٣٠۔ كِتَابُ الْبُيُوعِ ص ٣
a man form among the companions of the Prophet told him, he said: "O Messenger of Allah we cannot buy Saihani dates or 'idhq dates for the same amount of mixed dates (which are of inferior quality). Should we increase (the amount we give in payment for the better quality dates)?" The messenger of Allah said: "Sell them for silver them buy with it" (Using translation from Nasāʾī 4552)
أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ أَخْبَرَهُ قَالَ يَا رَسُولَ اللهِ إِنَّا لَا نَجْدُ الصَّيْحَانِيَّ وَلَا الْعِذْقَ بِجَمْعِ التَّمْرِ حَتَّى نَزِيدَهُمْ فَقَالَ رَسُولُ اللهِ ﷺ «بِعْهُ بِالْوَرِقِ ثُمَّ اشْتَرِهِ»
30.42 [Machine] Selling Dates with Different Dates
٣٠۔٤٢ بَيْعُ التَّمْرِ بِالتَّمْرِ مُتَفَاضِلًا
Messenger of Allah ﷺ appointed somebody as a governor of Khaibar. That governor brought to him an excellent kind of dates (from Khaibar). The Prophet ﷺ asked, "Are all the dates of Khaibar like this?" He replied, "By Allah, no, O Messenger of Allah ﷺ! But we barter one Sa of this (type of dates) for two Sas of dates of ours and two Sas of it for three of ours." Messenger of Allah ﷺ said, "Do not do so (as that is a kind of usury) but sell the mixed dates (of inferior quality) for money, and then buy good dates with that money." أَنَّ رَسُولَ اللهِ ﷺ اسْتَعْمَلَ رَجُلًا عَلَى خَيْبَرَ فَجَاءَ بِتَمْرٍ جَنِيبٍ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «أَكُلُّ تَمْرِ خَيْبَرَ هَكَذَا؟» قَالَ لَا وَاللهِ يَا رَسُولَ اللهِ إِنَّا لَنَأْخُذُ الصَّاعَ مِنْ هَذَا بِالصَّاعَيْنِ وَالصَّاعَيْنِ بِالثَّلَاثَةِ فَقَالَ رَسُولُ اللهِ ﷺ «لَا تَفْعَلْ بِعِ الْجَمْعَ بِالدَّرَاهِمِ ثُمَّ ابْتَعْ بِالدَّرَاهِمِ جَنِيبًا»
some dates from trees that were irrigated artificially were brought to the Messenger of Allah and the dates of the messenger of Allah were dates from trees that were nourished by their roots. He said: "Where did you get these from?" They said: "We bought a Sa of them for two Sa s of our dates: He said: "Do not do that, for this is not right. Rather sell your dates and but what you need of these," (Using translation from Nasāʾī 4554)
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِتَمْرٍ رَيَّانَ وَكَانَ تَمْرُ رَسُولِ اللهِ ﷺ بَعْلًا فِيهِ يُبْسٌ قَالَ «أَنَّى لَكُمْ هَذَا؟» قَالُوا ابْتَعْنَاهُ صَاعًا بِصَاعَيْنِ مِنْ تَمْرِنَا فَقَالَ «لَا تَفْعَلْ فَإِنَّ هَذَا لَا يَصْلُحُ بِعْ تَمْرَكَ وَاشْتَرِ مِنْ هَذَا حَاجَتَكَ»
"We used to be given mixed dates during the time of the Messenger of Allah and we would sell two Sa s for one Sa News of that reached the Messenger of Allah and he said Do not sell) two Sa s of dates for a Sa, or two Sa s of wheat for s Sa or a Dirham for two Dirhams. ," (Using translation from Nasāʾī 4555)
كُنَّا نُرْزَقُ تَمْرَ الْجَمْعِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَنَبِيعُ الصَّاعَيْنِ بِالصَّاعِ فَبَلَغَ ذَلِكَ رَسُولَ اللهِ ﷺ فَقَالَ «لَا صَاعَيْ تَمْرٍ بِصَاعٍ وَلَا صَاعَيْ حِنْطَةٍ بِصَاعٍ وَلَا دِرْهَمًا بِدِرْهَمَيْنِ»
"We used to sell two Sa s of mixed dates for a Sa but the Prophet said (Do not sell) two Sa s dates for a Sa or two Sa s wheat or a Sa or two Dirhams for a Dirham. ," (Using translation from Nasāʾī 4556)
النَّبِيُّ ﷺ «لَا صَاعَيْ تَمْرٍ بِصَاعٍ وَلَا صَاعَيْ حِنْطَةٍ بِصَاعٍ وَلَا دِرْهَمَيْنِ بِدِرْهَمٍ»
"Bilal brought some Bami dates to the Messenger of Allah and he said: 'What is this? 'He said: 'I bought a Sa of them for two Sas. The Messenger of Allah said: "O! The essence of Riba, do not approach it."' (Using translation from Nasāʾī 4557)
أَتَى بِلَالٌ رَسُولَ اللهِ ﷺ بِتَمْرٍ بَرْنِيٍّ فَقَالَ «مَا هَذَا؟» فَقَالَ اشْتَرَيْتَهُ صَاعًا بِصَاعَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ «أَوِّهْ عَيْنُ الرِّبَا لَا تَقْرَبْهُ»

٣٠۔٤٣ الرِّبَا
