41. Stoning (4/5)
٤١۔ كِتَابُ الرَّجْمِ ص ٤
The Prophet ﷺ said: He who sees something which should be kept hidden and conceals it will be like one who has brought to life a girl buried alive. (Using translation from Abū Dāʾūd 4891)
عَنْ رَسُولِ اللهِ ﷺ قَالَ «مَنْ رَأَى عَوْرَةً فَسَتَرَهَا كَانَ كَمَنِ اسْتَحْيَا مَوْءُودَةً مِنْ قَبْرِهَا»
[Machine] I heard the Messenger of Allah, ﷺ , say, "Whoever sees a fault or deficiency in a Muslim and conceals it, it is as if he has brought a buried daughter back to life."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «مَنْ رَأَى عَوْرَةً مِنْ مُسْلِمٍ فَسَتَرَهَا فَكَأَنَّمَا اسْتَحْيَا مَوْءُودَةً»
If anyone removes his brother’s anxiety of this world, Allah will remove for him one of the anxieties of the Day of resurrection; if anyone makes easy for an impoverished man, Allah will make easy for him in this world and on the day of resurrection; if anyone conceals a Muslim’s secrets, Allah will conceal his secrets in this world and on the Day of resurrection; Allah will remain in the aid of a servant so long as the servant remains in the aid of his brother. Abu Dawud said: ‘Uthman did not transmit the following words from Abu Mu’awiyah: “if anyone makes easy for an impoverished man”. (Using translation from Abū Dāʾūd 4946)
عَنِ النَّبِيِّ ﷺ قَالَ «مَنْ سَتَرَ أَخَاهُ الْمُسْلِمَ فِي الدُّنْيَا سَتَرَهُ اللهُ فِي الدُّنْيَا وَالْآخِرَةِ وَمَنْ نَفَّسَ عَنْ أَخِيهِ كُرْبَةً مِنْ كُرَبِ الدُّنْيَا نَفَّسَ اللهُ عَنْهُ كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَاللهُ فِي عَوْنِ الْعَبْدِ مَا كَانَ الْعَبْدُ فِي عَوْنِ أَخِيهِ»

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ نَفَّسَ عَنْ أَخِيهِ الْمُسْلِمِ كُرْبَةً مِنْ كُرَبِ الدُّنْيَا نَفَّسَ اللهُ عَنْهُ كُرْبَةً مِنْ كُرَبِ الْآخِرَةِ وَمَنْ سَتَرَ أَخَاهُ الْمُسْلِمَ سَتَرَهُ اللهُ فِي الدُّنْيَا وَالْآخِرَةِ وَاللهُ فِي عَوْنِ الْعَبْدِ مَا كَانَ الْعَبْدُ فِي عَوْنِ أَخِيهِ»
That the Messenger of Allah ﷺ said: "Whoever relieves a Muslim of a burden from the burdens of the world, Allah will relieve him of a burden from the burdens of the Hereafter. And whoever covers (the faults of) a Muslim, Allah will cover (his faults) for him in the world and the Hereafter. And Allah is engaged in helping the worshipper as long as the worshipper is engaged in helping his brother." (Using translation from Tirmidhī 1425)
قَالَ رَسُولُ اللهِ ﷺ «مَنْ فَرَّجَ عَنْ مُسْلِمٍ كُرْبَةً مِنْ كُرَبِ الدُّنْيَا فَرَّجَ اللهُ عَنْهُ كُرْبَةً مِنْ كُرَبِ الْآخِرَةِ وَمَنْ سَتَرَ أَخَاهُ الْمُؤْمِنَ فِي الدُّنْيَا سَتَرَهُ اللهُ فِي الْآخِرَةِ وَاللهُ فِي عَوْنِ الْعَبْدِ مَا كَانَ الْعَبْدُ فِي عَوْنِ أَخِيهِ»
[Machine] The Messenger of Allah ﷺ said, "Whoever relieves his brother of a distress, Allah will relieve him of a distress from the distressful Day of Judgment. And whoever conceals the faults of a Muslim, Allah will conceal his faults in this world and the Hereafter. Allah helps a servant as long as the servant helps his brother."
قَالَ رَسُولُ اللهِ ﷺ «مَنْ فَرَّجَ عَنْ أَخِيهِ كُرْبَةً فَرَّجَ اللهُ عَنْهُ كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَمَنْ سَتَرَ عَلَى أَخِيهِ الْمُسْلِمِ سَتَرَ اللهُ عَلَيْهِ فِي الدُّنْيَا وَالْآخِرَةِ وَاللهُ فِي حَاجَةِ الْعَبْدِ مَا كَانَ الْعَبْدُ فِي حَاجَةِ أَخِيهِ»
[Machine] The Messenger of Allah ﷺ said, "Whoever relieves a believer of a hardship from the hardships of this world, Allah will relieve him of a hardship from the hardships of the Hereafter. And whoever conceals the faults of a Muslim, Allah will conceal his faults in this world and the Hereafter. Allah will assist a servant as long as the servant is assisting his brother." [467] 7249 Ibrahim bin Ya'qub told me that Abu Nu'man told us that Abu 'Awanah told us from Al-A'mash from Abu Salih from Abu Hurairah. Perhaps he said from Abu Sa'id: The Messenger of Allah ﷺ said, "Whoever relieves a believer of a hardship, Allah will relieve him of a hardship similar to it, whether it be physical or otherwise." 7250 Muhammad bin Isma'il bin Samura Al-Kufi told me that Asbat, the son of Muhammad, told us that Al-A'mash told us: I was informed by Abu Salih, who was informed by Abu Hurairah, who narrated from the Prophet ﷺ something similar to that.
