45. Chapter
٤٥۔ كِتَابُ الظِّهَارِ
"Praise is to Allah Whose hearing encompasses all voices. The woman who disputed concerning her husband (Al-Mujadilah) came to the Prophet when I was (sitting) in a corner of the house, and she complained about her husband, but I did not hear what she said. The Allah revealed: 'Indeed Allah has heard the statement of her that disputes with you concerning her husband.'" (Using translation from Ibn Mājah 188)
الْحَمْدُ لِلَّهِ الَّذِي وَسِعَ سَمْعُهُ الْأَصْوَاتَ لَقَدْ جَاءَتِ الْمُجَادِلَةُ تَشْتَكِي إِلَى رَسُولِ اللهِ ﷺ وَأَنَا فِي نَاحِيَةِ الْبَيْتِ مَا أَسْمَعُ مَا تَقُولُ فَأَنْزَلَ اللهُ ﷻ {قَدْ سَمِعَ اللهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا} [المجادلة 1]
"Blessed is the One Whose hearing encompasses all things. I heard some of the words of Khawlah bint Tha'labah, but some of her words were not clear to me, when she complained to the Messenger of Allah ﷺ about her husband, and said: 'O Messenger of Allah, ﷺ he has consumed my youth and I split my belly for him (i.e., bore him many children), but when I grew old and could no longer bear children he declared Zihar upon me; O Allah, I complain to You.' She continued to complain until Jibra'il brought down these Verses: 'Indeed Allah has heard the statement of she who pleads with you (O Muhammad) concerning her husband, and complains to Allah" (58:1) (Using translation from Ibn Mājah 2063)
تَبَارَكَ اللهُ الَّذِي وَسِعَ سَمْعُهُ كُلَّ شَيْءٍ إِنِّي لَأَسْمَعُ كَلَامَ خَوْلَةَ بِنْتِ ثَعْلَبَةَ وَيَخْفَى عَلَيَّ بَعْضُهُ وَهِيَ تَشْتَكِي إِلَى رَسُولِ اللهِ ﷺ زَوْجَهَا وَهِيَ تَقُولُ يَا رَسُولَ اللهِ أَكَلَ شَبَابِي وَنَثَرْتُ لَهُ بَطْنِي حَتَّى إِذَا كَبِرَتْ سِنِّي وَانْقَطَعَ لَهُ وَلَدِي ظَاهَرَ مِنِّي اللهُمَّ إِنِّي أَشْكُو إِلَيْكَ قَالَتْ عَائِشَةُ ؓ فَمَا بَرِحَتْ حَتَّى نَزَلَ جِبْرِيلُ عَلَيْهِ السَّلَامُ بِهَؤُلَاءِ الْآيَاتِ {قَدْ سَمِعَ اللهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا} [المجادلة 1] قَالَ وَزَوْجُهَا أَوْسُ بْنُ الصَّامِتِ
حَمَّادٍ فَأَرْسَلَهُ
[Machine] "Regarding his wife during the pre-Islamic period, you are to me like the back of my mother, forbidden to me in Islam," he said. He was the first person to openly declare his acceptance of Islam. Aus was his name, and his cousin's daughter, whose name was Khawla bint Khaylid, was married to him. He divorced her and then took her back, saying, "I don't see you as anything but forbidden to me." She responded with the same, and he then told her, "Go to the Prophet ﷺ and present your case to him." So she went to the Prophet ﷺ and found him using a comb to comb his hair. She informed him of what had transpired, and he said, "O Khawla, has anything been revealed to us about your situation?" The Prophet ﷺ then received a revelation and said, "O Khawla, have good news. She responded with, "Good news?!" He repeated, "Good news!" And then he recited to her the verse from the Quran, "Indeed, Allah has heard the statement of the woman who argues with you concerning her husband and complains to Allah" (Surah Al-Mujadila, 58:1)."
لِامْرَأَتِهِ فِي الْجَاهِلِيَّةِ أَنْتِ عَلَيَّ كَظَهْرِ أُمِّي حُرِّمَتْ عَلَيْهِ فِي الْإِسْلَامِ قَالَ وَكَانَ أَوَّلُ مَنْ ظَاهَرَ فِي الْإِسْلَامِ أَوْسٌ وَكَانَتْ تَحْتَهُ ابْنَةُ عَمٍّ لَهُ يُقَالُ لَهَا خُوَيْلَةُ بِنْتُ خُوَيْلِدٍ فَظَاهَرَ مِنْهَا فَأُسْقِطَ فِي يَدِهِ وَقَالَ مَا أَرَاكِ إِلَّا قَدْ حُرِّمْتِ عَلَيَّ قَالَتْ لَهُ مِثْلَ ذَلِكَ قَالَ قَالَ فَانْطَلِقِي إِلَى النَّبِيِّ ﷺ فَسَلِيهِ فَأَتَتِ النَّبِيَّ ﷺ فَوَجَدَتْ عِنْدَهُ مَاشِطَةً تَمْشُطُ رَأْسَهُ فَأَخْبَرَتْهُ فَقَالَ يَا خُوَيْلَةُ مَا أُمْرِنَا فِي أَمْرِكِ بِشَيْءٍ فَأُنْزِلَ عَلَى النَّبِيِّ ﷺ فَقَالَ يَا خُوَيْلَةُ أَبْشِرِي قَالَتْ خَيْرًا قَالَ خَيْرًا فَقَرَأَ عَلَيْهَا قَوْلَهُ تَعَالَى {قَدْ سَمِعَ اللهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا وَتَشْتَكِي إِلَى اللهِ} [المجادلة 1] الْآيَاتِ
[Machine] A divorce does not occur in the back, meaning it is not valid.
لَا يَقَعُ فِي الظِّهَارِ طَلَاقٌ يَعْنِي بِالظِّهَارِ
[Machine] Dhuhr and 'Ila' were considered forms of divorce during the pre-Islamic period, but Allah abolished them. Allah imposed a waiting period of four months for 'Ila' and prescribed expiation for Dhuhr.
كَانَ الظِّهَارُ وَالْإِيلَاءُ طَلَاقًا عَلَى عَهْدِ الْجَاهِلِيَّةِ فَوَقَّتَ اللهُ ﷻ فِي الْإِيلَاءِ أَرْبَعَةَ أَشْهُرٍ وَجَعَلَ فِي الظِّهَارِ الْكَفَّارَةَ
45.2 [Machine] No appearance in the nation
٤٥۔٢ بَابُ لَا ظِهَارَ فِي الْأَمَةِ
لَا ظِهَارَ مِنَ الْأَمَةِ
لَيْسَ مِنَ الْأَمَةِ ظِهَارٌ
[Machine] There is no clear answer for the nation, and Allah knows best.
لَيْسَ لِلْأَمَةِ ظِهَارٌ وَاللهُ أَعْلَمُ
45.3 [Machine] No appearance before marriage
٤٥۔٣ بَابُ لَا ظِهَارَ قَبْلَ نِكَاحٍ
[Machine] Al-Zuhar and divorce before consummation have no effect, and we have narrated in the book of divorce from the Prophet ﷺ, and then from Ali and Ibn Abbas, that there is no divorce before marriage, and Al-Zuhar in its meaning. It has also been narrated from Umar ibn al-Khattab and there is a difference of opinion on that with a weak chain of transmission.
الظِّهَارُ وَالطَّلَاقُ قَبْلَ الْمِلْكِ بِشَيْءٍ وَرَوَيْنَا فِي كِتَابِ الطَّلَاقِ عَنِ النَّبِيِّ ﷺ ثُمَّ عَنْ عَلِيٍّ وَابْنِ عَبَّاسٍ ؓ لَا طَلَاقَ قَبْلَ نِكَاحٍ وَالظِّهَارُ فِي مَعْنَاهُ وَقَدْ رُوِيَ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ خِلَافُ ذَلِكَ بِإِسْنَادٍ مُرْسَلٍ
[Machine] To marry her and not approach her until he has absolved the expiation of the perpetrator, this is severed. Qasim ibn Muhammad did not live during the time of Umar ibn al-Khattab.
أَنْ يَتَزَوَّجَهَا وَلَا يَقْرَبُهَا حَتَّى يُكَفِّرَ كَفَّارَةَ الْمُتَظَاهِرِ هَذَا مُنْقَطِعٌ الْقَاسِمُ بْنُ مُحَمَّدٍ لَمْ يُدْرِكْ عُمَرَ بْنَ الْخَطَّابِ ؓ
45.4 [Machine] The man pretends with one word to four women.
٤٥۔٤ بَابُ الرَّجُلِ يُظَاهِرُ مِنْ أَرْبَعِ نِسْوَةٍ لَهُ بِكَلِمَةٍ وَاحِدَةٍ
[Machine] From Umar: A man came forward in the presence of four women with one word and said, "One expiation." And the same was narrated from Sa'id bin Al-Musayyib, from Umar.
عَنْ عُمَرَ ؓ فِي رَجُلٍ ظَاهَرَ مِنْ أَرْبَعِ نِسْوَةٍ بِكَلِمَةٍ قَالَ كَفَّارَةٌ وَاحِدَةٌ وَكَذَلِكَ رُوِيَ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ عَنْ عُمَرَ ؓ
[Machine] And he said in the new matter, in regards to each one of them (feminine plural pronoun) is an expiation, and it is narrated from Qatadah on the authority of Al-Hasan Al-Basri, and with it Al-Hakam ibn Utaibah said.
