30. Transactions
٣٠۔ كِتَابُ الْبُيُوعِ
"If a person becomes bankrupt, then a man finds the goods that he sold to him with him, he has more right to them than anyone else." (Using translation from Nasāʾī 4676)
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ أَيُّمَا امْرِئٍ أَفْلَسَ ثُمَّ وَجَدَ رَجُلٌ عِنْدَهُ سِلْعَتَهُ بِعَيْنِهَا فَهُوَ أَوْلَى بِهَا مِنْ غَيْرِهِ
if a man becomes bankrupt, then a specific item is found with him, and is recognized, then it belongs to the one who sold it to him. (Using translation from Nasāʾī 4677)
عَنِ النَّبِيِّ ﷺ عَنِ الرَّجُلِ يُعْدِمُ إِذَا وُجِدَ عِنْدَهُ الْمَتَاعُ بِعَيْنِهِ وَعَرَفَهُ أَنَّهُ لِصَاحِبِهِ الَّذِي بَاعَهُ
In the time of the Messenger of Allah ﷺ a man suffered loss affecting fruits he had bought and owed a large debt, so the Messenger of Allah ﷺ said: Give him sadaqah (alms). So the people gave him sadaqah (alms), but as that was not enough to pay the debt in full, the Messenger of Allah ﷺ said: Take what you find. But that is all you may have. أُصِيبَ رَجُلٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي ثِمَارٍ ابْتَاعَهَا فَكَثُرَ دَيْنُهُ فَقَالَ رَسُولُ اللهِ ﷺ «تَصَدَّقُوا عَلَيْهِ فَتَصَدَّقُوا عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِكَ وَفَاءَ دَيْنِهِ» فَقَالَ رَسُولُ اللهِ ﷺ خُذُوا مَا وَجَدْتُمْ وَلَيْسَ لَكُمْ إِلَّا ذَلِكَ