قَالَ رَسُولُ اللهِ ﷺ «مَنْ نَفَّسَ عَنْ مُسْلِمٍ كُرْبَةً مِنْ كُرَبِ الدُّنْيَا نَفَّسَ اللهُ عَنْهُ كُرْبَةً مِنْ كُرَبِ الْآخِرَةِ وَمَنْ سَتَرَ عَلَى مُسْلِمٍ سَتَرَهُ اللهُ فِي الدُّنْيَا وَالْآخِرَةِ وَاللهُ فِي عَوْنِ الْعَبْدِ مَا كَانَ الْعَبْدُ فِي عَوْنِ أَخِيهِ» [467] 7249 أَخْبَرَنِي إِبْرَاهِيمُ بْنُ يَعْقُوبَ قَالَ حَدَّثَنَا أَبُو النُّعْمَانُ قَالَ حَدَّثَنَا أَبُو عَوَانَةَ عَنِ الْأَعْمَشِ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ وَرُبَّمَا قَالَ عَنْ أَبِي سَعِيدٍ قَالَ قَالَ رَسُولُ اللهِ ﷺ مَنْ نَفَّسَ عَنْ مُسْلِمٍ كُرْبَةً مِثْلَهُ سَوَاءً 7250 أَخْبَرَنِي مُحَمَّدُ بْنُ إِسْمَاعِيلَ بْنِ سَمُرَةَ الْكُوفِيُّ قَالَ حَدَّثَنَا أَسْبَاطٌ هُوَ ابْنُ مُحَمَّدٍ قَالَ حَدَّثَنَا الْأَعْمَشُ قَالَ حُدِّثْتُ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ ﷺ نَحْوَهُ
A Muslim is a Muslim’s brother: he does not wrong him or abandon him. If anyone cares for his brother’s need, Allah will care for his need ; if anyone removes a Muslim’s anxiety, Allah will remove from him, on account of it, one of the anxieties of the Day of resurrection ; and if anyone conceals a Muslim’s fault, Allah will conceal his fault on the Day of resurrection. أَنَّ رَسُولَ اللهِ ﷺ قَالَ «الْمُسْلِمُ أَخُو الْمُسْلِمِ لَا يَظْلِمُهُ وَلَا يُسْلِمُهُ مَنْ كَانَ فِي حَاجَةِ أَخِيهِ كَانَ اللهُ فِي حَاجَتِهِ وَمَنْ فَرَّجَ عَنْ مُسْلِمٍ كُرْبَةً فَرَّجَ اللهُ عَنْهُ كُرْبَةً مِنْ كُرَبِ يَوْمِ الْقِيَامَةِ وَمَنْ سَتَرَ مُسْلِمًا سَتَرَهُ اللهُ يَوْمَ الْقِيَامَةِ»
"We were with the Prophet in a gathering and he said: 'Pledge to me that you will not associate anything with Allah, you will not steal, and you will not have unlawful sexual relations.' He recited the Verse to them (and said) Whoever does any of these things, and Allah conceals him then it is up to Allah, the mighty and Sublime: If He wills, He will punish him, and if He wills, He will forgive him. كُنَّا عِنْدَ النَّبِيِّ ﷺ فِي مَجْلِسٍ فَقَالَ «تُبَايِعُونِي عَلَى أَنْ لَا تُشْرِكُوا بِاللهِ شَيْئًا وَلَا تَسْرِقُوا وَلَا تَزْنُوا قَرَأَ عَلَيْهِمْ الْآيَةَ فَمَنْ وَفَّى مِنْكُمْ فَأَجْرُهُ عَلَى اللهِ وَمَنْ أَصَابَ مِنْ ذَلِكَ شَيْئًا فَسَتَرَهُ اللهُ عَلَيْهِ فَهُوَ إِلَى اللهِ إِنْ شَاءَ عَذَّبَهُ وَإِنْ شَاءَ غَفَرَ لَهُ»
41.37 [Machine] Exceeding the Slip of the Appearance
٤١۔٣٧ التَّجَاوُزُ عَنْ زَلَّةِ ذِي الْهَيْئَةِ
[Machine] The Messenger ﷺ said, "Take care of those with disabilities."
قَالَ رَسُولُ ﷺ «أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَاتِهِمْ»
The Messenger of Allah ﷺ Said: Forgive the people of good qualities their slips, but not faults to which prescribed penalties apply. (Using translation from Abū Dāʾūd 4375)
أَنَّ النَّبِيَّ ﷺ قَالَ «أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَتَهُمْ إِلَّا الْحُدُودَ»
[Machine] The Messenger of Allah ﷺ said, "Overlook the mistakes of the one who has a good character."
عَنْ رَسُولِ اللهِ ﷺ قَالَ «تَجَاوَزُوا عَنْ زَلَّةِ ذِي الْهَيْئَةِ»
The Messenger of Allah ﷺ Said: Forgive the people of good qualities their slips, but not faults to which prescribed penalties apply. (Using translation from Abū Dāʾūd 4375)
قَالَ رَسُولُ اللهِ ﷺ «أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَاتِهِمْ»
[Machine] Aisha, the Prophet ﷺ said, "Be gentle with those who have physical disabilities." He then left and did not punish him.
عَائِشَةُ إِنَّ النَّبِيَّ ﷺ قَالَ «أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثْرَتَهُمْ» قَالَ فَخَلَّى سَبِيلَهُ وَلَمْ يُعَاقِبْهُ

أَنَّ النَّبِيَّ ﷺ قَالَ «أَقِيلُوا ذَوِي الْهَيْئَاتِ عَثَرَاتِهِمْ»
41.38 [Machine] The Deafness in its Creation Affects the Limit, and Mentioning the Differences of the Transmitters of the News of Abu Umamah ibn Sahl in It.
٤١۔٣٨ الضَّرِيرُ فِي خِلْقَتِهِ يُصِيبُ الْحَدَّ، وَذِكْرُ اخْتِلَافِ النَّاقِلِينَ لِخَبَرِ أَبِي أُمَامَةَ بْنِ سَهْلٍ فِيهِ
[Machine] The Messenger of Allah ﷺ was presented with a man who had committed adultery, so he ordered for him to be stripped. Then, a man who had a limp in his legs was brought forward. The Messenger of Allah ﷺ said, "What good will the punishment do to him? Bring me a bundle of twigs." He then struck him with it once." [The words are from Muhammad]
أَنَّ رَسُولَ اللهِ ﷺ أُتِيَ بِرَجُلٍ قَدْ زَنَا فَأَمَرَ بِهِ فَجُرِّدَ فَإِذَا رَجُلٌ مُقْعَدٌ حَمِشُ السَّاقَيْنِ فَقَالَ رَسُولُ اللهِ ﷺ «مَا يُبْقِي الضَّرْبُ مِنْ هَذَا شَيْئًا فَدَعَا بَأَثَاكِيلَ فِيهَا مِائَةُ شَمْرُوخٍ فَضَرَبَهُ بِهَا ضَرْبَةً وَاحِدَةً» اللَّفْظُ لِمُحَمَّدٍ
[Machine] The messenger of Allah ﷺ came with a slave girl who was pregnant, and it was said to her, "Who impregnated you?" She said, "So and so, the muka'ad (paralyzed) man." So, he brought that man, and it turned out to be a man with a body without arms. The Prophet ﷺ said: "By Allah, he is not capable of causing any harm with this." Then, he commanded to bring a bunch of dates from the dates tree that had upright branches, and they were gathered. He struck him with it with one strike. And that was the branch of the palm tree in which the dates reach maturity.
