٤٦۔ كِتَابُ اللِّعَانِ ص ١
Ibn ‘Abbas said “Hilal bin Umayyah accused his wife in the presence of Prophet ﷺ of having committed adultery with Sharik bin Sahma’”. The Prophet ﷺ said “Produce evidence or you must receive punishment on your back.” He said “Apostle of Allaah ﷺ when one of us sees a man having intercourse with his wife should he go and seek evidence?” But the Prophet ﷺ merely said “You must produce evidence or you must receive punishment on your back.” Hilal then said “By Him Who sent you with the Truth, I am speaking Truly. May Allaah send down something which will free my back from punishment. Then the following Qur’anic verses were revealed “And those who make charges against their spouses but have no witnesses except themselves” reciting till he reached “one of those who speak the truth”. The Prophet ﷺ then returned and sent for them and they came (to him). Hilal bin Umayyah stood up and testified and the Prophet ﷺ was saying “Allaah knows that one of you is lying. Will one of you repent?” Then the woman got up and testified, but when she was about to do it a fifth time saying that Allaah’s anger be upon her if he was one of those who spoke the truth, they said to her “this is the deciding one”. Ibn ‘Abbas said “She then hesitated and drew back so that we thought the she would withdraw(what she said) “Look and see whether she gives birth to a child with eyes looking as if they have antimony in them, wide buttocks and fat legs, if she did. Sharik bin Sahma’ will be its father. She then gave birth to a child of a similar description. The Prophet ﷺ thereupon said “If it were not for what has already been stated in Allaah’s book I would have dealt severely with her.” Abu Dawud said “This tradition has been transmitted by the people of Medina alone. They narrated the tradition of Hilal on the authority of Ibn Bashshar.” (Using translation from Abū Dāʾūd 2254)
لَهُ النَّبِيُّ ﷺ الْبَيِّنَةُ أَوْ حَدٌّ فِي ظَهْرِكَ فَقَالَ يَا رَسُولَ اللهِ إِذَا رَأَى أَحَدُنَا رَجُلًا عَلَى امْرَأَتِهِ أَيَلْتَمِسُ الْبَيِّنَةَ؟ فَجَعَلَ النَّبِيُّ ﷺ يَقُولُ الْبَيِّنَةُ وَإِلَّا حَدٌّ فِي ظَهْرِكَ فَقَالَ هِلَالٌ وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنِّي لَصَادِقٌ وَلَيُنْزِلَنَّ اللهُ فِي أَمْرِي مَا يُبَرِّئُ ظَهْرِي مِنَ الْحَدِّ فَنَزَلَ جَبْرَائِيلُ عَلَيْهِ السَّلَامُ وَنَزَلَتِ الْآيَةُ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلَّا أَنْفُسُهُمْ} [النور 6] فَقَرَأَ حَتَّى بَلَغَ {وَالْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ} [النور 9] قَالَ فَانْصَرَفَ النَّبِيُّ ﷺ فَأَرْسَلَ إِلَيْهِمَا فَجَاءَا فَقَامَ هِلَالُ بْنُ أُمَيَّةَ فَشَهِدَ وَالنَّبِيُّ ﷺ يَقُولُ إِنَّ اللهَ يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ فَهَلْ مِنْكُمَا تَائِبٌ؟ ثُمَّ قَامَتْ فَشَهِدَتْ فَلَمَّا كَانَ عِنْدَ {الْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ} [النور 9] قَالُوا لَهَا إِنَّهَا مُوجِبَةٌ قَالَ ابْنُ عَبَّاسٍ فَتَلَكَّأَتْ حَتَّى ظَنَنَّا أَنَّهَا سَتَرْجِعُ ثُمَّ قَالَتْ لَا أَفْضَحُ قَوْمِي سَائِرَ الْيَوْمِ فَمَضَتْ فَقَالَ النَّبِيُّ ﷺ انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أَكْحَلَ الْعَيْنَيْنِ سَابِغَ الْأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ سَحْمَاءَ فَجَاءَتْ بِهِ كَذَلِكَ فَقَالَ النَّبِيُّ ﷺ لَوْلَا مَا مَضَى مِنْ كِتَابِ اللهِ تَعَالَى لَكَانَ لِي وَلَهَا شَأْنٌ
[Machine] When this verse was revealed, Sa'd bin 'Ubadah said, "Was it revealed like this? If I found a man enjoying her (i.e., his wife), I would not be able to control myself until I brought four witnesses." The Messenger of Allah ﷺ said, "O people of Ansar, do you not hear what your leader is saying?" They said, "O Messenger of Allah, do not blame him, for he is a jealous man. By Allah, he has never married a woman from among us except a virgin, nor did he divorce a woman unless he had a legitimate reason. But a man among us dared to marry her due to his extreme jealousy." Sa'd said, "By Allah, O Messenger of Allah, I know that what he says is true and that it is from Allah. But I was amazed." While the Messenger of Allah ﷺ was in that state, Hilal bin Umayyah Al-Waqifi, who was one of the three people whom Allah had revealed tawbah (repentance) to, came and said, "O Messenger of Allah, I came yesterday for dinner from a wall that I was near, and I saw a man at my family's house. I saw it with my own eyes and heard it with my own ears." The Messenger of Allah ﷺ disliked what he brought, and it was said, "Should Hilal be flogged and his testimony be rendered invalid among the Muslims?" Hilal said, "By Allah, O Messenger of Allah, I see in your face that you hate what I brought, but I hope that Allah will make a way out for me." While the Messenger of Allah ﷺ was in that state, the revelation came down upon him, and whenever the revelation came to him, he used to cover his cheeks and face, and his Companions would leave him alone. None of them would speak. When the revelation was lifted, he said, "Be glad, O Hilal." The Messenger of Allah ﷺ said to him, "Call her (i.e. the accused woman)." So she was called, and he said, "Verily, Allah knows that one of you is lying. Is there any of you who will repent?" Hilal said, "By Allah, O Messenger of Allah, I did not speak except the truth, and I have indeed told the truth." The Messenger of Allah ﷺ said, "Then the fifth testimony is given against you, that the curse of Allah be upon you if you are of those who are lying." And it was said to Hilal, "Take the fourth testimony, swearing by Allah that he is of those who are lying." And it was said to her at the fifth time, "Fear Allah, for the punishment of this world is less severe than the punishment of the Hereafter, and this act will make your punishment obligatory." So she remained silent for a while, then said, "By Allah, I will not disgrace my people." Then she gave the fifth testimony, that the anger of Allah be upon her if she is of those who are truthful. The Messenger of Allah ﷺ decided that she should not be stoned, nor should her child be stoned. But whoever accused her or accused her child shall receive the prescribed hadd punishment and she shall not have provision or a dwelling because they separated without divorce or death. The Messenger of Allah ﷺ said, "Look at her. If she comes with orange or green hair, crooked or curly, she belongs to Hilal bin Umayyah. But if she comes with straight, smooth black hair, she belongs to her husband." 'Abbada said, "I heard 'Ikrimah say, 'I saw him (i.e., Hilal) as the prince of Egypt, and it is not known who his father is. And Allah knows best."
لَمَّا نَزَلَتْ هَذِهِ الْآيَةُ {وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُوا بِأَرْبَعَةِ شُهَدَاءَ} [النور 4] إِلَى آخِرِ الْآيَةِ فَقَالَ سَعْدُ بْنُ عُبَادَةَ أَهَكَذَا أُنْزِلَتْ فَلَوْ وَجَدْتُ لَكَاعًا مُتَفَخِّذُهَا رَجُلٌ لَمْ يَكُنْ لِي أَنْ أُحَرِّكَهُ وَلَا أَهِيجَهُ حَتَّى آتِيَ بِأَرْبَعَةِ شُهَدَاءَ فَوَاللهِ لَا آتِي بِأَرْبَعَةِ شُهَدَاءَ حَتَّى يَقْضِيَ حَاجَتَهُ فَقَالَ رَسُولُ اللهِ ﷺ يَا مَعْشَرَ الْأَنْصَارِ أَلَا تَسْمَعُونَ مَا يَقُولُ سَيِّدِكُمْ؟ قَالُوا يَا رَسُولَ اللهِ لَا تَلُمْهُ فَإِنَّهُ رَجُلٌ غَيُورٌ وَاللهِ مَا تَزَوَّجَ فِينَا قَطُّ إِلَّا عَذْرَاءَ وَلَا طَلَّقَ امْرَأَةً لَهُ فَاجْتَرَأَ رَجُلٌ مِنَّا أَنْ يَتَزَوَّجَهَا مِنْ شِدَّةِ غَيْرَتِهِ قَالَ سَعْدٌ وَاللهِ إِنِّي لَأَعْلَمُ يَا رَسُولَ اللهِ أَنَّهَا لَحَقٌّ وَأَنَّهَا مِنْ عِنْدِ اللهِ وَلَكِنِّي عَجِبْتُ فَبَيْنَا رَسُولُ اللهِ ﷺ كَذَلِكَ إِذْ جَاءَ هِلَالُ بْنُ أُمَيَّةَ الْوَاقِفِيُّ وَهُوَ أَحَدُ الثَّلَاثَةِ الَّذِينَ تَابَ اللهُ عَلَيْهِمْ فَقَالَ يَا رَسُولَ اللهِ إِنِّي جِئْتُ الْبَارِحَةَ عِشَاءً مِنْ حَائِطٍ لِي كُنْتُ فِيهِ فَرَأَيْتُ عِنْدَ أَهْلِي رَجُلًا وَرَأَيْتُ بِعَيْنِيَّ وَسَمِعْتُ بِأُذُنِيَّ فَكَرِهَ رَسُولُ اللهِ ﷺ مَا جَاءَ بِهِ وَقِيلَ أَيُجْلَدُ هِلَالٌ وَتُبْطَلُ شَهَادَتُهُ فِي الْمُسْلِمِينَ؟ فَقَالَ هِلَالٌ يَا رَسُولَ اللهِ وَاللهِ إِنِّي لَأَرَى فِي وَجْهِكَ أَنَّكَ تَكْرَهُ مَا جِئْتُ بِهِ وَإِنِّي لَأَرْجُو أَنْ يَجْعَلَ اللهُ لِي فَرَجًا قَالَ فَبَيْنَمَا رَسُولُ اللهِ ﷺ كَذَلِكَ إِذْ نَزَلَ عَلَيْهِ الْوَحْيُ وَكَانَ رَسُولُ اللهِ ﷺ إِذَا نَزَلَ عَلَيْهِ الْوَحْيُ تَرَبَّدَ لِذَلِكَ خَدُّهُ وَوَجْهُهُ وَأَمْسَكَ عَنْهُ أَصْحَابُهُ فَلَمْ يَتَكَلَّمْ أَحَدٌ مِنْهُمْ فَلَمَّا رُفِعَ الْوَحْيُ قَالَ أَبْشِرْ يَا هِلَالُ فَقَالَ رَسُولُ اللهِ ﷺ ادْعُوهَا فَدُعِيَتْ فَقَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ تَبَارَكَ وَتَعَالَى يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ فَهَلْ مِنْكُمَا تَائِبٌ؟ فَقَالَ هِلَالٌ ؓ وَاللهِ يَا رَسُولَ اللهِ مَا قُلْتُ إِلَّا حَقًّا وَلَقَدْ صَدَقْتُ قَالَ فَقَالَتْ هِيَ عِنْدَ ذَلِكَ كَذَبَ قَالَ فَقِيلَ لِهِلَالٍ تَشْهَدُ أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّكَ لَمِنَ الصَّادِقِينَ وَقِيلَ لَهُ عِنْدَ الْخَامِسَةِ يَا هِلَالُ اتَّقِ اللهَ فَإِنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ وَإِنَّ هَذِهِ الْمُوجِبَةُ الَّتِي تُوجِبُ عَلَيْكَ الْعَذَابَ فَقَالَ وَاللهِ لَا يُعَذِّبُنِي اللهُ أَبَدًا كَمَا لَمْ يَجْلِدْنِي عَلَيْهَا قَالَ فَشَهِدَ الْخَامِسَةَ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ وَقِيلَ اشْهَدِي أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّهُ لَمِنَ الْكَاذِبِينَ وَقِيلَ لَهَا عِنْدَ الْخَامِسَةِ يَا هَذِهِ اتَّقِي اللهَ فَإِنَّ عَذَابَ اللهِ أَشَدُّ مِنْ عَذَابِ النَّاسِ وَإِنَّ هَذِهِ الْمُوجِبَةُ الَّتِي تُوجِبُ عَلَيْكِ الْعَذَابَ فَسَكَتَتْ سَاعَةً ثُمَّ قَالَتْ وَاللهِ لَا أَفْضَحُ قَوْمِي فَشَهِدَتِ الْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ قَالَ وَقَضَى رَسُولُ اللهِ ﷺ أَنْ لَا تُرْمَى وَلَا يُرْمَى وَلَدُهَا وَمَنْ رَمَاهَا أَوْ رَمَى وَلَدَهَا جُلِدَ الْحَدَّ وَلَيْسَ لَهَا عَلَيْهِ قُوتٌ وَلَا سُكْنَى مِنْ أَجْلِ أَنَّهُمَا يَتَفَرَّقَانِ بِغَيْرِ طَلَاقٍ وَلَا مُتَوَفًّى عَنْهَا فَقَالَ رَسُولُ اللهِ ﷺ انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أُثَيْبِجَ أُصَيْهِبَ أُرَيْسِحَ حَمْشَ السَّاقَيْنِ فَهُوَ لِهِلَالِ بْنِ أُمَيَّةَ وَإِنْ جَاءَتْ بِهِ خَدَلَّجَ السَّاقَيْنِ سَابِغَ الْإِلْيَتَيْنِ أَوْرَقَ جَعْدًا جُمَالِيًّا فَهُوَ لِصَاحِبِهِ قَالَ فَجَاءَتْ بِهِ أَوْرَقَ جَعْدًا جُمَالِيًّا خَدَلَّجَ السَّاقَيْنِ سَابِغَ الْإِلْيَتَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ لَوْلَا الْأَيْمَانُ لَكَانَ لِي وَلَهَا أَمْرٌ قَالَ عَبَّادٌ فَسَمِعْتُ عِكْرِمَةَ يَقُولُ لَقَدْ رَأَيْتُهُ أَمِيرَ مِصْرٍ مِنَ الْأَمْصَارِ وَلَا يُدْرَى مَنْ أَبُوهُ وَاللهُ أَعْلَمُ
46.2 [Machine] Who is cursed among spouses and who is not cursed? Imam Shafi'i, may Allah have mercy on him, said: "When Allah mentioned cursing upon spouses in absolute terms, it means that cursing is permissible in the case of divorce, and it is obligatory. And similarly, it is obligatory for every wife." 15293 - Abu Ali al-Rawdhbari reported to us, Abu Bakr ibn Dasa narrated to us, Abu Dawud narrated to us, Al-Hasan ibn Ali narrated to us, Yazid ibn Haroun narrated to us, I am Abbad ibn Mansour, from Ikrimah, from Ibn Abbas, who said: Hilal ibn Umayyah came and mentioned the story of al-li'an in detail, and at the end he said: Allah's Messenger ﷺ said: "If it were not for oaths, I would have a judgment in regard to it." Imam Ahmed said: So the one who curses is called a "li'an" with an oath.
