41. Stoning (2/5)
٤١۔ كِتَابُ الرَّجْمِ ص ٢
A man of the tribe of Asalam came to the Messenger of Allah ﷺ and made confession of fornication. He (the prophet) turned away from him. When he testified against him four times, the Prophet ﷺ said: Are you mad? He said: No. he asked: Are you married? He replied: Yes. The Prophet ﷺ then commanded regarding him and he was stoned in the place of prayer. Then when the stones hurt him, he fled, but was overtaken and stoned to death. The Prophet ﷺ then spoke well of him and did not pray over him. (Using translation from Abū Dāʾūd 4430)
أَنَّ رَجُلًا مِنْ أَسْلَمَ جَاءَ إِلَى النَّبِيِّ ﷺ فَاعْتَرَفَ بِالزِّنَا فَأَعْرَضَ عَنْهُ ثُمَّ اعْتَرَفَ فَأَعْرَضَ عَنْهُ حَتَّى شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ مَرَّاتٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «أَبِكَ جُنُونٌ؟» قَالَ لَا قَالَ «أُحْصِنْتَ؟» قَالَ نَعَمْ فَأَمَرَ بِهِ النَّبِيُّ ﷺ فَرُجِمَ بِالْمُصَلَّى فَلَمَّا أَذْلَقَتْهُ الْحِجَارَةُ فَرَّ فَادْرِكَ فَرُجِمَ حَتَّى مَاتَ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «خَيْرًا وَلَمْ يُصَلِّ عَلَيْهِ» اللَّفْظُ لِابْنِ رَافِعٍ
Messenger of Allah. I have committed adultery. He (the Holy Prophet) turned away from him, He (again) came round facing him and said to him: Messenger of Allah, I have committed adultery. He (the Holy Prophet) turned away until he did that four times, and as he testified four times against his own self, Messenger of Allah ﷺ called him and said: Are you mad? He said: No. He (again) said: Are you married? He said: Yes. Thereupon Messenger of Allah ﷺ said: Take him and stone him. (Using translation from Muslim 1691c)
أَتَى رَجُلٌ مِنَ الْمُسْلِمِينَ رَسُولَ اللهِ ﷺ وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ فَتَنَحَّى تِلْقَاءَ وَجْهِهِ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَعْرَضَ عَنْهُ حَتَّى ثَنَّى ذَلِكَ عَلَيْهِ أَرْبَعَ مَرَّاتٍ فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ دَعَاهُ فَقَالَ «أَبِكَ جُنُونٌ؟» قَالَ لَا قَالَ «فَهَلْ أُحْصِنْتَ؟» قَالَ نَعَمْ فَقَالَ رَسُولُ اللهِ ﷺ «اذْهَبُوا بِهِ فَارْجُمُوهُ»

٤١۔١٢ ذِكْرُ اخْتِلَافِ الزُّهْرِيِّ، وَيَحْيَى بْنِ سَعِيدٍ عَلَى سَعِيدِ بْنِ الْمُسَيِّبِ فِي هَذَا الْحَدِيثِ
[Machine] A man came to the Prophet ﷺ while he was in the mosque, and he called him saying, "O Messenger of Allah, indeed the last one has committed adultery." The Prophet ﷺ turned away from him, so he moved to the side of his face that the Prophet ﷺ had turned away from and said, "O Messenger of Allah, indeed the last one has committed adultery." The Prophet ﷺ turned away from him again, so he moved to the side of his face that the Prophet ﷺ had turned away from and said, "O Messenger of Allah, indeed the last one has committed adultery." The Prophet ﷺ turned away from him for the fourth time, but when he testified against himself four times, the Messenger of Allah ﷺ called him and asked, "Are you crazy?" He replied, "No." So the Prophet ﷺ said to him, "Take him and stone him." And he had been married.
أَتَى رَجُلٌ مِنْ أَسْلَمَ النَّبِيَّ ﷺ وَهُوَ فِي الْمَسْجِدِ فَنَادَاهُ فَقَالَ يَا رَسُولَ اللهِ إِنَّ الْآخِرَ زَنَا يَعْنِي نَفْسَهُ فَأَعْرَضَ عَنْهُ النَّبِيُّ ﷺ فَتَنَحَّى يَعْنِي لِشِقِّ وَجْهِهِ الَّذِي أَعْرَضَ قِبَلَهُ فَقَالَ يَا رَسُولَ اللهِ إِنَّ الْآخِرَ زَنَا فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ فَتَنَحَّى لِشِقِّ وَجْهِهِ الَّذِي أَعْرَضَ قِبَلَهُ فَقَالَ يَا رَسُولَ اللهِ إِنَّ الْآخِرَ زَنَا فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ فَتَنَحَّى الرَّابِعَةَ فَلَمَّا شَهِدَ عَلَى نَفْسِهِ أَرْبَعَ شَهَادَاتٍ دَعَاهُ رَسُولُ اللهِ ﷺ فَقَالَ «هَلْ بِكَ جُنُونٌ؟» قَالَ لَا فَقَالَ لَهُ النَّبِيُّ ﷺ «اذْهَبُوا بِهِ فَارْجُمُوهُ» وَكَانَ قَدْ أُحْصِنَ
[Machine] His father, Abu Bakr, repented to Allah and sought refuge in the protection of Allah. Allah accepts repentance from his servants. So he went to Umar and said the same thing he said to Abu Bakr. Umar asked him what Abu Bakr said to him, so he went to the Messenger of Allah ﷺ and said that the other person had committed adultery. Sa'id said that the Messenger of Allah ﷺ turned away from him three times. All of that was rejected until he insisted on it. So he sent for his family and said, "Is he complaining? Is his father insane?" They said, "O Messenger of Allah, by Allah, he is telling the truth." Then the Messenger of Allah ﷺ said, "Is he your father or your stepfather?" He said, "But he is my stepfather." So the Messenger of Allah ﷺ ordered that he be stoned to death. Al-Husayn ibn Mansur al-Naysaburi informed us, saying: Ibn Numayr told us, saying: Yahya ibn Sa'id narrated to us, from Sa'id ibn al-Musayyib, that a man who had embraced Islam came to Abu Bakr al-Siddiq and mentioned something like it.
لَهُ أَبُو بَكْرٍ تُبْ إِلَى اللهِ فَاسْتَتِرْ بِسِتْرِ اللهِ فَإِنَّ اللهَ يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ فَأَتَى عُمَرَ فَقَالَ لَهُ مِثْلَ مَا قَالَ لِأَبِي بَكْرٍ فَقَالَ لَهُ عُمَرُ مَا قَالَ لَهُ أَبُو بَكْرٍ فَأَتَى رَسُولَ اللهِ ﷺ فَقَالَ إِنَّ الْآخَرَ قَدْ زِنَا قَالَ سَعِيدٌ فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ ثَلَاثَ مِرَارٍ كُلُّ ذَلِكَ يُعْرِضُ عَنْهُ حَتَّى إِذَا أَكْثَرَ عَلَيْهِ بَعَثَ إِلَى أَهْلِهِ فَقَالَ «أَيَشْتَكِي؟ أَبِهِ جِنَّةٌ؟» قَالُوا يَا رَسُولَ اللهِ وَاللهِ إِنَّهُ لَصَحِيحٌ فَقَالَ رَسُولُ اللهِ ﷺ «أَبِكْرٌ أَمْ ثَيِّبٌ» قَالَ «بَلْ ثَيِّبٌ فَأَمَرَ بِهِ رَسُولُ اللهِ ﷺ فَرُجِمَ» 7142 أَخْبَرَنَا الْحُسَيْنُ بْنُ مَنْصُورٍ النَّيْسَابُورِيُّ قَالَ حَدَّثَنَا ابْنُ نُمَيْرٍ قَالَ حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ أَنَّ رَجُلًا مِنْ أَسْلَمَ أَتَى أَبَا بَكْرٍ الصِّدِّيقَ فَذَكَرَ نَحْوَهُ
[Machine] From another man who had embraced Islam, he mentioned to the Messenger of Allah ﷺ that he had committed adultery. The Messenger then ordered that he be stoned. Sa'id mentioned that the Messenger of Allah ﷺ prayed the funeral prayer for one of them.
عَنْ رَجُلٍ آخَرَ مِنْ أَسْلَمَ ذَكَرَ لِرَسُولِ اللهِ ﷺ أَنَّهُ زَنَا «فَأَمَرَ بِهِ فَرُجِمَ» فَذَكَرَ سَعِيدٌ أَنَّ رَسُولَ اللهِ ﷺ صَلَّى عَلَى أَحَدِهِمَا
41.13 [Machine] Acknowledgment of adultery twice
٤١۔١٣ الِاعْتِرَافُ بِالزِّنَا مَرَّتَيْنِ
[Machine] I heard Jabir bin Samurah saying, "A short, unkempt man with muscular arms wearing a garment came to the Messenger of Allah ﷺ, confessing to having committed adultery twice. The Prophet then ordered him to be stoned."
سَمِعْتُ جَابِرَ بْنَ سَمُرَةَ يَقُولُ «اتِيَ رَسُولُ اللهِ ﷺ بِرَجُلٍ قَصِيرٍ أَشْعَثَ ذِي عَضَلَاتٍ عَلَيْهِ إِزَارٌ قَدْ زَنَا فَرَدَّهُ مَرَّتَيْنِ ثُمَّ أَمَرَ بِهِ فَرُجِمَ»
[Machine] "And the Messenger of Allah ﷺ was leaning on a pillow on his left. He said, 'And there were people between me and him, so he spoke to him, and I do not know what he is speaking to him. And I am watching,' He then said, 'Take him away,' so he went with him. Then he said, 'Bring him back,' so he was brought back. And he spoke to him, then he said, 'Take him away and stone him.'"
