"If he forced her, then she is free at his expense and he has to give her mistress a similar slave as a replacement. If she obeyed him in that, then she belongs to her mistress, and he has to give her mistress a similar slave as well."

أَنَّ رَجُلاً غَشِيَ جَارِيَةً لاِمْرَأَتِهِ فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللَّهِ ﷺ فَقَالَ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ مِنْ مَالِهِ وَعَلَيْهِ الشَّرْوَى لِسَيِّدَتِهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لِسَيِّدَتِهَا وَمِثْلُهَا مِنْ مَالِهِ

[Machine] The Messenger of Allah ﷺ was asked about a man who has intercourse with his wife's slave-girl. He said, "If he dislikes her, then she is a free woman and she has the same right over him as she had over him. And if he is pleased with her, then she is his slave-girl and she has the same right over him as she had over him."

سُئِلَ رَسُولُ اللهِ ﷺ عَنِ الرَّجُلِ يُوَاقِعُ جَارِيَةَ امْرَأَتِهِ؟ قَالَ إِنْ أَكْرَهَهَا فَهِيَ حُرَّةٌ وَلَهَا عَلَيْهِ مِثْلُهَا وَإِنْ طَاوَعَتْهُ فَهِيَ أَمَتُهُ وَلَهَا عَلَيْهِ مِثْلُهَا

"The Prophet passed judgment concerning a man who had intercourse with his wife's slave woman: 'If he forced her, then she is free, and he has to give her mistress a similar slave as a replacement; if she obeyed him in that, then she belongs to him, and he has to give her mistress a similar slave as a replacement.'" أَنَّ رَجُلًا وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ فَرُفِعَ ذَاكَ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ مِثْلُهَا لَهَا وَإِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ مِثْلُهَا لَهَا

[Machine] A man went out on a expedition and took with him a slave girl belonging to his wife. He had a relationship with her, and this matter was mentioned to the Prophet ﷺ . He said: "If he forced her (into a relationship), then she is free and he must give her a similar slave girl. But if she willingly submitted, then she is his slave girl and he must give her a similar slave girl." Isma'il (may Allah be pleased with him) narrated that a man was in an expedition.

أَنَّ رَجُلًا خَرَجَ فِي غَزَاةٍ وَمَعَهُ جَارِيَةٌ لِامْرَأَتِهِ فَوَقَعَ بِهَا فَذُكِرَ لِلنَّبِيِّ ﷺ فَقَالَ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ عَتِيقَةٌ وَلَهَا عَلَيْهِ مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَتُهُ وَلَهَا عَلَيْهِ مِثْلُهَا وَقَالَ إِسْمَاعِيلُ مَرَّةً إِنَّ رَجُلًا كَانَ فِي غَزْوَةٍ

[Machine] The Messenger of Allah ﷺ ruled regarding a man who had intercourse with the slave girl of his wife, that if he forced her, then she is free and he must pay her owner an equal compensation.

قَضَى رَسُولُ اللهِ ﷺ فِي رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا

[Machine] About the Prophet ﷺ regarding a man who had relations with his wife's slave girl: "If he forced her, she is free and he must give her the same as her value. And if she willingly submitted, she belongs to him and he must give her the same as her value."

عَنِ النَّبِيِّ ﷺ فِي رَجُلٍ وَقَعَ عَلَى جَارِيَةِ امْرَأَتَهِ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَلَهَا عَلَيْهِ مِثْلُهَا»

قَضَى رَسُولُ اللهِ ﷺ فِي رَجُلٍ وَطَأَ جَارِيَةَ امْرَأَتَهِ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ أَمَةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا»

[AI] I heard a woman ask the Messenger of Allah ﷺ about a slave-girl she owned: her husband had taken her with him on a journey and had intercourse with her. The Messenger of Allah ﷺ said: “If he compelled her, then she is free, and he owes one like her; but if she consented to him, then she is his slave-girl, and he owes one like her.”

سَمِعْتُ امْرَأَةً تَسْأَلُ رَسُولَ اللَّهِ ﷺ عَنْ جَارِيَةٍ لَهَا، خَرَجَ بِهَا زَوْجُهَا إِلَى سَفَرٍ فَأَصَابَهَا، فَقَالَ رَسُولُ اللَّهِ ﷺ: «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ، وَعَلَيْهِ مِثْلُهَا، وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ جَارِيَتُهُ، وَعَلَيْهِ مِثْلُهَا».

