‘Abd Allah (bin Mas’ud) said “We were in the mosque on the night of a Friday, suddenly a man from the Ansar entered the mosque”. And said “If a man finds a man along with wife and declares (about her adultery) you will flog him. Or if he kills you, you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah, I shall ask the Apostle of Allaah ﷺ about it”. On the next day he came to the Apostle of Allaah ﷺ and said “If a man finds a man along with wife and declares (about her adultery) you will flog him. Or if he kills you, you will kill him or if keeps silence he will keep silence in anger.” He said “O Allaah, disclose”. He kept on praying until the verses regarding invoking curses (li’an) came down “As for those who accuse their wives but have no witnesses except themselves.” So, the man was first involved in this trial among the people. He and his wife came to the Apostle of Allaah ﷺ. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. She then wanted to invoke curses of Allaah on him. The Prophet ﷺ said “Do not do that. Bust she refused and did so (i.e., invoked curses). When they returned he said “Perhaps she will give birth to a black child with curly hair. (Using translation from Abū Dāʾūd 2253)

Ibn Shihab informed me of Lian and the tradition related to it, referring to the narration of Sahl bin Saʿd, the brother of Bani Saʿidi He said, "An Ansari man came to Messenger of Allah ﷺ and said, 'O Allah's Apostle! If a man saw another man with his wife, should he kill him, or what should he do?' So Allah revealed concerning his affair what is mentioned in the Holy Qur'an about the affair of those involved in a case of Lian. The Prophet ﷺ said, 'Allah has given His verdict regarding you and your wife.' So they carried out Lian in the mosque while I was present there. When they had finished, the man said, "O Messenger of Allah ﷺ! If I should now keep her with me as a wife then I have told a lie about her. Then he divorced her thrice before Messenger of Allah ﷺ ordered him, when they had finished the Lian process. So he divorced her in front of the Prophet ﷺ ." Ibn Shihab added, "After their case, it became a tradition that a couple involved in a case of Lian should be separated by divorce. That lady was pregnant then, and later on her son was called by his mother's name. The tradition concerning their inheritance was that she would be his heir and he would inherit of her property the share Allah had prescribed for him." Ibn Shihab said that Sahl bin Saʿd As'Saidi said that the Prophet ﷺ said (in the above narration), "If that lady delivers a small red child like a lizard, then the lady has spoken the truth and the man was a liar, but if she delivers a child with black eyes and huge lips, then her husband has spoken the truth." Then she delivered it in the shape one would dislike (as it proved her guilty).

We were on the night of Friday staying in the mosque when a person from the Ansar came there and said: If a person finds hiswoman along with a man, and he speaks about it, you would lash him, and if he kills, you will kill him, and if he keeps quiet he shall have to consume anger. By Allah, I will definitely ask about him from Allah's Mescenger ﷺ. On the following day he came to Messenger of Allah ﷺ and asked him thus: If a man were to find with his wife a man and if he were to talk about it, you would lash him; and if he killed, you would kill him, and if he were to keep quiet. he would consume anger, whereupon he (the Holy Prophet) said: Allah, solve (this problem), and he began to supplicate (before Him), and then the verses pertaining to li'an were revealed:" Those who accuse their wives and have no witnesses except themselves" (xxiv. 6). The person was then put to test according to these verses in the presence of the people. There came he and his wife in the presence of Messenger of Allah ﷺ, and they invoked curses (in order to testify their claim). The man swore four times in the name of Allah that he was one of the truthful and then invoked curse for the fifth time saying: Let there be curse of Allah upon him if he were among the liars. Then she began to invoke curse. Messenger of Allah ﷺ said to her: just wait (and curse after considering over it), but she refused and invoked curse and when she turned away, he (Allah's Apostle) said: It seems that this woman shall give birth to a curly-haired black child, And so she did gave birth to a curly-haired black child.

