“A man who had intercourse with the slave woman of his wife was brought to Nuʿman bin Bashir. He said: 'I will pass no other judgement than that of the Messenger of Allah ﷺ He said: 'If (his wife) had made her lawful for him, then I will give him one hundred lashes, but if she has not given permission, I will stone him.' ” (Using translation from Ibn Mājah 2551)   

«لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ رَجَمْتُهُ»  

the case of a man who had intercourse with the slave woman of his wife was referred to the Messenger of Allah ﷺ, and he did not stipulate any legal punishment for him. (Using translation from Ibn Mājah 2552)  

«أَنَّ رَسُولَ اللهِ ﷺ رُفِعَ إِلَيْهِ رَجُلٌ وَطِئَ جَارِيَةَ امْرَأَتِهِ فَلَمْ يُحِدَّهُ»  

[Machine] A man went on a raid and took with him a slave girl belonging to his wife. Something happened to her, and this was mentioned to the Prophet Muhammad ﷺ . He said, "If he forced her, then she is free and he must give her an equal in compensation. And if she willingly accepted it, then she is a slave and he must give an equal in compensation."  

أَنَّ رَجُلًا خَرَجَ فِي غَزَاةٍ وَمَعَهُ جَارِيَةٌ لِامْرَأَتِهِ فَوَقَعَ عَلَيْهَا فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لَهَا مَثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَةٌ وَعَلَيْهِ مَثْلُهَا لَهَا»  

"If he forced her, then she is free at his expense and he has to give her mistress a similar slave as a replacement. If she obeyed him in that, then she belongs to her mistress, and he has to give her mistress a similar slave as well." (Using translation from Nasāʾī 3364)  

أَنَّ رَجُلًا غَشِيَ جَارِيَةَ امْرَأَتِهِ فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ مِنْ مَالِهِ وَعَلَيْهِ الشَّرْوَى لِسَيِّدَتِهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لِسَيِّدَتِهَا وَمِثْلُهَا مِنْ مَالَهُ»  

The Messenger of Allah ﷺ made a decision about a man who had intercourse with his wife's slave-girl as follows. If he forced her, she is free, and he shall give her mistress a slave-girl similar to her; if she asked him to have intercourse voluntarily, she will belong to him, and he shall give her mistress a slave-girl similar to her. Abu Dawud said: This tradition has been transmitted by Yunus b. 'Ubaid, 'Amr b. Dinar, Mansur b. Zadhan and Salam from al-Hasan to the same effect. But yunus and Mansur did not mention Qabisah. قَضَى النَّبِيُّ ﷺ فِي رَجُلٍ وَطِئَ جَارِيَةِ امْرَأَتِهِ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مَثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ لِسَيِّدَتِهَا مَثْلُهَا» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَيْسَ فِي هَذَا الْبَابِ شَيْءٌ صَحِيحٌ يُحْتَجُّ بِهِ

عَنْ رَسُولِ اللهِ ﷺ «أَنَّهُ أَمَرَ فِيمَنْ زَنَا مِمَّنْ لَمْ يُحْصَنْ بِجَلْدِ مِائَةٍ وَتَغْرِيبِ عَامٍ»  

Messenger of Allah ﷺ judged that the unmarried person who was guilty of illegal sexual intercourse be exiled for one year and receive the legal punishment (i.e., be flogged with one-hundred stripes) . (Using translation from Bukhārī 6833)   

أَنَّ رَسُولَ اللهِ ﷺ «قَضَى فِيمَنْ زَنَا وَلَمْ يُحْصَنْ أَنْ يُنْفَى عَامًا مَعَ إِقَامَةِ الْحَدِّ عَلَيْهِ»  

[Machine] The Prophet ﷺ said, "If a slave woman commits fornication, flog her. If she commits fornication again, flog her. If she commits fornication a third time, flog her. Then sell her, even if it is with a strand of hair." Abu 'Abd al-Rahman said that Abu Uwais is weak, and his son Isma'il is even weaker than him.  

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِذَا زَنَتِ الْأَمَةُ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَبُو أُوَيْسٍ ضَعِيفٌ وَإِسْمَاعِيلُ ابْنُهُ أَضْعَفُ مِنْهُ  

[Machine] The Prophet ﷺ said, "Uphold the limits (prescribed by Allah) regarding what your right hands possess."  

