٤١۔٣٩ ذِكْرُ الِاخْتِلَافِ عَلَى يَعْقُوبَ بْنِ عَبْدِ اللهِ بْنِ الْأَشَجِّ فِيهِ

[Machine] There was a man among us who was physically blind, and he didn't cause any harm to the people of the house except for a maid from the housemaids. He had a relationship with her. Saad raised the matter to the Messenger of Allah ﷺ , and the Messenger of Allah ﷺ said, "Give him his full punishment." They said, "O Messenger of Allah! If we were to strike him, we would kill him, as he is weaker than that." He said, "Then take a bundle of reeds and strike him once with it." So they did as advised.  

الكبرى للنسائي:٧٢٦٨أَخْبَرَنِي مُحَمَّدُ بْنُ وَهْبٍ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ قَالَ حَدَّثَنِي مُحَمَّدُ بْنُ إِسْحَاقَ عَنِ يَعْقُوبَ بْنِ عَبْدِ اللهِ بْنِ الْأَشَجِّ عَنْ أَبِي أُمَامَةَ بْنِ سَهْلٍ عَنْ سَعِيدِ بْنِ سَعْدٍ قَالَ

كَانَ بَيْنَ أَبْيَاتِنَا رَجُلٌ ضَرِيرُ الْجَسَدِ فَلَمْ يَرُعْ أَهْلُ الدَّارِ إِلَّا وَهُوَ عَلَى يَعْنِي جَارِيَةً مِنْ جَوَارِي الدَّارِ يَفْجُرُ بِهَا فَرَفَعَ سَعْدٌ شَأْنَهُ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ «اضْرِبُوهُ حَدَّهُ» قَالُوا يَا رَسُولَ اللهِ إِنْ ضَرَبْنَاهُ قَتَلْنَاهُ هُوَ أَضْعَفُ مِنْ ذَلِكَ قَالَ «فَخُذُوا عِثْكَالًا فِيهِ مِائَةُ شِمْرَاخٍ فَاضْرِبُوهُ بِهَا ضَرْبَةً وَاحِدَةً» فَفَعَلُوا

[Machine] From Fulan, a weak person, the Prophet ﷺ was brought to him and he was questioned, and he admitted. The Prophet ﷺ said, "Strike him." They said, "We fear that he may die." The Prophet ﷺ said, "Strike him with a soft cushion."  

الكبرى للنسائي:٧٢٦٩أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا يَحْيَى قَالَ حَدَّثَنَا ابْنُ عَجْلَانَ قَالَ حَدَّثَنِي يَعْقُوبُ بْنُ عَبْدِ اللهِ بْنِ الْأَشَجِّ عَنْ أَبِي أُمَامَةَ بْنِ سَهْلِ بْنِ حَنِيِفٍ أَنَّ امْرَأَةً حَمَلَتْ فَقِيلَ لَهَا مِمَّنْ؟ فَقَالَتْ

مِنْ فُلَانٍ مُقْعَدٍ ضَعِيفٍ فَأُتِيَ بِهِ النَّبِيُّ ﷺ فَسُئِلَ فَاعْتَرَفَ فَقَالَ «اضْرِبُوهُ» فَقَالُوا نَخْشَى أَنْ يَمُوتَ فَقَالَ النَّبِيُّ ﷺ «اضْرِبُوهُ بِأُثْكُولٍ»

[Machine] A woman encountered a man in the darkness of the morning while she was going to the mosque, wrapped in a garment over herself. She called out for help to a passing man, so he ran away with his companion. Then, others passed by her, so she called out for help to them and they caught the man she had called out for. They reached him before the others did, and they brought him to her. She said to him, "I am the one who called out for help from you, but the other man is already gone." So they brought him to the Prophet ﷺ, and she informed him that he had encountered her. The people also informed the Prophet that they had caught him after he had made a strong escape. The Prophet said, "I had only come to the aid of her companion, so how were they able to catch me?" She said, "He is the one who encountered me." The Messenger of Allah ﷺ said, "Take him away and stone him." Then, a man from the people stood up and said, "Don't stone him, but stone me. I am the one who committed this act." So, he confessed, and three individuals gathered before the Messenger of Allah ﷺ - the one who had encountered her, the one who had come to her aid, and the woman. The Prophet said to the woman, "As for you, forgiveness has been granted to you." He said to the one who had come to her aid, "Well-spoken." Then, Umar asked, "Shouldn't we stone the one who confessed to adultery?" The Messenger of Allah ﷺ refused, saying, "No, for he has repented to Allah." Abu Abdur Rahman said, "The most generous of them in narration is the hadith of Abu Umamah, which is marfu."  

