٤١۔ كِتَابُ الرَّجْمِ ص ١
41.2 [Machine] Interpretation of the saying of Allah, Exalted is His glory: "And [they are] those who do not invoke with Allah another deity or kill the soul which Allah has forbidden [to be killed], except by right, and do not commit unlawful sexual intercourse. And whoever should do that will meet a penalty." [Al-Furqan: 68]
٤١۔٢ تَأْوِيلُ قَوْلِ اللهِ جَلَّ ثَنَاؤُهُ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ وَلَا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللهُ إِلَّا بِالْحَقِّ وَلَا يَزْنُونَ وَمَنْ يَفْعَلْ ذَلِكَ يَلْقَ أَثَامَا} [الفرقان: 68]
I asked the Prophet, "What is the greatest sin in the Sight of Allah?" He said, "That you set up a rival unto Allah though He Alone created you." I said, "That is indeed a great sin." Then asked, "What is next?" He said, "To kill your son lest he should share your food with you." I asked, "What is next?" He said, "To commit illegal sexual intercourse with the wife of your neighbor." (Using translation from Bukhārī 4477)
سَأَلْتُ رَسُولَ اللهِ ﷺ أَيُّ الذَّنْبِ أَعْظَمُ عِنْدَ اللهِ؟ قَالَ «أَنْ تَجْعَلَ لِلَّهِ نِدًّا وَهُوَ خَلَقَكَ» قُلْتُ إِنَّ ذَلِكَ لَعَظِيمٌ قُلْتُ ثُمَّ أَيُّ؟ قَالَ «ثُمَّ تَقْتُلُ وَلَدَكَ تَخَافُ أَنْ يَطْعَمَ مَعَكَ» قُلْتُ ثُمَّ أَيُّ؟ قَالَ «أَنْ تُزَانِيَ حَلِيلَةَ جَارِكَ»
[Machine] Abdullah said, "I asked the Messenger of Allah, ﷺ , 'O Messenger of Allah, which sin is the greatest?' He said, 'To associate partners with Allah while He has created you.' I asked, 'Then what?' He said, 'To kill your child out of fear of poverty.' I asked, 'Then what?' He said, 'To commit adultery with your neighbor's wife.' Then he recited this verse, 'And those who do not invoke with Allah another deity or kill the soul which Allah has forbidden [to be killed], except by right, and do not commit unlawful sexual intercourse. And whoever should do that will meet a penalty.' (Quran 25:68)"
قَالَ عَبْدُ اللهِ سَأَلْتُ رَسُولَ اللهِ ﷺ قُلْتُ يَا رَسُولَ اللهِ أَيُّ ذَنْبٍ أَعْظَمُ؟ قَالَ «أَنْ تَجْعَلَ لِلَّهِ نِدًّا وَهُوَ خَلَقَكَ» قُلْتُ ثُمَّ أَيُّ؟ قَالَ «أَنْ تَقْتُلَ وَلَدَكَ مِنْ أَجْلِ أَنْ يَطْعَمَ مَعَكَ» قُلْتُ ثُمَّ أَيُّ؟ قَالَ «أَنْ تُزَانِيَ حَلِيلَةَ جَارِكَ» ثُمَّ قَرَأَ هَذِهِ الْآيَةَ {وَالَّذِينَ لَا يَدْعُونَ مَعَ اللهِ إِلَهًا آخَرَ} [الفرقان 68] إِلَى قَوْلِهِ {يَلْقَ أَثَامًا} [الفرقان 68]
The Prophet ﷺ said, "When an adulterer commits illegal sexual intercourse, then he is not a believer at the time, he is doing it, and when a drinker of an alcoholic liquor drinks it, then he is not a believer at the time of drinking it, and when a thief steals, then he is not a believer at the time of stealing, and when a robber robs, and the people look at him, then he is not a believer at the time of doing robbery. قَالَ رَسُولُ اللهِ ﷺ «لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ يَرْفَعُ الْمُؤْمِنُونَ إِلَيْهِ فِيهَا أَبْصَارَهُمْ وَهُوَ حِينَ يَنْتَهِبُهَا مُؤْمِنٌ»

أَنَّ النَّبِيَّ ﷺ قَالَ «لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ وَهُوَ حِينَ يَشْرَبُهَا مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ يَرْفَعُ الْمُؤْمِنُونَ إِلَيْهِ أَبْصَارَهُمْ وَهُوَ حِينَ يَنْتَهِبُهَا مُؤْمِنٌ»

قَالَ رَسُولُ اللهِ ﷺ «لَا يَزْنِي الزَّانِي وَهُوَ حِينَ يَزْنِي مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ وَهُوَ حِينَ يَسْرِقُ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ وَهُوَ حِينَ يَشْرَبُهَا مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً يَرْفَعُ النَّاسُ فِيهَا أَبْصَارَهُمْ وَهُوَ حِينَ يَنْتَهِبُهَا مُؤْمِنٌ»
"No one who commits Zina is a believer at the moment when he is committing Zina; no one who steals is a believe at the moment when he is stealing; no one who drinks wine is a believer at the moment when he is drinking it; and no robber is a believer at the moment when he is robbing and the people are looking on. (Using translation from Nasāʾī 4870)
عَنِ النَّبِيِّ ﷺ قَالَ «لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً ذَاتَ شَرَفٍ يَرْفَعُ الْمُسْلِمُونَ إِلَيْهَا أَبْصَارَهُمْ وَهُوَ حِينَ يَنْتَهِبُهَا مُؤْمِنٌ»

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ شَارِبُهَا حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَنْتَهِبُ نُهْبَةً يَرْفَعُ النَّاسُ إِلَيْهِ فِيهَا أَبْصَارَهُمْ حِينَ يَنْتَهِبُهَا وَهُوَ مُؤْمِنٌ» 7094 أَخْبَرَنَا عِيسَى بْنُ حَمَّادٍ قَالَ أَخْبَرَنَا اللَّيْثُ عَنْ عَقِيلٍ عَنِ ابْنِ شِهَابٍ عَنْ سَعِيدٍ وَأَبِي سَلَمَةَ عَنْ أَبِي هُرَيْرَةَ عَنْ رَسُولِ اللهِ ﷺ مِثْلَ حَدِيثِ أَبِي بَكْرٍ هَذَا إِلَّا النُّهْبَةَ
When one commits fornication, one is not a believer ; when one steals, one is not a believer ; when one drinks, one is not a believer ; and repentance is placed before him. (Using translation from Abū Dāʾūd 4689)
«لَا يَزْنِي الزَّانِي حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ حِينَ يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ»
[Machine] The Messenger of Allah ﷺ said, "A believer does not commit adultery while he is a believer, nor does a thief steal while he is a believer, nor does a believer drink alcohol."
قَالَ رَسُولُ اللهِ ﷺ «لَا يَزْنِي الزَّانِي وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ السَّارِقُ وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ وَهُوَ مُؤْمِنٌ»
Messenger of Allah ﷺs said, "When a slave (of Allah) commits illegal sexual intercourse, he is not a believer at the time of committing it; and if he steals, he is not a believer at the time of stealing; and if he drinks an alcoholic drink, when he is not a believer at the time of drinking it; and he is not a believer when he commits a murder," 'Ikrima said: I asked Ibn Abbas, "How is faith taken away from him?" He said, Like this," by clasping his hands and then separating them, and added, "But if he repents, faith returns to him like this, by clasping his hands again. (Using translation from Bukhārī 6809)
قَالَ رَسُولُ اللهِ ﷺ «لَا يَزْنِي الْعَبْدُ حِينَ يَزْنِي وَهُوَ مُؤْمِنٌ وَلَا يَشْرَبُ الْخَمْرَ حِينَ يَشْرَبُهَا وَهُوَ مُؤْمِنٌ وَلَا يَسْرِقُ وَهُوَ مُؤْمِنٌ وَلَا يَقْتُلُ وَهُوَ مُؤْمِنٌ» فَقُلْتُ لِابْنِ عَبَّاسَ كَيْفَ يُنْتَزَعُ الْإِيمَانُ مِنْهُ؟ فَشَبَّكَ أَصَابِعَهُ ثُمَّ أَخْرَجَهَا فَقَالَ هَكَذَا فَإِذَا تَابَ عَادَ إِلَيْهِ هَكَذَا وَشَبَّكَ أَصَابِعَهَ
[Machine] The Messenger of Allah ﷺ said, "Allah loves three and disapproves of three. He disapproves of the arrogant, the miserly, and the old adulterer."