جِيءَ رَسُولُ اللهِ ﷺ بِجَارِيَةٍ وَهِيَ حُبْلَى فَقِيلَ لَهَا مَنْ أَحْبَلَكِ؟ فَقَالَتْ فُلَانٌ الْمُقْعَدُ فَجِيءَ بِفُلَانٍ فَإِذَا رَجُلٍ حَمِشِ الْجَسَدِ ضَرِيرٍ فَقَالَ «وَاللهِ مَا يُبْقِي الضَّرْبُ مِنْ هَذَا شَيْئًا فَأَمَرَ بِأَثَاكِيلَ مِائَةٍ فَجُمِعَتْ فَضَرَبَ بِهَا ضَرْبَةً وَاحِدَةً» وَهِيَ شَمَارِيخُ النَّخْلِ الَّتِي تَكُونُ فِيهَا الْعُذُوقُ
[Machine] The Prophet Muhammad ﷺ was brought a stool that used to be by the wall of Saad. He admitted, saying, "Whip him with the branches of the palm tree," meaning the date palm stalks.
أَنَّ النَّبِيَّ ﷺ أُتِيَ بِمُقْعَدٍ كَانَ يَكُونُ عِنْدَ جِدَارِ سَعْدٍ فَاعْتَرَفَ قَالَ «اجْلِدُوهُ بِأَثْكَالِ النَّخْلِ» يَعْنِي عُذُوقَ النَّخْلِ
[Machine] He heard Abu Umamah say, "There was a man sitting near the wall of Sa'd for a while, and then a pregnant woman appeared. She said, 'He is the one.' So he was asked, and he admitted it. The Prophet ﷺ ordered him to be lashed with palm branches."
أَنَّهُ سَمِعَ أَبَا أُمَامَةَ يَقُولُ كَانَ رَجُلٌ عِنْدَ جِدَارِ سَعْدٍ مَقْعَدٌ زَمَنٌ فَظَهَرَ بِامْرَأَةٍ حَمْلٌ فَقَالَتْ «هُوَ مِنْهُ فَسُئِلَ فَاعْتَرَفَ فَأَمَرَ بِهِ النَّبِيُّ ﷺ أَنْ يُجْلَدَ بِأَثْكَالِ النَّخْلِ»
[Machine] "That 'Ubayribah Uzaymin was with the wall of Sa'd committing adultery with a woman, so the Prophet ﷺ ordered that he be flogged. One of them said with the branch of the palm tree, and the other said with the strap of the palm tree. 7264 Ya'qub ibn Mahan al-Baghdadi informed us on the authority of Hushaym, on the authority of Yahya ibn Sa'id, on the authority of Abu Umamah ibn Sahl, that the Prophet ﷺ was brought a man who was insane or disabled and had committed an obscene act. So he ordered that he be struck with bundles of palm leaves, about 100 or something similar."
أَنَّ أُجَيْرِبَ أُزَيْمِنَ كَانَ عِنْدَ جِدَارِ سَعْدٍ زَنَا بِامْرَأَةٍ فَأَمَرَ النَّبِيُّ ﷺ أَنْ يُجْلَدَ قَالَ أَحَدُهُمَا بِأُكْثُولِ النَّخْلِ وَقَالَ الْآخَرُ بِأُثْكُولِ النَّخْلِ 7264 أَخْبَرَنَا يَعْقُوبُ بْنُ مَاهَانَ الْبَغْدَادِيُّ عَنْ هُشَيْمٍ عَنْ يَحْيَى بْنِ سَعِيدٍ عَنْ أَبِي أُمَامَةَ بْنِ سَهْلٍ أَنَّ النَّبِيَّ ﷺ أُتِيَ بِرَجُلٍ مُخَبَّلٍ أَوْ مُقْعَدٍ قَدْ فَجَرَ فَأَمَرَ بِهِ فَضُرِبَ بِأَثْكَالٍ فِيهِ مِائَةُ شِمْرَاخٍ أَوْ نَحْوُ ذَلِكَ
[Machine] He informed him that a man who was at the time of the Messenger of Allah ﷺ was married, but he committed adultery. So he was brought to the Prophet ﷺ , and it was said to him, "O Messenger of Allah, if you flog him, you will kill him." So the Messenger of Allah ﷺ said, "Strike him with the branches of the palm tree." So he was struck with them.
أَخْبَرَهُ أَنَّ رَجُلًا كَانَ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ نِضْوًا فَزَنَى فَأُتِيَ بِهِ النَّبِيُّ ﷺ فَقِيلَ لَهُ يَا رَسُولَ اللهِ إِنْ جَلَدْتَهُ قَتَلْتَهُ فَقَالَ رَسُولُ اللهِ ﷺ «اضْرِبُوهُ بِأَثْكَالٍ مِنَ النَّخْلِ» فَضُرِبَ بِهَا
[Machine] A man became ill until his skin adhered to his bones, then a slave girl who used to serve him entered upon him and he fell upon her, so he felt guilty and his chest became constricted due to his sin. He said to a group of people who were advising him, "Ask the Messenger of Allah ﷺ about me, for I have committed a forbidden act with a woman. Let him establish the punishment on me and purify me." So they mentioned that to the Messenger of Allah ﷺ , then they said, "If it is carried out on you, your bones will be crushed and if you are hit, you will die." He said, "Take one hundred palm branches and hit me with them one strike."
مَرِضَ رَجُلٌ حَتَّى عَادَ جِلْدًا عَلَى عَظْمٍ فَدَخَلَتْ عَلَيْهِ جَارِيَةٌ تَعُودُهُ فَوَقَعَ عَلَيْهَا فَضَاقَ صَدْرًا بِخَطِيئَتِهِ فَقَالَ لِقَوْمٍ يَعُودُونَهُ سَلُوا لِي رَسُولَ اللهِ ﷺ فَإِنِّي قَدْ وَقَعْتُ عَلَى امْرَأَةٍ حَرَامًا فَلْيُقِمْ عَلَيَّ الْحَدَّ وَلْيُطَهِّرْنِي فَذَكَرُوا ذَلِكَ لِرَسُولِ اللهِ ﷺ ثُمَّ قَالُوا لَوْ حُمِلَ إِلَيْكَ لَتَفَسَّخَتْ عِظَامُهُ وَلَوْ ضُرِبَ لَمَاتَ قَالَ «خُذُوا مِائَةَ شَمْرُوخٍ فَاضْرِبُوهُ بِهِ ضَرْبَةً وَاحِدَةً»
[Machine] A man fell ill until his skin adhered to his bones. Then a slave girl who used to serve him came to him and he tried to force himself upon her, so she complained about this to the people who used to serve her and said: "Ask the Messenger of Allah ﷺ to come and purify me and carry out the prescribed punishment for me." So they mentioned that to the Messenger of Allah ﷺ . Then a hundred stinging lashes were carried out upon him and he died. He said: "Take a hundred palm branches and strike him with a single strike."