أَنَّ النَّبِيَّ ﷺ قَالَ «أَقِيمُوا الْحُدُودَ عَلَى مَا مَلَكَتْ أَيْمَانُكُمْ»  

[Machine] The Prophet ﷺ said, "If one of you's slave woman commits adultery, then he should lash her."  

أَنَّ النَّبِيَّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا»  

[Machine] The Prophet ﷺ said, "If any of your female slaves commit adultery, flog them. If they commit adultery again, flog them. If they commit adultery a third time, flog them. And if they commit adultery again, then sell them, even if it is with a rope made of hair."  

أَنَّ النَّبِيَّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ»  

[Machine] On the authority of the Prophet ﷺ who said: "If the servant of any one of you commits adultery, then he should lash her." He repeated this three times. If she does it again, then he should sell her, even if it is with a rope made of hair.  

عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا زَنَتْ خَادِمُ أَحَدِكُمْ فَلْيَجْلِدْهَا» قَالَهَا ثَلَاثًا فَإِنْ عَادَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ  

[Machine] The Messenger of Allah ﷺ said, "If any of you finds his female slave committing adultery, he should whip her using the Book of Allah. If she repeats it, he should sell her, even if it is with a rope made of hair."  

قَالَ رَسُولُ اللهِ ﷺ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا بِكِتَابِ اللهِ فَإِنْ عَادَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ»  

[Machine] On the authority of the Prophet ﷺ who said, "When one of you's female slave commits adultery, then flog her."  

عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا»  

I heard the Prophet ﷺ saying, "If a slave-girl of yours commits illegal sexual intercourse and her illegal sexual intercourse is proved, she should be lashed, and after that nobody should blame her, and if she commits illegal sexual intercourse the second time, she should be lashed and nobody should blame her after that, and if she does the offense for the third time and her illegal sexual intercourse is proved, she should be sold even for a hair rope." (Using translation from Bukhārī 2234)  

قَالَ رَسُولُ اللهِ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا وَإِنْ زَنَتِ الثَّالِثَةَ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ»  

[Machine] From the Prophet, ﷺ , he said, "If one of you's slave woman commits adultery, then he should punish her (by lashing), and not harm her. If she commits adultery again, then he should punish her (by lashing) again. And if she commits adultery again, then he should sell her, even if it is with a rope made of hair or braids made of hair."  

عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا وَلَا يُعَنِّفْهَا فَإِنْ زَنَتْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ أَوْ بِضَفِيرٍ مِنْ شَعْرٍ»  

[Machine] The Prophet of Allah ﷺ said, "If the slave woman of any of you commits adultery, then ascertain her adultery and inflict the prescribed punishment upon her and do not inflict any extra punishment beyond that." Qutaybah added three things: If she commits adultery, then sell her even if it is with a strand of hair.  

قَالَ رَسُولُ اللهِ ﷺ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ» ثَلَاثًا زَادَ قُتَيْبَةُ وَإِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ  

[Machine] That the Prophet ﷺ said, "If the slave girl of one of you commits adultery, then he should flog her. If she commits adultery again, then he should flog her. And do not revile her, for if she commits adultery again, then he should sell her, even if it is for a strand of hair."  

أَنَّ النَّبِيَّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا فَإِنْ زَنَتْ فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ عَلَيْهَا فَإِنْ زَنَتْ فَلْيَبِعْهَا وَلَوْ بِضَفِيرٍ»  

[Machine] On the authority of the Prophet ﷺ , he said, "If one of you's slave woman commits adultery, he should flog her and not reproach her. Then if she commits adultery again, he should flog her and not reproach her. Then if she commits adultery again, he should sell her, even if it be with a hair of a rope." Narrated by Ali ibn Sa'id ibn Jarir An-Nasai, who said: "Yaqub ibn Ibrahim narrated to us, who said: 'My father narrated to us from Salih, from Muhammad ibn 'Ajlana, from Al-Maqburi, from Abu Hurayrah something similar to it."  

عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ ثُمَّ إِنْ زَنَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ» 7212 أَخْبَرَنَا عَلِيُّ بْنُ سَعِيدِ بْنِ جَرِيرٍ النَّسَائِيُّ قَالَ حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ قَالَ حَدَّثَنَا أَبِي عَنْ صَالِحٍ عَنْ مُحَمَّدِ بْنِ عَجْلَانَ عَنِ الْمَقْبُرِيِّ عَنْ أَبِي هُرَيْرَةَ نَحْوَ ذَلِكَ  

[Machine] "If a woman commits adultery, then flog her and do not cover up for her. If she commits adultery again, then flog her and do not cover up for her. If she commits adultery again, then flog her and do not cover up for her. Then sell her in the third or fourth time, even if it is with a rope." Bishr said in his narration: "If she commits adultery again, then flog her and do not cover up for her. Then sell her, even if it is with a rope."  

«إِذَا زَنَتِ الْأَمَةُ فَاجْلِدُوهَا وَلَا تُثَرِّبُوا عَلَيْهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا وَلَا تُثَرِّبُوا عَلَيْهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا وَلَا تُثَرِّبُوا عَلَيْهَا ثُمَّ بِيعُوهَا فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ ثُمَّ بِيعُوهَا وَلَوْ بِحَبْلٍ» قَالَ بِشْرٌ فِي حَدِيثِهِ ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا وَلَا تُثَرِّبُوا عَلَيْهَا ثُمَّ بِيعُوهَا وَلَوْ بِحَبْلٍ  

When the slave-woman of any of you commits adultery and this (offence of hers) becomes clear, she should be flogged (as the prescribed) punishment, but hurl no reproach at her. If she commits adultery again, she should (again be punished) by flogging, but hurl no reproach upon her. If she commits fornication for the third time and it becomes clear, then he should sell her, even if only for a rope of hair. (Using translation from Muslim 1703a)   

قَالَ رَسُولُ اللهِ ﷺ «إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ عَلَيْهَا فَإِنْ عَادَتْ فَزَنَتْ فَلْيَجْلِدْهَا وَلَا يُثَرِّبْ عَلَيْهَا فَإِنْ عَادَتْ فَزَنَتْ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ»  

[Machine] The Prophet ﷺ was approached by a man who said, "My wife has committed adultery." After investigating and confirming her adultery, the Prophet said, "Give her fifty lashes." The man returned and said, "She has repeated the act." Again, after verifying her adultery, the Prophet said, "Give her fifty lashes." The man returned once more and said, "She has repeated the act." Again, the Prophet verified the adultery and said, "Give her fifty lashes." The man returned yet again and said, "She has repeated the act." This time, the Prophet instructed, "Divorce her, even if it's with a hairstring."  

أَتَى النَّبِيَّ ﷺ رَجُلٌ فَقَالَ جَارِيَتِي زَنَتْ فَتَبَيَّنَ زِنَاهَا قَالَ «اجْلِدْهَا خَمْسِينَ» ثُمَّ أَتَاهُ فَقَالَ عَادَتْ فَتَبَيَّنَ زِنَاهَا قَالَ «اجْلِدْهَا خَمْسِينَ» ثُمَّ أَتَاهُ فَقَالَ عَادَتْ فَتَبَيَّنَ زِنَاهَا قَالَ «اجْلِدْهَا خَمْسِينَ» ثُمَّ أَتَاهُ فَقَالَ عَادَتْ فَتَبَيَّنَ زِنَاهَا قَالَ «بِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ»  

[Machine] On the authority of the Prophet ﷺ , a man came to him and said, "Indeed, my wife committed adultery." He (the Prophet ﷺ ) said, "Flog her" (i.e. punish her with fifty lashes). He (the man) asked, "What if she does it again?" He (the Prophet ﷺ ) said, "Then flog her again." The man asked again, "What if she does it again?" He (the Prophet ﷺ ) said, "Then flog her again, and if she does it again, then divorce her, even if it is with a strand of hair." Abu Abdur Rahman (the narrator) said, "This was a mistake, and the one before it was also a mistake. The correct opinion is the one before that one."  

عَنِ النَّبِيِّ ﷺ أَنَّهُ جَاءَهُ رَجُلٌ فَقَالَ إِنَّ وَلِيدَتِي زَنَتْ قَالَ «اجْلِدْهَا خَمْسِينَ» قَالَ فَإِنْ عَادَتْ؟ قَالَ «فَعُدْ» قَالَ فَإِنْ عَادَتْ قَالَ «فَعُدْ فَإِنْ عَادَتْ فَبِعْهَا وَلَوْ بِضَفِيرٍ» فِي الرَّابِعَةِ أَوِ الثَّالِثَةِ وَالضَّفِيرُ الْحَبْلُ قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا خَطَأٌ وَالَّذِي قَبْلَهُ خَطَأٌ وَالصَّوَابُ الَّذِي قَبْلَهُ  

[Machine] Abu Hurairah and Zaid bin Khalid reported that they heard the Messenger of Allah ﷺ being asked about what should be done with a slave woman if she commits adultery and does not repent. He replied, "Lash her, and if she commits adultery again, lash her. And if she commits adultery again, lash her. Then sell her, even if it is with a rope."  