قَالَ رَسُولُ اللهِ ﷺ «يُحِبُّ اللهُ ثَلَاثَةً وَيَبْغَضُ ثَلَاثَةً يَبْغَضُ الْمُخْتَالَ الْمُقِلَّ وَالْبَخِيلَ الْمُسْتَكْثِرَ وَالشَّيْخَ الزَّانِي»
[Machine] On the authority of the Prophet, ﷺ , he said, "There are three whom Allah loves and three whom Allah dislikes. The three whom Allah dislikes are the elderly adulterer, the arrogant poor person, and the rich oppressor."
عَنِ النَّبِيِّ ﷺ قَالَ «ثَلَاثَةٌ يُحِبُّهُمُ اللهُ وَثَلَاثَةٌ يُبْغِضُهُمُ اللهُ الثَّلَاثَةُ الَّذِينَ يُبْغِضُهُمُ اللهُ الشَّيْخُ الزَّانِي وَالْفَقِيرُ الْمُخْتَالُ وَالْغَنِيُّ الظَّلُومُ»
[Machine] The Messenger of Allah ﷺ said, "There are three types of people whom Allah will not look at on the Day of Judgment, nor purify them, and they will have a painful punishment: an adulterous old man, a lying religious leader, and a proud nobleman." And Muhammad ibn al-Ala' said in his narration, "an adulterous old man, a deceitful king, and an arrogant nobleman."
قَالَ رَسُولُ اللهِ ﷺ «ثَلَاثَةٌ لَا يَنْظُرُ اللهُ إِلَيْهِمْ يَوْمَ الْقِيَامَةِ وَلَا يُزَكِّيهِمْ وَلَهُمْ عَذَابٌ أَلِيمٌ الشَّيْخُ الزَّانِي وَالْإِمَامُ الْكَذَّابُ وَالْعَائِلُ الْمُخْتَالُ» وَقَالَ مُحَمَّدُ بْنُ الْعَلَاءِ فِي حَدِيثِهِ شَيْخٌ زَانٍ وَمَلِكٌ كَذَّابٌ وَعَائِلٌ مُسْتَكْبِرٌ
"There are four whom Allah, the Mighty and Sublime, hates: The vendor who sells his wares by means of false oaths, the poor man who shows off, the old man who commits Zina and the Imam who is unjust." (Using translation from Nasāʾī 2576)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «أَرْبَعَةٌ يُبْغِضُهُمُ اللهُ الْبَيَّاعُ الْحَلَّافُ وَالْفَقِيرُ الْمُخْتَالُ وَالشَّيْخُ الزَّانِي وَالْإِمَامُ الْجَائِرُ»
41.3 [Machine] The punishment for adultery of the married.
٤١۔٣ عُقُوبَةُ الزَّانِي الثَّيِّبِ
A freed slave woman of Sa’eed bin Qais, who was married and had committed an immoral action, was brought to ʿAli, he gave her one hundred lashes then he stoned her. Then he said: I flogged her in accordance with the Book of Allah and I stoned her in accordance with the Sunnah of the Messenger of Allah ﷺ. (Using translation from Aḥmad 942)
«جَلَدْتُكِ بِكِتَابِ اللهِ وَرَجَمْتُكِ بِسُنَّةِ رَسُولِ اللهِ ﷺ»
[Machine] And he said, "I will punish you with the Book of Allah and stone you according to the tradition of the Messenger of Allah ﷺ."
وَقَالَ «أَجْلِدُكِ بِكِتَابِ اللهِ وَأَرْجُمُكِ بِسُنَّةِ رَسُولِ اللهِ ﷺ»
Receive my teachings, receive my teachings. Allah has appointed a way for those women. If the parties have been married, they shall receive a hundred lashes and stoned to death. If the parties are unmarried, they shall receive a hundred lashes and banished for a year. (Using translation from Abū Dāʾūd 4415)
قَالَ رَسُولُ اللهِ ﷺ «خُذُوا عَنِّي قَدْ جَعَلَ اللهُ لَهُنَّ سَبِيلًا الثَّيِّبُ بِالثَّيِّبِ جَلْدُ مِائَةٍ وَرَجْمٌ بِالْحِجَارَةِ وَالْبِكْرُ بِالْبِكْرِ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ»
Take from me. Verily Allah has ordained a way for them (the women who commit fornication),: (When) a married man (commits adultery) with a married woman, and an unmarried male with an unmarried woman, then in case of married (persons) there is (a punishment) of one hundred lashes and then stoning (to death). And in case of unmarried persons, (the punishment) is one hundred lashes and exile for one year. (Using translation from Muslim 1690c)
كَانَ رَسُولُ اللهِ ﷺ إِذَا نُزِّلَ عَلَيْهِ كَرِبَ لِذَلِكَ وَتَرَبَّدَ لَهُ وَجْهُهُ فَنُزِّلَ عَلَيْهِ ذَاتَ يَوْمٍ فَلَقِيَ ذَلِكَ فَلَمَّا سُرِّيَ عَنْهُ قَالَ «خُذُوا عَنِّي قَدْ جَعَلَ اللهُ لَهُنَّ سَبِيلًا الْبِكْرُ بِالْبِكْرِ جَلْدِ مِائَةٍ وَنَفْيُ سَنَةٍ وَالثَّيِّبُ بِالثَّيِّبِ جَلْدُ مِائَةٍ وَالرَّجْمُ»
Messenger of Allah ﷺ as saying: Receive (teaching) from me, receive (teaching) from me. Allah has ordained a way for those (women). When an unmarried male commits adultery with an unmarried female (they should receive) one hundred lashes and banishment for one year. And in case of married male committing adultery with a married female, they shall receive one hundred lashes and be stoned to death. (Using translation from Muslim 1690a)
قَالَ رَسُولُ اللهِ ﷺ «خُذُوا عَنِّي قَدْ جَعَلَ اللهُ لَهُنَّ سَبِيلًا الثَّيِّبُ بِالثَّيِّبِ جُلْدِ مِائَةٍ وَالرَّجْمُ وَالْبِكْرُ بِالْبِكْرِ جَلْدُ مِائَةٍ وَنَفْيُ سَنَةٍ»
41.4 [Machine] Copying Leather from Clothing
٤١۔٤ نَسْخُ الْجَلْدِ عَنِ الثَّيِّبِ
[Machine] I heard the Messenger of Allah ﷺ say, "When an old man and an old woman commit adultery, stone them to death." 'Umar said, "When this verse was revealed, I went to the Messenger of Allah ﷺ and said, 'Write it for me.' Shu'bah said, 'It seems that he disliked that.' 'Umar said, 'Don't you see that an old man, if he does not marry, he is whipped, and if a young man commits adultery after having been married, he is stoned to death?'"