[AI] Abdullah said: "We were in the mosque on Friday night when a man from the Ansar (helpers) said: 'By Allah, if a man finds another man with his wife and he speaks, they will both be flogged, and if he kills him, they will both be killed, and if he remains silent, they will remain silent due to anger. By Allah, if I live until morning, I will go to the Messenger of Allah ﷺ '. When morning came, he went to the Messenger of Allah ﷺ and said: 'O Messenger of Allah, if a man finds another man with his wife and he speaks, they will both be flogged, and if he kills him, they will both be killed, and if he remains silent, they will remain silent due to anger?' He kept repeating: 'O Allah, open (the matter), O Allah, open (the matter)'. then the verse of cursing was revealed: 'And those who accuse their wives [of adultery] and have no witnesses except themselves' (Quran 24:6)."

I did not know what to say, so I got up and went to the house of Ibn 'Umar and said: "O Abu 'Abdur-Rahman, should the two who engage in Li'an be separated?" He said: "Yes, Subhan Allah! The first one who asked about that was so-and-so the son of so-and-so who said: 'O Messenger of Allah, what do you think if a man among us sees his wife committing immoral actions, and if he speaks of it, he will be speaking of a grave matter, but if he keeps quiet, he will be keeping quiet about a grave matter?' He did not answer him, then after that, he came to him and said: 'I was tried with the matter that I asked you about, so Allah, the Mighty and Sublime, revealed these Verses in Surat An-Nur.: 'And for those who accuse their wives' until he reached: 'And the fifth (testimony) should be that the Wrath of Allah be upon her if he (her husband) speaks the truth.' So he started with the man, exhorting him, reminding him, and telling him that the punishment in this world was less severe than the punishment in the Hereafter. He said: 'By the One Who sent you with the truth, I am not lying.' Then he turned to the woman and exhorted her and reminded her. She said: 'By the One Who sent you with the truth, he is lying.' So he started with the man, and he bore witness four times by Allah that he was telling the truth, and the fifth time (he invoked) the curse of Allah upon himself if he was lying. Then he turned to the woman and she bore witness four times by Allah that he was lying, and the fifth time (she invoked) the wrath of Allah upon herself if he was telling the truth. سَأَلْتُ ابْنَ عُمَرَ فَقُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ الْمُتَلَاعِنَيْنِ يُفَرَّقُ بَيْنَهُمَا؟ قَالَ سُبْحَانَ اللهِ نَعَمْ إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلَانٌ قَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى امْرَأَتَهُ عَلَى فَاحِشَةٍ كَيْفَ يَصْنَعُ؟ إِنْ سَكَتَ سَكَتَ عَلَى أَمْرٍ عَظِيمٍ وَإِنْ تَكَلَّمَ فَمِثْلُ ذَلِكَ فَسَكَتَ رَسُولُ اللهِ ﷺ وَلَمْ يُجِبْهُ فَقَامَ لِحَاجَتِهِ فَلَمَّا كَانَ بَعْدَ ذَلِكَ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ إِنَّ الَّذِي سَأَلْتُكَ عَنْهُ قَدِ ابْتُلِيتُ بِهِ قَالَ فَأَنْزَلَ اللهُ تَعَالَى هَذِهِ الْآيَاتِ فِي سُورَةِ النُّورِ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ} [النور 6] حَتَّى خَتَمَ الْآيَاتِ فَدَعَا الرَّجُلَ فَتَلَاهُنَّ عَلَيْهِ وَذَكَّرَهُ بِاللهِ تَعَالَى وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا كَذَبْتُ عَلَيْهَا ثُمَّ دَعَا الْمَرْأَةَ فَوَعَظَهَا وَذَكَّرَهَا وَأَخْبَرَهَا بِأَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَتْ وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنَّهُ لَكَاذِبٌ فَدَعَاالرَّجُلَ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللهِ إِنَّهُ لَمِنَ الصَّادِقِينَ وَالْخَامِسَةَ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ثُمَّ دَعَا بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللهِ إِنَّهُ لَمِنَ الْكَاذِبِينَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ ثُمَّ فَرَّقَ بَيْنَهُمَا