الكبرى للنسائي:٧٢٧٠أَخْبَرَنَا مُحَمَّدُ بْنُ يَحْيَى بْنِ مُحَمَّدٍ الْحَرَّانِيُّ قَالَ حَدَّثَنَا عَمْرُو بْنُ حَمَّادِ بْنِ طَلْحَةَ هُوَ الْقَنَّادُ حَدَّثَنَا أَسْبَاطِ بْنِ نَصْرٍ عَنْ سِمَاكٍ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ زَعَمَ

أَنَّ امْرَأَةً وَقَعَ عَلَيْهَا رَجُلٌ فِي سَوَادِ الصُّبْحِ وَهِيَ تَعْمِدُ إِلَى الْمَسْجِدِ عَكُورَةً عَلَى نَفْسِهَا فَاسْتَغَاثَتْ بِرَجُلٍ مَرَّ عَلَيْهَا وَفَرَّ صَاحِبُهَا ثُمَّ مَرَّ عَلَيْهَا ذَوُو عَدَدٍ فَاسْتَغَاثَتْ بِهِمْ فَأَدْرَكُوا الرَّجُلَ الَّذِي كَانَتِ اسْتَغَاثَتْ بِهِ فَأَخَذُوهُ وَسَبَقَهُمُ الْآخَرُ فَجَاءُوا بِهِ يَقُودُونَهُ إِلَيْهَا فَقَالَ لَهَا أَنَا الَّذِي أَغَثْتُكِ وَقَدْ ذَهَبَ الْآخَرُ قَالَ فَأَتَوْا بِهِ النَّبِيَّ ﷺ فَأَخْبَرَتْهُ أَنَّهُ وَقَعَ عَلَيْهَا وَأَخْبَرَ الْقَوْمُ أَنَّهُمْ أَدْرَكُوهُ يَشْتَدُّ فَقَالَ إِنَّمَا كُنْتُ أُغِيثُهَا عَلَى صَاحِبِهَا فَأَدْرَكُونِي هَؤُلَاءِ فَأَخَذُونِي قَالَتْ كَذَبَ هُوَ الَّذِي وَقَعَ عَلَيَّ فَقَالَ رَسُولُ اللهِ ﷺ «انْطَلِقُوا بِهِ فَارْجُمُوهُ» فَقَامَ الرَّجُلُ مِنَ النَّاسِ فَقَالَ لَا تَرْجُمُوهُ وَارْجُمُونِي فَأَنَا الَّذِيُ فَعَلْتُ بِهَا الْفِعْلَ فَاعْتَرَفَ فَاجْتَمَعَ ثَلَاثَةٌ عِنْدَ رَسُولِ اللهِ ﷺ الَّذِي وَقَعَ عَلَيْهَا وَالَّذِي أَغَاثَهَا وَالْمَرْأَةُ فَقَالَ أَمَّا أَنْتِ فَقَدْ غُفِرَ لَكِ وَقَالَ لِلَّذِي أَغَاثَهَا قَوْلًا حَسَنًا فَقَالَ عُمَرُ أَرْجُمُ الَّذِي اعْتَرَفَ بِالزِّنَى؟ فَأَبَى رَسُولَ اللهِ ﷺ قَالَ «لَا إِنَّهُ قَدْ تَابَ إِلَى اللهِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَجْوَدُهَا حَدِيثُ أَبِي أُمَامَةَ مُرْسَلٌ