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا أَلْبَتَّةَ» قَالَ عُمَرُ لَمَّا أُنْزِلَتْ أَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ أَكْتِبْنِيهَا قَالَ شُعْبَةُ كَأَنَّهُ كَرِهَ ذَلِكَ فَقَالَ عُمَرُ أَلَا تَرَى أَنَّ الشَّيْخَ إِذَا لَمْ يُحْصَنْ جُلِدَ وَأَنَّ الشَّابَّ إِذَا زَنَا وَقَدْ أُحْصِنَ رُجِمَ؟
she said, the Messenger of Allāh ﷺ recited the Āyah of Stoning to us: "al-shaykhu wa-al-shaykhah idhā zanayā fārjumūhumā al-battata bimā qaḍayā min al-ladhhah (The ˹married˺ man and a woman, if they commit adultery, then absolutely stone them for what they spent in ˹seeking˺ pleasure.)" لَقَدْ أَقَرَأَنَاهَا رَسُولُ اللهِ ﷺ آيَةَ الرَّجْمِ «الشَّيْخُ وَالشَّيْخَةُ فَارْجُمُوهُمَا أَلْبَتَّةَ بِمَا قَضَيَا مِنَ اللَّذَّةِ»
she said, the Messenger of Allāh ﷺ recited the Āyah of Stoning to us: "al-shaykhu wa-al-shaykhah idhā zanayā fārjumūhumā al-battata bimā qaḍayā min al-ladhhah (The ˹married˺ man and a woman, if they commit adultery, then absolutely stone them for what they spent in ˹seeking˺ pleasure.)" لَقَدْ أَقْرَأَنَا رَسُولُ اللهِ ﷺ آيَةَ الرَّجْمِ «الشَّيْخُ وَالشَّيْخَةُ فَارْجُمُوهُمَا أَلْبَتَّةَ بِمَا قَضَيَا مِنَ اللَّذَّةِ»
[Machine] I will go to the Messenger of Allah ﷺ , if Allah wills, and mention this and that. When he mentions the verse of stoning, I say, "O Messenger of Allah, write down the verse of stoning for me." He said, "I cannot."
أَذْهَبُ إِلَى رَسُولِ اللهِ ﷺ إِنْ شَاءَ اللهُ فَأَذْكُرُ كَذَا وَكَذَا فَإِذَا ذَكَرَ أَيَّةَ الرَّجْمِ فَأَقُولُ يَا رَسُولَ اللهِ أَكْتِبْنِي آيَةَ الرَّجْمِ قَالَ فَأَتَاهُ فَذَكَرَ ذَلِكَ لَهُ فَذَكَرَ آيَةَ الرَّجْمِ فَقَالَ يَا رَسُولَ اللهِ أَكْتِبْنِي آيَةَ الرَّجْمِ قَالَ «لَا أَسْتَطِيعُ»
[Machine] Ubayy ibn Ka'b said, "They are whipped and stoned, and they are stoned and not whipped, and they are whipped and not stoned." Qatadah, the knowledgeable sheikh, explained it as follows: When a married person commits adultery, they are whipped and then stoned. When an unmarried person commits adultery, they are stoned. And when an unmarried person who has not been chaste commits adultery, they are whipped.
قَالَ أُبَيُّ بْنُ كَعْبٍ «يُجْلَدُونَ وَيُرْجَمُونَ وَيُرْجَمُونَ وَلَا يُجْلَدُونَ وَيُجْلَدُونَ وَلَا يُرْجَمُونَ» فَفَسَّرَهُ قَتَادَةُ الشَّيْخُ الْمُحْصَنُ إِذَا زَنَا يُجْلَدُ ثُمَّ يُرْجَمُ وَالشَّابُّ الْمُحْصَنُ يُرْجَمُ إِذَا زَنَا وَالشَّابُّ الَّذِي لَمْ يُحْصَنْ يُجْلَدْ
[Machine] Ubayy said, "She used to recite Surah Al-Baqarah and it was the longest. And indeed, it contained the verse of stoning." The sheikh and the sheikha stoned them both as a punishment from Allah. And Allah is powerful and wise.
أُبَيٌّ «كَانَتْ لَتَعْدِلُ سُورَةَ الْبَقَرَةِ وَأَطْوَلَ وَلَقَدْ كَانَ فِيهَا آيَةُ الرَّجْمِ» الشَّيْخُ وَالشَّيْخَةُ فَارْجُمُوهُمَا أَلْبَتَّةَ نَكَالًا مِنَ اللهِ وَاللهُ عَزِيزٌ حَكِيمٌ
41.5 [Machine] Stoning Execution
٤١۔٥ تَثْبِيتُ الرَّجْمِ
[Machine] That some people say that the caliphate of Abu Bakr was a mistake, but Allah protected it from harm. And there is no caliphate except by consultation. And whoever pledges allegiance to someone without consultation, he shall not be obeyed. It is not a surprise if they are both killed. Shu'bah said: I asked Sa'd, "Why would it be a surprise if they are killed?" He said: Their punishment is that neither of them shall be obeyed. And they say, "And stoning [to death] was done by the Messenger of Allah ﷺ and we stoned [people], and Allah revealed in His book: 'If it was not that the people would say, 'He has added to the Book of Allah,' I would have written it with my own hand until its truth is established in the Book.'
أَنَّ أُنَاسًا يَقُولُونَ إِنَّ خِلَافَةَ أَبِي بَكْرٍ كَانَتْ فَلْتَةً وَلَكِنْ وَقَى اللهُ شَرَّهَا وَإِنَّهُ لَا خِلَافَةَ إِلَّا عَنْ مَشُورَةٍ وَأَيُّمَا رَجُلٍ بَايَعَ رَجُلًا عَنْ غَيْرِ مَشُورَةٍ لَا يُؤَمَّرُ وَاحِدٌ مِنْهُمَا تَغِرَّةً أَنْ يُقْتَلَا قَالَ شُعْبَةُ قُلْتُ لِسَعْدٍ مَا تَغِرَّةً أَنْ يُقْتَلَا؟ قَالَ عُقُوبَتُهُمَا أَنْ لَا يُؤْمَرَ وَاحِدٌ مِنْهُمَا وَيَقُولُونَ وَالرَّجْمُ وَقَدْ رَجَمَ بِهِ رَسُولُ اللهِ ﷺ وَرَجَمْنَا وَأَنْزَلَ اللهُ فِي كِتَابِهِ وَلَوْلَا أَنَّ النَّاسَ يَقُولُونَ زَادَ فِي كِتَابِ اللهِ لَكَتَبْتُهُ بِخَطِّي حَتَّى الْحِقَهُ بِالْكِتَابِ
[Machine] The Messenger of Allah ﷺ has been stoned, and we stoned after him.
«إِنَّ رَسُولَ اللهِ ﷺ قَدْ رَجَمَ وَرَجَمْنَا بَعْدَهُ»
[Machine] In his speech, he said, "Verily, the Messenger of Allah ﷺ stoned, and we stoned after him."
فِي خُطْبَتِهِ «أَلَا إِنَّ رَسُولَ اللهِ ﷺ رَجَمَ وَرَجَمْنَا بَعْدَهُ»
[Machine] "He gathered the common folk and their followers around him. So, delay that until the people come to the city," he said. "When I arrived in the city, I approached the minbar (pulpit) and heard him saying, 'I have come to know that some people claim that Abu Bakr's caliphate was a sudden event, but Allah has protected it. There is no caliphate except through consultation, and no one should be ordered to kill either of them (referring to Abu Bakr and Umar). And there are people who ask, 'What about stoning? Isn't it only mentioned in the Book of Allah?' The Messenger of Allah, ﷺ , stoned and we also stoned after him. If they were not to say, 'What is not mentioned in the Book of Allah is not established,' I would establish it as it was revealed.'" Abd Allah bin Muhammad bin Ishaq al-Adrami narrated to me that Ghundar narrated to us that Shu'bah narrated from Sa'd bin Ibrahim that he heard Ubayd Allah bin Abd Allah bin Utbah narrating from Ibn Abbas, from Abd al-Rahman bin Auf, who said, "Umar ibn al-Khattab performed Hajj and intended to address the people. Abd al-Rahman said, 'The common people have gathered, so delay it until they come.'"