l brought some dinars of mine and wanted to exchange them. Talhah bin ‘Ubaidullah met me and we agreed to an exchange. Then he took them and said: Wait until my storekeeper comes - Abu ʿAmir said. From al-Ghalal (a place). And he said concerning it. All of it should be ‘Take this’ and ʿtake thisʿ [i.e., exchanged on the spot]. - I asked ‘Umar bin al-Khattab ؓ about that and he said: I heard the Messenger of Allah ﷺ say: ʿSilver for gold is riba, unless it is exchanged on the spot, wheat for wheat is riba, unless it is exchanged on the spot; barley for barley is riba, unless it is exchanged on the spot dates for dates is ribu unless it is exchanged on the spot.” (Using translation from Aḥmad 314)
قَالَ رَسُولُ اللهِ ﷺ «الذَّهَبُ يَعْنِي بِالْوَرِقِ رِبًا إِلَّا هَاءَ وَهَاءَ وَالْبُرُّ بِالْبُرِّ رَبًّا إِلَّا هَاءَ وَهَاءَ وَالشَّعِيرُ بِالشَّعِيرِ رَبًّا إِلَّا هَاءَ وَهَاءَ وَالتَّمْرُ بِالتَّمْرِ رَبًّا إِلَّا هَاءَ وَهَاءَ»
30.44 [Machine] Dates with dates
٣٠۔٤٤ التَّمْرُ بِالتَّمْرِ
"The Messenger of Allah said: 'Dates for dates, wheat for wheat, barley for barley, salt for salt, exchanged hand to hand. Whoever gives more or takes more has engaged in Riba unless they are of different types." (Using translation from Nasāʾī 4559)
قَالَ رَسُولُ اللهِ ﷺ «التَّمْرُ بِالتَّمْرِ وَالْحِنْطَةُ بِالْحِنْطَةِ وَالشَّعِيرُ بِالشَّعِيرِ وَالْمِلْحُ بِالْمِلْحِ يَدًا بَيْدٍ فَمَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى إِلَّا مَا اخْتَلَفَتْ أَلْوَانُهُ»
30.45 [Machine] Selling goods with goods
٣٠۔٤٥ بَيْعُ الْبُرِّ بِالْبُرِّ
"Ubadah bin As-Samit and Muawiyah met at a stopping place on the road. 'Ubadah told them: 'The Messenger of Allah forbade selling gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates"'- one of them said: 'salt for salt,"' but the other did not say it-"unless it was like for like, hand to hand. And he commanded us to sell gold for silver and silver for gold, and wheat for barley and barley for wheat, and to hand, however we wanted."' And one of them said: "Whoever gives more or ask for more has engaged in Riba."' (Using translation from Nasāʾī 4560)
نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الذَّهَبِ بِالذَّهَبِ وَالْوَرِقِ بِالْوَرِقِ وَالْبُرِّ بِالْبُرِّ وَالشَّعِيرِ بِالشَّعِيرِ وَالتَّمْرِ بِالتَّمْرِ قَالَ أَحَدُهُمَا وَالْمِلْحِ بِالْمِلْحِ وَلَمْ يَقُلْهُ الْآخَرُ إِلَّا مِثْلًا بِمِثْلٍ يَدًا بَيْدٍ وَأَمَرَنَا أَنْ نَبِيعَ الذَّهَبَ بِالْوَرِقِ وَالْوَرِقَ بِالذَّهَبِ وَالْبُرَّ بِالشَّعِيرِ وَالشَّعِيرَ بِالْبُرِّ يَدًا بَيْدٍ كَيْفَ شِئْنَا قَالَ أَحَدُهُمَا فَمَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى
"The Messenger of Allah forbade selling gold for gold, silver for silver, dates for dates, wheat for wheat, barley for barley"- one of them said: "salt for salt," but the other did not say it-"unless it was equal amount for equal amount, like for like." One of them said: "Whoever gives more or takes more has engaged in Riba," but he other one did not say it. "And he commanded us to sell gold for silver and silver for gold, and wheat for barley and barley for wheat, hand to hand, however we wanted." (Using translation from Nasāʾī 4561)
نَهَانَا رَسُولُ اللهِ ﷺ عَنْ الذَّهَبِ بِالذَّهَبِ وَالْفِضَّةِ بِالْفِضَّةِ وَالتَّمْرِ بِالتَّمْرِ وَالْبُرِّ بِالْبُرِّ وَالشَّعِيرِ بِالشَّعِيرِ قَالَ أَحَدُهُمَا وَالْمِلْحِ بِالْمِلْحِ وَلَمْ يَقُلْهُ الْآخَرُ إِلَّا سَوَاءً بِسَوَاءٍ مِثْلًا بِمِثْلٍ قَالَ أَحَدُهُمَا مَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى وَلَمْ يَقُلِ الْآخَرُ وَأُمِرْنَا أَنْ نَبِيعَ الذَّهَبَ بِالْفِضَّةِ وَالْفِضَّةَ بِالذَّهَبِ وَالْبُرَّ بِالشَّعِيرِ وَالشَّعِيرَ بِالْبُرِّ يَدًا بَيْدٍ كَيْفَ شِئْنَا
30.46 [Machine] Selling Barley with Barley
٣٠۔٤٦ بَيْعُ الشَّعِيرِ بِالشَّعِيرِ
"Ubadah bin As-Samit and Muawiyah met at a stopping place on the road. 'Ubadah said: 'The Messenger of Allah forbade us to sell gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates"' - one of them said: "salt for salt, " but the other did not say "unless it was equal amount for equal amount, like for like." One of them said: "Whoever gives more or takes more has engaged in Riba," but the other one did not say it. News of this hadith reached Muawiyah and he stood up and said: 'What is the matter with men who narrate Hadiths from the Messenger of Allah when we accompanied him and we never heard him say it? News of that reached 'Ubadah bin As-Samit and he stood up and repeated the Hadith, then he said: 'We will narrate what we heard from the Messenger of Allah, whether Muawiyah likes it or not."' Qatadah contradicted him, he reported it from Muslim bin Yasar, from Abu Al-=Ashath, from 'Ubadah. (Using translation from Nasāʾī 4562)
