٤١۔٢٠ إِلَى أَيْنَ يُحْفَرُ لِلرَّجُلِ

[Machine] I was sitting with the Prophet ﷺ when a man named Ma'iz ibn Malik came to him and said, "O Messenger of Allah, I have committed adultery and I want you to purify me." The Prophet ﷺ told him to go back. The next day, he came to the Prophet ﷺ again and confessed to adultery. The Prophet ﷺ told him to go back. Then the Prophet ﷺ sent someone to ask the people about Ma'iz, saying, "What do you know about Ma'iz ibn Malik? Do you see him as a bad person or do you see any problem with his mind?" They replied, "O Messenger of Allah, we do not see anything wrong with him and we do not see any problem with his mind." Then Ma'iz came to the Prophet ﷺ for the third time and confessed to adultery, asking the Prophet ﷺ to purify him. The Prophet ﷺ sent someone to ask the people about Ma'iz again, and they gave the same response as before. Then, he came to the Prophet ﷺ for the fourth time and confessed to adultery. The Prophet ﷺ ordered a pit to be dug for him, and he was buried up to his chest. Then the Prophet ﷺ ordered the people to stone him. Buraida said, "Among the Prophet's companions, we used to talk about Ma'iz and say that if he had sat in his house after the first confession and not gone seeking punishment, it would have been better for him. But he repeated his confession three times, and then he acted as if he wanted punishment."

كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَ رَجُلٌ يُقَالُ لَهُ مَاعِزُ بْنُ مَالِكٍ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهُ النَّبِيُّ ﷺ «ارْجِعْ» فَلَمَّا كَانَ مِنَ الْغَدِ أَتَاهُ أَيْضًا فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا فَقَالَ لَهُ النَّبِيُّ ﷺ «ارْجِعْ» ثُمَّ أَرْسَلَ إِلَى قَوْمِهِ فَسَأَلَهُمْ عَنْهُ فَقَالَ «مَا تَعْلَمُونَ مِنْ مَاعِزِ بْنِ مَالِكٍ؟ هَلْ تَرَوْنَ بِهِ بَأْسًا أَوْ تُنْكِرُونَ فِي عَقْلِهِ شَيْئًا؟» فَقَالُوا يَا نَبِيَّ اللهِ مَا نَرَى بِهِ بَأْسًا وَمَا نُنْكِرُ مِنْ عَقْلِهِ شَيْئًا ثُمَّ عَادَ إِلَى النَّبِيِّ ﷺ الثَّالِثَةَ فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا وَقَالَ يَا نَبِيَّ اللهِ طَهِّرْنِي فَأَرْسَلَ رَسُولُ اللهِ ﷺ أَيْضًا إِلَى قَوْمِهِ فَسَأَلَهُمْ عَنْهُ فَقَالُوا كَمَا قَالُوا الْمَرَّةَ الْأُولَى مَا نَرَى بِهِ بَأْسًا وَمَا نُنْكِرُ مِنْ عَقْلِهِ شَيْئًا ثُمَّ رَجَعَ إِلَى النَّبِيِّ ﷺ الرَّابِعَةَ فَاعْتَرَفَ أَيْضًا عِنْدَهُ بِالزِّنَا فَأَمَرَ النَّبِيُّ ﷺ «فَحُفِرَ لَهُ حُفْرَةٌ فَجُعِلَ فِيهَا إِلَى صَدْرِهِ ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهُ» فَقَالَ بُرَيْدَةُ كُنَّا نَتَحَدَّثُ أَصْحَابَ نَبِيِّ اللهِ ﷺ بَيْنَنَا أَنَّ مَاعِزًا لَوْ جَلَسَ فِي رَحْلِهِ بَعْدَ اعْتِرَافِهِ ثَلَاثَ مِرَارٍ وَلَمْ يَطْلُبْهُ وَإِنَّمَا رَجَمَهُ عِنْدَ الرَّابِعَةِ [436] 7165 أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا حَرَمِيُّ بْنُ حَفْصٍ أَبُو عَلِيٍّ قَالَ حَدَّثَنَا ابْنُ عُلَاثَةَ قَالَ حَدَّثَنِي عَبْدُ الْعَزِيزِ بْنُ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ أَنَّ خَالِدَ بْنَ اللَّجْلَاجِ أَخْبَرَهُ أَنَّ أَبَاهُ أَخْبَرَهُ قَالَ كُنْتُ أَعْتَمِلُ فَمَرَّتِ امْرَأَةٌ وَمَعَهَا صَبِيٌّ فَثَارَ النَّاسُ وَثُرْتُ فِيمَنْ ثَارَ فَانْتَهَيْتُ إِلَى النَّبِيِّ ﷺ فَقَالَ لِلْمَرْأَةِ «مَنْ أَبُو هَذَا الْغُلَامِ؟» فَسَكَتَتْ قَالَ وَقَامَ فَتًى فَقَالَ أَنَا أَبُوهُ يَا رَسُولَ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ أَبُو هَذَا الْغُلَامِ؟» فَقَالَ الْفَتَى أَنَا أَبُوهُ يَا رَسُولَ اللهِ وَهِيَ حَدِيثَةُ السِّنِّ حَدِيثَةُ يَعْنِي عَهْدٍ بِخِزْيَةٍ وَلَيْسَتْ بِمُكَلِّمَتَكَ أَنَا أَبُوهُ يَا رَسُولَ اللهِ فَكَأَنَّهُ نَظَرَ إِلَى مَنْ حَوْلَهُ فَسَأَلَهُمْ «مَا تَقُولُونَ؟» فَقَالُوا لَا نَعْلَمُ إِلَّا خَيْرًا فَقَالَ «أُحْصِنْتَ؟» قَالَ نَعَمْ فَأَمَرَ بِرَجْمِهِ فَذَهَبْنَا بِهِ فَحَفَرْنَا لَهُ حَتَّى إِذَا أَمْكَنَّا رَمَيْنَاهُ حَتَّى هَدَأَ وَسَاقَ الْحَدِيثَ إِذَا اعْتَرَفَ بِالزِّنَا ثُمَّ رَجَعَ عَنْهُ

