[AI] The cursed ones were mentioned in the presence of the Messenger of Allah ﷺ , so Asim ibn Adi made a statement about it and then left. A man from his tribe came to him and informed him that he found another man with his wife. Asim replied, "I would not have been afflicted with this if it wasn't for my statement." He then brought the matter to the attention of the Messenger of Allah ﷺ and informed him about what he found upon his wife. This man was fair in complexion, lean, with little flesh and thin hair. The one who claimed to have found Adam among his people, was described as tall, with abundant curly hair. The Messenger of Allah ﷺ invoked Allah, saying, "O Allah, make the truth clear." He then presented a man who resembled the one mentioned by her husband as the one he found with her. The Messenger of Allah ﷺ then invoked a curse between the couple. A man in the gathering said to Ibn Abbas, "She is the one whom the Messenger of Allah ﷺ said, 'If I had stoned someone without clear evidence, I would have stoned her.'" Ibn Abbas replied, "She is not a woman who displays evil in Islam."

الْمُتَلَاعِنَانِ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ عَاصِمُ بْنُ عَدِيٍّ فِي ذَلِكَ قَوْلًا فَانْصَرَفَ فَأَتَاهُ رَجُلٌ مِنْ قَوْمِهِ فَذَكَرَ لَهُ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَالَ عَاصِمٌ مَا ابْتُلِيتُ بِهَذَا إِلَّا بِقَوْلِي فَجَاءَ بِهِ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَهُ بِالَّذِي وَجَدَ عَلَيْهِ امْرَأَتَهُ وَكَانَ ذَلِكَ الرَّجُلُ مُصْفَرًّا قَلِيلَ اللَّحْمِ سَبِطَ الشَّعْرِ وَكَانَ الَّذِي ادَّعَى أَنَّهُ وَجَدَ عِنْدَ أَهْلِهِ آدَمَ خَدْلًا كَثِيرَ اللَّحْمِ جَعْدًا قَطَطًا فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ بَيِّنْ فَوَضَعَتْ شَبِيهًا بِالَّذِي ذَكَرَ زَوْجُهَا أَنَّهُ وَجَدَهُ عِنْدَهَا فَلَاعَنَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا فَقَالَ رَجُلٌ لِابْنِ عَبَّاسٍ فِي الْمَجْلِسِ هِيَ الَّتِي قَالَ رَسُولُ اللهِ ﷺ لَوْ رَجَمْتُ أَحَدًا بِغَيْرِ بَيِّنَةٍ لَرَجَمْتُ هَذِهِ فَقَالَ ابْنُ عَبَّاسٍ ؓ لَا تِلْكَ امْرَأَةٌ كَانَتْ تُظْهِرُ السُّوءَ فِي الْإِسْلَامِ

'Uwaimir came to ʿAsim bin ʿAdi who was the chief of Bani Ajlan and said, "What do you say about a man who has found another man with his wife? Should he kill him whereupon you would kill him (i.e. the husband), or what should he do? Please ask Messenger of Allah ﷺ about this matter on my behalf." ʿAsim then went to the Prophet ﷺ and said, "O Messenger of Allah ﷺ! (And asked him that question) but Messenger of Allah ﷺ disliked the question," When 'Uwaimir asked ʿAsim (about the Prophet's answer) ʿAsim replied that Messenger of Allah ﷺ disliked such questions and considered it shameful. "Uwaimir then said, "By Allah, I will not give up asking unless I ask Messenger of Allah ﷺ about it." Uwaimir came (to the Prophet ) and said, "O Messenger of Allah ﷺ! A man has found another man with his wife! Should he kill him whereupon you would kill him (the husband, in Qisas) or what should he do?" Messenger of Allah ﷺ said, "Allah has revealed regarding you and your wife's case in the Qur'an "So Messenger of Allah ﷺ ordered them to perform the measures of Mula'ana according to what Allah had mentioned in His Book. So 'Uwaimir did Mula'ana with her and said, "O Messenger of Allah ﷺ! If I kept her I would oppress her." So 'Uwaimir divorced her and so divorce became a tradition after them for those who happened to be involved in a case of Mula'ana. Messenger of Allah ﷺ then said, "Look! If she (Uwaimir's wife) delivers a black child with deep black large eyes, big hips and fat legs, then I will be of the opinion that 'Uwaimir has spoken the truth; but if she delivers a red child looking like a Wahra then we will consider that 'Uwaimir has told a lie against her." Later on she delivered a child carrying the qualities which Messenger of Allah ﷺ had mentioned as a proof for 'Uwaimir's claim; therefore the child was ascribed to its mother henceforth.

What ʿAsim heard from Messenger of Allah ﷺ was hard on him. When he returned to his family, 'Uwaimir came to him and said "O ʿAsim! What did Messenger of Allah ﷺ say to you?" ʿAsim said, "You never bring me any good. Messenger of Allah ﷺ disliked to hear the problem which I asked him about." 'Uwaimir said, "By Allah, I will not leave the matter till I ask him about it." So 'Uwaimir proceeded till he came to Messenger of Allah ﷺ who was in the midst of the people and said, "O Messenger of Allah ﷺ! If a man finds with his wife another man, should he kill him, whereupon you would kill him (in Qisas): or otherwise, what should he do?" Messenger of Allah ﷺ said, "Allah has revealed something concerning the question of you and your wife. Go and bring her here." So they both carried out the judgment of Lian, while I was present among the people (as a witness). When both of them had finished, 'Uwaimir said, "O Messenger of Allah ﷺ! If I should now keep my wife with me, then I have told a lie". Then he pronounced his decision to divorce her thrice before Allah's Apostle ordered him to do so. (Ibn Shihab said, "That was the tradition for all those who are involved in a case of Lian."

