٣٠۔ كِتَابُ الْبُيُوعِ ص ٢
"The Messenger of Allah said: 'Do and whoever meets any of them and buys from him the vendor has the choice of annulling the transaction when he comes to the marketplace."' (Using translation from Nasāʾī 4501)
قَالَ رَسُولُ اللهِ ﷺ «لَا تَلَقَّوُا الْجَلْبَ فَمَنْ تَلَقَّاهُ فَاشْتَرَى مِنْهُ فَإِذَا أَتَى سَيِّدُهُ السُّوقَ فَهُوَ بِالْخِيَارِ»
30.19 [Machine] The man's bidding over his brother's bidding
٣٠۔١٩ سَوْمُ الرَّجُلِ عَلَى سَوْمِ أَخِيهِ
The Messenger of Allah said: "No town-dweller should sell for a desert-dweller, do not artificially inflate prices, no man should urge a seller to cancel a sale already agreed upon with another buy so as to by the goods himself, no one should make a proposal over the proposal of his brother and no woman should make a proposal over the proposal of his brother and no woman should ask for her sister in faith) to be divorced so as to turn over what is in her vessel Deprived her of her share of maintenance) and so that she may get married in her place: she will have what Allah has decreed or her." (Using translation from Nasāʾī 4502)
قَالَ رَسُولُ اللهِ ﷺ «لَا يَبِيعَنَّ حَاضِرٌ لِبَادٍ وَلَا تَنَاجَشُوا وَلَا يُسَاوِمِ الرَّجُلُ عَلَى سَوْمِ أَخِيهِ وَلَا يَخْطُبْ عَلَى خِطْبَةِ أَخِيهِ وَلَا تَسْأَلِ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتَكْتَفِئَ مَا فِي إِنَائِهَا وَلْتَنْكِحْ فَإِنَّمَا لَهَا مَا كَتَبَ اللهُ لَهَا»
30.20 [Machine] The sale of a man regarding the sale of his brother.
٣٠۔٢٠ بَيْعُ الرَّجُلِ عَلَى بَيْعِ أَخِيهِ
Messenger of Allah ﷺ said, "Do not urge somebody to return what he has already bought (i.e. in optional sale) from another seller so as to sell him your own goods." (Using translation from Bukhārī 2139)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَبِيعُ أَحَدُكُمْ عَلَى بَيْعِ بَعْضٍ»
"Do not urge someone to cancel a sale he has already agreed upon so as to sell him your own goods, unless he bys or changes his mind." (Using translation from Nasāʾī 4504)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «لَا يَبِيعُ الرَّجُلُ عَلَى بَيْعِ أَخِيهِ حَتَّى يَبْتَاعَ أَوْ يَذَرَ»
30.21 [Machine] In the Najsh
٣٠۔٢١ فِي النَّجْشِ
Messenger of Allah ﷺ forbade the practice of An-Najsh. (Using translation from Bukhārī 6963)
أَنَّ النَّبِيَّ ﷺ نَهَى عَنِ النَّجْشِ
"No tow-dweller should sell for desert-dweller, no man should outbid his brother; and no woman should ask for her sister (in faith) to be divorced so as to turn over what is in her bowl (deprive her of her share of maintenance)" (Using translation from Nasāʾī 4507)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَبِيعُ حَاضِرٌ لِبَادٍ وَلَا تَنَاجَشُوا وَلَا يَزِيدُ الرَّجُلُ عَلَى بَيْعِ أَخِيهِ وَلَا تَسْأَلُ الْمَرْأَةُ طَلَاقَ أُخْتِهَا لِتَسْتَكْفِئَ بِهِ مَا فِي صَحْفَتِهَا»
30.22 [Machine] Sales in excess
٣٠۔٢٢ الْبَيْعُ فِيمَنْ يَزِيدُ
the Messenger of Allah sold a drinking bowl and a blanket (for a horse of camel) to the highest bidder ' (Using translation from Nasāʾī 4508)
أَنَّ رَسُولَ ﷺ بَاعَ قَدَحًا وَحِلْسًا فِيمَنْ يَزِيدُ
30.23 [Machine] The Sale of Touch Sensation
٣٠۔٢٣ بَيْعُ الْمُلَامَسَةِ
Messenger of Allah ﷺ forbade selling by Mulamasa and Munabadha. (Using translation from Bukhārī 2146)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ
30.24 [Machine] The interpretation of that.