وَقَالَ فِي الْجَدِيدِ عَلَيْهِ فِي كُلِّ وَاحِدَةٍ مِنْهُنَّ كَفَّارَةٌ وَهُوَ رِوَايَةُ قَتَادَةَ عَنِ الْحَسَنِ الْبَصْرِيِّ وَبِهِ قَالَ الْحَكَمُ بْنُ عُتَيْبَةَ
45.5 [Machine] The manifestations that require expiation
٤٥۔٥ بَابُ الْمُظَاهِرِ الَّذِي تَلْزَمُهُ الْكَفَّارَةُ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {وَالَّذِينَ يُظَاهِرُونَ مِنْكُمْ مِنْ نِسَائِهِمْ ثُمَّ يَعُودُونَ لِمَا قَالُوا فَتَحْرِيرُ رَقَبَةٍ مِنْ قَبْلِ أَنْ يَتَمَاسَّا} الْآيَةَ
[Machine] That the manifestations have prohibited his wife from him with zihar, so if a certain period passes after the statement of zihar, he does not prohibit her with the divorce that she is prohibited with, nor with anything that has an outlet from which she can be prohibited. The expiation of zihar becomes obligatory upon him, as if they are going towards the fact that when he holds onto what he has prohibited upon himself, that it is permissible, he has returned to what he said is contradictory, so he allows what he has prohibited. He said, "I do not know any meaning more appropriate to it than this." Al-Shafi'i, may Allah have mercy on him, said, "I do not know of any contradiction in that the expiation of zihar is obligatory upon him, even if he does not return with another manifestation. Therefore, it is not permissible to say unless I know of a contradiction in that it is not in the meaning of the verse."
أَنَّ الْمُظَاهِرَ حَرَّمَ امْرَأَتَهُ بِالظِّهَارِ فَإِذَا أَتَتْ عَلَيْهِ مُدَّةٌ بَعْدَ الْقَوْلِ بِالظِّهَارِ لَمْ يُحَرِّمْهَا بِالطَّلَاقِ الَّذِي تُحَرَّمُ بِهِ وَلَا بِشَيْءٍ يَكُونُ لَهُ مَخْرَجٌ مِنْ أَنْ تُحَرَّمَ بِهِ فَقَدْ وَجَبَتْ عَلَيْهِ كَفَّارَةُ الظِّهَارِ كَأَنَّهُمْ يَذْهَبُونَ إِلَى أَنَّهُ إِذَا أَمْسَكَ مَا حَرَّمَ عَلَى نَفْسِهِ أَنَّهُ حَلَالٌ فَقَدْ عَادَ لِمَا قَالَ مُخَالَفَةٌ فَأَحَلَّ مَا حَرَّمَ قَالَ وَلَا أَعْلَمُ لَهُ مَعْنًى أَوْلَى بِهِ مِنْ هَذَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ لَا أَعْلَمُ مُخَالِفًا فِي أَنَّ عَلَيْهِ كَفَّارَةَ الظِّهَارِ وَإِنْ لَمْ يَعُدْ بِتَظَاهُرٍ آخَرَ فَلَمْ يَجُزْ أَنْ يُقَالَ مَا لَمْ أَعْلَمْ مُخَالِفًا فِي أَنَّهُ لَيْسَ بِمَعْنَى الْآيَةِ
[Machine] Bintu Dulaij was married to a man from the Ansar who had bad character and was blind and poor. During the time of Jahiliyyah, when a man wanted to divorce his wife, he would say to her, "You are on my mother's back." She argued with him about something, but he said to her, "You are on my mother's back." He had a family or two families. When she heard him say that, she tolerated it for the sake of her children and went to seek the help of the Prophet Muhammad ﷺ . She met Aisha, the mother of the believers, in her house. Aisha was washing the Prophet's head, so she stood up and said, "O Messenger of Allah, my husband is poor, blind, and has bad character, and I argued with him about something." He said to her, "You are on my mother's back," and he did not intend divorce. The Prophet raised his head and said, "I do not know anything except that it has become forbidden on him." She cried and said, "I complain to Allah about what has happened to me and my children." The face of the Prophet changed, so Aisha said, "Behind you." The woman moved aside, and the Messenger of Allah stayed there as long as Allah willed, then the revelation stopped. The Prophet said, "O Aisha, where is the woman?" She said, "Here she is." He said, "Summon her." So she called her, and she brought her husband to him. When he saw him, he was as he described him, blind, poor, and of bad character. The Prophet said, "I seek refuge in the All-Hearing, All-Knowing Allah from Satan, the accursed. In the name of Allah, the Most Gracious, the Most Merciful, Allah has certainly heard the statement of the woman who argues with you concerning her husband and complains to Allah." He recited to him the verse until the end. Then the Prophet said to him, "Can you free a slave?" He said, "No." He said, "Can you fast for two consecutive months?" He said to him, "By the One who sent you with the truth, I do not eat once, twice, or three times without almost losing my sight." He said, "Can you feed sixty poor people?" He said, "No, except if you help me with it." The Messenger of Allah called for him, and he discharged his oath. This is a specific case, but he has evidence, and Allah knows best.
بِنْتُ دُلَيْجٍ تَحْتَ رَجُلٍ مِنَ الْأَنْصَارِ وَكَانَ سَيِّئَ الْخُلُقِ ضَرِيرَ الْبَصَرِ فَقِيرًا وَكَانَتِ الْجَاهِلِيَّةُ إِذَا أَرَادَ الرَّجُلُ أَنْ يُفَارِقَ امْرَأَتَهُ قَالَ لَهَا أَنْتِ عَلَيَّ كَظَهْرِ أُمِّي فَنَازَعَتْهُ فِي بَعْضِ الشَّيْءِ فَقَالَ أَنْتِ عَلَيَّ كَظَهْرِ أُمِّي وَكَانَ لَهُ عَيِّلٌ أَوْ عَيِّلَانِ فَلَمَّا سَمِعَتْهُ يَقُولُ مَا قَالَ احْتَمَلَتْ صِبْيَانَهَا فَانْطَلَقَتْ تَسْعَى إِلَى رَسُولِ اللهِ ﷺ فَوَافَقَتْهُ عِنْدَ عَائِشَةَ أُمِّ الْمُؤْمِنِينَ ؓ فِي بَيْتِهَا وَإِذَا عَائِشَةُ تَغْسِلُ شِقَّ رَأْسِ رَسُولِ اللهِ ﷺ فَقَامَتْ عَلَيْهِ ثُمَّ قَالَتْ يَا رَسُولَ اللهِ إِنَّ زَوْجِي فَقِيرٌ ضَرِيرُ الْبَصَرِ سَيِّئُ الْخُلُقِ وَإِنِّي نَازَعْتُهُ فِي شَيْءٍ فَقَالَ أَنْتِ عَلَيَّ كَظَهْرِ أُمِّي وَلَمْ يُرِدِ الطَّلَاقَ فَرَفَعَ النَّبِيُّ ﷺ رَأْسَهُ فَقَالَ مَا أَعْلَمُ إِلَّا قَدْ حُرِّمْتِ عَلَيْهِ قَالَ فَاسْتَكَانَتْ وَقَالَتْ أَشْتَكِي إِلَى اللهِ مَا نَزَلَ بِي وَبِصِبْيَتِي قَالَ وَتَحَوَّلَتْ عَائِشَةُ تَغْسِلُ شِقَّ رَأْسِهِ الْآخَرَ فَتَحَوَّلَتْ مَعَهَا فَقَالَتْ مِثْلَ ذَلِكَ قَالَتْ وَلِي مِنْهُ عَيِّلٌ أَوْ عَيِّلَانِ فَرَفَعَ النَّبِيُّ ﷺ رَأْسَهُ إِلَيْهَا فَقَالَ مَا أَعْلَمُ إِلَّا قَدْ حُرِّمْتِ عَلَيْهِ فَبَكَتْ وَقَالَتْ أَشْتَكِي إِلَى اللهِ مَا نَزَلَ بِي وَبِصِبْيَتِي وَتَغَيَّرَ وَجْهُ رَسُولِ اللهِ ﷺ فَقَالَتْ عَائِشَةُ ؓ وَرَاءَكِ فَتَنَحَّتْ وَمَكَثَ رَسُولُ اللهِ ﷺ مَا شَاءَ اللهُ ثُمَّ انْقَطَعَ الْوَحْيُ فَقَالَ يَا عَائِشَةُ أَيْنَ الْمَرْأَةُ؟ قَالَتْ هَا هِيَ هَذِهِ قَالَ ادْعِيهَا فَدَعَتْهَا فَقَالَ النَّبِيُّ ﷺ اذْهَبِي فَجِيئِي بِزَوْجِكِ قَالَ فَانْطَلَقَتْ تَسْعَى فَلَمْ تَلْبَثْ أَنْ جَاءَتْ بِهِ فَأَدْخَلَتْهُ عَلَى النَّبِيِّ ﷺ فَإِذَا هُوَ كَمَا قَالَتْ ضَرِيرُ الْبَصَرِ فَقِيرٌ سَيِّئُ الْخُلُقِ فَقَالَ النَّبِيُّ ﷺ أَسْتَعِيذُ بِالسَّمِيعِ الْعَلِيمِ مِنَ الشَّيْطَانِ الرَّجِيمِ بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ {قَدْ سَمِعَ اللهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا وَتَشْتَكِي إِلَى اللهِ} [المجادلة 1] إِلَى آخِرِ الْآيَةِ فَقَالَ لَهُ النَّبِيُّ ﷺ أَتَجِدُ عِتْقَ رَقَبَةٍ؟ قَالَ لَا قَالَ أَفَتَسْتَطِيعُ صَوْمَ شَهْرَيْنِ مُتَتَابِعَيْنِ؟ قَالَ لَهُ وَالَّذِي بَعَثَكَ بِالْحَقِّ إِذَا لَمْ آكُلِ الْمَرَّةَ وَالْمَرَّتَيْنِ وَالثَّلَاثَ يَكَادُ أَنْ يَغْشُوَ بَصَرِي قَالَ فَتَسْتَطِيعُ أَنْ تُطْعِمَ سِتِّينَ مِسْكِينًا؟ قَالَ لَا إِلَّا أَنْ تُعِينَنِي فِيهَا قَالَ فَدَعَا بِهِ رَسُولُ اللهِ ﷺ فَكَفَّرَ يَمِينَهُ هَذَا مُرْسَلٌ وَلَكِنْ لَهُ شَوَاهِدُ وَاللهُ أَعْلَمُ
45.6 [Machine] He does not approach it until he purifies himself" God, may He be blessed and exalted, said: "Before they touch one another" [Al-Mujadila: 3]. Al-Shafi'i, may Allah have mercy on him, said: "So if the touch happens before the expiation, then the time has passed, and the expiation is not invalidated, and we do not add anything to it as we say to him: 'Make up for the prayer at such a time and before such a time', then the time has passed, so he performs it because it is obligatory upon him, and we do not say to him: 'increase in it' due to the passing of time.