Ibn ʿAbbas; said, "Once Lian was mentioned before the Prophet ﷺ whereupon ʿAsim bin Adi said something and went away. Then a man from his tribe came to him, complaining that he had found a man with his wife. ʿAsim said, 'I have not been put to task except for my statement (about Lian).' ʿAsim took the man to the Prophet ﷺ and the man told him of the state in which he had found his wife. The man was pale, thin, and of lank hair, while the other man whom he claimed he had seen with his wife, was brown, fat and had much flesh on his calves. The Prophet ﷺ invoked, saying, 'O Allah! Reveal the truth.' So that lady delivered a child resembling the man whom her husband had mentioned he had found her with. The Prophet ﷺ then made them carry out Lian." Then a man from that gathering asked Ibn ʿAbbas, "Was she the same lady regarding which the Prophet ﷺ had said, 'If I were to stone to death someone without witness, I would have stoned this lady'?" Ibn ʿAbbas said, "No, that was another lady who, though being a Muslim, used to arouse suspicion by her outright misbehavior. "

البخاري:٥٣١٠حَدَّثَنَا سَعِيدُ بْنُ عُفَيْرٍ قَالَ حَدَّثَنِي اللَّيْثُ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ ذُكِرَ

التَّلاَعُنُ عِنْدَ النَّبِيِّ ﷺ فَقَالَ عَاصِمُ بْنُ عَدِيٍّ فِي ذَلِكَ قَوْلاً ثُمَّ انْصَرَفَ فَأَتَاهُ رَجُلٌ مِنْ قَوْمِهِ يَشْكُو إِلَيْهِ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً فَقَالَ عَاصِمٌ مَا ابْتُلِيتُ بِهَذَا إِلاَّ لِقَوْلِي فَذَهَبَ بِهِ إِلَى النَّبِيِّ ﷺ فَأَخْبَرَهُ بِالَّذِي وَجَدَ عَلَيْهِ امْرَأَتَهُ وَكَانَ ذَلِكَ الرَّجُلُ مُصْفَرًّا قَلِيلَ اللَّحْمِ سَبْطَ الشَّعَرِ وَكَانَ الَّذِي ادَّعَى عَلَيْهِ أَنَّهُ وَجَدَهُ عِنْدَ أَهْلِهِ خَدْلاً آدَمَ كَثِيرَ اللَّحْمِ فَقَالَ النَّبِيُّ ﷺ اللَّهُمَّ بَيِّنْ فَجَاءَتْ شَبِيهًا بِالرَّجُلِ الَّذِي ذَكَرَ زَوْجُهَا أَنَّهُ وَجَدَهُ فَلاَعَنَ النَّبِيُّ ﷺ بَيْنَهُمَا قَالَ رَجُلٌ لاِبْنِ عَبَّاسٍ فِي الْمَجْلِسِ هِيَ الَّتِي قَالَ النَّبِيُّ ﷺ لَوْ رَجَمْتُ أَحَدًا بِغَيْرِ بَيِّنَةٍ رَجَمْتُ هَذِهِ فَقَالَ لاَ تِلْكَ امْرَأَةٌ كَانَتْ تُظْهِرُ فِي الإِسْلاَمِ السُّوءَ قَالَ أَبُو صَالِحٍ وَعَبْدُ اللَّهِ بْنُ يُوسُفَ خَدِلاً

Those involved in a case of Lian were mentioned before Messenger of Allah ﷺ ʿAsim bin Adi said something about that and then left. Later on a man from his tribe came to him and told him that he had found another man with his wife. On that ʿAsim said, "I have not been put to task except for what I have said (about Lian)." ʿAsim took the man to Messenger of Allah ﷺ and he told him of the state in which he found his wife. The man was pale, thin and lank-haired, while the other man whom he had found with his wife was brown, fat with thick calves and curly hair. Messenger of Allah ﷺ said, "O Allah! Reveal the truth." Then the lady delivered a child resembling the man whom her husband had mentioned he had found with her. So Messenger of Allah ﷺ ordered them to carry out Lien. A man from that gathering said to Ibn ʿAbbas, "Was she the same lady regarding whom Messenger of Allah ﷺ said, 'If I were to stone to death someone without witnesses, I would have stoned this lady'?" Ibn ʿAbbas said, "No, that was another lady who, though being a Muslim, used to arouse suspicion because of her outright misbehavior."

أَنَّهُ قَالَ ذُكِرَ الْمُتَلاَعِنَانِ عِنْدَ رَسُولِ اللَّهِ ﷺ فَقَالَ عَاصِمُ بْنُ عَدِيٍّ فِي ذَلِكَ قَوْلاً ثُمَّ انْصَرَفَ فَأَتَاهُ رَجُلٌ مِنْ قَوْمِهِ فَذَكَرَ لَهُ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً فَقَالَ عَاصِمٌ مَا ابْتُلِيتُ بِهَذَا الأَمْرِ إِلاَّ لِقَوْلِي فَذَهَبَ بِهِ إِلَى رَسُولِ اللَّهِ ﷺ فَأَخْبَرَهُ بِالَّذِي وَجَدَ عَلَيْهِ امْرَأَتَهُ وَكَانَ ذَلِكَ الرَّجُلُ مُصْفَرًّا قَلِيلَ اللَّحْمِ سَبْطَ الشَّعَرِ وَكَانَ الَّذِي وَجَدَ عِنْدَ أَهْلِهِ آدَمَ خَدْلاً كَثِيرَ اللَّحْمِ جَعْدًا قَطَطًا فَقَالَ رَسُولُ اللَّهِ ﷺ اللَّهُمَّ بَيِّنْ فَوَضَعَتْ شَبِيهًا بِالرَّجُلِ الَّذِي ذَكَرَ زَوْجُهَا أَنَّهُ وَجَدَ عِنْدَهَا فَلاَعَنَ رَسُولُ اللَّهِ ﷺ بَيْنَهُمَا فَقَالَ رَجُلٌ لاِبْنِ عَبَّاسٍ فِي الْمَجْلِسِ هِيَ الَّتِي قَالَ رَسُولُ اللَّهِ ﷺ لَوْ رَجَمْتُ أَحَدًا بِغَيْرِ بَيِّنَةٍ لَرَجَمْتُ هَذِهِ فَقَالَ ابْنُ عَبَّاسٍ لاَ تِلْكَ امْرَأَةٌ كَانَتْ تُظْهِرُ السُّوءَ فِي الإِسْلاَمِ

Lian was mentioned in the presence of the Prophet, ʿAsim bin Adi said a statement about it, and when he left, a man from his tribe came to him complaining that he had seen a man with his wife. ʿAsim said, "I have been put to trial only because of my statement." So he took the man to the Prophet ﷺ and the man told him about the incident. The man (husband) was of yellow complexion, thin, and of lank hair, while the man whom he had accused of having been with his wife, was reddish brown with fat thick legs and fat body. The Prophet ﷺ said, "O Allah! Reveal the truth." Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn ʿAbbas in the gathering, "Was that the same lady about whom the Prophet ﷺ said, "If I were to stone any lady (for committing illegal sexual intercourse) to death without witnesses, I would have stoned that lade to death?" Ibn ʿAbbas said, "No, that was another lady who used to behave in such a suspicious way among the Muslims that one might accuse her of committing illegal sexual intercourse."