[AI] We were with the Prophet ﷺ in the mosque of Al-Madinah on a certain night, when a man said, "What do you think if a man finds another man with his wife? If he kills him, will he be killed, or if he remains silent, will he bear the burden of anger?" By Allah, I will ask the Messenger of Allah ﷺ about this matter." The next morning, he went to the Messenger of Allah ﷺ and asked him the same question. The Prophet ﷺ replied, "If a man finds another man with his wife, and he kills him, then he will be killed. And if he speaks about it, he will be punished. And if he remains silent, he will bear the burden of anger." Then the verse was revealed, "And those who accuse their wives [of adultery] and have no witnesses except themselves - then the witness of one of them [shall be] four testimonies [swearing] by Allah that indeed, he is of the truthful. And the fifth [oath will be] that the curse of Allah be upon him if he should be among the liars" [Quran 24:6-7]. The man came to the Prophet ﷺ with his wife, and they both invoked curses on each other. The man confessed four times, "By Allah, he is one of the truthful." And on the fifth time, he said, "May the curse of Allah be upon me if I am lying." Then, when he turned away, the Prophet ﷺ said, "Wait, there is a possibility that she might bring forth a child who has curly hair." Eventually, she gave birth to a child with curly hair. Isaq said, Yahya Ibn Ma'een told me, "I asked Jarir, and he said, "No one else from Al-A'mash reported this hadith except you. But I heard it from him."

[AI] A man from the Ansar came to the Prophet ﷺ and said, "O Messenger of Allah, what if a man finds his wife with another man and kills him, would you kill him or how would he act?" So Allah revealed in the Quran the ruling concerning this matter. The Messenger of Allah ﷺ said to him, "Allah has decreed regarding you and your wife." The man said, "We cursed each other in the mosque and I witnessed it. When we finished, I lied about it, O Messenger of Allah. If I had held her, I would have divorced her before the Prophet commanded it.” When they finished cursing each other, she left him in the presence of the Prophet ﷺ. The Prophet ﷺ said, "That is the separation between every cursed couple." The Prophet ﷺ also said, "If she comes with Uhaymir, a short-statured person who appears as a free woman, then I do not see her except that she is telling the truth and he is lying about her. And if she comes with someone who has black eyes with two thick eyelashes, then I do not see him except that he is telling the truth about her." So she came with him against her wishes in accordance with that which is detested.

A man came to Messenger of Allah ﷺ and said, "O Messenger of Allah ﷺ! Suppose a man saw another man with his wife, should he kill him whereupon you might kill him (i.e. the killer) (in Qisas) or what should he do?" So Allah revealed concerning their case what is mentioned of the order of Mula'ana. Allah's Apostle said to the man, "The matter between you and your wife has been decided." So they did Mula'ana in the presence of Messenger of Allah ﷺ and I was present there, and then the man divorced his wife. So it became a tradition to dissolve the marriage of those spouses who were involved in a case of Mula'ana. The woman was pregnant and the husband denied that he was the cause of her pregnancy, so the son was (later) ascribed to her. Then it became a tradition that such a son would be the heir of his mother, and she would inherit of him what Allah prescribed for her. (Using translation from Bukhārī 4746)

Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). [AI] A man from the Ansar came to the Prophet ﷺ and said, "O Messenger of Allah, what should a man do if he finds his wife with another man? Should he kill him and be killed himself?" So Allah revealed in the Quran regarding this matter. The Prophet ﷺ said, "The matter has been decided for you and your wife." They both cursed each other, and then the man left his wife in the presence of the Prophet ﷺ . It became a practice after them that if a couple curses each other, they should be separated. The wife was pregnant, and he denied that the child was his. His son was called to his mother. Abu Abdullah Al-Hafiz informed us, Abu Al-Abbas I am Ar-Rabi' reported in the hadith of Ibn Abi Dhia' that it indicates that Sahl ibn Sa'd said, "It was the practice of the cursed ones." In the hadith of Malik and Ibrahim ibn Sa'd, it is as if it is the statement of Ibn Shihab, and it may be that this is not a difference mentioned by Ibn Shihab once without mentioning Sa'ad and another time mentioning Sa'ad. Ibn Abi Dhia' agreed with Ibrahim ibn Sa'd in what he added to the end of the hadith in addition to the hadith of Malik. As for the hadith of Ibn Abi Dhia' it was informed by Abu Abdullah Al-Hafiz, Abu Sa'd Ahmad ibn Ya'qub ibn Ahmad Al-Thaqafi. Umar ibn Hafs As-Sadusi informed us, Asim ibn Ali narrated to us, Ibn Abi Dhia' narrated from Az-Zuhri, from Sahl ibn Sa'd As-Sa'idi, that Uwaimir came to Asim ibn Adi and mentioned the hadith in the meaning of the narration of Abdullah ibn Naafi'.