وَرَسُولُ اللهِ ﷺ مُتَّكِئٌ عَلَى وِسَادَةِ عَنْ يَسَارِهِ قَالَ وَبَيْنِي وَبَيْنَهُ الْقَوْمُ فَكَلَّمَهُ وَمَا أَدْرِي مَا يُكَلِّمُهُ وَأَنَا أَنْظُرُ ثُمَّ قَالَ «اذْهَبُوا بِهِ» فَانْطُلِقَ بِهِ ثُمَّ قَالَ «رُدُّوهُ» فَرُدَّ فَكَلَّمَهُ ثُمَّ قَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ»
41.14 [Machine] Another type of confession
٤١۔١٤ نَوْعٌ آخَرُ مِنَ الِاعْتِرَافِ
I was working in the market. A woman passed carrying a child. The people rushed towards her, and I also rushed along with them. I then went to the Prophet ﷺ while he was asking: Who is the father of this (child) who is with you? She remained silent. A young man by her side said: I am his father, Messenger of Allah! He then turned towards her and asked: Who is the father of this child with you? The young man said: I am his father, Messenger of Allah! The Messenger of Allah ﷺ then looked at some of those who were around him and asked them about him. They said: We only know good (about him). The Prophet ﷺ said to him: Are you married? He said: Yes. So he gave orders regarding him and he was stoned to death. He (the narrator) said: We took him out, dug a pit for him and put him in it. We then threw stones at him until he died. A man then came asking about the man who was stoned. We brought him to the Prophet ﷺ and said: This man has come asking about the wicked man. The Messenger of Allah ﷺ said: He is more agreeable than the fragrance of musk in the eyes of Allah. The man was his father. We then helped him in washing, shrouding and burying him. (The narrator said:) I do not know whether he said or did not say "in praying over him." This is the tradition of Abdah, and it is more accurate. (Using translation from Abū Dāʾūd 4435)
أَخْبَرَهُ أَنَّهُ كَانَ قَاعِدًا يَعْتَمِلُ فِي السُّوقِ فَمَرَّتِ امْرَأَةٌ تَحْمِلُ صَبِيًّا فَثَارَ النَّاسُ وَثُرْتُ فِيمَنْ ثَارَ فَانْتَهَيْتُ إِلَى النَّبِيِّ ﷺ وَهُوَ يَقُولُ «مَنْ أَبُو هَذَا مَعَكِ؟» فَسَكَتَتْ فَقَالَ شَابٌّ بِحِذْائِهَا أَنَا أَبُوهُ يَا رَسُولَ اللهِ قَالَ فَأَقْبَلَ عَلَيْهَا فَقَالَ «مَنْ أَبُو هَذَا مَعَكِ؟» فَسَكَتَتْ فَقَالَ الْفَتَى إِنَّهَا حَدِيثَةُ السِّنِّ حَدِيثَةُ عَهْدٍ بِخِزْيَةٍ وَلَيْسَتْ بِمُكَلِّمَتِكَ فَأَنَا أَبُوهُ فَنَظَرَ إِلَى بَعْضِ أَصْحَابِهِ كَأَنَّهُ يَسْأَلُهُمْ عَنْهُ فَقَالُوا مَا عَلِمْنَا إِلَّا خَيْرًا أَوْ نَحْوَ ذَا فَقَالَ لَهُ النَّبِيُّ ﷺ «أُحْصِنْتَ؟» قَالَ نَعَمْ فَأَمَرَ بِهِ يُرْجَمُ قَالَ فَخَرَجْنَا بِهِ فَحَفَرْنَا لَهُ حَتَّى أَمْكَنَّا ثُمَّ رَمَيْنَاهُ بِالْحِجَارَةِ حَتَّى هَدَأَ ثُمَّ انْصَرَفْنَا إِلَى مَجَالِسِنَا فَبَيْنَا نَحْنُ كَذَلِكَ إِذْ جَاءَ شَيْخٌ يَسْأَلُ عَنِ الْمَرْجُومِ فَقُمْنَا إِلَيْهِ فَأَخَذْنَا بِتَلَابِيبِهِ فَانْطَلَقْنَا بِهِ إِلَى النَّبِيِّ ﷺ فَقُلْنَا يَا رَسُولَ اللهِ إِنَّ هَذَا يَسْأَلُ عَنِ الْخَبِيثِ فَقَالَ رَسُولُ اللهِ ﷺ «مَهْ فَلَهُوَ أَطْيَبُ عِنْدَ اللهِ مِنْ رِيحِ الْمِسْكِ» فَانْصَرَفْنَا مَعَ الشَّيْخِ فَإِذَا هُوَ أَبُوهُ فَأتَيْنَا إِلَيْهِ فَأَعَنَّاهُ عَلَى غُسْلِهِ وَتَكْفِينِهِ قَالَ لَا أَدْرِي وَالصَّلَاةِ عَلَيْهِ أَمْ لَا
[Machine] We were working in the market when the Messenger of Allah ﷺ ordered for a man to be stoned. Then, a man came to us and asked who guided him to the place where he was stoned. So, we held onto him until we brought him to the Messenger of Allah ﷺ , and we said, "O Messenger of Allah, this man came to ask us about the wicked person who was stoned today." The Messenger of Allah ﷺ said, "Do not call him wicked, for by Allah, he is more fragrant to Allah than musk."
كُنَّا نَعْمَلَ فِي السُّوقِ فَأَمَرَ رَسُولُ اللهِ ﷺ بِرَجُلٍ فَرُجِمَ فَجَاءَهُ رَجُلٌ فَسَأَلَنَا مَنْ نَدُلُّهُ عَلَى مَكَانِهِ الَّذِي رُجِمَ فِيهِ؟ فَتَعَلَّقْنَا بِهِ حَتَّى أَتَيْنَا بِهِ رَسُولَ اللهِ ﷺ فَقُلْنَا يَا رَسُولَ اللهِ إِنَّ هَذَا جَاءَ لِيَسْأَلَنَا عَنْ ذَلِكَ الْخَبِيثِ الَّذِي رَجَمْتَ الْيَوْمَ فَقَالُ رَسُولُ اللهِ ﷺ «لَا تَقُولُوا خَبِيثٌ فَوَاللهِ لَهُوَ أَطْيَبُ عِنْدَ اللهِ مِنَ الْمِسْكِ»
41.15 [Machine] Another Type of Confession
٤١۔١٥ نَوْعٌ آخَرُ مِنَ الِاعْتِرَافِ
[Machine] "O Messenger of Allah, purify me." He said, "Woe to you, go back and seek forgiveness from Allah and repent to Him." She said, "Perhaps you intend to return me as you returned Ma'iz ibn Malik?" He asked, "What is that?" She said, "It is my pregnancy from adultery." He asked, "Are you pregnant?" She replied, "Yes." He said, "We will not stone you until you give birth." So a man from the Ansar took responsibility for her until she gave birth, and then he came to the Prophet ﷺ and said, "O Prophet of Allah, she has given birth." The Prophet ﷺ said, "In that case, we will not stone her and we will leave her child, who is an infant, with no one to nurse him." So a man from the Ansar stood up and said, "I will nurse him, O Messenger of Allah." So he was stoned.
يَا رَسُولَ اللهِ طَهِّرْنِي قَالَ «وَيْحَكِ ارْجِعِي فَاسْتَغْفِرِي اللهَ وَتُوبِي إِلَيْهِ» فَقَالَتْ لَعَلَّكَ تُرِيدُ أَنْ تَرُدُّنِي كَمَا رَدَدْتَ مَاعِزَ بْنَ مَالِكٍ؟ قَالَ «وَمَا ذَاكَ؟» قَالَتْ إِنَّهَا حُبْلَى مِنَ الزِّنَا قَالَ «أَثَيِّبٌ أَنْتِ؟» قَالَتْ نَعَمْ قَالَ «فَلَا نَرْجُمُكِ حَتَّى تَضَعِي مَا فِي بَطْنِكِ» قَالَ فَكَفَلَهَا رَجُلٌ مِنَ الْأَنْصَارِ حَتَّى وَضَعَتْ وَأَتَى إِلَى النَّبِيِّ ﷺ فَقَالَ قَدْ وَضَعَتِ الْغَامِدِيَّةُ فَقَالَ «إِذًا لَا نَرْجُمُهَا وَنَدَعُ وَلَدَهَا صَغِيرًا لَيْسَ لَهُ مَنْ يُرْضِعُهُ» فَقَامَ رَجُلٌ مِنَ الْأَنْصَارِ فَقَالَ إِلَيَّ رَضَاعُهُ يَا نَبِيَّ اللهِ فَرَجَمَهَا
[Machine] A woman came to the Prophet ﷺ and said, "I have committed adultery, so impose the prescribed punishment on me." He said, "Go and breastfeed your child first." When she had weaned her child, she came to him and said, "O Messenger of Allah, I have committed adultery, so impose the prescribed punishment on me." He said, "Bring someone to nurse your child." A man got up and said, "I will nurse her child, O Messenger of Allah." So, he ordered that she be stoned.
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَقَالَتْ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ الْحَدَّ فَقَالَ «انْطَلِقِي حَتَّى تَفْطِمِي وَلَدَكِ» فَلَمَّا فَطَمَتْ وَلَدَهَا أَتَتْ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ الْحَدَّ فَقَالَ «هَاتِ مَنْ يَكْفُلُ وَلَدَكِ» فَقَامَ رَجُلٌ فَقَالَ أَنَا أَكْفُلُ وَلَدَهَا يَا رَسُولَ اللهِ فَرَجَمَهَا
41.16 [Machine] Confession once, mentioning the disagreement of Al-Oza'iy, and Hisham on Yahya Ibn Abi Kathir in the news of Imran Ibn Husayn in it
٤١۔١٦ الِاعْتِرَافُ مَرَّةً وَاحِدَةً، وَذِكْرُ اخْتِلَافِ الْأَوْزَاعِيِّ، وَهِشَامٌ عَلَى يَحْيَى بْنِ أَبِي كَثِيرٍ فِي خَبَرِ عِمْرَانَ بْنِ حُصَيْنٍ فِيهِ
Allah's Apostle, I have done something for which (prescribed punishment) must be imposed upon me, so impose that. Allah's Apostle ﷺ called her master and said: Treat her well, and when she delivers bring her to me. He did accordingly. Then Allah's Apostle ﷺ pronounced judgment about her and her clothes were tied around her and then he commanded and she was stoned to death. He then prayed over her (dead body). Thereupon Umar said to him: Allah's Apostle, you offer prayer for her, whereas she had committed adultery! Thereupon he said: She has made such a repentance that if it were to be divided among seventy men of Medina, it would be enough. Have you found any repentance better than this that she sacr ficed her life for Allah, the Majestic? (Using translation from Muslim 1696a)
أَقْبَلَتِ امْرَأَةٌ إِلَى رَسُولِ اللهِ ﷺ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَدَعَا وَلِيَّهَا فَقَالَ أَحْسِنْ إِلَى هَذِهِ حَتَّى تَضَعَ مَا فِي بَطْنِهَا فَإِذَا وَضَعَتْ مَا فِي بَطْنِهَا فَائْتِ بِهَا فَلَمَّا وَضَعَتْ مَا فِي بَطْنِهَا أُتِيَ بِهَا رَسُولَ اللهِ ﷺ فَأَمَرَ بِهَا رَسُولُ اللهِ ﷺ فَشَكَتْ عَلَيْهَا ثِيَابَهَا ثُمَّ أَمَرَ بِهَا فَرُجِمَتْ ثُمَّ صَلَّى عَلَيْهَا فَقَالَ عُمَرُ يَا رَسُولَ اللهِ أَتُصَلِّي عَلَيْهَا وَقَدْ زَنَتْ؟ قَالَ قَدْ تَابَتْ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ سَبْعِينَ لَوَسِعَتْهُمْ وَهَلْ وَجَدَتْ تَوْبَةً أَفْضَلَ مِنْ أَنْ جَادَتْ بِمُهْجَةِ نَفْسِهَا لِلَّهِ؟
A woman belonging to the tribe of Juhaynah (according to the version of Aban) came to the Prophet ﷺ and said that she had committed fornication and that she was pregnant. The Messenger of Allah ﷺ called her guardian. Then the Messenger of Allah ﷺ said to him: Be good to her, and when she bears a child, bring her (to me). When she gave birth to the child, he brought her (to him). The Prophet ﷺ gave orders regarding her, and her clothes were tied to her. He then commanded regarding her and she was stoned to death. He commanded the people (to pray) and they prayed over her. Thereupon Umar said: Are you praying over her, Messenger of Allah, when she has committed fornication? He said: By Him in Whose hand my soul is, she has repented to such an extent that if it were divided among the seventy people of Medina, it would have been enough for them all. And what do you find better than the fact that she gave her life. Aban did not say in his version: Then her clothes were tied to her. (Using translation from Abū Dāʾūd 4440)
أَنَّ امْرَأَةً مِنْ جُهَيْنَةَ أَتَتْ رَسُولَ اللهِ ﷺ فَقَالَتْ إِنِّي زَنَيْتُ وَهِيَ حُبْلَى فَدَفَعَهَا إِلَى وَلِيِّهَا فَقَالَ «أَحْسِنْ إِلَيْهَا فَإِذَا وَضَعَتْ فَائْتِنِي بِهَا» فَلَمَّا وَضَعَتْ جَاءَ بِهَا فَأَمَرَ بِهَا فَشَكَتْ عَلَيْهَا ثِيَابَهَا ثُمَّ رَجَمَهَا ثُمَّ صَلَّى عَلَيْهَا فَقَالَ لَهُ عُمَرُ تُصَلِّي عَلَيْهَا وَقَدْ زَنَتْ؟ فَقَالَ «لَقَدْ تَابَتْ تَوْبَةً لَوْ قُسِمَتْ بَيْنَ سَبْعِينَ مِنْ أَهْلِ الْمَدِينَةِ لَوَسِعَتْهُمْ وَهَلْ وَجَدْتَ أَفْضَلَ مِنْ أَنْ جَادَتْ بِنَفْسِهَا لِلَّهِ؟» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَبُو الْمُهَاجِرِ خَطَأٌ وَالصَّوَابُ أَبُو الْمُهَلَّبِ وَأَبُو قِلَابَةَ اسْمُهُ عَبْدُ اللهِ بْنُ زَيْدٍ
