46. Chapter (2/2)
٤٦۔ كِتَابُ اللِّعَانِ ص ٢
[Machine] The Prophet ﷺ cursed them both and she testified four times by Allah that he was among the liars. When it came to the fifth time, she was told to fear Allah, for the punishment of this world is lighter than the punishment of the hereafter, and this is the incident that would warrant punishment for her. She remained silent for a moment, then she said, "By Allah, I will not bring shame upon my people," and she testified during the fifth time that the wrath of Allah be upon her if he was among the truthful. The Messenger of Allah ﷺ then separated them and decided that her child could not be attributed to any father, and she could not be accused of adultery. Whoever accuses her or accuses her child will be subjected to the prescribed punishment. He also decided that she would have no home or provision because they would separate without divorce or her becoming a widow.
النَّبِيَّ ﷺ لَاعَنَ بَيْنَهُمَا وَأَنَّهَا شَهِدَتْ بَعْدَ الْتِعَانِ الزَّوْجِ أَرْبَعَ شَهَادَاتٍ بِاللهِ أَنَّهُ لَمِنَ الْكَاذِبِينَ فَلَمَّا كَانَتِ الْخَامِسَةُ قِيلَ لَهَا اتَّقِي اللهَ فَإِنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الْآخِرَةِ وإِنَّ هَذِهِ الْمُوجِبَةُ الَّتِي تُوجِبُ عَلَيْكِ الْعَذَابَ فَسَكَتَتْ سَاعَةً ثُمَّ قَالَتْ وَاللهِ لَا أَفْضَحُ قَوْمِي فَشَهِدَتْ فِي الْخَامِسَةِ أَنَّ غَضَبَ اللهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ فَفَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَقَضَى أَنْ لَا يُدْعَى وَلَدُهَا لِأَبٍ وَلَا تُرْمَى وَلَا يُرْمَى وَلَدُهَا وَمَنْ رَمَاهَا أَوْ رَمَى وَلَدَهَا فَعَلَيْهِ الْحَدُّ وَقَضَى أَنْ لَا بَيْتَ لَهَا عَلَيْهِ وَلَا قُوتَ مِنْ أَجْلِ أَنَّهُمَا يَتَفَرَّقَانِ مِنْ غَيْرِ طَلَاقٍ وَلَا مُتَوَفَّى عَنْهَا
[Machine] So the year passed and the cursed ones were separated, never to be reunited again.
فَمَضَتِ السُّنَّةُ بَعْدُ فِي الْمُتَلَاعِنَيْنِ يُفَرَّقُ بَيْنَهُمَا ثُمَّ لَا يَجْتَمِعَانِ أَبَدًا
[Machine] So we cursed in the presence of the Messenger of Allah ﷺ, so the Messenger of Allah ﷺ separated between them and said, "They shall never come together."
فَتَلَاعَنَا عِنْدَ رَسُولِ اللهِ ﷺ فَفَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَقَالَ لَا يَجْتَمِعَانِ أَبَدًا
أَنْ لَا يَجْتَمِعَا أَبَدًا
[Machine] "They are separated and will never come together."
يُفَرَّقُ بَيْنَهُمَا وَلَا يَجْتَمِعَانِ أَبَدًا الْحَدُّ
[Machine] If he lies about himself after swearing, he will be struck and the child will be attached to him, and they will never be united. And Allah knows best.
إِذَا أَكْذَبَ نَفْسَهُ بَعْدَ اللِّعَانِ ضُرِبَ وَأُلْزِقَ بِهِ الْوَلَدُ وَلَا يَجْتَمِعَانِ أَبَدًا وَاللهُ أَعْلَمُ
46.13 [Machine] No cursing until a man accuses his wife of adultery directly.
٤٦۔١٣ بَابُ لَا لِعَانَ حَتَّى يَقْذِفَ الرَّجُلُ زَوْجَتَهُ بِالزِّنَا صَرِيحًا
[Machine] A man found his wife with another man, so he killed him. You have killed him, and if he speaks, you will lash him. I will surely mention this to the Messenger of Allah. So he mentioned it to the Messenger of Allah, and Allah revealed the verses of cursing. Then the man came and accused his wife, so the Messenger of Allah issued the curse between them and said, "Perhaps she will bring forth a black, curly-haired child." He said, "So she brought forth a black, curly-haired child."