أَنَّ أَبَا هُرَيْرَةَ وَزِيدَ بْنَ خَالِدٍ حَدَّثَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللهِ ﷺ وَهُوَ يُسْأَلُ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصِنْ؟ قَالَ «اجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ وَالضَّفِيرُ الْحَبْلُ»  

that Messenger of Allah ﷺ was asked about an unmarried slave-girl who committed illegal sexual intercourse. They heard him saying, "Flog her, and if she commits illegal sexual intercourse after that, flog her again, and on the third (or the fourth) offense, sell her." (Using translation from Bukhārī 2232)   

أَخْبَرَهُ أَنَّ أَبَا هُرَيْرَةَ وَزَيْدَ بْنَ خَالِدٍ أَخْبَرَاهُ أَنَّهُمَا سَمِعَا رَسُولَ اللهِ ﷺ وَهُوَ يُسْأَلُ عَنِ الْأَمَةِ تَزْنِي وَلَمْ تُحْصِنْ قَالَ «اجْلِدُوهَا إِنْ زَنَتْ ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ»  

The Messenger of Allah ﷺ was asked about a slave-woman who commits fornication, and she is not married: If she commits fornication, flog her: if she commits fornication again flog her; if only for a rope of hair (dafir). Ibn Shihab: I do not know whether he (the Prophet) said it is a third or a fourth time. (Using translation from Abū Dāʾūd 4469)   

أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصِنْ؟ قَالَ «إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ بَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ» وَالضَّفِيرُ الْحَبْلُ  

[Machine] "The Prophet ﷺ was asked about a slave girl who commits adultery before she is married. He said, 'Flog her, and if she commits adultery again, flog her.' He also said regarding the fourth or third time, 'Sell her, even if it is for her hair.' Abu Abdul Rahman said, 'The correct narration is from Malik, and the mistake in this narration is from Shibil.'"  

أَنَّ النَّبِيَّ ﷺ سُئِلَ عَنِ الْأَمَةِ تَزْنِي قَبْلَ أَنْ تُحْصِنَ قَالَ اجْلِدُوهَا فَإِنْ زَنَتْ فَاجْلِدُوهَا وَقَالَ فِي الرَّابِعَةِ أَوِ الثَّالِثَةِ بِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ أَبُو عَبْدِ الرَّحْمَنِ وَالصَّوَابُ حَدِيثُ مَالِكٍ وَشِبْلٌ فِي هَذَا الْحَدِيثِ خَطَأٌ  

[Machine] He told him that the Messenger of Allah ﷺ said: "If the slave-girl commits illegal sexual intercourse, then flog her one hundred times, and do not let compassion move you to not flog her. Then if she commits illegal sexual intercourse again after that, flog her another hundred times and do not let compassion move you to not flog her. And yet if she commits illegal sexual intercourse for the third time, then flog her another hundred times and sell her even if only for a rope." And the "rope" is a "frayed one" in the third or fourth (lashing). And Zaid bin Khalid narrated to him (the same) from the Messenger of Allah ﷺ something similar to that.  

أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْوَلِيدَةُ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ وَأَخْبَرَهُ زَيْدُ بْنُ خَالِدٍ عَنْ رَسُولِ اللهِ ﷺ مِثْلَ ذَلِكَ  

[Machine] He informed him that the Messenger of Allah ﷺ said, "If the slavegirl commits adultery, then flog her, and if she commits adultery again, then flog her again, and if she commits adultery again, then sell her, even if it is for a rope." And the rope is in the third or fourth offense.  

أَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْوَلِيدَةُ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ  

“If a slave woman commits fornication then whip her, and if she commits fornication then whip her, and if she commits fornication then whip her, then sell her even if that is for a rope.” (Using translation from Ibn Mājah 2566)

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «إِذَا زَنَتِ الْأَمَةُ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ» وَالضَّفِيرُ الْحَبْلُ  

[Machine] Narrated Abu Huraira: Allah's Apostle ﷺ said, "When a slave is freed by his master and he has the price of his freedom, he must pay his master the price and keep what remains as his reward in the Hereafter. If a slave is granted freedom by sharing the value of his price with his master, he has to pay his master the share agreed upon, and the rest will be his reward in the Hereafter." Abu 'Abdullah said, "This is the tradition which has been criticized by the scholars."  

عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا أَصَابَ الْمُكَاتِبُ حَدًّا أَوْ مِيرَاثًا وَرِثَ بِحِسَابِ مَا عُتِقَ مِنْهُ وَأُقِيمَ عَلَيْهِ الْحَدُّ بِحِسَابِ مَا عُتِقَ مِنْهُ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا لَا يَصِحُّ وَهُوَ مُخْتَلَفٌ فِيهِ  

[Machine] A girl came to me and I mentioned that to the Prophet ﷺ . He said, "Do not beat her until she gives birth."  

زَنَتْ جَارِيَةٌ لِي فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «لَا تَضْرِبْهَا حَتَّى تَضَعَ»  

[Machine] The Messenger of Allah ﷺ said, "Implement the punishment on her." So, I looked and found that the blood had not dried from her. So, I went to the Prophet ﷺ and he said, "When the blood dries from her, carry out the prescribed punishment on what your right hands possess."  

رَسُولُ اللهِ ﷺ «أَقِمْ عَلَيْهَا الْحَدَّ» فَنَظَرْتُ فَإِذَا هِيَ لَمْ يَجِفَّ عَنْهَا الدَّمُ فَأَتَيْتُ النَّبِيَّ ﷺ فَقَالَ «إِذَا جَفَّ عَنْهَا الدَّمُ وَأَقِيمُوا الْحُدُودَ عَلَى مَا مَلَكَتْ أَيْمَانُكُمْ»  

[Machine] The Prophet ﷺ was informed about a group of people who had committed a crime, so he sent me to them and said, "Go and establish the punishment (hadd) upon them." So, I went and found that their blood had not dried up yet, so I returned to him and said, "I found that their blood has not dried up yet." The Messenger of Allah ﷺ said, "Wait until it dries up, then whip them." Then the Messenger of Allah ﷺ said, "Establish the punishments on what your right hands possess." Abu Abdullah Al-Rahman Al-A'la said, "He (the Prophet) is not strong in that."  

أُخْبِرَ النَّبِيُّ ﷺ بِأَمَةٍ لَهُمْ فَجَرَتْ فَأَرْسَلَنِي إِلَيْهَا فَقَالَ «اذْهَبْ فَأَقِمْ عَلَيْهَا الْحَدَّ» فَانْطَلَقْتُ فَوَجَدْتُهَا لَمْ تَجِفَّ مِنْ دِمَائِهَا فَرَجَعْتُ إِلَيْهِ فَقُلْتُ لَهُ وَجَدْتُهَا لَمْ تَجِفَّ مِنْ دِمَائِهَا فَقَالَ رَسُولُ اللهِ ﷺ «فَإِذَا هِيَ جَفَّتْ مِنْ دِمَائِهَا فَاجْلِدْهَا» ثُمَّ قَالَ رَسُولُ اللهِ ﷺ «أَقِيمُوا الْحُدُودَ عَلَى مَا مَلَكَتْ أَيْمَانُكُمْ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ عَبْدُ الْأَعْلَى لَيْسَ بِذَلِكَ الْقَوِيِّ  

[Machine] The Messenger of Allah ﷺ was brought a woman who was experiencing abnormal bleeding after childbirth, in order to consult him about her situation. He said, "Go until the bleeding stops." Abu Abdul Rahman said, "This is a rejected Hadith, it has no basis."  

أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِامْرَأَةٍ بَغِيٍّ فِي نِفَاسِهَا لِيَحِدَّهَا قَالَ «اذْهَبِي حَتَّى يَنْقَطِعَ عَنْكِ الدَّمُ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا حَدِيثٌ مُنْكَرٌ لَا شَيْءَ  

[Machine] I was sitting with the Messenger of Allah ﷺ when al-Ghamidiyyah from the Azd tribe came to him and said, "O Messenger of Allah, I have committed adultery." He turned her away. She said, "O Messenger of Allah, do you want to turn me away as you turned away Ma'iz?" By Allah, I am now pregnant." He said, "Go until you give birth to the child." She came back and said, "I have given birth to the child, O Messenger of Allah." He said, "Go and breastfeed him." She breastfed him and came back with the child in her hand, eating a piece of date. She said, "I have breastfed him and he is now eating." The Messenger of Allah ﷺ then gave him to a Muslim man and ordered them to dig a hole up to her chest. He then ordered his companions and they stoned her. Khalid bin Al-Waleed threw a stone at her with which something from her blood splashed on his clothes. He cursed her, so the Messenger of Allah ﷺ said to him, "Do not curse her, O Khalid, for she has repented with a repentance that, if the people of Makkah repented with, it would be sufficient for them." Then he commanded that she be shrouded and prayed over. Bashir said, "Ibn Buraida narrated to me from his father that we, the companions of Muhammad ﷺ, used to talk that if the goat and this woman had not begged for forgiveness in the fourth time, then the Messenger of Allah ﷺ would not have sought them."  

كُنْتُ جَالِسًا عِنْدَ رَسُولِ اللهِ ﷺ فَجَاءَتْهُ الْغَامِدِيَّةُ مِنَ الْأَزْدِ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي زَنَيْتُ فَرَدَّهَا فَقَالَتْ يَا رَسُولَ اللهِ أَتُرِيدُ أَنْ تَرُدَّنِي كَمَا رَدَدْتَ مَاعِزًا فَوَاللهِ إِنِّي الْآنَ لَحُبْلَى قَالَ انْطَلِقِي حَتَّى تَضَعِيهِ ثُمَّ جَاءَتْ فَقَالَتْ قَدْ وَضَعْتُهُ يَا رَسُولَ اللهِ قَالَ «انْطَلِقِي حَتَّى تَفْطِمِيهِ» فَفَطَمَتْهُ ثُمَّ جَاءَتْ بِهِ وَفِي يَدِهِ كِسْرَةٌ يَأْكُلُهَا فَقَالَتْ قَدْ فَطَمْتُهُ وَهُوَ ذَا يَأْكُلُ فَدَفَعَهُ رَسُولُ اللهِ ﷺ إِلَى رَجُلٍ مِنَ الْمُسْلِمِينَ ثُمَّ أَمَرَهُمْ فَحَفَرُوا لَهَا حُفْرَةً إِلَى صَدْرِهَا ثُمَّ أَمَرَ أَصْحَابَهُ فَرَجَمُوهَا فَرَمَاهَا خَالِدُ بْنُ الْوَلِيدِ بِحَجَرٍ فَانْتَضِحْ شَيْءٌ مِنْ دَمِهَا عَلَى جُبَّةِ خَالِدٍ فَسَبَّهَا فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «لَا تَسُبَّهَا يَا خَالِدُ؛ فَإِنَّهَا قَدْ تَابَتْ تَوْبَةً لَوْ تَابَهَا صَاحِبُ مَكْسٍ لَتَابَ اللهُ عَلَيْهِ ثُمَّ أَمَرَ بِهَا فَكُفِّنَتْ ثُمَّ صَلَّى عَلَيْهَا» قَالَ بَشِيرٌ فَحَدَّثَنِي ابْنُ بُرَيْدَةَ عَنْ أَبِيهِ قَالَ كُنَّا أَصْحَابَ مُحَمَّدٍ ﷺ نَتَحَدَّثُ لَوْ أَنَّ مَاعِزًا وَهَذِهِ الْمَرْأَةَ لَمْ يُجِيبَا فِي الرَّابِعَةِ لَمْ يَطْلُبْهُمَا رَسُولُ اللهِ ﷺ  

[Machine] A woman was stoned during the time of the Prophet Muhammad ﷺ . After we finished stoning her, I went to the Prophet Muhammad ﷺ and said, "We have stoned this wicked woman." The Messenger of Allah ﷺ replied, "Stoning is an expiation for what she has done."  

