46. Chapter
٤٦۔ كِتَابُ اللِّعَانِ
A man came to Messenger of Allah ﷺ and said, "O Messenger of Allah ﷺ! Suppose a man saw another man with his wife, should he kill him whereupon you might kill him (i.e. the killer) (in Qisas) or what should he do?" So Allah revealed concerning their case what is mentioned of the order of Mula'ana. Allah's Apostle said to the man, "The matter between you and your wife has been decided." So they did Mula'ana in the presence of Messenger of Allah ﷺ and I was present there, and then the man divorced his wife. So it became a tradition to dissolve the marriage of those spouses who were involved in a case of Mula'ana. The woman was pregnant and the husband denied that he was the cause of her pregnancy, so the son was (later) ascribed to her. Then it became a tradition that such a son would be the heir of his mother, and she would inherit of him what Allah prescribed for her. (Using translation from Bukhārī 4746)
أَنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا رَأَى مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ بِهِ؟ فَأَنْزَلَ اللهُ ﷻ مَا ذُكِرَ فِي الْقُرْآنِ مِنَ التَّلَاعُنِ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ قَدْ قُضِيَ فِيكَ وَفِي امْرَأَتِكَ قَالَ فَتَلَاعَنَا وَأَنَا شَاهِدٌ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَقَدْ كَذَبْتُ عَلَيْهَا فَفَارَقَهَا فَكَانَتْ سُنَّةً بَعْدُ فِيهِمَا أَنْ يُفَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَكَانَتْ حَامِلًا فَأَنْكَرَ حَمْلَهَا وَكَانَ ابْنُهَا يُدْعَى إِلَيْهَا ثُمَّ جَرَتِ السُّنَّةُ فِي الْمَوَارِيثِ أَنْ يَرِثَهَا وَتَرِثَ مِنْهُ مَا فَرَضَ اللهُ ﷻ لَهُمَا
‘Abd Allah (bin Mas’ud) said “We were in the mosque on the night of a Friday, suddenly a man from the Ansar entered the mosque”. And said “If a man finds a man along with wife and declares (about her adultery) you will flog him. Or if he kills you, you will kill him or if keeps silence he will keep silence in anger. I swear by Allaah, I shall ask the Apostle of Allaah ﷺ about it”. On the next day he came to the Apostle of Allaah ﷺ and said “If a man finds a man along with wife and declares (about her adultery) you will flog him. Or if he kills you, you will kill him or if keeps silence he will keep silence in anger.” He said “O Allaah, disclose”. He kept on praying until the verses regarding invoking curses (li’an) came down “As for those who accuse their wives but have no witnesses except themselves.” So, the man was first involved in this trial among the people. He and his wife came to the Apostle of Allaah ﷺ. They invoked curses on each other. The man bore witness before Allaah four times that the thing he said was indeed true. He then invoked curse of Allaah on him for the fifth time if he was a liar. She then wanted to invoke curses of Allaah on him. The Prophet ﷺ said “Do not do that. Bust she refused and did so (i.e., invoked curses). When they returned he said “Perhaps she will give birth to a black child with curly hair. (Using translation from Abū Dāʾūd 2253)