مَرِضَ رَجُلٌ حَتَّى عَادَ جِلْدًا عَلَى عَظْمٍ فَدَخَلَتْ عَلَيْهِ جَارِيَةٌ تَعُودُهُ فَوَقَعَ عَلَيْهَا فَضَاقَ صَدْرًا بِخَطِيئَتِهِ فَقَالَ لِقَوْمٍ يَعُودُونَهُ سَلُوا لِي رَسُولَ اللهِ ﷺ فَإِنِّي قَدْ وَقَعْتُ عَلَى امْرَأَةٍ حَرَامًا فَلْيُقِمْ عَلَيَّ الْحَدَّ وَلْيُطَهِّرْنِي فَذَكَرُوا ذَلِكَ لِرَسُولِ اللهِ ﷺ ثُمَّ قَالُوا لَوْ حُمِلَ إِلَيْكَ لَتَفَسَّخَتْ عِظَامُهُ وَلَوْ ضُرِبَ مِائَةً لَمَاتَ قَالَ «خُذُوا مِائَةَ شَمْرُوخٍ فَاضْرِبُوهُ ضَرْبَةً وَاحِدَةً»
41.39 [Machine] The mention of differences regarding Ya'qub ibn Abdullah ibn Al-Ashajj in it.
٤١۔٣٩ ذِكْرُ الِاخْتِلَافِ عَلَى يَعْقُوبَ بْنِ عَبْدِ اللهِ بْنِ الْأَشَجِّ فِيهِ
[Machine] There was a man among us who was physically blind, and he didn't cause any harm to the people of the house except for a maid from the housemaids. He had a relationship with her. Saad raised the matter to the Messenger of Allah ﷺ , and the Messenger of Allah ﷺ said, "Give him his full punishment." They said, "O Messenger of Allah! If we were to strike him, we would kill him, as he is weaker than that." He said, "Then take a bundle of reeds and strike him once with it." So they did as advised.
كَانَ بَيْنَ أَبْيَاتِنَا رَجُلٌ ضَرِيرُ الْجَسَدِ فَلَمْ يَرُعْ أَهْلُ الدَّارِ إِلَّا وَهُوَ عَلَى يَعْنِي جَارِيَةً مِنْ جَوَارِي الدَّارِ يَفْجُرُ بِهَا فَرَفَعَ سَعْدٌ شَأْنَهُ إِلَى رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ «اضْرِبُوهُ حَدَّهُ» قَالُوا يَا رَسُولَ اللهِ إِنْ ضَرَبْنَاهُ قَتَلْنَاهُ هُوَ أَضْعَفُ مِنْ ذَلِكَ قَالَ «فَخُذُوا عِثْكَالًا فِيهِ مِائَةُ شِمْرَاخٍ فَاضْرِبُوهُ بِهَا ضَرْبَةً وَاحِدَةً» فَفَعَلُوا
[Machine] From Fulan, a weak person, the Prophet ﷺ was brought to him and he was questioned, and he admitted. The Prophet ﷺ said, "Strike him." They said, "We fear that he may die." The Prophet ﷺ said, "Strike him with a soft cushion."
مِنْ فُلَانٍ مُقْعَدٍ ضَعِيفٍ فَأُتِيَ بِهِ النَّبِيُّ ﷺ فَسُئِلَ فَاعْتَرَفَ فَقَالَ «اضْرِبُوهُ» فَقَالُوا نَخْشَى أَنْ يَمُوتَ فَقَالَ النَّبِيُّ ﷺ «اضْرِبُوهُ بِأُثْكُولٍ»
[Machine] A woman encountered a man in the darkness of the morning while she was going to the mosque, wrapped in a garment over herself. She called out for help to a passing man, so he ran away with his companion. Then, others passed by her, so she called out for help to them and they caught the man she had called out for. They reached him before the others did, and they brought him to her. She said to him, "I am the one who called out for help from you, but the other man is already gone." So they brought him to the Prophet ﷺ, and she informed him that he had encountered her. The people also informed the Prophet that they had caught him after he had made a strong escape. The Prophet said, "I had only come to the aid of her companion, so how were they able to catch me?" She said, "He is the one who encountered me." The Messenger of Allah ﷺ said, "Take him away and stone him." Then, a man from the people stood up and said, "Don't stone him, but stone me. I am the one who committed this act." So, he confessed, and three individuals gathered before the Messenger of Allah ﷺ - the one who had encountered her, the one who had come to her aid, and the woman. The Prophet said to the woman, "As for you, forgiveness has been granted to you." He said to the one who had come to her aid, "Well-spoken." Then, Umar asked, "Shouldn't we stone the one who confessed to adultery?" The Messenger of Allah ﷺ refused, saying, "No, for he has repented to Allah." Abu Abdur Rahman said, "The most generous of them in narration is the hadith of Abu Umamah, which is marfu."
أَنَّ امْرَأَةً وَقَعَ عَلَيْهَا رَجُلٌ فِي سَوَادِ الصُّبْحِ وَهِيَ تَعْمِدُ إِلَى الْمَسْجِدِ عَكُورَةً عَلَى نَفْسِهَا فَاسْتَغَاثَتْ بِرَجُلٍ مَرَّ عَلَيْهَا وَفَرَّ صَاحِبُهَا ثُمَّ مَرَّ عَلَيْهَا ذَوُو عَدَدٍ فَاسْتَغَاثَتْ بِهِمْ فَأَدْرَكُوا الرَّجُلَ الَّذِي كَانَتِ اسْتَغَاثَتْ بِهِ فَأَخَذُوهُ وَسَبَقَهُمُ الْآخَرُ فَجَاءُوا بِهِ يَقُودُونَهُ إِلَيْهَا فَقَالَ لَهَا أَنَا الَّذِي أَغَثْتُكِ وَقَدْ ذَهَبَ الْآخَرُ قَالَ فَأَتَوْا بِهِ النَّبِيَّ ﷺ فَأَخْبَرَتْهُ أَنَّهُ وَقَعَ عَلَيْهَا وَأَخْبَرَ الْقَوْمُ أَنَّهُمْ أَدْرَكُوهُ يَشْتَدُّ فَقَالَ إِنَّمَا كُنْتُ أُغِيثُهَا عَلَى صَاحِبِهَا فَأَدْرَكُونِي هَؤُلَاءِ فَأَخَذُونِي قَالَتْ كَذَبَ هُوَ الَّذِي وَقَعَ عَلَيَّ فَقَالَ رَسُولُ اللهِ ﷺ «انْطَلِقُوا بِهِ فَارْجُمُوهُ» فَقَامَ الرَّجُلُ مِنَ النَّاسِ فَقَالَ لَا تَرْجُمُوهُ وَارْجُمُونِي فَأَنَا الَّذِيُ فَعَلْتُ بِهَا الْفِعْلَ فَاعْتَرَفَ فَاجْتَمَعَ ثَلَاثَةٌ عِنْدَ رَسُولِ اللهِ ﷺ الَّذِي وَقَعَ عَلَيْهَا وَالَّذِي أَغَاثَهَا وَالْمَرْأَةُ فَقَالَ أَمَّا أَنْتِ فَقَدْ غُفِرَ لَكِ وَقَالَ لِلَّذِي أَغَاثَهَا قَوْلًا حَسَنًا فَقَالَ عُمَرُ أَرْجُمُ الَّذِي اعْتَرَفَ بِالزِّنَى؟ فَأَبَى رَسُولَ اللهِ ﷺ قَالَ «لَا إِنَّهُ قَدْ تَابَ إِلَى اللهِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ أَجْوَدُهَا حَدِيثُ أَبِي أُمَامَةَ مُرْسَلٌ

٤١۔٤٠ ذِكْرُ مَنِ اعْتَرَفَ بِحَدٍّ وَلَمْ يُسَمِّهِ
[Machine] The Messenger of Allah ﷺ said, "A man came to me and said, 'O Messenger of Allah, I have committed a sin and I want you to establish the punishment on me.' The Messenger of Allah ﷺ turned away from him. The prayer was then established. After finishing the prayer, the man said, 'O Messenger of Allah, I have committed a sin and I want you to establish the punishment on me.' The Messenger of Allah ﷺ asked him, 'Did you perform ablution when you came?' The man replied, 'Yes.' The Messenger of Allah ﷺ asked him, 'Did you pray with us?' The man replied, 'Yes.' The Messenger of Allah ﷺ said, 'Then go, for Allah has forgiven you.' Abu 'Abdullah said, 'We do not know of anyone who followed Al-Walid's narration regarding this incident, except for Wathilah. The correct narration is from Abu 'Amr, from Abu Umamah. And Allah knows best."