عُبَادَةُ نَهَى رَسُولُ اللهِ ﷺ عَنْ أَنْ نَبِيعَ الذَّهَبَ بِالذَّهَبِ وَالْوَرِقَ بِالْوَرِقِ وَالْبُرَّ بِالْبُرِّ وَالشَّعِيرَ بِالشَّعِيرِ وَالتَّمْرَ بِالتَّمْرِ فَقَالَ أَحَدُهُمَا وَالْمِلْحَ بِالْمِلْحِ وَلَمْ يَقُلِ الْآخَرُ إِلَّا سَوَاءً بِسَوَاءٍ مِثْلًا بِمِثْلٍ قَالَ أَحَدُهُمَا مَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى وَلَمْ يَقُلْهُ الْآخَرُ وَأَمَرَنَا أَنْ نَبِيعَ الذَّهَبَ بِالْوَرِقِ وَالْوَرِقَ بِالذَّهَبِ وَالْبُرَّ بِالشَّعِيرِ وَالشَّعِيرَ بِالْبُرِّ يَدًا بِيَدٍ كَيْفَ شِئْنَا فَبَلَغَ الْحَدِيثُ مُعَاوِيَةَ فَقَامَ فَقَالَ مَا بَالُ رِجَالٍ يُحَدِّثُونَ أَحَادِيثَ عَنْ رَسُولِ اللهِ ﷺ قَدْ صَحِبْنَاهُ فَلَمْ نَسْمَعْهَا مِنْهُ فَبَلَغَ ذَلِكَ عُبَادَةَ فَقَامَ فَأَعَادَ الْحَدِيثَ وَقَالَ لَنُحَدِّثَنَّ بِمَا سَمِعْنَا مِنْ رَسُولِ اللهِ ﷺ وَإِنْ رُغِمَ مُعَاوِيَةُ خَالَفَهُ قَتَادَةُ فَرَوَاهُ عَنْ مُسْلِمِ بْنِ يَسَارٍ عَنْ أَبِي الْأَشْعَثِ عَنْ عُبَادَةَ
"O people, you have invented kinds of transactions, I do not know what they are, but make sure it is gold for gold, of the same weight, or silver for silver, of the same weight. There is nothing wrong with selling silver for gold, hand to hand, giving more silver than gold, but no credit is allowed. When you sell wheat for wheat and barley for barley, it should be measure for measure, but there is nothing wrong with selling barley for wheat, hand to hand, giving more barley than wheat, but no credit is allowed. And when you sell dates for dates, it should be measure for measure" And he mentioned salt, "measure for measure, and whoever gives more or asks for more has engaged in Riba. عَنْ عُبَادَةَ بْنِ الصَّامِتِ وَكَانَ بَدْرِيًّا وَكَانَ بَايَعَ رَسُولَ اللهِ ﷺ أَنْ لَا يَخَافَ فِي اللهِ لَوْمَةَ لَائِمٍ أَنَّ عُبَادَةَ بْنَ الصَّامِتِ قَامَ خَطِيبًا فَقَالَ أَيُّهَا النَّاسُ إِنَّكُمْ قَدْ أَحْدَثْتُمْ بُيُوعًا لَا أَدْرِي مَا هِيَ أَلَا إِنَّ الذَّهَبَ بِالذَّهَبِ وَزْنًا بِوَزْنٍ تِبْرُهَا وَعَيْنُهَا وَإِنَّ الْفِضَّةَ بِالْفِضَّةِ وَزْنًا بِوَزْنٍ تِبْرُهَا وَعَيْنُهَا وَلَا بَأْسَ بِبَيْعِ الْفِضَّةِ بِالذَّهَبِ يَدًا بَيْدٍ وَالْفِضَّةُ أَكْثَرُهُمَا وَلَا تَصْلُحُ نَسِيئَةً أَلَا إِنَّ الْبُرَّ بِالْبُرِّ وَالشَّعِيرَ بِالشَّعِيرِ مُدْيًا بِمُدْيٍ وَلَا بَأْسَ بِبَيْعِ الشَّعِيرِ بِالْحِنْطَةِ يَدًا بَيْدٍ وَالشَّعِيرُ أَكْثَرُهُمَا وَلَا يَصْلُحُ نَسِيئَةً أَلَا وَإِنَّ التَّمْرَ بِالتَّمْرِ مُدْيًا بِمُدْيٍ حَتَّى ذَكَرَ الْمِلْحَ مُدْيًا بِمُدْيٍ فَمَنْ زَادَ أَوِ اسْتَزَادَ فَقَدْ أَرْبَى
"The messenger of Allah said: 'Gold for gold, of equal measure; silver for silver, of equal measure; salt for salt, dates for dates wheat for wheat, barley for barley, like for like. Whoever gives more or takes more has engaged in Riba."' (Sahih) The wording is that of Muhammad Yaqub did not mention - "Wheat for wheat". (Using translation from Nasāʾī 4564)
قَالَ رَسُولُ اللهِ ﷺ «الذَّهَبُ بِالذَّهَبِ تِبْرُهُ وَعَيْنُهُ وَزْنًا بِوَزْنٍ وَالْفِضَّةُ بِالْفِضَّةِ تِبْرُهُ وَعَيْنُهُ وَزْنًا بِوَزْنٍ وَالْمِلْحُ بِالْمِلْحِ وَالتَّمْرُ بِالتَّمْرِ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ كَيْلًا بِكَيْلٍ فَمَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى وَلَا بَأْسَ بِبَيْعِ الشَّعِيرِ بِالْبُرِّ وَالشَّعِيرُ أَكْثَرُهُمَا يَدًا بِيَدٍ»
30.47 [Machine] The sale of salt with salt
٣٠۔٤٧ بَيْعُ الْمِلْحِ بِالْمِلْحِ
[Machine] 'Ubada bin As-Samit said, "The Messenger of Allah ﷺ forbade exchanging gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates, and salt for salt except in equal amounts. Whoever adds more or accepts more has engaged in usury." And the wording is from Muhammad.