٤٦۔٢ بَابُ مَنْ يُلَاعِنُ مِنَ الْأَزْوَاجِ وَمَنْ لَا يُلَاعِنُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " لَمَّا ذَكَرَ اللهُ اللِّعَانَ عَلَى الْأَزْوَاجِ مُطْلَقًا كَانَ اللِّعَانُ عَلَى كُلِّ زَوْجٍ جَازَ طَلَاقُهُ وَلَزِمَهُ الْفَرْضُ , وَكَذَلِكَ عَلَى كُلِّ زَوْجَةٍ لَزِمَهَا الْفَرْضُ " 15293 - أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ، أَنَا أَبُو بَكْرِ بْنُ دَاسَةَ، نا أَبُو دَاوُدَ، نا الْحَسَنُ بْنُ عَلِيٍّ، نا يَزِيدُ بْنُ هَارُونَ، أَنَا عَبَّادُ بْنُ مَنْصُورٍ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ قَالَ: جَاءَ هِلَالُ بْنُ أُمَيَّةَ فَذَكَرَ قِصَّةَ اللِّعَانِ بِطُولِهَا وَفِي آخِرِهَا قَالَ: فَقَالَ رَسُولُ اللهِ ﷺ: " لَوْلَا الْأَيْمَانُ لَكَانَ لِي وَلَهَا شَأْنٌ " , قَالَ الْإِمَامُ أَحْمَدُ: فَسُمِّيَ اللِّعَانُ يَمِينًا
[Machine] When Hilal bin Umayyah threw his wife, it was said to him, "By Allah, the Messenger of Allah ﷺ will surely order you to be lashed eighty times." He said, "Allah is more just than that. It is more just for Him to strike me eighty times, knowing that I have seen until I am certain, and I have heard until I am convinced. No, by Allah, He will never strike me." Then the verse of cursing was revealed, so the Messenger of Allah ﷺ called them when the verse was revealed and said, "Allah knows that one of you is lying. Is there anyone among you who will repent?" Hilal said, "By Allah, I am telling the truth." The Messenger of Allah ﷺ said to him, "Swear by Allah, the One besides whom there is no god, that you are telling the truth." So he said that four times, and if he was lying, the curse of Allah would be upon him. The Messenger of Allah ﷺ said, "Stop at the fifth one, as that is deserving." He swore, then she said four times, "By Allah, the One besides whom there is no god, he is one of the liars." So if he was telling the truth, the anger of Allah would be upon her. The Messenger of Allah ﷺ said, "Stop at the fifth one, as that is deserving." She hesitated and thought about confessing, then she said, "I don't want to expose my people." The Messenger of Allah ﷺ said, "If she comes with him and her eyelids are painted with kohl, her eyes are smeared with antimony, her thighs are dark and plump, her shins are well-built, then it is for the man with whom she was accused. And if she comes with him and he is pale, thin, with a thin beard, then it is for Hilal bin Umayyah." She came with him in a brazen manner. Ayub said, "The man who accused her was Hilal bin Umayyah, the son of Sahma, who was the brother of Bara bin Malik, the brother of Anas bin Malik's mother. His mother was black, and Sharik used to go to Hilal's house and stay with him. The sheikh named the word of cursing an oath."
لَمَّا قَذَفَ هِلَالُ بْنُ أُمَيَّةَ امْرَأَتَهُ قِيلَ لَهُ وَاللهِ لَيَحُدَّنَّكَ رَسُولُ اللهِ ﷺ ثَمَانِينَ جَلْدَةً قَالَ اللهُ أَعْدَلُ مِنْ ذَلِكَ أَنْ يَضْرِبَنِي ثَمَانِينَ ضَرْبَةً وَقَدْ عَلِمَ أَنِّي رَأَيْتُ حَتَّى اسْتَوْثَقْتُ وَسَمِعْتُ حَتَّى اسْتَبَنْتُ لَا وَاللهِ لَا يَضْرِبُنِي أَبَدًا فَنَزَلَتْ آيَةُ الْمُلَاعَنَةِ فَدَعَاهُمَا رَسُولُ اللهِ ﷺ حِينَ نَزَلَتِ الْآيَةُ فَقَالَ اللهُ يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ فَهَلْ مِنْكُمَا تَائِبٌ؟ فَقَالَ هِلَالٌ وَاللهِ إِنِّي لَصَادِقٌ فَقَالَ لَهُ احْلِفْ بِاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ إِنِّي لَصَادِقٌ تَقُولُ ذَلِكَ أَرْبَعَ مَرَّاتٍ فَإِنْ كُنْتَ كَاذِبًا فَعَلَيَّ لَعْنَةُ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ قِفُوهُ عِنْدَ الْخَامِسَةِ فَإِنَّهَا مُوجِبَةٌ فَحَلَفَ ثُمَّ قَالَتْ أَرْبَعًا وَاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ إِنَّهُ لَمِنَ الْكَاذِبِينَ فَإِنْ كَانَ صَادِقًا فَعَلَيْهَا غَضَبُ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ قِفُوهَا عِنْدَ الْخَامِسَةِ فَإِنَّهَا مُوجِبَةٌ فَتَرَدَّدَتْ وَهَمَّتْ بِالِاعْتِرَافِ ثُمَّ قَالَتْ لَا أَفْضَحُ قَوْمِي فَقَالَ رَسُولُ اللهِ ﷺ إِنْ جَاءَتْ بِهِ أَكْحَلَ أَدْعَجَ سَابِغَ الْأَلْيَتَيْنِ أَلِفَ الْفَخِذَيْنِ خَدَلَّجَ السَّاقَيْنِ فَهُوَ لِلَّذِي رُمِيَتْ بِهِ وَإِنْ جَاءَتْ بِهِ أَصْفَرَ قَضِيفًا سَبِطًا فَهُوَ لِهِلَالِ بْنِ أُمَيَّةَ فَجَاءَتْ بِهِ عَلَى صِفَةِ الْبَغِيِّ قَالَ أَيُّوبُ وَقَالَ مُحَمَّدُ بْنُ سِيرِينَ كَانَ الرَّجُلُ الَّذِي قَذَفَهَا بِهِ هِلَالُ بْنُ أُمَيَّةَ شَرِيكَ بْنَ سَحْمَاءَ وَكَانَ أَخَا الْبَرَاءِ بْنِ مَالِكٍ أَخِي أَنَسِ بْنِ مَالِكٍ لِأُمِّهِ وَكَانَتْ أُمُّهُ سَوْدَاءَ وَكَانَ شَرِيكٌ يَأْوِي إِلَى مَنْزِلِ هِلَالٍ وَيَكُونُ عِنْدَهُ قَالَ الشَّيْخُ فَسَمَّى كَلِمَةَ اللِّعَانِ حَلِفًا
[Machine] The Messenger of Allah ﷺ separated between a man and a woman from the Ansar. He castigated his wife and asked both of them to swear in front of him, the Messenger of Allah ﷺ , and then he separated them.
رَسُولَ اللهِ ﷺ فَرَّقَ بَيْنَ رَجُلٍ وَامْرَأَةٍ مِنَ الْأَنْصَارِ قَذَفَ امْرَأَتَهُ أَحْلَفَهُمَا رَسُولُ اللهِ ﷺ ثُمَّ فَرَّقَ بَيْنَهُمَا
[Machine] The Prophet ﷺ said: "There are four things that do not curse their husbands: Jewish women, Christian women under Muslim men, free women under slave men, and slave women under free men. And Christian women under a Christian man." So we said to them, "Have you heard this from an unknown man and a mistaken man? And the narration of 'Amr ibn Shuayb from Abdullah ibn Amr is broken, and the two narrations contradict each other. One of them narrates from the Prophet ﷺ , and the other contradicts Abdullah ibn Amr." So it does not establish the narration from Amr ibn Shuayb or Abdullah ibn Amr, and no one accepts it except a mistaken man. And 'Amr ibn Shuayb has narrated to us rulings that are in accordance with our sayings and contradict yours, narrated by trustworthy people who attribute them to the Prophet ﷺ . So you rejected it from us and rejected his narration and attributed it to a mistake, so you are invalidated. If his hadith is established by his own hadiths that we agreed upon, and you contradicted it in about thirty rulings from the Prophet ﷺ , you have contradicted most of them, so you are unjust. If you argue with his narration, and he is not among those whose narrations we accept, and then you argue with it as if it were established from him, and he is among those whose narrations we accept, we do not accept it because it is broken between him and Abdullah ibn Amr.
النَّبِيِّ ﷺ أَنَّهُ قَالَ أَرْبَعٌ لَا لِعَانَ بَيْنَهُنَّ وَبَيْنَ أَزْوَاجِهِنَّ الْيَهُودِيَّةُ وَالنَّصْرَانِيَّةُ تَحْتَ الْمُسْلِمِ وَالْحُرَّةُ تَحْتَ الْعَبْدِ وَالْأَمَةُ عِنْدَ الْحُرِّ وَالنَّصْرَانِيَّةُ عِنْدَ النَّصْرَانِيِّ فَقُلْنَا لَهُمْ رَوَيْتُمْ هَذَا عَنْ رَجُلٍ مَجْهُولٍ وَرَجُلٍ غَلَطَ وَعَمْرُو بْنُ شُعَيْبٍ عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو مُنْقَطِعٌ وَاللَّذَانِ رَوَيَا يَقُولُ أَحَدُهُمَا عَنِ النَّبِيِّ ﷺ وَالْآخَرُ يَقِفُهُ عَلَى عَبْدِ اللهِ بْنِ عَمْرٍو فَهُوَ لَا يَثْبُتُ عَنْ عَمْرٍو وَلَا عَنْ عَبْدِ اللهِ بْنِ عَمْرٍو وَلَا يَبْلُغُ بِهِ النَّبِيَّ ﷺ إِلَّا رَجُلٌ غَلِطَ قَالَ وَعَمْرُو بْنُ شُعَيْبٍ قَدْ رَوَى لَنَا عَنِ النَّبِيِّ ﷺ أَحْكَامًا تُوَافِقُ أَقَاوِيلَنَا وَتُخَالِفُ أَقَاوِيلَكُمْ يَرْوِيهَا عَنْهُ الثِّقَاتُ فَيُسْنِدُهَا إِلَى النَّبِيِّ ﷺ فَرَدَدْتُمُوهَا عَلَيْنَا وَرَدَدْتُمْ رِوَايَتَهُ وَنَسَبْتُمُوهَا إِلَى الْغَلَطِ فَأَنْتُمْ مَحْجُوجُونَ إِنْ كَانَ مِمَّنْ يَثْبُتُ حَدِيثُهُ بِأَحَادِيثِهِ الَّتِي وَافَقْنَاهَا وَخَالَفْتُمُوهَا فِي نَحْوٍ مِنْ ثَلَاثِينَ حُكْمًا عَنِ النَّبِيِّ ﷺ خَالَفْتُمْ أَكْثَرَهَا فَأَنْتُمْ غَيْرُ مُنْصِفِينَ إِنِ احْتَجَجْتُمْ بِرِوَايَتِهِ وَهُوَ مِمَّنْ لَا نُثْبِتُ رِوَايَتَهُ ثُمَّ احْتَجَجْتُمْ مِنْهَا بِمَا لَوْ كَانَ ثَابِتًا عَنْهُ وَهُوَ مِمَّنْ يَثْبُتُ حَدِيثُهُ لَمْ نُثْبِتْهُ لِأَنَّهُ مُنْقَطِعٌ بَيْنَهُ وَبَيْنَ عَبْدِ اللهِ بْنِ عَمْرٍو
[Machine] The Messenger of Allah ﷺ said that there are four types of women who are not cursed among each other: the Christian woman under the protection of a Muslim, the Jewish woman under the protection of a Muslim, the female slave under the ownership of a free man, and the free woman under the ownership of a slave. Abu Al-Hassan Ad-Daraqutni, the memorizer, said that this is Uthman ibn Ata al-Khorasani, and he is very weak in hadith. He was followed by Ibn Bazieh ar-Ramli from Ata al-Khorasani, and he is also weak. 15298 Abu Bakr ibn al-Harith informed us, I am Abu Muhammad ibn Hayyan, Muhammad ibn al-Hassan ibn Ali ibn Bahri informed us, Abu Musa informed us, Abu Al-Walid informed us, Yazid ibn Bazieh ar-Ramli from Ata al-Khorasani, from Amr ibn Shuayb, from his father, from his grandfather, from the Prophet ﷺ, with a similar narration. The Shaykh and Ata al-Khorasani are also not strong.

[Machine] The Messenger of Allah ﷺ said: There are four characteristics that do not exist between a free person and a slave, between a free woman and a slave woman, between a Muslim and a Jewish woman, and between a Muslim and a Christian woman. Abu Al-Hassan Al-Darqutni, the memorizer Uthman bin Abdul Rahman, said: His name is Al-Waqqasi, weak in hadith #15300. Abu Abdullah Al-Hafiz narrated to us, Abu Al-Abbas Muhammad bin Ya'qub narrated to us, Abbas bin Muhammad Al-Duri said: I heard Yahya bin Ma'in say: Al-Waqqasi is his name, Uthman bin Abdul Rahman, and he is weak. #15301. Abu Abdullah Al-Sulami and Abu Bakr bin Al-Harith Al-Faqih said: We are Ali bin Omar Al-Hafiz, narrated by Al-Rahawi, Hasan bin Ahmad bin Saeed, narrated by Muhammad bin Abi Furwah, narrated by Abu, narrated by Imad bin Matar, narrated by Hammad bin Amr, from Zaid bin Rufai, from Amr bin Shuayb, from his father, from his grandfather, that the Messenger of Allah ﷺ sent Attab bin Asid and mentioned something similar to it. Ali (may Allah have mercy on him) said: Hammad bin Amr, Imad bin Matar, and Zaid bin Rufai are weak. We have narrated it from Yahya bin Ma'in and Al-Bukhari regarding Hammad bin Amr. And Al-Darqutni said: It is narrated from Ibn Juraij and Al-Awza'i, and they are two imams, from Amr bin Shuayb, from his father, from his grandfather. His saying: Neither of them raised it to the Prophet ﷺ .