'Asim, what did Messenger of Allah ﷺ say to you? 'Asim said to 'Uwaimir: You did not bring something good. Messenger of Allah ﷺ did not like this religious verdict that I sought from him. 'Uwaimir said: By Allah, I will not rest until I have asked him about it. 'Uwaimir proceeded until he came to Messenger of Allah ﷺ as he was sitting amidst people, and said: Messenger of Allah, tell me about a person who found a man with his wife. Should he kill him, and then you would kill him, or how should he act? Thereupon Messenger of Allah ﷺ said: (Verses) have been revealed concerning you and your wife; so go and bring her. Sahl said that they both invoked curses (and further said): I was along with people in the company of Messenger of Allah ﷺ. And when they had finished, Uwaimir said: Messenger of Allah, I shall have told a lie against her if I keep her (now). So he divorced her with three pronouncements before Messenger of Allah ﷺ had commanded him. Ibn Shihab said: Subsequently that was the practice of invokers of curses (al Mutala'inain)

مسلم:١٤٩٢أوَحَدَّثَنَا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنِ ابْنِ شِهَابٍ أَنَّ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ أَخْبَرَهُ أَنَّ عُوَيْمِرًا الْعَجْلاَنِيَّ جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ الأَنْصَارِيِّ فَقَالَ لَهُ أَرَأَيْتَ يَا عَاصِمُ لَوْ

أَنَّ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ فَسَلْ لِي عَنْ ذَلِكَ يَا عَاصِمُ رَسُولَ اللَّهِ ﷺ فَسَأَلَ عَاصِمٌ رَسُولَ اللَّهِ ﷺ فَكَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ ﷺ قَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا قَالَ عُوَيْمِرٌ وَاللَّهِ لاَ أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ ﷺ وَسَطَ النَّاسِ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ فَقَالَ رَسُولُ اللَّهِ ﷺ قَدْ نَزَلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَأْتِ بِهَا قَالَ سَهْلٌ فَتَلاَعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ ﷺ فَلَمَّا فَرَغَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلاَثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ ﷺ قَالَ ابْنُ شِهَابٍ فَكَانَتْ سُنَّةَ الْمُتَلاَعِنَيْنِ

Mention was made of li'an in the presence of Messenger of Allah ﷺ. And Asim b. 'Adi passed a remark about it and then turned away, and a man of his tribe came to him complaining that he had found a man with his wife, whereupon 'Asim said: I have been taken by my words. He took him to Messenger of Allah ﷺ and told him about the man whom he had found with his wife and this man was a lean, yellow-coloured man with lank hair, and the person who was accused of committing adultery with her (his wife) had fleshy shanks, with wheat complexion and heavy bulk. Messenger of Allah ﷺ said: O Allah, make (this case) manifest. And as she gave birth to a child, whose face resembled that person about whom her husband had made mention that he had found her with, and Messenger of Allah (may peace be, upon him) had asked them to invoke curses. A person said to Ibn 'Abbas (Allah be pleased with him): Is she (that woman) about whom Messenger of Allah (may peace be upen him) (said):" If I were to stone anybody without evidence, I would have stoned her"? Ibn 'Abbas (Allah be pleased with him) said: No, it is not she. That woman was one who openly spread evil in society.

مسلم:١٤٩٧أوَحَدَّثَنَا مُحَمَّدُ بْنُ رُمْحِ بْنِ الْمُهَاجِرِ وَعِيسَى بْنُ حَمَّادٍ الْمِصْرِيَّانِ وَاللَّفْظُ لاِبْنِ رُمْحٍ قَالاَ أَخْبَرَنَا اللَّيْثُ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ قَالَ ذُكِرَ

Sahl bin Sa’ad Al Sa’idi said that ‘Uwaimir bin Ashqar Al Ajilani came to ‘Asim bin Adl and said to him “Asim tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). Ibn Shihab said “Then this became the method of invoking curses.”

أبو داود:٢٢٤٥حَدَّثَنَا عَبْدُ اللَّهِ بْنُ مَسْلَمَةَ الْقَعْنَبِيُّ عَنْ مَالِكٍ عَنِ ابْنِ شِهَابٍ أَنَّ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ أَخْبَرَهُ أَنَّ عُوَيْمِرَ بْنَ أَشْقَرَ الْعَجْلاَنِيَّ جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ فَقَالَ

لَهُ يَا عَاصِمُ أَرَأَيْتَ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ سَلْ لِي يَا عَاصِمُ رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ فَسَأَلَ عَاصِمٌ رَسُولَ اللَّهِ ﷺ فَكَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ لَهُ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ ﷺ فَقَالَ عَاصِمٌ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللَّهِ لاَ أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ ﷺ وَهُوَ وَسَطَ النَّاسِ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ فَقَالَ رَسُولُ اللَّهِ ﷺ قَدْ أُنْزِلَ فِيكَ وَفِي صَاحِبَتِكَ قُرْآنٌ فَاذْهَبْ فَأْتِ بِهَا قَالَ سَهْلٌ فَتَلاَعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ ﷺ فَلَمَّا فَرَغَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا عُوَيْمِرٌ ثَلاَثًا قَبْلَ أَنْ يَأْمُرَهُ النَّبِيُّ ﷺ قَالَ ابْنُ شِهَابٍ فَكَانَتْ تِلْكَ سُنَّةَ الْمُتَلاَعِنَيْنِ