قَالَ عُبَادَةُ بْنُ الصَّامِتِ «نَهَى رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الذَّهَبِ بِالذَّهَبِ وَالْفِضَّةِ بِالْفِضَّةِ وَالْبُرِّ بِالْبُرِّ وَالشَّعِيرِ بِالشَّعِيرِ وَالتَّمْرِ بِالتَّمْرِ وَالْمِلْحِ بِالْمِلْحِ إِلَّا مِثْلًا بِمِثْلٍ سَوَاءً بِسَوَاءٍ فَمَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى» وَاللَّفْظُ لِمُحَمَّدٍ
"Abu Al-Mutawakkil passed by them in the market and some people, including me, stood up to greet him. We said: 'We have come to you to ask you about transactions.' He said: 'I heard a man say to Abu Saeed Al-Khudri': 'Is there anyone between you and the Messenger of Allah (in the chain of narrators) apart from Abu Saeed Al-Khudri? He said: 'There is no one else between him and I. He said: Gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates, salt for salt, equal amounts. Whoever gives more than that or takes more has engaged in Riba, and the taker and the giver are the same."' (Using translation from Nasāʾī 4565)
أَنَّ أَبَا الْمُتَوَكِّلِ مَرَّ بِهِمْ فِي السُّوقِ فَقَامَ إِلَيْهِ قَوْمٌ أَنَا فِيهِمْ قَالَ قُلْنَا أَتَيْنَاكَ لِنَسْأَلَكَ عَنِ الصَّرْفِ قَالَ سَمِعْتُ أَبَا سَعِيدٍ الْخُدْرِيَّ قَالَ لَهُ رَجُلٌ أَمَا بَيْنَكَ وَبَيْنَ النَّبِيِّ ﷺ غَيْرُ أَبِي سَعِيدٍ؟ قَالَ لَيْسَ بَيْنِي وَبَيْنَهُ غَيْرُهُ قَالَ قَالَ «الذَّهَبُ بِالذَّهَبِ وَالْوَرِقُ بِالْوَرِقِ» قَالَ سُلَيْمَانُ أَوْ قَالَ وَالْفِضَّةُ بِالْفِضَّةِ وَالْبُرُّ بِالْبُرِّ وَالشَّعِيرُ بِالشَّعِيرِ وَالتَّمْرُ بِالتَّمْرِ وَالْمِلْحُ بِالْمِلْحِ سَوَاءً بِسَوَاءٍ فَمَنْ زَادَ عَلَى ذَلِكَ أَوِ ازْدَادَ فَقَدْ أَرْبَى وَالْآخِذُ وَالْمُعْطِي فِيهِ سَوَاءٌ
"I heard the Messenger of Allah say: 'Gold, equal amount."' (One of the narrators) Yaqub did not mention: "Equal amount." Muawiyah said: "This does not mean anything." 'Ubadah said; "By Allah I do not care if I am in a land where Muawiyah is not present. I bear witness that I heard the Messenger of Allah say that." (Using translation from Nasāʾī 4566)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ الذَّهَبُ الْكِفَّةُ بِالْكِفَّةِ وَالْفِضَّةُ الْكِفَّةُ بِالْكِفَّةِ حَتَّى خَصَّ قَالَ الْمِلْحُ الْكِفَّةُ بِالْكِفَّةِ قَالَ مُعَاوِيَةُ إِنَّ هَذَا لَا يَقُولُ شَيْئًا فَقَالَ عُبَادَةُ إِنِّي وَاللهِ مَا أُبَالِي أَنْ لَا أَكُونَ بِأَرْضٍ يَكُونُ بِهَا مُعَاوِيَةُ إِنِّي أَشْهَدُ أَنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ ذَلِكَ اللَّفْظُ لِهَارُونَ
30.48 [Machine] The sale of dinar for dinar.
٣٠۔٤٨ بَيْعُ الدِّينَارِ بِالدِّينَارِ
"Dinar for Dinar Dirham for Dirham, no difference between them." (Using translation from Nasāʾī 4567)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا»
30.49 [Machine] The sale of dirhams with dirhams.