قَالَ رَسُولُ اللهِ ﷺ أَرْبَعَةٌ لَيْسَ بَيْنَهُمْ لِعَانٌ لَيْسَ بَيْنَ الْحُرِّ وَالْأَمَةِ لِعَانٌ وَلَيْسَ بَيْنَ الْحُرَّةِ وَالْعَبْدِ لِعَانٌ وَلَيْسَ بَيْنَ الْمُسْلِمِ وَالْيَهُودِيَّةِ لِعَانٌ وَلَيْسَ بَيْنَ الْمُسْلِمِ وَالنَّصْرَانِيَّةِ لِعَانٌ قَالَ أَبُو الْحَسَنِ الدَّارَقُطْنِيُّ الْحَافِظُ عُثْمَانُ بْنُ عَبْدِ الرَّحْمَنِ هُوَ الْوَقَّاصِيُّ مَتْرُوكُ الْحَدِيثِ 15300 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا الْعَبَّاسُ بْنُ مُحَمَّدٍ الدُّورِيُّ قَالَ سَمِعْتُ يَحْيَى بْنَ مَعِينٍ يَقُولُ الْوَقَّاصِيُّ اسْمُهُ عُثْمَانُ بْنُ عَبْدِ الرَّحْمَنِ وَهُوَ ضَعِيفٌ 15301 وَأَخْبَرَنَا أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ قَالَا أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ نا الرَّهَاوِيُّ الْحَسَنُ بْنُ أَحْمَدَ بْنِ سَعِيدٍ نا مُحَمَّدُ بْنُ أَبِي فَرْوَةَ نا أَبِي نا عِمَادُ بْنُ مَطَرٍ نا حَمَّادُ بْنُ عَمْرٍو عَنْ زَيْدِ بْنِ رُفَيْعٍ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللهِ ﷺ بَعَثَ عَتَّابَ بْنَ أَسِيدٍ فَذَكَرَ نَحْوَهُ قَالَ عَلِيٌّ رَحِمَهُ اللهُ حَمَّادُ بْنُ عَمْرٍو وَعِمَادُ بْنُ مَطَرٍ وَزَيْدُ بْنُ رُفَيْعٍ ضُعَفَاءُ وَقَدْ رُوِّينَاهُ عَنْ يَحْيَى بْنِ مَعِينٍ وَالْبُخَارِيِّ فِي حَمَّادِ بْنِ عَمْرٍو وَقَالَ الدَّارَقُطْنِيُّ وَرُوِيَ عَنِ ابْنِ جُرَيْجٍ وَالْأَوْزَاعِيِّ وَهُمَا إِمَامَانِ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَوْلُهُ لَمْ يَرْفَعَاهُ إِلَى النَّبِيِّ ﷺ
عَنْ عَمْرٍو
[Machine] His grandfather, and this is connected to the people of Hadith, some of whom have named their grandfather. Abdullah ibn Amr said and Shuayb ibn Muhammad ibn Abdullah heard from his grandfather Abdullah that it is authentic from his grandfather Abdullah. However, the chain of narration must be authenticated to Amr, and the chains of narration of this hadith are not authenticated to Amr. And Allah knows best.
جَدِّهِ وَذَلِكَ مَوْصُولٌ عِنْدَ أَهْلِ الْحَدِيثِ فَقَدْ سَمَّى بَعْضُهُمْ فِي هَذَا جَدَّهُ فَقَالَ عَبْدُ اللهِ بْنُ عَمْرٍو وَسَمَاعُ شُعَيْبِ بْنِ مُحَمَّدِ بْنِ عَبْدِ اللهِ صَحِيحٌ مِنْ جَدِّهِ عَبْدِ اللهِ لَكِنْ يَجِبُ أَنْ يَكُونَ الْإِسْنَادُ إِلَى عَمْرٍو صَحِيحًا وَلَمْ تَصِحَّ أَسَانِيدُ هَذَا الْحَدِيثِ إِلَى عَمْرٍو وَاللهُ أَعْلَمُ
[Machine] The Messenger of Allah ﷺ said, "O 'Attab bin Asid, I have sent you to the people of Makkah to forbid them from such and such, to mention the hadeeth to them. There are four things between them that are not allowed: the cursing of the Yemeni Jew by the Muslim, the cursing of the Christian by the Muslim, the slave having freedom with the slave-girl, and the free man having concubines. And this hadeeth, with this chain of narration, is false. Yahya bin Salih Al-Aili, his narrations are not reliable. And Allah knows best."
قَالَ رَسُولُ اللهِ ﷺ يَا عَتَّابُ بْنُ أَسِيدٍ إِنِّي قَدْ بَعَثْتُكَ إِلَى أَهْلِ مَكَّةَ فَانْهَهُمْ عَنْ كَذَا وَذَكَرَ الْحَدِيثَ وَفِيهِ أَرْبَعَةٌ لَيْسَ بَيْنَهُمْ مُلَاعَنَةٌ الْيَهُودِيَّةُ تَحْتَ الْمُسْلِمِ وَالنَّصْرَانِيَّةُ تَحْتَ الْمُسْلِمِ وَالْعَبْدُ عِنْدَهُ الْحُرَّةُ وَالْحُرُّ عِنْدَهُ الْأَمَةُ وَهَذَا الْحَدِيثُ بِهَذَا الْإِسْنَادِ بَاطِلٌ يَحْيَى بْنُ صَالِحٍ الْأَيْلِيُّ أَحَادِيثُهُ غَيْرُ مَحْفُوظَةٍ وَاللهُ تَعَالَى أَعْلَمُ
46.3 [Machine] Where is the curse located?
٤٦۔٣ بَابُ أَيْنَ يَكُونُ اللِّعَانُ
[Machine] "O Messenger of Allah, what do you think if a man finds his wife with another man, what should he do?" So, the verse of cursing was revealed regarding this matter. The Messenger of Allah ﷺ said, "Allah has already decreed upon you and upon your wife." He said, "Then we cursed each other in the mosque while I was a witness." And he mentioned the hadith.
يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ وَجَدَ رَجُلٌ مَعَ امْرَأَتِهِ رَجُلًا مَا يَفْعَلُ بِهِ؟ فَنَزَلَتْ فِيهِ آيَةُ اللِّعَانِ فَقَالَ رَسُولُ اللهِ ﷺ قَضَى اللهُ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا فِي الْمَسْجِدِ وَأَنَا شَاهِدٌ وَذَكَرَ الْحَدِيثَ
[Machine] I heard Abdullah ibn Ja'far saying, "I was present when the Messenger of Allah ﷺ cursed between Uwaymir al-Ajlani and his wife. The Messenger of Allah ﷺ returned from Tabuk and he denied the pregnancy that was in her belly, claiming that it is from a man called Ibn al-Sahma'. The Messenger of Allah ﷺ said to him, 'Bring your wife, for the Quran has been revealed regarding both of you.' So they cursed each other after Asr prayer, near the pulpit, while she was pregnant." And Abu Bakr narrated to us, Ali narrated to us, Ahmad ibn 'Isa al-Khawwas narrated to us, and Muhammad ibn Sa'ad al-Awfi narrated to us, from al-Waqidi, with a similar chain of narration.
سَمِعْتُ عَبْدَ اللهِ بْنَ جَعْفَرٍ يَقُولُ حَضَرْتُ رَسُولَ اللهِ ﷺ حِينَ لَاعَنَ بَيْنَ عُوَيْمِرٍ الْعَجْلَانِيِّ وَامْرَأَتِهِ مَرْجِعَ رَسُولِ اللهِ ﷺ مِنْ تَبُوكَ فَأَنْكَرَ حَمْلَهَا الَّذِي فِي بَطْنِهَا فَقَالَ هُوَ مِنِ ابْنِ السَّحْمَاءِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ هَاتِ امْرَأَتَكَ فَقَدْ نَزَلَ الْقُرْآنُ فِيكُمَا فَلَاعَنَ بَيْنَهُمَا بَعْدَ الْعَصْرِ عِنْدَ الْمِنْبَرِ عَلَى حَمْلٍ 15307 وَأَخْبَرَنَا أَبُو بَكْرٍ أنا عَلِيٌّ نا أَحْمَدُ بْنُ عِيسَى الْخَوَّاصُ نا مُحَمَّدُ بْنُ سَعْدٍ الْعَوْفِيُّ نا الْوَاقِدِيُّ بِهَذَا الْإِسْنَادِ نَحْوَهُ
[Machine] "That the Messenger of Allah ﷺ said: 'Whoever swears an oath on my pulpit with an impious right hand, he will occupy a seat in the Fire.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ حَلَفَ عَلَى مِنْبَرِي هَذَا بِيَمِينٍ آثِمَةٍ تَبَوَّأَ مَقْعَدَهُ مِنَ النَّارِ
The Prophet ﷺ said: One should not take a false oath at this pulpit of mine even on a green tooth-stick; otherwise he will make his abode in Hell, or Hell will be certain for him. (Using translation from Abū Dāʾūd 3246)
قَالَ رَسُولُ اللهِ ﷺ لَا يَحْلِفُ رَجُلٌ عَلَى يَمِينٍ آثِمَةٍ عِنْدَ هَذَا الْمِنْبَرِ إِلَّا تَبَوَّأَ مَقْعَدَهُ مِنَ النَّارِ وَلَوْ عَلَى سِوَاكٍ أَخْضَرَ
46.4 [Machine] The Sunnah of cursing, disowning children, and attributing them to someone else, and other matters.
٤٦۔٤ بَابُ سُنَّةِ اللِّعَانِ وَنَفْيِ الْوَلَدِ وَإِلْحَاقِهِ بِالْأُمِّ وَغَيْرِ ذَلِكَ
Sahl bin Sa’ad Al Sa’idi said that ‘Uwaimir bin Ashqar Al Ajilani came to ‘Asim bin Adl and said to him “Asim tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). Ibn Shihab said “Then this became the method of invoking curses.” (Using translation from Abū Dāʾūd 2245)
أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي يَا عَاصِمُ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَسَأَلَ عَاصِمٌ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللهِ ﷺ؟ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِ بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللهِ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللهِ ﷺ وَسَطَ النَّاسِ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَقَالَ النَّبِيُّ ﷺ قَدْ أَنْزَلَ اللهُ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَائْتِ بِهَا فَقَالَ سَهْلُ بْنُ سَعْدٍ فَتَلَاعَنَا عِنْدَ رَسُولِ اللهِ ﷺ وَأَنَا مَعَ النَّاسِ فَلَمَّا فَرَغَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ قَالَ ابْنُ شِهَابٍ فَكَانَتْ تِلْكَ سُنَّةَ الْمُتَلَاعِنَيْنِ 15311 وَأَخْبَرَنَا أَبُو نَصْرٍ مُحَمَّدُ بْنُ عَلِيِّ بْنِ مُحَمَّدٍ الشِّيرَازِيُّ الْفَقِيهُ نا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ نا يَحْيَى بْنُ مُحَمَّدٍ وَمُحَمَّدُ بْنُ نَصْرٍ وَجَعْفَرُ بْنُ مُحَمَّدٍ قَالُوا نا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنِ ابْنِ شِهَابٍ فَذَكَرَ الْحَدِيثَ بِنَحْوِهِ
"Uwaimir came to 'Asim bin 'Adi and said: 'Ask the Messenger of Ailah ﷺ for me: "Do you think that if a man finds another man with his wife and kills him, he should be killed in retaliation, or what should he do?" 'Asim asked the Messenger of Allah ﷺ about that, and the Messenger of Allah ﷺ disapproved of the question. Then 'Uwaimir met him ('Asim) and asked him about that, saying: 'What did you do?’ He said: I did that and you have not brought me any good. I asked the Messenger of Allah ﷺ and he disapproved of this question.’ Uwaimir said: 'By Allah, I will go to the Messenger of Allah ﷺ myself and ask him.' So he went to the Messenger of Allah ﷺ and found that Qur'an had been revealed concerning them, and the Prophet ﷺ told them to go through the procedure of Li'an. 'Uwaimir said: 'O Messenger of Allah, ﷺ by Allah if I take her back, I would have been telling lies about her.' So he left her before the Messenger of Allah ﷺ told him to do so, and that became the Sunnah for two who engage in the procedure of Li'an. Then the Prophet ﷺ said: 'Wait and see. If she gives birth to a child who is black in color with widely-spaced dark eyes and large buttocks, then I think that he was telling the truth about her, but if she gives birth to a child with a red complexion like a Wahrah,[1] then I think that he was lying.' Then she gave birth to a child with features resembling those of the man concerning whom she was accused." (Using translation from Ibn Mājah 2066)
يَا عَاصِمُ بْنَ عَدِيٍّ سَلْ لِي رَسُولَ اللهِ ﷺ عَنْ رَجُلٍ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَتَلَهُ أَيُقْتَلُ بِهِ أَمْ كَيْفَ يَصْنَعُ؟ فَسَأَلَ عَاصِمٌ النَّبِيَّ ﷺ فَعَابَ النَّبِيُّ ﷺ الْمَسَائِلَ فَلَقِيَهُ عُوَيْمِرٌ فَقَالَ مَا صَنَعْتَ؟ قَالَ مَا صَنَعْتُ أَنَّكَ لَمْ تَأْتِنِي بِخَيْرٍ سَأَلْتُ رَسُولَ اللهِ ﷺ فَعَابَ الْمَسَائِلَ قَالَ عُوَيْمِرٌ وَاللهِ لَآتِيَنَّ رَسُولَ اللهِ ﷺ وَلَأَسْأَلَنَّهُ فَأَتَاهُ فَوَجَدَهُ قَدْ أُنْزِلَ عَلَيْهِ فِيهِمَا فَدَعَاهُمَا فَلَاعَنَ بَيْنَهُمَا فَقَالَ عُوَيْمِرٌ لَئِنِ انْطَلَقْتَ بِهَا لَقَدْ كَذَبْتَ عَلَيْهَا فَفَارَقَهَا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ عَظِيمَ الْأَلْيَتَيْنِ فَمَا أَرَاهُ إِلَّا قَدْ صَدَقَ وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحَرَةٌ فَمَا أَرَاهُ إِلَّا كَاذِبًا فَجَاءَتْ بِهِ عَلَى النَّعْتِ الْمَكْرُوهِ قَالَ ابْنُ شِهَابٍ فَصَارَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ
'Uwaimir Al-ʿAjlani came to ʿAsim bin ʿAdi and said, "If a man found another man with his wife and killed him, would you sentence the husband to death (in Qisas,) i.e., equality in punishment)? O ʿAsim! Please ask Messenger of Allah ﷺ about this matter on my behalf." ʿAsim asked the Prophet ﷺ but the Prophet disliked the question and disapproved of it. ʿAsim returned and informed 'Uwaimir that the Prophet disliked that type of question. 'Uwaimir said, "By Allah, I will go (personally) to the Prophet." 'Uwaimir came to the Prophet ﷺ when Allah had already revealed Qur'anic Verses (in that respect), after ʿAsim had left (the Prophet ﷺ ). So the Prophet ﷺ said to 'Uwaimir, "Allah has revealed Qur'anic Verses regarding you and your wife." The Prophet ﷺ then called for them, and they came and carried out the order of Lian. Then 'Uwaimir said, "O Messenger of Allah ﷺ! Now if I kept her with me, I would be accused of telling a lie." So 'Uwaimir divorced her although the Prophet ﷺ did not order him to do so. Later on this practice of divorcing became the tradition of couples involved in a case of Li'an. The Prophet ﷺ said (to the people). "Wait for her! If she delivers a red short (small) child like a Wahra (a short red animal). then I will be of the opinion that he ('Uwaimir) has told a lie but if she delivered a black big-eyed one with big buttocks, then I will be of the opinion that he has told the truth about her." أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَتَلَهُ أَتَقْتُلُونَهُ؟ سَلْ لِي يَا عَاصِمُ رَسُولَ اللهِ ﷺ فَسَأَلَ النَّبِيَّ ﷺ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَعَابَهَا فَرَجَعَ عَاصِمٌ إِلَى عُوَيْمِرٍ فَأَخْبَرَهُ أَنَّ النَّبِيَّ ﷺ كَرِهَ الْمَسَائِلَ وَعَابَهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَآتِيَنَّ رَسُولَ اللهِ ﷺ فَجَاءَ رَسُولَ اللهِ ﷺ وَقَدْ نَزَلَ الْقُرْآنُ خِلَافَ عَاصِمٍ فَسَأَلَ رَسُولَ اللهِ ﷺ فَقَالَ قَدْ نَزَلَ فِيكُمَا الْقُرْآنُ فَتَقَدَّمَا فَتَلَاعَنَا ثُمَّ قَالَ كَذَبْتُ عَلَيْهَا إِنْ أَمْسَكْتُهَا فَفَارَقَهَا وَمَا أَمَرَهُ النَّبِيُّ ﷺ فَمَضَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ وَقَالَ رَسُولُ اللهِ ﷺ انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أَحْمَرَ قَصِيرًا كَأَنَّهُ وَحَرَةٌ فَلَا أَحْسَبُهُ إِلَّا قَدْ كَذَبَ عَلَيْهَا وَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَعْيَنَ ذَا أَلْيَتَيْنِ فَلَا أَحْسَبُهُ إِلَّا قَدْ صَدَقَ عَلَيْهَا فَجَاءَتْ بِهِ عَلَى النَّعْتِ الْمَكْرُوهِ
[Machine] A man from the Ansar came to the Prophet ﷺ and said, "O Messenger of Allah, what should a man do if he finds his wife with another man? Should he kill him and be killed himself?" So Allah revealed in the Quran regarding this matter. The Prophet ﷺ said, "The matter has been decided for you and your wife." They both cursed each other, and then the man left his wife in the presence of the Prophet ﷺ . It became a practice after them that if a couple curses each other, they should be separated. The wife was pregnant, and he denied that the child was his. His son was called to his mother. Abu Abdullah Al-Hafiz informed us, Abu Al-Abbas I am Ar-Rabi' reported in the hadith of Ibn Abi Dhia' that it indicates that Sahl ibn Sa'd said, "It was the practice of the cursed ones." In the hadith of Malik and Ibrahim ibn Sa'd, it is as if it is the statement of Ibn Shihab, and it may be that this is not a difference mentioned by Ibn Shihab once without mentioning Sa'ad and another time mentioning Sa'ad. Ibn Abi Dhia' agreed with Ibrahim ibn Sa'd in what he added to the end of the hadith in addition to the hadith of Malik. As for the hadith of Ibn Abi Dhia' it was informed by Abu Abdullah Al-Hafiz, Abu Sa'd Ahmad ibn Ya'qub ibn Ahmad Al-Thaqafi. Umar ibn Hafs As-Sadusi informed us, Asim ibn Ali narrated to us, Ibn Abi Dhia' narrated from Az-Zuhri, from Sahl ibn Sa'd As-Sa'idi, that Uwaimir came to Asim ibn Adi and mentioned the hadith in the meaning of the narration of Abdullah ibn Naafi'.
