٣٠۔ كِتَابُ الْبُيُوعِ ص ١
I heard the Messenger of Allah ﷺ say: What is lawful is clear and what is unlawful is clear, but between them are certain doubtful things. I give you an example for this. Allah has a preserve, and Allah's preserve is the things He has declared unlawful. He who pastures (his animals) round the preserve will soon fall into it. He who falls into doubtful things will soon be courageous. (Using translation from Abū Dāʾūd 3329)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «إِنَّ الْحَلَالَ بَيِّنٌ وَإِنَّ الْحَرَامَ بَيِّنٌ وَإِنَّ بَيْنَ ذَلِكَ أُمُورًا مُشْتَبِهَاتٍ» قَالَ وَرُبَّمَا قَالَ وَإِنَّ مِنْ ذَلِكَ أُمُورًا مُشْتَبِهَةً وَسَأَضْرِبُ لَكُمْ فِي ذَلِكَ مَثَلًا إِنَّ اللهَ حَمَى حِمًى وَإِنَّ حِمَى اللهِ مَا حَرَّمَ وَإِنَّهُ مَنْ يَرْتَعْ حَوْلَ الْحِمَى يُوشِكُ أَنْ يُخَالِطَ الْحِمَى وَرُبَّمَا قَالَ إِنَّهُ مَنْ يَرْعَى حَوْلَ الْحِمَى يُوشِكُ أَنْ يَرْتَعَ فِيهِ وَإِنَّ مَنْ يُخَالِطُ الرِّيبَةَ يُوشِكُ أَنْ يَجْسُرَ
"The Messenger of Allah said: 'There will come a time when a man will not care where his wealth comes from, whether (the source is) Halal or Haram." (Using translation from Nasāʾī 4454)
قَالَ رَسُولُ اللهِ ﷺ «يَأْتِي عَلَى النَّاسِ زَمَانٌ مَا يُبَالِي الرَّجُلُ مِنْ أَيْنَ أَصَابَ الْمَالَ مِنْ حِلٍّ أَوْ حَرَامٍ»
"The Messenger of Allah said: "There will come a time when there will be no one left who does not consume Riba, and whoever does not consume it will nevertheless be affected by residue." (Sahih ) (Using translation from Nasāʾī 4455)
قَالَ رَسُولُ اللهِ ﷺ «يَأْتِي عَلَى النَّاسِ زَمَانٌ يَأْكُلُونَ الرِّبَا فَمَنْ لَمْ يَأْكُلْهُ أَصَابَهُ مِنْ غُبَارِهِ»
30.2 [Machine] Encouragement for earning
٣٠۔٢ الْحَثُّ عَلَى الْكَسْبِ
"The Messenger of Allah said: "The best (most Pure) food that a man eats is that which he has earned himself, and a man's child (and his child's wealth) is part of his earnings" (Sahih ) (Using translation from Nasāʾī 4449)
قَالَ رَسُولُ اللهِ ﷺ «إِنَّ أَطْيَبَ مَا أَكَلَ الرَّجُلُ مِنْ كَسْبِهِ وَإِنَّ وَلَدَ الرَّجُلِ مِنْ كَسْبِهِ»
"Your children are part of the best of your earnings, so eat from what your children earn." (Using translation from Nasāʾī 4450)
أَنَّ النَّبِيَّ ﷺ قَالَ «إِنَّ أَوْلَادَكُمْ مِنْ أَطْيَبِ كَسْبِكُمْ فَكُلُوا مِنْ كَسْبِ أَوْلَادِكُمْ»
"The Messenger of Allah said: 'The best (most pure) food that a man eats is that which he has earned himself, and his child (and his child's wealth) is part of his earning," (Using translation from Nasāʾī 4451)
قَالَ رَسُولُ اللهِ ﷺ «إِنَّ أَطْيَبَ مَا أَكَلَ الرَّجُلُ مِنْ كَسْبِهِ وَوَلَدُهُ مِنْ كَسْبِهِ»
[Machine] The Messenger of Allah ﷺ said, "The best thing a man can eat is from his own earnings, and his children are also from his own earnings." 6004 Sulaiman said, and Umamah bin Umayr narrated from his aunt, from Aisha, from the Messenger of Allah ﷺ, something similar to that.