كُنَّا لَيْلَةَ الْجُمُعَةِ فِي الْمَسْجِدِ إِذْ دَخَلَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ لَوْ أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَإِنْ تَكَلَّمَ جَلَدْتُمُوهُ وَإِنْ قَتَلَ قَتَلْتُمُوهُ وَإِنْ سَكَتَ سَكَتَ عَلَى غَيْظٍ وَاللهِ لَأَسْأَلَنَّ عَنْهُ رَسُولَ اللهِ ﷺ فَلَمَّا كَانَ مِنَ الْغَدِ أَتَى رَسُولَ اللهِ ﷺ فَسَأَلَهُ فَقَالَ لَوْ أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَتَكَلَّمَ جَلَدْتُمُوهُ أَوْ قَتَلَ قَتَلْتُمُوهُ أَوْ سَكَتَ سَكَتَ عَلَى غَيْظٍ فَقَالَ اللهُمَّ افْتَحْ وَجَعَلَ يَدْعُو فَنَزَلَتْ آيَةُ اللِّعَانِ {وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلَّا أَنْفُسُهُمْ} [النور 6] هَذِهِ الْآيَاتِ فَابْتُلِيَ بِهِ الرَّجُلُ مِنْ بَيْنِ النَّاسِ فَجَاءَ هُوَ وَامْرَأَتُهُ إِلَى رَسُولِ اللهِ ﷺ فَتَلَاعَنَا فَشَهِدَ الرَّجُلُ أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّهُ لَمِنَ الصَّادِقِينَ ثُمَّ لَعَنَ الْخَامِسَةَ أَنَّ لَعْنَةَ اللهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ فَذَهَبَتْ لِتَلْتَعِنَ فَقَالَ رَسُولُ اللهِ ﷺ مَهْ فَلَعَنَتْ فَلَمَّا أَدْبَرَا قَالَ لَعَلَّهَا أَنْ تَجِيءَ بِهِ أَسْوَدَ جَعْدًا فَجَاءَتْ بِهِ أَسْوَدَ جَعْدًا
أَنَّ النَّبِيَّ ﷺ لَاعَنَ بِالْحَمْلِ
[Machine] "Lā'ana fa Lā'ana Rasūl Allāh ﷺ ya'nī baynahumā fa qāla Rasūl Allāh ﷺ inẓuruhā fa in jā'at bihi abyadah sabtan aqdā al'aynayn fahuwa li Hilāl ibn Umayyah wa in jā'at bihi akhalah ja'dan hamshas-sāqayn fahuwa li Shariq ibn Sahmā' qāla fa unbi'tu annahā jā'at bihi akhalah ja'dan hamshas-sāqayn."
"I cursed, and the Messenger of Allah ﷺ cursed him, meaning between the two of them. The Messenger of Allah ﷺ said, 'Look at it, if it comes with white streaks, it will be for Hilal ibn Umayyah, and if it comes with dark curly hair, twisted at the legs, it will be for Shariq ibn Sahma'.' He said, 'So, I was informed that it came with dark curly hair, twisted at the legs.'
لَاعَنَ فَلَاعَنَ رَسُولُ اللهِ ﷺ يَعْنِي بَيْنَهُمَا فَقَالَ رَسُولُ اللهِ ﷺ انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أَبْيَضَ سَبْطًا أَقْضَى الْعَيْنَيْنِ فَهُوَ لِهِلَالِ بْنِ أُمَيَّةَ وَإِنْ جَاءَتْ بِهِ أَكْحَلَ جَعْدًا حَمْشَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ سَحْمَاءَ قَالَ فَأُنْبِئْتُ أَنَّهَا جَاءَتْ بِهِ أَكْحَلَ جَعْدًا حَمْشَ السَّاقَيْنِ
[Machine] The cursed ones were mentioned in the presence of the Messenger of Allah ﷺ , so Asim ibn Adi made a statement about it and then left. A man from his tribe came to him and informed him that he found another man with his wife. Asim replied, "I would not have been afflicted with this if it wasn't for my statement." He then brought the matter to the attention of the Messenger of Allah ﷺ and informed him about what he found upon his wife. This man was fair in complexion, lean, with little flesh and thin hair. The one who claimed to have found Adam among his people, was described as tall, with abundant curly hair. The Messenger of Allah ﷺ invoked Allah, saying, "O Allah, make the truth clear." He then presented a man who resembled the one mentioned by her husband as the one he found with her. The Messenger of Allah ﷺ then invoked a curse between the couple. A man in the gathering said to Ibn Abbas, "She is the one whom the Messenger of Allah ﷺ said, 'If I had stoned someone without clear evidence, I would have stoned her.'" Ibn Abbas replied, "She is not a woman who displays evil in Islam."