٣٠۔٢٤ تَفْسِيرُ ذَلِكَ
the Messenger of Allah forbade Mulamasah, which means touching a garment without looking at it, and Munabadha, which is where one man sells his garment to another man, by throwing it to him, without him checking it or looking at it. (Using translation from Nasāʾī 4510)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُلَامَسَةِ لَمْسِ الثَّوْبِ لَا يَنْظُرُ إِلَيْهِ وَعَنِ الْمُنَابَذَةِ وَهِيَ طَرْحُ الرَّجُلِ ثَوْبَهُ إِلَى الرَّجُلِ بِالْبَيْعِ قَبْلَ أَنْ يُقَلِّبَهُ أَوْ يَنْظُرَ إِلَيْهِ

٣٠۔٢٥ بَيْعُ الْمُنَابَذَةِ
"The Messenger of Allah forbade two kinds of transactions: Mulamash and Munabddhah " (Using translation from Nasāʾī 4511)
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُلَامَسَةِ وَالْمُنَابَذَةِ فِي الْبَيْعِ
"The Messenger of Allah ﷺ forbade two kinds of transactions: Mulimasah and Mundbadhah. (Using translation from Ibn Mājah 2169)
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعَتَيْنِ الْمُلَامَسَةُ وَالْمُنَابَذَةُ
30.26 [Machine] Translation: "Interpretation of that
٣٠۔٢٦ تَفْسِيرُ ذَلِكَ
"The Messenger of Allah forbade Munabadhah and Mulamash. Mulamasah is when two men trade garments with each other under cover of night, each man touching the garment of the other with his hand> and Munabadhah is when one man throws a garment to another and the other throws a garment to him, and they trade them with each other in that manner." (Using translation from Nasāʾī 4513)
سَمِعْتُ أَبَا هُرَيْرَةَ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُنَابَذَةِ وَالْمُلَامَسَةِ وَالْمُلَامَسَةُ أَنْ يَتَبَايَعَ الرَّجُلَانِ بِالثَّوْبَيْنِ تَحْتَ اللَّيْلِ يَلْمِسُ كُلُّ رَجُلٍ مِنْهُمَا ثَوْبَ صَاحِبِهِ بِيَدِهِ وَالْمُنَابَذَةُ أَنْ يَنْبِذَ الرَّجُلُ إِلَى الرَّجُلِ الثَّوْبَ وَيَنْبِذَ الْآخَرُ إِلَيْهِ الثَّوْبَ فَيَتَبَايَعَا عَلَى ذَلِكَ
Messenger of Allah ﷺ forbade the selling by Munabadha, i.e. to sell one's garment by casting it to the buyer not allowing him to examine or see it. Similarly he forbade the selling by Mulamasa. Mulamasa is to buy a garment, for example, by merely touching it, not looking at it. (Using translation from Bukhārī 2144)
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُلَامَسَةِ وَالْمُلَامَسَةُ لَمْسُ الثَّوْبِ لَا يَنْظُرُ إِلَيْهِ وَعَنِ الْمُنَابَذَةِ وَالْمُنَابَذَةُ طَرْحُ الرَّجُلِ ثَوْبَهُ إِلَى الرَّجُلِ قَبْلَ أَنْ يُقَلِّبَهُ
"The Messenger of Allah forbade two kinds of garments and two kinds of transactions. As for the two kinds of transactions, they are Mulamash and Munabadhaha. Munabadha is when a man says, 'I throw this garment, and the transaction becomes binding, and Mulamasah is when a man touches it with his had, without spreading it out and checking it, and once he touches it, the transaction becomes binding." نَهَى رَسُولُ اللهِ ﷺ عَنْ لِبْسَتَيْنِ وَعَنْ بَيْعَتَيْنِ أَمَّا الْبَيْعَتَانِ فَالْمُلَامَسَةُ وَالْمُنَابَذَةُ وَالْمُنَابَذَةُ أَنْ يَقُولَ الرَّجُلُ إِذَا نَبَذْتُ هَذَا الثَّوْبَ فَقَدْ وَجَبَ يَعْنِي الْبَيْعَ وَالْمُلَامَسَةُ أَنْ يَمَسَّهُ بِيَدِهِ وَلَا يَنْشُرَهُ وَلَا يُقَلِّبَهُ إِذَا مَسَّهُ وَجَبَ الْبَيْعُ
[Machine] The Messenger of Allah ﷺ prohibited the wearing of two garments, and the Messenger of Allah ﷺ forbade us from selling two types of transactions, namely "munabazah" and "mulamasah", which were forms of transactions that they used to engage in during the pre-Islamic era. Abu Abdur-Rahman said: This is a mistake and Ja'far ibn Burqan is not strong in the narration especially in matters besides this one, and likewise Sufyan ibn Husayn and Sulaiman ibn Kathir.