أَنَّهُ قَدِ اجْتَمَعَ عِنْدَكَ رَعَاعُ النَّاسِ وَسِفْلَتُهُمْ فَأَخِّرْ ذَلِكَ حَتَّى تَأْتِيَ الْمَدِينَةَ قَالَ فَلَمَّا قَدِمَ الْمَدِينَةَ دَنَوْتُ قَرِيبًا مِنَ الْمِنْبَرِ فَسَمِعْتُهُ يَقُولُ إِنِّي قَدْ عَرَفْتُ أَنَّ نَاسًا يَقُولُونَ إِنَّ خِلَافَةَ أَبِي بَكْرٍ كَانَتْ فَلْتَةً وَإِنَّ اللهَ وَقَى شَرَّهَا إِنَّهُ لَا خِلَافَةَ إِلَّا عَنْ مَشُورَةٍ فَلَا يُؤَمَّرُ وَاحِدٌ مِنْهُمَا تَغِرَّةَ أَنْ يُقْتَلَا وَأَنَّ نَاسًا يَقُولُونَ مَا بَالُ الرَّجْمِ وَإِنَّمَا فِي كِتَابِ اللهِ الْجَلْدُ؟ وَقَدْ رَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمْنَا بَعْدَهُ وَلَوْلَا أَنْ يَقُولُوا «أَثْبَتَ فِي كِتَابِ اللهِ مَا لَيْسَ فِيهِ لَأَثْبَتُّهَا كَمَا أُنْزِلَتْ» 7117 أَخْبَرَنِي عَبْدُ اللهِ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ الْأَذْرَمِيُّ قَالَ حَدَّثَنَا غُنْدَرٌ قَالَ حَدَّثَنَا شُعْبَةُ عَنْ سَعْدِ بْنِ إِبْرَاهِيمَ قَالَ سَمِعْتُ عُبَيْدَ اللهِ بْنَ عَبْدِ اللهِ بْنِ عُتْبَةَ يُحَدِّثُ عَنِ ابْنِ عَبَّاسٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ قَالَ حَجَّ عُمَرُ بْنُ الْخَطَّابِ فَأَرَادَ أَنْ يَخْطُبَ النَّاسَ فَقَالَ عَبْدُ الرَّحْمَنِ إِنَّهُ قَدِ اجْتَمَعَ رِعَاعُ النَّاسِ فَأَخِّرْ ذَلِكَ نَحْوَهُ
[Machine] That people's time should pass until someone says, "We do not find stoning in the Book of Allah," and they stray by neglecting a duty that Allah has revealed. Verily, stoning is a punishment for those who commit adultery while being married, and evidence has been mentioned through a pregnancy, confession, or testimony. We have also read that if the sheikh and the sheikha commit adultery, then stone them to death. The Messenger of Allah ﷺ stoned, and we have stoned after him. Abu Abdulrahman said, "I do not know of anyone who mentioned the sheikh and the sheikha being stoned to death except for Sufyan, and it is likely that he was mistaken. And Allah knows best."
أَنْ يَطُولَ بِالنَّاسِ زَمَانٌ حَتَّى يَقُولَ قَائِلٌ مَا نَجِدُ الرَّجْمَ فِي كِتَابِ اللهِ فَيَضِلُّوا بِتَرْكِ فَرِيضَةٍ أَنْزَلَهَا اللهُ أَلَا وَإِنَّ الرَّجْمَ حَقٌّ عَلَى مَنْ زَنَا إِذَا أُحْصِنَ وَكَانَتِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ وَقَدْ قَرَأْنَاهَا الشَّيْخُ وَالشَّيْخَةُ إِذَا زَنَيَا فَارْجُمُوهُمَا أَلْبَتَّةَ وَقَدْ رَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمْنَا بَعْدَهُ قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا أَعْلَمُ أَنَّ أَحَدًا ذَكَرَ فِي هَذَا الْحَدِيثِ الشَّيْخُ وَالشَّيْخَةُ فَارْجُمُوهُمَا أَلْبَتَّةَ غَيْرَ سُفْيَانَ وَيَنْبَغِي أَنْ يَكُونَ وَهِمَ وَاللهُ أَعْلَمُ
ʿUmar said: Allah, may He be exalted, sent Muhammad ﷺ and sent down the Book to him. Among that which was revealed to him was the verse of stoning. We recited it and understood it. But I fear that with the passage of time, some people will say: We do not find the verse of stoning in the Book of Allah, and as a result an obligation that Allah revealed will be forsaken. Stoning is the due punishment in the Book of Allah for those who commit zina, both men and women, if they have been married and if proof is established, or there is a pregnancy or a confession. إِنَّ اللهَ بَعَثَ مُحَمَّدًا ﷺ وَأَنْزَلَ عَلَيْهِ الْكِتَابَ فَكَانَ فِيمَا أُنْزِلَ عَلَيْهِ آيَةُ الرَّجْمِ فَقَرَأْنَاهَا وَوَعَيْنَاهَا وَرَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمْنَا بَعْدَهُ وَأَخْشَى إِنْ طَالَ بِالنَّاسِ زَمَانٌ أَنْ يَقُولَ قَائِلٌ «مَا نَجِدُ آيَةَ الرَّجْمِ فِي كِتَابِ اللهِ فَيَتْرُكَ فَرِيضَةً أَنْزَلَهَا اللهُ وَإِنَّ الرَّجْمَ فِي كِتَابِ اللهِ حَقٌّ عَلَى مَنْ زَنَا إِذَا أُحْصِنَ مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا قَامَتْ عَلَيْهِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ»
Verily Allah sent Muhammad ﷺ with truth and He sent down the Book upon him, and the verse of stoning was included in what was sent down to him. We recited it, retained it in our memory and understood it. Messenger of Allah ﷺ awarded the punishment of stoning to death (to the married adulterer and adulteress) and, after him, we also awarded the punishment of stoning, I am afraid that with the lapse of time, the people (may forget it) and may say: We do not find the punishment of stoning in the Book of Allah, and thus go astray by abandoning this duty prescribed by Allah. Stoning is a duty laid down in Allah's Book for married men and women who commit adultery when proof is established, or it there is pregnancy, or a confession. (Using translation from Muslim 1691a)

[Machine] Omar, I am staying the night if God wills. I am warning them against those people who oppress them in their affairs," said Abdulrahman. So I said, "Oh Amir al-Mu'minin, do not do that on this day. The season gathers the masses and their chaos. I fear that you might say something that they would take and fly off with, and not put it in its proper place. Wait until you enter the city, as it is the abode of migration, Sunnah, and faith. Purify yourself with the scholars and their leaders. Say what you want to say in a way that they understand it and put it in its proper place," said Omar. "If I enter the city safely, I will speak to the people there in the first gathering I establish, if God wills," he added. According to Ibn Abbas, when I arrived at the city, I migrated to Jumaa and found Sa'id ibn Zayd had already proceeded me in migration. He sat next to the pulpit and I sat next to him. Omar did not ascend the pulpit, so I ascended it and performed the prayer of witness and praised Allah for what He deserves. Then he said, "As for what follows, I will say something to you which I do not know if it will remain with you until my death. Whoever understands it and preserves it, let him speak it wherever his journey ends. And whoever fears that he will not understand it, then it is not allowed for anyone to accuse me of lying. Indeed, Allah sent Muhammad ﷺ with the truth and revealed the book to him. In what was revealed to him was the verse of stoning, so we recited it and the Messenger of Allah ﷺ carried it out, and we carried it out after him. I fear that if a long time passes, someone might say, ‘We do not find the stoning in the book of Allah,’ and they will go astray by abandoning an obligation that Allah has revealed. Indeed, stoning is prescribed in the book of Allah for the one who committed adultery, if he is married, be it from the males or females, when clear evidence is established or if a confession is made."