"We were with the Prophet [SAW] when a man stood up and said: 'I adjure you, by Allah, pass judgment between us according to the Book of Allah.' His opponent, who was wiser than him, stood up and said: 'He is right, pass judgment between us according to the Book of Allah.' He said: 'Speak.' He said: 'My son was a laborer serving this man, and he committed Zina with his wife. I ransomed him with one hundred sheep and a servant.' It is as if he was told that his son was to be stoned to death but he ransomed him from that. 'Then I asked some knowledgeable men and they told me that my son was to be given one hundred lashes and exiled for a year.' The Messenger of Allah [SAW] said to him: 'By the One in Whose hand is my soul, I will pass judgment between you according to the Book of Allah, the Mighty and Sublime. As for the one hundred sheep and the servant, take them back, and your son is to be given one hundred lashes and exiled for a year. O Unais, go tomorrow to the wife of this man and if she confesses, then stone her to death.' She did confess, so he stoned her to death." (Using translation from Nasāʾī 5411)
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ وَشِبْلٍ قَالُوا كُنَّا عِنْدَ رَسُولِ اللهِ ﷺ فَقَامَ إِلَيْهِ رَجُلٌ فَقَالَ أَنْشُدُكَ بِاللهِ قَضَيْتَ بَيْنَنَا بِكِتَابِ اللهِ فَقَامَ خَصْمُهُ وَكَانَ أَفْقَهَ مِنْهُ فَقَالَ أَجَلِ اقْضِ بَيْنَنَا بِكِتَابِ اللهِ قَالَ «قُلْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَخَادِمٍ كَأَنَّهُ أُخْبِرَ أَنَّهُ عَلَى ابْنِهِ الرَّجْمُ فَافْتَدَى بِهِ ثُمَّ سَأَلْتُ رِجَالًا مِنْ أَهْلِ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ فَقَالَ لَهُ النَّبِيُّ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ الْمِائَةُ شَاةٍ وَالْخَادِمُ رَدٌّ عَلَيْكَ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَاغْدُ يَا انَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَرَجَمَهَا»
Two men brought a dispute before the Messenger of Allah ﷺ. One of them said: Pronounce judgement between us in accordance with Allah’s Book, Messenger of Allah! The other who had more understanding said: Yes, Messenger of Allah! Pronounce judgement between us in accordance with Allah’s Book, and allow me to speak. He (the Prophet) said: Speak, He then said: My son who was a hired servant with this(man) committed fornication with his wife, and when I was told that my son must be stoned to death, I ransomed him with a hundred sheep and a slave girl of mine; but when I asked the learned, they told me that my son should receive a hundred lashes and be banished for a year, and that stoning to death applied only to man’s wife. The apostle of Allah ﷺ replied: By him in whose hand my soul is, I shall certainly pronounce judgment between you in accordance with Allah’s Book. Your sheep and your slave girl must be returned to you, and your son shall receive a hundred lashes and be banished for a year. And he commanded Unias al-Aslami go to that man’s wife, and if she confessed, he should stone her to death. She confessed and he stoned her. (Using translation from Abū Dāʾūd 4445)
أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ أَحَدُهُمَا اقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَقَالَ الْآخَرُ وَهُوَ أَفْقَهُهُمَا يَا رَسُولَ اللهِ ائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ قَالَ «تَكَلَّمْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَجَارِيَةٍ ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَذَكَرَ كَلِمَةً مَعْنَاهَا وَتَغْرِيبُ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ فَقَالَ رَسُولُ اللهِ ﷺ «أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ عَلَيْكَ» وَجَلَدَ يَعْنِي ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ انَيْسًا أَنْ يَأْتِيَ امْرَأَةَ الْآخَرِ فَإِنِ اعْتَرَفَتْ رَجَمَهَا فَاعْتَرَفَتْ فَرَجَمَهَا
A bedouin came to Messenger of Allah ﷺ and said, "O Allah's apostle! I ask you by Allah to judge My case according to Allah's Laws." His opponent, who was more learned than he, said, "Yes, judge between us according to Allah's Laws, and allow me to speak." Messenger of Allah ﷺ said, "Speak." He (i .e. the bedouin or the other man) said, "My son was working as a laborer for this (man) and he committed illegal sexual intercourse with his wife. The people told me that it was obligatory that my son should be stoned to death, so in lieu of that I ransomed my son by paying one hundred sheep and a slave girl. Then I asked the religious scholars about it, and they informed me that my son must be lashed one hundred lashes, and be exiled for one year, and the wife of this (man) must be stoned to death." Messenger of Allah ﷺ said, "By Him in Whose Hands my soul is, I will judge between you according to Allah's Laws. The slave-girl and the sheep are to be returned to you, your son is to receive a hundred lashes and be exiled for one year. You, Unais, go to the wife of this (man) and if she confesses her guilt, stone her to death." Unais went to that woman next morning and she confessed. Messenger of Allah ﷺ ordered that she be stoned to death. (Using translation from Bukhārī 2724)
عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ أَنَّهُمَا قَالَا إِنَّ رَجُلًا مِنَ الْأَعْرَابِ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَنْشُدُكَ أَلَا قَضَيْتَ لِي بِكِتَابِ اللهِ فَقَالَ الْخَصْمُ الْآخَرُ وَهُوَ أَفْقَهُ مِنْهُ نَعَمْ فَاقْضِ بَيْنَنَا بِكِتَابِ اللهِ وَائْذَنْ لِي قَالَ رَسُولُ اللهِ ﷺ «قُلْ» قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ وَإِنِّي اخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَوَلِيدَةٍ فَسَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ مَا عَلَى ابْنِي مِائَةُ جَلْدَةٍ وَتَغْرِيبُ عَامٍ وَأَنْ عَلَى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللهِ الْوَلِيدَةُ وَالْغَنَمُ رَدٌّ وَعَلَى ابْنِكِ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ اغْدُ يَا أُنَيْسُ عَلَى امْرَأَةِ هَذَا فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا» فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَأَمَرَ بِهَا رَسُولُ اللهِ ﷺ فَرُجِمَتْ
[Machine] I heard Abu Hurairah saying, "Two men came to the Prophet ﷺ and said, 'O Messenger of Allah, judge between me and this man. My son was a hired worker for his wife, and he committed adultery with her. I asked those who do not know, and they informed me that my son should be stoned to death, so I ransomed him with such and such.' Then I asked those who know, and they informed me that my son should not be stoned to death.' The Prophet ﷺ said, 'I will judge between you according to the truth. As for what you have given, it will be returned to you. As for your son, he will be whipped a hundred lashes and banished for a year. And as for his wife, she will be stoned to death.'"
سَمِعْتَ أَبَا هُرَيْرَةَ يَقُولُ أَتَى رَجُلَانِ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ اقْضِ بَيْنِي وَبَيْنَ هَذَا كَانَ ابْنِي أَجِيرًا لِامْرَأَتِهِ وَابْنِي لَمْ يُحْصَنْ فَزَنَا بِهَا فَسَأَلْتُ مَنْ لَا يَعْلَمُ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ مِنْهُ بِكَذَا وَكَذَا ثُمَّ سَأَلْتُ مِنْ يَعْلَمُ فَأَخْبَرُونِي أَنْ لَيْسَ عَلَى ابْنِي الرَّجْمُ قَالَ النَّبِيُّ ﷺ «لَأَقْضِيَنَّ بَيْنَكُمَا بِالْحَقِّ أَمَّا مَا أَعْطَيْتَهُ فَرَدٌّ عَلَيْكَ وَأَمَّا ابْنُكَ فَنَجْلِدُهُ مِائَةً وَنُغَرِّبُهُ سَنَةً وَأَمَّا امْرَأَتُهُ فَتُرْجَمُ»
41.17 [Machine] How should a woman be treated during stoning and mentioning the differences in that?
٤١۔١٧ كَيْفَ يُفْعَلُ بِالْمَرْأَةِ عِنْدَ الرَّجْمِ، وَذِكْرُ الِاخْتِلَافِ فِي ذَلِكَ
[Machine] A woman from Juhayna confessed to the Prophet ﷺ about adultery and said, "I am pregnant." The Prophet ﷺ called her guardian and advised him to treat her kindly and inform him when she gives birth. He did so and informed the Prophet ﷺ, who then ordered that her clothes be tightened on her and commanded her stoning. After that, he offered the funeral prayer for her.
أَنَّ امْرَأَةً مِنْ جُهَيْنَةَ اعْتَرَفَتْ عِنْدَ النَّبِيِّ ﷺ بِالزِّنَا وَقَالَتْ إِنِّي حُبْلَى فَدَعَا النَّبِيُّ ﷺ وَلِيَّهَا فَقَالَ «أَحْسِنْ إِلَيْهَا فَإِذَا وَضَعَتْ فَأَخْبِرْنِي فَفَعَلَ فَأَخْبَرَ بِهَا النَّبِيَّ ﷺ فَشُكَّتْ عَلَيْهَا ثِيَابَهَا ثُمَّ أَمَرَ بِرَجْمِهَا فَرُجِمَتْ ثُمَّ صَلَّى عَلَيْهَا»
a woman came to the Prophet ﷺ and confessed to committing fornication. He issued orders, and her garments were tightened around her (so that her private parts would not become uncovered) then he stoned her, then he offered the funeral prayer for her. (Using translation from Ibn Mājah 2555)
أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ﷺ فَاعْتَرَفَتْ بِالزِّنَا فَأَمَرَ بِهَا رَسُولُ اللهِ ﷺ «فَشَكَتْ عَلَيْهَا ثِيَابَهَا يَعْنِي شُدَّ عَلَيْهَا ثِيَابُهَا ثُمَّ رَجَمَهَا ثُمَّ صَلَّى عَلَيْهَا» أَرْسَلَهُ أَيُّوبُ
41.18 [Machine] The woman's pit to her grave.
٤١۔١٨ الْحُفْرَةُ لِلْمَرْأَةِ إِلَى ثِنْدُوتِهَا
[Machine] I witnessed the Prophet ﷺ standing on his mount when a woman with a baby bump came to him and said that she committed adultery and asked him to stone her. The Prophet ﷺ told her to cover herself with the protection of Allah and she went away. She returned to the Prophet ﷺ while he was still on his mount and asked him again to stone her. Again, the Prophet ﷺ told her to seek the protection of Allah and she went away. Then a third woman came to him while he was still on his mount and grabbed the reins of the mount, saying that she would not let go unless the Prophet ﷺ stoned her. He told her to let go and go away, and she did. Later on, she gave birth to a baby boy and brought him to the Prophet ﷺ , who spoke to the baby and then told the woman to go and perform ablution to cleanse herself from the blood. She did so and then came back. The Prophet ﷺ sent some women to examine her and see if she was clear from the blood. They testified to her purity in front of the Prophet ﷺ . He then ordered for a pit to be dug for her and he and the Muslims gathered around. He took a stone in his hand, the size of a chickpea or a date stone, and threw it at her. Then he told the Muslims to throw stones at her, but to avoid hitting her face. They threw the stones until she was killed. The Prophet ﷺ then ordered to bury her and he prayed for her. Afterwards, he said that if her reward was distributed among the people of Hijaz, it would suffice them all.