نَهَى رَسُولُ اللهِ ﷺ عَنْ لِبْسَتَيْنِ وَنَهَانَا رَسُولُ اللهِ ﷺ عَنْ بَيْعَتَيْنِ عَنِ الْمُنَابَذَةِ وَالْمُلَامَسَةِ وَهِيَ بَيُوعٌ كَانُوا يَتَبَايَعُونَ بِهَا فِي الْجَاهِلِيَّةِ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا خَطَأٌ وَجَعْفَرُ بْنُ بُرْقَانَ لَيْسَ بِالْقَوِيِّ فِي الزُّهْرِيِّ خَاصَّةً وَفِي غَيْرِهِ لَا بَأْسَ بِهِ وَكَذَلِكَ سُفْيَانُ بْنُ حُسَيْنٍ وَسُلَيْمَانُ بْنُ كَثِيرٍ
Munabadhah and Mulamasha. And he said that Mulamasah means when one man says to another: "I will sell you my garment for your garment," and neither of them looks at the garment of the others, rather he just touches it. And Munabadhah is when he says: "I will throw what I have and you throw what you have," so that they buy from one another, and neither of them knows how much the other has, and so on. عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنْ بَيْعَتَيْنِ أَمَّا الْبَيْعَتَانِ فَالْمُنَابَذَةُ وَالْمُلَامَسَةُ وَزَعَمَ أَنَّ الْمُلَامَسَةَ أَنْ يَقُولَ الرَّجُلُ لِلرَّجُلِ أَبِيعُكَ ثَوْبِي بِثَوْبِكَ وَلَا يَنْظُرُ وَاحِدٌ مِنْهُمَا إِلَى ثَوْبِ الْآخَرِ وَلَكِنْ يَلْمِسُهُ لَمْسًا وَأَمَّا الْمُنَابَذَةُ أَنْ يَقُولَ أَنْبِذُ مَا مَعِي وَتَنْبِذُ مَا مَعَكَ يَشْتَرِي أَحَدُهُمَا مِنَ الْآخَرِ وَلَا يَدْرِي كُلُّ وَاحِدٍ مِنْهُمَا كَمْ مَعَ الْآخَرِ وَنَحْوٌ مِنْ ذَا وَصَفَ إِنْ شَاءَ اللهُ
30.27 [Machine] The sale of stones
٣٠۔٢٧ بَيْعُ الْحَصَاةِ
"The Messenger of Allah ﷺ forbade Gharar transaction sand Hasah transactions. " (Using translation from Ibn Mājah 2194)
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْحَصَاةِ وَعَنْ بَيْعِ الْغَرَرِ
30.28 [Machine] Selling fruit before it ripens.
٣٠۔٢٨ بَيْعُ الثَّمَرِ قَبْلَ أَنْ يَبْدُوَ صَلَاحُهُ
"Do not sell fruits until they have ripened." And he forbade (both) the seller and the purchaser (to engage in such a transaction). (Using translation from Ibn Mājah 2214)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «لَا تَبِيعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ» نَهَى الْبَائِعَ وَالْمُشْتَرِيَ
[Machine] The Messenger of Allah ﷺ prohibited selling fruit until its goodness is apparent. Yunus ibn 'Abd al-A'la and al-Harith ibn Muskin narrated it to me. I heard it from Ibn Wahb, who said that Yunus narrated it from Ibn Shihab, who said that Sa'id and Abu Salamah told him that Abu Hurairah said that the Messenger of Allah ﷺ said, "Do not sell fruit until its goodness is apparent, and do not sell fruit with dates." Ibn Shihab said that Salim ibn 'Abdullah narrated it from his father that the Messenger of Allah ﷺ prohibited something similar.