عُمَرُ إِنِّي قَائِمٌ الْعَشِيَّةَ إِنْ شَاءَ اللهُ فَمُحَذِّرُهُمْ هَؤُلَاءِ النَّفَرَ الَّذِينَ يَغْصِبُونَهُمْ أَمْرَهُمْ قَالَ عَبْدُ الرَّحْمَنِ فَقُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ لَا تَفْعَلْ ذَلِكَ يَوْمَكَ هَذَا فَإِنَّ الْمَوْسِمَ يَجْمَعُ رَعَاعَ النَّاسِ وَغَوْغَاءَهُمْ فَأَخْشَى أَنْ تَقُولَ مَقَالَةً يُطَّيَّرُونَ بِهَا كُلَّ مُطِّيَّرٍ وَلَا يَضَعُونَهَا عَلَى مَوْضِعَهَا أَمْهِلْ حَتَّى تَقْدِمَ الْمَدِينَةَ فَإِنَّهَا دَارُ الْهِجْرَةِ وَالسُّنَّةِ وَالْإِيمَانِ فَتَخْلُصُ بِفُقَهَاءِ النَّاسِ وَأَشْرَافِهِمْ تَقُولُ مَا قُلْتَ مُتَمَكِّنًا فَيَفْهَمُونَ مَقَالَتَكَ وَيَضَعُونَهَا عَلَى مَوَاضِعِهَا قَالَ عُمَرُ لَئِنْ قَدِمَتُ الْمَدِينَةَ صَالِحًا لَأُكَلِّمَنَّ النَّاسَ بِهَا فِي أَوَّلِ مَقَامٍ أَقُومُهُ إِنْ شَاءَ اللهُ قَالَ ابْنُ عَبَّاسٍ فَلَمَّا قَدِمَتُ الْمَدِينَةَ هَجَّرْتُ إِلَى الْجُمُعَةِ فَوَجَدْتُ سَعِيدَ بْنَ زَيْدٍ قَدْ سَبَقَنِي بِالتَّهْجِيرِ فَجَلَسَ إِلَى جَنْبِ الْمِنْبَرِ فَجَلَسْتُ إِلَى جَنْبِهِ فَلَمْ يَنْشَبْ عُمَرُ أَنْ خَرَجَ فَجَلَسَ عَلَى الْمِنْبَرِ فَتَشَهَّدَ فَأَثْنَى عَلَى اللهِ بِمَا هُوَ أَهْلُهُ ثُمَّ قَالَ أَمَّا بَعْدُ فَإِنِّي قَائِلٌ لَكُمْ مَقَالَةً لَا أَدْرِي لَعَلَّهَا بَيْنَ يَدَيْ أَجَلِي فَمَنْ عَقِلَهَا وَوَعَاهَا فَلْيُحَدِّثْ بِهَا حَيْثُ تَنْتَهِي بِهِ رَاحِلَتُهُ وَمَنْ خَشِيَ أَنْ لَا يُعِيَهَا فَلَا أُحِلُّ لِأَحَدٍ أَنْ يَكْذِبَ عَلَيَّ إِنَّ اللهَ بَعَثَ مُحَمَّدًا ﷺ بِالْحَقِّ وَأَنْزَلَ عَلَيْهِ الْكِتَابَ فَكَانَ فِيمَا أَنْزَلَ عَلَيْهِ آيَةُ الرَّجْمِ فَقَرَأْنَاهَا وَرَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمْنَا بَعْدَهُ فَأَخْشَى إِنْ طَالَ بِالنَّاسِ زَمَانٌ أَنْ يَقُولَ قَائِلٌ مَا نَجِدُ الرَّجْمَ فِي كِتَابِ اللهِ فَيَضِلُّونَ بِتَرْكِ فَرِيضَةٍ أَنْزَلَهَا اللهُ وَإِنَّ الرَّجْمَ فِي كِتَابِ اللهِ حَقٌّ عَلَى مَنْ زَنَا إِذَا أُحْصِنَ مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا قَامَتِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ
[Machine] Umar said from the pulpit, "The Messenger of Allah ﷺ was stoned and we stoned."
قَالَ عُمَرُ عَلَى الْمِنْبَرِ «لَقَدْ رَجَمَ رَسُولُ اللهِ ﷺ وَرَجَمْنَا»
[Machine] "Whoever denies stoning has indeed denied the Quran, where they do not expect it." The saying comes from the verse "O People of the Scripture, there has come to you Our Messenger making clear to you much of what you used to conceal of the Scripture." [Al-Ma'idah 15] So stoning was one of the things they used to conceal.
«مَنْ كَفَرَ بِالرَّجْمِ فَقَدْ كَفَرَ بِالْقُرْآنِ مِنْ حَيْثُ لَا يَحْتَسِبُ» قَوْلُ {يَا أَهْلَ الْكِتَابِ قَدْ جَاءَكُمْ رَسُولُنَا يُبَيِّنُ لَكُمْ كَثِيرًا مِمَّا كُنْتُمْ تُخْفُونَ مِنَ الْكِتَابِ} [المائدة 15] فَكَانَ الرَّجْمُ مِمَّا أَخْفُوا
41.6 [Machine] How to confess to adultery
٤١۔٦ كَيْفُ الِاعْتِرَافُ بِالزِّنَا
Messenger of Allah, purify me, whereupon he said: Woe be upon you, go back, ask forgiveness of Allah and turn to Him in repentance. He (the narrator) said that he went back not far, then came and said: Messenger of Allah, purify me. whereupon Messenger of Allah ﷺ said: Woe be upon you, go back and ask forgiveness of Allah and turn to Him in repentance. He (the narrator) said that he went back not far, when he came and said: Messenger of Allah, purify me. Allah's Apostle ﷺ said as he had said before. When it was the fourth time, Messenger of Allah (may, peace be upon him) said: From what am I to purify you? He said: From adultery, Messenger of Allah ﷺ asked if he had been mad. He was informed that he was not mad. He said: Has he drunk wine? A person stood up and smelt his breath but noticed no smell of wine. Thereupon Messenger of Allah ﷺ said: Have you committed adultery? He said: Yes. He made pronouncement about him and he was stoned to death. The people had been (divided) into two groups about him (Ma'iz). One of them said: He has been undone for his sins had encompassed him, whereas another said: There is no repentance more excellent than the repentance of Ma'iz, for he came to Allah's Apostle ﷺ and placing his hand in his (in the Holy Prophet's) hand said: Kill me with stones. (This controversy about Ma'iz) remained for two or three days. Then came Messenger of Allah ﷺ to them (his Companions) as they were sitting. He greeted them with salutation and then sat down and said: Ask forgiveness for Ma'iz b. Malik. They said: May Allah forgive Ma'iz b. Malik. Thereupon Messenger of Allah ﷺ said: He (Ma'iz) has made such a repentance that if that were to be divided among a people, it would have been enough for all of them. He (the narrator) said: Then a woman of Ghamid, a branch of Azd, came to him and said: Messenger of of Allah, purify me, whereupon he said: Woe be upon you; go back and beg forgiveness from Allah and turn to Him in repentance. She said: I find that you intend to send me back as you sent back Ma'iz. b. Malik. He (the Holy, Prophet) said: What has happened to you? She said that she had become pregnant as a result of fornication. He (the Holy Prophet) said: Is it you (who has done that)? She said: Yes. He (the Holy Prophet) said to her: (You will not be punished) until you deliver what is there in your womb. One of the Ansar became responsible for her until she was delivered (of the child). He (that Ansari) came to Allah's Apostle ﷺ and said the woman of Ghamid has given birth to a child. He (the Holy Prophet) said: In that case we shall not stone her and so leave her infant with none to suckle him. One of the Ansar got up and said: Allah's Apostle, let the responsibility of his suckling be upon me. She was then stoned to death. (Using translation from Muslim 1695a)
جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ «وَيْحَكَ ارْجِعْ فَاسْتَغْفِرِ اللهَ وَتُبْ إِلَيْهِ» فَرَجَعَ غَيْرَ بَعِيدٍ ثُمَّ جَاءَهُ فَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ «وَيْحَكَ ارْجِعْ فَاسْتَغْفِرِ اللهَ وَتُبْ إِلَيْهِ فَرَجَعَ غَيْرَ بَعِيدٍ» ثُمَّ جَاءَهُ فَقَالَ يَا رَسُولَ اللهِ طَهِّرْنِي فَقَالَ النَّبِيُّ ﷺ مِثْلَ ذَلِكَ حَتَّى إِذَا كَانَتِ الرَّابِعَةُ قَالَ لَهُ النَّبِيُّ ﷺ «مِمَّ اطَهِّرُكَ؟» قَالَ مِنَ الزِّنَا فَسَأَلَهُ النَّبِيُّ ﷺ «أَبِهِ جُنُونٌ» فَأُخْبِرَ أَنَّهُ لَيْسَ بِمَجْنُونٍ وَسَأَلَ «أَشَرِبْتَ خَمْرًا» فَقَامَ رَجُلٌ فَاسْتَنْكَهَهُ فَلَمْ يَجِدْ مِنْهُ رِيحَ خَمْرٍ فَقَالَ النَّبِيُّ ﷺ «أَثَيِّبٌ أَنْتَ؟» قَالَ نَعَمْ فَأَمَرَ بِهِ فَرُجِمَ فَكَانَ النَّاسُ فِيهِ فِرْقَتَيْنِ قَائِلٌ يَقُولُ لَقَدْ هَلَكَ مَاعِزٌ عَلَى أَسْوَءِ عَمَلِهِ لَقَدْ أَحَاطَتْ بِهِ خَطِيئَتُهُ وَقَائِلٌ يَقُولُ أَتَوْبَةٌ أَفْضَلُ مِنْ تَوْبَةِ مَاعِزِ بْنِ مَالِكٍ أَنْ جَاءَ إِلَى رَسُولِ اللهِ ﷺ فَوَضَعَ يَدَهُ فِي يَدِهِ وَقَالَ اقْتُلْنِي بِالْحِجَارَةِ فَلَبِثُوا بِذَلِكَ يَوْمَيْنِ أَوْ ثَلَاثَةً فَجَاءَ النَّبِيُّ ﷺ وَهُمْ جُلُوسٌ فَسَلَّمَ ثُمَّ جَلَسَ فَقَالَ «اسْتَغْفِرُوا لِمَاعِزِ بْنِ مَالِكٍ» فَقَالُوا يَغْفِرِ اللهُ لِمَاعِزِ بْنِ مَالِكٍ فَقَالَ النَّبِيُّ ﷺ «لَقَدْ تَابَ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ مِائَةٍ لَوَسِعَتْهُمْ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ هَذَا صَالِحُ الْإِسْنَادِ
41.7 [Machine] The mention of Imam's investigation on the confessor regarding adultery and the differences in the narrators' words about the news of Abu Zubair in that.
٤١۔٧ ذِكْرُ اسْتِقْصَاءِ الْإِمَامِ عَلَى الْمُعْتَرِفِ عِنْدَهُ بِالزِّنَا، وَاخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرِ أَبِي الزُّبَيْرِ فِي ذَلِكَ
[Machine] A goat came to the Prophet ﷺ and said, "Indeed, I have committed adultery." The Prophet turned away from it until it came to him for the fifth time. He then asked, "Did you marry her?" The goat replied, "Yes." The Prophet said, "It is as if the black eye liner disappears in the kohl or as if urine disappears in the well." The goat replied, "Yes." The Prophet asked, "Do you know what adultery is?" The goat replied, "I have come to you with a matter that is forbidden, just as a man goes to his wife lawfully." The Prophet asked, "What do you want?" The goat said, "I want to be purified." So the Prophet ordered that it be stoned, and it was stoned. Then the Prophet ﷺ heard two of his companions saying, "Look at this one whom Allah has concealed." But then he did not remain calm until it was stoned like a dog, and he mentioned a word that meant it. Then he saw a donkey's jaw that was filled with his leg, so he said to so-and-so and so-and-so, "Approach and eat from this donkey's jaw." They said, "May Allah forgive you, can we eat from the jaw?" He said, "By the One in whose hand is my soul, that which both of you have obtained from your brother is greater than that. And by Him in whose hand is my soul, He is in the rivers of Paradise, bathing in them."
جَاءَ مَاعِزٌ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ حَتَّى إِذَا كَانَ فِي الْخَامِسَةِ أَقْبَلَ عَلَيْهِ فَقَالَ «أَنْكَحْتَهَا؟ حَتَّى غَابَ ذَلِكَ مِنْكَ فِي ذَلِكَ مِنْهَا» قَالَ نَعَمْ قَالَ «كَمَا يَغِيبُ الْمِرْوَدُ فِي الْمِكْحَلَةِ أَوْ كَمَا يَغِيبُ الرِّشَاءُ فِي الْبِئْرِ» قَالَ نَعَمْ قَالَ «تَدْرِي مَا الزِّنَا» قَالَ أَتَيْتُ مِنْهَا أَمْرًا حَرَامًا كَمَا يَأْتِي الرَّجُلُ امْرَأَتَهُ حَلَالًا قَالَ «فَمَا تُرِيدُ؟» قَالَ أُرِيدُ أَنْ تُطَهِّرَنِي فَأَمَرَ بِهِ أَنْ يُرْجَمَ فَرُجِمَ فَسَمِعَ النَّبِيُّ ﷺ رَجُلَيْنِ مِنْ أَصْحَابِهِ يَقُولَانِ انْظُرُوا إِلَى هَذَا الَّذِي سَتَرَهُ ثُمَّ لَمْ تَقَرَّ نَفْسُهُ حَتَّى رُجِمَ رَجْمَ الْكَلْبِ وَذَكَرَ كَلِمَةً مَعْنَاهَا فَرَأَى جِيفَةَ حِمَارٍ قَدْ شُغِرَ بِرِجْلِهِ فَقَالَ إِلَى فُلَانٍ وَفُلَانٍ «ادْنُوَا فَكُلَا مِنْ جِيفَةِ هَذَا الْحِمَارِ» قَالَا غَفَرَ اللهُ لَكَ أَتُؤْكَلُ جِيفَةٌ؟ قَالَ «فَالَّذِي نِلْتُمَا مِنْ أَخِيكُمَا أَعْظَمُ مِنْ ذَلِكَ وَالَّذِي نَفْسِي بِيَدِهِ إِنَّهُ لَفِي أَنْهَارِ الْجَنَّةِ يَتَغَمَّسُ فِيهَا»
A man of the tribe of Aslam came to the Prophet ﷺ and testified four times against himself that he had had illicit intercourse with a woman, while all the time the Prophet ﷺ was turning away from him. Then when he confessed a fifth time, he turned round and asked: Did you have intercourse with her? He replied: Yes. He asked: Have you done it so that your sexual organ penetrated hers? He replied: Yes. He asked: Have you done it like a collyrium stick when enclosed in its case and a rope in a well? He replied: Yes. He asked: Do you know what fornication is? He replied: Yes. I have done with her unlawfully what a man may lawfully do with his wife. He then asked: What do you want from what you have said? He said: I want you to purify me. So he gave orders regarding him and he was stoned to death. Then the Prophet ﷺ heard one of his companions saying to another: Look at this man whose fault was concealed by Allah but who would not leave the matter alone, so that he was stoned like a dog. He said nothing to them but walked on for a time till he came to