٣٠۔٤٩ بَيْعُ الدِّرْهَمِ بِالدِّرْهَمِ
"Umar said: Dinar for Dinar, Dirham for Dirham, no difference between them, this is the obligation that our Prophet enjoined upon us." (Using translation from Nasāʾī 4568)
قَالَ عُمَرُ «الدِّينَارُ بِالدِّينَارِ وَالدِّرْهَمُ بِالدِّرْهَمِ لَا فَضْلَ بَيْنَهُمَا هَذَا عَهْدُ نَبِيِّنَا ﷺ إِلَيْنَا»
"The Messenger of Allah said: 'Gold for gold, weight for weight, like for like; and silver for silver, weight for weight, like for like. Whoever gives more or takes more has engaged in Riba."' (Using translation from Nasāʾī 4569)
قَالَ رَسُولُ اللهِ ﷺ «الذَّهَبُ بِالذَّهَبِ وَزْنًا بِوَزْنٍ مِثْلًا بِمِثْلٍ وَالْفِضَّةُ بِالْفِضَّةِ وَزْنًا بِوَزْنٍ مِثْلًا بِمِثْلٍ فَمَنْ زَادَ أَوِ ازْدَادَ فَقَدْ أَرْبَى»
30.50 [Machine] The sale of gold with gold
٣٠۔٥٠ بَيْعُ الذَّهَبِ بِالذَّهَبِ
Messenger of Allah ﷺ said, "Do not sell gold for gold unless equivalent in weight, and do not sell less amount for greater amount or vice versa; and do not sell silver for silver unless equivalent in weight, and do not sell less amount for greater amount or vice versa and do not sell gold or silver that is not present at the moment of exchange for gold or silver that is present. أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا تَبِيعُوا الذَّهَبَ بِالذَّهَبِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا الْوَرِقَ بِالْوَرِقِ إِلَّا مِثْلًا بِمِثْلٍ وَلَا تُشِفُّوا بَعْضَهَا عَلَى بَعْضٍ وَلَا تَبِيعُوا مِنْهَا شَيْئًا غَائِبًا بِنَاجِزٍ»
"My eyes saw and my ears heard the Messenger of Allah. And he mentioned the prohibition of (selling) gold for gold and silver for silver, unless it is equal amounts, like for like. And do not sell it in return for something to be paid later, and do not differentiate." (Using translation from Nasāʾī 4571)
وَسَمِعَ أُذُنِي مِنْ رَسُولِ اللهِ ﷺ فَذَكَرَ النَّهْيَ عَنِ الذَّهَبِ بِالذَّهَبِ وَالْوَرِقِ بِالْوَرِقِ إِلَّا سَوَاءً بِسَوَاءٍ مِثْلًا بِمِثْلٍ وَلَا تَبِيعُوا غَائِبًا بِنَاجِزٍ وَلَا تُشِفُّوا أَحَدَهُمَا عَلَى الْآخَرِ
Muawiyah sold a cup of gold or silver for more than its weight. Abu Ad-Darda' said: "I heard the Messenger of Allah forbid such transactions unless it was like for like." (Using translation from Nasāʾī 4572)
أَنَّ مُعَاوِيَةَ بَاعَ سِقَايَةً مِنْ ذَهَبٍ أَوْ وَرِقٍ بِأَكْثَرَ مِنْ وَزْنِهَا فَقَالَ أَبُو الدَّرْدَاءِ سَمِعْتُ رَسُولَ اللهِ ﷺ يَنْهَى عَنْ مِثْلِ هَذَا إِلَّا مِثْلًا بِمِثْلٍ
30.51 [Machine] Selling the necklace with beads, and the gold with gold.
٣٠۔٥١ بَيْعُ الْقِلَادَةِ فِيهَا الْخَرَزُ، وَالذَّهَبُ بِالذَّهَبِ
At the battle of Khaibar I bought a necklace in which there were gold and pearls for twelve dinars. I separated them and found that its worth was more than twelve dinars. So I mentioned that to the Prophet ﷺ who said: It must not be sold till the contents are considered separately. (Using translation from Abū Dāʾūd 3352)
اشْتَرَيْتُ يَوْمَ خَيْبَرَ قِلَادَةً فِيهَا ذَهَبٌ وَخَرَزٌ فَفَصَّلْتُهَا فَوَجَدْتُ فِيهَا أَكْثَرَ مِنِ اثْنَيْ عَشَرَ دِينَارًا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «لَا تُبَاعُ حَتَّى تُفَصَّلَ»
"On the Day of Khaibar I got a necklace containing gold and gems, and I wanted to sell it. Mention of that was made to the Prophet and he said: 'Take it apart, and then sell it."' (Using translation from Nasāʾī 4574)
أَصَبْتُ يَوْمَ خَيْبَرَ قِلَادَةً فِيهَا ذَهَبٌ وَخَرَزٌ فَأَرَدْتُ بَيْعَهَا فَذَكَرْتُ يَعْنِي لِلنَّبِيِّ ﷺ فَقَالَ «افْصِلْ بَعْضَهَا مِنْ بَعْضٍ ثُمَّ بِعْهَا»
30.52 [Machine] Selling silver with gold harmfully
٣٠۔٥٢ بَيْعُ الْفِضَّةِ بِالذَّهَبِ نَسِيئَةً
[Machine] The Prophet ﷺ came to us in Medina while we were selling goods. He said, "If it is a hand-to-hand transaction, then there is no problem with it. And if it involves any violation or wrongdoing, then it is usury." Then he told me to bring Zaid ibn Arqam, so I went to him and asked him the same question, and he replied with the same answer.