الْمُتَلَاعِنَانِ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ عَاصِمُ بْنُ عَدِيٍّ فِي ذَلِكَ قَوْلًا فَانْصَرَفَ فَأَتَاهُ رَجُلٌ مِنْ قَوْمِهِ فَذَكَرَ لَهُ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَالَ عَاصِمٌ مَا ابْتُلِيتُ بِهَذَا إِلَّا بِقَوْلِي فَجَاءَ بِهِ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَهُ بِالَّذِي وَجَدَ عَلَيْهِ امْرَأَتَهُ وَكَانَ ذَلِكَ الرَّجُلُ مُصْفَرًّا قَلِيلَ اللَّحْمِ سَبِطَ الشَّعْرِ وَكَانَ الَّذِي ادَّعَى أَنَّهُ وَجَدَ عِنْدَ أَهْلِهِ آدَمَ خَدْلًا كَثِيرَ اللَّحْمِ جَعْدًا قَطَطًا فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ فَوَضَعَتْ شَبِيهًا بِالَّذِي ذَكَرَ زَوْجُهَا أَنَّهُ وَجَدَهُ عِنْدَهَا فَلَاعَنَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا فَقَالَ رَجُلٌ لِابْنِ عَبَّاسٍ فِي الْمَجْلِسِ هِيَ الَّتِي قَالَ رَسُولُ اللهِ ﷺ لَوْ رَجَمْتُ أَحَدًا بِغَيْرِ بَيِّنَةٍ لَرَجَمْتُ هَذِهِ فَقَالَ ابْنُ عَبَّاسٍ ؓ لَا تِلْكَ امْرَأَةٌ كَانَتْ تُظْهِرُ السُّوءَ فِي الْإِسْلَامِ
[Machine] He came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I have no covenant with my family since the season of pollinating the palm trees." He said, "And its pollinating is that when it is pollinated, it is not irrigated for forty days after pollination." He said, "So I found a man with my wife, and her husband was fair-skinned, with thick calves, hairless, and the one who was thrown with him is black, curly-haired, short, and hairy." The Messenger of Allah ﷺ said, "O Allah, make the truth clear, then curse the liar between them." Then a person resembling the man who was accused came.
جَاءَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ وَاللهِ مَالِي عَهْدٌ بِأَهْلِي مُنْذُ عَفَارِ النَّخْلِ قَالَ وَعَفَارُهَا أَنَّهَا إِذَا كَانَتْ تُؤَبَّرُ تُعْفَرُ أَرْبَعِينَ يَوْمًا لَا تُسْقَى بَعْدَ الْإِبَّارِ قَالَ فَوَجَدْتُ مَعَ امْرَأَتِي رَجُلًا قَالَ وَكَانَ زَوْجُهَا مُصْفَرًّا حَمْشَ السَّاقَيْنِ سَبِطَ الشَّعْرِ وَالَّذِي رُمِيَتْ بِهِ خَدْلًا إِلَى السَّوَادِ جَعْدًا قَطَطًا مُسْتَهًا قَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ ثُمَّ لَاعَنَ بَيْنَهُمَا فَجَاءَ شَبِيهًا بِالرَّجُلِ الَّذِي رُمِيَتْ بِهِ
[Machine] Allah cursed the man between the two camels and his wife who was pregnant. Her husband said, "By Allah, I have not come near her since we flocked the palm trees." The Messenger of Allah ﷺ said, "The 'afar' (period of not watering the date palm) is to water the palm trees after leaving them without water for two months." The Messenger of Allah ﷺ then supplicated and called to the husband of the woman, "May her arms and legs be discolored with gold-like hair." The one who was accused of impregnating Al-Sahma'a (the woman) came with a young boy who was black, with bleary eyes, having curly hair that reached his elbows and thick calves. Al-Qasim, the son of Shaddad bin Al-Had, asked Ibn Abbas, "Is this the woman about whom the Messenger of Allah ﷺ said: 'If I were to stone anyone without clear proof, I would have stoned her'?" Ibn Abbas replied, "This is not a woman who concealed evil in Islam." Ibn Abi Al-Zinad narrated it from his father with his Isanad (chain of narrators), from Abu Al-Zinad from his father, with this Tafsir (interpretation). The Messenger of Allah ﷺ cursed the man between the two camels and his wife who was pregnant. Her husband said, "By Allah, I have not come near her since we flocked the palm trees." He mentioned the Tafsir (interpretation) of "Afar." The Messenger of Allah ﷺ then supplicated and they claimed that the husband of the woman had golden-colored hair. He mentioned it in a different way, except that he said, "It turned tawny (golden-brown) instead of black." He added some other details. Ibn Khuzaymah narrated it, as well as Al-Rabi' bin Sulayman, who said, "I am the son of Wahb. Ibn Abi Al-Zinad narrated it from his father, from Abu Al-Zinad, from his father. Al-Qasim bin Muhammad narrated it from Abdullah bin Abbas, may Allah be pleased with him, and he mentioned it."