Ibn Shihab informed me of Lian and the tradition related to it, referring to the narration of Sahl bin Saʿd, the brother of Bani Saʿidi He said, "An Ansari man came to Messenger of Allah ﷺ and said, 'O Allah's Apostle! If a man saw another man with his wife, should he kill him, or what should he do?' So Allah revealed concerning his affair what is mentioned in the Holy Qur'an about the affair of those involved in a case of Lian. The Prophet ﷺ said, 'Allah has given His verdict regarding you and your wife.' So they carried out Lian in the mosque while I was present there. When they had finished, the man said, "O Messenger of Allah ﷺ! If I should now keep her with me as a wife then I have told a lie about her. Then he divorced her thrice before Messenger of Allah ﷺ ordered him, when they had finished the Lian process. So he divorced her in front of the Prophet ﷺ ." Ibn Shihab added, "After their case, it became a tradition that a couple involved in a case of Lian should be separated by divorce. That lady was pregnant then, and later on her son was called by his mother's name. The tradition concerning their inheritance was that she would be his heir and he would inherit of her property the share Allah had prescribed for him." Ibn Shihab said that Sahl bin Saʿd As'Saidi said that the Prophet ﷺ said (in the above narration), "If that lady delivers a small red child like a lizard, then the lady has spoken the truth and the man was a liar, but if she delivers a child with black eyes and huge lips, then her husband has spoken the truth." Then she delivered it in the shape one would dislike (as it proved her guilty). (Using translation from Bukhārī 5309)

[AI] A man came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, what do you think if a man finds another man with his wife, should he kill him and you kill her?" So Allah revealed concerning both of them what is mentioned in the Quran regarding the adulterous couple. The Messenger of Allah ﷺ said, "Allah has decided in your case and in the case of your wife." He said, "We curse each other and I am a witness before the Messenger of Allah ﷺ." The Prophet ﷺ said, "If you keep her, you have lied about her, so divorce her." The tradition among them was to separate between the two cursed individuals, and she was pregnant and denied her pregnancy. The Messenger of Allah ﷺ then said, "Her child will be called to her." Then the tradition regarding inheritance was implemented, that he would inherit her and she would inherit from him what Allah had ordained for her. Abu Ya'la said, "The matter was decided regarding him." He said, "He and al-Hasan." He said, "O Messenger of Allah, if I keep her and they testify, it will be a tradition between them and their speech will be about other than that."