the corpse of an ass with its legs in the air. He asked: Where are so and so? They said: Here we are, Messenger of Allah ﷺ! He said: Go down and eat some of this ass's corpse. They replied: Messenger of Allah! Who can eat any of this? He said: The dishonour you have just shown to your brother is more serious than eating some of it. By Him in Whose hand my soul is, he is now among the rivers of Paradise and plunging into them. أَخْبَرَهُ أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ يَقُولُ جَاءَ الْأَسْلَمِيُّ إِلَى رَسُولِ اللهِ ﷺ فَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ بِالزِّنَا يَقُولُ أَتَيْتُ امْرَأَةً حَرَامًا كُلُّ ذَلِكَ يُعْرِضُ عَنْهُ رَسُولُ اللهِ ﷺ فَأَقْبَلَ فِي الْخَامِسَةِ فَقَالَ لَهُ «أَنْكَحْتَهَا؟» قَالَ نَعَمْ قَالَ «فَهَلْ تَدْرِي مَا الزِّنَا؟» قَالَ نَعَمْ قَالَ أَتَيْتُ مِنْهَا حَرَامًا مِثْلَ مَا يَأْتِي الرَّجُلُ مِنْ أَهْلِهِ حَلَالًا قَالَ «فَمَا تُرِيدُ بِهَذَا الْقَوْلِ؟» قَالَ أُرِيدُ أَنْ تُطَهِّرَنِي قَالَ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ أَنْ يُرْجَمَ فَرُجِمَ فَسَمِعَ رَجُلَيْنِ مِنْ أَصْحَابِهِ يَقُولُ أَحَدُهُمَا لِصَاحِبِهِ انْظُرُوا إِلَى هَذَا الَّذِي سَتَرَ اللهُ عَلَيْهِ فَلَمْ تَدَعْهُ نَفْسُهُ حَتَّى رُجِمَ رَجْمَ الْكَلْبِ فَسَكَتَ عَنْهُمَا رَسُولُ اللهِ ﷺ سَاعَةً فَمَرَّ بِجِيفَةِ حِمَارٍ شَائِلٍ بِرِجْلِهِ فَقَالَ «أَيْنَ فُلَانٌ وَفُلَانٌ؟» فَقَالَا نَحْنُ ذَا يَا رَسُولَ اللهِ قَالَ لَهُمَا «كُلَا مِنْ جِيفَةِ هَذَا الْحِمَارِ» فَقَالَا يَا رَسُولَ اللهِ غَفَرَ اللهُ لَكَ مَنْ يَأْكُلُ هَذَا؟ فَقَالَ رَسُولُ اللهِ ﷺ «مَا نِلْتُمَا مِنْ عِرْضِ هَذَا آنِفًا أَشَدُّ مِنْ أَكْلِ هَذِهِ الْجِيفَةِ فَوَالَّذِي نَفْسِي بِيَدِهِ إِنَّهُ الْآنَ فِي أَنْهَارِ الْجَنَّةِ»
[Machine] "Go to the Messenger of Allah ﷺ before the Quran is revealed to you. So he went to the Messenger of Allah ﷺ and informed him that he had committed adultery, but the Messenger turned away from him. Then he informed him again, and again the Messenger turned away from him. He informed him a third time, and again the Messenger turned away from him. When it was the fourth time, he ordered his stoning. When he was stoned, he fled to a tree and was killed. A man said to his companion, 'This person was killed like a dog.' So the Messenger of Allah ﷺ came to them riding on a dead donkey and said to them, 'Trample on this donkey.' They said, 'O Messenger of Allah, it is a dead carcass, how can we trample on it?' He said, 'That which you have said about your brother is worse. By the One in whose hand is the soul of Muhammad, he is sinking in the rivers of Paradise.' He said to Hazal, 'Woe to you, O Hazal! May his mercy be upon you.' Abu 'Abdur-Rahman 'Abdullah bin Hidad, who is not well-known, reported a difference of opinion regarding the name of his father, Abu Al-Zubair."
ائْتِ رَسُولَ اللهِ ﷺ قَبْلَ أَنْ يَنْزِلَ فِيكَ الْقُرْآنُ فَأَتَى رَسُولَ اللهِ ﷺ فَأَخْبَرَهُ أَنَّهُ قَدْ زَنَا فَأَعْرَضَ عَنْهُ ثُمَّ أَخْبَرَهُ فَأَعْرَضَ عَنْهُ ثُمَّ أَخْبَرَهُ فَأَعْرَضَ عَنْهُ أَرْبَعَ مَرَّاتٍ فَلَمَّا كَانَتِ الرَّابِعَةُ أَمَرَ بِرَجْمِهِ فَلَمَّا رُجِمَ لَجَأَ إِلَى شَجَرَةٍ فَقُتِلَ فَقَالَ رَجُلٌ لِصَاحِبِهِ هَذَا الَّذِي قُتِلَ كَمَا يُقْتَلُ الْكَلْبُ فَأَتَى رَسُولُ اللهِ ﷺ عَلَى حِمَارٍ مَيِّتٍ فَقَالَ لَهُمَا «انْهَسَا مِنْ هَذَا الْحِمَارِ» فَقَالَا يَا رَسُولَ اللهِ جِيفَةٌ مَيِّتَةٌ كَيْفَ نَنْهَسُ مِنْهَا؟ فَقَالَ «الَّذِي أَصَبْتُمَا مِنْ أَخِيكُمَا أَنْتَنُ وَالَّذِي نَفْسُ مُحَمَّدٍ بِيَدِهِ إِنَّهُ لَيَنْغَمِسُ فِي أَنْهَارِ الْجَنَّةِ» وَقَالَ لِهَزَّالٍ وَيْحَكَ يَا هَزَّالُ أَلَا رَحْمَتَهُ قَالَ أَبُو عَبْدِ الرَّحْمَنِ عَبْدُ الرَّحْمَنِ بْنُ هِضَاضٍ لَيْسَ بِمَشْهُورٍ وَقَدِ اخْتُلِفَ عَلَى أَبِي الزُّبَيْرِ فِي اسْمِ أَبِيهِ
41.8 [Machine] The question about the mindset of the adulterer
٤١۔٨ الْمَسْأَلَةُ عَنْ عَقْلِ الْمُعْتَرِفِ بِالزِّنَا
[Machine] I was sitting with the Messenger of Allah ﷺ , when Al-Aslamy Ma'iz ibn Malik came to him and said, "O Messenger of Allah, I have committed adultery and I want you to purify me." The Prophet told him, "Go back." He returned and came to him a second time, and the Prophet told him, "Go back." He returned again and came to him a third time. Then the Messenger of Allah ﷺ asked his people about him, and they spoke well of him and praised his intelligence, saying, "Is he insane?" They replied, "No, by Allah, O Messenger of Allah. He is sound." They praised him for his intelligence and religion. He came to the Prophet for the fourth time, and the Prophet asked them about him again, and they replied with the same response. So the Prophet commanded them, "Dig a hole for him up to his chest, then stone him."
كُنْتُ جَالِسًا عِنْدَ رَسُولِ اللهِ ﷺ فَجَاءَهُ الْأَسْلَمِيُّ مَاعِزُ بْنُ مَالِكٍ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهُ «ارْجِعْ» فَرَجَعَ ثُمَّ أَتَاهُ الثَّانِيَةَ فَقَالَ «ارْجِعْ» فَرَجَعَ فَأَتَاهُ الثَّالِثَةَ فَأَتَى رَسُولُ اللهِ ﷺ قَوْمَهُ فَسَأَلَهُمْ فَأَحْسَنُوا عَلَيْهِ الثَّنَاءَ قَالَ «كَيْفَ عَقْلُهُ؟ هَلْ بِهِ جُنُونٌ؟» فَقَالُوا لَا وَاللهِ يَا رَسُولَ اللهِ إِنَّهُ لَصَحِيحٌ فَأَحْسَنُوا عَلَيْهِ الثَّنَاءَ فِي عَقْلِهِ وَدِينِهِ فَأَتَاهُ الرَّابِعَةَ فَسَأَلَهُمْ عَنْهُ فَقَالُوا مِثْلَ ذَلِكَ فَأَمَرَهُمْ «فَحَفَرُوا لَهُ حُفْرَةً إِلَى صَدْرِهِ ثُمَّ رَجَمُوهُ»
41.9 [Machine] The issue of recognizing adultery and mentioning the differences regarding 'Ikrimah in the narration of Ma'iz.