"What do you think, O 'Asim! If a man finds another man with his wife, should he kill him, and be killed in retaliation, or what should he do? O 'Asim! Ask the Messenger of Allah about that for me." So 'Asim asked the Messenger of Allah about that, and the Messenger of Allah disapproved of the question, and criticized the asking of too many questions until 'Asim felt upset. When 'Asim went back to his people, 'Uwaimir came to him and said: "O 'Asim, what did the Messenger of Allah say to you?" 'Asim said: "You have not brought me any good. The Messenger of Allah disapproved of the question you asked." 'Uwaimir said: "By Allah, I will go and ask the Messenger of Allah." So he went to the Messenger of Allah and found him in the midst of the people. He said: "O Messenger of Allah, what do you think if a man finds another man with his wife -should he kill him, and be killed in retaliation or what should he do?" The Messenger of Allah said: "Something has been revealed concerning you and your wife, so go and bring her here." Sahl said: "So they engaged in the procedure of Li'an, and I was among the people in the presence of the Messenger of Allah. When 'Uwaimir finished he said: "I would have been telling lies about her, O Messenger of Allah, if I keep her." So he divorced her thrice before the Messenger of Allah told him to do so."

أَنَّ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَيَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ سَلْ لِي يَا عَاصِمُ رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ فَسَأَلَ عَاصِمٌ رَسُولَ اللَّهِ ﷺ فَكَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ ﷺ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتَ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللَّهِ لاَ أَنْتَهِي حَتَّى أَسْأَلَ عَنْهَا رَسُولَ اللَّهِ ﷺ فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ ﷺ وَسَطَ النَّاسِ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ فَقَالَ رَسُولُ اللَّهِ ﷺ قَدْ نَزَلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَائْتِ بِهَا قَالَ سَهْلٌ فَتَلاَعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ ﷺ فَلَمَّا فَرَغَ عُوَيْمِرٌ قَالَ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلاَثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ ﷺ

"Uwaimir, a man from Banu 'Ajlan, came and said: 'O 'Asim, what do you think if a man sees another man with his wife, should he kill him and be killed in retaliation, or what should he do? O 'Asim, ask the Messenger of Allah about that for me.'" So 'Asim asked the Messenger of Allah about that, and the Messenger of Allah disapproved of the question and criticized the asking of too many questions. Then 'Uwaimir came to him and said: "What happened, O 'Asim?" 'Asim said to 'Uwaimir: "What happened?! You have not brought me any good. The Messenger of Allah disapproved of the question I asked." 'Uwaimir said: "By Allah, I will go and ask the Messenger of Allah." So he went to the Messenger of Allah and asked him. The Messenger of Allah said: "Allah the Mighty and Sublime has revealed (something) concerning you and your wife, so bring her here." Sahl said: "I was among the people in the presence of the Messenger of Allah and he brought her and they engaged in the procedure of Li'an. He said: 'O Messenger of Allah, by Allah! If I keep her I would have been telling lies about her.' So he parted from her before the Messenger of Allah told him to separate from her, and that became the way of Li'an."

"Mention of Li'an was made in the presence of the Messenger of Allah and 'Asim bin 'Adiyy said something about that, then he went away. A man from among his people came to him, complaining that he had found a man with his wife. 'Asim said: 'I was only put to this test because of what I said.' He took him to the Messenger of Allah and told him of the situation in which he found his wife. That man was pale and slim with straight hair, and the one whom he claimed to have found with his wife was dark and well-built. The Messenger of Allah said: 'O Allah, make it clear to me.' Then she gave birth to a child who resembled the one whom her husband said he had found with her. So the Messenger of Allah conducted the procedure of Li'an between them." A man in the gathering said to Ibn 'Abbas: "Was she the one of whom the Messenger of Allah said: 'If I were to have stoned anyone without evidence I would have stoned this one?'" Ibn 'Abbas said: "No, that was a woman who used to do mischief even after becoming Muslim."

Sahl bin Sa’ad Al Sa’idi said that ‘Uwaimir bin Ashqar Al Ajilani came to ‘Asim bin Adl and said to him “Asim tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). Ibn Shihab said “Then this became the method of invoking curses.” (Using translation from Abū Dāʾūd 2245)

أحمد:٢٢٨٥١قَرَأْتُ عَلَى عَبْدِ الرَّحْمَنِ مَالِكٍ عَنِ ابْنِ شِهَابٍ وَحَدَّثَنَا إِسْحَاقُ بْنُ عِيسَى أَخْبَرَنِي مَالِكٌ عَنِ ابْنِ شِهَابٍ أَنَّ سَهْلَ بْنَ سَعْدٍ أَخْبَرَهُ أَنَّ عُوَيْمِرًا الْعَجْلَانِيَّ جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ الْأَنْصَارِيِّ فَقَالَ

يَا عَاصِمُ أَرَأَيْتَ رَجلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ؟ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي عَنْ ذَلِكَ يَا عَاصِمُ رَسُولَ اللهِ ﷺ فَسَأَلَ عَاصِمٌ النَّبِيَّ ﷺ عَنْ ذَلِكَ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مِمَّا يَسْمَعُ قَالَ إِسْحَاقُ مَا سَمِعَ مِنْ رَسُولِ اللهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لكَ رَسُولُ اللهِ ﷺ؟ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَاأَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى النَّبِيَّ ﷺ وَسْطَ النَّاسِ فَقَالَ لِرَسُولِ اللهِ ﷺ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ قَدْ أَنْزَلَ اللهُ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَأْتِ بِهَا قَالَ سَهْلُ بْنُ سَعْدٍ فَتَلَاعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللهِ ﷺ فَلَمَّا فَرَغَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ

Yahya related to me from Malik from Ibn Shihab that Sahl ibn Sad as-Saidi told him that Uwaymir al-Ajlani came to Asim ibn Adi al- Ansari and said to him, "Asim! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself, or what should .he do? Asim! ask the Messenger of Allah ﷺ about that for me." Asim asked the Messenger of Allah ﷺ about it. The Messenger of Allah ﷺ was revolted by the questions and reproved them until what he heard from the Messenger of Allah ﷺ. was intolerable for Asim. When Asim returned to his people, Uwaymir came to him and said, " Asim! what did the Messenger of Allah ﷺ say to you?" Asim said to Uwaymir, "You didn't bring me any good. The Messenger of Allah ﷺ was revolted by the question which I asked him." Uwaymir said, "By Allah! I will not stop until I ask him about it!" Uwaymir stood up and went to the Messenger of Allah ﷺ in the middle of the people and said, "Messenger of Allah! What do you think a man who finds another man with his wife should do? Should he kill him and then be killed himself, or what should he do?" The Messenger of Allah ﷺ said, "Something has been sent down about you and your wife, so go and bring her." Sahl continued, "They mutually cursed one another in the presence of the Messenge ﷺ and I was present with the people. When they finished cursing each other, Uwaymir said, 'I shall have lied about her, Messenger of Allah, if I keep her,' and pronounced the divorce three times before the Messenger of Allah ﷺ ordered him to do it." Malik said that Ibn Shihab said, "That was how the sunna of a couple mutually cursing each other was established (lian)."