أَنَّ رَجُلًا وَجَدَ مَعَ امْرَأَتِهِ رَجُلًا فَقَتَلَهُ قَتَلْتُمُوهُ وَإِنْ تَكَلَّمَ جَلَدْتُمُوهُ لَأَذْكُرَنَّ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَذَكَرَهُ لِرَسُولِ اللهِ ﷺ فَأَنْزَلَ اللهُ تَعَالَى آيَاتِ اللِّعَانِ ثُمَّ جَاءَ الرَّجُلُ فَقَذَفَ امْرَأَتَهُ فَلَاعَنَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَقَالَ لَعَلَّهَا أَنْ تَجِيءَ بِهِ أَسْوَدَ جَعْدًا قَالَ فَجَاءَتْ بِهِ أَسْوَدَ جَعْدًا
46.14 [Machine] No curse or limit in exposing
٤٦۔١٤ بَابُ لَا لِعَانَ وَلَا حَدَّ فِي التَّعْرِيضِ
[Machine] That the Messenger of Allah ﷺ was approached by a Bedouin man who said, "O Messenger of Allah, in the narration of Al-Shafi'i, it is mentioned that a man from the desert came to the Prophet ﷺ and said to him, 'Indeed, my wife has given birth to a dark-skinned boy.' The Prophet ﷺ said to him, 'Do you have any camels?' He replied, 'Yes.' The Prophet ﷺ asked, 'What color are they?' He answered, 'Red.'" The Prophet ﷺ then asked, 'Are there any gray ones among them?' He replied, 'Yes.' The Prophet ﷺ asked, 'How do you see that?' He said, 'By a vein that I removed.' So the Prophet ﷺ said, 'Perhaps this vein is the cause.'
أَنَّ رَسُولَ اللهِ ﷺ جَاءَهُ رَجُلٌ أَعْرَابِيٌّ فَقَالَ يَا رَسُولَ اللهِ وَفِي رِوَايَةِ الشَّافِعِيِّ أَنَّ رَجُلًا مِنْ أَهْلِ الْبَادِيَةِ أَتَى النَّبِيَّ ﷺ فَقَالَ لَهُ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ لَهُ النَّبِيُّ ﷺ هَلْ لَكَ مِنْ إِبِلٍ؟ قَالَ نَعَمْ قَالَ فَمَا أَلْوَانُهَا؟ قَالَ حُمْرٌ قَالَ فَهَلْ فِيهَا مِنْ أَوْرَقَ؟ قَالَ نَعَمْ قَالَ أَنَّى تَرَى ذَلِكَ؟ قَالَ عِرْقًا نَزَعَهُ فَقَالَ النَّبِيُّ ﷺ فَلَعَلَّ هَذَا نَزَعَهُ عِرْقٌ
[Machine] "A Bedouin man from the tribe of Banu Fazara came to the Prophet ﷺ and said, 'Indeed, my wife has given birth to a dark-skinned boy.' The Prophet ﷺ said to him, 'Do you have any camels?' He replied, 'Yes.' The Prophet ﷺ asked, 'What are their colors?' He answered, 'Red.' The Prophet ﷺ then asked, 'Do any of them have white markings?' He replied, 'Yes, some of them have white markings.' The Prophet ﷺ said, 'Perhaps it is from the genes of one of them that the child inherited this.' The phrase 'perhaps it is from the genes of one of them' is a narration from Imam Shafi'i, and in the narration of Qutaiba, it mentions that a man from the tribe of Banu Fazara came to the Prophet ﷺ and said, 'Perhaps it is from the genes of one of them.'"