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ 6067 أَخْبَرَنِي يُونُسُ بْنُ عَبْدِ الْأَعْلَى وَالْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ عَنِ ابْنِ وَهْبٍ قَالَ أَخْبَرَنِي يُونُسُ عَنِ ابْنِ شِهَابٍ قَالَ حَدَّثَنِي سَعِيدٌ وَأَبُو سَلَمَةَ أَنَّ أَبَا هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللهِ ﷺ «لَا تَبَايَعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهَا وَلَا تَتَبَايَعُوا الثَّمَرَ بِالتَّمْرِ» قَالَ ابْنُ شِهَابٍ حَدَّثَنِي سَالِمُ بْنُ عَبْدِ اللهِ عَنْ أَبِيهِ أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ مِثْلِهِ سَوَاءً
"The Messenger of Allah stood up among us ad said: 'Do not sell fruits until their condition is known."" (Using translation from Nasāʾī 4522)
سَمِعْتُ عَبْدَ اللهِ بْنَ عُمَرَ يَقُولُ قَامَ فِينَا رَسُولُ اللهِ ﷺ فَقَالَ «لَا تَبِيعُوا الثَّمَرَ حَتَّى يَبْدُوَ صَلَاحُهُ»
"I heard Jabir bin 'Abdullah (narrate) from the Prophet that he forbade Mukhabarah, Muzabanah and Muhaqalah, an (he forbade) selling fruits until their condition is known, an that they should only sold for Dinars and Dirhams, but he granted a concession regarding the sale of Araya: (Using translation from Nasāʾī 4523)
عَنِ النَّبِيِّ ﷺ أَنَّهُ نَهَى عَنِ الْمُخَابَرَةِ وَالْمُزَابَنَةِ وَالْمُحَاقَلَةِ وَأَنْ يُبَاعَ الثَّمَرُ حَتَّى يَبْدُوَ صَلَاحُهُ وَأَنْ يُبَاعَ إِلَّا بِالدِّينَارِ وَالدِّرْهَمِ وَرَخَّصَ فِي الْعَرَايَا
the Prophet forbade Mukhabarah, Muzabanah and Muhaqalah, and selling fruits until they were fit to eat, except in the case f 'Aray. (Using translation from Nasāʾī 4524)
أَنَّ النَّبِيَّ ﷺ نَهَى عَنِ الْمُخَابَرَةِ وَالْمُزَابَنَةِ وَالْمُحَاقَلَةِ وَعَنْ بَيْعِ الثَّمَرِ حَتَّى يُطْعَمَ إِلَّا الْعَرَايَا
"the Messenger of Allah forbade selling the fruit of date palms until they are fit to eat." (Using translation from Nasāʾī 4525)
«نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ النَّخْلِ حَتَّى تُطْعَمَ»
30.29 [Machine] The purchase of fruits before their ripeness, before they are cut, and not leaving them until they are fully ripe.
٣٠۔٢٩ شِرَاءُ الثِّمَارِ قَبْلَ أَنْ يَبْدُوَ صَلَاحُهَا عَلَى أَنْ يَقْطَعَهَا وَلَا يَتْرُكَهَا إِلَى أَوَانِ إِدْرَاكِهَا
the Messenger of Allah forbade selling fruits before they ripen. It was said: "O Messenger of Allah what does ripen mean?" he said: 'when they turn red." And the Messenger of Allah said: "What do you think if Allah withholds the fruits (causes it not to ripen), why would any one of you take his brother's wealth?" (Using translation from Nasāʾī 4526)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنْ بَيْعِ الثِّمَارِ حَتَّى تُزْهِيَ قِيلَ يَا رَسُولَ اللهِ وَمَا تُزْهِيَ؟ قَالَ «حَتَّى تَحْمَرَّ» وَقَالَ رَسُولُ اللهِ ﷺ «أَرَأَيْتَ إِنْ مَنَعَ اللهُ الثَّمَرَةَ فَبِمَ يَأْخُذُ أَحَدُكُمْ مَالَ أَخِيهِ؟»
30.30 [Machine] The Situation of Epidemics
٣٠۔٣٠ وَضْعُ الْجَوَائِحِ
The Messenger of Allah ﷺ as saying: If you were to sell dried dates to your brother and they were smitten by blight, it will not be allowable for you to take your brother's property unjustly. (Using translation from Abū Dāʾūd 3470)
قَالَ رَسُولُ اللهِ ﷺ «إِنْ بِعْتَ مِنْ أَخِيكَ ثَمَرًا فَأَصَابَتْهُ جَائِحَةٌ فَلَا يَحِلُّ لَكَ أَنْ تَأْخُذَ مِنْهُ شَيْئًا بِمَ تَأْخُذُ مَالَ أَخِيكَ بِغَيْرِ حَقٍّ؟»