أَنَّ عُوَيْمِرًا الْعَجْلاَنِيَّ جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ الأَنْصَارِيِّ فَقَالَ لَهُ يَا عَاصِمُ أَرَأَيْتَ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ سَلْ لِي يَا عَاصِمُ عَنْ ذَلِكَ رَسُولَ اللَّهِ ﷺ فَسَأَلَ عَاصِمٌ رَسُولَ اللَّهِ ﷺ عَنْ ذَلِكَ فَكَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ ﷺ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللَّهِ ﷺ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللَّهِ لاَ أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ ﷺ وَسْطَ النَّاسِ فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ فَقَالَ رَسُولُ اللَّهِ ﷺ قَدْ أُنْزِلَ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَأْتِ بِهَا قَالَ سَهْلٌ فَتَلاَعَنَا وَأَنَا مَعَ النَّاسِ عِنْدَ رَسُولِ اللَّهِ ﷺ فَلَمَّا فَرَغَا مِنْ تَلاَعُنِهِمَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللَّهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلاَثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللَّهِ وَقَالَ مَالِكٌ قَالَ ابْنُ شِهَابٍ فَكَانَتْ تِلْكَ بَعْدُ سُنَّةَ الْمُتَلاَعِنَيْنِ

Sahl bin Sa’ad Al Sa’idi said that ‘Uwaimir bin Ashqar Al Ajilani came to ‘Asim bin Adl and said to him “Asim tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). 'Uwaimir came to ʿAsim bin ʿAdi who was the chief of Bani Ajlan and said, "What do you say about a man who has found another man with his wife? Should he kill him whereupon you would kill him (i.e. the husband), or what should he do? Please ask Messenger of Allah ﷺ about this matter on my behalf." ʿAsim then went to the Prophet ﷺ and said, "O Messenger of Allah ﷺ! (And asked him that question) but Messenger of Allah ﷺ disliked the question," When 'Uwaimir asked ʿAsim (about the Prophet's answer) ʿAsim replied that Messenger of Allah ﷺ disliked such questions and considered it shameful. "Uwaimir then said, "By Allah, I will not give up asking unless I ask Messenger of Allah ﷺ about it." Uwaimir came (to the Prophet ) and said, "O Messenger of Allah ﷺ! A man has found another man with his wife! Should he kill him whereupon you would kill him (the husband, in Qisas) or what should he do?" Messenger of Allah ﷺ said, "Allah has revealed regarding you and your wife's case in the Qur'an "So Messenger of Allah ﷺ ordered them to perform the measures of Mula'ana according to what Allah had mentioned in His Book. So 'Uwaimir did Mula'ana with her and said, "O Messenger of Allah ﷺ! If I kept her I would oppress her." So 'Uwaimir divorced her and so divorce became a tradition after them for those who happened to be involved in a case of Mula'ana. Messenger of Allah ﷺ then said, "Look! If she (Uwaimir's wife) delivers a black child with deep black large eyes, big hips and fat legs, then I will be of the opinion that 'Uwaimir has spoken the truth; but if she delivers a red child looking like a Wahra then we will consider that 'Uwaimir has told a lie against her." Later on she delivered a child carrying the qualities which Messenger of Allah ﷺ had mentioned as a proof for 'Uwaimir's claim; therefore the child was ascribed to its mother henceforth. Then Asim said, "O Messenger of Allah, if I confine her, I will be wronging her." He said, "Then divorce her, for that will be a Sunnah (example) for those who come after them among the cursed ones." The Messenger of Allah ﷺ said, "Look, if she gives birth to a child who resembles Asim, with thick calves, and gap between his teeth, I do not think that Umayr is telling the truth, but if she gives birth to a child who resembles Umayr, as if he was free, I do not think that Asim is telling the truth." Then she bore a child who resembled the Messenger of Allah ﷺ in the features that `Umayr had described, and it was said that he was the son of his mother.

Later on a man from his tribe came to him and told him that he had found another man with his wife. On that ʿAsim said, "I have not been put to task except for what I have said (about Lian)." ʿAsim took the man to Messenger of Allah ﷺ and he told him of the state in which he found his wife. The man was pale, thin and lank-haired, while the other man whom he had found with his wife was brown, fat with thick calves and curly hair. Messenger of Allah ﷺ said, "O Allah! Reveal the truth." Then the lady delivered a child resembling the man whom her husband had mentioned he had found with her. So Messenger of Allah ﷺ ordered them to carry out Lien. A man from that gathering said to Ibn ʿAbbas, "Was she the same lady regarding whom Messenger of Allah ﷺ said, 'If I were to stone to death someone without witnesses, I would have stoned this lady'?" Ibn ʿAbbas said, "No, that was another lady who, though being a Muslim, used to arouse suspicion because of her outright misbehavior." (Using translation from Bukhārī 5316)

