٣٠۔٢٦ تَفْسِيرُ ذَلِكَ

"The Messenger of Allah forbade Munabadhah and Mulamash. Mulamasah is when two men trade garments with each other under cover of night, each man touching the garment of the other with his hand> and Munabadhah is when one man throws a garment to another and the other throws a garment to him, and they trade them with each other in that manner." الكبرى للنسائي:٦٠٥٩أَخْبَرَنَا مُحَمَّدُ بْنُ مُصَفَّى بْنِ بُهْلُولٍ عَنْ مُحَمَّدِ بْنِ حَرْبٍ عَنِ الزُّبَيْدِيِّ عَنِ الزُّهْرِيِّ قَالَ سَمِعْتُ سَعِيدًا يَقُولُ

سَمِعْتُ أَبَا هُرَيْرَةَ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُنَابَذَةِ وَالْمُلَامَسَةِ وَالْمُلَامَسَةُ أَنْ يَتَبَايَعَ الرَّجُلَانِ بِالثَّوْبَيْنِ تَحْتَ اللَّيْلِ يَلْمِسُ كُلُّ رَجُلٍ مِنْهُمَا ثَوْبَ صَاحِبِهِ بِيَدِهِ وَالْمُنَابَذَةُ أَنْ يَنْبِذَ الرَّجُلُ إِلَى الرَّجُلِ الثَّوْبَ وَيَنْبِذَ الْآخَرُ إِلَيْهِ الثَّوْبَ فَيَتَبَايَعَا عَلَى ذَلِكَ

Messenger of Allah ﷺ forbade the selling by Munabadha, i.e. to sell one's garment by casting it to the buyer not allowing him to examine or see it. Similarly he forbade the selling by Mulamasa. Mulamasa is to buy a garment, for example, by merely touching it, not looking at it. (Using translation from Bukhārī 2144)

نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُلَامَسَةِ وَالْمُلَامَسَةُ لَمْسُ الثَّوْبِ لَا يَنْظُرُ إِلَيْهِ وَعَنِ الْمُنَابَذَةِ وَالْمُنَابَذَةُ طَرْحُ الرَّجُلِ ثَوْبَهُ إِلَى الرَّجُلِ قَبْلَ أَنْ يُقَلِّبَهُ

"The Messenger of Allah forbade two kinds of garments and two kinds of transactions. As for the two kinds of transactions, they are Mulamash and Munabadhaha. Munabadha is when a man says, 'I throw this garment, and the transaction becomes binding, and Mulamasah is when a man touches it with his had, without spreading it out and checking it, and once he touches it, the transaction becomes binding." نَهَى رَسُولُ اللهِ ﷺ عَنْ لِبْسَتَيْنِ وَعَنْ بَيْعَتَيْنِ أَمَّا الْبَيْعَتَانِ فَالْمُلَامَسَةُ وَالْمُنَابَذَةُ وَالْمُنَابَذَةُ أَنْ يَقُولَ الرَّجُلُ إِذَا نَبَذْتُ هَذَا الثَّوْبَ فَقَدْ وَجَبَ يَعْنِي الْبَيْعَ وَالْمُلَامَسَةُ أَنْ يَمَسَّهُ بِيَدِهِ وَلَا يَنْشُرَهُ وَلَا يُقَلِّبَهُ إِذَا مَسَّهُ وَجَبَ الْبَيْعُ

[Machine] The Messenger of Allah ﷺ prohibited the wearing of two garments, and the Messenger of Allah ﷺ forbade us from selling two types of transactions, namely "munabazah" and "mulamasah", which were forms of transactions that they used to engage in during the pre-Islamic era. Abu Abdur-Rahman said: This is a mistake and Ja'far ibn Burqan is not strong in the narration especially in matters besides this one, and likewise Sufyan ibn Husayn and Sulaiman ibn Kathir.

نَهَى رَسُولُ اللهِ ﷺ عَنْ لِبْسَتَيْنِ وَنَهَانَا رَسُولُ اللهِ ﷺ عَنْ بَيْعَتَيْنِ عَنِ الْمُنَابَذَةِ وَالْمُلَامَسَةِ وَهِيَ بَيُوعٌ كَانُوا يَتَبَايَعُونَ بِهَا فِي الْجَاهِلِيَّةِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا خَطَأٌ وَجَعْفَرُ بْنُ بُرْقَانَ لَيْسَ بِالْقَوِيِّ فِي الزُّهْرِيِّ خَاصَّةً وَفِي غَيْرِهِ لَا بَأْسَ بِهِ وَكَذَلِكَ سُفْيَانُ بْنُ حُسَيْنٍ وَسُلَيْمَانُ بْنُ كَثِيرٍ

Munabadhah and Mulamasha. And he said that Mulamasah means when one man says to another: "I will sell you my garment for your garment," and neither of them looks at the garment of the others, rather he just touches it. And Munabadhah is when he says: "I will throw what I have and you throw what you have," so that they buy from one another, and neither of them knows how much the other has, and so on. (Using translation from Nasāʾī 4517)

عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنْ بَيْعَتَيْنِ أَمَّا الْبَيْعَتَانِ فَالْمُنَابَذَةُ وَالْمُلَامَسَةُ وَزَعَمَ أَنَّ الْمُلَامَسَةَ أَنْ يَقُولَ الرَّجُلُ لِلرَّجُلِ أَبِيعُكَ ثَوْبِي بِثَوْبِكَ وَلَا يَنْظُرُ وَاحِدٌ مِنْهُمَا إِلَى ثَوْبِ الْآخَرِ وَلَكِنْ يَلْمِسُهُ لَمْسًا وَأَمَّا الْمُنَابَذَةُ أَنْ يَقُولَ أَنْبِذُ مَا مَعِي وَتَنْبِذُ مَا مَعَكَ يَشْتَرِي أَحَدُهُمَا مِنَ الْآخَرِ وَلَا يَدْرِي كُلُّ وَاحِدٍ مِنْهُمَا كَمْ مَعَ الْآخَرِ وَنَحْوٌ مِنْ ذَا وَصَفَ إِنْ شَاءَ اللهُ