٤٥۔٦ بَابُ لَا يَقْرَبُهَا حَتَّى يُكَفِّرَ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {مِنْ قَبْلِ أَنْ يَتَمَاسَّا} [المجادلة: 3] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: فَإِذَا كَانَتِ الْمُمَاسَّةُ قَبْلَ الْكَفَّارَةِ فَذَهَبَ الْوَقْتُ لَمْ تَبْطُلِ الْكَفَّارَةُ وَلَمْ نَزِدْ عَلَيْهِ فِيهَا كَمَا يُقَالُ لَهُ أَدِّ الصَّلَاةَ فِي وَقْتِ كَذَا وَقَبْلَ وَقْتِ كَذَا فَيَذْهَبُ الْوَقْتُ فَيُؤَدِّيهَا لِأَنَّهَا فَرْضٌ عَلَيْهِ , وَلَا يُقَالُ لَهُ زِدْ فِيهَا لِذَهَابِ الْوَقْتِ
"I was a man who had a lot of desire for women, and I do not think there was any man who had as great a share of that as me. When Ramadan began, I declared Zihar upon my wife (to last) until Ramadan ended. While she was talking to me one night, part of her body became uncovered. I jumped on her and had intercourse with her. The next morning I went to my people and told them, and said to them: 'Ask the Messenger of Allah ﷺ for me.' They said: 'We will not do that, lest Allah reveal Quran concerning us or the Messenger of Allah ﷺ says, something about us, and it will be a lasting source of disgrace for us. Rather we will leave you to deal with it yourself. Go yourself and tell the Messenger of Allah ﷺ about your problem.' So I went out and when I came to him, I told him what happened. The Messenger of Allah ﷺ said: 'Did you really do that?' I said: 'I really did that, and here I am, O Messenger of Allah. ﷺ I will bear Allah’s ruling on me with patience.' He said: 'Free a slave.' I said: 'By the One Who sent you with the truth, I do not own anything but myself.' He said: 'Fast for two consecutive months.' I said: 'O Messenger of Allah, the thing that happened to me was only because of fasting.' He said: 'Then give charity, or feed sixty poor persons.' I said: 'By the One Who sent you with the truttu we spent last night with no dinner.' He said: 'Then go to the collector of charity of Banu Zuraiq, and tell him to give you something, then feed sixty poor persons, and benefit from the rest.'" (Using translation from Ibn Mājah 2062)
كُنْتُ امْرَأً أَسْتَكْثِرُ مِنَ النِّسَاءِ لَا أَرَى رَجُلًا كَانَ يُصِيبُ مِنْ ذَلِكَ مَا أُصِيبُهُ فَلَمَّا دَخَلَ رَمَضَانُ ظَاهَرْتُ مِنِ امْرَأَتِي حَتَّى يَنْسَلِخَ رَمَضَانُ فَبَيْنَمَا هِيَ تُحَدِّثُنِي ذَاتَ لَيْلَةٍ فَكُشِفَ لِي مِنْهَا شَيْءٌ فَوَثَبْتُ عَلَيْهَا فَوَاقَعْتُهَا فَلَمَّا أَصْبَحْتُ غَدَوْتُ عَلَى قَوْمِي فَأَخْبَرْتُهُمْ خَبَرِي فَقُلْتُ لَهُمْ سَلُوا لِي رَسُولَ اللهِ ﷺ فَقَالُوا مَا كُنَّا لِنَفْعَلَ إِذًا يَنْزِلُ فِينَا مِنَ اللهِ كِتَابٌ أَوْ يَكُونُ فِينَا مِنْ رَسُولِ اللهِ ﷺ قَوْلٌ فَيَبْقَى عَارُهُ عَلَيْنَا وَلَكِنْ سَوْفَ نُسَلِّمُكَ بِجَرِيرَتِكَ فَاذْهَبْ أَنْتَ فَاذْكُرْ شَأْنَكَ لِرَسُولِ اللهِ ﷺ فَخَرَجْتُ حَتَّى جِئْتَهُ فَأَخْبَرْتُهُ الْخَبَرَ فَقَالَ رَسُولُ اللهِ ﷺ أَنْتَ بِذَلِكَ؟ قَالَ قُلْتُ أَنَا بِذَلِكَ وَهَذَا أَنَا يَا رَسُولَ اللهِ صَابِرٌ لِحُكْمِ اللهِ عَلَيَّ قَالَ فَأَعْتِقْ رَقَبَةً قَالَ قُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَصْبَحْتُ أَمْلِكُ إِلَّا رَقَبَتِي هَذِهِ قَالَ فَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ قُلْتُ يَا رَسُولَ اللهِ وَهَلْ دَخَلَ عَلَيَّ مَا دَخَلَ مِنَ الْبَلَاءِ إِلَّا بِالصَّوْمِ؟ قَالَ فَتَصَدَّقْ أَطْعِمْ سِتِّينَ مِسْكِينًا قَالَ قُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَقَدْ بِتْنَا لَيْلَتَنَا هَذِهِ مَا لَنَا مِنْ عَشَاءٍ قَالَ فَاذْهَبْ إِلَى صَاحِبِ صَدَقَةِ بَنِي زُرَيْقٍ فَقُلْ لَهُ فَلْيَدْفَعْهَا إِلَيْكَ فَأَطْعِمْ سِتِّينَ مِسْكِينًا وَانْتَفِعْ بِبَقِيَّتِهَا
the Prophet ﷺ said concerning a man who declared Zihar upon his wife having intercourse with her before compensation: "Let him offer one expiation." (Using translation from Ibn Mājah 2064)
عَنِ النَّبِيِّ ﷺ فِي الْمُظَاهِرِ يُوَاقِعُ قَبْلَ أَنْ يُكَفِّرَ قَالَ كَفَّارَةٌ وَاحِدَةٌ
أَتَى النَّبِيَّ ﷺ وَقَدْ ظَاهَرَ مِنِ امْرَأَتِهِ فَوَقَعَ عَلَيْهَا فَقَالَ يَا رَسُولَ اللهِ إِنِّي ظَاهَرْتُ مِنِ امْرَأَتِي فَوَقَعْتُ عَلَيْهَا مِنْ قَبْلِ أَنْ أُكَفِّرَ قَالَ وَمَا حَمَلَكَ عَلَى ذَلِكَ يَرْحَمُكَ اللهُ؟ قَالَ رَأَيْتُ خَلْخَالَهَا فِي ضَوْءِ الْقَمَرِ قَالَ فَلَا تَقْرَبْهَا حَتَّى تَفْعَلَ مَا أَمَرَ اللهُ ﷻ 15260 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا أَبُو بَكْرِ بْنُ دَاسَةَ نا أَبُو دَاوُدَ قَالَ كَتَبَ إِلِيَّ الْحُسَيْنُ بْنُ الْحُرَيْثِ أنا الْفَضْلُ بْنُ مُوسَى عَنْ مَعْمَرٍ عَنِ الْحَكَمِ بْنِ أَبَانَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ عَنِ النَّبِيِّ ﷺ بِمَعْنَى هَذَا وَبِمَعْنَاهُ
[Machine] That he should ask for forgiveness, so he came to the Prophet ﷺ and informed him. He said, "What prompted you to do what you did?". He replied, "I saw the whiteness of her calves in the moonlight." He said, "Separate yourself from her until you are forgiven." Then he said, "And that was narrated to me by Yazid bin Ayoub, from Ismail, from Al-Hakam bin Aban, from Ikrimah, from the Prophet ﷺ in a similar manner, but he did not mention the calves and likewise
أَنْ يُكَفِّرَ فَأَتَى النَّبِيَّ ﷺ فَأَخْبَرَهُ قَالَ مَا حَمَلَكَ عَلَى مَا صَنَعْتَ؟ قَالَ رَأَيْتُ بَيَاضَ سَاقِهَا فِي الْقَمَرِ قَالَ فَاعْتَزِلْهَا حَتَّى تُكَفِّرَ عَنْكَ 15262 قَالَ وَنا زِيَادُ بْنُ أَيُّوبَ نا إِسْمَاعِيلُ نا الْحَكَمُ بْنُ أَبَانَ عَنْ عِكْرِمَةَ عَنِ النَّبِيِّ ﷺ نَحْوَهُ لَمْ يَذْكُرِ السَّاقَ وَكَذَلِكَ
[Machine] A man came to the Prophet ﷺ and said, "I have engaged in sexual intercourse with my wife before completing her purification (from menstruation)." The Prophet ﷺ asked him, "What led you to do that?" The man replied, "The moon appeared to me and I desired her, so I engaged with her before her purification was complete." The Prophet ﷺ advised him, "Refrain from her until she completes her purification."
أَتَى رَجُلٌ النَّبِيَّ ﷺ فَقَالَ إِنِّي ظَاهَرْتُ مِنِ امْرَأَتِي فَوَقَعْتُ بِهَا قَبْلَ أَنْ أُكَفِّرَ قَالَ وَمَا حَمَلَكَ عَلَى ذَلِكَ؟ قَالَ أَبْدَى لِيَ الْقَمَرُ خَلْخَالَيْهَا فَوَقَعْتُ بِهَا قَبْلَ أَنْ أُكَفِّرَ قَالَ كُفَّ عَنْهَا حَتَّى تُكَفِّرَ
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, I had relations with my wife and I saw the whiteness of her ankles in the moonlight, and it amazed me, so I approached her." He said, "Did you not hear what Allah said before you came into contact?" He said, "Yes, O Messenger of Allah, I did." He said, "Hold yourself back from her until she attains purification."