شَهِدْتُ النَّبِيَّ ﷺ وَهُوَ وَاقِفٌ عَلَى بَغْلَتِهِ فَجَاءَتْهُ امْرَأَةٌ حُبْلَى فَقَالَتْ إِنَّهَا قَدْ بَغَتْ فَارْجُمْهَا فَقَالَ لَهَا النَّبِيُّ ﷺ «اسْتَتِرِي بِسِتْرِ اللهِ» فَذَهَبَتْ ثُمَّ رَجَعَتْ إِلَى النَّبِيِّ ﷺ وَهُوَ وَاقِفٌ عَلَى بَغْلَتِهِ فَقَالَتْ ارْجُمْهَا فَقَالَ النَّبِيُّ ﷺ اسْتَتِرِي بِسِتْرِ اللهِ فَرَجَعَتْ ثُمَّ جَاءَتِ الثَّالِثَةَ وَهُوَ وَاقِفٌ عَلَى بَغْلَتِهِ فَأَخَذَتْ بِاللِّجَامِ فَقَالَتْ أَنْشُدُكَ اللهَ إِلَّا رَجَمْتَهَا قَالَ «انْطَلِقِي فَلِدِي» فَانْطَلَقَتْ فَوَلَدَتْ غُلَامًا فَجَاءَتْ بِهِ النَّبِيَّ ﷺ فَكَلَّمَهُ النَّبِيُّ ﷺ ثُمَّ قَالَ انْطَلِقِي فَتَطَهَّرِي مِنَ الدَّمِ فَانْطَلَقَتْ فَتَطَهَّرَتْ مِنَ الدَّمِ ثُمَّ جَاءَتْ فَبَعَثَ النَّبِيُّ ﷺ إِلَى نِسْوَةٍ فَأَمَرَهُنَّ أَنْ يَسْتَبْرِئْنَهَا وَأَنْ يَنْظُرْنَ أَطَهُرَتْ مِنَ الدَّمِ؟ فَجِئْنَ فَشَهِدْنَ عِنْدَ النَّبِيِّ ﷺ بِطُهْرِهَا فَأَمَرَ لَهَا النَّبِيُّ ﷺ بِحُفْرَةٍ إِلَى ثِنْدُوَتِهَا ثُمَّ أَقْبَلَ هُوَ وَالْمُسْلِمُونَ فَقَالَ بِيَدِهِ فَأَخَذَ حَصَاةً كَأَنَّهَا حِمَّصَةٌ أَوْ مِثْلَ الْحِمِّصَةِ فَرَمَاهَا ثُمَّ قَالَ لِلْمُسْلِمِينَ «ارْمُوهَا وَإِيَّاكُمْ وَجْهَهَا» فَرَمُوهَا حَتَّى طُفِئَتْ فَأَمَرَ بِإِخْرَاجِهَا فَصَلَّى عَلَيْهَا ثُمَّ قَالَ «لَوْ قُسِمَ أَجْرُهُا بَيْنَ أَهْلِ الْحِجَازِ لَوَسِعَهُمْ»
[Machine] I was sitting with the Prophet ﷺ when a woman came to him and said, "O Prophet of Allah, I have committed adultery and I want you to purify me." The Prophet ﷺ told her to go back. The next day she came to him and confessed to him her adultery, saying, "O Prophet of Allah, purify me, for perhaps you want to treat me like Ma'iz bin Malik." She then begged him saying, "I am pregnant." The Prophet ﷺ told her to go back until she gives birth. After she gave birth, she came to him carrying the baby in a piece of cloth, saying, "O Prophet of Allah, I have given birth." He told her to go and breastfeed the baby until he is weaned. When she weaned him, she came to him with the baby in her hand, holding a piece of bread, and said, "O Prophet of Allah, I have weaned him." He ordered for the baby to be given to a Muslim man and for a hole to be dug for her. She was then placed in the hole up to her chest, and the people were ordered to stone her. Khalid bin Al-Walid came forward with a stone and threw it at her, causing blood to splatter on his face or forehead. He cursed her, and the Prophet ﷺ heard him cursing her. He said, "Wait, O Khalid. Do not curse her. By the One in whose hand is my soul, she has repented with a repentance that if it were divided among the inhabitants of Makkah, it would have sufficed them all." The Prophet ﷺ ordered for her to be shrouded, prayed for her, and she was buried.
كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَتْهُ امْرَأَةٌ فَقَالَتْ يَا نَبِيَّ اللهِ إِنِّي قَدْ زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهَا النَّبِيُّ ﷺ «ارْجِعِي» فَلَمَّا كَانَ مِنَ الْغَدِ أَتَتْهُ فَاعْتَرَفَتْ عِنْدَهُ بِالزِّنَا فَقَالَتْ يَا نَبِيَّ اللهِ طَهِّرْنِي لَعَلَّكَ تُرِيدُ أَنْ تَرُدَّنِي كَمَا رَدَدْتَ مَاعِزَ بْنَ مَالِكٍ فَوَاللهِ إِنِّي لَحُبْلَى فَقَالَ لَهَا النَّبِيُّ ﷺ «ارْجِعِي حَتَّى تَلِدِي» فَلَمَّا وَلَدَتْ جَاءَتْهُ بِالصَّبِيِّ تَحْمِلُهُ فِي خِرْقَةٍ فَقَالَتْ يَا نَبِيَّ اللهِ هَذَا قَدْ وَلَدْتُ قَالَ «فَاذْهَبِي فَأَرْضِعِيهِ حَتَّى تَفْطِمِيهِ» فَلَمَّا فَطَمَتْهُ جَاءَتْ بِالصَّبِيِّ فِي يَدِهِ كِسْرَةَ خُبْزٍ فَقَالَتْ يَا نَبِيَّ اللهِ هَذَا قَدْ فَطَمْتُهُ فَأَمَرَ بِالصَّبِيِّ فَدَفَعَهُ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ وَأَمَرَ بِهَا فَحَفَرَ لَهَا حُفْرَةً فَجُعِلَتْ فِيهَا إِلَى صَدْرِهَا ثُمَّ أَمْرَ النَّاسَ أَنْ يَرْجُمُوهَا فَأَقْبَلَ خَالِدُ بْنُ الْوَلِيدِ بِحَجَرٍ فَرَمَاهَا فَانْتَضَحَ الدَّمُ عَلَى وَجْهِ خَالِدٍ أَوْ جَبْهَتِهِ فَسَبَّهَا فَسَمِعَ النَّبِيُّ ﷺ سَبَّهُ إِيَّاهَا فَقَالَ «مَهْلًا يَا خَالِدُ لَا تَسُبَّهَا فَوَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ تَابَتْ تَوْبَةً لَوْ تَابَهَا صَاحِبُ مَكْسٍ لَقُبِلَ مِنْهُ فَأَمَرَ بِهَا فَكُفِّنَتْ وَصَلَّى عَلَيْهَا وَدُفِنَتْ»
41.19 [Machine] How is it done by the man and mentioning the difference of the carriers of the news in that
٤١۔١٩ كَيْفُ يُفْعَلُ بِالرَّجُلِ، وَذِكْرُ اخْتِلَافِ النَّاقِلِينَ لِلْخَبَرِ فِي ذَلِكَ
[Machine] "Ma'iz ibn Malik came to the Prophet ﷺ and said, 'I have committed a grave sin,' and he mentioned a word with its meaning. The Prophet repeated it a few times, then some people asked, 'Is there any punishment for him?' It was said, 'There is no punishment for him.' So he commanded us and we took him to Bani Gharqad. We did not dig a hole for him nor did we tie him up, but we threw him with stones made of pottery and waste. He ran away and we pursued him until he reached Al-Harrah, where he mentioned a word with its meaning. He stood still and we threw him with big stones until he died."
أَنَّ مَاعِزَ بْنَ مَالِكٍ اتِيَ النَّبِيَّ ﷺ فَقَالَ إِنِّي أَصَبْتُ فَاحِشَةً وَذَكَرَ كَلِمَةً مَعْنَاهَا فَرَدَّهُ مِرَارًا فَسَأَلَ قَوْمٌ أَبِهِ بَأْسٌ؟ قِيلَ «مَا بِهِ بَأْسٌ فَأَمَرَنَا فَانْطَلَقْنَا بِهِ إِلَى بَقِيعِ الْغَرْقَدِ فَلَمْ نَحْفُرْ لَهُ وَلَمْ نَوثِقْهُ فَرَمَيْنَاهُ بَخَزَفِ وَجَنْدَلٍ فَسَعَى وَابْتَدَرْنَا خَلْفَهُ فَأَتَى الْحَرَّةَ ثُمَّ ذَكَرَ كَلَامًا مَعْنَاهُ فَانْتَصَبَ لَنَا فَرَمَيْنَاهُ بِجَلَامِيدٍ حَتَّى سَكَنَ»
[Machine] Ma'iz bin Malik came to the Prophet ﷺ and confessed to committing adultery four times. The Prophet ﷺ asked about him, then he commanded that he be stoned to death. We stoned him with stones, clay bricks, and bones, and we did not leave any pit or cleft without filling it. We preceded him to the "Harrah" and followed him there. He stood up for us, and we stoned him until he became silent. The Prophet ﷺ did not ask for forgiveness for him nor did he curse him.
جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ فَاعْتَرَفَ بِالزِّنَا أَرْبَعَ مَرَّاتٍ فَسَأَلَ عَنْهُ النَّبِيُّ ﷺ «ثُمَّ أَمَرَ بِهِ فَرُجِمَ فَرَجَمْنَاهُ بَالْخَزَفِ وَالْجَنْدَلِ وَالْعِظَامِ وَمَا حَفَرْنَا لَهُ وَمَا أَوْثَقْنَاهُ فَسَبَقَنَا إِلَى الْحَرَّةِ فَاتَّبَعْنَاهُ فَقَامَ لَنَا فَرَمَيْنَاهُ حَتَّى سَكَتَ فَمَا اسْتَغْفَرَ لَهُ النَّبِيُّ ﷺ وَلَا سَبَّهُ»
[Machine] I heard Abu Huraira saying, "A man came to the Prophet ﷺ and said, 'O Messenger of Allah, I have committed adultery.' The Prophet asked him, 'O woe to you! Do you know what adultery is?' The man replied, 'Yes, it is when a man engages in sexual relations with a woman who is not lawful for him, just as he would do with his own wife.' The Prophet told him, 'Go away.' He came back and passed by a man called Al-Nazzal and said to him, 'Did you not see that I came to the Prophet ﷺ and said to him, "O Messenger of Allah, I have committed adultery," and he asked me, "O woe to you! Do you know what adultery is?" and I replied, "Yes, it is when a man engages in sexual relations with a woman who is not lawful for him, just as he would do with his own wife," and he sent me away?' The man said to him, 'Go back to him.' So he went back to the Prophet ﷺ and said, 'O Messenger of Allah, I have committed adultery.' The Prophet asked him the same question, and he gave the same answer. This happened three times, and each time the Prophet told him to go away. Then the Prophet asked him, 'Have you done it and then left it?' He replied, 'Yes.' The Prophet said, 'Woe to you! The whole day is a punishment for you.' Then he ordered that he be stoned, and said, 'Killing him is the duty of the people of the Nazzal tribe.' So he was stoned to death and died. Two men from among the Prophet's companions passed by and said, 'Look at this man, who came to the Prophet ﷺ with all of that and the Prophet ﷺ rejected him, but he insisted on being killed, like a dog.' The Prophet ﷺ heard that and passed by a dead donkey lying on its side with its legs in the air. He said, 'O two of you, come and eat from this.' They said, 'O Messenger of Allah, who would eat from this?' He said, 'What you refused to eat before from your brother (meaning the stoned man) was worse than this. By the One in Whose Hand is my soul, I have seen him in Paradise, dipping himself in rivers of Paradise.'"
