41. Stoning (5/5)
٤١۔ كِتَابُ الرَّجْمِ ص ٥
Ibn ʿAbbas mentioned the couple who had taken the oath of Lian. ʿAbdullah bin Shaddad said (to him), "Was this woman about whom Messenger of Allah ﷺ said, 'If I were ever to stone to death any woman without witnesses. (I would have stoned that woman to death)?' Ibn ʿAbbas replied," No, that lady exposed herself (by her suspicious behavior). (Using translation from Bukhārī 6855)
قَالَ رَسُولُ اللهِ ﷺ «لَوْ كُنْتُ رَاجِمًا مِنْ غَيْرِ بَيِّنَةٍ رَجَمْتُهَا؟» قَالَ لَا تِلْكَ امْرَأَةٌ أَعْلَنَتْ
41.47 [Machine] Who did the deed of the people of Lot
٤١۔٤٧ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ
[Machine] The Messenger of Allah (PBUH) said: "May Allah curse those who commit the acts of the people of Lot. May Allah curse those who commit the acts of the people of Lot. May Allah curse those who commit the acts of the people of Lot."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَعَنَ اللهُ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ لَعَنَ اللهُ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ لَعَنَ اللهُ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ»

41.48 [Machine] Who fell on an animal
٤١۔٤٨ مَنْ وَقَعَ عَلَى بَهِيمَةٍ
[Machine] The Messenger of Allah ﷺ said, "May Allah curse the one who has sexual intercourse with an animal."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَعَنَ اللهُ مَنْ وَقَعَ عَلَى بَهِيمَةٍ»
That the Messenger of Allah ﷺ said: "Whomever you see having relations with an animal then kill him and kill animal." So it was said to Ibn 'Abbas: "What is the case of the animal?" He said: "I did not hear anything from the Messenger of Allah ﷺ about this, but I see that the Messenger of Allah ﷺ disliked eating its meat or using it, due to the fact that such a (heinous) thing has been done with that animal." أَنَّ رَسُولَ اللهِ قَالَ «مَنْ وَجَدْتُمُوهُ وَقَعَ عَلَى بَهِيمَةٍ فَاقْتُلُوهُ وَاقْتُلُوا الْبَهِيمَةَ» فَقِيلَ لِابْنِ عَبَّاسٍ مَا شَأْنُ الْبَهِيمَةِ؟ قَالَ مَا سَمِعْتُ عَنْ رَسُولِ اللهِ ﷺ فِي ذَلِكَ شَيْئًا وَلَكِنْ أَرَى رَسُولَ اللهِ ﷺ كَرِهَ أَنْ يُؤْكَلَ مِنْ لَحْمِهَا أَوْ يُنْتَفَعَ بِهَا وَقَدْ عَمِلَ بِهَا ذَلِكَ الْعَمَلَ
[Machine] "Abu Abdul Rahman, this is unknown and the first one is preserved."
أَبُو عَبْدِ الرَّحْمَنِ هَذَا غَيْرُ مَعْرُوفٍ وَالْأَوَّلُ هُوَ الْمَحْفُوظُ
41.49 [Machine] Exile.
٤١۔٤٩ التَّغْرِيبُ
[Machine] "That the Messenger of Allah ﷺ traveled and migrated, and that Abu Bakr traveled and migrated, and that Umar traveled and migrated."
«أَنَّ رَسُولَ اللهِ ﷺ ضَرَبَ وَغَرَّبَ وَأَنَّ أَبَا بَكْرٍ ضَرَبَ وَغَرَّبَ وَأَنَّ عُمَرَ ضَرَبَ وَغَرَّبَ»
41.50 [Machine] The crazy woman hits the limit.
٤١۔٥٠ الْمَجْنُونَةُ تُصِيبُ الْحَدَّ
Ibn Abbas said: A lunatic woman passed by Ali ibn AbuTalib. He then mentioned the rest of the tradition to the same effect as Uthman mentioned. This version has: Do you not remember that the Messenger of Allah ﷺ has said: There are three whose actions are not recorded: a lunatic whose mind is deranged till he is restored to consciousness, a sleeper till he awakes, and a boy till he reaches puberty? (Using translation from Abū Dāʾūd 4401)
أَنَّ رَسُولَ اللهِ قَالَ «رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ الْمَجْنُونِ الْمَغْلُوبِ عَلَى عَقْلِهِ وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ» قَالَ صَدَقْتَ قَالَ فَخَلَّى عَنْهَا
[Machine] Umar brought a woman who had committed adultery, and with her was her child. Ali passed by and let her go, saying, "This is a trial from the children of so-and-so." Then he said, "By Allah, I knew that the Messenger of Allah ﷺ said, 'The pen has been lifted from three: from the sleeper until he wakes up, from the one who is insane until he comes to his senses, and from the child until he reaches puberty.'"