أَتَى رَجُلٌ النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي ظَاهَرْتُ مِنِ امْرَأَتِي فَرَأَيْتُ بَيَاضَ خَلْخَالِهَا فِي الْقَمَرِ فَأَعْجَبَنِي فَوَقَعْتُ عَلَيْهَا قَالَ أَوَ مَا قَالَ اللهُ {مِنْ قَبْلِ أَنْ يَتَمَاسَّا} [المجادلة 3]؟ قَالَ قَدْ فَعَلْتُ يَا رَسُولَ اللهِ قَالَ أَمْسِكْ عَنْهَا حَتَّى تُكَفِّرَ
[Machine] About the jurists from the people of Madinah, they used to say that whoever engages in sexual intercourse with his wife and then divorces her before he has to offer expiation for the act of intercourse, and then he marries her again after that, he is not required to offer the expiation for the act of intercourse until he has to offer expiation for engaging in sexual intercourse outside of marriage.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ مَنْ ظَاهَرَ مِنِ امْرَأَتِهِ ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يُكَفِّرَ ثُمَّ تَزَوَّجَهَا بَعْدَ ذَلِكَ لَمْ يَمَسَّهَا حَتَّى يُكَفِّرَ كَفَّارَةَ الظِّهَارِ
45.7 [Machine] The emancipation of the believer in the case of killing, according to Imam Shafi'i
٤٥۔٧ بَابُ عِتْقِ الْمُؤْمِنَةِ فِي الظِّهَارِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لَا يُجْزِيهِ تَحْرِيرُ رَقَبَةٍ عَلَى غَيْرِ دِينِ الْإِسْلَامِ؛ لِأَنَّ اللهَ تَعَالَى يَقُولُ فِي الْقَتْلِ: {فَتَحْرِيرُ رَقَبَةٍ مُؤْمِنَةٍ} [النساء: 92] , فَكَانَ شَرْطُ اللهِ تَعَالَى فِي رَقَبَةِ الْقَتْلِ إِذَا كَانَ كَفَّارَةً كَالدَّلِيلِ وَاللهُ أَعْلَمُ أَنْ لَا تَجْزِيَ رَقَبَةٌ فِي كَفَّارَةٍ إِلَّا مُؤْمِنَةً كَمَا شَرَطَ اللهُ الْعَدْلَ فِي الشَّهَادَةِ فِي مَوْضِعَيْنِ، وَأَطْلَقَ الشُّهُودَ فِي ثَلَاثَةِ مَوَاضِعَ، فَلَمَّا كَانَتْ شَهَادَةٌ كُلُّهَا اسْتَدْلَلْنَا عَلَى أَنَّ مَا أَطْلَقَ مِنَ الشَّهَادَاتِ إِنْ شَاءَ اللهُ عَلَى مِثْلِ مَعْنَى مَا شَرَطَ , قَالَ: وَإِنَّمَا رَدَّ اللهُ أَمْوَالَ الْمُسْلِمِينَ عَلَى الْمُسْلِمِينَ لَا عَلَى الْمُشْرِكِينَ , قَالَ: وَأَحَبُّ لَهُ أَنْ لَا يُعْتِقَ إِلَّا بَالِغَةً مُؤْمِنَةً وَإِنْ كَانَتْ أَعْجَمِيَّةً فَوَصَفَتِ الْإِسْلَامَ أَجْزَأَتْهُ
[Machine] He said, "I went to the Messenger of Allah ﷺ and said, 'O Messenger of Allah, I had a slave girl who used to take care of my sheep. I went to her and one sheep from the flock was missing. I asked her about it and she said, 'The wolf ate it.' I felt sorry for her, so I slapped her face and I had a necklace on my neck. I asked her, 'Should I free you?' The Messenger of Allah ﷺ said to her, 'Where is Allah?' She said, 'In the sky.' He asked, 'Who am I?' She said, 'You are the Messenger of Allah.' He said, 'Free her.' Omar bin Al-Hakam said, 'O Messenger of Allah, in the era of ignorance, we used to do certain things. We used to go to fortune-tellers.' The Prophet ﷺ said, 'Do not go to fortune-tellers.' Omar said, 'We used to practice divination.' The Prophet ﷺ said, 'That is something which a person may find in himself, but it does not harm you.' Ash-Shafi'i (may Allah have mercy on him) said, 'The name of the man was Mu'awiyah bin Al-Hakam.' This was narrated by Az-Zuhri and Yahya bin Abi Kathir. The Shaykh (may Allah have mercy on him) said, 'That is how it is.'"
أَنَّهُ قَالَ أَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ جَارِيَةً لِي كَانَتْ تَرْعَى غَنَمًا لِي فَجِئْتُهَا وَقَدْ فُقِدَتْ شَاةٌ مِنَ الْغَنَمِ فَسَأَلْتُهَا عَنْهَا فَقَالَتْ أَكَلَهَا الذِّئْبُ فَأَسِفْتُ عَلَيْهَا وَكُنْتُ مِنْ بَنِي آدَمَ فَلَطَمْتُ وَجْهَهَا وَعَلَيَّ رَقَبَةٌ أَفَأُعْتِقُهَا؟ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ أَيْنَ اللهُ؟ فَقَالَتْ فِي السَّمَاءِ فَقَالَ مَنْ أَنَا؟ قَالَتْ أَنْتَ رَسُولُ اللهِ فَقَالَ فَأَعْتِقْهَا فَقَالَ عُمَرُ بْنُ الْحَكَمِ يَا رَسُولَ اللهِ أَشْيَاءُ كُنَّا نَصْنَعُهَا فِي الْجَاهِلِيَّةِ كُنَّا نَأْتِي الْكُهَّانَ فَقَالَ النَّبِيُّ ﷺ لَا تَأْتُوا الْكُهَّانَ فَقَالَ عُمَرُ وَكُنَّا نَتَطَيَّرُ فَقَالَ إِنَّمَا ذَلِكَ شَيْءٌ يَجِدُ أَحَدُكُمْ فِي نَفْسِهِ فَلَا يَضُرَّنَّكُمْ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ اسْمُ الرَّجُلِ مُعَاوِيَةُ بْنُ الْحَكَمِ كَذَا رَوَى الزُّهْرِيُّ وَيَحْيَى بْنُ أَبِي كَثِيرٍ قَالَ الشَّيْخُ رَحِمَهُ اللهُ كَذَا
45.8 [Machine] The release of mute person when they gesture with faith and pray
٤٥۔٨ بَابُ إِعْتَاقِ الْخَرْسَاءِ إِذَا أَشَارَتْ بِالْإِيمَانِ وَصَلَّتْ
A man brought the Prophet ﷺ a black slave girl. He said: Messenger of Allah, emancipation of believing slave is due to me. He asked her: Where is Allah ? She pointed to the heaven with her finger. He then asked her: Who am I ? She pointed to the Prophet ﷺ and to the heaven, that is to say: You are the Messenger of Allah. He then said: Set her free, she is a believer. (Using translation from Abū Dāʾūd 3284)
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ بِجَارِيَةٍ سَوْدَاءَ فَقَالَ يَا رَسُولَ اللهِ إِنَّ عَلَيَّ عِتْقَ رَقَبَةٍ مُؤْمِنَةٍ فَقَالَ لَهَا أَيْنَ اللهُ؟ فَأَشَارَتْ إِلَى السَّمَاءِ بِإِصْبَعِهَا فَقَالَ لَهَا فَمَنْ أَنَا؟ فَأَشَارَتْ إِلَى النَّبِيِّ ﷺ وَإِلَى السَّمَاءِ تَعْنِي أَنْتَ رَسُولُ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ أَعْتِقْهَا فَإِنَّهَا مُؤْمِنَةٌ
[Machine] A woman came to the Messenger of Allah ﷺ with a black slave woman and said, "O Messenger of Allah, I have a believing slave woman. Should I free her?" The Messenger of Allah ﷺ asked her, "Who is your Lord?" She replied, "Allah is my Lord." He asked her, "What is your religion?" She said, "Islam." He asked her, "Who am I?" She replied, "You are the Messenger of Allah." Then he said to her, "So pray the five daily prayers and believe in what I have brought from Allah." She said, "Yes." Then he slapped her on the back and said, "Free her."
جَاءَتِ امْرَأَةٌ إِلَى رَسُولِ اللهِ ﷺ بِأَمَةٍ سَوْدَاءَ فَقَالَتْ يَا رَسُولَ اللهِ إِنَّ عَلَيَّ رَقَبَةً مُؤْمِنَةً أَفَتُجْزِئُ عَنِّي هَذِهِ؟ فَقَالَ رَسُولُ اللهِ ﷺ مَنْ رَبُّكِ؟ قَالَتْ اللهُ رَبِّي قَالَ فَمَا دِينُكِ؟ قَالَتْ الْإِسْلَامُ قَالَ فَمَنْ أَنَا؟ قَالَتْ أَنْتَ رَسُولُ اللهِ قَالَ فَتُصَلِّينَ الْخَمْسَ وَتُقِرِّينَ بِمَا جِئْتُ بِهِ مِنْ عِنْدِ اللهِ؟ قَالَتْ نَعَمْ فَضَرَبَ ﷺ عَلَى ظَهْرِهَا وقَالَ أَعْتِقِيهَا
45.9 [Machine] Description of Islam
٤٥۔٩ بَابُ وَصْفِ الْإِسْلَامِ
[Machine] The Prophet ﷺ said, "I will fight against the people until they testify that there is no god but Allah, and once they testify that there is no god but Allah and believe in me and what I have brought, their blood and wealth will be protected from me, except for its due and their reckoning will be with Allah."