٤١۔٩ مَسْأَلَةُ الْمُعْتَرِفِ بِالزِّنَا عَنْ كَيْفِيَّتِهِ، وَذِكْرُ الِاخْتِلَافِ عَلَى عِكْرِمَةَ فِي حَدِيثِ مَاعِزٍ فِيهِ
[Machine] The Muslim came to the Messenger of Allah ﷺ and confessed to committing adultery. He said, "Perhaps you kissed, winked, or looked."
أَنَّ الْأَسْلَمِيَّ أَتَى رَسُولَ اللهِ ﷺ فَاعْتَرَفَ بِالزِّنَا فَقَالَ «لَعَلَّكَ قَبَّلْتَ أَوْ غَمَزْتَ أَوْ نَظَرْتَ»
[Machine] The Prophet ﷺ said to Ma'iz ibn Malik, "Woe to you! Perhaps you kissed her or winked at her or looked at her?" He replied, "No." The Prophet ﷺ said, "So would you do it?" He said, "Yes." At that moment, the Prophet ﷺ ordered for him to be stoned. Omar mentioned this incident in his narration: Ma'iz came to the Prophet ﷺ and the Prophet ﷺ said to him, "Perhaps you kissed her or winked at her or looked at her?" He replied, "No." The Prophet ﷺ said, "Did you do it?" He denied it. Then, he admitted it, saying, "Yes, O Messenger of Allah." So, the Prophet ﷺ ordered for him to be stoned.
أَنَّ النَّبِيَّ ﷺ قَالَ لِمَاعِزِ بْنِ مَالِكٍ وَيْحَكَ لَعَلَّكَ قَبَّلْتَ أَوْ غَمَزْتَ أَوْ نَظَرْتَ قَالَ لَا قَالَ «فَنِكْتَهَا» قَالَ نَعَمْ قَالَ فَعِنْدَ ذَلِكَ أَمَرَ بِرَجْمِهِ وَقَالَ عَمْرٌو فِي حَدِيثِهِ أَتَى مَاعِزٌ النَّبِيَّ ﷺ فَقَالَ النَّبِيُّ ﷺ «لَعَلَّكَ قَبَّلْتَ أَوْ غَمَزْتَ أَوْ نَظَرْتَ» قَالَ لَا قَالَ «أَفَعَلْتَ؟» لَا يُكَنِّي قَالَ نَعَمْ يَا رَسُولَ اللهِ فَأَمَرَ بِرَجْمِهِ
[Machine] A goat came to the Prophet ﷺ and said to him, "I have committed adultery." The Prophet turned away from it, but it repeated the statement multiple times. He then asked, "Have you been married?" The goat replied, "Yes." So, his people asked about it, saying, "Was there any legal punishment over the goat, or was there any reproach?" They answered, "No." So, the Messenger of Allah ﷺ stoned it.
أَنَّ مَاعِزًا أَتَى النَّبِيَّ ﷺ فَقَالَ لَهُ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ فَقَالَهَا مِرَارًا فَقَالَ لَهُ «أَنَكَحْتَ؟» قَالَ نَعَمْ فَسَأَلَ عَنْهُ قَوْمَهُ «أَبِهِ بَأْسٌ؟ أَبِهِ مَسٌّ؟» قَالُوا لَا فَرَجَمَهُ رَسُولُ اللهِ ﷺ
41.10 [Machine] Recognition of adultery four times
٤١۔١٠ الِاعْتِرَافُ بِالزِّنَا أَرْبَعَ مَرَّاتٍ
Is it true what has reached me about you? He said: What has reached you about me? He said: It has reached me that you have committed (adultery) with the slave-girl of so and so? He said: Yes. He (the narrator) said: He testified four times. He (the Holy Prophet) then made pronouncement about him and he was stoned (to death). (Using translation from Muslim 1693)
أَنَّ النَّبِيَّ ﷺ قَالَ لِمَاعِزِ بْنِ مَالِكٍ «أَحَقٌّ مَا بَلَغَنِي عَنْكَ» قَالَ مَا بَلَغَكَ عَنِّي؟ قَالَ «بَلَغَنِي أَنَّكَ وَقَعْتَ بِجَارِيَةِ آلِ فُلَانٍ» قَالَ «نَعَمْ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ ثُمَّ أَمَرَ بِهِ فَرُجِمَ»
[Machine] The Messenger of Allah ﷺ said, "Is it true what I have heard about you, that you committed adultery with the wife of a certain person?" He replied, "Yes." So he confessed four times, two times, then two times, and he was stoned to death.
قَالَ رَسُولُ اللهِ ﷺ «حَقٌّ مَا بَلَغَنِي عَنْكَ مَاعِزُ أَنَّكَ وَقَعْتَ عَلَى وَلِيدَةِ بَنِي فُلَانٍ؟» قَالَ «نَعَمْ فَاعْتَرَفَ أَرْبَعَ مَرَّاتٍ مَرَّتَيْنِ مَرَّتَيْنِ فَرَجَمَهُ»
[Machine] The Messenger of Allah, ﷺ , brought Maa'iz Ibn Malik and he confessed twice. Then he said, "Take him and return him." He confessed two more times until he confessed four times. Then he said, "Take him and stone him."
أَتَى رَسُولُ اللهِ ﷺ بِمَاعِزِ بْنِ مَالِكٍ فَاعْتَرَفَ مَرَّتَيْنِ ثُمَّ قَالَ «اذْهَبُوا بِهِ ثُمَّ رُدُّوهُ» فَاعْتَرَفَ مَرَّتَيْنِ حَتَّى اعْتَرَفَ أَرْبَعًا فَقَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ»
41.11 [Machine] The Mention of Differences regarding Az-Zuhri in the Hadith of Ma'iz
٤١۔١١ ذِكْرُ الِاخْتِلَافِ عَلَى الزُّهْرِيِّ، فِي حَدِيثِ مَاعِزٍ
A man from the tribe of Bani Aslam came to the Prophet ﷺ while he was in the mosque and said, "I have committed illegal sexual intercourse." The Prophet ﷺ turned his face to the other side. The man turned towards the side towards which the Prophet ﷺ had turned his face, and gave four witnesses against himself. On that the Prophet ﷺ called him and said, "Are you insane?" (He added), "Are you married?" The man said, 'Yes." On that the Prophet ﷺ ordered him to be stoned to the death in the Musalla (a praying place). When the stones hit him with their sharp edges and he fled, but he was caught at Al- Harra and then killed (Using translation from Bukhārī 5270)
أَنَّ رَجُلًا مِنْ أَسْلَمَ أَتَى رَسُولَ اللهِ ﷺ وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ فَحَدَّثَهُ أَنَّهُ زَنَا فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ فَتَنَحَّى بِشِقِّهِ الَّذِي أَعْرَضَ قِبَلَهُ فَأَخْبَرَهُ أَنَّهُ زَنَا فَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ فَدَعَاهُ رَسُولُ اللهِ ﷺ فَقَالَ «هَلْ بِكَ جُنُونٌ؟» قَالَ لَا قَالَ فَهَلْ أُحْصِنْتَ؟ قَالَ نَعَمْ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ أَنْ يُرْجَمَ بِالْمُصَلَّى فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ جَمَزَ حَتَّى أُدْرِكَ بِالْحَرَّةِ فَقُتِلَ بِهَا رَجْمًا
A man from the tribe of Bani Aslam came to Messenger of Allah ﷺ and Informed him that he had committed illegal sexual intercourse and bore witness four times against himself. Messenger of Allah ﷺ ordered him to be stoned to death as he was a married Person. (Using translation from Bukhārī 6814)
أَنَّ رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى رَسُولِ اللهِ ﷺ فَحَدَّثَهُ أَنَّهُ زَنَا فَشَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ فَأَمَرَ رَسُولُ اللهِ ﷺ فَرُجِمَ كَانَ قَدْ أُحْصِنَ زَعَمُوا أَنَّهُ مَاعِزُ بْنُ مَالِكٍ
