the revelation was delayed and consulted them regarding divorcing his wives. As for Usama, he pointed to what he knew about the innocence of his family and his love for them. He said, 'O Messenger of Allah, your family and we only know goodness.' As for Ali, he said, 'O Messenger of Allah, may Allah not restrict your choices. There are many women apart from them, and if you ask the virgin girl, she will testify to your truthfulness.' So, the Messenger of Allah ﷺ called Barira and asked her, 'O Barira, have you seen anything that disturbs you?' Barira replied, 'No, by the One who sent you with the truth, I have never seen anything wrong in her behavior, except that she is a young girl who falls asleep before kneading her family's dough, and the chickens come and eat it.'"
عَنْ حَدِيثِ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ حِينَ قَالَ لَهَا أَهْلُ الْإِفْكِ مَا قَالُوا فَبَرَّأَهَا اللهُ وَكُلٌّ حَدَّثَنِي طَائِفَةً مِنَ الْحَدِيثِ وَإِنْ كَانَ بَعْضُهُمْ أَوْعَى مِنْ بَعْضٍ زَعَمُوا أَنَّ عَائِشَةَ زَوْجَ النَّبِيِّ ﷺ قَالَتْ وَدَعَا رَسُولُ اللهِ ﷺ عَلِيَّ بْنَ أَبِي طَالِبٍ وَأُسَامَةَ بْنَ زَيْدٍ حِينَ اسْتَلْبَثَ الْوَحْيُ يَسْتَشِيرُهُمَا فِي فِرَاقِ أَهْلِهِ فَأَمَّا أُسَامَةُ فَأَشَارَ عَلَى رَسُولِ اللهِ ﷺ بِالَّذِي يَعْلَمُ مِنْ بَرَاءَةِ أَهْلِهِ وَبِالَّذِي فِي نَفْسِهِ مِنَ الوُّدِّ لَهُمْ فَقَالَ يَا رَسُولَ اللهِ أَهْلُكَ وَلَا نَعْلَمُ إِلَّا خَيْرًا وَأَمَّا عَلِيٌّ فَقَالَ يَا رَسُولَ اللهِ لَمْ يُضَيِّقِ اللهُ عَلَيْكَ وَالنِّسَاءُ سِوَاهَا كَثِيرٌ وَإِنْ تَسْأَلِ الْجَارِيَةَ تَصْدُقْكَ فَدَعَا رَسُولُ اللهِ ﷺ بَرِيرَةَ فَقَالَ «أَيْ بَرِيرَةُ هَلْ رَأَيْتِ مِنْ شَيْءٍ يَرِيبُكِ؟» قَالَتْ بَرِيرَةُ لَا وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا رَأَيْتُ عَلَيْهَا أَمْرًا قَطُّ أَغْمِصُهُ عَلَيْهَا أَكْثَرَ مِنْ أَنَّهَا جَارِيَةٌ حَدِيثَةُ السِّنِّ تَنَامُ عَنْ عَجِينِ أَهْلِهَا فَيَأْتِي الدَّاجِنُ فَيَأْكُلُهُ
29.65 [Machine] The matter of the ruling of the people of knowledge regarding the sold item
٢٩۔٦٥ مَسْأَلَةُ الْحَاكِمِ أَهْلُ الْعِلْمِ بِالسِّلْعَةِ الَّتِي تُبَاعُ
Which of them is better? He replied: Soft and white kind of wheat. So he forbade him from it and said: I heard the Messenger of Allah (sawa) say, when he was asked about buying dry dates for fresh. The Messenger of Allah (sawa) said: Are fresh dates diminished when they become dry? The (the people) replied: Yes. So the Messenger of Allah ﷺ forbade that. Abu Dawud said: A similar tradition has also been transmitted by Isma'il b. Umayyah. (Using translation from Abū Dāʾūd 3359)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَسْأَلُ عَنِ اشْتِرَاءِ التَّمْرِ بِالرُّطَبِ قَالَ «أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ؟» قَالُوا نَعَمْ فَنَهَى عَنْهُ
29.66 [Machine] The verdict is in the qafah.
٢٩۔٦٦ الْحُكْمُ بِالْقَافَةِ
"The Messenger of Allah came to me one day looking happy and said: 'O 'Aishah! Did you not see that Mujazziz Al-Mudliji came to me when Usamah bin Zaid was with me. He saw Usamah bin Zaid and Zaid with a blanket over them; their heads were covered but their feet were exposed, and he said: These feet belong to one another.'" (Using translation from Nasāʾī 3494)
دَخَلَ عَلَيَّ رَسُولُ اللهِ ﷺ ذَاتَ يَوْمٍ مَسْرُورًا فَقَالَ «يَا عَائِشَةُ أَلَمْ تَرَيْ أَنَّ مُجَزِّزًا الْمُدْلِجِيَّ دَخَلَ عَلَيَّ وَعِنْدِي أُسَامَةُ بْنُ زَيْدٍ فَرَأَى أُسَامَةَ وَزَيْدًا وَعَلَيْهِمَا قَطِيفَةٌ وَقَدْ غَطَّيَا رُءُوسَهُمَا وَبَدَتْ أَقْدَامُهُمَا؟» فَقَالَ هَذِهِ أَقْدَامٌ بَعْضُهَا مِنْ بَعْضٍ قَالَ سُفْيَانُ هَذَا تَقْوِيَةُ الْقَافَةِ
29.67 [Machine] The ruling of drawing lots and mentioning the differences among the narrators of the story of Ali ibn Abi Talib in that.