قَدِمَ عَلَيْنَا النَّبِيُّ ﷺ الْمَدِينَةَ وَنَحْنُ نَبِيعُ هَذَا الْبَيْعَ فَقَالَ «مَا كَانَ يَدًا بَيْدٍ فَلَا بَأْسَ بِهِ وَمَا كَانَ نَسِيئَةً فَهُوَ رَبًّا» ثُمَّ قَالَ لِي ائْتِ زَيْدَ بْنَ أَرْقَمَ فَأَتَيْتُهُ فَسَأَلْتُهُ فَقَالَ مِثْلَ ذَلِكَ
" I asked Al-Bara bin 'Azib and Zaid bin Arqam and they said: 'We were merchants at the time of the Messenger of Allah and we asked the Prophet of Allah about money exchange. He said: "If it is done hand to hand there is nothing wrong with it, but if it is done on credit then it is not right." (Using translation from Nasāʾī 4576)
أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ وَعَامِرُ بْنُ مُصْعَبٍ أَنَّهُمَا سَمِعَا أَبَا الْمِنْهَالِ يَقُولُ سَأَلْتُ الْبَرَاءَ بْنَ عَازِبٍ وَزَيْدَ بْنَ أَرْقَمَ فَقَالَا كُنَّا تَاجِرَيْنِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلْنَا رَسُولَ اللهِ ﷺ عَنِ الصَّرْفِ فَقَالَ «إِنْ كَانَ يَدًا بَيْدٍ فَلَا بَأْسَ وَإِنْ كَانَ نَسِيئَةً فَلَا يَصْلُحُ»
"I asked Al-Bara bin 'Azib about money exchange. He said: 'Ask Zaid bin Arqam, for he is better than me and more knowledgeable.' So I asked Zaid and he said: 'Ask Al-Bara for he is better than me and more knowledgeable.' And they both said: 'The Messenger of Allah forbade (selling) silver for gold on credit."' سَلِ الْبَرَاءَ؛ فَإِنَّهُ خَيْرٌ مِنِّي وَأَعْلَمُ فَقَالَا جَمِيعًا نَهَى رَسُولُ اللهِ ﷺ عَنِ الْوَرِقِ بِالذَّهَبِ دَيْنًا
30.53 [Machine] Selling Silver for Gold and Selling Gold for Silver
٣٠۔٥٣ بَيْعُ الْفِضَّةِ بِالذَّهَبِ، وَبَيْعُ الذَّهَبِ بِالْفِضَّةِ
that his father said, "The Prophet ﷺ forbade the selling of gold for gold and silver for silver except if they are equivalent in weight, and allowed us to sell gold for silver and vice versa as we wished." (Using translation from Bukhārī 2182)
نَهَانَا رَسُولُ اللهِ ﷺ عَنْ بَيْعِ الْفِضَّةِ بِالْفِضَّةِ وَالذَّهَبِ بِالذَّهَبِ إِلَّا سَوَاءً بِسَوَاءٍ وَأَمَرَنَا أَنْ نَبْتَاعَ الذَّهَبَ فِي الْفِضَّةِ كَيْفَ شِئْنَا وَالْفِضَّةَ بِالذَّهَبِ كَيْفَ شِئْنَا
[Machine] The Messenger of Allah ﷺ forbade us from selling silver for silver except for an equal amount, and from selling gold for gold except for an equal amount. And the Messenger of Allah ﷺ said, "Exchange gold for silver however you please, and exchange silver for gold however you please." Abu Abdur-Rahman narrated the news from my father, Tawbah, who came between Yahya ibn Abi Kathir and Abdur-Rahman ibn Abi Bakrah, Yahya ibn Abi Ishaq.
نَهَانَا رَسُولُ اللهِ ﷺ أَنْ نَبِيعَ الْفِضَّةَ بِالْفِضَّةِ إِلَّا عَيْنًا بِعَيْنٍ سَوَاءً بِسَوَاءٍ وَلَا نَبِيعَ الذَّهَبَ بِالذَّهَبِ إِلَّا عَيْنًا بِعَيْنٍ وَسَوَاءً بِسَوَاءٍ وَقَالَ رَسُولُ اللهِ ﷺ «تَبَايَعُوا الذَّهَبَ بِالْفِضَّةِ كَيْفَ شِئْتُمْ وَالْفِضَّةَ بِالذَّهَبِ كَيْفَ شِئْتُمْ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ خَبَرُ أَبِي تَوْبَةَ أَدْخَلَ بَيْنَ يَحْيَى بْنِ أَبِي كَثِيرٍ وَبَيْنَ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرَةَ يَحْيَى بْنَ أَبِي إِسْحَاقَ
"There is no Riba except in credit.' (Using translation from Nasāʾī 4580)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا رِبًا إِلَّا فِي النَّسِيئَةِ»
"I said to Ibn Abbas: 'Do you think that what you are saying is something that you found in the Book of Allah, or something that you heard from the Messenger of Allah?' He said: 'I did not find it in the Book of Allah, nor did I hear it from the messenger of Allah, rather Usamah bin Zaid told me that the Messenger of Allah said: 'Riba is only in credit."' سَمِعَ أَبَا سَعِيدٍ الْخُدْرِيَّ يَقُولُ قُلْتُ لِابْنِ عَبَّاسٍ أَرَأَيْتَ هَذَا الَّذِي تَقُولُ أَشَيْئًا وَجَدْتَهُ فِي كِتَابِ اللهِ أَوْ سَمِعْتَهُ مِنْ رَسُولِ اللهِ ﷺ؟ قَالَ مَا وَجَدْتُهُ فِي كِتَابِ اللهِ وَلَا سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ وَلَكِنْ أُسَامَةُ بْنُ زَيْدٍ أَخْبَرَنِي أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِنَّمَا الرِّبَا فِي النَّسِيئَةِ»
"There is no Riba except in credit.' (Using translation from Nasāʾī 4580)
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ «لَا رِبَا إِلَّا فِي النَّسِيئَةِ»
30.54 [Machine] Taking gold from paper, and paper from gold, and mentioning the differences in the words of the narrators of Ibn Umar's report on that.