[Machine] Ma'iz ibn Malik came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I have committed adultery." The Prophet turned away from him. He then came to him from his right side and said, "O Messenger of Allah, I have committed adultery." The Prophet turned away from him. He then came to him from his left side and said, "O Messenger of Allah, I have committed adultery." The Prophet repeated this four times and then said, "Take him and stone him." So they took him and when the stones touched him, he ran away. A man with a stone in his hand, who had a short arm, struck him and killed him. When this was mentioned to the Messenger of Allah, he said, "Why didn't you leave him alone?"

جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ فَأَعْرَضَ عَنْهُ ثُمَّ جَاءَهُ مِنْ شِقِّهِ الْأَيْمَنِ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ فَأَعْرَضَ عَنْهُ ثُمَّ جَاءَهُ مِنْ شِقِّهِ الْأَيْسَرِ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ فَقَالَ ذَلِكَ أَرْبَعَ مَرَّاتٍ قَالَ «انْطَلِقُوا بِهِ فَارْجُمُوهُ» فَانْطَلَقُوا بِهِ فَلَمَّا مَسَّتْهُ الْحِجَارَةُ أَدْبَرَ يَشْتَدُّ فَلَقِيَهُ رَجُلٌ فِي يَدِهِ لِحْيُ جَمَلٍ فَضَرَبَهُ فَصَرَعَهُ فَذُكِرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فِرَارُهُ حِينَ مَسَّتْهُ الْحِجَارَةُ قَالَ «فَهَلَّا تَرَكْتُمُوهُ»

[Machine] Goat bin Malik came to the Prophet ﷺ and said, "O Messenger of Allah, I have committed adultery. So establish the punishment prescribed in the Book of Allah upon me." He turned away from him. The man repeated his confession four times, and each time the Prophet ﷺ turned away from him. Finally, the Prophet ﷺ said, "Go and stone him." When the stones touched him, he ran away, but Abdullah pursued him and struck him with a stick made from the shoulder bone of a camel, causing his death. The people then stoned him until he died. News of his escape reached the Messenger of Allah ﷺ, and he asked, "Why did you not leave him? Perhaps he would have repented and Allah would have accepted his repentance."

جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَقِمْ عَلَيَّ كِتَابَ اللهِ فَأَعْرَضَ عَنْهُ ثُمَّ قَالَ لَهُ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ كِتَابَ اللهِ حَتَّى جَاءَ أَرْبَعَ مَرَّاتٍ فَقَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» فَلَمَّا مَسَّتْهُ الْحِجَارَةُ جَمَزَ فَاشْتَدَّ فَخَرَجَ عَبْدُ اللهِ مِنْ بَادِيَتِهِ فَرَمَاهُ بِوَظِيفِ حِمَارٍ فَصَرَعَهُ فَرَمَاهُ النَّاسُ حَتَّى قَتَلُوهُ فَذُكِرَ لِرَسُولِ اللهِ ﷺ فِرَارَهُ فَقَالَ «هَلَّا تَرَكْتُمُوهُ لَعَلَّهُ يَتُوبُ فَيَتُوبَ اللهُ عَلَيْهِ؟»

[Machine] "Return me to the Messenger of Allah ﷺ , but we denied that. So I went to Aasim ibn Umar ibn Qatadah and mentioned it to him. Al-Hasan ibn Muhammad said to me, 'I had heard about that and I denied it.' So I went to Jabir ibn Abdullah and said to him, 'People have mentioned something from the words of Ma'iz, saying, 'Return me to the Messenger of Allah ﷺ .' I denied it.' He said to me, 'I was with those who stoned him. When he felt the stones, he said, 'Return me to the Messenger of Allah ﷺ , for indeed my people have deceived me.' They said to him, 'Go to the Messenger of Allah ﷺ , for he will not kill you.' We did not stop stoning him until we killed him.' When we mentioned that to him, he said, 'Did you not leave him alone until I could find out about his situation?'"

رُدُّونِي إِلَى رَسُولِ اللهِ ﷺ فَأَنْكَرْنَا ذَلِكَ فَأَتَيْتُ عَاصِمَ بْنَ عُمَرَ بْنِ قَتَادَةَ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ لِي الْحَسَنُ بْنُ مُحَمَّدٍ لَقَدْ بَلَغَنِي ذَلِكَ فَأَنْكَرْتُهُ فَأَتَيْتُ جَابِرَ بْنَ عَبْدِ اللهِ فَقُلْتُ لَهُ لَقَدْ ذَكَرَ النَّاسُ شَيْئًا مِنْ قَوْلِ مَاعِزٍ رُدُّونِي فَأَنْكَرْتُهُ فَقَالَ أَنَا كُنْتُ فِيمَنْ رَجَمَهُ إِنَّهُ لَمَّا وَجَدَ مَسَّ الْحِجَارَةِ قَالَ رُدُّونِي إِلَى رَسُولِ اللهِ ﷺ فَإِنَّ قَوْمِي غَرُّونِي قَالُوا إِئْتِ رَسُولَ اللهِ ﷺ فَإِنَّهُ غَيْرُ قَاتِلِكَ فَمَا أَقْلَعْنَا عَنْهُ حَتَّى قَتَلْنَاهُ فَلَمَّا ذَكَرْنَا ذَلِكَ لَهُ قَالَ «أَلَا تَرَكْتُمُوهُ؟ حَتَّى أَنْظُرَ فِي شَأْنِهِ»

Muhammad ibn Ishaq said: I mentioned the story of Ma'iz ibn Malik to Asim ibn Umar ibn Qatadah. He said to me: Hasan ibn Muhammad ibn Ali ibn AbuTalib said to me: Some men of the tribe of Aslam whom I do not blame and whom you like have transmitted to me the saying of the Messenger of Allah ﷺ: Why did you not leave him alone? He said: But I did not understand this tradition. So I went to Jabir ibn Abdullah and said (to him): Some men of the tribe of Aslam narrate that the Messenger of Allah ﷺ said when they mentioned to him the anxiety of Ma'iz when the stones hurt him: "Why did you not leave him alone?' But I do not know this tradition. He said: My cousin, I know this tradition more than the people. I was one of those who had stoned the man. When we came out with him, stoned him and he felt the effect of the stones, he cried: O people! return me to the Messenger of Allah ﷺ. My people killed me and deceived me; they told me that the Messenger of Allah ﷺ would not kill me. We did not keep away from him till we killed him. When we returned to the Messenger of Allah ﷺ we informed him of it. He said: Why did you not leave him alone and bring him to me? and he said this so that the Messenger of Allah ﷺ might ascertain it from him. But he did not say this to abandon the prescribed punishment. He said: I then understood the intent of the tradition. (Using translation from Abū Dāʾūd 4420)   

الكبرى للنسائي:٧١٦٩أَخْبَرَنَا يَحْيَى بْنُ حَبِيبِ بْنِ عَرَبِيٍّ قَالَ حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ إِسْحَاقَ قَالَ حَدَّثَنِي مُحَمَّدُ بْنُ إِبْرَاهِيمَ عَنْ أَبِي الْهَيْثَمِ بْنِ نَصْرِ بْنِ دَهْرٍ الْأَسْلَمِيِّ عَنْ أَبِيهِ قَالَ