أَنَّ أَعْرَابِيًّا مِنْ بَنِي فَزَارَةَ أَتَى النَّبِيَّ ﷺ فَقَالَ إِنَّ امْرَأَتِي وَلَدَتْ غُلَامًا أَسْوَدَ فَقَالَ لَهُ النَّبِيُّ ﷺ هَلْ لَكَ مِنْ إِبِلٍ؟ قَالَ نَعَمْ قَالَ فَمَا أَلْوَانُهَا؟ قَالَ حُمْرٌ قَالَ هَلْ فِيهَا مِنْ أَوْرَقَ؟ قَالَ إِنَّ فِيهَا لَوُرْقًا قَالَ فَأَنَّى أَصَابَهَا ذَلِكَ؟ قَالَ لَعَلَّهُ عِرْقٌ نَزَعَهُ فَقَالَ النَّبِيُّ ﷺ وَهَذَا لَعَلَّهُ نَزَعَهُ عِرْقٌ لَفْظُ حَدِيثِ الشَّافِعِيِّ وَفِي رِوَايَةِ قُتَيْبَةَ جَاءَ رَجُلٌ مِنْ بَنِي فَزَارَةَ إِلَى النَّبِيِّ ﷺ وَقَالَ عَسَى أَنْ يَكُونَ نَزَعَهُ عِرْقٌ
46.15 [Machine] The man admits to the pregnancy of his wife or her child once, so he cannot deny it afterwards.
٤٦۔١٥ بَابُ الرَّجُلِ يُقِرُّ بِحَبَلِ امْرَأَتِهِ أَوْ بِوَلَدِهَا مَرَّةً فَلَا يَكُونُ لَهُ نَفْيُهُ بَعْدَهُ
[Machine] He decided concerning a man who denied his wife's child while he was in her womb, then he confessed to it while he was in her womb. When the child was born, he denied him, so Umar ibn al-Khattab ordered him to be lashed eighty times for slandering his lineage, then the child was attributed to him.
أَنَّهُ قَضَى فِي رَجُلٍ أَنْكَرَ وَلَدَ امْرَأَتِهِ وَهُوَ فِي بَطْنِهَا ثُمَّ اعْتَرَفَ بِهِ وَهُوَ فِي بَطْنِهَا حَتَّى إِذَا وُلِدَ أَنْكَرَهُ فَأَمَرَ بِهِ عُمَرُ بْنُ الْخَطَّابِ ؓ فَجُلِدَ ثَمَانِينَ جَلْدَةً لِفِرْيَتِهِ عَلَيْهَا ثُمَّ أَلْحَقَ بِهِ وَلَدَهَا
أَنْ يَنْفِيَهُ وَاللهُ أَعْلَمُ
46.16 [Machine] The heading translates to: "The son's right to be laid on the marriage bed and the marriage.
٤٦۔١٦ بَابُ الْوَلَدِ لِلْفِرَاشِ بِالْوَطْءِ بِمِلْكِ الْيَمِينِ، وَالنِّكَاحِ
[Machine] That the Messenger of Allah ﷺ said, "Offspring belongs to the bed (where they are born), and stones (to be thrown) belong to the adulterer."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ
[Machine] The Prophet ﷺ said: "A child belongs to his bed, and the stone belongs to the adulteress."