قَالَ جَاءَ رَسُولَ اللهِ ﷺ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَأَعْرَضَ عَنْهُ رَسُولُ اللهِ ﷺ فَأُقِيمَتِ الصَّلَاةُ فَلَمَّا سَلَّمَ قَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَقَالَ لَهُ رَسُولُ اللهِ ﷺ «هَلْ تَوَضَّأْتَ حِينَ أَقْبَلْتَ؟» قَالَ نَعَمْ قَالَ «فَصَلَّيْتَ مَعَنَا؟» قَالَ نَعَمْ قَالَ «فَاذْهَبْ فَإِنَّ اللهَ قَدْ عَفَا عَنْكَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ لَا نَعْلَمُ أَنَّ أَحَدًا تَابَعَ الْوَلِيدَ عَلَى قَوْلِهِ عَنْ وَاثِلَةَ وَالصَّوَابُ أَبُو عَمَّارٍ عَنْ أَبِي أُمَامَةَ وَاللهُ أَعْلَمُ
A man came to the prophet ﷺ and said : Messenger of Allah ! I have committed a crime which involves prescribed punishment so inflict it on me . He said : Have you not performed ablution when you came? He said : Yes, He said: Have you not prayed with us when we prayed ? He said : Yes .He then said : Go off, for Allah, the Exalted, forgave you. (Using translation from Abū Dāʾūd 4381)

The man repeated this request two more times, and the Messenger turned away each time. Then, when the prayer was established and the Messenger of Allah ﷺ finished, the man said, "O Messenger of Allah, I have committed a sin, so establish the punishment on me." The Messenger asked him, "Did you perform ablution when you came?" The man replied, "Yes." The Messenger then asked him, "Did you pray with us when we prayed?" The man replied, "Yes." The Messenger then said, "Go, for Allah has forgiven you."
أَنَّ رَجُلًا أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَأَعْرَضَ عَنْهُ ثُمَّ قَالَ إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَأَعْرَضَ عَنْهُ ثُمَّ قَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ حَدًّا فَأَعْرَضَ عَنْهُ وَأُقِيمَتِ الصَّلَاةُ فَلَمَّا سَلَّمَ رَسُولُ اللهِ ﷺ قَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ حَدًّا فَأَقِمْهُ عَلَيَّ فَقَالَ «هَلْ تَوَضَّأْتَ حِينَ أَقْبَلْتَ؟» قَالَ نَعَمْ قَالَ «هَلْ صَلَّيْتَ مَعَنَا حِينَ صَلَّيْنَا؟» قَالَ نَعَمْ قَالَ «اذْهَبْ فَإِنَّ اللهَ قَدْ عَفَا عَنْكَ»
[Machine] A man came to the Prophet ﷺ and said: "Indeed, I have committed a sin from the limits of Allah, so establish the punishment upon me." The Prophet ﷺ remained silent to him. Then he repeated his request, and the Prophet ﷺ remained silent to him again. Then the prayer was established and he prayed. After that, he left and the man followed him and repeated his request to the Prophet ﷺ. He said, "Did you perform ablution when you left your house and did you do it well, then did you pray with us?" He said, "Yes." He said, "Indeed, Allah has forgiven your sin or your mistake."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنِّي أَصَبْتُ حَدًّا مِنْ حُدُودِ اللهِ فَأَقِمْهُ عَلَيَّ فَسَكَتَ عَنْهُ ثُمَّ أَعَادَ فَسَكَتَ عَنْهُ ثُمَّ أُقِيمَتِ الصَّلَاةُ فَصَلَّى ثُمَّ انْصَرَفَ فَأَتْبَعَهُ الرَّجُلُ فَأَعَادَ عَلَيْهِ فَقَالَ «هَلْ تَوَضَّأْتَ حِينَ خَرَجْتَ مِنْ بَيْتِكَ فَأَحْسَنْتَ الْوُضُوءَ ثُمَّ صَلَّيْتَ مَعَنَا؟» قَالَ نَعَمْ قَالَ «فَإِنَّ اللهَ قَدْ غَفَرَ لَكَ ذَنْبَكَ أَوْ حَدَّكَ»
41.41 [Machine] Who has confessed to what is not obligatory in the boundaries, and discussing the difference regarding Samaak bin Harb in the incident of Abdullah bin Mas'ood, in that.
٤١۔٤١ مَنِ اعْتَرَفَ بِمَا لَا تَجِبُ فِيهِ الْحُدُودُ، وَذِكْرُ الِاخْتِلَافِ عَلَى سِمَاكِ بْنِ حَرْبٍ فِي خَبَرِ عَبْدِ اللهِ بْنِ مَسْعُودٍ، فِي ذَلِكَ
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, I have mastered everything except for sexual intercourse." So Allah revealed, "And establish prayer at the two ends of the day." [Hud 114]
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي أَصَبْتُ مِنْهَا كُلَّ شَيْءٍ غَيْرَ الْجِمَاعِ فَأَنْزَلَ اللهُ ﷻ {وَأَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ} [هود 114]
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, I have been afflicted by a woman, but I have not given her anything." So Allah the Almighty revealed, "And establish prayer at the two ends of the day" [Hud 114].