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ أَبِي الرَّبِيعِ وَمِنْهُمْ عِيَاضُ بْنُ عَبْدِ اللهِ الْفِهْرِيُّ 15322 أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنا أَبُو بَكْرِ بْنُ دَاسَةَ نا أَبُو دَاوُدَ نا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ نا ابْنُ وَهْبٍ عَنْ عِيَاضِ بْنِ عَبْدِ اللهِ الْفِهْرِيِّ وَغَيْرِهِ عَنِ ابْنِ شِهَابٍ عَنْ سَهْلِ بْنِ سَعْدٍ فِي هَذَا الْخَبَرِ قَالَ فَطَلَّقَهَا ثَلَاثَ تَطْلِيقَاتٍ عِنْدَ رَسُولِ اللهِ ﷺ فَأَنْفَذَهُ رَسُولُ اللهِ ﷺ وَصَارَ مَا صُنِعَ عِنْدَ رَسُولِ اللهِ ﷺ سُنَّةً قَالَ سَهْلٌ وَحَضَرْتُ هَذَا عِنْدَ رَسُولِ اللهِ ﷺ فَمَضَتِ السُّنَّةُ بَعْدُ فِي الْمُتَلَاعِنَيْنِ أَنْ يُفَرَّقَ بَيْنَهُمَا ثُمَّ لَا يَجْتَمِعَانِ أَبَدًا وَمِنْهُمْ سُفْيَانُ بْنُ عُيَيْنَةَ إِلَّا أَنَّهُ لَمْ يُتْقِنْهُ إِتْقَانَ هَؤُلَاءِ وَزَادَ فِيهِ فَفَرَّقَ بَيْنَهُمَا

I was asked about the invokers of curses during the reign of Mus'ab (b. Zubair) whether they could separate (themselves by this process). He said: I did not understand what to say. So I went to the house of Ibn 'Umar (Allah be pleased with them) in Mecca. I said to his servant: Seek permission for Me. He said that he (Ibn 'Umar) had been taking rest. He (Ibn 'Umar) heard my voice. and said: Are you Ibn Jubair? I said: Yes. He'said: Come in. By Allah, it must be some (great) need which has brought you here at this Hour. So I got in and found him lying on a blanket reclining against a pillow stuffed with fibres of date-palm. I said: O Abu'Abd al-Rahman, should there be separation between the invokers of curses? He said: Hallowed be Allah, yes, The first one who asked about it was so and so. he said: Messenger of Allah, tell me If one of us finds his wife committing adultery: what should he do? If he talks, that is something great, and if he keeps quiet that is also (something great) (which he cannot afford to do). Allah's Prophet ﷺ kept quiet (or some time). After some time he (that very person) came to him (Messenger of Allah) and said: I have been involved in that very cage about which I had asked you Allah the Exalted and Majestic then revealed (these) verses of Surah Nur:" Those who accuse their wives" (verse 6), and he (the Holy Prophet) recited them to him and admonished him, and exhorted him and informed him that the torment of the world is less painful than the torment of the Hereafter. He said: No, by Him Who sent you with Truth, I did not tell a lie against her. He (the Holy Prophet) then called her (the wife of that person who had accused her) and admonished her, and exhorted her, and informed her that the torment of this world is less painful than the torment of the Hereafter. She said: No, by Him Who sent thee with Truth, he is a liar. (it was) the man who started the swearing of oath and he swore in the name of Allah four times that he was among the truthful. and at the fifth turn he said: Let there be curse of Allah upon him if he were among the liars. Then the woman was called and she swore four times in the name of Allah that he (her husband) was among the liars, and at the fifth time (she said): Let there be curse upon her if he were among the truthful. He (the Holy Prophet) then effected separation between the two. (Using translation from Muslim 1493a)

البيهقي:١٥٣٤٢أَخْبَرَنَا أَبُو الْحُسَيْنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ عَبْدِ اللهِ بْنِ بِشْرَانَ الْعَدْلُ بِبَغْدَادَ أنا أَبُو جَعْفَرٍ مُحَمَّدُ بْنُ عَمْرٍو الرَّزَّازُ نا مُحَمَّدُ بْنُ عُبَيْدِ اللهِ بْنِ الْمُنَادِي نا إِسْحَاقُ بْنُ يُوسُفَ نا عَبْدُ الْمَلِكِ بْنُ أَبِي سُلَيْمَانَ عَنْ سَعِيدِ بْنِ جُبَيْرٍ قَالَ سُئِلْتُ عَنِ الْمُتَلَاعِنَيْنِ فِي زَمَنِ مُصْعَبِ بْنِ الزُّبَيْرِ يُفَرَّقُ بَيْنَهُمَا؟ فَمَا دَرَيْتُ مَا أَقُولُ فَقُمْتُ إِلَى مَنْزِلِ عَبْدِ اللهِ بْنِ عُمَرَ فَاسْتَأْذَنْتُ عَلَيْهِ فَقِيلَ هُوَ نَائِمٌ فَسَمِعَ صَوْتِي فَقَالَ ابْنُ جُبَيْرٍ فَأْذَنُوا لَهُ قَالَ فَدَخَلْتُ عَلَيْهِ فَقَالَ