سَمِعَ النَّبِيَّ ﷺ يَقُولُ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ
A’ishah said “Sa’d bin Abi Waqqas and ‘Abd bin Zamah disputed amongst themselves about the (relationship of the) son of the slave girl of Zam’ah and brought the case to the Apostle of Allaah ﷺ. Sa’d said “My brother ‘Utbah enjoined me that when I came to Makkah I should see the son of the slave girl of Zam’ah and take his possession for that is his son”. ‘Abd bin Zam’ah said “He is my brother, the son of my father’s slave girl having been born on my father’s bed”. The Apostle of Allaah ﷺ saw his clear resemblance to ‘Utbah. So he said “The child is attributed to the one on whose bed it is born and the fornicator is deprived of any right (lit. the fornicator will have the stone). Veil yourself from him, Saudah. Musaddad added in his version “he is your brother ‘Abd”. (Using translation from Abū Dāʾūd 2273)
عَبْدَ بْنَ زَمْعَةَ وَسَعْدًا اخْتَصَمَا إِلَى رَسُولِ اللهِ ﷺ فِي ابْنِ أَمَةِ زَمْعَةَ فَقَالَ سَعْدٌ يَا رَسُولَ اللهِ أَوْصَانِي أَخِي إِذَا قَدِمْتُ مَكَّةَ أَنْظُرُ إِلَى ابْنِ أَمَةِ زَمْعَةَ فَأَقْبِضُهُ فَإِنَّهُ ابْنِي فَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وَابْنُ أَمَةِ أَبِي وُلِدَ عَلَى فِرَاشِ أَبِي فَرَأَى شَبَهًا بَيِّنًا بِعُتْبَةَ فَقَالَ هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَاحْتَجِبِي مِنْهُ يَا سَوْدَةُ أَخْرَجَاهُ فِي الصَّحِيحَيْنِ مِنْ حَدِيثِ سُفْيَانَ بْنِ عُيَيْنَةَ
[Machine] He was born on his father's bed, and they went to the Messenger of Allah. Sa`d said, "O Messenger of Allah, my brother made a will concerning me." So the Messenger of Allah said, "Abd bin Zam`ah is your brother, and Ibn Waleedah is your father." Then the Messenger of Allah said to Sawdah bint Zam`ah, "Shield yourself from him when he sees you, due to the resemblance he has with `Utbah." She did not see him until she met Allah. This is the wording of the Hadith of Abu `Abdullah.
وُلِدَ عَلَى فِرَاشِ أَبِي فَتَسَاوَقَا إِلَى رَسُولِ اللهِ ﷺ فَقَالَ سَعْدٌ يَا رَسُولَ اللهِ إِنَّ أَخِي كَانَ عَهِدَ إِلِيَّ فِيهِ فَقَالَ عَبْدُ بْنُ زَمْعَةَ أَخِي وَابْنُ وَلِيدَةِ أَبِي فَقَالَ رَسُولُ اللهِ ﷺ هُوَ لَكَ يَا عَبْدُ بْنَ زَمْعَةَ الْوَلَدُ لِلْفِرَاشِ وَلِلْعَاهِرِ الْحَجَرُ ثُمَّ قَالَ لِسَوْدَةَ بِنْتِ زَمْعَةَ ؓ احْتَجِبِي مِنْهُ لَمَّا رَأَى مِنْ شَبَهِهِ بِعُتْبَةَ فَمَا رَآهَا حَتَّى لَقِيَتِ اللهَ ﷻ لَفْظُ حَدِيثِ أَبِي عَبْدِ اللهِ
[Machine] When Ibrahim, the son of the Prophet ﷺ, was born from Mariyah, his wife, the Prophet ﷺ was almost inclined towards considering him as his own child until Jibril came to him and greeted him. Jibril said, "Peace be upon you, O father of Ibrahim." In this, there is evidence of the certainty of lineage for the offspring of the Ummah.
أَنَّهُ لَمَّا وُلِدَ إِبْرَاهِيمُ ابْنُ النَّبِيِّ ﷺ مِنْ مَارِيَةَ جَارِيَتِهِ كَادَ يَقَعُ فِي نَفْسِ النَّبِيِّ ﷺ مِنْهُ حَتَّى أَتَاهُ جِبْرِيلُ عَلَيْهِ السَّلَامُ فَقَالَ السَّلَامُ عَلَيْكَ أَبَا إِبْرَاهِيمَ وَفِي هَذَا إِنْ ثَبَتَ دَلَالَةٌ عَلَى ثُبُوتِ النَّسَبِ لِفِرَاشِ الْأَمَةِ
[Machine] What is wrong with men who have relations with their wives and then abandon them, refusing to receive a child unless its father admits that it is from him? If the father admits, then I will attribute the child to him. Otherwise, they should separate. And I, Malik, heard from Nafi' who heard from Safiyyah, the daughter of Abu 'Ubayd, who heard from 'Umar, regarding the sending of children, it is similar in meaning to the hadith of Ibn Shihab, narrated by Salim.