أَنَّ النَّبِيَّ ﷺ قَالَ أُقَاتِلُ النَّاسَ حَتَّى يَقُولُوا لَا إِلَهَ إِلَّا اللهُ فَإِذَا شَهِدُوا أَنْ لَا إِلَهَ إِلَّا اللهُ وَآمَنُوا بِي وَبِمَا جِئْتُ بِهِ فَقَدْ عَصَمُوا مِنِّي دِمَاءَهُمْ إِلَّا بِحَقِّهَا وَحِسَابُهُمْ عَلَى اللهِ
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ أَتَى النَّبِيَّ ﷺ بِجَارِيَةٍ لَهُ سَوْدَاءَ فَقَالَ لِرَسُولِ اللهِ ﷺ يَا رَسُولَ اللهِ إِنَّ عَلَيَّ رَقَبَةً مُؤْمِنَةً أَفَأُعْتِقُ هَذِهِ؟ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ أَتَشْهَدِينَ أَنْ لَا إِلَهَ إِلَّا اللهُ؟ قَالَتْ نَعَمْ قَالَ أَتَشْهَدِينَ أَنَّ مُحَمَّدًا رَسُولُ اللهِ؟ قَالَتْ نَعَمْ قَالَ أَتُوقِنِينَ بِالْبَعْثِ مِنْ بَعْدِ الْمَوْتِ؟ قَالَتْ نَعَمْ فَقَالَ رَسُولُ اللهِ ﷺ فَأَعْتِقْهَا هَذَا مُرْسَلٌ وَقَدْ مَضَى مَوْصُولًا بِبَعْضِ مَعْنَاهُ
"I came to the Messenger of Allah and said: 'My mother left a will saying that a slave should be freed on her behalf. I have a Nubian slave girl; will it suffice if I free her on her behalf?' He said: 'Bring her here.' The Prophet said to her: 'Who is your Lord?' She said: 'Allah.' He said: 'Who am I?' She said: 'The Messenger of Allah.' He said: 'Set her free , for she is a believer.'" (Using translation from Nasāʾī 3653)
قُلْتُ يَا رَسُولَ اللهِ إِنَّ أُمِّي أَوْصَتْ إِلِيَّ أَنْ أَعْتِقْ عَنْهَا رَقَبَةً وَإِنَّ عِنْدِي جَارِيَةً سَوْدَاءَ نُوبِيَّةً فَقَالَ رَسُولُ اللهِ ﷺ ادْعُ بِهَا فَقَالَ مَنْ رَبُّكِ؟ قَالَتْ اللهُ قَالَ فَمَنْ أَنَا؟ قَالَتْ رَسُولُ اللهِ قَالَ أَعْتِقْهَا فَإِنَّهَا مُؤْمِنَةٌ
45.10 [Machine] Do not replace a mandatory obligation with another obligation; instead, replace it with the condition of manumission.
٤٥۔١٠ بَابُ لَا تَجْزِي فِي رَقَبَةٍ وَاجِبَةٍ رَقَبَةٌ تُشْتَرَى بِشَرْطٍ أَنْ تُعْتَقَ
Muhammad bin Ja'far narrated to us, from Shu'bah, from Amr bin Murrah who said: "I asked Abu Ubaidah bin Abdullah: 'Did you remember anything from Abdullah?' He said, 'No'" (Using translation from Tirmidhī 624)

45.11 [Machine] Who has the expiation through fasting?
٤٥۔١١ بَابُ مَنْ لَهُ الْكَفَّارَةُ بِالصِّيَامِ قَالَ اللهُ تَبَارَكَ وَتَعَالَى: {فَتَحْرِيرُ رَقَبَةٍ مِنْ قَبْلِ أَنْ يَتَمَاسَّا فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ مِنْ قَبْلِ أَنْ يَتَمَاسَّا}
[Machine] He approached me and spoke to me about something while he was in a state of irritation. I replied to him and he became angry and said, "You are like the back of my mother." Then he went out to his people's gathering and returned to me and tried to please me with himself, but I refused. He insisted, so I pushed him forcefully and overpowered him with what a weak man is overpowered by a woman. She said, so I said, "By the one in whose hand is the soul of Khawla, it will not reach me until Allah judges between me and you." So I went to the Prophet ﷺ to complain to him about what I had encountered. He said, "Fear Allah and treat your husband and your cousin well." She said, "I did not stop until Allah revealed: 'Indeed, Allah has heard the statement of her that disputes with you [Prophet] concerning her husband.'" (Quran 58:1) until the expiation was ordered. The Prophet ﷺ said, "Tell him to free a slave." She said, "By Allah, he does not possess a slave." He said, "Then let him fast for two consecutive months." She said, "I said, 'O Messenger of Allah, he is an old man and cannot fast.'" He said, "Then let him feed sixty poor people." She said, "I said, 'O Messenger of Allah, he does not have anything to feed them with.'" He said, "Yes, indeed, we will help him with a pile of dates. A mound of dates can accommodate thirty was." She said, "I said, 'O Messenger of Allah, can I help him with another mound of dates?'" He said, "You have done well in advising him. Let him give charity then. Allah knows best."
دَخَلَ عَلَيَّ فَكَلَّمَنِي بِشَيْءٍ وَهُوَ فِيهِ كَالضَّجْرِ فَرَادَدْتُهُ فَغَضِبَ وَقَالَ أَنْتِ عَلَيَّ كَظَهْرِ أُمِّي ثُمَّ خَرَجَ إِلَى نَادِي قَوْمِهِ ثُمَّ رَجَعَ إِلِيَّ فَرَاوَدَنِي عَلَى نَفْسِي فَأَبَيْتُ فَشَادَّنِي فَشَادَدْتُهُ فَغَلَبْتُهُ بِمَا تَغْلِبُ بِهِ الْمَرْأَةُ الرَّجُلَ الضَّعِيفَ قَالَتْ فَقُلْتُ وَالَّذِي نَفْسُ خُوَيْلَةَ بِيَدِهِ لَا تَصِلُ إِلِيَّ حَتَّى يَحْكُمَ اللهُ فِيَّ وَفِيكَ فَأَتَيْتُ النَّبِيَّ ﷺ أَشْكُو إِلَيْهِ مَا لَقِيتُ فَقَالَ زَوْجُكِ وَابْنُ عَمِّكِ اتَّقِي اللهَ وَأَحْسِنِي صُحْبَتَهُ قَالَتْ فَمَا بَرِحْتُ حَتَّى أَنْزَلَ اللهُ ﷻ {قَدْ سَمِعَ اللهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا} [المجادلة 1] إِلَى الْكَفَّارَةِ فَقَالَ النَّبِيُّ ﷺ مُرِيهِ فَلْيُعْتِقْ رَقَبَةً قَالَتْ وَاللهِ مَا عِنْدَهُ رَقَبَةٌ يَمْلِكُهَا قَالَ فَلْيَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَتْ قُلْتُ يَا رَسُولَ اللهِ شَيْخٌ كَبِيرٌ مَا بِهِ مِنْ صِيَامٍ قَالَ فَلْيُطْعِمْ سِتِّينَ مِسْكِينًا فَقُلْتُ يَا نَبِيَّ اللهِ مَا عِنْدَهُ مَا يُطْعِمُ قَالَ بَلَى سَنُعِينُهُ بِعَرَقٍ وَالْعَرَقُ الْمِكْتَلُ يَسَعُ فِيهِ ثَلَاثِينَ صَاعًا مِنَ التَّمْرِ قَالَتْ فَقُلْتُ يَا رَسُولَ اللهِ وَأَنَا أُعِينُهُ بِعَرَقٍ آخَرَ قَالَ قَدْ أَحْسَنْتِ مُرِيهِ فَلْيَتَصَدَّقْ وَاللهُ أَعْلَمُ

45.13 [Machine] Who is responsible for the expiation by feeding?
٤٥۔١٣ بَابُ مَنْ لَهُ الْكَفَّارَةُ بِالْإِطْعَامِ
[Machine] "Khuwaylah bint Tha'labah was married to Aws ibn al-Samit, and she accused him of impotence. The Prophet Muhammad ﷺ was informed about this, so she said, 'By the One who sent you with the truth, I did not come to you except seeking mercy for him. He does have some benefits.' Allah then revealed verses in the Quran regarding this matter. The Prophet Muhammad ﷺ said, 'Let him set her free.' She replied, 'By the One who sent you with the truth, he does not have a slave to set free.' The Prophet said, 'Then let him fast for two consecutive months.' She replied, 'By the One who sent you with the truth, if I were to ask him to fast for three days, he would not be able to do it due to his old age.' The Prophet said, 'Then let him feed sixty poor people.' She replied, 'By the One who sent you with the truth, he is not capable of that.' The Prophet said, 'Then let him go to so-and-so, as he informed me that he has half a sa' of dates for charity. Let him take it as charity for himself, and then give it as charity to sixty poor people. This is a message and he is a witness for what comes before it.' And Allah knows best."
أَنَّ خُوَيْلَةَ بِنْتَ ثَعْلَبَةَ كَانَتْ تَحْتَ أَوْسِ بْنِ الصَّامِتِ فَتَظَاهَرَ مِنْهَا وَكَانَ بِهِ لَمَمٌ فَجَاءَتْ رَسُولَ اللهِ ﷺ فَقَالَتْ إِنَّ أَوْسًا تَظَاهَرَ مِنِّي وَذَكَرَتْ أَنَّ بِهِ لَمَمًا فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا جِئْتُكَ إِلَّا رَحْمَةً لَهُ إِنَّ لَهُ فِيَّ مَنَافِعَ فَأَنْزَلَ اللهُ ﷻ فِيهِمَا الْقُرْآنَ فَقَالَ رَسُولُ اللهِ ﷺ مُرِيهِ فَلْيُعْتِقْ رَقَبَةً فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا عِنْدَهُ رَقَبَةٌ وَلَا يَمْلِكُهَا فَقَالَ مُرِيهِ فَلْيَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَوْ كَلَّفْتَهُ ثَلَاثَةَ أَيَّامٍ مَا اسْتَطَاعَ وَكَانَ الْحَرُّ فَقَالَ مُرِيهِ فَلْيُطْعِمْ سِتِّينَ مِسْكِينًا فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا يَقْدِرُ عَلَيْهِ قَالَ مُرِيهِ فَلْيَذْهَبْ إِلَى فُلَانِ بْنِ فُلَانٍ فَقَدْ أَخْبَرَنِي أَنَّ عِنْدَهُ شَطْرَ تَمْرٍ صَدَقَةٍ فَلْيَأْخُذْهُ صَدَقَةً عَلَيْهِ ثُمَّ لِيَتَصَدَّقْ بِهِ عَلَى سِتِّينَ مِسْكِينًا هَذَا مُرْسَلٌ وَهُوَ شَاهِدٌ لِلْمَوْصُولِ قَبْلَهُ وَاللهُ أَعْلَمُ
45.14 [Machine] It is not permissible to provide food for less than sixty poor individuals, with each poor person receiving a portion of their country's food.