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَأَنْزَلَ اللهُ ﷻ فِي شَأْنِهِ مَا ذُكِرَ فِي الْقُرْآنِ مِنْ أَمْرِ الْمُتَلَاعِنَيْنِ قَالَ النَّبِيُّ ﷺ قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ ثُمَّ فَارَقَهَا عِنْدَ النَّبِيِّ ﷺ فَكَانَتْ سُنَّةً بَعْدَهُمَا أَنْ يُفَرَّقَ بَيْنَهُمَا أَيِ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا فَكَانَ ابْنُهُ يُدْعَى إِلَى أُمِّهِ 15315 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ نا أَبُو الْعَبَّاسِ أَنَا الرَّبِيعُ أَنَا الشَّافِعِيُّ قَالَ فِي حَدِيثِ ابْنِ أَبِي ذِئْبٍ دَلِيلٌ عَلَى أَنَّ سَهْلَ بْنَ سَعْدٍ قَالَ كَانَتْ سُنَّةَ الْمُتَلَاعِنَيْنِ وَفِي حَدِيثِ مَالِكٍ وَإِبْرَاهِيمَ بْنِ سَعْدٍ كَأَنَّهُ قَوْلُ ابْنِ شِهَابٍ وَقَدْ يَكُونُ هَذَا غَيْرَ مُخْتَلِفٍ يَقُولُهُ مَرَّةً ابْنُ شِهَابٍ وَلَا يَذْكُرُ سَهْلًا وَيَقُولُهُ أُخْرَى وَيَذْكُرُ سَهْلًا وَوَافَقَ ابْنُ أَبِي ذِئْبٍ إِبْرَاهِيمَ بْنَ سَعْدٍ فِيمَا زَادَ فِي آخِرِ الْحَدِيثِ عَلَى حَدِيثِ مَالِكٍ قَالَ الشَّيْخُ أَمَّا حَدِيثُ ابْنِ أَبِي ذِئْبٍ 15316 فَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أَخْبَرَنِي أَبُو سَعْدٍ أَحْمَدُ بْنُ يَعْقُوبَ بْنِ أَحْمَدَ الثَّقَفِيُّ نا عُمَرُ بْنُ حَفْصٍ السَّدُوسِيُّ نا عَاصِمُ بْنُ عَلِيٍّ نا ابْنُ أَبِي ذِئْبٍ عَنِ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ السَّاعِدِيِّ أَنَّ عُوَيْمِرًا جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ فَذَكَرَ الْحَدِيثَ بِمَعْنَى رِوَايَةِ عَبْدِ اللهِ بْنِ نَافِعٍ
Ibn Shihab informed me of Lian and the tradition related to it, referring to the narration of Sahl bin Saʿd, the brother of Bani Saʿidi He said, "An Ansari man came to Messenger of Allah ﷺ and said, 'O Allah's Apostle! If a man saw another man with his wife, should he kill him, or what should he do?' So Allah revealed concerning his affair what is mentioned in the Holy Qur'an about the affair of those involved in a case of Lian. The Prophet ﷺ said, 'Allah has given His verdict regarding you and your wife.' So they carried out Lian in the mosque while I was present there. When they had finished, the man said, "O Messenger of Allah ﷺ! If I should now keep her with me as a wife then I have told a lie about her. Then he divorced her thrice before Messenger of Allah ﷺ ordered him, when they had finished the Lian process. So he divorced her in front of the Prophet ﷺ ." Ibn Shihab added, "After their case, it became a tradition that a couple involved in a case of Lian should be separated by divorce. That lady was pregnant then, and later on her son was called by his mother's name. The tradition concerning their inheritance was that she would be his heir and he would inherit of her property the share Allah had prescribed for him." Ibn Shihab said that Sahl bin Saʿd As'Saidi said that the Prophet ﷺ said (in the above narration), "If that lady delivers a small red child like a lizard, then the lady has spoken the truth and the man was a liar, but if she delivers a child with black eyes and huge lips, then her husband has spoken the truth." Then she delivered it in the shape one would dislike (as it proved her guilty). (Using translation from Bukhārī 5309)
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ جَاءَ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ أَمْ كَيْفَ يَفْعَلُ؟ فَأَنْزَلَ اللهُ فِي شَأْنِهِ مَا ذُكِرَ فِي الْقُرْآنِ مِنْ أَمْرِ الْمُتَلَاعِنَيْنِ فَقَالَ النَّبِيُّ ﷺ قَدْ قَضَى اللهُ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا فِي الْمَسْجِدِ وَأَنَا شَاهِدٌ فَلَمَّا فَرَغَا قَالَ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ حِينَ فَرَغَا مِنَ التَّلَاعُنِ فَفَارَقَهَا عِنْدَ النَّبِيِّ ﷺ وَقَالَ ذَاكَ تَفْرِيقٌ بَيْنَ كُلِّ مُتَلَاعِنَيْنِ قَالَ ابْنُ جُرَيْجٍ قَالَ ابْنُ شِهَابٍ كَانَتِ السُّنَّةُ بَعْدَهُمَا أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا وَكَانَ ابْنُهَا يُدْعَى لِأُمِّهِ ثُمَّ جَرَتِ السُّنَّةُ فِي مِيرَاثِهَا أَنَّهَا تَرِثُهُ وَيَرِثُ مِنْهَا مَا فَرَضَ اللهُ ﷻ لَهُمَا قَالَ ابْنُ جُرَيْجٍ عَنِ ابْنِ شِهَابٍ عَنْ سَهْلِ بْنِ سَعْدٍ فِي هَذَا الْحَدِيثِ أَنَّ النَّبِيَّ ﷺ قَالَ إِنْ جَاءَتْ بِهِ أَحْمَرَ قَصِيرًا أَوْحَرَ فَمَا أَرَاهَا إِلَّا قَدْ صَدَقَتْ وَكَذَبَ عَلَيْهَا وَإِنْ جَاءَتْ بِهِ أَسْوَدَ أَعْيَنَ ذَا أَلْيَتَيْنِ فَلَا أَرَاهُ إِلَّا قَدْ صَدَقَ عَلَيْهَا فَجَاءَتْ بِهِ عَلَى الْمَكْرُوهِ مِنْ ذَلِكَ
[Machine] How do you say about a man who finds another man with his wife, should he kill him and you kill him or what should he do? He said, ask the Messenger of Allah ﷺ about that. So Asim came to the Prophet ﷺ and said, "O Messenger of Allah, a man finds another man with his wife, should he kill him and you kill him or what should he do?" So the Messenger of Allah ﷺ disliked the questions and criticized them. So Uwaimir said, "By Allah, I will not stop until I ask the Messenger of Allah ﷺ about that." So Uwaimir came and said, "O Messenger of Allah, a man finds another man with his wife, should he kill him and you kill him or what should he do?" So the Messenger of Allah ﷺ said, "Allah has revealed the Quran concerning you and your companion. So the Messenger of Allah ﷺ commanded both of them to curse each other with what Allah mentioned in His Book." So he said, "So she cursed him." Then he said, "O Messenger of Allah, if I divorce her, I have wronged her." He said, "So he divorced her, and it was a Sunnah for those who came after them from among the cursing parties." Then the Messenger of Allah ﷺ said, "Be cautious, for if she comes with a child called As'ham, it should be attributed to her. It will darken the two eyes, make the legs skinny, and I do not think Uwaimir except that he will be speaking the truth about her. And if she comes with a child called Uhaymir, it will be as if he is a free-roaming bull and I do not think Uwaimir except that he will be lying about her." He said, "She came with him with a description similar to the one the Messenger of Allah ﷺ attributed to him due to Uwaimir's testimony." He said, "After that, he was traced back to his mother."
كَيْفَ تَقُولُ فِي رَجُلٍ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ قَالَ سَلْ لي رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ قَالَ فَأَتَى عَاصِمٌ النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ فَسَأَلَهُ عُوَيْمِرٌ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ قَدْ كَرِهَ الْمَسَائِلَ وَعَابَهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ قَالَ فَجَاءَ عُوَيْمِرٌ فَقَالَ يَا رَسُولَ اللهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَقَالَ رَسُولُ اللهِ ﷺ قَدْ أَنْزَلَ اللهُ الْقُرْآنَ فِيكَ وَفِي صَاحِبَتِكَ فَأَمَرَهُمَا رَسُولُ اللهِ ﷺ بِالْمُلَاعَنَةِ بِمَا سَمَّى اللهُ فِي كِتَابِهِ قَالَ فَلَاعَنَهَا ثُمَّ قَالَ يَا رَسُولَ اللهِ إِنْ حَبَسْتُهَا فَقَدْ ظَلَمْتُهَا قَالَ فَطَلَّقَهَا وَكَانَتْ بَعْدُ سُنَّةً لِمَنْ كَانَ بَعْدَهُمَا مِنَ الْمُتَلَاعِنَيْنِ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ أَبْصِرُوا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ الْعَيْنَيْنِ عَظِيمَ الْأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَلَا أَحْسَبُ عُوَيْمِرًا إِلَّا وقَدْ صَدَقَ عَلَيْهَا وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحَرَةٌ فَلَا أَحْسَبُ عُوَيْمِرًا إِلَّا وَقَدْ كَذَبَ عَلَيْهَا قَالَ فَجَاءَتْ بِهِ عَلَى النَّعْتِ الَّذِي نَعَتَ رَسُولُ اللهِ ﷺ مِنْ تَصْدِيقِ عُوَيْمِرٍ قَالَ فَكَانَ يُنْسَبُ بَعْدَ ذَلِكَ لِأُمِّهِ
[Machine] A man came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, what do you think if a man finds another man with his wife, should he kill him and you kill her?" So Allah revealed concerning both of them what is mentioned in the Quran regarding the adulterous couple. The Messenger of Allah ﷺ said, "Allah has decided in your case and in the case of your wife." He said, "We curse each other and I am a witness before the Messenger of Allah ﷺ." The Prophet ﷺ said, "If you keep her, you have lied about her, so divorce her." The tradition among them was to separate between the two cursed individuals, and she was pregnant and denied her pregnancy. The Messenger of Allah ﷺ then said, "Her child will be called to her." Then the tradition regarding inheritance was implemented, that he would inherit her and she would inherit from him what Allah had ordained for her. Abu Ya'la said, "The matter was decided regarding him." He said, "He and al-Hasan." He said, "O Messenger of Allah, if I keep her and they testify, it will be a tradition between them and their speech will be about other than that."
