"If he forced her, then she is free at his expense and he has to give her mistress a similar slave as a replacement. If she obeyed him in that, then she belongs to her mistress, and he has to give her mistress a similar slave as well."

أَنَّ رَجُلاً غَشِيَ جَارِيَةً لاِمْرَأَتِهِ فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ مِنْ مَالِهِ وَعَلَيْهِ الشَّرْوَى لِسَيِّدَتِهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لِسَيِّدَتِهَا وَمِثْلُهَا مِنْ مَالِهِ

"The Prophet passed judgment concerning a man who had intercourse with his wife's slave woman: 'If he forced her, then she is free, and he has to give her mistress a similar slave as a replacement; if she obeyed him in that, then she belongs to him, and he has to give her mistress a similar slave as a replacement.'" قَضَى رَسُولُ اللهِ ﷺ فِي رَجُلٍ وَطَأَ جَارِيَةَ امْرَأَتَهِ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ أَمَةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا»

[Machine] The Prophet ﷺ ruled regarding a man who had sexual intercourse with his slave-woman, whether it was against her will, she is free, and the man has to give her mistress the same punishment, and if she willingly obeyed him, then she belongs to him and her mistress has the same right over her.

«قَضَى النَّبِيُّ ﷺ فِي رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا»

"If he forced her, then she is free at his expense and he has to give her mistress a similar slave as a replacement. If she obeyed him in that, then she belongs to her mistress, and he has to give her mistress a similar slave as well." (Using translation from Nasāʾī 3364)

[Machine] About the Prophet ﷺ regarding a man who had sexual intercourse with his wife's slave-girl, he said: "If he forced her to do so, then she is free, and he must free a slave-girl like her. But if she willingly agreed, then she is a slave-girl and he must free a slave-girl like her." This was narrated by Ma'mar from Qatadah.

عَنِ النَّبِيِّ ﷺ فِي رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ فَقَالَ إِنِ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَلَهَا عَلَيْهِ مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَةٌ وَلَهَا عَلَيْهِ مِثْلُهَا وَرَوَاهُ مَعْمَرٌ عَنْ قَتَادَةَ

"عَنْ سَلَمَةَ بْن الْمُحَبِّقِ قَالَ: قَضَى رَسُولُ الله ﷺ فِى رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِه: إِنْ كَانَ اسْتَكْرَهَها فَهِى حُرَّةٌ، وَعَلَيْهِ لِسَيِّدَتِها مِثْلُها، وَإنْ كَانَتْ طَاوَعَتْهُ فَهِى لَهُ، وَعَلَيْهِ لِسَيِّدتِهَا مِثْلُهَا".