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي قَدْ أَصَبْتُ مِنَ امْرَأَةٍ غَيْرَ أَنِّي لَمْ آتِهَا فَأَنْزَلَ اللهُ تَعَالَى {وَأَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ} [هود 114]
[Machine] A man came to the Messenger of Allah ﷺ and said, "Indeed, I have touched a woman in the farthest part of the city, and I have touched her without engaging in sexual intercourse." So this verse was revealed, "Establish prayer at the two ends of the day" [Hud: 114]. 7279 - Muhammad ibn Bashshar informed us, he said: 'Amr ibn al-Haytham Abu Qatan narrated to us, he said: Shu'bah narrated from Simak ibn Harb, from Ibrahim, from my maternal uncle, from 'Abdullah, from the Prophet ﷺ .

٤١۔٤٢ ذِكْرُ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِهَذَا الْخَبَرِ
[Machine] A man met a woman in some of the streets of the city, and he had sexual intercourse with her. So he came to the Prophet ﷺ and told him about it. Then Allah revealed in that regard: "And establish prayer at the two ends of the day and at the approach of the night. Indeed, good deeds do away with misdeeds." (Surah Hud, 11:114) until "for those who remember Allah" (Surah Hud, 11:114). Mu'adh said, "O Messenger of Allah, was this revelation specifically for him or for all people in general?" He said, "No, it was for all people in general."
أَنَّ رَجُلًا لَقِيَ امْرَأَةً فِي بَعْضِ طُرُقِ الْمَدِينَةِ فَأَصَابَ مِنْهَا مَا دُونَ الْجِمَاعِ فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَأَنْزَلَ اللهُ تَعَالَى فِي ذَلِكَ {وَأَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ} [هود 114] إِلَى {لِلذَّاكِرِينَ} [هود 114] قَالَ مُعَاذٌ يَا رَسُولَ اللهِ نَزَلَتْ لِهَذَا خَاصَّةً أَوْ لِلنَّاسِ عَامَّةً قَالَ «بَلْ لَكُمْ عَامَّةً»
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, I married a woman in the gardens and I did everything except that I did not see anything forbidden from her. I kissed her, embraced her, and did nothing else. So do to me what you wish." The Messenger of Allah ﷺ did not say anything to him. The man left, and Umar said, "Allah has concealed this for him. If he had concealed it himself, the Messenger of Allah ﷺ would have followed him." Umar then sent someone to bring the man back and he recited to him the verse, "And establish prayer at the two ends of the day and at the approach of the night..." [Hud: 114]. Mu'adh said, "Is this verse specific for him or for the people in general, O Prophet of Allah?" He ﷺ said, "It is for the people in general."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي أَخَذْتُ امْرَأَةً فِي الْبَسَاتِينِ فَفَعَلْتُ بِهَا كُلَّ شَيْءٍ غَيْرَ أَنِّي لَمْ أَرَ مِنْهَا مُحَرَّمًا فَقَبَّلْتُهَا وَالْتَزَمْتُهَا وَلَمْ أَفْعَلْ غَيْرَ ذَلِكَ فَافْعَلْ بِي مَا شِئْتَ فَلَمْ يَقُلْ لَهُ رَسُولُ اللهِ ﷺ شَيْئًا فَذَهَبَ الرَّجُلُ فَقَالَ عُمَرُ لَقَدْ سَتَرَ اللهُ عَلَى هَذَا لَوْ سَتَرَ عَلَى نَفْسِهِ فَأَتْبَعَهُ رَسُولُ اللهِ ﷺ رَجُلًا وَقَالَ رُدَّهُ عَلَيَّ فَجَاءَهُ فَقَرَأَ عَلَيْهِ {وَأَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ} [هود 114] الْآيَةَ قَالَ مُعَاذٌ أَلَهُ خَاصَّةً أَمْ لِلنَّاسِ عَامَّةً يَا نَبِيَّ اللهِ؟ قَالَ «لِلنَّاسِ عَامَّةً»
[Machine] A man came to the Prophet ﷺ and said, "I have taken a woman in the garden and I have done everything with her except marry her. Do to me whatever you want." The Messenger of Allah ﷺ did not say anything to him, and he left. Then he recited this verse to him: "Establish prayer at the two ends of the day and at the approach of the night. Indeed, good deeds do away with misdeeds." [Hud 114]
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ إِنِّي أَخَذْتُ امْرَأَةً فِي الْبُسْتَانِ فَأَصَبْتُ كُلَّ شَيْءٍ غَيْرَ أَنْ لَمْ أَنْكِحْهَا فَافْعَلْ بِي مَا شِئْتَ فَلَمْ يَقُلْ لَهُ رَسُولُ اللهِ ﷺ شَيْئًا يُذْكَرُ وَطَلَعَ فَقَرَأَ عَلَيْهِ هَذِهِ الْآيَةَ {أَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ إِنَّ الْحَسَنَاتِ يُذْهِبْنَ السَّيِّئَاتِ} [هود 114]
A man came to the Prophet ﷺ and said: I contacted directly a women at the furthest part of the city (i.e., Medina), and I did with her everything except sexual intercourse. So here I am; inflict any punishment you wish. Thereupon ‘Umar said: Allah has concealed your fault; it would have been better if you also had concealed it yourself. The Prophet ﷺ sent a men after him. (When he came) he recited the verse: “And establish regular prayers at the two ends of the day and at the approaches of the night. . .” up to the end of the verse. A man from the people got up and asked: Is it particular to him, Messenger of Allah, or for the people in general? He replied: It is all the people. (Using translation from Abū Dāʾūd 4468)

[Machine] A man named Fulan bin Muattib came to the Prophet ﷺ and said, "O Messenger of Allah, I entered upon a woman and obtained from her what a man obtains from his wife, except that I did not have sexual intercourse with her." The Messenger of Allah ﷺ did not respond or answer him until this verse was revealed to him, "Establish prayer at the two ends of the day and at the approach of the night." [Hud 114] The Prophet ﷺ then summoned him and recited this verse to him.
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ يُقَالُ لَهُ فُلَانُ بْنُ مُعَتِّبٍ فَقَالَ يَا رَسُولَ اللهِ دَخَلْتُ عَلَى امْرَأَةٍ فَنِلْتُ مِنْهَا مَا يَنَالُ الرَّجُلُ مِنْ أَهْلِهِ إِلَّا أَنِّي لَمْ أُواقعها فَلَمْ يَرُدَّ رَسُولُ اللهِ ﷺ وَلَمْ يُجِبْ حَتَّى أُنْزِلَ عَلَيْهِ هَذِهِ الْآيَةُ {أَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ} [هود 114] الْآيَةَ فَدَعَاهُ رَسُولُ اللهِ ﷺ فَقَرَأَهَا عَلَيْهِ
[Machine] A man had an encounter with a woman and he went to the Prophet ﷺ and told him about it. Then Allah revealed the verse: "And establish prayer at the two ends of the day and at the approach of the night." The man asked the Prophet, "Is this verse for me, O Messenger of Allah?" The Prophet replied, "No, it is for those who adhere to it from my ummah (nation)." Abu Abdullah Al-Rahman said, "This is the correct (narration)."