التَّلَاعُنُ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ عَاصِمُ بْنُ عَدِيٍّ فِي ذَلِكَ قَوْلًا ثُمَّ انْصَرَفَ فَأَتَاهُ رَجُلٌ مِنْ قَوْمِهِ يَشْكُو إِلَيْهِ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَالَ عَاصِمٌ مَا ابْتُلِيتُ بِهَذَا إِلَّا لِقَوْلِي فَذَهَبَ بِهِ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَهُ بِالَّذِي وَجَدَ عَلَيْهِ امْرَأَتَهُ فَكَانَ ذَلِكَ الرَّجُلُ مُصْفَرًّا قَلِيلَ اللَّحْمِ سَبِطَ الشَّعْرَةِ وَكَانَ الَّذِي ادَّعَى عَلَيْهِ أَنَّهُ وَجَدَهُ عِنْدَ امْرَأَتِهِ آدَمَ خَدْلًا كَثِيرَ اللَّحْمِ فَقَالَ رَسُولُ اللهِ ﷺ «اللهُمَّ بَيِّنْ» فَوَضَعَتْ شَبِيهًا بِالرَّجُلِ الَّذِي ذَكَرَ زَوْجُهَا أَنَّهُ وَجَدَهُ عِنْدَهَا فَلَاعَنَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا فَقَالَ رَجُلٌ لِابْنِ عَبَّاسٍ فِي الْمَجْلِسِ هِيَ الَّتِي قَالَ رَسُولُ اللهِ ﷺ «لَوْ رَجَمْتُ أَحَدًا بِغَيْرِ بَيِّنَةٍ رَجَمْتُ هَذِهِ»؟ فَقَالَ ابْنُ عَبَّاسٍ لَا تِلْكَ امْرَأَةٌ كَانَتْ تُظْهِرُ السَّوءَ فِي الْإِسْلَامِ

Lian was mentioned in the presence of the Prophet, ʿAsim bin Adi said a statement about it, and when he left, a man from his tribe came to him complaining that he had seen a man with his wife. ʿAsim said, "I have been put to trial only because of my statement." So he took the man to the Prophet ﷺ and the man told him about the incident. The man (husband) was of yellow complexion, thin, and of lank hair, while the man whom he had accused of having been with his wife, was reddish brown with fat thick legs and fat body. The Prophet ﷺ said, "O Allah! Reveal the truth." Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn ʿAbbas in the gathering, "Was that the same lady about whom the Prophet ﷺ said, "If I were to stone any lady (for committing illegal sexual intercourse) to death without witnesses, I would have stoned that lade to death?" Ibn ʿAbbas said, "No, that was another lady who used to behave in such a suspicious way among the Muslims that one might accuse her of committing illegal sexual intercourse." Sahl bin Sa’ad Al Sa’idi said that ‘Uwaimir bin Ashqar Al Ajilani came to ‘Asim bin Adl and said to him “Asim tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act? Ask the Apostle of Allaah ﷺ ‘Asim, for me about it. ‘Asim then asked the Apostle of Allaah ﷺ about it. The Apostle of Allaah ﷺ disliked the question and denounced it. What ‘Asim heard from the Apostle of Allaah ﷺ fell heavy on him. When ‘Asim returned to his family ‘Uwaimr came to him and asked ‘Asim “What did the Apostle of Allaah ﷺ say to you”? Asim replied “You did not do good to me”. The Apostle of Allaah ﷺ disliked the question that I asked him. Thereupon ‘Uwaimir said “I swear by Allaah, I shall not leave until I ask him about it. So, ‘Uwaimir came to the Apostle of Allaah ﷺ while he was sitting in the midst of the people.” He said “Apostle of Allaah ﷺ tell me about a man who finds a man along with his wife. Should he kill him and then be killed by you, or how should he act?” The Apostle of Allaah ﷺ said “A revelation has been sent down about you and your wife so go away and bring her. Sahl said “So we cursed one another while I was along with the people who were with the Apostle of Allaah ﷺ. Then when they finished, ‘Umamir said “I shall have lied against her, Apostle of Allaah ﷺ if I keep her. He pronounced her divorce three times before the Apostle of Allaah ﷺcommanded him (to do so). أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ سَلْ لِي يَا عَاصِمُ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَسَأَلَ عَاصِمٌ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللهِ ﷺ فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللهِ ﷺ؟ فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِ بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللهِ الْمَسْأَلَةَ الَّتِي سَأَلْتُهُ عَنْهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَهُ عَنْهَا فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللهِ ﷺ وَسَطَ النَّاسِ فَقَالَ يَا رَسُولَ اللهِ أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَقَالَ النَّبِيُّ ﷺ قَدْ أَنْزَلَ اللهُ فِيكَ وَفِي صَاحِبَتِكَ فَاذْهَبْ فَائْتِ بِهَا فَقَالَ سَهْلُ بْنُ سَعْدٍ فَتَلَاعَنَا عِنْدَ رَسُولِ اللهِ ﷺ وَأَنَا مَعَ النَّاسِ فَلَمَّا فَرَغَا قَالَ عُوَيْمِرٌ كَذَبْتُ عَلَيْهَا يَا رَسُولَ اللهِ إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ رَسُولُ اللهِ ﷺ قَالَ ابْنُ شِهَابٍ فَكَانَتْ تِلْكَ سُنَّةَ الْمُتَلَاعِنَيْنِ 15311 وَأَخْبَرَنَا أَبُو نَصْرٍ مُحَمَّدُ بْنُ عَلِيِّ بْنِ مُحَمَّدٍ الشِّيرَازِيُّ الْفَقِيهُ نا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ نا يَحْيَى بْنُ مُحَمَّدٍ وَمُحَمَّدُ بْنُ نَصْرٍ وَجَعْفَرُ بْنُ مُحَمَّدٍ قَالُوا نا يَحْيَى بْنُ يَحْيَى قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنِ ابْنِ شِهَابٍ فَذَكَرَ الْحَدِيثَ بِنَحْوِهِ

Ibn Shihab informed me of Lian and the tradition related to it, referring to the narration of Sahl bin Saʿd, the brother of Bani Saʿidi He said, "An Ansari man came to Messenger of Allah ﷺ and said, 'O Allah's Apostle! If a man saw another man with his wife, should he kill him, or what should he do?' So Allah revealed concerning his affair what is mentioned in the Holy Qur'an about the affair of those involved in a case of Lian. The Prophet ﷺ said, 'Allah has given His verdict regarding you and your wife.' So they carried out Lian in the mosque while I was present there. When they had finished, the man said, "O Messenger of Allah ﷺ! If I should now keep her with me as a wife then I have told a lie about her. Then he divorced her thrice before Messenger of Allah ﷺ ordered him, when they had finished the Lian process. So he divorced her in front of the Prophet ﷺ ." Ibn Shihab added, "After their case, it became a tradition that a couple involved in a case of Lian should be separated by divorce. That lady was pregnant then, and later on her son was called by his mother's name. The tradition concerning their inheritance was that she would be his heir and he would inherit of her property the share Allah had prescribed for him." Ibn Shihab said that Sahl bin Saʿd As'Saidi said that the Prophet ﷺ said (in the above narration), "If that lady delivers a small red child like a lizard, then the lady has spoken the truth and the man was a liar, but if she delivers a child with black eyes and huge lips, then her husband has spoken the truth." Then she delivered it in the shape one would dislike (as it proved her guilty). (Using translation from Bukhārī 5309)