قَالَ رَسُولُ اللهِ ﷺ «إِنَّ أَطْيَبَ مَا أَكَلَ الرَّجُلُ مِنْ كَسْبِهِ وَإِنَّ وَلَدَهُ مِنْ كَسْبِهِ» 6004 قَالَ سُلَيْمَانُ وَأَخْبَرَنِي عُمَارَةُ بْنُ عُمَيْرٍ عَنْ عَمَّتِهِ عَنْ عَائِشَةَ عَنْ رَسُولِ اللهِ ﷺ مِثْلَ ذَلِكَ
30.3 [Machine] Trade
٣٠۔٣ التِّجَارَةُ
"The Messenger of Allah said: 'One of the portents of the Hour will be that wealth becomes widespread and abundant, and trade will become widespread, but knowledge will disappear. A man will try to sell something and will say: "No, not until I consult the merchant of banu so and so: and People will look throughout a vast area for a scribe and will not find one." (Sahih ) (Using translation from Nasāʾī 4456)
قَالَ رَسُولُ اللهِ ﷺ إِنَّ مِنْ أَشْرَاطِ السَّاعَةِ أَنْ يَفْشُوَ الْمَالُ وَيَكْثُرَ وَتَفْشُوَ التِّجَارَةُ وَيَظْهَرَ الْجَهْلُ وَيَبِيعَ الرَّجُلُ الْبَيْعَ فَيَقُولَ حَتَّى أَسْتَأْمِرَ تَاجِرَ بَنِي فُلَانٍ وَيُلْتَمَسَ فِي الْحَيِّ الْعَظِيمِ الْكَاتِبُ فَلَا يُوجَدُ
30.4 [Machine] What merchants should do regarding disclosure in their transactions
٣٠۔٤ مَا يَجِبُ عَلَى التُّجَّارِ مِنَ التَّوْفيَةِ فِي مُبَايَعَتِهِمْ
The Prophet ﷺ said, "The buyer and the seller have the option of canceling or confirming the bargain unless they separate, and if they spoke the truth and made clear the defects of the goods, them they would be blessed in their bargain, and if they told lies and hid some facts, their bargain would be deprived of Allah's blessings." (Using translation from Bukhārī 2110)
قَالَ رَسُولُ اللهِ ﷺ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِنْ صَدَقَا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذَبَا وَكَتَمَا مُحِقَ بَرَكَةُ بَيْعِهِمَا»
30.5 [Machine] The hypocrite sells his goods with false oaths.
٣٠۔٥ الْمُنْفِقُ سِلْعَتَهُ بِالْحَلِفِ الْكَاذِبِ
"There are three to whom Allah will not speak on the Day of Resurrection, or look at them, or sanctify them, and theirs will be a painful torment." The Messenger of Allah repeated and Abu Dharr said: "May they be lost and doomed." He said: "The one who lets his garment hang beneath his ankles, a vendor who tries to sell his product by means of false oaths, and the one who reminds people of what he has given them." (Using translation from Nasāʾī 2563)
عَنِ النَّبِيِّ ﷺ قَالَ «ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللهُ يَوْمَ الْقِيَامَةِ وَلَا يَنْظُرُ إِلَيْهِمْ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ» فَقَرَأَهَا رَسُولُ اللهِ ﷺ فَقَالَ أَبُو ذَرٍّ خَابُوا وَخَسِرُوا قَالَ «الْمُسْبِلُ إِزَارَهُ خُيَلَاءَ وَالْمُنَفِّقُ سِلْعَتَهُ بِالْحَلِفِ الْكَاذِبِ وَالْمَنَّانُ عَطَاءَهُ»
"There are three at whom Allah will not look on the Day of Resurrection, nor will He sanctify them, and theirs will be a painful torment: the one who does not give anything but he reminds (the recipient of his gift), the one who drags his Izar (below the ankles), and the one who sells his product by means of false oaths." (Sahih ) (Using translation from Nasāʾī 4459)
عَنِ النَّبِيِّ ﷺ قَالَ «ثَلَاثَةٌ لَا يَنْظُرُ اللهُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ الَّذِي لَا يُعْطِي شَيْئًا إِلَّا مِنَّهُ وَالْمُسْبِلُ إِزَارَهُ وَالْمُنَفِّقُ سِلْعَتَهُ بِالْكَذِبِ»
"Taking oaths may help you to make a sale but it takes (blessing) away from the earnings "(Sahih ) (Using translation from Nasāʾī 4461)