[Machine] A man from the Quraysh tribe traveled and took his wife's maid with him. He had relations with her, and when he arrived to the Prophet ﷺ, she informed him about it. The Prophet ﷺ said, "If she did it willingly, then she belongs to him and he must give a similar slave as compensation. But if he forced her, then she is free and he must give a similar slave as compensation."

أَنَّ رَجُلًا مِنْ قُرَيْشٍ سَافَرَ فَأَرْسَلَتْ مَعَهُ امْرَأَتُهُ بِجَارِيَةٍ لَهَا فَغَشَاهَا فَلَمَّا قَدِمَ عَلَى النَّبِيِّ ﷺ أَخْبَرَتْهُ بِذَلِكَ فَقَالَ «إِنَّ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ مِثْلُهَا وَإِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ مِثْلُهَا»

[Machine] The Prophet ﷺ ruled regarding a man who had sexual intercourse with his slave-woman, whether it was against her will, she is free, and the man has to give her mistress the same punishment, and if she willingly obeyed him, then she belongs to him and her mistress has the same right over her.

«قَضَى النَّبِيُّ ﷺ فِي رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا»

"If he forced her, then she is free at his expense and he has to give her mistress a similar slave as a replacement. If she obeyed him in that, then she belongs to her mistress, and he has to give her mistress a similar slave as well." (Using translation from Nasāʾī 3364)

[Machine] A man went on a raid and took with him a slave girl belonging to his wife. Something happened to her, and this was mentioned to the Prophet Muhammad ﷺ . He said, "If he forced her, then she is free and he must give her an equal in compensation. And if she willingly accepted it, then she is a slave and he must give an equal in compensation."

أَنَّ رَجُلًا خَرَجَ فِي غَزَاةٍ وَمَعَهُ جَارِيَةٌ لِامْرَأَتِهِ فَوَقَعَ عَلَيْهَا فَذُكِرَ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لَهَا مَثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَةٌ وَعَلَيْهِ مَثْلُهَا لَهَا»

"If he forced her, then she is free at his expense and he has to give her mistress a similar slave as a replacement. If she obeyed him in that, then she belongs to her mistress, and he has to give her mistress a similar slave as well." (Using translation from Nasāʾī 3364)

أَنَّ رَجُلًا غَشِيَ جَارِيَةَ امْرَأَتِهِ فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ مِنْ مَالِهِ وَعَلَيْهِ الشَّرْوَى لِسَيِّدَتِهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لِسَيِّدَتِهَا وَمِثْلُهَا مِنْ مَالَهُ»

The Messenger of Allah ﷺ made a decision about a man who had intercourse with his wife's slave-girl as follows. If he forced her, she is free, and he shall give her mistress a slave-girl similar to her; if she asked him to have intercourse voluntarily, she will belong to him, and he shall give her mistress a slave-girl similar to her. Abu Dawud said: This tradition has been transmitted by Yunus b. 'Ubaid, 'Amr b. Dinar, Mansur b. Zadhan and Salam from al-Hasan to the same effect. But yunus and Mansur did not mention Qabisah. قَضَى النَّبِيُّ ﷺ فِي رَجُلٍ وَطِئَ جَارِيَةِ امْرَأَتِهِ «إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مَثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ لِسَيِّدَتِهَا مَثْلُهَا» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَيْسَ فِي هَذَا الْبَابِ شَيْءٌ صَحِيحٌ يُحْتَجُّ بِهِ

[Machine] A man had an intimate encounter with a woman who was married to him. They were brought to the Prophet ﷺ and he said, "If she did it willingly, then she belongs to him and he must give something of equal value in compensation. But if she was unwilling, then she is free and he must give something of equal value in compensation."

أَنَّ رَجُلًا وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ فَرُفِعُوا إِلَى النَّبِيِّ ﷺ فَقَالَ إِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ مِثْلُهَا وَإِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ مِثْلُهَا كَذَا

"عَنْ سَلَمَةَ بْن الْمُحَبِّقِ قَالَ: قَضَى رَسُولُ الله ﷺ فِى رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِه: إِنْ كَانَ اسْتَكْرَهَها فَهِى حُرَّةٌ، وَعَلَيْهِ لِسَيِّدَتِها مِثْلُها، وَإنْ كَانَتْ طَاوَعَتْهُ فَهِى لَهُ، وَعَلَيْهِ لِسَيِّدتِهَا مِثْلُهَا".