أَنَّ رَجُلًا أَصَابَ مِنَ امْرَأَةٍ قُبْلَةً فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَأَنْزَلَ اللهُ {وَأَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ} [هود 114] فَقَالَ الرَّجُلُ أَلِي هَذِهِ يَا رَسُولَ اللهِ؟ فَقَالَ «بَلْ هِيَ لِمَنْ عَمِلَ بِهَا مِنْ أُمَّتِي» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا هُوَ الصَّحِيحُ
[Machine] A woman came to him accompanied by her husband who had been sent by the Prophet of Allah ﷺ on a mission. She said to him, "Sell me some dates for a dirham." I told her, "I am amazed that there are dates in the house that are better than these." He took them with him, winked at her, and kissed her. Then he left and met Abu Bakr who asked him, "Have I been destroyed?" He replied, "What is your concern?" He told him the story, and asked him, "Can I repent?" He said, "Yes, repent and do not repeat it, and do not tell anyone." Then he went until he met the Prophet ﷺ and narrated the incident to him. The Prophet said, "You have left behind a man from the Muslims who is fighting for the sake of Allah with this, and I thought that I am one of the people of Hell and that Allah will never forgive me. But the Prophet ﷺ interceded for me until Allah revealed to him, 'And establish prayer at the two ends of the day and at the approach of the night. Indeed, good deeds do away with misdeeds. That is a reminder for those who remember.' He sent the verse to me and recited it to me."
أَتَتْهُ امْرَأَةً وَزَوْجُهَا قَدْ بَعَثَهُ نَبِيُّ اللهِ ﷺ فِي بَعْثٍ فَقَالَتْ لَهُ بِعْنِي بِدِرْهَمٍ تَمْرًا فَقُلْتُ لَهَا وَأَعْجَبَتْنِي إِنَّ فِي الْبَيْتِ تَمْرًا أَطْيَبُ مِنْ هَذَا فَانْطَلَقَ بِهَا فَغَمَزَهَا وَقَبَّلَهَا فَفَرَغَ ثُمَّ خَرَجَ فَلَقِيَ أَبَا بَكْرٍ فَقَالَ لَهُ هَلَكْتُ فَقَالَ لَهُ مَا شَأْنُكَ فَقَصَّ عَلَيْهِ أَمْرَهُ وَقَالَ لَهُ هَلْ لِي مِنْ تَوْبَةٍ؟ قَالَ نَعَمْ فَتُبْ وَلَا تَعُدْ وَلَا تُخْبِرَنَّ أَحَدًا ثُمَّ انْطَلَقَ حَتَّى أَتَى النَّبِيَّ ﷺ فَقَصَّ عَلَيْهِ أَمْرَهُ فَقَالَ خَلَفْتَ رَجُلًا مِنَ الْمُسْلِمِينَ غَازِيًا فِي سَبِيلِ اللهِ بِهَذَا فَظَنَنْتُ أَنِّي مِنْ أَهْلِ النَّارِ وَأَنَّ اللهَ لَا يَغْفِرُ لِي أَبَدًا وَأَطْرَقَ عَنِّي نَبِيُّ اللهِ ﷺ حَتَّى نَزَلَتْ عَلَيْهِ {وَأَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ} [هود 114] إِلَى {ذِكْرَى لِلذَّاكِرِينَ} [هود 114] فَأَرْسَلُ إِلَيَّ نَبِيُّ اللهِ ﷺ فَقَرَأَهُنَّ عَلَيَّ
[Machine] A man came to the Prophet ﷺ and said, "I have experienced something with a woman less than the act of sexual intercourse, so Allah revealed this verse: 'And establish prayer at the two ends of the day and at the approach of the night.' [Hud: 114] until 'a reminder for those who remember.' [Hud: 114]" Muadh said, "O Messenger of Allah, is it specific to me?" He said, "No, it is for all people."
إِنَّ رَجُلًا أَتَى النَّبِيَّ ﷺ فَقَالَ إِنِّي أَصَبْتُ مِنَ امْرَأَةٍ مَا دُونَ الْجِمَاعِ فَأَنْزَلَ اللهُ هَذِهِ الْآيَةَ {وَأَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ} [هود 114] إِلَى {ذِكْرَى لِلذَّاكِرِينَ} [هود 114] فَقَالَ معاذ يَا رَسُولَ اللهِ أَلَهُ خَاصَّةً؟ فَقَالَ «بَلِ لِلنَّاسِ كَافَّةً»
[Machine] I was in the city, and a girl passed by me. I grabbed her shawl and went to the Prophet ﷺ while he was conducting transactions with people. He said, "Are you not the one who stole the shawl?" I said, "O Messenger of Allah, I will not repeat it. Please sell it to me."
كُنْتُ بِالْمَدِينَةِ فَمَرَّتْ بِي جَارِيَةٌ فَأَخَذْتُ بِكَشْحِهَا فَأَتَيْتُ النَّبِيَّ ﷺ وَهُوَ يُبَايِعُ النَّاسَ فَقَالَ أَلَسْتَ صَاحِبَ الْجَبِيذَةَ فَقُلْتُ يَا رَسُولَ اللهِ لَا أَعُودُ فَبَايِعْنِي
41.43 [Machine] How much is the punishment? And mention the difference of the narrators of the news in that.
٤١۔٤٣ كَمِ التَّعْزِيرُ؟ وَذِكْرُ اخْتِلَافِ النَّاقِلِينَ لِلْخَبَرِ فِي ذَلِكَ
I heard the Prophet ﷺ saying, "Do not flog anyone more than ten stripes except if he is involved in a crime necessitating Allah's legal Punishment." (Using translation from Bukhārī 6850)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ «لَا يُجْلَدُ فَوْقَ عَشَرَةِ أَسْوَاطٍ فِي غَيْرِ حَدٍّ مِنْ حُدُودِ اللهِ»

[Machine] The Prophet ﷺ heard and said, "One should not be lashed more than ten times except in a punishment that is within the bounds of Allah." Abu Abdur-Rahman Abdullah bin Jabir said, "There is no problem with that."