أَنَّ رَجُلًا أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ فَأَنْزَلَ اللهُ ﷻ فِيهِمَا مَا ذُكِرَ فِي الْقُرْآنِ فِي الْمُتَلَاعِنَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ قَدْ قَضَى اللهُ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ إِنْ أَمْسَكْتُهَا فَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا وَكَانَتِ السُّنَّةُ فِيهِمَا أَنْ يُفَرِّقَا بَيْنَ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا وَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا ثُمَّ جَرَتِ السُّنَّةُ فِي الْمِيرَاثِ أَنْ يَرِثَهَا وَتَرِثُ مِنْهُ مَا فَرَضَ اللهُ لَهَا قَالَ أَبُو يَعْلَى قَدْ قُضِيَ فِيكَ قَالَ هُوَ وَالْحَسَنُ فَقَالَ يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا وَقَالَا فَكَانَتْ سُنَّةً بَيْنَهُمْ وَحَدِيثُهُمْ فِيمَا سِوَى ذَلِكَ وَاحِدٌ
[Machine] Sahl ibn Saad al-Saadi heard Sahl ibn Saad al-Saadi say, "I witnessed the two cursed ones during the time of the Messenger of Allah ﷺ , then he separated them, and he said, 'O Messenger of Allah, I lied about her if I were to retain her.'"
سَمِعَ سَهْلَ بْنَ سَعْدٍ السَّعْدِيَّ يَقُولُ شَهِدْتُ الْمُتَلَاعِنَيْنِ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَفَرَّقَ بَيْنَهُمَا فَقَالَ يَا رَسُولَ اللهِ قَدْ كَذَبْتُ عَلَيْهَا إِنْ أَنَا أَمْسَكْتُهَا
[Machine] I heard Ibn Umar say: The Messenger of Allah ﷺ separated the two fingers with his middle finger and said, "These two fingers represent the middle finger and the one after it represents the praising finger (index finger). He said, "Verily, Allah knows that one of you is lying. Would any of you repent?"
سَمِعْتُ ابْنَ عُمَرَ ؓ يَقُولُ: فَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَ أَخَوَيْ بَنِي عَجْلَانَ وَقَالَ هَكَذَا بِأُصْبُعِهِ الْمُسَبِّحَةِ وَالْوُسْطَى فَقَرَنَهُمَا الْوُسْطَى وَالَّتِي تَلِيهَا يَعْنِي الْمُسَبِّحَةَ وَقَالَ: «إِنَّ اللهَ يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ، فَهَلْ مِنْكُمَا تَائِبٌ؟»
Ibn ‘Umar said “The Apostle of Allaah ﷺ said to the spouses who invoked curses on each other. Your reckoning is in Allaah’s hands for one of you is liar there is no way for you to (remarry) her. He then asked Apostle of Allaah ﷺ what about my property? He replied “There is no property for you. If you have spoken the truth, it is the price for your having had the right to intercourse with her and if you have lied against her it is still more remote for you. أَنَّ النَّبِيَّ ﷺ قَالَ لِلْمُتَلَاعِنَيْنِ حِسَابُكُمَا عَلَى اللهِ أَحَدُكُمَا كَاذِبٌ لَا سَبِيلَ لَكَ عَلَيْهَا قَالَ يَا رَسُولَ اللهِ مَالِي قَالَ لَا مَالَ لَكَ إِنْ كُنْتَ صَدَقْتَ عَلَيْهَا فَهُوَ بِمَا اسْتَحْلَلْتَ مِنْ فَرْجِهَا وَإِنْ كُنْتَ كَذَبْتَ عَلَيْهَا فَذَلِكَ أَبْعَدُ لَكَ مِنْهَا أَوْ مِنْهُ
[Machine] Umara qad farraqa Rasulu Allahi bayna al-mutalaain.
عُمَرَ ؓ قَدْ فَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَ الْمُتَلَاعِنَيْنِ
[Machine] The Messenger of Allah ﷺ separated the child from its mother after she weaned him. This is mentioned in the narration of Malik, where Al-Shafi'i (may Allah have mercy on him) said: "It is possible for him to divorce her three times." This means that in the narration of Sahal, it is possible for him to divorce her based on what he finds in himself, based on his knowledge of her truthfulness, lies, and her daring to go against his prohibition. He divorced her three times without realizing that a curse is a form of separation, just as a divorce is a form of separation. It is also like someone who stipulates a condition in a sale or guarantee in a loan, which he is bound by whether he stipulates it or not. Ibn 'Umar narrated from the Prophet ﷺ that he separated between two parties who curse each other, and the separation of the Prophet ﷺ is different from a husband's divorce. It is only a separation of ruling. Al-Shaykh (may Allah have mercy on him) said: "And we have narrated in the narration of 'Abbad ibn Mansur from 'Ikrimah from Ibn 'Abbas (may Allah be pleased with them) in the story of Hilal ibn Umayah that the Messenger of Allah ﷺ decided that she should not be stoned, and her child should not be stoned. And whoever stones her or stones her child, he is to be subjected to the hadd punishment, and she is not entitled to maintenance or residence, because they are separated without divorce or death. And this narration confirms what al-Shafi’i said.”
وَانْتَفَى مِنْ وَلَدِهَا فَفَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ يُحْتَمَلُ طَلَاقُهُ ثَلَاثًا يَعْنِي فِي حَدِيثِ سَهْلٍ أَنْ يَكُونَ بِمَا وَجَدَ فِي نَفْسِهِ بِعِلْمِهِ بِصِدْقِهِ وَكَذِبِهَا وَجُرْأَتِهَا عَلَى النَّهْيِ فَطَلَّقَهَا ثَلَاثًا جَاهِلًا بِأَنَّ اللِّعَانَ فُرْقَةٌ فَكَانَ كَمَنْ طَلَّقَ مَنْ طَلَّقَ عَلَيْهِ بِغَيْرِ طَلَاقِهِ وَكَمَنْ شَرَطَ الْعُهْدَةَ فِي الْبَيْعِ وَالضَّمَانَ فِي السَّلَفِ وَهُوَ يَلْزَمُهُ شَرَطَ أَوْ لَمْ يَشْرِطْ قَالَ وَزَادَ ابْنُ عُمَرَ عَنِ النَّبِيِّ ﷺ أَنَّهُ فَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَتَفْرِيقُ النَّبِيِّ ﷺ غَيْرُ فُرْقَةِ الزَّوْجِ إِنَّمَا هُوَ تَفْرِيقُ حُكْمٍ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَدْ رَوَيْنَا فِي حَدِيثِ عَبَّادِ بْنِ مَنْصُورٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ فِي قِصَّةِ هِلَالِ بْنِ أُمَيَّةَ قَالَ وَقَضَى رَسُولُ اللهِ ﷺ أَنْ لَا تُرْمَى وَلَا يُرْمَى وَلَدُهَا وَمَنْ رَمَاهَا أَوْ رَمَى وَلَدَهَا جُلِدَ الْحَدَّ وَلَيْسَ لَهَا عَلَيْهِ قُوتٌ وَلَا سُكْنَى؛ مِنْ أَجْلِ أَنَّهُمَا يَتَفَرَّقَانِ بِغَيْرِ طَلَاقٍ وَلَا مُتَوَفًّى عَنْهَا وَهَذِهِ الرِّوَايَةُ تُؤَكِّدُ مَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ تَعَالَى
46.5 [Machine] The child for the bed as long as the master of the bed does not scold him.
٤٦۔٥ بَابُ الْوَلَدِ لِلْفِرَاشِ مَا لَمْ يَنْفِهِ رَبُّ الْفِرَاشِ بِاللِّعَانِ
[Machine] "That the Messenger of Allah ﷺ said: 'The child belongs to the bed and the adulterer gets the stone.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ
[Machine] You have spoken the truth but the Messenger of Allah ﷺ had decreed it from his bed.
عُمَرُ صَدَقْتَ وَلَكِنَّ رَسُولَ اللهِ ﷺ قَضَى بِالْفِرَاشِ
[Machine] "He said, 'My family married me to a Roman slave woman, and I had intercourse with her, and she gave birth to a black boy, like me, so I named him Abdullah. Then I had intercourse with her again, and she gave birth to another black boy, like me, so I named him Ubaydullah.' He said, 'Then she conceived a baby for my family, and they called him Birjees. He defamed her (child) with his tongue, and she gave birth to a boy who looked like a baby falcon, so I asked her, 'What is this?' She said, 'This is the son of Birjees.' It was referred to the Commander of the Believers, Uthman ibn Affan, may Allah be pleased with him. He said, 'Do you agree that I should judge between you according to the ruling of the Messenger of Allah?' Verily, the Messenger of Allah ruled that the child belongs to the bed (i.e. father). Mahdi said, 'And I think he said, 'And whip both of them.' They were both slaves.' In the narration of the Roudhbaarayy, Yoohannah said, 'I think he said, 'And whip her.' And I think he said, 'And they were both slaves.' And I think he said, 'And they had 15,332.' And Abu Bakr ibn Furak informed us, 'I am Abdullah ibn Ja'far, Yunus ibn Habib informed me, Abu Dawood informed me, and Jarir ibn Hazim and Mahdi ibn Maymoon narrated from Muhammad ibn Abdullah ibn Abi Ya'qoub, from Rabah, who mentioned it in its meaning.' He said, 'Verily, the Messenger of Allah ruled that the child belongs to the bed (i.e. the father), and the stone belongs to the adulteress. He is your son, you inherit him, and he inherits you.' I said, 'Glory be to Allah.' He said, 'That's it.' So I used to favor him between them (the two black boys) and this one (the white boy). Allah knows best."
أَنَّهُ قَالَ زَوَّجَنِي أَهْلِي أَمَةً لَهُمْ رُومِيَّةً فَوَقَعْتُ عَلَيْهَا فَوَلَدَتْ لِي غُلَامًا أَسْوَدَ مِثْلِي فَسَمَّيْتُهُ عَبْدَ اللهِ ثم وَقَعْتُ عَلَيْهَا فَوَلَدَتْ لِي غُلَامًا أَسْوَدَ مِثْلِي فَسَمَّيْتُهُ عُبَيْدَ اللهِ قََالَ فَطَبَنَ لَهَا غُلَامٌ لِأَهْلِي يُقَالُ لَهُ بِرْجِيسَ فَرَاطَنَهَا بِلِسَانِهِ فَوَلَدَتْ غُلَامًا كَأَنَّهُ وَزَغَةٌ فَقُلْتُ لَهَا مَا هَذَا؟ فَقَالَتْ هُوَ ابْنُ بِرْجِيسَ فَرُفِعَتْ إِلَى أَمِيرِ الْمُؤْمِنِينَ عُثْمَانَ بْنِ عَفَّانَ رَضِيَ اللهُ تعالى عَنْهُ قَالَ أَحْسَبُهُ قَالَ فَسَأَلَهَا فَاعْتَرَفَتْ فَقَالَ عُثْمَانُ بْنُ عَفَّانَ ؓ تَرْضَيَانِ أَنْ أَقْضِيَ بَيْنَكُمَا بِقَضَاءِ رَسُولِ اللهِ ﷺ؟ إِنَّ رَسُولَ اللهِ ﷺ قَضَى أَنَّ الْوَلَدَ لِلْفِرَاشِ قَالَ مَهْدِيٌّ وَأَحْسَبُهُ قَالَ وَجَلَدَهَا وَجَلَدَهُ وَكَانَا مَمْلُوكَيْنِ لَفْظُ حَدِيثِ الْمُقْرِئِ وَفِي رِوَايَةِ الرُّوذْبَارِيِّ يُوحَنَّهْ قَالَ أَحْسَبُهُ قَالَ مَهْدِيٌّ فَسَأَلَهُمَا فَاعْتَرَفَا وَقَالَ فِي آخِرِهِ قَالَ فَجَلَدَهَا وَجَلَدَهُ وَأَحْسَبُهُ قَالَ وَكَانَا مَمْلُوكَيْنِ 15332 وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ فُورَكٍ أنا عَبْدُ اللهِ بْنُ جَعْفَرٍ نا يُونُسُ بْنُ حَبِيبٍ نا أَبُو دَاوُدَ نا جَرِيرُ بْنُ حَازِمٍ وَمَهْدِيُّ بْنُ مَيْمُونٍ عَنْ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ أَبِي يَعْقُوبَ عَنْ رَبَاحٍ فَذَكَرَهُ بِمَعْنَاهُ وَقَالَ فِي آخِرِهِ إِنَّ رَسُولَ اللهِ ﷺ قَضَى أَنَّ الْوَلَدَ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرَ هُوَ ابْنُكَ تَرِثُهُ وَيَرِثُكَ قُلْتُ سُبْحَانَ اللهِ قَالَ هُوَ ذَاكَ فَكُنْتُ أُنَيِّمُهُ بَيْنَهُمَا هَذَانِ أَسْوَدَانِ وَهَذَا أَبْيَضُ وَاللهُ أَعْلَمُ
46.6 [Machine] The tightening of allowing a woman into a community that she does not belong to and the denial of a man's son.
٤٦۔٦ بَابُ التَّشْدِيدِ فِي إِدْخَالِ الْمَرْأَةِ عَلَى قَوْمٍ مَنْ لَيْسَ مِنْهُمْ وَفِي نَفْيِ الرَّجُلِ وَلَدَهُ
[Machine] He heard the Messenger of Allah ﷺ say: "When the verse of cursing was revealed, the Prophet ﷺ said, 'Any woman who enters upon a people who are not her own is not from Allah in anything, and Allah will not admit her into His Paradise. And any man who denies his child while he looks at him, Allah will hide Himself from him and expose him to the whole world, from among the first and the last.'" And Abu Abdullah Ishaq ibn Muhammad ibn Yusuf as-Susi narrated to us, Abu Jafar al-Baghdadi narrated to us, Ismail ibn Ishaq narrated to us, Ahmad ibn Isa narrated to us, Abdullah ibn Wahb narrated to me, Amr ibn al-Harith narrated to me from Ibn al-Had from Abdullah ibn Yunus from Sa'id al-Maqburi from Abu Hurairah that he heard the Messenger of Allah ﷺ say, and he mentioned it in the same wording as a marfu' report. Abdullah ibn Yunus said, "Muhammad ibn Ka'b al-Quradhi and Sa'id al-Maqburi narrate this hadith." And he said, "I have received this from the Messenger of Allah ﷺ ."