٢٩۔٦٧ الْحُكْمُ بِالْقُرْعَةِ وَذِكْرُ اخْتِلَافِ النَّاقِلِينَ لِخَبَرِ عَلِيِّ بْنِ أَبِي طَالِبٍ فِي ذَلِكَ
[Machine] "Ali came with three others while he was in Yemen. They encountered a woman in a state of menstruation, so he asked two men, 'Do you confirm that this child is hers?' They replied, 'No.' Then he asked two other men, 'Do you confirm that this child is hers?' They also replied, 'No.' So he drew lots among them and ruled that the child belonged to the one on whom the lot fell. He then imposed on him two-thirds of the blood money. I mentioned this to the Prophet ﷺ, and he laughed until his molars showed. Is'haq ibn Shahin reported to us that Khalid narrated to us from Ash-Sha'bi from a man from Hadramaut, from Zaid ibn Arqam who said: 'The Messenger of Allah ﷺ sent Ali to Yemen and he brought back a boy who three people claimed as their own, and the narration continues.'"
أُتِيَ عَلِيٌّ بِثَلَاثَةٍ وَهُوَ بِالْيَمَنِ وَقَعُوا عَلَى امْرَأَةٍ فِي طُهْرٍ وَاحِدٍ فَسَأَلَ اثْنَيْنِ أَتُقِرَّانِ يَعْنِي لِهَذَا بِالْوَلَدِ ؟ قَالَا لَا ثُمَّ سَأَلَ اثْنَيْنِ أَتُقِرَّانِ لِهَذَا بِالْوَلَدِ؟ قَالَا لَا فَأَقْرَعَ بَيْنَهُمْ فَقَضَى بِالْوَلَدِ لِلَّذِي صَارَتْ عَلَيْهِ الْقُرْعَةُ وَجَعَلَ عَلَيْهِ ثُلُثَيِ الدِّيَةِ فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَضَحِكَ حَتَّى بَدَتْ نَوَاجِذُهُ 5994 أَخْبَرَنَا إِسْحَاقُ بْنُ شَاهِينَ قَالَ حَدَّثَنَا خَالِدٌ عَنِ الشَّيْبَانِيِّ عَنِ الشَّعْبِيِّ عَنْ رَجُلٍ مِنْ حَضْرَمَوْتَ عَنْ زَيْدِ بْنِ أَرْقَمَ قَالَ بَعَثَ رَسُولُ اللهِ ﷺ عَلِيًّا عَلَى الْيَمَنِ فَأُتِيَ بِغُلَامٍ تَنَازَعَ فِيهِ ثَلَاثَةٌ وَسَاقَ الْحَدِيثَ
29.68 [Machine] The mentioning of the name of this Hadrami.
٢٩۔٦٨ ذِكْرُ اسْمِ هَذَا الْحَضْرَمِيِّ
[Machine] While we were with the Messenger of Allah ﷺ , a man from the people of Yemen came and started informing and narrating to him the hadith.
بَيْنَا نَحْنُ عِنْدَ رَسُولِ اللهِ ﷺ إِذْ جَاءَ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ فَجَعَلَ يُخْبِرُهُ وَيُحَدِّثُهُ وَذَكَرَ الْحَدِيثَ
[Machine] Indeed, the Ansar voted on which of their homes should host the Messenger of Allah ﷺ, and Abu Ayyub cast his vote to host the Messenger of Allah ﷺ. So the Messenger of Allah ﷺ would send us the food that was given to him, and Abu Abdur Rahman Bahir bin Saad said, "He was trustworthy."
إِنَّ الْأَنْصَارَ اقْتَرَعُوا مَنَازِلَهُمْ أَيُّهُمْ يُؤْوِي رَسُولَ اللهِ ﷺ فَقَرَعَهُمْ أَبُو أَيُّوبَ فَأَوَى إِلَيْهِ رَسُولَ اللهِ ﷺ فَكَانَ رَسُولُ اللهِ ﷺ إِذَا «أُهْدِيَ إِلَيْهِ طَعَامٌ بَعَثَ بِهِ إِلَيْنَا» مُخْتَصَرٌ قَالَ أَبُو عَبْدِ الرَّحْمَنِ بَحِيرُ بْنُ سَعْدٍ ثِقَةٌ