سَمِعْتُ أَبَا هُرَيْرَةَ يَقُولُ إِنَّ رَجُلًا أَتَى نَبِيَّ اللهِ ﷺ فَقَالَ يَا نَبِيَّ اللهِ إِنِّي زَنَيْتُ قَالَ «أَيْ وَيْحَكَ وَهَلْ تَدْرِي مَا الزِّنَا؟» قَالَ نَعَمْ يُصِيبُ الرَّجُلُ مِنَ الْمَرْأَةِ الَّتِي لَا تَحِلُّ لَهُ كَمَا يُصِيبُ مِنْ أَهْلِهِ فَقَالَ لَهُ «انْطَلُقْ» فَرَدَّهُ فَمَرَّ بِرَجُلٍ يُقَالُ لَهُ النَّزَّالُ فَقَالَ أَلَمْ تَرَ أَنِّي أَتَيْتُ النَّبِيَّ ﷺ فَقُلْتُ يَا نَبِيَّ اللهِ إِنِّي قَدْ زَنَيْتَ فَقَالَ لِي «أَيْ وَيْحَكَ وَهَلْ تَدْرِي مَا الزِّنَا؟» قُلْتُ نَعَمْ يُصِيبُ الرَّجُلُ مِنَ الْمَرْأَةِ الَّتِي لَا تَحِلُّ لَهُ كَمَا يُصِيبُ مِنْ أَهْلِهِ وَإِنَّهُ رَدَّنِي؟ فَقَالَ لَهُ عُدْ إِلَيْهِ فَأَتَاهُ فَقَالَ لَهُ يَا نَبِيَّ اللهِ إِنِّي زَنَيْتُ قَالَ «أَيْ وَيْحَكَ وَهَلْ تَدْرِي مَا الزِّنَا؟» قَالَ نَعَمْ يُصِيبُ الرَّجُلُ مِنَ الْمَرْأَةِ الَّتِي لَا تَحِلُّ لَهُ كَمَا يُصِيبُ مِنْ أَهْلِهِ فَقَالَ لَهُ «انْطَلِقْ» فَرَدَّهُ فَأَتَى النَّزَّالَ فَقَالَ لَهُ عُدْ إِلَيْهِ فَعَادَ إِلَيْهِ فَقَالَ لَهُ يَا نَبِيَّ اللهِ إِنِّي قَدْ زَنَيْتُ قَالَ «أَيْ وَيْحَكَ وَهَلْ تَدْرِي مَا الزِّنَا؟» فَقَالَ مِثْلَ ذَلِكَ فَرَدَّهُ فَأَتَى النَّزَّالَ فَقَالَ لَهُ عُدْ إِلَيْهِ فَعَادَ إِلَيْهِ الرَّابِعَةَ فَقَالَ يَا نَبِيَّ اللهِ قَدْ زَنَيْتُ قَالَ «أَيْ وَيْحَكَ وَهَلْ تَدْرِي مَا الزِّنَا؟» قَالَ نَعَمْ يُصِيبُ الرَّجُلُ مِنَ الْمَرْأَةِ الَّتِي لَا تَحِلُّ لَهُ كَمَا يُصِيبُ مِنْ أَهْلِهِ فَقَالَ لَهُ «هَلْ أَدْخَلْتَ وَأَخْرَجْتَ؟» قَالَ نَعَمْ قَالَ النَّبِيُّ ﷺ «تَبًّا لَكَ سَائِرَ الْيَوْمِ» فَأَمَرَ بِرَجْمِهِ وَقَالَ «أَهْلَكَهُ النَّزَّالُ» ثَلَاثًا قَالَ فَرُجِمَ فَانْتَهَى إِلَى أَصْلِ شَجَرَةٍ فَاضْطَجَعَ وَتَوَسَّدَ يَمِينِهِ حَتَّى قُتِلَ فَمَرَّ بِهِ رَجُلَانِ مِنْ أَصْحَابِ النَّبِيِّ ﷺ فَقَالَا انْظُرَا إِلَى هَذَا الَّذِي أَتَى النَّبِيَّ ﷺ كُلَّ ذَلِكَ يَرُدُّهُ فَأَبَى إِلَّا أَنْ يُقْتَلَ قَتْلَ الْكَلْبِ فَسَمِعَ النَّبِيُّ ﷺ فَمَرَّ بِحِمَارٍ مَيِّتٍ شَائِلٍ رِجْلَهُ فَقَالَ «يَا هَذَانِ تَعَالَيَا فَكُلَا» قَالَا يَا نَبِيَّ اللهِ وَهَلْ أَحَدٌ يَأْكُلُ مِنْ هَذَا؟ قَالَ «مَا نِلْتُمَا قَبْلُ مِنْ أَخِيكُمَا كَانَ أَشَدَّ مِنْ هَذَا وَالَّذِي نَفْسِي بِيَدِهِ لَقَدْ رَأَيْتُهُ بَيْنَ أَنْهَارِ الْجَنَّةِ يَنْغَمِسُ» قَالَ يَعْنِي يَتَنَعَّمُ
[Machine] About a man from the companions of the Prophet ﷺ who said: Ma'iz ibn Malik came to the Prophet ﷺ four times, each time he would confess and say, "Have you informed anyone other than me?" Then the Prophet ﷺ ordered for him to be stoned, and they took him to a place where his chest would touch the wall. He then ran away, and a man threw a stone which hit him on the base of his ears, causing him to fall and die.
عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ قَالَ جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ أَرْبَعَ مَرَّاتٍ كُلَّ ذَلِكَ يَرُدَّهُ وَيَقُولُ «أَخْبَرْتَ أَحَدًا غَيْرِي» ثُمَّ أَمَرَ بِرَجْمِهِ فَذَهَبُوا بِهِ إِلَى مَكَانٍ يَبْلُغُ صَدْرَهَ إِلَى حَائِطٍ فَذَهَبَ يَثِبُ فَرَمَاهُ رَجُلٌ فَأَصَابَ أَصْلَ أُذُنَيْهِ فَصُرِعَ فَقَتَلَهُ
41.20 [Machine] Where is the man digging to?
٤١۔٢٠ إِلَى أَيْنَ يُحْفَرُ لِلرَّجُلِ
[Machine] I was sitting with the Prophet ﷺ when a man named Ma'iz ibn Malik came to him and said, "O Messenger of Allah, I have committed adultery and I want you to purify me." The Prophet ﷺ told him to go back. The next day, he came to the Prophet ﷺ again and confessed to adultery. The Prophet ﷺ told him to go back. Then the Prophet ﷺ sent someone to ask the people about Ma'iz, saying, "What do you know about Ma'iz ibn Malik? Do you see him as a bad person or do you see any problem with his mind?" They replied, "O Messenger of Allah, we do not see anything wrong with him and we do not see any problem with his mind." Then Ma'iz came to the Prophet ﷺ for the third time and confessed to adultery, asking the Prophet ﷺ to purify him. The Prophet ﷺ sent someone to ask the people about Ma'iz again, and they gave the same response as before. Then, he came to the Prophet ﷺ for the fourth time and confessed to adultery. The Prophet ﷺ ordered a pit to be dug for him, and he was buried up to his chest. Then the Prophet ﷺ ordered the people to stone him. Buraida said, "Among the Prophet's companions, we used to talk about Ma'iz and say that if he had sat in his house after the first confession and not gone seeking punishment, it would have been better for him. But he repeated his confession three times, and then he acted as if he wanted punishment."
كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ ﷺ فَجَاءَ رَجُلٌ يُقَالُ لَهُ مَاعِزُ بْنُ مَالِكٍ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ وَإِنِّي أُرِيدُ أَنْ تُطَهِّرَنِي فَقَالَ لَهُ النَّبِيُّ ﷺ «ارْجِعْ» فَلَمَّا كَانَ مِنَ الْغَدِ أَتَاهُ أَيْضًا فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا فَقَالَ لَهُ النَّبِيُّ ﷺ «ارْجِعْ» ثُمَّ أَرْسَلَ إِلَى قَوْمِهِ فَسَأَلَهُمْ عَنْهُ فَقَالَ «مَا تَعْلَمُونَ مِنْ مَاعِزِ بْنِ مَالِكٍ؟ هَلْ تَرَوْنَ بِهِ بَأْسًا أَوْ تُنْكِرُونَ فِي عَقْلِهِ شَيْئًا؟» فَقَالُوا يَا نَبِيَّ اللهِ مَا نَرَى بِهِ بَأْسًا وَمَا نُنْكِرُ مِنْ عَقْلِهِ شَيْئًا ثُمَّ عَادَ إِلَى النَّبِيِّ ﷺ الثَّالِثَةَ فَاعْتَرَفَ عِنْدَهُ بِالزِّنَا وَقَالَ يَا نَبِيَّ اللهِ طَهِّرْنِي فَأَرْسَلَ رَسُولُ اللهِ ﷺ أَيْضًا إِلَى قَوْمِهِ فَسَأَلَهُمْ عَنْهُ فَقَالُوا كَمَا قَالُوا الْمَرَّةَ الْأُولَى مَا نَرَى بِهِ بَأْسًا وَمَا نُنْكِرُ مِنْ عَقْلِهِ شَيْئًا ثُمَّ رَجَعَ إِلَى النَّبِيِّ ﷺ الرَّابِعَةَ فَاعْتَرَفَ أَيْضًا عِنْدَهُ بِالزِّنَا فَأَمَرَ النَّبِيُّ ﷺ «فَحُفِرَ لَهُ حُفْرَةٌ فَجُعِلَ فِيهَا إِلَى صَدْرِهِ ثُمَّ أَمَرَ النَّاسَ أَنْ يَرْجُمُوهُ» فَقَالَ بُرَيْدَةُ كُنَّا نَتَحَدَّثُ أَصْحَابَ نَبِيِّ اللهِ ﷺ بَيْنَنَا أَنَّ مَاعِزًا لَوْ جَلَسَ فِي رَحْلِهِ بَعْدَ اعْتِرَافِهِ ثَلَاثَ مِرَارٍ وَلَمْ يَطْلُبْهُ وَإِنَّمَا رَجَمَهُ عِنْدَ الرَّابِعَةِ [436] 7165 أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا حَرَمِيُّ بْنُ حَفْصٍ أَبُو عَلِيٍّ قَالَ حَدَّثَنَا ابْنُ عُلَاثَةَ قَالَ حَدَّثَنِي عَبْدُ الْعَزِيزِ بْنُ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ أَنَّ خَالِدَ بْنَ اللَّجْلَاجِ أَخْبَرَهُ أَنَّ أَبَاهُ أَخْبَرَهُ قَالَ كُنْتُ أَعْتَمِلُ فَمَرَّتِ امْرَأَةٌ وَمَعَهَا صَبِيٌّ فَثَارَ النَّاسُ وَثُرْتُ فِيمَنْ ثَارَ فَانْتَهَيْتُ إِلَى النَّبِيِّ ﷺ فَقَالَ لِلْمَرْأَةِ «مَنْ أَبُو هَذَا الْغُلَامِ؟» فَسَكَتَتْ قَالَ وَقَامَ فَتًى فَقَالَ أَنَا أَبُوهُ يَا رَسُولَ اللهِ فَقَالَ رَسُولُ اللهِ ﷺ «مَنْ أَبُو هَذَا الْغُلَامِ؟» فَقَالَ الْفَتَى أَنَا أَبُوهُ يَا رَسُولَ اللهِ وَهِيَ حَدِيثَةُ السِّنِّ حَدِيثَةُ يَعْنِي عَهْدٍ بِخِزْيَةٍ وَلَيْسَتْ بِمُكَلِّمَتَكَ أَنَا أَبُوهُ يَا رَسُولَ اللهِ فَكَأَنَّهُ نَظَرَ إِلَى مَنْ حَوْلَهُ فَسَأَلَهُمْ «مَا تَقُولُونَ؟» فَقَالُوا لَا نَعْلَمُ إِلَّا خَيْرًا فَقَالَ «أُحْصِنْتَ؟» قَالَ نَعَمْ فَأَمَرَ بِرَجْمِهِ فَذَهَبْنَا بِهِ فَحَفَرْنَا لَهُ حَتَّى إِذَا أَمْكَنَّا رَمَيْنَاهُ حَتَّى هَدَأَ وَسَاقَ الْحَدِيثَ إِذَا اعْتَرَفَ بِالزِّنَا ثُمَّ رَجَعَ عَنْهُ
[Machine] Ma'iz ibn Malik came to the Messenger of Allah ﷺ and said, "O Messenger of Allah, I have committed adultery." The Prophet turned away from him. He then came to him from his right side and said, "O Messenger of Allah, I have committed adultery." The Prophet turned away from him. He then came to him from his left side and said, "O Messenger of Allah, I have committed adultery." The Prophet repeated this four times and then said, "Take him and stone him." So they took him and when the stones touched him, he ran away. A man with a stone in his hand, who had a short arm, struck him and killed him. When this was mentioned to the Messenger of Allah, he said, "Why didn't you leave him alone?"
جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ فَأَعْرَضَ عَنْهُ ثُمَّ جَاءَهُ مِنْ شِقِّهِ الْأَيْمَنِ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ فَأَعْرَضَ عَنْهُ ثُمَّ جَاءَهُ مِنْ شِقِّهِ الْأَيْسَرِ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ زَنَيْتُ فَقَالَ ذَلِكَ أَرْبَعَ مَرَّاتٍ قَالَ «انْطَلِقُوا بِهِ فَارْجُمُوهُ» فَانْطَلَقُوا بِهِ فَلَمَّا مَسَّتْهُ الْحِجَارَةُ أَدْبَرَ يَشْتَدُّ فَلَقِيَهُ رَجُلٌ فِي يَدِهِ لِحْيُ جَمَلٍ فَضَرَبَهُ فَصَرَعَهُ فَذُكِرَ ذَلِكَ لِرَسُولِ اللهِ ﷺ فِرَارُهُ حِينَ مَسَّتْهُ الْحِجَارَةُ قَالَ «فَهَلَّا تَرَكْتُمُوهُ»
[Machine] Goat bin Malik came to the Prophet ﷺ and said, "O Messenger of Allah, I have committed adultery. So establish the punishment prescribed in the Book of Allah upon me." He turned away from him. The man repeated his confession four times, and each time the Prophet ﷺ turned away from him. Finally, the Prophet ﷺ said, "Go and stone him." When the stones touched him, he ran away, but Abdullah pursued him and struck him with a stick made from the shoulder bone of a camel, causing his death. The people then stoned him until he died. News of his escape reached the Messenger of Allah ﷺ, and he asked, "Why did you not leave him? Perhaps he would have repented and Allah would have accepted his repentance."
جَاءَ مَاعِزُ بْنُ مَالِكٍ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَأَقِمْ عَلَيَّ كِتَابَ اللهِ فَأَعْرَضَ عَنْهُ ثُمَّ قَالَ لَهُ إِنِّي زَنَيْتُ فَأَقِمْ فِيَّ كِتَابَ اللهِ حَتَّى جَاءَ أَرْبَعَ مَرَّاتٍ فَقَالَ «اذْهَبُوا بِهِ فَارْجُمُوهُ» فَلَمَّا مَسَّتْهُ الْحِجَارَةُ جَمَزَ فَاشْتَدَّ فَخَرَجَ عَبْدُ اللهِ مِنْ بَادِيَتِهِ فَرَمَاهُ بِوَظِيفِ حِمَارٍ فَصَرَعَهُ فَرَمَاهُ النَّاسُ حَتَّى قَتَلُوهُ فَذُكِرَ لِرَسُولِ اللهِ ﷺ فِرَارَهُ فَقَالَ «هَلَّا تَرَكْتُمُوهُ لَعَلَّهُ يَتُوبُ فَيَتُوبَ اللهُ عَلَيْهِ؟»
[Machine] "Return me to the Messenger of Allah ﷺ , but we denied that. So I went to Aasim ibn Umar ibn Qatadah and mentioned it to him. Al-Hasan ibn Muhammad said to me, 'I had heard about that and I denied it.' So I went to Jabir ibn Abdullah and said to him, 'People have mentioned something from the words of Ma'iz, saying, 'Return me to the Messenger of Allah ﷺ .' I denied it.' He said to me, 'I was with those who stoned him. When he felt the stones, he said, 'Return me to the Messenger of Allah ﷺ , for indeed my people have deceived me.' They said to him, 'Go to the Messenger of Allah ﷺ , for he will not kill you.' We did not stop stoning him until we killed him.' When we mentioned that to him, he said, 'Did you not leave him alone until I could find out about his situation?'"
رُدُّونِي إِلَى رَسُولِ اللهِ ﷺ فَأَنْكَرْنَا ذَلِكَ فَأَتَيْتُ عَاصِمَ بْنَ عُمَرَ بْنِ قَتَادَةَ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ لِي الْحَسَنُ بْنُ مُحَمَّدٍ لَقَدْ بَلَغَنِي ذَلِكَ فَأَنْكَرْتُهُ فَأَتَيْتُ جَابِرَ بْنَ عَبْدِ اللهِ فَقُلْتُ لَهُ لَقَدْ ذَكَرَ النَّاسُ شَيْئًا مِنْ قَوْلِ مَاعِزٍ رُدُّونِي فَأَنْكَرْتُهُ فَقَالَ أَنَا كُنْتُ فِيمَنْ رَجَمَهُ إِنَّهُ لَمَّا وَجَدَ مَسَّ الْحِجَارَةِ قَالَ رُدُّونِي إِلَى رَسُولِ اللهِ ﷺ فَإِنَّ قَوْمِي غَرُّونِي قَالُوا إِئْتِ رَسُولَ اللهِ ﷺ فَإِنَّهُ غَيْرُ قَاتِلِكَ فَمَا أَقْلَعْنَا عَنْهُ حَتَّى قَتَلْنَاهُ فَلَمَّا ذَكَرْنَا ذَلِكَ لَهُ قَالَ «أَلَا تَرَكْتُمُوهُ؟ حَتَّى أَنْظُرَ فِي شَأْنِهِ»
Muhammad ibn Ishaq said: I mentioned the story of Ma'iz ibn Malik to Asim ibn Umar ibn Qatadah. He said to me: Hasan ibn Muhammad ibn Ali ibn AbuTalib said to me: Some men of the tribe of Aslam whom I do not blame and whom you like have transmitted to me the saying of the Messenger of Allah ﷺ: Why did you not leave him alone? He said: But I did not understand this tradition. So I went to Jabir ibn Abdullah and said (to him): Some men of the tribe of Aslam narrate that the Messenger of Allah ﷺ said when they mentioned to him the anxiety of Ma'iz when the stones hurt him: "Why did you not leave him alone?' But I do not know this tradition. He said: My cousin, I know this tradition more than the people. I was one of those who had stoned the man. When we came out with him, stoned him and he felt the effect of the stones, he cried: O people! return me to the Messenger of Allah ﷺ. My people killed me and deceived me; they told me that the Messenger of Allah ﷺ would not kill me. We did not keep away from him till we killed him. When we returned to the Messenger of Allah ﷺ we informed him of it. He said: Why did you not leave him alone and bring him to me? and he said this so that the Messenger of Allah ﷺ might ascertain it from him. But he did not say this to abandon the prescribed punishment. He said: I then understood the intent of the tradition. (Using translation from Abū Dāʾūd 4420)
كُنْتُ فِيمَنْ رَجَمَهُ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ جَزِعَ جَزَعًا شَدِيدًا فَذَكَرْنَا ذَلِكَ لِرَسُولِ اللهِ ﷺ قَالَ «فَهَلَّا تَرَكْتُمُوهُ؟» قَالَ مُحَمَّدٌ فَذَكَرْتُ ذَلِكَ مِنْ حَدِيثِهِ حِينَ سَمِعْتُهُ «أَلَا تَرَكْتُمُوهُ؟» لِعَاصِمِ بْنِ عُمَرَ بْنِ قَتَادَةَ فَقَالَ لِي حَدَّثَنِي حُسْنُ بْنُ مُحَمَّدِ بْنِ عَلِيِّ بْنِ أَبِي طَالِبٍ قَالَ حَدَّثَنِي ذَلِكَ مِنْ قَوْلِ رَسُولِ اللهِ ﷺ أَلَا تَرَكْتُمُوهُ؟ لِمَاعِزِ بْنِ مَالِكٍ مَنْ شِئْتَ مِنْ رِجَالِ أَسْلَمَ مِمَّنْ لَا أَتَّهِمُ وَلَمْ أَعْرِفْ وَجْهَ الْحَدِيثِ فَجِئْتُ جَابِرَ بْنَ عَبْدِ اللهِ فَقُلْتُ إِنَّ رِجَالَ أَسْلَمَ يُحَدِّثُونِي أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَهُمْ حِينَ ذَكَرُوا جَزَعَ مَاعِزٍ مِنَ الْحِجَارَةِ حِينَ أَصَابَتْهُ «فَهَلَّا تَرَكْتُمُوهُ؟» وَمَا أَتَّهِمُ الْقَوْمَ وَمَا أَعْرِفُ الْحَدِيثَ قَالَ يَا ابْنَ أَخِي أَنَا أَعْلَمُ النَّاسِ بِهَذَا الْحَدِيثِ؛ كُنْتُ فِيمَنْ رَجَمَ الرَّجُلَ إِنَّا لَمَّا خَرَجْنَا بِهِ فَرَجَمْنَاهُ فَوَجَدَ مَسَّ الْحِجَارَةِ صَرَخَ بِنَا يَا قَوْمُ رُدُّونِي إِلَى رَسُولِ اللهِ ﷺ فَإِنَّ قَوْمِي قَتَلُونِي وَغَرُّونِي مِنْ نَفْسِي وَأَخْبَرُونِي أَنَّ رَسُولَ اللهِ ﷺ غَيْرُ قَاتِلٍ فَلَمْ نَنْزِعْ عَنْهُ حَتَّى قَتَلْنَاهُ فَلَمَّا رَجَعْنَا إِلَى رَسُولِ اللهِ ﷺ قَالَ «فَهَلَّا تَرَكْتُمُ الرَّجُلَ؟ وَجِئْتُمُونِي بِهِ» لِيَتَثَبَّتَ رَسُولُ اللهِ ﷺ فِيهِ فَأَمَّا تَرْكُ حَدٍّ فَلَا قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الْإِسْنَادُ خَيْرٌ مِنَ الَّذِي قَبْلَهُ
[Machine] Goat bin Malik narrated that a man from our group came to the Messenger of Allah ﷺ and mentioned a word implying adultery, thus admitting his own guilt. The Messenger of Allah ﷺ ordered us to stone him, so we took him to the area of Banu Niyar and stoned him. When he felt the pain of the stones, he became extremely distressed. After we had finished stoning him and returned to the Messenger of Allah ﷺ , we informed him about the man's distress. He said, "Why didn't you leave him alone?"
أَتَى مَاعِزُ بْنُ مَالِكٍ رَجُلٌ مِنَّا رَسُولَ اللهِ ﷺ ثُمَّ ذَكَرَ كَلِمَةً مَعْنَاهَا فَأَقَرَّ عَلَى نَفْسِهِ بِالزِّنَا فَأَمَرَنَا رَسُولُ اللهِ ﷺ بِرَجْمِهِ فَخَرَجْنَا بِهِ إِلَى حَرَّةِ بَنِي نيَارٍ فَرَجَمْنَاهُ فَلَمَّا وَجَدَ مَسَّ الْحِجَارَةِ جَزِعَ جَزَعًا شَدِيدًا فَلَمَّا فَرَغْنَا مِنْهُ وَرَجَعْنَا إِلَى رَسُولِ اللهِ ﷺ ذَكَرْنَا لَهُ جَزَعَهُ قَالَ «فَهَلَّا تَرَكْتُمُوهُ»
41.21 [Machine] The Presence of the Imam: Implementing Punishments and the Fate of the Thrown Stone
٤١۔٢١ حُضُورُ الْإِمَامِ إِقَامَةَ الْحُدُودِ وَقَدْرُ الْحَجَرِ الَّذِي يُرْمَى بِهِ
[Machine] He saw the Messenger of Allah ﷺ on a gray female camel when a woman came to him and said, "She has gone astray, so admonish her." He said to her, "Go back and take shelter in the protection of Allah's covering." She recited to him three times, 'All of that, he tells her to go back and take shelter in the protection of Allah's covering.' He did not give her anything except that he ordered her to be stoned to death, saying, "Stay until you give birth to what is in your womb." So she went and then came back and said, "I have given birth to a boy." The Messenger of Allah ﷺ took care of him and then said to her, "Go until you are purified." So she went and then returned and said, "I have been purified." He sent women along with her who checked her purity, and then they came and testified before him that she had been purified. He ordered for a place to be prepared for her until she reached her menstrual period, and then he came with the Muslims. He took a stone the size of a chickpea and threw it at her. Then he said to the Muslims, "Throw stones at her and beware of her face." He prayed for her and said, "If her repentance were to be divided among the people of Hejaz, it would suffice them all." [440] Muhammad Ibn Al-Muthanna informed us, saying: 'Uthman Ibn 'Umar told me that Zakariya Abu Imran said: "I heard an elderly man near Sa'id Ibn 'Amr Ibn 'Uthman saying: 'Abdul Rahman Ibn Abi Bakrah narrated to us from his father that the Messenger of Allah ﷺ was standing and he mentioned something similar to this.'"