أُتِيَ عُمَرُ بِامْرَأَةٍ قَدْ زَنَتْ وَمَعَهَا وَلَدُهَا فَمَرَّ عَلِيٌّ فَخَلَّى سَبِيلَهَا وَقَالَ هَذِهِ مُبْتَلَاةُ بَنِي فُلَانٍ ثُمَّ قَالَ وَاللهِ لَقَدْ عَلُمْتُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الْمُبْتَلَى حَتَّى يَعْقِلَ وَعَنِ الصَّغِيرِ حَتَّى يَبْلُغَ يُكْبُرَ»
عَنْ يَحْيَى بْنِ أَيُّوبَ أَيْضًا فَلَيْسَ بِذَاكَ
ʿThe Pen has been lifted from three; from the sleeper until he wakes up, from the crazy - or insane- one until he comes back to his senses, and from the minor until he grows up.” (Using translation from Aḥmad 956)
أَنَّ النَّبِيَّ ﷺ قَالَ رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَالْمَعْتُوهِ أَوْ قَالَ الْمَجْنُونِ حَتَّى يَعْقِلَ وَالصَّغِيرِ حَتَّى يَشُبَّ
[Machine] We have Abu Abdurrahman, none of which is accurate, and the stopped version is more correct.
لَنَا أَبُو عَبْدِ الرَّحْمَنِ مَا فِيهِ شَيْءٌ صَحِيحٌ وَالْمَوْقُوفُ أَصَحُّ هَذَا أَوْلَى بِالصَّوَابِ
41.51 [Machine] In the one who admits that he committed adultery with a specific woman
٤١۔٥١ فِي الَّذِي يَعْتَرِفُ أَنَّهُ زَنَا بِامْرَأَةٍ بِعَيْنِهَا
A man of Bakr ibn Layth came to the Prophet ﷺ and made confession four times that he had committed fornication with a woman, so he had a hundred lashes administered to him. The man had not been married. He then asked him to produce proof against the woman, and she said: I swear by Allah, Messenger of Allah, that he has lied. Then he was given the punishment of eighty lashes of falsehood. (Using translation from Abū Dāʾūd 4467)
أَنَّ رَجُلًا مِنْ بَنِي لَيْثِ بْنِ بَكْرِ أَتَى النَّبِيَّ ﷺ فَأَقَرَّ أَنَّهُ زِنَا بِامْرَأَةٍ أَرْبَعَ مَرَّاتٍ فَجَلَدَهُ مِائَةً وَكَانَ بِكْرًا وَسَأَلَهُ الْبَيِّنَةَ عَلَى الْمَرْأَةِ فَقَالَتِ الْمَرْأَةُ «كَذَبَ وَاللهِ يَا رَسُولَ اللهِ فَجَلَدَهُ جَلْدَ الْفِرْيَةِ ثَمَانِينَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا حَدِيثٌ مُنْكَرٌ
[Machine] Some companions of the Prophet ﷺ whipped a man for calling another a son of the crazy one.
أَنَّ بَعْضَ أَصْحَابِ النَّبِيِّ ﷺ «جَلَدَ رَجُلًا أَنْ دَعَا آخَرَ بِابْنِ الْمَجْنُونِ»
41.52 [Machine] Order to Avoid Hitting the Face
٤١۔٥٢ الْأَمْرُ بِاجْتِنَابِ الْوَجْهِ فِي الضَّرْبِ
The Prophet ﷺ said: When one of you inflicts a beating, he should avoid striking the face. (Using translation from Abū Dāʾūd 4493)
عَنِ النَّبِيِّ ﷺ قَالَ «إِذَا ضَرَبَ أَحَدُكُمْ فَلْيَجْتَنِبِ الْوَجْهَ»
41.53 [Machine] The limit of ejaculation
٤١۔٥٣ حَدُّ الْقَذْفِ
When my vindication came down, the Prophet ﷺ mounted the pulpit and mentioned that, and recited the Qur'an. Then when he came down from the pulpit he ordered regarding the two men and the woman, and they were given the prescribed punishment. (Using translation from Abū Dāʾūd 4474)
«لَمَّا نَزَلَ عُذْرِي قَامَ النَّبِيُّ ﷺ عَلَى الْمِنْبَرِ فَذَكَرَ ذَلِكَ وَتَلَا فَلَمَّا نَزَلَ عَنِ الْمِنْبَرِ أَمْرَ بِالرَّجُلَيْنِ وَالْمَرْأَةِ فَضُرِبُوا حَدَّهُمْ»
41.54 [Machine] The throwing of the Mamluk
٤١۔٥٤ قَذْفُ الْمَمْلُوكِ
"If somebody slanders his slave (by accusing him of committing illegal sexual intercourse) and the slave is innocent from what he says, Allah will impose the punishment upon him on the Day of Resurrection, unless it is as he said about him." (Using translation from Tirmidhī 1947)
أَنَّهُ حَدَّثَهُ قَالَ قَالَ أَبُو الْقَاسِمِ ﷺ نَبِيُّ التَّوْبَةِ «مَنْ قَذَفَ مَمْلُوكَهُ بَرِيئًا مِمَّا قَالَ أَقَامَ عَلَيْهِ الْحَدَّ يَوْمَ الْقِيَامَةِ إِلَّا أَنْ يَكُونَ كَمَا قَالَ» قَالَ أَبُو عَبْدِ الرَّحْمَنِ هَذَا حَدِيثٌ جَيِّدٌ
[Machine] "Whoever mistreats his slave, he will have a punishment on the Day of Judgment from Allah. If He wishes, He will take it from him, and if He wishes, He will forgive him."
«مَنْ قَذَفَ مَمْلُوكَهُ كَانَ لِلَّهِ فِي ظَهْرِهِ حَدٌّ يَوْمَ الْقِيَامَةِ إِنْ شَاءَ أَخَذَهُ وَإِنْ شَاءَ عَفَا عَنْهُ»