٤٥۔١٤ بَابُ لَا يَجْزِي أَنْ يُطْعِمَ أَقَلَّ مِنْ سِتِّينَ مِسْكِينًا كُلَّ مِسْكِينٍ مُدًّا مِنْ طَعَامِ بَلَدِهِ
[Machine] It is narrated that Salamah ibn Sakhr al-Bayadi made a condition with his wife that she would be like his mother's back to him, meaning he would not approach her intimately, until Ramadan passed. When half of Ramadan had passed, his wife gained weight and became beautiful to him, so he approached her intimately one night. Afterwards, he went to the Prophet ﷺ and mentioned what had happened to him. The Prophet advised him to set a slave free, but Salamah replied that he did not have one. The Prophet then advised him to fast for two consecutive months, but Salamah said he was unable to. The Prophet then advised him to feed sixty poor people, but Salamah said he could not find that many. Finally, the Prophet brought a container filled with dates, estimated to be fifteen or sixteen saa' (a type of measurement), and told him to give it as charity to sixty poor people.
أَنَّ سَلَمَةَ بْنِ صَخْرٍ الْبَيَاضِيِّ جَعَلَ امْرَأَتَهُ عَلَيْهِ كَظَهْرِ أُمِّهِ إِنْ غَشِيَهَا حَتَّى يَمْضِيَ رَمَضَانُ فَلَمَّا مَضَى النِّصْفُ مِنْ رَمَضَانَ سَمُنَتِ الْمَرْأَةُ وَتَرَبَّعَتْ فَأَعْجَبَتْهُ فَغَشِيَهَا لَيْلًا ثُمَّ أَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ أَعْتِقْ رَقَبَةً فَقَالَ لَا أَجِدُ فَقَالَ صُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ فَقَالَ لَا أَسْتَطِيعُ قَالَ أَطْعِمْ سِتِّينَ مِسْكِينًا قَالَ لَا أَجِدُ قَالَ فَأُتِيَ النَّبِيُّ ﷺ بِعَرَقٍ فِيهِ خَمْسَةَ عَشَرَ صَاعًا أَوْ سِتَّةَ عَشَرَ صَاعًا فَقَالَ تَصَدَّقْ بِهَذَا عَلَى سِتِّينَ مِسْكِينًا وَكَذَلِكَ
[Machine] Narrated Abu Huraira: Salama bin Al-Akwa' used to tie his wife or sister with his Dhihir (upper garment) during the period of Ramaḍān. Then he brought her to the Prophet ﷺ while she was shy. He said, "Do you tie her?" He replied, "Yes." He said, "Amaḥlu" (untie her). So he untied her and ordered her to spend the night with him. He then brought a ḍirham and a ṭarq (a measure of dates) and told him, "Give this to the poor people". So the narrator did not refuse, rather, he took them and kept silent about that.
أَنَّ رَسُولَ اللهِ ﷺ أَعْطَاهُ مِكْتَلًا فِيهِ خَمْسَةَ عَشَرَ صَاعًا فَقَالَ أَطْعِمْهُ سِتِّينَ مِسْكِينًا وَذَلِكَ لِكُلِّ مِسْكِينٍ مُدًّا أَخْبَرَنَا أَبُو مُحَمَّدٍ الْحَسَنُ بْنُ عَلِيِّ بْنِ الْمُؤَمَّلِ أنا أَبُو عُثْمَانَ عَمْرُو بْنُ عَبْدِ اللهِ الْبَصْرِيُّ نا مُوسَى بْنُ هَارُونَ نا إِسْحَاقُ بْنُ رَاهَوَيْهِ أنا الْوَلِيدُ بْنُ مُسْلِمٍ نا شَيْبَانُ النَّحْوِيُّ فَذَكَرَهُ 15279 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا أَبُو بَكْرِ بْنُ دَاسَةَ نا أَبُو دَاوُدَ نا مُوسَى بْنُ إِسْمَاعِيلَ نا أَبَانُ نا يَحْيَى عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ قَالَ يَعْنِي الْعَرَقَ زِنْبِيلٌ يَأْخُذُ خَمْسَةَ عَشَرَ صَاعًا 15280 وَرُوِيَ عَنِ الْأَوْزَاعِيِّ عَنْ يَحْيَى عَنْ أَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ أَنَّ سَلَمَةَ بْنَ صَخْرٍ الْبَيَاضِيَّ جَعَلَ امْرَأَتَهُ عَلَيْهِ كَظَهْرِ أُمِّهِ حَتَّى يَمْضِيَ رَمَضَانُ فَذَكَرَ الْحَدِيثَ إِلَى أَنْ قَالَ فَأُتِيَ النَّبِيُّ ﷺ بِمِكْتَلٍ فِيهِ خَمْسَةَ عَشَرَ صَاعًا مِنْ تَمْرٍ فَدَفَعَهُ إِلَيْهِ وَقَالَ اذْهَبْ وَأَطْعِمْ هَذَا سِتِّينَ مِسْكِينًا أَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ أنا أَبُو مُحَمَّدِ بْنُ حَيَّانَ الْأَصْبَهَانِيُّ نا مُحَمَّدُ بْنُ عَبْدِ الرَّحِيمِ بْنِ شَبِيبٍ نا يَحْيَى بْنُ عُثْمَانَ الْحَرْبِيُّ نا الْهِقْلُ بْنُ زِيَادٍ عَنِ الْأَوْزَاعِيِّ فَذَكَرَهُ وَهُوَ خَطَأٌ الْمَشْهُورُ عَنْ يَحْيَى مُرْسَلٌ دُونَ ذِكْرِ أَبِي هُرَيْرَةَ فِيهِ
[Machine] I was a man who had been given something from the other women that no one else had been given. When Ramadan came, I appeared from my wife fearful that I would be affected by her during the night. I continued in this state and couldn't release until dawn caught up with me. While she was with me one night, something was exposed to me from her and I jumped on her. When I woke up in the morning, I went to my people and told them my news. I said, "Come with me to the Messenger of Allah ﷺ." They said, "No, by Allah, we will not go with you for fear that something from the Qur'an will be revealed in us and the Messenger of Allah ﷺ would say something about us that would remain our disgrace." So you go and do what seems right for you." So I went to the Messenger of Allah ﷺ and told him my news. He said, "You are that person?" I said, "Yes, I am that person, so decide in my matter according to the judgment of Allah, for I am patient and hoping. So I have freed a slave." I struck my neck with my hand and said, "By the One who sent you with the truth, I do not possess anything else besides it." He said, "Fast for two consecutive months." I said, "O Messenger of Allah, have I only been afflicted with what I have been afflicted with in fasting?" He said, "Then feed sixty poor people." I said, "O Messenger of Allah, by the One who sent you with the truth, we spent this night of ours in a terrible condition, and we couldn't find anything for dinner." He said, "Go to the person who gave charity from the Banu Zurayq and let him give you something from his dates, so you may feed sixty poor people with it and seek his assistance for your family." So I went to my people and said, "I found difficulty with you. It was narrated to me from this source from Sulayman bin Yasir. And Abu Abdullah Rahman As-Salami allowed me to narrate it with a chain that is similar to this one. He told us that Abu Hassan bin Subayh informed them that I am Abdullah bin Muhammad bin Shirawayh, I am Ishaq al-Hanzali, I am Abdullah bin Idris, I am Muhammad bin Ishaq. He mentioned his chain of narration like this and said at the end, "Go to the person who gave charity from the Banu Zurayq and let him give you something from his dates so you may feed sixty poor people with it, and eat the rest, meaning the leftover dates." This narration indicates that he gives sixty poor people from the dates, and then he eats the rest of the dates. It also indicates what was narrated to us by Abu Ali Ar-Rudbahri, that Abu Bakr bin Dasa told them, Abu Dawood told them, Ibn As-Sarh told them, Ibn Wahb told them, Ibn Lahiah told them, and Amr bin Al-Harith told them, from Bukayr bin Al-Ashajj, from Sulayman bin Yasir, with this narration, who said, "The Prophet ﷺ was given dates, about fifteen Sa's. So he said, 'Give charity with this.' So he said, 'O Messenger of Allah, is there anyone poorer than me and my family?' The Messenger of Allah ﷺ said, 'You and your family eat from it.' This narration agrees with the narration of Abu Salamah bin Abdur Rahman and Ibn Thawban in the story of Salamah bin Sakhr, and it is stronger. As for the Hadith of Aus bin As-Samit, the narrations differ regarding it.