"Whoever sells fruit then his crop fails, he should not take (anything) from his brother." (And he said something along the lines of) "Why would anyone of you consume the wealth of his Muslim brother?" (Using translation from Nasāʾī 4528)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ بَاعَ ثَمَرًا فَأَصَابَهُ جَائِحَةٌ فَلَا يَأْخُذْ مِنْ أَخِيهِ وَذَكَرَ شَيْئًا عَلَامَ يَأْكُلُ أَحَدُكُمْ مَالَ أَخِيهِ الْمُسْلِمِ»
the Prophet annulled transaction in the event of crop faioure. (Using translation from Nasāʾī 4529)
أَنَّ النَّبِيَّ ﷺ وَضَعَ الْجَوَائِحَ
In the time of the Messenger of Allah ﷺ a man suffered loss affecting fruits he had bought and owed a large debt, so the Messenger of Allah ﷺ said: Give him sadaqah (alms). So the people gave him sadaqah (alms), but as that was not enough to pay the debt in full, the Messenger of Allah ﷺ said: Take what you find. But that is all you may have. (Using translation from Abū Dāʾūd 3469)
أُصِيبَ رَجُلٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فِي ثِمَارٍ ابْتَاعَهَا فَكَثُرَ دَيْنُهُ فَقَالَ رَسُولُ اللهِ ﷺ «تَصَدَّقُوا عَلَيْهِ» فَتَصَدَّقَ النَّاسُ عَلَيْهِ فَلَمْ يَبْلُغْ ذَلِكَ وَفَاءَ دَيْنِهِ فَقَالَ رَسُولُ اللهِ ﷺ «خُذُوا مَا وَجَدْتُمْ وَلَيْسَ لَكُمْ إِلَّا ذَلِكَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا أَصَحُّ مِنْ حَدِيثِ سُلَيْمَانَ بْنِ عَتِيقٍ
30.31 [Machine] Sale of fruit for years
٣٠۔٣١ بَيْعُ الثَّمَرِ سِنِينَ
the Prophet forbade selling the harvest for a number of years (in advance.) (Using translation from Nasāʾī 4531)
أَنَّ النَّبِيِّ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ سِنِينَ
30.32 [Machine] Selling fruits with dates
٣٠۔٣٢ بَيْعُ الثَّمَرِ بِالتَّمْرِ
the Prophet forbade selling fresh dates still on the tree for dried dates. Ibn 'Umar said: "Azid bin Thabit narrated to me, that Messenger of Allah permitted that in the case o 'Ayaya"' (Using translation from Nasāʾī 4532)
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ بِالتَّمْرِ وَقَالَ ابْنُ عُمَرَ حَدَّثَنِي زَيْدُ بْنُ ثَابِتٍ أَنَّ رَسُولَ اللهِ ﷺ رَخَّصَ فِي بَيْعِ الْعَرَايَا
Ibn 'Umar (Allah be pleased with them) reported Messenger of Allah ﷺ having forbidden Muzabana, and Muzabana implies the selling of dry dates for fresh dates on the tree with a definite measure (making it clear) that in case it increases, it belongs to me and if it is less, it is my responsibility. (Using translation from Muslim 1542e)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عنِ الْمُزَابَنَةِ وَالْمُزَابَنَةُ أَنْ يُبَاعَ مَا فِي رُءُوسِ النَّخْلِ بِتَمْرٍ بِكَيْلٍ مُسَمًّى إِنْ زَادَ فَلِي وَإِنْ نَقَصَ فَعَلَيَّ
30.33 [Machine] Selling grapes with raisins
٣٠۔٣٣ بَيْعُ الْكَرْمِ بِالزَّبِيبِ
Ibn Umar (Allah be pleased them) reported Messenger of Allah ﷺ having forbidden Muzabana, and Muzabana implies the selling of fresh dates for dry dates by measuring them out and the selling of raisins by measure for grapes. (Using translation from Muslim 1542a)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى يَعْنِي عَنِ الْمُزَابَنَةِ وَالْمُزَابَنَةُ بَيْعُ الثَّمَرِ بِالتَّمْرِ كَيْلًا وَبَيْعُ الْكَرْمِ بِالزَّبِيبِ كَيْلًا
The Prophet ﷺ forbade Muzabana and Muhaqala. (Using translation from Bukhārī 2187)
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُحَاقَلَةِ وَالْمُزَابَنَةِ