عَنِ النَّبِيِّ ﷺ قَالَ «الْحَلِفُ مَنْفَقَةٌ لِلسِّلْعَةِ مَمْحَقَةٌ لِلْكَسْبِ»
Beware of swearing; it produces a ready sale for a commodity, but blots out the blessing. (Using translation from Muslim 1607)
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ «إِيَّاكُمْ وَكَثْرَةَ الْحَلِفِ فِي الْبَيْعِ؛ فَإِنَّهَا تُنْفِقُ ثُمَّ تُمْحِقُ»
30.6 [Machine] The binding oath for deception in sales
٣٠۔٦ الْحَلِفُ الْمُوجِبَةُ لِلْخَدِيعَةِ فِي الْبَيْعِ
"There are three to whom Allah will not speak on the Day of Resurrection, or will He look at them, or sanctify them and theirs will be a painful torment: A man who has surplus water when traveling but he withholds it form a wayfarer; a man who swears allegiance to an imam for worldly gains, and if he gives him what he wants he is loyal to him but if he does not give him anything he is not loyal to him: and a man who sells a man his product after 'Asr, swerving by Allah that he bought it for such and such a price, and the other believes him." (Using translation from Nasāʾī 4462)
عَنْ رَسُولِ اللهِ ﷺ قَالَ ثَلَاثَةٌ لَا يُكَلِّمُهُمُ اللهُ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ رَجُلٌ بَخِلَ فَضْلَ مَاءٍ بِالطَّرِيقِ يَمْنَعُ ابْنَ السَّبِيلِ مِنْهُ وَرَجُلٌ بَايَعَ إِمَامًا لِدُنْيَا إِنْ أَعْطَاهُ مَا يُرِيدُ وَفَى لَهُ وَإِنْ لَمْ يُعْطِهِ لَمْ يَفِ لَهُ وَرَجُلٌ سَاوَمَ رَجُلًا عَلَى سِلْعَةٍ بَعْدَ الْعَصْرِ فَحَلَفَ لَهُ بِاللهِ لَقَدْ أُعْطِيَ بِهَا كَذَا وَكَذَا فَصَدَّقَهُ الْآخَرُ
30.7 [Machine] Commanding Charity for Those Who Have Not Bound an Oath in Their Hearts at the Time of Their Sale
٣٠۔٧ الْأَمْرُ بِالصَّدَقَةِ لِمَنْ لَمْ يَعْقِدِ الْيَمِينَ بِقَلْبِهِ فِي حَالِ بَيْعِهِ
"We used to trade in the markets of Al-Madinah and we used to call ourselves as-Samasir (brokers) and the people called us that, but the Messenger of Allah came out to s and called us by a name that was better than what we called ourselves. He said: "O merchants (Tujjar)! Selling involves (false) oaths and idle talk, so mix some charity with it,"" (Sahih ) (Using translation from Nasāʾī 4463)
كُنَّا بِالْمَدِينَةِ نَبِيعُ الْأَوْسَاقَ وَنَبْتَاعُهَا وَنُسَمِّي أَنْفُسَنَا السَّمَاسِرَةَ وَيُسَمِّينَا النَّاسُ فَخَرَجَ إِلَيْنَا رَسُولُ اللهِ ﷺ فَسَمَّانَا بِاسْمٍ هُوَ خَيْرٌ لَنَا مِنَ الَّذِي سَمَّيْنَا بِهِ أَنْفُسَنَا فَقَالَ «يَا مَعْشَرَ التُّجَّارِ إِنَّهُ يَشْهَدُ بَيْعَكُمُ الْحَلِفُ وَاللَّغْوُ شُوبُوهُ بِالصَّدَقَةِ»
30.8 [Machine] The necessity of choice for buyers before their separation.
٣٠۔٨ وُجُوبُ الْخِيَارِ لِلْمُتَبَايِعَيْنِ قَبْلَ افْتِرَاقِهِمَا
The Prophet ﷺ said, "The buyer and the seller have the option of canceling or confirming the bargain unless they separate, and if they spoke the truth and made clear the defects of the goods, them they would be blessed in their bargain, and if they told lies and hid some facts, their bargain would be deprived of Allah's blessings." (Using translation from Bukhārī 2110)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِنْ بَيَّنَا وَصَدَقَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَذَبَا وَكَتَمَا مُحِقَ بَرَكَةُ بَيْعِهِمَا»
30.9 [Machine] The necessity of agreement for the sellers before their separation, and mentioning the disagreement on a beneficial word in his statement about it.