٣٠۔٥٤ أَخْذُ الذَّهَبِ مِنَ الْوَرِقِ، وَالْوَرِقِ مِنَ الذَّهَبِ، وَذَكَرُ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرٍ ابْنُ عُمَرَ فِي ذَلِكَ
"I used to sell gold for silver, or silver for gold. I came to the Messenger of Allah and told him about that, and he said: 'If you make a deal with your companion, d o not leave him when there is still any ambiguity (in the deal) between you."' (Using translation from Nasāʾī 4583)
كُنْتُ أَبِيعُ الذَّهَبَ بِالْفِضَّةِ وَالْفِضَّةَ بِالذَّهَبِ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَأَخْبَرْتُهُ بِذَلِكَ فَقَالَ «إِذَا بَايَعْتَ صَاحِبَكَ فَلَا تُفَارِقْهُ وَبَيْنَكَ وَبَيْنَهُ لَبْسٌ»
he did not like to exchange Dinars for Dirhams or Dirhams for Dinars. (Using translation from Nasāʾī 4584)
أَنْ يَأْخُذَ الدَّنَانِيرَ مِنَ الدَّرَاهِمِ وَالدَّرَاهِمَ مِنَ الدَّنَانِيرِ
he did not see anything wrong with parying Dirhams for Dinars. (Using translation from Nasāʾī 4585)
أَنَّهُ كَانَ لَا يَرَى بَأْسًا يَعْنِي اقْتِضَاءَ الدَّرَاهِمِ مِنَ الدَّنَانِيرِ وَالدَّنَانِيرِ مِنَ الدَّرَاهِمِ
عَنْ سَعِيدِ بْنِ جُبَيْرٍ بِمِثْلِهِ
"I used to sell camels at Al-Baqi and I would sell Dinars in exchange for Dirhams. I came to the Prophet in the house of Hafsah and said: 'O Messenger of Allah, I want to ask you: I sell camels in Al-Baqi and I sell Dinars in exchange for Dirhams. He said: 'There is nothing wrong with it if you take the price on that day, unless you depart when there is still unfinished business between you both (buyer and seller)."' كُنْتُ أَبِيعُ الْإِبِلَ بِالْبَقِيعِ أَبِيعُ بِالدَّنَانِيرِ وَآخُذُ الدَّرَاهِمَ فَأَتَيْتُ النَّبِيَّ ﷺ فِي بَيْتِ حَفْصَةَ فَقُلْتُ يَا رَسُولَ اللهِ إِنِّي أُرِيدُ أَنْ أَسْأَلَكَ إِنِّي أَبِيعُ بِالْبَقِيعِ فَأَبِيعُ بِالدَّنَانِيرِ وَآخُذُ الدَّرَاهِمَ قَالَ «لَا بَأْسَ أَنْ تَأْخُذَهَا بِسِعْرِ يَوْمِهَا مَا لَمْ يُفَرِّقْ بَيْنَكُمَا شَيْءٌ»
30.55 [Machine] Taking the leaf from the gold
٣٠۔٥٥ أَخْذُ الْوَرِقِ مِنَ الذَّهَبِ
"I came to the Prophet and said: 'Wait, I want to ask you something. I sell camels in Al-Baqi with a price set in Dinars but I accept Dirhams instead.' He said: 'There is nothing wrong with it if you take the price on that day, still unfinished business between you both (buyer and seller)"' (Using translation from Nasāʾī 4589)
أَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ رُوَيْدَكَ أَسْأَلُكَ إِنِّي أَبِيعُ الْإِبِلَ بِالْبَقِيعِ بِدَنَانِيرَ وَآخُذُ الدَّرَاهِمَ قَالَ «لَا بَأْسَ أَنْ تَأْخُذَ بِسِعْرِ يَوْمِهَا مَا لَمْ تَفْتَرِقَا وَبَيْنَكُمَا شَيْءٌ»
30.56 [Machine] Weight Gain
٣٠۔٥٦ الزِّيَادَةُ فِي الْوَزْنِ
"When the Prophet ﷺ came to Al-Madinah, he called for a scale and weighed (something) for me and gave me more." (Using translation from Nasāʾī 4590)
لَمَّا قَدِمَ النَّبِيُّ ﷺ الْمَدِينَةَ دَعَا بِمِيزَانٍ فَوَزَنَ لِي وَزَادَنِي
'The Messenger of Allah paid off what he owed me, and gave me more." (Using translation from Nasāʾī 4591)
«قَضَانِي رَسُولُ اللهِ ﷺ وَزَادَنِي»
30.57 [Machine] Tipping the scale
٣٠۔٥٧ الرُّجْحَانِ فِي الْوَزْنِ
"Makhrafah Al-Abdi and I brought some cloth from Hajar, and the Messenger of Allah came to us while we were in Mina where there w a man who weighed (goods) in return for payment. He bought some trousers from us, and said to the man who weighed: 'Weigh it, and allow more."' (Using translation from Nasāʾī 4592)
جَلَبْتُ أَنَا وَمَخْرَفَةُ الْعَبْدِيُّ بَزًّا مِنْ هَجَرَ فَأَتَانَا رَسُولُ اللهِ ﷺ وَنَحْنُ بِمِنًى وَوَزَّانٌ يَزِنُ بِالْأَجْرِ فَاشْتَرَى مِنَّا سَرَاوِيلَ فَقَالَ لِلْوَزَّانِ «زِنْ وَأَرْجِحْ»
[Machine] I sent a message to the Messenger of Allah ﷺ regarding the ruling on wearing shorts before the migration. Abu Abdur Rahman answered me, and the hadith of Sufyan seems more correct than the hadith of Shu'bah.