كُنْتُ امْرَأً قَدْ أُوتِيتُ مِنْ جِمَاعِ النِّسَاءِ مَا لَمْ يُؤْتَ غَيْرِي فَلَمَّا دَخَلَ رَمَضَانُ ظَاهَرْتُ مِنِ امْرَأَتِي مَخَافَةَ أَنْ أُصِيبَ مِنْهَا شَيْئًا فِي بَعْضِ اللَّيْلِ وَأَتَتَابَعُ فِي ذَلِكَ وَلَا أَسْتَطِيعُ أَنْ أَنْزِلَ حَتَّى يُدْرِكَنِيَ الصُّبْحُ فَبَيْنَمَا هِيَ ذَاتَ لَيْلَةٍ بِحِيَالٍ مِنِّي إِذَا انْكَشَفَ لِي مِنْهَا شَيْءٌ فَوَثَبْتُ عَلَيْهَا فَلَمَّا أَصْبَحْتُ غَدَوْتُ عَلَى قَوْمِي فَأَخْبَرْتُهُمْ خَبَرِي فَقُلْتُ انْطَلِقُوا مَعِي إِلَى رَسُولِ اللهِ ﷺ فَقَالُوا لَا وَاللهِ لَا نَذْهَبُ مَعَكَ نَخَافُ أَنْ يَنْزِلَ فِينَا شَيْءٌ مِنَ الْقُرْآنِ وَيَقُولُ فِينَا رَسُولُ اللهِ ﷺ مَقَالَةً يَبْقَى عَلَيْنَا عَارُهَا فَاذْهَبْ أَنْتَ فَاصْنَعْ مَا بَدَا لَكَ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَأَخْبَرْتُهُ خَبَرِي فَقَالَ أَنْتَ ذَاكَ؟ فَقُلْتُ أَنَا ذَاكَ فَاقْضِ فِيَّ حُكْمَ اللهِ فَإِنِّي صَابِرٌ مُحْتَسِبٌ قَالَ أَعْتِقْ رَقَبَةً فَضَرَبْتُ صَفْحَ عُنُقِ رَقَبَتِي بِيَدِي فَقُلْتُ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا أَصْبَحْتُ أَمْلِكُ غَيْرَهَا قَالَ صُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ فَقُلْتُ يَا رَسُولَ اللهِ وَهَلْ أَصَابَنِي مَا أَصَابَنِي إِلَّا فِي الصِّيَامِ؟ قَالَ فَأَطْعِمْ سِتِّينَ مِسْكِينًا قُلْتُ يَا رَسُولَ اللهِ وَالَّذِي بَعَثَكَ بِالْحَقِّ لَقَدْ بِتْنَا لَيْلَتَنَا هَذِهِ وَحْشًا مَا نَجِدُ عَشَاءً قَالَ انْطَلِقْ إِلَى صَاحِبِ الصَّدَقَةِ صَدَقَةِ بَنِي زُرَيْقٍ فَلْيَدْفَعْهَا إِلَيْكَ فَأَطْعِمْ مِنْهَا وَسْقًا سِتِّينَ مِسْكِينًا وَتَسْتَعِينُ بِسَائِرِهَا عَلَى عِيَالِكَ فَأَتَيْتُ قَوْمِي فَقُلْتُ وَجَدْتُ عِنْدَكُمُ الضِّيقَ كَذَا رُوِيَ مِنْ هَذَا الْوَجْهِ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ 15282 وَقَدْ أَخْبَرَنِيهِ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ إِجَازَةً أَنَّ أَبَا الْحَسَنِ بْنَ صُبَيْحٍ أَخْبَرَهُمْ أنا عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ شِيرَوَيْهِ أنا إِسْحَاقُ الْحَنْظَلِيُّ أنا عَبْدُ اللهِ بْنُ إِدْرِيسَ نا مُحَمَّدُ بْنُ إِسْحَاقَ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ وَقَالَ فِي آخِرِهِ فَاذْهَبْ إِلَى صَاحِبِ صَدَقَةِ بَنِي زُرَيْقٍ فَلْيَدْفَعْ إِلَيْكَ وَسْقًا مِنْ تَمْرٍ فَأَطْعِمْ سِتِّينَ مِسْكِينًا وَكُلْ بَقِيَّتَهُ أَنْتَ وَأَهْلُكَ وَهَذَا يَدُلُّ عَلَى أَنَّهُ يُعْطِي مِنَ الْوَسْقِ سِتِّينَ مِسْكِينًا ثُمَّ يَأْكُلُ بَقِيَّتَهُ يَعْنِي بَقِيَّةَ الْوَسْقِ 15283 وَيَدُلُّ عَلَيْهِ أَيْضًا مَا أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا أَبُو بَكْرِ بْنُ دَاسَةَ نا أَبُو دَاوُدَ نا ابْنُ السَّرْحِ نا ابْنُ وَهْبٍ أَخْبَرَنِي ابْنُ لَهِيعَةَ وَعَمْرُو بْنُ الْحَارِثِ عَنْ بُكَيْرِ بْنِ الْأَشَجِّ عَنْ سُلَيْمَانَ بْنِ يَسَارٍ بِهَذَا الْخَبَرِ قَالَ فَأُتِيَ النَّبِيُّ ﷺ بِتَمْرٍ فَأَعْطَاهُ إِيَّاهُ وَهُوَ قَرِيبٌ مِنْ خَمْسَةَ عَشَرَ صَاعًا فَقَالَ تَصَدَّقْ بِهَذَا فَقَالَ يَا رَسُولَ اللهِ عَلَى أَفْقَرَ مِنِّي وَمِنْ أَهْلِي؟ فَقَالَ رَسُولُ اللهِ ﷺ كُلْ أَنْتَ وَأَهْلُكَ فَهَذِهِ الرِّوَايَةُ عَنْ سُلَيْمَانَ مُوَافِقَةٌ لِرِوَايَةِ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ وَابْنِ ثَوْبَانَ فِي قِصَّةِ سَلَمَةَ بْنِ صَخْرٍ فَهِيَ أَوْلَى وَأَمَّا حَدِيثُ أَوْسِ بْنِ الصَّامِتِ فَقَدِ اخْتَلَفَتِ الرِّوَايَةُ فِيهِ
[Machine] From me is my husband Aus bin As-Saamit, so I went to the Messenger of Allah ﷺ to complain to him. The Messenger of Allah ﷺ argued with me about it and said, "Fear Allah, for he is your husband and your cousin." I did not leave until the Quran was revealed, "Indeed, Allah has heard the statement of her that disputes with you concerning her husband" [Al-Mujadila: 1]. He said, "He should either free a slave." She said, "He does not have anything to give as charity." He said, "Then let him fast for two consecutive months." She said, "O Messenger of Allah, he is an old man and not capable of fasting." He said, "Then let him feed sixty poor persons." I said, "He does not have anything to give as charity." He said, "I will help him with a basket of dates." She said, "O Messenger of Allah, I will also help him with another basket." He said, "You have done well. Go and feed sixty poor persons with it, and return to your cousin." He said, "The basket contained sixty Sa'a." Abu 'Ali Ar-Rudbary said, "I am Abu Bakr bin Daasah. Abu Dawud narrated to us that Hasan bin Ali narrated to him from Abdul Aziz bin Yahya Al-Harani, from Muhammad bin Salamah, from Ibn Ishaq with this chain of narrators, except that he said, 'The basket contained thirty Sa'a." Abu Dawud said, "This is more correct than the Hadith of Yahya bin Adam." Abu Ali narrated to us, from Abu Bakr, from Abu Dawud, who said, "I read to Ibn Wazeer in Egypt. Bishr bin Bakr narrated to us, from Al-Awza'i, from Ata, from Aws bin Ubada, who mentioned the story of the emancipation of a slave and said, 'Khawilah said, "What would be the use of it by us, by Allah, nobody would serve him except me." He said, "But he does not have anything." He said, "Then let him fast for two consecutive months." She said, "By Allah, if he would not drink three times a day, his vision would be impaired." He said, "Then let him feed sixty poor persons." She said, "From where should we bring food like that?" The Prophet ﷺ called for half a Sa'a of dates, which is thirty Sa'a. He said, "Let him feed sixty poor persons with it and let him return it to you like this."
مِنِّي زَوْجِي أَوْسُ بْنُ الصَّامِتِ فَجِئْتُ رَسُولَ اللهِ ﷺ أَشْكُو إِلَيْهِ وَرَسُولُ اللهِ ﷺ يُجَادِلُنِي فِيهِ وَيَقُولُ اتَّقِي اللهَ فَإِنَّهُ زَوْجُكِ وَابْنُ عَمِّكِ فَمَا بَرِحْتُ حَتَّى نَزَلَ الْقُرْآنُ {قَدْ سَمِعَ اللهُ قَوْلَ الَّتِي تُجَادِلُكَ فِي زَوْجِهَا} [المجادلة 1] قَالَ يُعْتِقُ رَقَبَةً قَالَتْ لَا يَجِدُ قَالَ فَيَصُومُ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَتْ يَا رَسُولَ اللهِ إِنَّهُ شَيْخٌ كَبِيرٌ مَا بِهِ مِنْ صِيَامٍ قَالَ فَلْيُطْعِمْ سِتِّينَ مِسْكِينًا قُلْتُ مَا عِنْدَهُ مِنْ شَيْءٍ يَتَصَدَّقُ بِهِ قَالَ فَإِنِّي سَأُعِينُهُ بِعَرَقٍ مِنْ تَمْرٍ قَالْتْ يَا رَسُولَ اللهِ وَإِنِّي أُعِينُهُ بِعَرَقٍ آخَرَ قَالَ قَدْ أَحْسَنْتِ اذْهَبِي فَأَطْعِمِي بِهَا عَنْهُ سِتِّينَ مِسْكِينًا وَارْجِعِي إِلَى ابْنِ عَمِّكِ قَالَ وَالْعَرَقُ سِتُّونَ صَاعًا 15285 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا أَبُو بَكْرِ بْنُ دَاسَةَ نا أَبُو دَاوُدَ نا الْحَسَنُ بْنُ عَلِيٍّ نا عَبْدُ الْعَزِيزِ بْنُ يَحْيَى الْحَرَّانِيُّ نا مُحَمَّدُ بْنُ سَلَمَةَ عَنِ ابْنِ إِسْحَاقَ بِهَذَا الْإِسْنَادِ نَحْوَهُ إِلَّا أَنَّهُ قَالَ وَالْعَرَقُ مِكْتَلٌ يَسَعُ ثَلَاثِينَ صَاعًا قَالَ أَبُو دَاوُدَ وَهَذَا أَصَحُّ مِنْ حَدِيثِ يَحْيَى بْنِ آدَمَ 15286 وَأَخْبَرَنَا أَبُو عَلِيٍّ نا أَبُو بَكْرٍ نا أَبُو دَاوُدَ قَالَ قَرَأْتُ عَلَى ابْنِ وَزِيرٍ الْمِصْرِيِّ حَدَّثَكُمْ بِشْرُ بْنُ بَكْرٍ نا الْأَوْزَاعِيُّ نا عَطَاءٌ عَنْ أَوْسٍ أَخِي عُبَادَةَ بْنِ الصَّامِتِ أَنَّ النَّبِيَّ ﷺ أَعْطَاهُ خَمْسَةَ عَشَرَ صَاعًا مِنْ شَعِيرٍ إِطْعَامَ سِتِّينَ مِسْكِينًا قَالَ أَبُو دَاوُدَ عَطَاءٌ لَمْ يُدْرِكْ أَوْسًا وَهُوَ مِنْ أَهْلِ بَدْرٍ قَدِيمُ الْمَوْتِ وَالْحَدِيثُ مُرْسَلٌ 15287 أَخْبَرَنَا أَبُو عَبْدِ اللهِ إِسْحَاقُ بْنُ مُحَمَّدِ بْنِ يُوسُفَ السُّوسِيُّ نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا الْعَبَّاسُ بْنُ مُحَمَّدٍ نا عُبَيْدُ اللهِ بْنُ مُوسَى نا أَبُو حَمْزَةَ الثُّمَالِيُّ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ فَذَكَرَ قِصَّةَ ظِهَارِ أَوْسٍ إِلَى أَنْ قَالَ فَتَحْرِيرُ رَقَبَةٍ قَالَتْ خُوَيْلَةُ قُلْتُ وَأِيُّ الرَّقَبَةِ لَنَا وَاللهِ مَا يَخْدُمُهُ غَيْرِي قَالَ فَمَنْ لَمْ يَجِدْ فَصِيَامُ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَتْ وَاللهِ لَوْلَا أَنَّهُ يَذْهَبُ يَشْرَبُ فِي الْيَوْمِ ثَلَاثَ مَرَّاتٍ لَذَهَبَ بَصَرُهُ قَالَ فَمَنْ لَمْ يَسْتَطِعْ فَإِطْعَامُ سِتِّينَ مِسْكِينًا قَالَتْ فَمِنْ أَيْنَ هِيَ الْأَكْلَةُ إِلَى مِثْلِهَا فَدَعَا النَّبِيُّ ﷺ بِشَطْرِ وَسْقٍ ثَلَاثِينَ صَاعًا وَالْوَسْقُ سِتُّونَ صَاعًا قَالَ لِيُطْعِمْ سِتِّينَ مِسْكِينًا وَلْيُرْجِعْكِ كَذَا
[Machine] You are on my mother's back, if I stepped on you, then the Prophet ﷺ was told about it, and he did not say anything to him. Then she came to him again and the Messenger of Allah ﷺ said to him, "Free a slave." He said, "I do not have that, O Messenger of Allah." He said, "Fast for two consecutive months." He said, "I cannot do that." He said, "Then feed sixty poor people thirty units of food." He said, "I do not have that, O Messenger of Allah, unless you assist me." The Messenger of Allah ﷺ helped him with fifteen units of food, and the people helped him until he reached thirty units of food. The Messenger of Allah ﷺ said to him, "Feed sixty poor people." He said, "O Messenger of Allah, there is no one poorer than me and my family." The Messenger of Allah ﷺ said to him, "Take it for yourself and your family," so he took it.