مَا بَالُ رِجَالٍ يَطُوفُونَ وَلَائِدَهُمْ ثُمَّ يَعْزِلُونَهُنَّ لَا تَأْتِينِي وَلِيدَةٌ يَعْتَرِفُ سَيِّدُهَا أَنْ قَدْ أَلَمَّ بِهَا إِلَّا أَلْحَقْتُ بِهِ وَلَدَهَا وَاعْزِلُوا بَعْدُ أَوِ اتْرُكُوا قَالَ وَأنا مَالِكٌ عَنْ نَافِعٍ عَنْ صَفِيَّةَ بِنْتِ أَبِي عُبَيْدٍ عَنْ عُمَرَ ؓ فِي إِرْسَالِ الْوَلَائِدِ يُوطَيْنَ بِمِثْلِ مَعْنَى حَدِيثِ ابْنِ شِهَابٍ عَنْ سَالِمٍ
[Machine] Men tread on their tables, then they invite them to come out, but they don't come. Then a child is born to their master, and she confesses that her master has inflicted pain on her, so I send her away after I take her child. Abu Sa'id bin Abi 'Umar informed us that Abu al-Abbas al-Asammu narrated to us: I am al-Rabi'. I said to al-Shafi'i, "Did anyone other than us disagree with you on this issue?" He said, "Yes, some of the Easterners." I said, "So what was their argument?" He said, "Their argument was that they claimed 'Umar denied the paternity of a female slave's child that he acknowledged, and Zaid bin Thabit denied the paternity of a female slave's child that he acknowledged, and Ibn 'Abbas denied the paternity of a female slave's child." I said, "So what was your argument against them?" Meaning, what was your response. He said, "As for 'Umar, it is narrated that he denied the pregnancy of a female slave who admitted to committing something disliked. And as for Zaid bin Thabit and Ibn 'Abbas, if they did deny the paternity of the children of two well-known female slaves, then it is permissible for them. And similarly, for the husband of a free woman, if he knows that she has become pregnant from adultery, he can disown her child and it will not be attributed to him in the eyes of Allah. And he spoke about it in length here."
رِجَالٍ يَطَئُونَ وَلَائِدَهُمْ ثُمَّ يَدَعُونَهُنَّ يَخْرُجْنَ لَا تَأْتِينِي وَلِيدَةٌ يَعْتَرِفُ سَيِّدُهَا أَنْ قَدْ أَلَمَّ بِهَا إِلَّا أَلْحَقْتُ بِهِ وَلَدَهَا فَأَرْسِلُوهُنَّ بَعْدُ أَوْ أَمْسِكُوهُنَّ 15376 أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو نا أَبُو الْعَبَّاسِ الْأَصَمُّ أَنَا الرَّبِيعُ قَالَ قُلْتُ لِلشَّافِعِيِّ ؓ فَهَلْ خَالَفَكَ فِي هَذَا غَيْرُنَا؟ قَالَ نَعَمْ بَعْضُ الْمَشْرِقِيِّينَ قُلْتُ فَمَا كَانَتْ حُجَّتُهُمْ؟ قَالَ كَانَتْ حُجَّتُهُمْ أَنْ قَالُوا انْتَفَى عُمَرُ ؓ مِنْ وَلَدِ جَارِيَةٍ لَهُ وَانْتَفَى زَيْدُ بْنُ ثَابِتٍ ؓ مِنْ وَلَدِ جَارِيَةٍ لَهُ وَانْتَفَى ابْنُ عَبَّاسٍ ؓ مِنْ وَلَدِ جَارِيَةٍ قُلْتُ فَمَا كَانَتْ حُجَّتُكَ عَلَيْهِمْ؟ يَعْنِي جَوَابُكَ قَالَ أَمَّا عُمَرُ ؓ فَرُوِيَ عَنْهُ أَنَّهُ أَنْكَرَ حَمْلَ جَارِيَةٍ لَهُ أَقَرَّتْ بِالْمَكْرُوهِ وَأَمَّا زَيْدُ بْنُ ثَابِتٍ وَابْنُ عَبَّاسٍ ؓ فَإِنَّهُمَا أَنْكَرَا إِنْ كَانَا فِعْلًا وَلَدَ جَارِيَتَيْنِ عُرْفًا أَنْ لَيْسَ مِنْهُمَا فَحَلَالٌ لَهُمَا وَكَذَلِكَ لِزَوْجِ الْحُرَّةِ إِذَا عَلِمَ أَنَّهَا حَبِلَتْ مِنَ الزِّنَا أَنْ يَدْفَعَ وَلَدَهَا وَلَا يَلْحَقْ بِنَسَبِهِ مَنْ لَيْسَ مِنْهُ فِيمَا بَيْنَهُ وَبَيْنَ اللهِ ﷻ وَتَكَلَّمَ عَلَيْهِ بِمَا يَطُولُ ذِكْرُهُ هَاهُنَا
46.17 [Machine] The woman gives birth to a child on the bed of a man under suspicion that he may not be the father and that he may be the second.