سَمِعَ النَّبِيَّ ﷺ قَالَ «لَا يُجْلَدُ فَوْقَ عَشْرِ جَلْدَاتٍ إِلَّا فِي حَدٍّ مِنْ حُدُودِ اللهِ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ عَبْدُ الرَّحْمَنِ بْنُ جَابِرٍ لَا بَأْسَ بِهِ
41.44 [Machine] The number of witnesses to adultery
٤١۔٤٤ عَدَدُ الشُّهُودِ عَلَى الزِّنَا
That Sa'd b. 'Ubadah said to the Messenger of Allah ﷺ : What do you think if I find with my wife a man ; should I give him some time until I bring four witnesses ?" He said: "Yes". (Using translation from Abū Dāʾūd 4533)
يَا رَسُولَ اللهِ أَرَأَيْتَ إِنْ وَجَدْتُ مَعَ امْرَأَتِي رَجُلًا أُمْهِلُهُ حَتَّى آتِيَ بِأَرْبَعَةِ شُهَدَاءَ؟ قَالَ «نَعَمْ»
41.45 [Machine] The testimony of the People of the Book on each other regarding boundaries.
٤١۔٤٥ شَهَادَةُ أَهْلِ الْكِتَابِ بَعْضُهُمْ عَلَى بَعْضٍ فِي الْحُدُودِ
some jews came to the Messenger of Allah ﷺ and mentioned to him that a man and a women of their number had committed fornication. The Messenger of Allah ﷺ asked them: What do you find in the Torah about stoning? They replied: We disgrace them and they should be flogged. ‘Abd Allah b. Salam said: You lie; it contains (instruction for) stoning. So they brought the Torah and spread it out, and one of them put his hand over the verse of stoning and read what preceded it and what followed it. ‘Abd Allah b. Salam said to him: Lift your hand. When he did so, the verse of stoning was seen to be in it. They then said: He has spoken the truth, Muhammad, the verse of stoning is in it. The Messenger of Allah ﷺ then gave command regarding them, and they were stoned to death. ‘Abd Allah b. ‘Umar said: I saw the man leaning on the woman protecting her from the stones. أَنَّ الْيَهُودَ جَاءُوا إِلَى رَسُولِ اللهِ ﷺ فَذَكَرُوا لَهُ أَنَّ رَجُلًا مِنْهُمْ وَامْرَأَةً زَنَيَا فَقَالَ لَهُمْ «مَا تَجِدُونَ فِي التَّوْرَاةِ فِي شَأْنِ الرَّجْمِ؟» فَقَالُوا نَفْضَحُهُمْ وَيُجْلَدُونَ قَالَ عَبْدُ اللهِ بْنُ سَلَامٍ إِنَّ فِيهَا الرَّجْمَ فَأَتَوْا بِالتَّوْرَاةِ فَنَظَرُوهَا فَوَضَعَ أَحَدُهُمْ يَدَهُ عَلَى آيَةِ الرَّجْمِ فَقْرَأَ مَا قَبْلَهَا وَمَا بَعْدَهَا فَقَالَ لَهُ عَبْدُ اللهِ بْنُ سَلَامٍ ارْفَعْ يَدَكَ فَرَفَعَ يَدَهُ فَإِذَا فِيهَا آيَةُ الرَّجْمِ قَالُوا صِدْقٌ يَا مُحَمَّدُ فِيهَا آيَةُ الرَّجْمِ فَأَمَرَ بِهِمَا رَسُولُ اللهِ ﷺ فَرُجِمَا قَالَ عَبْدُ اللهِ بْنُ عُمَرَ فَرَأَيْتُ الرَّجُلَ يَحْنِي عَلَى الْمَرْأَةِ يَقِيهَا الْحِجَارَةَ
41.46 [Machine] Can the imam establish the limits with his knowledge?
٤١۔٤٦ هَلْ لِلْإِمَامِ أَنْ يُقِيمَ الْحُدُودَ بِعِلْمِهِ؟
Lian was mentioned in the presence of the Prophet, ʿAsim bin Adi said a statement about it, and when he left, a man from his tribe came to him complaining that he had seen a man with his wife. ʿAsim said, "I have been put to trial only because of my statement." So he took the man to the Prophet ﷺ and the man told him about the incident. The man (husband) was of yellow complexion, thin, and of lank hair, while the man whom he had accused of having been with his wife, was reddish brown with fat thick legs and fat body. The Prophet ﷺ said, "O Allah! Reveal the truth." Later on the lady delivered a child resembling the man whom the husband had accused of having been with her. So the Prophet ﷺ made them take the oath of Lian. A man said to Ibn ʿAbbas in the gathering, "Was that the same lady about whom the Prophet ﷺ said, "If I were to stone any lady (for committing illegal sexual intercourse) to death without witnesses, I would have stoned that lade to death?" Ibn ʿAbbas said, "No, that was another lady who used to behave in such a suspicious way among the Muslims that one might accuse her of committing illegal sexual intercourse." التَّلَاعُنُ عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ عَاصِمُ بْنُ عَدِيٍّ فِي ذَلِكَ قَوْلًا ثُمَّ انْصَرَفَ فَأَتَاهُ رَجُلٌ مِنْ قَوْمِهِ يَشْكُو إِلَيْهِ أَنَّهُ وَجَدَ مَعَ أَهْلِهِ رَجُلًا فَقَالَ عَاصِمٌ مَا ابْتُلِيتُ إِلَّا بِقَوْلِي فَذَهَبَ بِهِ إِلَى رَسُولِ اللهِ ﷺ فَأَخْبَرَهُ بِالَّذِي وَجَدَ عَلَيْهِ امْرَأَتَهُ وَكَانَ ذَلِكَ الرَّجُلُ مُصْفَرًّا قَلِيلَ اللَّحْمِ سَبِطَ الشَّعْرِ وَكَانَ الَّذِي يَدَّعِي عَلَيْهِ أَنَّهُ وَجَدَهُ عِنْدَ أَهْلِهِ خَدْلًا كَثِيرَ اللَّحْمِ فَقَالَ رَسُولُ اللهِ ﷺ «اللهُمَّ بَيِّنْ فَوَضَعَتْ شَبِيهًا بِالرَّجُلِ الَّذِي ذَكَرَ زَوْجُهَا أَنَّهُ وَجَدَهُ عِنْدَهَا فَلَاعَنْ رَسُولُ اللهِ ﷺ» بَيْنَهُمَا فَقَالَ رَجُلٌ لِابْنِ عَبَّاسٍ فِي الْمَجْلِسِ هِيَ الَّتِي قَالَ رَسُولُ اللهِ ﷺ «لَوْ رَجَمْتُ أَحَدًا بِغَيْرِ بَيِّنَةٍ رَجَمْتُ هَذِهِ؟» فَقَالَ ابْنُ عَبَّاسٍ لَا تِلْكَ امْرَأَةٌ كَانَتْ تُظْهِرُ فِي الْإِسْلَامِ الشَّرَّ