رُجِمَتِ امْرَأَةٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَلَمَّا فَرَغْنَا مِنْهَا جِئْتُ إِلَى رَسُولِ اللهِ ﷺ فَقُلْتُ قَدْ رَجَمْنَا هَذِهِ الْخَبِيثَةَ فَقَالَ رَسُولُ اللهِ ﷺ «الرَّجْمُ كَفَّارَةُ مَا صَنَعَتْ»  

[Machine] A woman was stoned during the time of the Messenger of Allah ﷺ . When we were done with her, I went to the Prophet ﷺ and said, "O Messenger of Allah, we have stoned this wicked woman." The Messenger of Allah ﷺ said, "It is a means of expiation for what she has done." Abu 'Abd al-Rahman said, "ʻAmr ibn al-Sharid was not a Sahabi (a companion of the Prophet) and I do not know Qasim ibn Rashid, but he seems to be a Madani (from Madinah), and Makhrama ibn Bukayr ibn Abdullah ibn al-Ashajj did not hear it from his father."  

رُجِمَتِ امْرَأَةٌ فِي عَهْدِ رَسُولِ اللهِ ﷺ فَلَمَّا فَرَغْنَا مِنْهَا جِئْتُ إِلَى النَّبِيِّ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ قَدْ رَجَمْنَا هَذِهِ الْخَبِيثَةَ فَقَالَ رَسُولُ اللهِ ﷺ «هُوَ كَفَّارَةُ مَا صَنَعَتْ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَيْسَ لِعَمْرِو بْنِ الشَّرِيدِ صُحْبَةٌ وَالْقَاسِمُ بْنُ رِشْدِينَ لَا أَعْرِفُهُ وَيُشْبِهِ أَنْ يَكُونَ مَدَنِيًّا وَمَخْرَمَةُ بْنُ بُكَيْرِ بْنِ عَبْدِ اللهِ بْنِ الْأَشَجِّ لَمْ يَسْمَعْ مِنْ أَبِيهِ  

[Machine] Ma'iz bin Malik came to the Prophet ﷺ and said, "O Messenger of Allah, establish the punishment prescribed by Allah upon me." He turned him away four times. Then the Prophet ﷺ commanded that he be stoned. When the stones hit him, he tried to escape but was caught by Abdullah bin Unais from his tribe who struck him with a stick and killed him. Abdullah then came to the Prophet ﷺ and informed him of the incident. The Prophet ﷺ said, "Why did you not leave him? Perhaps he would repent, and then Allah would accept his repentance." Then he said, "O Hzal (the nickname of Abdullah), it would have been better for you if you had covered him with your garment."  

أَنَّ مَاعِزَ بْنَ مَالِكٍ أَتَى النَّبِيَّ ﷺ فَقَالَ أَقِمْ عَلَيَّ كِتَابَ اللهِ فَأَعْرَضَ عَنْهُ أَرْبَعَ مِرَارٍ ثُمَّ أَمَرَ النَّبِيُّ ﷺ بِرَجْمِهِ فَلَمَّا مَسَّتْهُ الْحِجَارَةُ خَرَجَ يَشْتَدُّ وَخَرَجَ عَبْدُ اللهِ بْنُ أُنَيْسٍ مِنْ نَادِي قَوْمِهِ بِوَظِيفِ حِمَارٍ فَضَرَبَهُ فَصَرَعَهُ فَأَتَى النَّبِيَّ ﷺ فَحَدَّثَهُ بِأَمْرِهِ فَقَالَ «أَلَا تَرَكْتُمُوهُ لَعَلَّهُ يَتُوبُ فَيَتُوبَ اللهُ عَلَيْهِ» ثُمَّ قَالَ «يَا هَزَّالُ لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ»  

[Machine] "That the Prophet ﷺ said, 'Woe to you, O Hazzal, if you had covered it with your own garment, it would have been better for you.'"  

أَنَّ النَّبِيَّ ﷺ قَالَ «وَيْلَكَ يَا هَزَّالُ لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ»  

[Machine] The Prophet ﷺ said to him, "O Hazal, if you cover it with your garment, it would be better for you." Yahya said, "So I mentioned this Hadith to Ibn Ibn Nua'im Ibn Hazal, and he said, 'He is my grandfather.' He said, 'This has indeed happened.'"  