كُنْتُ فِيمَنْ رَجَمَهُ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ جَزِعَ جَزَعًا شَدِيدًا فَذَكَرْنَا ذَلِكَ لِرَسُولِ اللهِ ﷺ قَالَ «فَهَلَّا تَرَكْتُمُوهُ؟» قَالَ مُحَمَّدٌ فَذَكَرْتُ ذَلِكَ مِنْ حَدِيثِهِ حِينَ سَمِعْتُهُ «أَلَا تَرَكْتُمُوهُ؟» لِعَاصِمِ بْنِ عُمَرَ بْنِ قَتَادَةَ فَقَالَ لِي حَدَّثَنِي حُسْنُ بْنُ مُحَمَّدِ بْنِ عَلِيِّ بْنِ أَبِي طَالِبٍ قَالَ حَدَّثَنِي ذَلِكَ مِنْ قَوْلِ رَسُولِ اللهِ ﷺ أَلَا تَرَكْتُمُوهُ؟ لِمَاعِزِ بْنِ مَالِكٍ مَنْ شِئْتَ مِنْ رِجَالِ أَسْلَمَ مِمَّنْ لَا أَتَّهِمُ وَلَمْ أَعْرِفْ وَجْهَ الْحَدِيثِ فَجِئْتُ جَابِرَ بْنَ عَبْدِ اللهِ فَقُلْتُ إِنَّ رِجَالَ أَسْلَمَ يُحَدِّثُونِي أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَهُمْ حِينَ ذَكَرُوا جَزَعَ مَاعِزٍ مِنَ الْحِجَارَةِ حِينَ أَصَابَتْهُ «فَهَلَّا تَرَكْتُمُوهُ؟» وَمَا أَتَّهِمُ الْقَوْمَ وَمَا أَعْرِفُ الْحَدِيثَ قَالَ يَا ابْنَ أَخِي أَنَا أَعْلَمُ النَّاسِ بِهَذَا الْحَدِيثِ؛ كُنْتُ فِيمَنْ رَجَمَ الرَّجُلَ إِنَّا لَمَّا خَرَجْنَا بِهِ فَرَجَمْنَاهُ فَوَجَدَ مَسَّ الْحِجَارَةِ صَرَخَ بِنَا يَا قَوْمُ رُدُّونِي إِلَى رَسُولِ اللهِ ﷺ فَإِنَّ قَوْمِي قَتَلُونِي وَغَرُّونِي مِنْ نَفْسِي وَأَخْبَرُونِي أَنَّ رَسُولَ اللهِ ﷺ غَيْرُ قَاتِلٍ فَلَمْ نَنْزِعْ عَنْهُ حَتَّى قَتَلْنَاهُ فَلَمَّا رَجَعْنَا إِلَى رَسُولِ اللهِ ﷺ قَالَ «فَهَلَّا تَرَكْتُمُ الرَّجُلَ؟ وَجِئْتُمُونِي بِهِ» لِيَتَثَبَّتَ رَسُولُ اللهِ ﷺ فِيهِ فَأَمَّا تَرْكُ حَدٍّ فَلَا قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الْإِسْنَادُ خَيْرٌ مِنَ الَّذِي قَبْلَهُ

[Machine] Goat bin Malik narrated that a man from our group came to the Messenger of Allah ﷺ and mentioned a word implying adultery, thus admitting his own guilt. The Messenger of Allah ﷺ ordered us to stone him, so we took him to the area of Banu Niyar and stoned him. When he felt the pain of the stones, he became extremely distressed. After we had finished stoning him and returned to the Messenger of Allah ﷺ , we informed him about the man's distress. He said, "Why didn't you leave him alone?"

أَتَى مَاعِزُ بْنُ مَالِكٍ رَجُلٌ مِنَّا رَسُولَ اللهِ ﷺ ثُمَّ ذَكَرَ كَلِمَةً مَعْنَاهَا فَأَقَرَّ عَلَى نَفْسِهِ بِالزِّنَا فَأَمَرَنَا رَسُولُ اللهِ ﷺ بِرَجْمِهِ فَخَرَجْنَا بِهِ إِلَى حَرَّةِ بَنِي نيَارٍ فَرَجَمْنَاهُ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ جَزِعَ جَزَعًا شَدِيدًا فَلَمَّا فَرَغْنَا مِنْهُ وَرَجَعْنَا إِلَى رَسُولِ اللهِ ﷺ ذَكَرْنَا لَهُ جَزَعَهُ قَالَ «فَهَلَّا تَرَكْتُمُوهُ»