30.34 [Machine] Sale of clothing
٣٠۔٣٤ بَيْعُ الْعَرِيَّةِ
"Zaid bin Thabit narrated to me that the Messenger of Allah ﷺ gave a concession regarding the sale of 'Araya.” (Using translation from Ibn Mājah 2268)
أَنَّ رَسُولَ اللهِ ﷺ رَخَّصَ فِي الْعَرَايَا
The Prophet ﷺ gave license for the sale of 'araya for dried dates and fresh dates. (Using translation from Abū Dāʾūd 3362)
أَنَّ النَّبِيَّ ﷺ رَخَّصَ فِي بَيْعِ الْعَرَايَا بِالتَّمْرِ وَالرُّطَبِ
30.35 [Machine] The sale of naked dates by bunch
٣٠۔٣٥ بَيْعُ الْعَرَايَا بِخَرْصِهَا تَمْرًا
Zaid b. Thabit (Allah be pleased with him) reported Messenger of Allah ﷺ granting concession in case of 'ariyya transactions and that implies selling of (dry dates for fresh dates) according to a measure. (Using translation from Muslim 1539h)
أَنَّ رَسُولَ اللهِ ﷺ رَخَّصَ فِي الْعَرَايَا تُبَاعُ بِخَرْصِهَا

٣٠۔٣٦ بَيْعُ الْعَرَايَا بِالرُّطَبِ
"The Messenger of Allah granted a concession allowing 'Araya sales for fresh dates and for dried dates, but he did not allow anything other than that." (Using translation from Nasāʾī 4540)
أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ رَخَّصَ فِي بَيْعِ الْعَرَايَا بِالرُّطَبِ وَبِالتَّمْرِ وَلَمْ يُرَخِّصْ فِي غَيْرِ ذَلِكَ
It was narrated from Au Hurairah that the prophet granted a concession allowing estimation for 'Ararya sales, so long as they were five Wasq or less then that (Using translation from Nasāʾī 4541)
أَنَّ النَّبِيَّ ﷺ رَخَّصَ فِي الْعَرَايَا أَنْ تُبَاعَ بِخَرْصِهَا فِي خَمْسَةِ أَوْسُقٍ أَوْ مَا دُونَ خَمْسَةٍ
It was narrated from Sahl bin Abi Hathamah that the Prophet forbade selling fruits before their condition was known, but he granted a concession allowing 'Araya sales by estimate, so its people could eat fresh dates. (Using translation from Nasāʾī 4542)
أَنَّ النَّبِيَّ ﷺ نَهَى عَنْ بَيْعِ الثَّمَرِ حَتَّى يَبْدُوَ صَلَاحُهُ وَرَخَّصَ فِي الْعَرَايَا أَنْ تُبَاعَ بِخَرْصِهَا يَأْكُلُهَا أَهْلُهَا رُطَبًا
Rafi bin Khadij and Sahl Bi Abi Hathamah narrated that the Messenger of Allah forbade Muzabanah, which means selling fresh dates still on the tree for dried dates, except in cases of 'Araya, for which he gave permission. (Sahih (Using translation from Nasāʾī 4543)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُزَابَنَةِ بَيْعُ الثَّمَرِ بِالتَّمْرِ إِلَّا أَصْحَابَ الْعَرَايَا فَإِنَّهُ أَذِنَ لَهُمْ

٣٠۔٣٧ اشْتِرَاءُ التَّمْرِ بِالرُّطَبِ
"The Messenger of Allah was asked about (buying) fresh dates with dried dates, and he said to those who were around him: 'Will fresh dates decrease (in weight or volume) when they dry out?" they said Yes,' so he forbade that." (Using translation from Nasāʾī 4545)
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ التَّمْرِ بِالرُّطَبِ فَقَالَ لِمَنْ حَوْلَهُ «أَيَنْقُصُ الرُّطَبُ إِذَا يَبِسَ؟» قَالُوا نَعَمْ فَنَهَى عَنْهُ
"The Messenger of Allah was asked about (buying) said; 'Will fresh dates decrees (in weight or volume) when they dry out? 'They said 'yes so he forbade that" (Using translation from Nasāʾī 4546)
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ الرُّطَبِ بِالتَّمْرِ فَقَالَ «أَيَنْقُصُ إِذَا يَبِسَ؟» قَالَ نَعَمْ فَنَهَى عَنْهُ
30.38 [Machine] The sale of patience from dates, the known weight of which is unknown.