بِعْتُ مِنْ رَسُولِ ﷺ رَحْلَ سَرَاوِيلَ قَبْلَ الْهِجْرَةِ فَأَرْجَحَ لِي قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَحَدِيثُ سُفْيَانَ أَشْبَهُ بِالصَّوَابِ مِنْ حَدِيثِ شُعْبَةَ
"The Messenger of Allah said: "Volume is to be measured according to the system of the people of Al-Madinah, and weight is to be measured according to the system of the peole of Makkah."' (Sahih) This is the wording of Ishaq (one of the narrators). (Using translation from Nasāʾī 4594)
قَالَ رَسُولُ اللهِ ﷺ «الْمِكْيَالُ عَلَى مِكْيَالِ أَهْلِ الْمَدِينَةِ وَالْوَزْنُ عَلَى وَزْنِ أَهْلِ مَكَّةَ» اللَّفْظُ لِإِسْحَاقَ
30.58 [Machine] Sale of Food Before It Expires
٣٠۔٥٨ بَيْعُ الطَّعَامِ قَبْلَ أَنْ يُسْتَوْفَى
The Messenger of Allah ﷺsaid: “Whoever buys foodstuff should not sell it until he takes possession of all of it.” (Using translation from Aḥmad 396)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَسْتَوْفِيَهُ»
The Prophet ﷺ said, "He who buys foodstuff should not sell it till he has received it." (Using translation from Bukhārī 2133)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ»
[Machine] The Messenger of Allah ﷺ said, "Whoever buys food, should not sell it until he has measured it." [55] 6146 Ishaaq ibn Mansoor told us, he said: Abdul Rahman informed us, from Sufyan, from Amr, from Tawus, from Ibn Abbas, from the Prophet ﷺ, with the same narration, and the one before it, until he takes it.
قَالَ رَسُولُ اللهِ ﷺ «مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَكْتَالَهُ» [55] 6146 أَخْبَرَنَا إِسْحَاقُ بْنُ مَنْصُورٍ قَالَ أَخْبَرَنَا عَبْدُ الرَّحْمَنِ عَنْ سُفْيَانَ عَنْ عَمْرٍو عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيَّ ﷺ بِمِثْلِهِ وَالَّذِي قَبْلَهُ حَتَّى يَقْبِضَهُ
[Machine] As for what the Messenger of Allah ﷺ prohibited, it is that food should not be sold until it is received.
أَمَّا الَّذِي نَهَى عَنْهُ رَسُولُ اللهِ ﷺ أَنْ يُبَاعَ حَتَّى يُسْتَوْفَى فَالطَّعَامُ
The Prophet ﷺ forbade the selling of foodstuff before receiving it. I consider that all types of sellings should be done similarly. (Using translation from Bukhārī 2135)
سَمِعْتُ ابْنَ عَبَّاسٍ يَقُولُ أَمَّا الَّذِي نَهَى عَنْهُ رَسُولُ اللهِ ﷺ فَهُوَ الطَّعَامُ أَنْ يُبَاعَ حَتَّى يُقْبَضَ
He who buys food-rain should not sell it until he has taken possession of it. Ibn Abbas (Allah be pleased with them) said: I regard everything like food (so far as this principle is concerned). (Using translation from Muslim 1525c)
قَالَ رَسُولُ اللهِ ﷺ «مَنِ ابْتَاعَ طَعَامًا فَلَا يَبِعْهُ حَتَّى يَقْبِضَهُ» قَالَ ابْنُ عَبَّاسٍ فَأَحْسَبُ أَنَّ كُلَّ شَيْءٍ بِمَنْزِلَةِ الطَّعَامِ
[Machine] The Messenger of Allah ﷺ said, "Do not follow a meal until you buy it and fully pay for it." Ibrahim ibn al-Hasan narrated to me, he said, Haggag informed us, he said, Ibn Juraij said, and Ata narrated it from Abdullah ibn Asimah al-Jushami, from Hakim ibn Hizam, from the Prophet ﷺ .
قَالَ رَسُولُ اللهِ ﷺ «لَا تَبِعْ طَعَامًا حَتَّى تَشْتَرِيَهُ وَتَسْتَوْفِيَهُ» [56] 6151 أَخْبَرَنَي إِبْرَاهِيمُ بْنُ الْحَسَنِ قَالَ حَدَّثَنَا حَجَّاجٌ قَالَ قَالَ ابْنُ جُرَيْجٍ وَأَخْبَرَنِي عَطَاءٌ ذَلِكَ عَنْ عَبْدِ اللهِ بْنِ عِصْمَةَ الْجُشَمِيِّ عَنْ حَكِيمِ بْنِ حِزَامٍ عَنِ النَّبِيِّ ﷺ