أَنْتِ عَلَيَّ كَظَهْرِ أُمِّي إِنْ أَنَا وَطِئْتُكِ فَأَتَتِ النَّبِيَّ ﷺ فَشَكَتْ ذَلِكَ إِلَيْهِ وَلَمْ يَبْلُغِ النَّبِيَّ ﷺ فِي ذَلِكَ شَيْءٌ ثُمَّ أَتَتْهُ مَرَّةً أُخْرَى فَقَالَ لَهُ رَسُولُ اللهِ ﷺ أَعْتِقْ رَقَبَةً فَقَالَ لَيْسَ عِنْدِي ذَلِكَ يَا رَسُولَ اللهِ قَالَ صُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَ لَا أَسْتَطِيعُ ذَلِكَ قَالَ فَأَطْعِمْ سِتِّينَ مِسْكِينًا ثَلَاثِينَ صَاعًا قَالَ لَسْتُ أَمْلِكُ ذَلِكَ يَا رَسُولَ اللهِ إِلَّا أَنْ تُعِينَنِي قَالَ فَأَعَانَهُ رَسُولُ اللهِ ﷺ بِخَمْسَةَ عَشَرَ صَاعًا وَأَعَانَهُ النَّاسُ حَتَّى بَلَغَ ثَلَاثِينَ صَاعًا وَقَالَ لَهُ رَسُولُ اللهِ ﷺ أَطْعِمْ سِتِّينَ مِسْكِينًا قَالَ يَا رَسُولَ اللهِ مَا أَحَدٌ أَفْقَرُ إليه مِنِّي وَأَهْلِ بَيْتِي فَقَالَ لَهُ رَسُولُ اللهِ ﷺ خُذْهُ أَنْتَ وَأَهْلُكَ فَأَخَذَهُ كَذَا
[Machine] A man said, "O Messenger of Allah, I have been destroyed." He said, "What happened to you?" He replied, "I fell upon my family on a day in the month of Ramadan." He said, "Free a slave." He said, "I cannot find one." He said, "Then fast for two consecutive months." He said, "I am unable to do so." He said, "Then feed sixty poor people." He said, "I cannot find them." He said, "Then bring a basket filled with dates." The Prophet ﷺ said, "Take it and give it in charity." He said, "To someone poorer than my family? By Allah, there is no one in Medina poorer than us." The Prophet ﷺ laughed until his molar teeth showed and said, "Take it and seek forgiveness from Allah and feed your family with it."
قَالَ رَجُلٌ يَا رَسُولَ اللهِ هَلَكْتُ قَالَ وَيْحَكَ وَمَا ذَاكَ؟ قَالَ وَقَعْتُ عَلَى أَهْلِي فِي يَوْمٍ مِنْ شَهْرِ رَمَضَانَ قَالَ أَعْتِقْ رَقَبَةً قَالَ مَا أَجِدُهَا قَالَ فَصُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَ مَا أَسْتَطِيعُ قَالَ فَأَطْعِمْ سِتِّينَ مِسْكِينًا قَالَ مَا أَجِدُ قَالَ فَأُتِيَ النَّبِيُّ ﷺ بِعَرَقٍ فِيهِ تَمْرٌ خَمْسَةَ عَشَرَ صَاعًا قَالَ خُذْهُ فَتَصَدَّقْ بِهِ قَالَ عَلَى أَفْقَرَ مِنْ أَهْلِي فَوَاللهِ مَا بَيْنَ لَابَتَيِ الْمَدِينَةِ أَحْوَجُ مِنْ أَهْلِي قَالَ فَضَحِكَ النَّبِيُّ ﷺ حَتَّى بَدَتْ نَوَاجِذُهُ قَالَ خُذْهُ وَاسْتَغْفِرِ اللهَ وَأَطْعِمْهُ أَهْلَكَ وَكَذَلِكَ
[Machine] Sa'id ibn al-Musayyib narrated that a man came to the Prophet ﷺ and said, "I have committed adultery with my wife during Ramadan." The Prophet ﷺ said, "Free a slave." The man replied, "I do not have the means to do so." The Prophet ﷺ said, "Then fast for two consecutive months." The man said, "I cannot do that either." The Prophet ﷺ said, "Then feed sixty poor people." The man replied, "I cannot find them." Then, someone brought a container filled with dates, amounting to fifteen sa' (a measurement unit) of dates, which was equivalent to sixty-four quarters of dates. The Prophet ﷺ gave it to the man and said, "Feed sixty poor people with this." The man said, "O Messenger of Allah, there are people between us who are more in need of it." The Prophet ﷺ said, "Go and feed your family with it. This is a confirmation of the connected narration, and this narration is more reliable than the narration of 'Ata' al-Khurasani from Ibn al-Musayyib with doubt in fifteen or twenty. Likewise, it has been narrated from Ibrahim ibn 'Amir from Ibn al-Musayyib with certainty in fifteen. And if Allah wills, it will be narrated in the book of oaths and traditions from the companions about the permissibility of giving a handful of food as charity to each poor person. And Allah is the Guide."
عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَتَى النَّبِيَّ ﷺ رَجُلٌ فَقَالَ إِنِّي وَقَعْتُ عَلَى أَهْلِي فِي رَمَضَانَ قَالَ حَرِّرْ رَقَبَةً قَالَ لَا أَجِدُ قَالَ صُمْ شَهْرَيْنِ مُتَتَابِعَيْنِ قَالَ لَا أَسْتَطِيعُ قَالَ فَتَصَدَّقْ عَلَى سِتِّينَ مِسْكِينًا قَالَ لَا أَجِدُ قَالَ فَأُتِيَ النَّبِيُّ ﷺ بِمِكْتَلٍ يَكُونُ خَمْسَةَ عَشَرَ صَاعًا مِنْ تَمْرٍ يَكُونُ سِتِّينَ رَبْعًا فَأَعْطَاهُ إِيَّاهُ فَقَالَ لَهُ أَطْعِمْ هَذَا سِتِّينَ مِسْكِينًا قَالَ يَا رَسُولَ اللهِ مَا بَيْنَ لَابَتَيْهَا أَهْلُ بَيْتٍ أَحْوَجُ مِنَّا فَقَالَ لَهُ اذْهَبْ فَأَطْعِمْهُ أَهْلَكَ فِي هَذَا الْمُرْسَلِ تَأْكِيدٌ لِلرِّوَايَةِ الْمَوْصُولَةِ وَهَذَا أَوْلَى مِنْ رِوَايَةِ عَطَاءٍ الْخُرَاسَانِيِّ عَنِ ابْنِ الْمُسَيِّبِ بِالشَّكِّ فِي خَمْسَةَ عَشَرَ أَوْ عِشْرِينَ وَكَذَلِكَ رُوِيَ عَنْ إِبْرَاهِيمَ بْنِ عَامِرٍ عَنِ ابْنِ الْمُسَيِّبِ خَمْسَةَ عَشَرَ بِلَا شَكٍّ وَسَيُرْوَى إِنْ شَاءَ اللهُ تَعَالَى فِي كِتَابِ الْأَيْمَانِ الْآثَارُ عَنِ الصَّحَابَةِ فِي جَوَازِ التَّصْدِقِ بِمُدٍّ عَلَى كُلِّ مِسْكِينٍ وَاللهُ الْمُوَفِّقُ