٣٠۔٩ وُجُوبُ الْخِيَارِ لِلْمُتَبَايِعَيْنِ قَبْلَ افْتِرَاقِهِمَا، وَذِكْرُ الِاخْتِلَافِ عَلَى نَافِعٍ فِي لَفْظِ حَدِيثِهِ فِيهِ
The Messenger of Allah ﷺ as saying: Each one of the two parties in a business has an option (to annul it) against the other party so long as they have not separated, except in a conditional bargain. (Using translation from Abū Dāʾūd 3454)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْمُتَبَايِعَانِ كُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ عَلَى صَاحِبِهِ مَا لَمْ يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
The Messenger of Allah ﷺ said: “The two parties to a transaction have the option (of cancelling it) so long as they have not parted or there is a condition which gives the option to cancel.ʿ (Using translation from Aḥmad 393)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا أَوْ يَكُونَ خِيَارًا»
"The Messenger of Allah said: 'The two parties to a transaction both have the choice so long as they have not separated, unless they have both chosen to conclude they transaction. If they have both chosen to conclude the transaction, then the transaction is binding." (Sahih ) (Using translation from Nasāʾī 4467)
قَالَ رَسُولُ اللهِ ﷺ «الْمُتَبَايِعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا إِلَّا أَنْ يَكُونَ الْبَيْعُ كَانَ عَنْ خِيَارٍ فَإِنْ كَانَ الْبَيْعُ عَنْ خِيَارٍ فَقَدْ وَجَبَ الْبَيْعُ»
"Nafi dictated to me, from Ibn 'Umar who said: The Messenger of Allah said: 'the two parties to a transaction both have the choice so long as they have not separated, unless they have both chosen to conclude the transaction. If they have both chosen to conclude the transaction, then the transactions binding." (Sahih ) (Using translation from Nasāʾī 4468)
قَالَ رَسُولُ اللهِ ﷺ «إِذَا تَبَايَعَ الْمُبْتَاعَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ مِنْ بَيْعِهِ مَا لَمْ يَتَفَرَّقَا أَوْ يَكُونَ بَيْعُهُمَا عَنْ خِيَارٍ فَإِنْ كَانَ عَنْ خِيَارِ فَقَدْ وَجَبَ الْبَيْعُ»
”The two parties to a transaction have the choice (of annulling it) so long as they have not yet parted." (Using translation from Ibn Mājah 2182)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا أَوْ يَقُولَ اخْتَرْ
"The Messenger of Allah said: 'The two parties to a transaction both have the choice so long as they have not separated or chosen to conclude the transaction." Or perhaps Nafi said: "Or one of them has said to the other: 'Decide! "(Sahih ) (Using translation from Nasāʾī 4470)
قَالَ رَسُولُ اللهِ ﷺ «الْبَيِّعَانِ بِالْخِيَارِ حَتَّى يَتَفَرَّقَا أَوْ يَكُونَ بَيْعَ خِيَارٍ» وَرُبَّمَا قَالَ نَافِعٌ أَوْ يَقُولَ أَحَدُهُمَا لِلْآخَرِ اخْتَرْ
"When two men enter into a transaction, each of them has the choice (of annulling it) so long as they have not yet parted and are still together, or one of them has given the option or choice to the other. Once he has accepted the terms of the other, then the transaction is binding. If they part after concluding the transaction and neither of them has rescinded the transaction then the transaction is binding.” (Using translation from Ibn Mājah 2181)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «إِذَا تَبَايَعَ الرَّجُلَانِ فَكُلُّ وَاحِدٍ مِنْهُمَا بِالْخِيَارِ حَتَّى يَتَفَرَّقَا» وَقَالَ مَرَّةً أُخْرَى مَا لَمْ يَتَفَرَّقَا وَكَانَا جَمِيعًا أَوْ خَيَّرَ أَحَدُهُمَا الْآخَرَ فَإِنْ خَيَّرَ أَحَدُهُمَا الْآخَرَ فَتَبَايَعَا عَلَى ذَلِكَ فَقَدْ وَجَبَ الْبَيْعُ وَإِنْ تَفَرَّقَا بَعْدَ أَنْ تَبَايَعَا وَلَمْ يَتْرُكْ وَاحِدٌ مِنْهُمَا الْبَيْعَ فَقَدْ وَجَبَ الْبَيْعُ
"I heard Nafi narrating from Ibn 'Umar, form the Messenger of Allah 'the two parties to a transaction both have the choice so long as they have not separated unless they have chosen to conclude the transaction. " Nafi said: ''When 'Abdullah bought something he like, he would leave straightaway." (Using translation from Nasāʾī 4473)