مَا جَاءَ بِكَ هَذِهِ السَّاعَةَ إِلَّا حَاجَةٌ فَإِذَا هُوَ مُفْتَرِشٌ بَرْذَعَةَ رَحْلِهِ مُتَوَسِّدًا بِوِسَادَةٍ حَشْوُهَا لِيفٌ أَوْ سَلَبٌ قَالَ السَّلَبُ يَعْنِي لِيفَ الْمَقْلِ فَقُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ الْمُتَلَاعِنَيْنِ يُفَرَّقُ بَيْنَهُمَا؟ فَقَالَ سُبْحَانَ اللهِ نَعَمْ إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ هَذَا فُلَانُ بْنُ فُلَانٍ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى عَلَى امْرَأَتِهِ رَجُلًا كَيْفَ يَصْنَعُ إِنْ تَكَلَّمَ تَكَلَّمَ بِأَمْرٍ عَظِيمٍ وَإِنْ سَكَتَ سَكَتَ عَلَى مِثْلِ ذَلِكَ قَالَ فَلَمْ يُجِبْهُ النَّبِيُّ ﷺ فَلَمَّا كَانَ بَعْدَ ذَلِكَ أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ الَّذِي كُنْتُ سَأَلْتُ عَنْهُ قَدِ ابْتُلِيتُ بِهِ قَالَ فَأَنْزَلَ اللهُ ﷻ الْآيَاتِ الَّتِي فِي سُورَةِ النُّورِ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ} [النور 6] إِلَى آخِرِ الْآيَاتِ قَالَ فَدَعَا النَّبِيُّ ﷺ بِالرَّجُلِ فَتَلَا عَلَيْهِ وَوَعَظَهُ وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا كَذَبْتُ عَلَيْهَا قَالَ ثُمَّ دَعَا النَّبِيُّ ﷺ بِالْمَرْأَةِ فَتَلَا عَلَيْهَا وَوَعَظَهَا وَذَكَّرَهَا وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ فَقَالَتْ لَا وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا صَدَقَكَ لَقَدْ كَذَبَكَ قَالَ فَبَدَأَ النَّبِيُّ ﷺ بِالرَّجُلِ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّهُ لَمِنَ الصَّادِقِينَ وَفِي الْخَامِسَةِ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ثُمَّ ثَنَّى النَّبِيُّ ﷺ بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّهُ لَمِنَ الْكَاذِبِينَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ قَالَ ثُمَّ فَرَّقَ بَيْنَهُمَا

A man came to Messenger of Allah ﷺ and said, "O Messenger of Allah ﷺ! Suppose a man saw another man with his wife, should he kill him whereupon you might kill him (i.e. the killer) (in Qisas) or what should he do?" So Allah revealed concerning their case what is mentioned of the order of Mula'ana. Allah's Apostle said to the man, "The matter between you and your wife has been decided." So they did Mula'ana in the presence of Messenger of Allah ﷺ and I was present there, and then the man divorced his wife. So it became a tradition to dissolve the marriage of those spouses who were involved in a case of Mula'ana. The woman was pregnant and the husband denied that he was the cause of her pregnancy, so the son was (later) ascribed to her. Then it became a tradition that such a son would be the heir of his mother, and she would inherit of him what Allah prescribed for her. (Using translation from Bukhārī 4746)

أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ بِهِ؟ فَأَنْزَلَ اللهُ ﷻ مَا ذُكِرَ فِي الْقُرْآنِ مِنَ التَّلَاعُنِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا فَكَانَتْ سُنَّةً بَعْدُ فِيهِمَا أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا وَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا ثُمَّ جَرَتِ السُّنَّةُ فِي الْمَوَارِيثِ أَنْ يَرِثَهَا وَتَرِثَ مِنْهُ مَا فَرَضَ اللهُ ﷻ لَهُمَا

"عَبْ: ثَنَا ابْنُ جُرَيْجٍ قَالَ: أَخْبَرَنِى ابْنُ شِهَابٍ، عَنْ سَهْلِ بْنِ سَعْدِ أَنَّ رَجُلًا مِنَ الأَنْصَارِ جَاءَ النَّبِىَّ ﷺ فَقَالَ: يَارَسُولَ الله، أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَيَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ فَأَنْزَلَ الله فِى شَأنِهِ مَا ذُكِرَ فِى الْقُرَآنِ فِى أَمْرِ الْمُتَلاَعنَيْنِ، فَقَالَ لَهُ رَسُولُ الله ﷺ ، قَدْ قَضَى الله فِيكَ وَفِى امْرَأَتِكَ، فَتَلاَعَنَا فِى الْمَسْجِدِ وَأَنَا شَاهِدٌ، فَلَمَّا فَرَغَ، قَالَ: كَذَبْتُ عَلَيْهَا يَارَسُولَ الله إِنْ أَمْسَكْتُهَا، فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأمُرَهُ النَّبِىُّ ﷺ حِينَ فَرَغَا مِنَ التلاَعُنِ، فَفَارَقها عِنْدَ النَّبِىِّ ﷺ ، فَقَالَ النَّبِىُّ ﷺ ذَلِكَ التَّفْرِيقُ بَيْنَ كُلِّ مُتَلاَعِنَيْنِ، وَكَانَتْ حَامِلًا، فَأَنْكَرَهُ، فَكَانَ ابْنُهَا يُدْعَى

لأُمِّهِ، وَقَالَ النَّبِىُّ ﷺ : إِن جَاءَتْ بِهِ أُحَيْمِرَ قَضِيئًا () كَأَنَّهُ وَحَرَةٌ ( *) فَلاَ أَرَاهَا إِلاَّ صَدَقَتْ، وَكَذَبَ عَلَيْهَا، وَإِنْ جَاءَتْ بِهِ أَسْوَدَ ذَا أَلْيَتَيْنِ، فَلاَ أُرَاهُ إِلاَّ قَدْ صَدَقَ عَلَيْهَا، فَجَاءَتْ بِهِ عَلَى الْمَكْرُوهِ مِنْ ذَلِكَ، قَالَ ابْنُ جُرَيْجٍ: وَسَمِعْتُ عَبْدَ الله بْنَ عُبَيدِ بْنِ عُمَيْرٍ يَقُولُ: قِيلَ لِلنَّبِىِّ ﷺ : هُوَ هَذَا يَا رَسُولَ الله، هُوَ هَذَا، فَأَمَدَّهُ رَسُولُ الله ﷺ بِبَصَرِهِ حَتَّى رَأَيْنَا أَنَّهُ قَائِلٌ لَهُ شَيْئًا، فَلَمْ يَقُلْ لَهُ شَيْئًا، قَالَ ابْنُ جُرَيْجٍ: وَسَمِعْتُ مُحَمَّدَ بْنَ عَبَّادِ بْنِ جَعْفَرٍ يَقُولُ: قَالَ النَّبِىُّ ﷺ : لَمَّا تَلاَعَنَا، أَمَّا أَنْتُمَا فَقَدْ عَرَفْتُمَا أنِّى لاَ أَعْلَمُ الْغَيْبَ، وَقَالَ ابْنُ جُرَيجٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ عَنْ عَلِىٍّ قَالَ: لَمَّا كَانَ مِنْ شَأنِ الْمُتَلاَعِنَيْنِ عِنْدَ النَّبِىِّ ﷺ ، قَالَ: لاَ أُحِبُّ أَنْ أَكُونَ أَوَّلَ الأَرْبَعَةِ".