So the Messenger of Allah ﷺ said, "Allah has revealed the Quran concerning you and your companion. So the Messenger of Allah ﷺ commanded both of them to curse each other with what Allah mentioned in His Book." So he said, "So she cursed him." Then he said, "O Messenger of Allah, if I divorce her, I have wronged her." He said, "So he divorced her, and it was a Sunnah for those who came after them from among the cursing parties." Then the Messenger of Allah ﷺ said, "Be cautious, for if she comes with a child called As'ham, it should be attributed to her. It will darken the two eyes, make the legs skinny, and I do not think Uwaimir except that he will be speaking the truth about her. And if she comes with a child called Uhaymir, it will be as if he is a free-roaming bull and I do not think Uwaimir except that he will be lying about her." He said, "She came with him with a description similar to the one the Messenger of Allah ﷺ attributed to him due to Uwaimir's testimony." He said, "After that, he was traced back to his mother."

كَيْفَ تَقُولُ فِي رَجُلٍ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ قَالَ سَلْ لي رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ قَالَ فَأَتَى عَاصِمٌ النَّبِيَّ ﷺ فَقَالَ يَا رَسُولَ اللهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَكَرِهَ رَسُولُ اللهِ ﷺ الْمَسَائِلَ فَسَأَلَهُ عُوَيْمِرٌ فَقَالَ إِنَّ رَسُولَ اللهِ ﷺ قَدْ كَرِهَ الْمَسَائِلَ وَعَابَهَا فَقَالَ عُوَيْمِرٌ وَاللهِ لَا أَنْتَهِي حَتَّى أَسْأَلَ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ قَالَ فَجَاءَ عُوَيْمِرٌ فَقَالَ يَا رَسُولَ اللهِ رَجُلٌ وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَتَقْتُلُونَهُ أَمْ كَيْفَ يَصْنَعُ؟ فَقَالَ رَسُولُ اللهِ ﷺ قَدْ أَنْزَلَ اللهُ الْقُرْآنَ فِيكَ وَفِي صَاحِبَتِكَ فَأَمَرَهُمَا رَسُولُ اللهِ ﷺ بِالْمُلَاعَنَةِ بِمَا سَمَّى اللهُ فِي كِتَابِهِ قَالَ فَلَاعَنَهَا ثُمَّ قَالَ يَا رَسُولَ اللهِ إِنْ حَبَسْتُهَا فَقَدْ ظَلَمْتُهَا قَالَ فَطَلَّقَهَا وَكَانَتْ بَعْدُ سُنَّةً لِمَنْ كَانَ بَعْدَهُمَا مِنَ الْمُتَلَاعِنَيْنِ ثُمَّ قَالَ رَسُولُ اللهِ ﷺ أَبْصِرُوا فَإِنْ جَاءَتْ بِهِ أَسْحَمَ أَدْعَجَ الْعَيْنَيْنِ عَظِيمَ الْأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَلَا أَحْسَبُ عُوَيْمِرًا إِلَّا وقَدْ صَدَقَ عَلَيْهَا وَإِنْ جَاءَتْ بِهِ أُحَيْمِرَ كَأَنَّهُ وَحَرَةٌ فَلَا أَحْسَبُ عُوَيْمِرًا إِلَّا وَقَدْ كَذَبَ عَلَيْهَا قَالَ فَجَاءَتْ بِهِ عَلَى النَّعْتِ الَّذِي نَعَتَ رَسُولُ اللهِ ﷺ مِنْ تَصْدِيقِ عُوَيْمِرٍ قَالَ فَكَانَ يُنْسَبُ بَعْدَ ذَلِكَ لِأُمِّهِ

رَوَاهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ إِسْحَاقَ عَنْ مُحَمَّدِ بْنِ يُوسُفَ وَرَوَاهُ الْأَوْزَاعِيُّ عَنِ الزُّبَيْدِيِّ عَنِ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ فَذَكَرَ فِيهِ فَتَلَاعَنَا فَفَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَقَالَ لَا يَجْتَمِعَانِ أَبَدًا 15319 أَخْبَرَنَا أَبُو عَمْرٍو الْأَدِيبُ أنا أَبُو بَكْرٍ الْإِسْمَاعِيلِيُّ نا ابْنُ أَبِي حَسَّانَ مِنْ أَصْلِ كِتَابِهِ وَهُوَ إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ أَبِي حَسَّانَ نا عَبْدُ الرَّحْمَنِ بْنُ إِبْرَاهِيمَ نا الْوَلِيدُ هُوَ ابْنُ مُسْلِمٍ وَعُمَرُ بْنُ عَبْدِ الْوَاحِدِ قَالَا نا الْأَوْزَاعِيُّ عَنِ الزُّبَيْدِيِّ عَنِ الزُّهْرِيِّ عَنْ سَهْلِ بْنِ سَعْدٍ السَّاعِدِيِّ فَذَكَرَهُ وَلَمْ يَذْكُرْ فِيهِ قِصَّةَ الطَّلَاقِ وَمِنْهُمْ يُونُسُ بْنُ يَزِيدَ الْأَيْلِيُّ 15320 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنا إِسْمَاعِيلُ بْنُ أَحَمَدٍ التَّاجِرُ أنا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ قُتَيْبَةَ نا حَرْمَلَةُ بْنُ يَحْيَى نا ابْنُ وَهْبٍ أَخْبَرَنِي يُونُسُ عَنِ ابْنِ شِهَابٍ أَخْبَرَنِي سَهْلُ بْنُ سَعْدٍ الْأَنْصَارِيُّ أَنَّ عُوَيْمِرًا الْأَنْصَارِيَّ مِنْ بَنِي الْعَجْلَانِ أَتَى عَاصِمَ بْنَ عَدِيٍّ فَذَكَرَ الْحَدِيثَ بِمَعْنَى حَدِيثِ مَالِكٍ إِلَّا أَنَّهُ قَالَ فَلَمَّا فَرَغَا مِنْ تَلَاعُنِهِمَا قَالَ يَا رَسُولَ اللهِ كَذَبْتُ عَلَيْهَا إِنْ أَمْسَكْتُهَا فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأْمُرَهُ النَّبِيُّ ﷺ فَكَانَ فِرَاقُهُ إِيَّاهَا بَعْدُ سُنَّةً فِي الْمُتَلَاعِنَيْنِ قَالَ سَهْلٌ وَكَانَتْ حَامِلًا وَكَانَ ابْنُهَا يُدْعَى إِلَى أُمِّهِ ثُمَّ جَرَتِ السُّنَّةُ أَنَّهُ يَرِثُهَا وَتَرِثُ مِنْهُ مَا فَرَضَ اللهُ لَهَا رَوَاهُ مُسْلِمٌ فِي الصَّحِيحِ عَنْ حَرْمَلَةَ بْنِ يَحْيَى وَمِنْهُمْ فُلَيْحُ بْنُ سُلَيْمَانَ