عَنْ رَسُولِ اللهِ ﷺ «أَنَّ الْمُتَبَايِعَيْنِ بِالْخِيَارِ فِي بَيْعِهِمَا مَا لَمْ يَفْتَرِقَا إِلَّا أَنْ يَكُونَ الْبَيْعُ خِيَارًا» قَالَ نَافِعٌ وَكَانَ عَبْدُ اللهِ بْنُ عُمَرَ إِذَا اشْتَرَى شَيْئًا يُعْجِبُهُ فَارَقَ صَاحِبَهُ
"Nafi narrated to us from Ibn 'Umar, who said: 'The Messenger of Allah said: There is no transaction between the two parties until they separate, unless they have chosen to conclude the transaction."" (Sahih ) (Using translation from Nasāʾī 4474)
قَالَ رَسُولُ اللهِ ﷺ «الْمُتَبَايِعَانِ لَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
30.10 Section
٣٠۔١٠ ذِكْرُ الِاخْتِلَافِ عَلَى عَبْدِ اللهِ بْنِ دِينَارٍ فِي لَفْظِ هَذَا الْحَدِيثِ
The Prophet ﷺ said, "No deal is settled and finalized unless the buyer and the seller separate, except if the deal is optional (whereby the validity of the bargain depends on the stipulations agreed upon). (Using translation from Bukhārī 2113)
قَالَ رَسُولُ اللهِ ﷺ «كُلُّ بَيِّعَيْنِ لَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
"When two people meet to engage in trade, the transaction between them is not binding until they separate, unless they have chosen to conclude the transaction." (Using translation from Nasāʾī 4476)
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ «كُلُّ بَيِّعَيْنِ فَلَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
The Prophet ﷺ said, "No deal is settled and finalized unless the buyer and the seller separate, except if the deal is optional (whereby the validity of the bargain depends on the stipulations agreed upon). (Using translation from Bukhārī 2113)
قَالَ رَسُولُ اللهِ ﷺ «كُلُّ بَيِّعَيْنِ لَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
There is no transaction between two persons entering a transaction until they separate, but only when there is an option to annul it. (Using translation from Muslim 1531e)
قَالَ رَسُولُ اللهِ ﷺ «كُلُّ بَيِّعَيْنِ فَلَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
"When two people meet to engage in trade, the transaction between them is not binding until they separate, unless they have chosen to conclude the transaction." (Using translation from Nasāʾī 4476)
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ «كُلُّ بَيِّعَيْنِ فَلَا بَيْعَ بَيْنَهُمَا حَتَّى يَتَفَرَّقَا إِلَّا بَيْعَ الْخِيَارِ»
"Two traders have the choice as long as they have not separated, or, they have chosen to conclude the transaction." (Using translation from Nasāʾī 4480)
عَنِ النَّبِيِّ ﷺ قَالَ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا أَوْ يَكُونَ بَيْعُهُمَا عَنْ خِيَارٍ»
"Two trades have the choice as long as until they reach a deal that suits both of them and they confirm it three times. " (Using translation from Nasāʾī 4481)
«الْبَيِّعَانِ بِالْخِيَارِ حَتَّى يَتَفَرَّقَا أَوْ يَأْخُذَ كُلُّ وَاحِدٍ مِنْهُمَا مِنَ الْبَيْعِ مَا هَوِيَ وَيَتَخَايَرَانِ ثَلَاثَ مِرَارٍ»
"The Messenger of Allah said;" Two traders have the choice as long as they have not separated, or until they reach a deal that suits both of th4em or that is satisfactory (to both)" (Using translation from Nasāʾī 4482)
قَالَ رَسُولُ اللهِ ﷺ «الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا أَوْ يَأْخُذْ أَحَدُهُمَا مَا رَضِيَ مِنْ صَاحِبِهِ وَمَا هَوِيَ»
30.11 [Machine] The necessity of choice for buyers before their physical separation.
٣٠۔١١ وُجُوبُ الْخِيَارِ لِلْمُتَبَايِعَيْنِ قَبْلَ افْتِرَاقِهِمَا بِأَبْدَانِهِمَا
The Prophet ﷺ said: Both parties in a business transaction have a right to annul it so long as they have not separated unless it is a bargain with the option to annul is attached to it; and it is not permissible for one of them to separate from the other for fear that one may demand that the bargain be rescinded. (Using translation from Abū Dāʾūd 3456)