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ لَمَّا نَزَلَتْ آيَةُ الْمُلَاعَنَةِ قَالَ النَّبِيُّ ﷺ أَيُّمَا امْرَأَةٍ أَدْخَلَتْ عَلَى قَوْمٍ مَنْ لَيْسَ مِنْهُمْ فَلَيْسَتْ مِنَ اللهِ فِي شَيْءٍ وَلَنْ يُدْخِلَهَا اللهُ جَنَّتَهُ وَأَيُّمَا رَجُلٍ جَحَدَ وَلَدَهُ وَهُوَ يَنْظُرُ إِلَيْهِ احْتَجَبَ اللهُ مِنْهُ وَفَضَحَهُ بِهِ عَلَى رُءُوسِ الْخَلَائِقِ بَيْنَ الْأَوَّلِينَ وَالْأَخِرِينَ 15334 وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ إِسْحَاقُ بْنُ مُحَمَّدِ بْنِ يُوسُفَ السُّوسِيُّ نا أَبُو جَعْفَرٍ الْبَغْدَادِيُّ نا إِسْمَاعِيلُ بْنُ إِسْحَاقَ نا أَحْمَدُ بْنُ عِيسَى نا عَبْدُ اللهِ بْنُ وَهْبٍ أَخْبَرَنِي عَمْرُو بْنُ الْحَارِثِ عَنِ ابْنِ الْهَادِ عَنْ عَبْدِ اللهِ بْنِ يُونُسَ عَنْ سَعِيدٍ الْمَقْبُرِيِّ عَنْ أَبِي هُرَيْرَةَ ؓ أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ فَذَكَرَهُ بِمِثْلِهِ مَرْفُوعًا قَالَ عَبْدُ اللهِ بْنُ يُونُسَ فَقَالَ مُحَمَّدُ بْنُ كَعْبٍ الْقُرَظِيُّ وَسَعِيدٌ الْمَقْبُرِيُّ يُحَدِّثُ بِهَذَا الْحَدِيثِ فَقَالَ بَلَغَنِي هَذَا عَنْ رَسُولِ اللهِ ﷺ
46.7 [Machine] Who claims to belong to someone other than his father
٤٦۔٧ بَابُ مَنِ ادُّعِيَ إِلَى غَيْرِ أَبِيهِ
[Machine] The Messenger of Allah ﷺ said, "Whoever claims to be from someone other than his father, knowing that he is not, has disbelieved. And whoever claims something that is not his, he is not from us and should take his seat in the Fire. And whoever accuses a man of disbelief or says he is an enemy of Allah, when it is not true, then he has cast upon himself a great burden or injustice. It was not as he claimed."
قَالَ رَسُولُ اللهِ ﷺ مَنِ ادُّعِيَ إِلَى غَيْرِ أَبِيهِ وَهُوَ يَعْلَمُهُ فَقَدْ كَفَرَ وَمَنِ ادَّعَى مَا لَيْسَ لَهُ فَلَيْسَ مِنَّا وَلْيَتَبَوَّأْ مَقْعَدَهُ مِنَ النَّارِ وَمَنِ ادَّعَى رَجُلًا بِالْكُفْرِ أَوْ قَالَ عَدُوَّ اللهِ وَلَيْسَ كَذَلِكَ فَقَدْ حَارَ أَوْ جَارَ عَلَيْهِ لَمْ يَكُنْ كَذَلِكَ
I heard the Prophet ﷺ saying, "Whoever claims to be the son of a person other than his father, and he knows that person is not his father, then Paradise will be forbidden for him." I mentioned that to Abu Bakra, and he said, "My ears heard that and my heart memorized it from Messenger of Allah ﷺ. (Using translation from Bukhārī 6766)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنِ ادُّعِيَ إِلَى غَيْرِ أَبِيهِ وَهُوَ يَعْلَمُ أَنَّهُ غَيْرُ أَبِيهِ فَالْجَنَّةُ عَلَيْهِ حَرَامٌ قَالَ فَذَكَرْتُ ذَلِكَ لِأَبِي بَكْرَةَ فَقَالَ سَمِعَتْهُ أُذُنَايَ وَوَعَاهُ قَلْبِي
Both of my ears heard the Messenger of Allah saying this: He who claimed the fatherhood of anyone else besides his real father knowingly (committed a great sin) ;Paradise is forbidden to him. Abu Bakra asserted that he too heard it from the Messenger of Allah (may peace be upon him ). (Using translation from Muslim 63a)
لَمَّا ادَّعَى مُعَاوِيَةُ زِيَادًا لَقِيتُ أَبَا بَكْرَةَ فَقُلْتُ مَا هَذَا الَّذِي صَنَعْتُمْ فَإِنِّي سَمِعْتُ سَعْدًا يَقُولُ سَمِعَتْهُ أُذُنَايَ وَوَعَاهُ قَلْبِي مِنْ رَسُولِ اللهِ ﷺ يَقُولُ مَنِ ادَّعَى أَبًا فِي الْإِسْلَامِ وَهُوَ يَعْلَمُ أَنَّهُ غَيْرُ أَبِيهِ فَالْجَنَّةُ عَلَيْهِ حَرَامٌ قَالَ أَبُو بَكْرَةَ وَأَنَا سَمِعْتُهُ مِنْهُ
46.8 [Machine] Guidance on the curse of the spouses in the minutes of a group of believers.
٤٦۔٨ بَابُ لِعَانِ الزَّوْجَيْنِ بِمَحْضَرِ طَائِفَةٍ مِنَ الْمُؤْمِنِينَ
[Machine] I witnessed the two cursed ones in the presence of the Prophet ﷺ when I was fifteen years old, then he narrated the story.
شَهِدْتُ الْمُتَلَاعِنَيْنِ عِنْدَ النَّبِيِّ ﷺ وَأَنَا ابْنُ خَمْسَ عَشْرَةَ سَنَةً ثُمَّ سَاقَ الْحَدِيثَ
[Machine] "Allah ﷺ says to the two cursed ones, 'Your judgment is with Allah. One of you is a liar and there is no means of escape for you.' So one of them said, 'O Messenger of Allah, what is my wealth?' He replied, 'You have no wealth, if you were truthful then it is with the wealth that you wrongfully acquired from her, and if you lied about her then that is further away from you.' They mentioned this in the authentic hadith as was narrated by Abdullah bin Mas'ood, Abdullah bin Umar, Abdullah bin Abbas, and Anas bin Malik. And in that is an indication of their witnessing, along with others, their cursing each other. And Allah knows best."
اللهِ ﷺ يَقُولُ لِلْمُتَلَاعِنَيْنِ حِسَابُكُمَا عَلَى اللهِ أَحَدَكُمَا كَاذِبٌ لَا سَبِيلَ لَكَ عَلَيْهَا فَقَالَ يَا رَسُولَ اللهِ مَالِي مَالِي قَالَ لَا مَالَ لَكَ إِنْ كُنْتَ صَدَقْتَ فَهُوَ بِمَا اسْتَحْلَلْتَ مِنْ فَرْجِهَا وَإِنْ كُنْتَ كَذَبْتَ عَلَيْهَا فَذَاكَ أَبْعَدُ لَكَ فِيهِ أَوْ فِيهَا أَخْرَجَاهُ فِي الصَّحِيحِ كَمَا مَضَى وَقَدْ رَوَى قِصَّةَ الْمُتَلَاعِنَيْنِ عَبْدُ اللهِ بْنُ مَسْعُودٍ وَعَبْدُ اللهِ بْنُ عُمَرَ وَعَبْدُ اللهِ بْنُ عَبَّاسٍ وَأَنَسُ بْنُ مَالِكٍ ؓ وَفِي ذَلِكَ دَلَالَةٌ عَلَى شُهُودِهِمْ مَعَ غَيْرِهِمْ تَلَاعُنَهُمَا وَاللهُ تَعَالَى أَعْلَمُ
46.9 [Machine] Translation: "How does cursing work? And in the story of Uwaimir Al-Ajlani, it was narrated that the Messenger of Allah ﷺ said: 'Allah has revealed the Quran regarding you and your companion.' The Messenger of Allah ﷺ ordered them to exchange curses with what Allah the Almighty named in His book.
٤٦۔٩ بَابُ كَيْفَ اللِّعَانُ وَقَدْ رُوِيَ فِي قِصَّةِ عُوَيْمِرٍ الْعَجْلَانِيِّ قَالَ: فَقَالَ رَسُولُ اللهِ ﷺ: " قَدْ أَنْزَلَ اللهُ الْقُرْآنَ فِيكَ وَفِي صَاحِبَتِكَ " فَأَمَرَهُمَا رَسُولُ اللهِ ﷺ بِالْمُلَاعَنَةِ بِمَا سَمَّى اللهُ تَعَالَى فِي كِتَابِهِ
[Machine] The Messenger of Allah ﷺ revealed the Quran in you and in your companion. The Messenger of Allah ﷺ commanded them to invoke curses according to what Allah Almighty specified in His book.
رَسُولُ اللهِ ﷺ قَدْ أَنْزَلَ اللهُ الْقُرْآنَ فِيكَ وَفِي صَاحِبَتِكَ فَأَمَرَهُمَا رَسُولُ اللهِ ﷺ بِالْمُلَاعَنَةِ بِمَا سَمَّى اللهُ تَعَالَى فِي كِتَابِهِ
A man accused his wife of illegal sexual intercourse and denied his paternity to her (conceived) child during the lifetime of Messenger of Allah ﷺ. Messenger of Allah ﷺ ordered them both to do Mula'ana as Allah decreed and then gave his decision that the child would be for the mother, and a divorce decree was issued for the couple involved in a case of Mula'ana. رَجُلًا رَمَى امْرَأَتَهُ وَانْتَفَى مِنْ وَلَدِهَا فِي زَمَنِ رَسُولِ اللهِ ﷺ فَأَمَرَهُمَا رَسُولُ اللهِ ﷺ فَتَلَاعَنَا كَمَا قَالَ اللهُ ﷻ ثُمَّ قَضَى بِالْوَلَدِ لِلْمَرْأَةِ وَفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ
I was asked about the invokers of curses during the reign of Mus'ab (b. Zubair) whether they could separate (themselves by this process). He said: I did not understand what to say. So I went to the house of Ibn 'Umar (Allah be pleased with them) in Mecca. I said to his servant: Seek permission for Me. He said that he (Ibn 'Umar) had been taking rest. He (Ibn 'Umar) heard my voice. and said: Are you Ibn Jubair? I said: Yes. He'said: Come in. By Allah, it must be some (great) need which has brought you here at this Hour. So I got in and found him lying on a blanket reclining against a pillow stuffed with fibres of date-palm. I said: O Abu'Abd al-Rahman, should there be separation between the invokers of curses? He said: Hallowed be Allah, yes, The first one who asked about it was so and so. he said: Messenger of Allah, tell me If one of us finds his wife committing adultery: what should he do? If he talks, that is something great, and if he keeps quiet that is also (something great) (which he cannot afford to do). Allah's Prophet ﷺ kept quiet (or some time). After some time he (that very person) came to him (Messenger of Allah) and said: I have been involved in that very cage about which I had asked you Allah the Exalted and Majestic then revealed (these) verses of Surah Nur:" Those who accuse their wives" (verse 6), and he (the Holy Prophet) recited them to him and admonished him, and exhorted him and informed him that the torment of the world is less painful than the torment of the Hereafter. He said: No, by Him Who sent you with Truth, I did not tell a lie against her. He (the Holy Prophet) then called her (the wife of that person who had accused her) and admonished her, and exhorted her, and informed her that the torment of this world is less painful than the torment of the Hereafter. She said: No, by Him Who sent thee with Truth, he is a liar. (it was) the man who started the swearing of oath and he swore in the name of Allah four times that he was among the truthful. and at the fifth turn he said: Let there be curse of Allah upon him if he were among the liars. Then the woman was called and she swore four times in the name of Allah that he (her husband) was among the liars, and at the fifth time (she said): Let there be curse upon her if he were among the truthful. He (the Holy Prophet) then effected separation between the two. (Using translation from Muslim 1493a)
مَا جَاءَ بِكَ هَذِهِ السَّاعَةَ إِلَّا حَاجَةٌ فَإِذَا هُوَ مُفْتَرِشٌ بَرْذَعَةَ رَحْلِهِ مُتَوَسِّدًا بِوِسَادَةٍ حَشْوُهَا لِيفٌ أَوْ سَلَبٌ قَالَ السَّلَبُ يَعْنِي لِيفَ الْمَقْلِ فَقُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ الْمُتَلَاعِنَيْنِ يُفَرَّقُ بَيْنَهُمَا؟ فَقَالَ سُبْحَانَ اللهِ نَعَمْ إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ هَذَا فُلَانُ بْنُ فُلَانٍ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى عَلَى امْرَأَتِهِ رَجُلًا كَيْفَ يَصْنَعُ إِنْ تَكَلَّمَ تَكَلَّمَ بِأَمْرٍ عَظِيمٍ وَإِنْ سَكَتَ سَكَتَ عَلَى مِثْلِ ذَلِكَ قَالَ فَلَمْ يُجِبْهُ النَّبِيُّ ﷺ فَلَمَّا كَانَ بَعْدَ ذَلِكَ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ الَّذِي كُنْتُ سَأَلْتُ عَنْهُ قَدِ ابْتُلِيتُ بِهِ قَالَ فَأَنْزَلَ اللهُ ﷻ الْآيَاتِ الَّتِي فِي سُورَةِ النُّورِ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ} [النور 6] إِلَى آخِرِ الْآيَاتِ قَالَ فَدَعَا النَّبِيُّ ﷺ بِالرَّجُلِ فَتَلَا عَلَيْهِ وَوَعَظَهُ وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا كَذَبْتُ عَلَيْهَا قَالَ ثُمَّ دَعَا النَّبِيُّ ﷺ بِالْمَرْأَةِ فَتَلَا عَلَيْهَا وَوَعَظَهَا وَذَكَّرَهَا وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَتْ لَا وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا صَدَقَكَ لَقَدْ كَذَبَكَ قَالَ فَبَدَأَ النَّبِيُّ ﷺ بِالرَّجُلِ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّهُ لَمِنَ الصَّادِقِينَ وَفِي الْخَامِسَةِ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ثُمَّ ثَنَّى النَّبِيُّ ﷺ بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّهُ لَمِنَ الْكَاذِبِينَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ قَالَ ثُمَّ فَرَّقَ بَيْنَهُمَا
[Machine] "The Messenger of Allah ﷺ ordered a man, who was cursing between two people who were also cursing, to place his hand on his mouth at the fifth time. He said it was obligatory, and Allah, (glory be to Him), knows best."