[AI] A man came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, what do you think if a man finds another man with his wife, should he kill him and you kill her?" So Allah revealed concerning both of them what is mentioned in the Quran regarding the adulterous couple. The Messenger of Allah ﷺ said, "Allah has decided in your case and in the case of your wife." He said, "We curse each other and I am a witness before the Messenger of Allah ﷺ." The Prophet ﷺ said, "If you keep her, you have lied about her, so divorce her." The tradition among them was to separate between the two cursed individuals, and she was pregnant and denied her pregnancy. The Messenger of Allah ﷺ then said, "Her child will be called to her." Then the tradition regarding inheritance was implemented, that he would inherit her and she would inherit from him what Allah had ordained for her. Abu Ya'la said, "The matter was decided regarding him." He said, "He and al-Hasan." He said, "O Messenger of Allah, if I keep her and they testify, it will be a tradition between them and their speech will be about other than that."

"عَبْ: ثَنَا ابْنُ جُرَيْجٍ قَالَ: أَخْبَرَنِى ابْنُ شِهَابٍ، عَنْ سَهْلِ بْنِ سَعْدِ أَنَّ رَجُلًا مِنَ الأَنْصَارِ جَاءَ النَّبِىَّ ﷺ فَقَالَ: يَارَسُولَ الله، أَرَأَيْتَ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا أَيَقْتُلُهُ فَيَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ؟ فَأَنْزَلَ الله فِى شَأنِهِ مَا ذُكِرَ فِى الْقُرَآنِ فِى أَمْرِ الْمُتَلاَعنَيْنِ، فَقَالَ لَهُ رَسُولُ الله ﷺ ، قَدْ قَضَى الله فِيكَ وَفِى امْرَأَتِكَ، فَتَلاَعَنَا فِى الْمَسْجِدِ وَأَنَا شَاهِدٌ، فَلَمَّا فَرَغَ، قَالَ: كَذَبْتُ عَلَيْهَا يَارَسُولَ الله إِنْ أَمْسَكْتُهَا، فَطَلَّقَهَا ثَلَاثًا قَبْلَ أَنْ يَأمُرَهُ النَّبِىُّ ﷺ حِينَ فَرَغَا مِنَ التلاَعُنِ، فَفَارَقها عِنْدَ النَّبِىِّ ﷺ ، فَقَالَ النَّبِىُّ ﷺ ذَلِكَ التَّفْرِيقُ بَيْنَ كُلِّ مُتَلاَعِنَيْنِ، وَكَانَتْ حَامِلًا، فَأَنْكَرَهُ، فَكَانَ ابْنُهَا يُدْعَى

لأُمِّهِ، وَقَالَ النَّبِىُّ ﷺ : إِن جَاءَتْ بِهِ أُحَيْمِرَ قَضِيئًا () كَأَنَّهُ وَحَرَةٌ ( *) فَلاَ أَرَاهَا إِلاَّ صَدَقَتْ، وَكَذَبَ عَلَيْهَا، وَإِنْ جَاءَتْ بِهِ أَسْوَدَ ذَا أَلْيَتَيْنِ، فَلاَ أُرَاهُ إِلاَّ قَدْ صَدَقَ عَلَيْهَا، فَجَاءَتْ بِهِ عَلَى الْمَكْرُوهِ مِنْ ذَلِكَ، قَالَ ابْنُ جُرَيْجٍ: وَسَمِعْتُ عَبْدَ الله بْنَ عُبَيدِ بْنِ عُمَيْرٍ يَقُولُ: قِيلَ لِلنَّبِىِّ ﷺ : هُوَ هَذَا يَا رَسُولَ الله، هُوَ هَذَا، فَأَمَدَّهُ رَسُولُ الله ﷺ بِبَصَرِهِ حَتَّى رَأَيْنَا أَنَّهُ قَائِلٌ لَهُ شَيْئًا، فَلَمْ يَقُلْ لَهُ شَيْئًا، قَالَ ابْنُ جُرَيْجٍ: وَسَمِعْتُ مُحَمَّدَ بْنَ عَبَّادِ بْنِ جَعْفَرٍ يَقُولُ: قَالَ النَّبِىُّ ﷺ : لَمَّا تَلاَعَنَا، أَمَّا أَنْتُمَا فَقَدْ عَرَفْتُمَا أنِّى لاَ أَعْلَمُ الْغَيْبَ، وَقَالَ ابْنُ جُرَيجٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ عَنْ عَلِىٍّ قَالَ: لَمَّا كَانَ مِنْ شَأنِ الْمُتَلاَعِنَيْنِ عِنْدَ النَّبِىِّ ﷺ ، قَالَ: لاَ أُحِبُّ أَنْ أَكُونَ أَوَّلَ الأَرْبَعَةِ".