أَنَّهُ رَأَى رَسُولَ اللهِ ﷺ عَلَى بَغْلَةٍ شَهْبَاءَ إِذْ جَاءَتْهُ امْرَأَةٌ فَقَالَتْ إِنَّهَا قَدْ بَغَتْ فَأَقِمْ عَلَيْهَا فَقَالَ لَهَا «ارْجِعِي فَاسْتَتِرِي بِسِتْرِ اللهِ» فَأَنْشَدَتْ عَلَيْهِ ثَلَاثًا كُلُّ ذَلِكَ يَقُولُ لَهَا ارْجِعِي فَاسْتَتِرِي بِسِتْرِ اللهِ فَأَنْشَدَتْهُ إِلَّا أَقَامَ عَلَيْهَا الْحَدَّ فَقَالَ «امْكُثِي حَتَّى تَضَعِي مَا فِي بَطْنِكِ» فَذَهَبَتْ ثُمَّ جَاءَتْ فَقَالَتْ إِنِّي قَدْ وَلَدَتْ غُلَامًا قَالَ فَكَفَلَهُ رَسُولُ اللهِ ﷺ ثُمَّ قَالَ لَهَا «اذْهَبِي حَتَّى تَطْهُرِي» فَذَهَبَتْ ثُمَّ رَجَعَتْ فَقَالَتْ قَدْ طَهُرَتْ فَأَرْسَلَ مَعَهَا نِسْوَةً فَاسْتَبْرَأْنَ طُهْرَهَا ثُمَّ جِئْنَ فَشَهِدْنَ عِنْدَهُ أَنَّهَا قَدْ طَهُرَتْ فَأَمَرَ بِحُفَيْرَةٍ إِلَى ثَنْدُوَتِهَا ثُمَّ جَاءَ وَالْمُسْلِمُونَ مَعَهُ فَأَخَذَ حَصَاةً مِثْلَ الْحِمِّصَةِ فَرَمَاهَا بِهَا ثُمَّ قَالَ ﷺ لِلْمُسْلِمِينَ «ارْمُوهَا وَاتَّقُوا وَجْهَهَا» فَصَلَّى عَلَيْهَا وَقَالَ «لَوْ قُسِمَتْ تَوْبَتُهَا بَيْنَ أَهْلِ الْحِجَازِ لَوَسِعَتْهُمْ» [440] 7172 أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُثَنَّى قَالَ حَدَّثَنِي عُثْمَانُ بْنُ عُمَرَ قَالَ أَخْبَرَنَا زَكَرِيَّا أَبُو عِمْرَانَ قَالَ سَمِعْتُ شَيْخًا عِنْدَ سَعِيدِ بْنِ عَمْرِو بْنِ عُثْمَانَ قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ أَبِي بَكْرَةَ عَنْ أَبِيهِ أَنَّ رَسُولَ اللهِ ﷺ كَانَ وَاقِفًا فَذَكَرَ نَحْوَهُ
41.22 [Machine] In a relationship with an affair and was not known for his faithfulness until he was punished.
٤١۔٢٢ فِي مُحْصَنٍ زَنَا وَلَمْ يُعْلَمْ بِإِحْصَانِهِ حَتَّى جُلِدَ /
[Machine] A man committed adultery with a woman, so the Prophet ﷺ ordered that he be lashed as punishment. Later, it was reported that he was married, so the Prophet ﷺ ordered that he be stoned to death. Abu Abdur-Rahman said, "I do not know of anyone who narrated this hadith except Ibn Wahb."
أَنَّ رَجُلًا «زَنَا بِامْرَأَةٍ فَأَمَرَ بِهِ النَّبِيُّ ﷺ فَجُلِدَ الْحَدَّ ثُمَّ أُخْبِرَ أَنَّهُ مُحْصَنٌ فَأَمَرَ بِهِ فَرُجِمَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا أَعْلَمَ أَنَّ أَحَدًا رَفَعَ هَذَا الْحَدِيثَ غَيْرَ ابْنِ وَهْبٍ
[Machine] Abu Asim al-Nabeel said: Ibn Jurayj informed us that Abu Zubayr told me that he heard Jabir ibn Abdullah saying: "Regarding a married person who committed adultery but his adultery was not known until he was whipped, and then it became known that he was chaste, he should be stoned." Abu Abdur-Rahman said: "This is the correct opinion, and the one before it is incorrect."
عَنْ أَبِي عَاصِمٍ هُوَ النَّبِيلُ قَالَ أَخْبَرَنَا ابْنُ جُرَيْجٍ قَالَ أَخْبَرَنِي أَبُو الزُّبَيْرِ أَنَّهُ سَمِعَ جَابِرَ بْنَ عَبْدِ اللهِ قَالَ فِي مُحْصَنٍ زَنَا وَلَمْ يُعْلَمْ بِإِحْصَانِهِ حَتَّى جُلِدَ ثُمَّ عُلِمَ بِإِحْصَانِهِ قَالَ يُرْجَمُ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا الصَّوَابُ وَالَّذِي قَبْلَهُ خَطَأٌ
41.23 [Machine] The Imam's Residence in Addressing the People of the Book When They Resort to Him.
٤١۔٢٣ إِقَامَةُ الْإِمَامِ الْحَدَّ عَلَى أَهْلِ الْكِتَابِ إِذَا تَحَاكَمُوا إِلَيْهِ
[Machine] That the Jews came to the Prophet ﷺ with a man and a woman from among themselves who had committed adultery. The Prophet asked them, "What does your book say about this?" They replied, "We erase their faces and disgrace them." The Prophet said, "You have lied. Indeed, stoning is mentioned in it." So, they brought the Torah and a blind man who was a reader recited it. When he reached a certain part, he placed his hand on it. He was told, "Raise your hand," and he raised it, and there it was mentioned. They said, "O Muhammad, it is indeed mentioned in it, but we used to conceal it among ourselves." The Messenger of Allah ﷺ then ordered for them in this way.
أَنَّ الْيَهُودَ أَتَوَا النَّبِيَّ ﷺ بِرَجُلٍ مِنْهُمْ وَامْرَأَةٍ قَدْ زَنَيَا فَقَالَ «مَا تَجِدُونَ فِي كِتَابِكُمْ» قَالُوا نُسَخِّمُ وُجُوهَهُمَا وَيُخْزَيَانِ قَالَ «كَذَبْتُمْ إِنَّ فِيهَا الرَّجْمَ» فَائْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ فَجَاءُوا بِالتَّوْرَاةِ وَجَاءُوا بِقَارِئٍ لَهُمْ أَعْوَرَ فَقَرَأَ حَتَّى إِذَا انْتَهَى إِلَى مَوْضِعٍ مِنْهَا وَضَعَ يَدَهُ عَلَيْهِ فَقِيلَ لَهُ ارْفَعْ يَدَكَ فَرَفَعَ فَإِذَا هِيَ تَلُوحُ فَقَالُوا يَا مُحَمَّدُ إِنَّ فِيهَا الرَّجْمَ وَلَكِنَّا كُنَّا نَتَكَاتَمُهُ بَيْنَنَا فَأَمَرَ بِهِمَا رَسُولُ اللهِ ﷺ كَذَا
[Machine] He told him, when they were brought to the Prophet, he said, "What do you find in your book?" They said, "We do not find stoning." Abdullah bin Salam said, "They lied about stoning in their book, so it was said to them, 'Bring the Torah and recite it if you are truthful.'" So they brought the Torah and their reader, and he placed his hand on the place of stoning and started reciting what was left. Abdullah bin Salam said to him, "Remove your hand, and there it is, the stoning mentioned." So the Messenger of Allah ﷺ commanded them and they were stoned.
أَنَّهُ حَدَّثَهُ أَنَّهُ لَمَّا رُفِعَا إِلَى النَّبِيِّ ﷺ قَالَ «مَا تَجِدُونَ فِي كِتَابِكُمْ؟» قَالُوا لَا نَجِدُ الرَّجْمَ قَالَ عَبْدُ اللهِ بْنُ سَلَامٍ كَذَبُوا الرَّجْمُ فِي كِتَابِهِمْ فَقِيلَ ائْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ فَجَاءُوا بِالتَّوْرَاةِ وَجَاءَ قَارِئِهُمْ فَجَعَلَ كَفَّهُ عَلَى مَوْضِعِ الرَّجْمِ فَجَعَلَ يَقْرَأُ مَا خَلَا ذَلِكَ فَقَالَ لَهُ عَبْدُ اللهِ بْنُ سَلَامٍ «أَزْحِلْ كَفَّكَ فَإِذَا هُوَ بِالرَّجْمِ يَلُوحُ فَأَمَرَ رَسُولُ اللهِ ﷺ بِهِمَا فَرُجِمَا»
The Jews brought to the Prophet ﷺ a man and a woman from among them who had committed illegal sexual intercourse. The Prophet ﷺ said to them, "How do you usually punish the one amongst you who has committed illegal sexual intercourse?" They replied, "We blacken their faces with coal and beat them," He said, "Don't you find the order of Ar-Rajm (i.e. stoning to death) in the Torah?" They replied, "We do not find anything in it." ʿAbdullah bin Salam (after hearing this conversation) said to them. "You have told a lie! Bring here the Torah and recite it if you are truthful." (So the Jews brought the Torah). And the religious teacher who was teaching it to them, put his hand over the Verse of Ar- Rajm and started reading what was written above and below the place hidden with his hand, but he did not read the Verse of Ar-Rajm. ʿAbdullah bin Salam removed his (i.e. the teacher's) hand from the Verse of Ar-Rajm and said, "What is this?" So when the Jews saw that Verse, they said, "This is the Verse of Ar-Rajm." So the Prophet ﷺ ordered the two adulterers to be stoned to death, and they were stoned to death near the place where biers used to be placed near the Mosque. I saw her companion (i.e. the adulterer) bowing over her so as to protect her from the stones. (Using translation from Bukhārī 4556)
أَنَّ الْيَهُودَ جَاءُوا إِلَى رَسُولِ اللهِ ﷺ بِرَجُلٍ مِنْهُمْ وَامْرَأَةٍ قَدْ زَنَيَا قَالَ فَقَالَ «كَيْفَ تَفْعَلُونَ بِمَنْ زَنَا مِنْكُمْ؟» قَالَ نَضْرِبُهُمَا قَالَ «مَا تَجِدُونَ فِي التَّوْرَاةِ؟» قَالُوا مَا نَجِدُ فِيهَا شَيْئًا فَقَالَ عَبْدُ اللهِ بْنُ سَلَامٍ كَذَبُوا فِي التَّوْرَاةِ الرَّجْمُ فَائْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ فَجَاءُوا بِالتَّوْرَاةِ فَوَضَعَ مُدَرِّسُهَا الَّذِي يُدَرِّسُهَا مِنْهُمْ كَفَّهُ عَلَى آيَةِ الرَّجْمِ فَطَفِقَ يَقْرَأُ مَا دُونَ يَدِهِ وَمَا وَرَاءَهَا لَا يَقْرَأُ آيَةَ الرَّجْمِ فَضَرَبَ عَبْدُ اللهِ بْنُ سَلَامٍ يَدَهُ فَقَالَ مَا هَذِهِ؟ قَالَ هِيَ آيَةُ الرَّجْمِ فَأَمَرَ بِهِمَا رَسُولُ اللهِ ﷺ فَرُجِمَا قَرِيبًا مِنْ حَيْثُ تُوضَعُ الْجَنَائِزُ قَالَ عَبْدُ اللهِ فَرَأَيْتُ صَاحِبَهَا يَحْنِي عَلَيْهَا لِيَقِيَهَا الْحِجَارَةَ

أَنَّ رَسُولَ اللهِ ﷺ «رَجَمَ يَهُودِيًّا وَيَهُودِيَّةً بِالْبَلَاطِ»

«أَنَّ النَّبِيَّ ﷺ رَجَمَ يَهُودِيًّا وَيَهُودِيَّةً»