رَسُولَ اللهِ ﷺ أَمَرَ رَجُلًا لَاعَنَ بَيْنَ الْمُتَلَاعِنَيْنِ أَنْ يَضَعَ يَدَهُ عَلَى فِيهِ عِنْدَ الْخَامِسَةِ وَقَالَ إِنَّهَا مُوجِبَةٌ وَاللهُ سُبْحَانَهُ وَتَعَالَى أَعْلَمُ
46.10 [Machine] Cursing on pregnancy
٤٦۔١٠ بَابُ اللِّعَانِ عَلَى الْحَمْلِ
A man came to Messenger of Allah ﷺ and said, "O Messenger of Allah ﷺ! Suppose a man saw another man with his wife, should he kill him whereupon you might kill him (i.e. the killer) (in Qisas) or what should he do?" So Allah revealed concerning their case what is mentioned of the order of Mula'ana. Allah's Apostle said to the man, "The matter between you and your wife has been decided." So they did Mula'ana in the presence of Messenger of Allah ﷺ and I was present there, and then the man divorced his wife. So it became a tradition to dissolve the marriage of those spouses who were involved in a case of Mula'ana. The woman was pregnant and the husband denied that he was the cause of her pregnancy, so the son was (later) ascribed to her. Then it became a tradition that such a son would be the heir of his mother, and she would inherit of him what Allah prescribed for her. (Using translation from Bukhārī 4746)
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ بِهِ؟ فَأَنْزَلَ اللهُ ﷻ مَا ذُكِرَ فِي الْقُرْآنِ مِنَ التَّلَاعُنِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا فَكَانَتْ سُنَّةً بَعْدُ فِيهِمَا أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا وَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا ثُمَّ جَرَتِ السُّنَّةُ فِي الْمَوَارِيثِ أَنْ يَرِثَهَا وَتَرِثَ مِنْهُ مَا فَرَضَ اللهُ ﷻ لَهُمَا
‘Abd Allah (bin Mas’ud) said “We were in the mosque on the night of a Friday, suddenly a man from the Ansar entered the mosque”. And said “If a man finds a man along with wife and declares (about her adultery) you will flog him. Or if he kills you, you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah, I shall ask the Apostle of Allaah ﷺ about it”. On the next day he came to the Apostle of Allaah ﷺ and said “If a man finds a man along with wife and declares (about her adultery) you will flog him. Or if he kills you, you will kill him or if keeps silence he will keep silence in anger.” He said “O Allaah, disclose”. He kept on praying until the verses regarding invoking curses (li’an) came down “As for those who accuse their wives but have no witnesses except themselves.” So, the man was first involved in this trial among the people. He and his wife came to the Apostle of Allaah ﷺ. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. She then wanted to invoke curses of Allaah on him. The Prophet ﷺ said “Do not do that. Bust she refused and did so (i.e., invoked curses). When they returned he said “Perhaps she will give birth to a black child with curly hair. (Using translation from Abū Dāʾūd 2253)
كُنَّا لَيْلَةَ الْجُمُعَةِ فِي الْمَسْجِدِ إِذْ دَخَلَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ لَوْ أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَإِنْ تَكَلَّمَ جَلَدْتُمُوهُ وَإِنْ قَتَلَ قَتَلْتُمُوهُ وَإِنْ سَكَتَ سَكَتَ عَلَى غَيْظٍ وَاللهِ لَأَسْأَلَنَّ عَنْهُ رَسُولَ اللهِ ﷺ فَلَمَّا كَانَ مِنَ الْغَدِ أَتَى رَسُولَ اللهِ ﷺ فَسَأَلَهُ فَقَالَ لَوْ أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَتَكَلَّمَ جَلَدْتُمُوهُ أَوْ قَتَلَ قَتَلْتُمُوهُ أَوْ سَكَتَ سَكَتَ عَلَى غَيْظٍ فَقَالَ اللهُمَّ افْتَحْ وَجَعَلَ يَدْعُو فَنَزَلَتْ آيَةُ اللِّعَانِ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلَّا أَنْفُسُهُمْ} [النور 6] هَذِهِ الْآيَاتِ فَابْتُلِيَ بِهِ الرَّجُلُ مِنْ بَيْنِ النَّاسِ فَجَاءَ هُوَ وَامْرَأَتُهُ إِلَى رَسُولِ اللهِ ﷺ فَتَلَاعَنَا فَشَهِدَ الرَّجُلُ أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّهُ لَمِنَ الصَّادِقِينَ ثُمَّ لَعَنَ الْخَامِسَةَ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ فَذَهَبَتْ لِتَلْتَعِنَ فَقَالَ رَسُولُ اللهِ ﷺ مَهْ فَلَعَنَتْ فَلَمَّا أَدْبَرَا قَالَ لَعَلَّهَا أَنْ تَجِيءَ بِهِ أَسْوَدَ جَعْدًا فَجَاءَتْ بِهِ أَسْوَدَ جَعْدًا
أَنَّ النَّبِيَّ ﷺ لَاعَنَ بِالْحَمْلِ
[Machine] "Lā'ana fa Lā'ana Rasūl Allāh ﷺ ya'nī baynahumā fa qāla Rasūl Allāh ﷺ inẓuruhā fa in jā'at bihi abyadah sabtan aqdā al'aynayn fahuwa li Hilāl ibn Umayyah wa in jā'at bihi akhalah ja'dan hamshas-sāqayn fahuwa li Shariq ibn Sahmā' qāla fa unbi'tu annahā jā'at bihi akhalah ja'dan hamshas-sāqayn."
"I cursed, and the Messenger of Allah ﷺ cursed him, meaning between the two of them. The Messenger of Allah ﷺ said, 'Look at it, if it comes with white streaks, it will be for Hilal ibn Umayyah, and if it comes with dark curly hair, twisted at the legs, it will be for Shariq ibn Sahma'.' He said, 'So, I was informed that it came with dark curly hair, twisted at the legs.'
لَاعَنَ فَلَاعَنَ رَسُولُ اللهِ ﷺ يَعْنِي بَيْنَهُمَا فَقَالَ رَسُولُ اللهِ ﷺ انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أَبْيَضَ سَبْطًا أَقْضَى الْعَيْنَيْنِ فَهُوَ لِهِلَالِ بْنِ أُمَيَّةَ وَإِنْ جَاءَتْ بِهِ أَكْحَلَ جَعْدًا حَمْشَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ سَحْمَاءَ قَالَ فَأُنْبِئْتُ أَنَّهَا جَاءَتْ بِهِ أَكْحَلَ جَعْدًا حَمْشَ السَّاقَيْنِ
[Machine] The cursed ones were mentioned in the presence of the Messenger of Allah ﷺ , so Asim ibn Adi made a statement about it and then left. A man from his tribe came to him and informed him that he found another man with his wife. Asim replied, "I would not have been afflicted with this if it wasn't for my statement." He then brought the matter to the attention of the Messenger of Allah ﷺ and informed him about what he found upon his wife. This man was fair in complexion, lean, with little flesh and thin hair. The one who claimed to have found Adam among his people, was described as tall, with abundant curly hair. The Messenger of Allah ﷺ invoked Allah, saying, "O Allah, make the truth clear." He then presented a man who resembled the one mentioned by her husband as the one he found with her. The Messenger of Allah ﷺ then invoked a curse between the couple. A man in the gathering said to Ibn Abbas, "She is the one whom the Messenger of Allah ﷺ said, 'If I had stoned someone without clear evidence, I would have stoned her.'" Ibn Abbas replied, "She is not a woman who displays evil in Islam."
الْمُتَلَاعِنَانِ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ عَاصِمُ بْنُ عَدِيٍّ فِي ذَلِكَ قَوْلًا فَانْصَرَفَ فَأَتَاهُ رَجُلٌ مِنْ قَوْمِهِ فَذَكَرَ لَهُ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَالَ عَاصِمٌ مَا ابْتُلِيتُ بِهَذَا إِلَّا بِقَوْلِي فَجَاءَ بِهِ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَهُ بِالَّذِي وَجَدَ عَلَيْهِ امْرَأَتَهُ وَكَانَ ذَلِكَ الرَّجُلُ مُصْفَرًّا قَلِيلَ اللَّحْمِ سَبِطَ الشَّعْرِ وَكَانَ الَّذِي ادَّعَى أَنَّهُ وَجَدَ عِنْدَ أَهْلِهِ آدَمَ خَدْلًا كَثِيرَ اللَّحْمِ جَعْدًا قَطَطًا فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ فَوَضَعَتْ شَبِيهًا بِالَّذِي ذَكَرَ زَوْجُهَا أَنَّهُ وَجَدَهُ عِنْدَهَا فَلَاعَنَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا فَقَالَ رَجُلٌ لِابْنِ عَبَّاسٍ فِي الْمَجْلِسِ هِيَ الَّتِي قَالَ رَسُولُ اللهِ ﷺ لَوْ رَجَمْتُ أَحَدًا بِغَيْرِ بَيِّنَةٍ لَرَجَمْتُ هَذِهِ فَقَالَ ابْنُ عَبَّاسٍ ؓ لَا تِلْكَ امْرَأَةٌ كَانَتْ تُظْهِرُ السُّوءَ فِي الْإِسْلَامِ
[Machine] He came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I have no covenant with my family since the season of pollinating the palm trees." He said, "And its pollinating is that when it is pollinated, it is not irrigated for forty days after pollination." He said, "So I found a man with my wife, and her husband was fair-skinned, with thick calves, hairless, and the one who was thrown with him is black, curly-haired, short, and hairy." The Messenger of Allah ﷺ said, "O Allah, make the truth clear, then curse the liar between them." Then a person resembling the man who was accused came.
جَاءَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ وَاللهِ مَالِي عَهْدٌ بِأَهْلِي مُنْذُ عَفَارِ النَّخْلِ قَالَ وَعَفَارُهَا أَنَّهَا إِذَا كَانَتْ تُؤَبَّرُ تُعْفَرُ أَرْبَعِينَ يَوْمًا لَا تُسْقَى بَعْدَ الْإِبَّارِ قَالَ فَوَجَدْتُ مَعَ امْرَأَتِي رَجُلًا قَالَ وَكَانَ زَوْجُهَا مُصْفَرًّا حَمْشَ السَّاقَيْنِ سَبِطَ الشَّعْرِ وَالَّذِي رُمِيَتْ بِهِ خَدْلًا إِلَى السَّوَادِ جَعْدًا قَطَطًا مُسْتَهًا قَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ ثُمَّ لَاعَنَ بَيْنَهُمَا فَجَاءَ شَبِيهًا بِالرَّجُلِ الَّذِي رُمِيَتْ بِهِ
[Machine] Allah cursed the man between the two camels and his wife who was pregnant. Her husband said, "By Allah, I have not come near her since we flocked the palm trees." The Messenger of Allah ﷺ said, "The 'afar' (period of not watering the date palm) is to water the palm trees after leaving them without water for two months." The Messenger of Allah ﷺ then supplicated and called to the husband of the woman, "May her arms and legs be discolored with gold-like hair." The one who was accused of impregnating Al-Sahma'a (the woman) came with a young boy who was black, with bleary eyes, having curly hair that reached his elbows and thick calves. Al-Qasim, the son of Shaddad bin Al-Had, asked Ibn Abbas, "Is this the woman about whom the Messenger of Allah ﷺ said: 'If I were to stone anyone without clear proof, I would have stoned her'?" Ibn Abbas replied, "This is not a woman who concealed evil in Islam." Ibn Abi Al-Zinad narrated it from his father with his Isanad (chain of narrators), from Abu Al-Zinad from his father, with this Tafsir (interpretation). The Messenger of Allah ﷺ cursed the man between the two camels and his wife who was pregnant. Her husband said, "By Allah, I have not come near her since we flocked the palm trees." He mentioned the Tafsir (interpretation) of "Afar." The Messenger of Allah ﷺ then supplicated and they claimed that the husband of the woman had golden-colored hair. He mentioned it in a different way, except that he said, "It turned tawny (golden-brown) instead of black." He added some other details. Ibn Khuzaymah narrated it, as well as Al-Rabi' bin Sulayman, who said, "I am the son of Wahb. Ibn Abi Al-Zinad narrated it from his father, from Abu Al-Zinad, from his father. Al-Qasim bin Muhammad narrated it from Abdullah bin Abbas, may Allah be pleased with him, and he mentioned it."