لَهُ النَّبِيُّ ﷺ «يَا هَزَّالُ لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ» قَالَ يَحْيَى فَذَكَرْتُ هَذَا الْحَدِيثَ لِابْنِ ابْنِهِ يَزِيدَ بْنِ نُعَيْمِ بْنِ هَزَّالٍ فَقَالَ هُوَ جَدِّي قَالَ قَدْ كَانَ هَذَا  

[Machine] The Messenger of Allah ﷺ said to a man who had embraced Islam and was called Hazal, "O Hazal, if you cover yourself with your clothes, it would be better for you." Yahya said, "I was informed of this hadith in a gathering that included Yazid ibn Nu'aym ibn Hazal al-Aslami, who said, 'Hazal is my grandfather, and this hadith is true.'"  

أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِرَجُلٍ مِنْ أَسْلَمَ يُقَالُ لَهُ هَزَّالٌ «يَا هَزَّالِ لَوْ سَتَرْتَهُ بِرِدَائِكَ كَانَ خَيْرًا لَكَ» قَالَ يَحْيَى فَحُدِّثْتُ بِهَذَا الْحَدِيثِ فِي مَجْلِسٍ فِيهِ يَزِيدُ بْنُ نُعَيْمِ بْنِ هَزَّالٍ الْأَسْلَمِيُّ فَقَالَ يَزِيدُ هَزَّالٌ جَدِّي وَهَذَا الْحَدِيثُ حَقٌّ  

[Machine] That the Prophet ﷺ would come and inform him of his hadith, so he went to Ma'iz and informed him, but he turned away from him while he was repeating that to the Messenger of Allah ﷺ. So he sent to his people and asked them, "Is he insane?". They said, "No." So he asked them, "Is he married or unmarried?" They said, "He is married." So he ordered that he be stoned. Then he said, "O Hazal, if you had concealed it, it would have been better for you."  

أَنْ يَأْتِيَ النَّبِيَّ ﷺ فَيُخْبِرَهُ بِحَدِيثِهِ فَأَتَى مَاعِزٌ فَأَخْبَرَهُ فَأَعْرَضَ عَنْهُ وَهُوَ يُرَدِّدُ ذَلِكَ عَلَى رَسُولِ اللهِ ﷺ فَبَعَثَ إِلَى قَوْمِهِ فَسَأَلَهُمْ أَبِهِ جُنُونٌ؟ قَالُوا لَا فَسَأَلَ عَنْهُ أَثَيِّبٌ أَمْ بِكْرٌ قَالُوا ثَيِّبٌ فَأَمَرَ بِهِ فَرُجِمَ ثُمَّ قَالَ «يَا هَزَّالُ لَوْ سَتَرْتَهُ كَانَ خَيْرًا لَكَ»  

[Machine] To acknowledge and repent before he came to the Messenger of Allah, ﷺ , so the Messenger of Allah, ﷺ , commanded his stoning.  

أَنْ يَعْتَرِفَ وَيَتُوبَ حَتَّى أَتَى رَسُولَ اللهِ ﷺ «فَأَمَرَ رَسُولُ اللهِ ﷺ بِرَجْمِهِ»  

[Machine] He (the Prophet) commanded him to go to the Prophet ﷺ to inform him about what you did, in case a revelation be sent down concerning you. The Prophet ﷺ then ordered that he be stoned. When the stones bit him, he left and encountered a man who struck him with a camel's leg, causing him to die. He (the man) said, "O Hazal, if you had covered him with your garment, it would have been better for you."  

لَهُ انْطَلِقْ إِلَى النَّبِيِّ ﷺ فَتُخْبِرَهُ بِالَّذِي صَنَعْتَ عَسَى أَنْ يَنْزِلَ فِيكَ قُرْآنٌ فَأَمَرَ بِهِ النَّبِيُّ ﷺ فَرُجِمَ فَلَمَّا عَضَّتْهُ مَسُّ الْحِجَارَةِ انْطَلَقَ فَاسْتَقْبَلَهُ رَجُلٌ بِكَذَا وَكَذَا أَوْ بِسَاقِ بَعِيرٍ فَضَرَبَهُ فَصَرَعَهُ فَقَالَ «يَا هَزَّالُ لَوْ سَتَرْتَهُ بِثَوْبِكَ كَانَ خَيْرًا لَكَ»  

The Prophet ﷺ said: He who sees something which should be kept hidden and conceals it will be like one who has brought to life a girl buried alive. (Using translation from Abū Dāʾūd 4891)   

سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنْ رَأَى عَوْرَةً فَسَتَرَهَا كَانَ كَمَنْ أَحْيَا مَوْءُودَةً مِنْ قَبْرِهَا»