اللهِ ﷺ لَاعَنَ بَيْنَ الْعَجْلَانِيِّ وَامْرَأَتِهِ وَكَانَتْ حَامِلًا فَقَالَ زَوْجُهَا وَاللهِ مَا قَرَبْتُهَا مُنْذُ عَفَرْنَا قَالَ وَالْعَفْرُ أَنْ يُسْقَى النَّخْلُ بَعْدَ أَنْ يُتْرَكَ مِنَ السَّقْيِ بَعْدَ الْإِبَّارِ شَهْرَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ فَدَعَا رَسُولُ اللهِ ﷺ زَوْجَ الْمَرْأَةِ حَمْشَ الذِّرَاعَيْنِ وَالسَّاقَيْنِ أَصْهَبَ الشَّعْرِ وَكَانَ الَّذِي رُمِيَتْ بِهِ ابْنَ السَّحْمَاءِ فَجَاءَتْ بِغُلَامٍ أَسْوَدَ أَكْحَلَ جَعْدًا عَبْلَ الذِّرَاعَيْنِ خَدْلَ السَّاقَيْنِ قَالَ الْقَاسِمُ قَالَ ابْنُ شَدَّادِ بْنِ الْهَادِ لِابْنِ عَبَّاسٍ أَهِيَ الْمَرْأَةُ الَّتِي قَالَ رَسُولُ اللهِ ﷺ لَوْ كُنْتُ رَاجِمًا أَحَدًا بِغَيْرِ بَيِّنَةٍ لَرَجَمْتُهَا ؟ فَقَالَ ابْنُ عَبَّاسٍ لَا تِلْكَ امْرَأَةٌ أَعْلَنَتِ السُّوءَ فِي الْإِسْلَامِ وَرَوَاهُ ابْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ بِإِسْنَادِهِ أَنَّ رَسُولَ اللهِ ﷺ لَاعَنَ بَيْنَ الْعَجْلَانِيِّ وَامْرَأَتِهِ وَكَانَتْ حُبْلَى وَقَالَ زَوْجُهَا وَاللهِ مَا قَرَبْتُهَا مُنْذُ عَفَرْنَا النَّخْلَ وَذَكَرَ تَفْسِيرَ الْعَفْرِ وَقَالَ فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ وَزَعَمُوا أَنَّ زَوْجَ الْمَرْأَةِ كَانَ حَمْشَ الذِّرَاعَيْنِ فَذَكَرَهُ بِنَحْوِهِ غَيْرَ أَنَّهُ قَالَ أَجْلَى بَدَلَ أَكْحَلَ وَزَادَ قَطَطًا قَالَ ابْنُ خُزَيْمَةَ نا الرَّبِيعُ بْنُ سُلَيْمَانَ أنا ابْنُ وَهْبٍ أَخْبَرَنِي ابْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ حَدَّثَنِي الْقَاسِمُ بْنُ مُحَمَّدٍ عَنْ عَبْدِ اللهِ بْنِ عَبَّاسٍ ؓ فَذَكَرَهُ