اللهِ ﷺ لَاعَنَ بَيْنَ الْعَجْلَانِيِّ وَامْرَأَتِهِ وَكَانَتْ حَامِلًا فَقَالَ زَوْجُهَا وَاللهِ مَا قَرَبْتُهَا مُنْذُ عَفَرْنَا قَالَ وَالْعَفْرُ أَنْ يُسْقَى النَّخْلُ بَعْدَ أَنْ يُتْرَكَ مِنَ السَّقْيِ بَعْدَ الْإِبَّارِ شَهْرَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ فَدَعَا رَسُولُ اللهِ ﷺ زَوْجَ الْمَرْأَةِ حَمْشَ الذِّرَاعَيْنِ وَالسَّاقَيْنِ أَصْهَبَ الشَّعْرِ وَكَانَ الَّذِي رُمِيَتْ بِهِ ابْنَ السَّحْمَاءِ فَجَاءَتْ بِغُلَامٍ أَسْوَدَ أَكْحَلَ جَعْدًا عَبْلَ الذِّرَاعَيْنِ خَدْلَ السَّاقَيْنِ قَالَ الْقَاسِمُ قَالَ ابْنُ شَدَّادِ بْنِ الْهَادِ لِابْنِ عَبَّاسٍ أَهِيَ الْمَرْأَةُ الَّتِي قَالَ رَسُولُ اللهِ ﷺ لَوْ كُنْتُ رَاجِمًا أَحَدًا بِغَيْرِ بَيِّنَةٍ لَرَجَمْتُهَا ؟ فَقَالَ ابْنُ عَبَّاسٍ لَا تِلْكَ امْرَأَةٌ أَعْلَنَتِ السُّوءَ فِي الْإِسْلَامِ وَرَوَاهُ ابْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ بِإِسْنَادِهِ أَنَّ رَسُولَ اللهِ ﷺ لَاعَنَ بَيْنَ الْعَجْلَانِيِّ وَامْرَأَتِهِ وَكَانَتْ حُبْلَى وَقَالَ زَوْجُهَا وَاللهِ مَا قَرَبْتُهَا مُنْذُ عَفَرْنَا النَّخْلَ وَذَكَرَ تَفْسِيرَ الْعَفْرِ وَقَالَ فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ وَزَعَمُوا أَنَّ زَوْجَ الْمَرْأَةِ كَانَ حَمْشَ الذِّرَاعَيْنِ فَذَكَرَهُ بِنَحْوِهِ غَيْرَ أَنَّهُ قَالَ أَجْلَى بَدَلَ أَكْحَلَ وَزَادَ قَطَطًا قَالَ ابْنُ خُزَيْمَةَ نا الرَّبِيعُ بْنُ سُلَيْمَانَ أنا ابْنُ وَهْبٍ أَخْبَرَنِي ابْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ حَدَّثَنِي الْقَاسِمُ بْنُ مُحَمَّدٍ عَنْ عَبْدِ اللهِ بْنِ عَبَّاسٍ ؓ فَذَكَرَهُ

٤٦۔١١ فَصْلٌ فِي سُؤَالِ الْمَرْمِيِّ بِالْمَرْأَةِ
فِي قَوْلِهِ {وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُوا بِأَرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً} [النور 4] الْآيَةَ قَالَ فَقَامَ عَاصِمُ بْنُ عَدِيٍّ فَذَكَرَ قِصَّةَ سُؤَالِهِ فِي رَجُلٍ يَرَى رَجُلًا عَلَى بَطْنِ امْرَأَتِهِ يَزْنِي بِهَا وَنُزُولَ آيَةِ اللِّعَانِ وَرَمْيَ ابْنِ عَمِّهِ هِلَالِ بْنِ أُمَيَّةَ امْرَأَتَهُ بِابْنِ عَمِّهِ شَرِيكِ بْنِ سَحْمَاءَ وَأَنَّهَا حُبْلَى قَالَ فَأَرْسَلَ رَسُولُ اللهِ ﷺ إِلَى الْخَلِيلِ وَالْمَرْأَةِ وَالزَّوْجِ فَاجْتَمَعُوا عِنْدَهُ فَقَالَ النَّبِيُّ ﷺ لِزَوْجِهَا هِلَالٍ وَيْحَكَ مَا تَقُولُ فِي بِنْتِ عَمِّكَ وَابْنِ عَمِّكَ وَخَلِيلِكَ أَنْ تَقْذِفَهَا بِبُهْتَانٍ فَقَالَ الزَّوْجُ أُقْسِمُ بِاللهِ يَا رَسُولَ اللهِ لَقَدْ رَأَيْتُهُ مَعَهَا عَلَى بَطْنِهَا وَإِنَّهَا لَحُبْلَى وَمَا قَرَبْتُهَا مُنْذُ أَرْبَعَةِ أَشْهُرٍ فَقَالَ النَّبِيُّ ﷺ لِلْمَرْأَةِ وَيْحَكِ مَا يَقُولُ زَوْجُكِ؟ قَالَتْ أَحْلِفُ بِاللهِ إِنَّهُ لَكَاذِبٌ وَمَا رَأَى مِنَّا شَيْئًا يُرِيبُهُ وَذَكَرَ كَلَامًا طَوِيلًا فِي الْإِنْكَارِ فَقَالَ النَّبِيُّ ﷺ لِلْخَلِيلِ وَيْحَكَ مَا يَقُولُ ابْنُ عَمِّكَ؟ فَقَالَ أُقْسِمُ بِاللهِ مَا رَأَى مَا يَقُولُ وَإِنَّهُ لَمِنَ الْكَاذِبِينَ وَذَكَرَ كَلَامًا طَوِيلًا فِي الْإِنْكَارِ قَالَ فَقَالَ النَّبِيُّ ﷺ لِلْمَرْأَةِ وَالزَّوْجِ قُومَا فَاحْلِفَا بِاللهِ فَقَامَا عِنْدَ الْمِنْبَرِ فِي دُبُرِ صَلَاةِ الْعَصْرِ فَحَلَفَ زَوْجُهَا هِلَالُ بْنُ أُمَيَّةَ فَقَالَ أَشْهَدُ بِاللهِ إِنِّي لَمِنَ الصَّادِقِينَ فَذَكَرَ لِعَانَهُ وَصِفَةَ لِعَانِهَا وَذَكَرَ فِي لِعَانِ الزَّوْجِ أَنَّهَا لَحُبْلَى مِنْ غَيْرِي وَإِنِّي لَمِنَ الصَّادِقِينَ ثُمَّ لَمْ يَذْكُرْ أَنَّهُ أَحْلَفَ شَرِيكًا وَإِنَّمَا ذَكَرَ قَوْلَ النَّبِيِّ ﷺ إِذَا وَلَدَتْ فَأْتُونِي بِهِ فَوَلَدَتْ غُلَامًا أَسْوَدَ جَعْدًا كَأَنَّهُ مِنَ الْحَبَشَةِ فَلَمَّا أَنْ نَظَرَ إِلَيْهِ فَرَأَى شَبَهَهُ بِشَرِيكٍ وَكَانَ ابْنَ حَبَشِيَّةٍ قَالَ لَوْلَا مَا مَضَى مِنَ الْأَيْمَانِ لَكَانَ لِي فِيهَا أَمْرٌ يَعْنِي الرَّجْمَ فَقَوْلُ الشَّافِعِيِّ رَحِمَهُ اللهُ وَسَأَلَ النَّبِيُّ ﷺ شَرِيكًا فَأَنْكَرَ فَلَمْ يُحَلِّفْهُ يُحْتَمَلُ أَنْ يَكُونَ إِنَّمَا أَخَذَهُ عَنْ أَهْلِ التَّفْسِيرِ فَإِنَّهُ كَانَ مَسْمُوعًا لَهُ وَلَمْ أَجِدْهُ فِي الرِّوَايَاتِ الْمَوْصُولَةِ وَالَّذِي قَالَ الشَّافِعِيُّ فِي كِتَابِ أَحْكَامِ الْقُرْآنِ وَلَمْ يُحْضِرْ رَسُولُ اللهِ ﷺ الْمَرْمِيَّ بِالْمَرْأَةِ إِنَّمَا قَالَهُ فِي قِصَّةِ عُوَيْمِرٍ الْعَجْلَانِيِّ وَالْمَرْمِيُّ بِالْمَرْأَةِ لَمْ يُسَمَّ فِي قِصَّةِ الْعَجْلَانِيِّ فِي الرِّوَايَاتِ الَّتِي عِنْدَنَا إِلَّا أَنَّ قَوْلَ النَّبِيِّ ﷺ إِنْ جَاءَتْ بِهِ بِنَعْتِ كَذَا وَكَذَا فِي تِلْكَ الْقِصَّةِ أَيْضًا يَدُلُّ عَلَى أَنَّهُ رَمَاهَا بِرَجُلٍ بِعَيْنِهِ وَلَمْ يُنْقَلْ فِيهَا أَنَّهُ أَحْضَرَهُ فَقَالَ الشَّافِعِيُّ فِي الْإِمْلَاءِ أَظُنُّهُ وَقَدْ قَذَفَ الرَّجُلُ الْعَجْلَانِيُّ امْرَأَتَهُ بِابْنِ عَمِّهِ وَابْنُ عَمِّهِ شَرِيكُ بْنُ السَّحْمَاءِ ثُمَّ سَاقَ الْكَلَامَ إِلَى أَنْ قَالَ وَالْتَعَنَ الْعَجْلَانِيُّ فَلَمْ يُحِدَّ النَّبِيُّ ﷺ شَرِيكًا بِالْتِعَانِهِ وَالَّذِي فِي مَا رَوَيْنَا مِنَ الْأَحَادِيثِ أَنَّ الَّذِيَ رَمَى زَوْجَتَهُ بِشَرِيكِ بْنِ سَحْمَاءَ هِلَالُ بْنُ أُمَيَّةَ الْوَاقِفِيُّ مِنْ بَنِي الْوَاقِفِ وَلَا أَعْلَمُ أَحَدًا سَمَّى فِي قِصَّةِ عُوَيْمِرٍ الْعَجْلَانِيِّ رَمْيَهُ امْرَأَتَهُ بِشَرِيكِ بْنِ سَحْمَاءَ إِلَّا مِنْ جِهَةِ مُحَمَّدِ بْنِ عُمَرَ الْوَاقِدِيِّ بِإِسْنَادٍ لَهُ قَدْ ذَكَرْنَاهُ فِيمَا مَضَى وَهُوَ أَيْضًا فِي رِوَايَةِ أَبِي الزِّنَادِ عَنِ الْقَاسِمِ عَنِ ابْنِ عَبَّاسٍ ؓ كَمَا مَضَى فِي الرِّوَايَاتِ الْمَشْهُورَةِ وَإِنَّمَا سُمِّيَ فِي قِصَّةِ هِلَالِ بْنِ أُمَيَّةَ وَيُشْبِهُ أَنْ تَكُونَ الْقِصَّتَانِ وَاحِدَةً فَقَدْ ذُكِرَ فِي الرِّوَايَاتِ الْمَوْصُولَةِ فِي قِصَّةِ الْعَجْلَانِيِّ أَنَّهُ أَمَرَ عَاصِمَ بْنَ عَدِيٍّ لِلسُّؤَالِ عَنْ ذَلِكَ ثُمَّ نَزَلَتِ الْآيَةُ وَجَاءَ عُوَيْمِرٌ الْعَجْلَانِيُّ فَلَاعَنَ النَّبِيُّ ﷺ بَيْنَهُ وَبَيْنَ امْرَأَتِهِ قَالَ إِنْ جَاءَتْ بِهِ كَذَا وَكَذَا وَذُكِرَ فِي قِصَّةِ هِلَالِ بْنِ أُمَيَّةَ أَيْضًا نُزُولُ الْآيَةِ فِيهِ وَأَنَّهُ لَاعَنَ بَيْنَهُ وَبَيْنَ امْرَأَتِهِ فَقَالَ إِنْ جَاءَتْ بِهِ كَذَا وَكَذَا وَذَكَرَ مُقَاتِلُ بْنُ حَيَّانَ فِي قِصَّةِ هِلَالٍ سُؤَالَ عَاصِمِ بْنِ عَدِيٍّ فَإِمَّا أَنْ تَكُونَا قِصَّةً وَاحِدَةً وَاخْتَلَفَ الرُّوَاةُ فِي اسْمِ الرَّامِي فَابْنُ عَبَّاسٍ ؓ فِي إِحْدَى الرِّوَايَتَيْنِ وَأَنَسُ بْنُ مَالِكٍ ؓ يُسَمِّيَانِهِ هِلَالَ بْنَ أُمَيَّةَ وَسَهْلُ بْنُ سَعْدٍ يُسَمِّيهِ عُوَيْمِرًا الْعَجْلَانِيَّ وَابْنُ عَبَّاسٍ ؓ فِي رِوَايَةِ ابْنِ أَبِي الزِّنَادِ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ عَنْهُ يَقُولُ لَاعَنَ بَيْنَ الْعَجْلَانِيِّ وَامْرَأَتِهِ وَابْنُ عُمَرَ ؓ يَقُولُ فَرَّقَ بَيْنَ أَخَوَيْ بَنِي الْعَجْلَانِ وَابْنُ مَسْعُودٍ ؓ يَقُولُ رَجُلٌ مِنَ الْأَنْصَارِ فَيَكُونُ قَوْلُهُ فِي الْإِمْلَاءِ خَارِجًا عَنْ بَعْضِ مَا رُوِيَ مِنَ الِاخْتِلَافِ فِي اسْمِ الرَّجُلِ وَإِمَّا أَنْ تَكُونَا قِصَّتَيْنِ وَكَانَ عَاصِمٌ حِينَ سَأَلَ عَنْ ذَلِكَ إِنمَّا سَأَلَ لِعُوَيْمِرٍ الْعَجْلَانِيِّ فَابْتُلِيَ بِهِ أَيْضًا هِلَالُ بْنُ أُمَيَّةَ فَنَزَلَتِ الْآيَةُ فحِينَ حَضَرَ كُلٌّ واحد مِنْهُمَا لَاعَنَ بَيْنَهُ وَبَيْنَ امْرَأَتِهِ وَأُضِيفَ نُزُولُ الْآيَةِ فِيهِ إِلَيْهِ فَعَلَى هَذَا يَنْبَغِي أَنْ يَكُونَ مَا وَقَعَ فِي الْإِمْلَاءِ خَطَأٌ مِنَ الْكَاتِبِ أَوْ تَقْلِيدًا لِمَا رُوِيَ فِي حَدِيثِ أَبِي الزِّنَادِ وَحَدِيثِ الْوَاقِدِيِّ وَاللهُ أَعْلَمُ
46.12 [Machine] What happens after divorce, separation from children, and isolation of woman if she does not remarry.
٤٦۔١٢ بَابُ مَا يَكُونُ بَعْدَ الْتِعَانِ الزَّوْجِ مِنَ الْفُرْقَةِ وَنَفْيِ الْوَلَدِ وَحَّدِ الْمَرْأَةِ إِنْ لَمْ تَلْتَعِنْ
The words narrated by Malik alone are: "and he attributed the child to the woman." Yunus narrated from Al Zuhri on the authority of Sahl bin Sa’d in the tradition regarding li’an(invoking curses). He disowned her conception hence her child was attributed to her. (Using translation from Abū Dāʾūd 2259)
لَاعَنَ امْرَأَتَهُ فِي زَمَنِ النَّبِيِّ ﷺ وَانْتَفَى مِنْ وَلَدِهَا فَفَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ
لَاعَنَ امْرَأَتَهُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَفَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَأَلْحَقَ الْوَلَدَ بِأُمِّهِ؟ قَالَ نَعَمْ
[Machine] The Messenger of Allah ﷺ said to the two curse-invokers, "Your account is with Allah. One of you is a liar, and there is no way for you to avoid it." One of them said, "O Messenger of Allah, what is mine is mine." He ﷺ said, "If you are truthful about it, then it is what you have legally acquired from her private part. But if you are lying about it, then it is further away from you than her (private part). This was reported in the authentic Hadith by Sufyan, as it has been transmitted to us from Muhammad ibn Zaid, from Sa'id ibn Jubayr, from Ibn 'Umar, from the Prophet ﷺ , who said, "When two curse-invokers separate, they will never come together again."
قَالَ رَسُولُ اللهِ ﷺ لِلْمُتَلَاعِنَيْنِ حِسَابُكُمَا عَلَى اللهِ أَحَدُكُمَا كَاذِبٌ لَا سَبِيلَ لَكَ عَلَيْهَا فَقَالَ يَا رَسُولَ اللهِ مَالِي مَالِي قَالَ إِنْ كُنْتَ صَدَقْتَ عَلَيْهَا فَهُوَ بِمَا اسْتَحْلَلْتَ مِنْ فَرْجِهَا وَإِنْ كُنْتَ كَذَبْتَ عَلَيْهَا فَهُوَ أَبْعَدُ لَكَ مِنْهُ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ سُفْيَانَ كَمَا مَضَى وَرُوِّينَا عَنْ مُحَمَّدِ بْنِ زَيْدٍ عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنِ ابْنِ عُمَرَ ؓ عَنِ النَّبِيِّ ﷺ قَالَ الْمُتَلَاعِنَانِ إِذَا تَفَرَّقَا لَا يَجْتَمِعَانِ أَبَدًا