The people passed by the Messenger of Allah ﷺ with a Jew who was blackened with charcoal and who was being flogged. He called them and said: Is this the prescribed punishment for a fornicator? They said: Yes. He then called on a learned man among them and asked him: I adjure you by Allah Who revealed the Torah to Moses, do you find this prescribed punishment for a fornicator in your divine Book? He said: By Allah, no. If you had not adjured me about this, I should not have informed you. We find stoning to be prescribed punishment for a fornicator in our Divine Book. But it (fornication) became frequent in our people of rank; so when we seized a person of rank, we left him alone, and when we seized a weak person, we inflicted the prescribed punishment on him. So we said: Come, let us agree on something which may be enforced equally on people of higher and lower rank. So we agreed to blacken the face of a criminal with charcoal, and flog him, and we abandoned stoning. The Messenger of Allah ﷺ then said: O Allah, I am the first to give life to Thy command which they have killed. So he commanded regarding him (the Jew) and he was stoned to death. Allah Most High then sent down: "O Apostle, let not those who race one another into unbelief, make thee grieve..." up to "They say: If you are given this, take it, but if not, beware!...." up to "And if any do fail to judge by (the light of) what Allah hath revealed, they are (no better than) unbelievers," about Jews, up to "And if any do fail to judge by (the right of) what Allah hath revealed, they are no better than) wrong-doers" about Jews: and revealed the verses up to "And if any do fail to judge by (the light of) what Allah hath revealed, they are (no better than) those who rebel." About this he said: This whole verse was revealed about the infidels. (Using translation from Abū Dāʾūd 4448)
مَرَّ عَلَى النَّبِيِّ ﷺ يَهُودِيٌّ مُحَمَّمٌ مَجْلُودٌ فَقَالَ «هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ؟» قَالُوا نَعَمْ فَدَعَا رَجُلًا مِنْ عُلَمَائِهِمْ قَالَ أَنْشُدُكَ بِاللهِ هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ قَالَ لَا وَلَوْلَا أَنَّكَ مَا سَأَلْتَنِي مَا صَدَقْتُكَ نَجِدُهُ الرَّجْمَ وَلَكِنْ كَثُرَ فِي أَشْرَافِنَا كُنَّا إِذَا أَخَذْنَا الشَّرِيفَ تَرَكْنَاهُ وَإِذَا أَخَذْنَا الضَّعِيفَ أَقَمْنَا عَلَيْهِ الْحَدَّ فَقُلْنَا تَعَالَوْا نَجْتَمِعُ عَلَى شَيْءٍ نُقِيمُهُ عَلَى الشَّرِيفِ وَالْوَضِيعِ مِنَّا فَاجْتَمَعْنَا عَلَى التَّحْمِيمِ وَالْجَلْدِ مَكَانَ الرَّجْمِ فَأَنْزَلَ اللهُ تَعَالَى {يَا أَيُّهَا الرَّسُولُ لَا يَحْزُنْكَ الَّذِينَ يُسَارِعُونَ فِي الْكُفْرِ} [المائدة 41] إِلَى قَوْلِهِ {إِنْ أُوتِيتُمْ هَذَا فَخُذُوهُ} [المائدة 41] يَقُولُونَ ائْتُوا مُحَمَّدًا فَإِنْ أَفْتَاكُمْ بِالتَّحْمِيمِ وَالْجَلْدِ فَخُذُوهُ وَإِنْ أَفْتَاكُمْ بِالرَّجْمِ فَاحْذَرُوا إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ} [المائدة 44] قَالَ فِي الْيَهُودِ إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الظَّالِمُونَ} [المائدة 45] قَالَ فِي الْيَهُودِ إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْفَاسِقُونَ} [المائدة 47] قَالَ هِيَ فِي الْكُفَّارِ كُلُّهَا قَالَ رَسُولُ اللهِ ﷺ «اللهُمَّ إِنِّي أَوَّلُ مَنْ أَحْيَا أَمَرَكَ إِذْ أَمَاتُوهُ» فَأَمَرَ بِهِ فَرُجِمَ
[Machine] Two verses were abrogated from this Surah, meaning the verse of Al-Qalaid (liabilities) and His saying, "So if they come to you, judge between them or turn away from them," returning them to their rulers, until the revelation of "And judge between them by what Allah has revealed" [Surah Al-Ma'idah: 49]. He (May Allah bless him and grant him peace) was commanded to judge between them by what Allah has revealed.
نُسِخَ مِنْ هَذِهِ السُّورَةِ يَعْنِي آيَتَانِ آيَةُ الْقَلَائِدِ وَقَوْلُهُ {فَإِنْ جَاءُوكَ فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ} رُدَّهُمْ إِلَى حُكَّامِهِمْ حَتَّى نَزَلَتْ {وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ} [المائدة 49] قَالَ «فَأُمِرَ رَسُولُ اللهِ ﷺ أَنْ يَحْكُمَ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ»
41.24 [Machine] The punishment for one who comes to a forbidden zone, and mentioning the disagreement of the narrators about the news of Bara'ah ibn 'Azib in it.
٤١۔٢٤ عُقُوبَةُ مَنْ أَتَى ذَاتَ مَحْرَمٍ، وَذِكْرُ اخْتِلَافِ النَّاقِلِينَ لِخَبَرِ الْبَرَاءِ بْنِ عَازِبٍ فِيهِ
[Machine] He mentioned a word that means, "I used to wander in those neighborhoods on camels because I had lost my way during the time of the Prophet ﷺ, when a group came with their flags and the Bedouins sought refuge with me because of my position as the Messenger of Allah ﷺ. They then brought out a man and killed him, so I asked about his story and they said, "He married his father's wife."
أَنَّهُ ذَكَرَ كَلِمَةً مَعْنَاهَا أَنِّي لَأَطُوفُ فِي تِلْكِ الْأَحْيَاءِ عَلَى إِبِلٍ لِي ضَلَّتْ فِي عَهْدِ النَّبِيِّ ﷺ إِذْ جَاءَ رَهْطٌ مَعَهُمْ لَوَاؤُهُمْ فَجَعَلَ الْأَعْرَابُ يَلُوذُونَ بِي لِمَنْزِلَتِي مِنْ رَسُولِ اللهِ ﷺ فَاسْتَخْرَجُوا رَجُلًا فَضَرَبُوا عُنُقَهُ فَسَأَلْتُ عَنْ قِصَّتِهِ فَقَالُوا «عَرَّسَ بِامْرَأَةِ أَبِيهِ»
[Machine] Some people passed by us, so we asked them, "Where are you going?" They said, "We were sent by the Prophet ﷺ to a man who approaches his father's wife to kill him."
مَرَّ بِنَا نَاسٌ يَنْطَلِقُونَ فَقُلْنَا لَهُمْ أَيْنَ تُرِيدُونَ؟ قَالُوا «بَعَثَنَا النَّبِيُّ ﷺ إِلَى رَجُلٍ يَأْتِي امْرَأَةَ أَبِيهِ أَنْ نَقْتُلَهُ»
“The Messenger of Allah ﷺ sent me to a man who had married his father's wife after he died, to strike his neck (execute him) and confiscate his wealth.” (Using translation from Ibn Mājah 2608)
«بَعَثَنِي رَسُولُ اللهِ ﷺ إِلَى رَجُلٍ تَزَوَّجَ امْرَأَةَ أَبِيهِ مِنْ بَعْدِهِ أَنْ أَضْرِبَ عُنُقَهُ أَوْ أَقْتُلَهُ»
[Machine] "The Messenger of Allah ﷺ sent me to a man who married his father's wife, and ordered me to kill him."
«بَعَثَنِي رَسُولُ اللهِ ﷺ إِلَى رَجُلٍ تَزَوَّجَ امْرَأَةَ أَبِيهِ فَأَمَرَنِي أَنْ أَقْتُلَهُ»
[Machine] The Messenger of Allah ﷺ sent his grandfather, Muawiya's grandfather, to a man who had married his father's wife, so he killed him and confiscated his wealth.
أَنَّ رَسُولَ اللهِ ﷺ «بَعَثَ أَبَاهُ جَدَّ مُعَاوِيَةَ إِلَى رَجُلٍ عَرَّسَ بِامْرَأَةِ أَبِيهِ فَضَرَبَ عُنُقَهُ وَخَمَّسَ مَالَهُ»
41.25 [Machine] Regarding the person who deceived his wife, and mentioning the disagreement of the narrators regarding the news of Nu'man ibn Bashir in that, and mentioning the disagreement regarding Abu Bishr.
٤١۔٢٥ فِيمَنْ غَشِيَ جَارِيَةَ امْرَأَتِهِ، وَذِكْرُ اخْتِلَافِ النَّاقِلِينَ لِخَبَرِ النُّعْمَانِ بْنِ بَشِيرٍ فِي ذَلِكَ، وَذِكْرُ الِاخْتِلَافِ عَلَى أَبِي بِشْرٍ
The Prophet ﷺ said: about a man who had (unlawful) intercourse with his wife's slave girl: If she made her lawful for him, he will be flogged one hundred lashes; if she did not make her lawful for him, I shall stone him. (Using translation from Abū Dāʾūd 4459)
عَنِ النَّبِيِّ ﷺ فِي الرَّجُلِ يَأْتِي جَارِيَةَ امْرَأَتِهِ قَالَ «إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ رَجَمْتُهُ»
[Machine] Al-Nu'man, I have a clear news in that I received it from the Messenger of Allah ﷺ "If you had given him permission, I would have beaten him a hundred times, and if you had not given him permission, I would have stoned him."
النُّعْمَانُ أَمَا إِنَّ عِنْدِي فِي ذَلِكَ خَبَرًا شَافِيًا أَخَذْتُهُ مِنْ رَسُولِ اللهِ ﷺ «إِنْ كُنْتِ أَذِنْتِ لَهُ ضَرَبْتُهُ مِائَةً وَإِنْ كُنْتِ لَمْ تَأْذَنِي لَهُ رَجَمْتُهُ»
41.26 [Machine] The mention of differences on Qatada
٤١۔٢٦ ذِكْرُ الِاخْتِلَافِ عَلَى قَتَادَةَ
"If she let him do that, I will flog him with one hundred stripes, and if she did not let him do that, I will stone him (to death)." (Using translation from Nasāʾī 3362)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ فِي رَجُلٍ وَقَعَ بِجَارِيَةِ امْرَأَتِهِ «إِنْ كَانَتْ أَحَلَّتْهَا لَهُ فَاجْلِدُوهُ مِائَةَ جَلْدَةٍ وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ فَارْجُمُوهُ»
Habib ibn Salim said: A man called AbdurRahman ibn Hunayn had intercourse with his wife's slave-girl. The matter was brought to an-Nu'man ibn Bashir who was the Governor of Kufah. He said: I shall decide between you in accordance with the decision of the Messenger of Allah ﷺ. If she made her lawful for you, I shall flog you one hundred lashes. If she did not make her lawful for you, I shall stone you to death. So they found that she had made her lawful for him. He, therefore, flogged him one hundred lashes. Qatadah said: I wrote to Habib b. Salim; so he wrote this (tradition) to me. (Using translation from Abū Dāʾūd 4458)
لَأَقْضِيَنَّ فِيكَ بِقَضِيَّةِ رَسُولِ اللهِ ﷺ «إِنْ كَانَتْ أَحَلَّتْهَا لَكَ جَلَدْتُكَ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَكَ رَجَمْتُكَ بِالْحِجَارَةِ» قَالَ فَكَانَتْ أَحَلَّتْهَا لَهُ فَجَلَدَهُ مِائَةً قَالَ قَتَادَةُ فَكَتَبْتُ إِلَى حَبِيبِ بْنِ سَالِمٍ فَكَتَبَ إِلَيَّ بِهَذَا