٤٦۔١٧ بَابُ الْمَرْأَةِ تَأْتِي بِوَلَدٍ عَلَى فِرَاشِ رَجُلٍ مِنْ شُبْهَةٍ لَا يُمْكِنُ أَنْ يَكُونَ مِنَ الْأَوَّلِ وَيُمْكِنُ أَنْ يَكُونَ مِنَ الثَّانِي
[Machine] It is said that her dowry was given to her by her father, so Ubaidullah set off and caught up with Muawiyah. He was absent from his wife for a long time and the father of the girl died, so her family married her off to a man from among them called Ikrimah. When Ubaidullah found out about this, he came and disputed with them to Ali, and the woman responded to him. She was pregnant with Ikrimah's child, so she delivered the child into Ali's hands. The woman said to Ali, "Am I more entitled to my wealth or Ubaidullah bin al-Harith?" He replied, "No, you are more entitled to it." She said, "I testify that everything that I had from Ikrimah in terms of dowry is his." When she gave birth, she returned it to Ubaidullah bin al-Harith and reconciled the child with his father. And Allah knows best.
يُقَالُ لَهَا الدَّرْدَاءُ زَوَّجَهَا إِيَّاهُ أَبُوهَا فَانْطَلَقَ عُبَيْدُ اللهِ فَلَحِقَ بِمُعَاوِيَةَ فَأَطَالَ الْغَيْبَةَ عَلَى امْرَأَتِهِ وَمَاتَ أَبُو الْجَارِيَةِ فَزَوَّجَهَا أَهْلُهَا مِنْ رَجُلٍ مِنْهُمْ يُقَالُ لَهُ عِكْرِمَةُ فَبَلَغَ ذَلِكَ عُبَيْدَ اللهِ فَقَدِمَ فَخَاصَمَهُمْ إِلَى عَلِيٍّ ؓ فَرَدَّ عَلَيْهِ الْمَرْأَةَ وَكَانَتْ حَامِلًا مِنْ عِكْرِمَةَ فَوَضَعَهَا عَلَى يَدَيْ عَدْلٍ فَقَالَتِ الْمَرْأَةُ لِعَلِيٍّ ؓ أَنَا أَحَقُّ بِمَالِي أَوْ عُبَيْدُ اللهِ بْنُ الْحُرِّ؟ فَقَالَ بَلْ أَنْتَ أَحَقُّ بِذَلِكَ قَالَتْ فَأُشْهِدُكَ أَنَّ كُلَّ مَا كَانَ لِي عَلَى عِكْرِمَةَ مِنْ شَيْءٍ مِنْ صَدَاقٍ فَهُوَ لَهُ فَلَمَّا وَضَعَتْ مَا فِي بَطْنِهَا رَدَّهَا إِلَى عُبَيْدِ اللهِ بْنِ الْحُرِّ وَأَلْحَقَ الْوَلِيدَ بِأَبِيهِ وَاللهُ أَعْلَمُ