٣٠۔٣٨ بَيْعُ الصُّبْرَةِ مِنَ التَّمْرِ، لَا يُعْلَمُ مَكِيلَتُهَا بِالْكَيْلِ الْمُسَمَّى مِنَ التَّمْرِ
"The Messenger of Allah forbade selling a heap of dried dates whose volume is unknown for known volume of dried dates," (Using translation from Nasāʾī 4547)
أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ يَقُولُ نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الصُّبْرَةِ مِنَ التَّمْرِ لَا يُعْلَمُ مَكِيلَتُهَا بِالْكَيْلِ الْمُسَمَّى مِنَ التَّمْرِ

٣٠۔٣٩ بَيْعُ الصُّبْرَةِ مِنَ الطَّعَامِ بِالصُّبْرَةِ مِنَ الطَّعَامِ
"The Prophet said: ' A heap of grain should not be sold for a heap of grain, or for a heap of grain of known measure. " (Using translation from Nasāʾī 4548)
قَالَ النَّبِيُّ ﷺ «لَا تُبَاعُ الصُّبْرَةُ مِنَ الطَّعَامِ بِالصُّبْرَةِ مِنَ الطَّعَامِ وَلَا الصُّبْرَةُ مِنَ الطَّعَامِ بِالْكَيْلِ مِنَ الطَّعَامِ الْمُسَمَّى»
30.40 [Machine] Selling crops for food
٣٠۔٤٠ بَيْعُ الزَّرْعِ بِالطَّعَامِ
Messenger of Allah ﷺ forbade Al-Muzabana, i.e. to sell ungathered dates of one's garden for measured dried dates or fresh ungathered grapes for measured dried grapes; or standing crops for measured quantity of foodstuff. He forbade all such bargains. (Using translation from Bukhārī 2205)
نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُزَابَنَةِ أَنْ يَبِيعَ ثَمَرَ حَائِطِهِ وَإِنْ كَانَ نَخْلًا بِتَمْرٍ كَيْلًا وَإِنْ كَانَ كَرْمًا أَنْ يَبِيعَهُ بِزَبِيبٍ كَيْلًا أَوْ كَانَ زَرْعًا أَنْ يَبِيعَهُ بِكَيْلِ طَعَامٍ نَهَى عَنْ ذَلِكَ كُلِّهِ
the Messenger of Allah forbade Mukhabarah, Muzabanah and Muhaqalah, and selling dates before they arte fit or eating, and selling them for anything except Dinars and Dirhams. ," (Using translation from Nasāʾī 4550)
أَنَّ رَسُولَ اللهِ ﷺ نَهَى عَنِ الْمُخَابَرَةِ وَالْمُزَابَنَةِ وَالْمُحَاقَلَةِ وَعَنْ بَيْعِ الثَّمَرَةِ قَبْلَ أَنْ تُطْعَمَ وَعَنْ بَيْعِ ذَلِكَ إِلَّا بِالدَّنَانِيرِ وَالدَّرَاهِمِ
the Prophet forbade Mukhabarah, Muzabanah and Muhaqalah, and selling fruits until they were fit to eat, except in the case f 'Aray. (Using translation from Nasāʾī 4524)

30.41 [Machine] The sale of wheat until it whitens
٣٠۔٤١ بَيْعُ السُّنْبُلِ حَتَّى يَبْيَضَّ
The Messenger of Allah ﷺ forbade selling palm-trees till the dates began to ripen, and ears of corn till they were white and were safe from blight, forbidding it both to the buyer and to the seller. (Using translation from Abū Dāʾūd 3368)
