٤٧۔ كِتَابُ الْعِدَدِ ص ١
Asma', daughter of Yazid ibn as-Sakan al-Ansariyyah, was divorced in the time of the Messenger of Allah ﷺ. No waiting period was prescribed for a divorced woman (at that time). When Asma' was divorced, Allah, the Exalted, sent down the injunction of waiting period for divorce. She is the first of the divorced women about whom the verse relating to waiting period was sent down. (Using translation from Abū Dāʾūd 2281)
أَنَّهَا طُلِّقَتْ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ وَلَمْ يَكُنْ لِلْمُطَلَّقَةِ عِدَّةٌ فَأَنْزَلَ اللهُ جَلَّ ثَنَاؤُهُ حِينَ طُلِّقَتْ أَسْمَاءُ بِالْعِدَّةِ لِلطَّلَاقِ فَكَانَتْ أَوَّلَ مَنْ أُنْزِلَ فِيهَا الْعِدَّةُ لِلطَّلَاقِ
[Machine] When the verse of women in Surah Al-Baqarah was revealed, regarding divorce and the death of a husband, Ubayy ibn Ka'b said, “O Messenger of Allah, some people from the people of Madinah say that there are still women about whom nothing has been mentioned." The Prophet asked, "What are they?" Ubayy replied, "Those who are young and old, those who are pregnant." Then the verse was revealed, "{And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruated. And for those who are pregnant, their term is until they give birth.}" [Al-Talaq 4]
لَمَّا نَزَلَتْ عِدَّةُ النِّسَاءِ فِي سُورَةِ الْبَقَرَةِ فِي الْمُطَلَّقَةِ وَالْمُتَوَفَّى عَنْهَا زَوْجُهَا قَالَ قَالَ أُبَيُّ بْنُ كَعْبٍ يَا رَسُولَ اللهِ إِنَّ أُنَاسًا مِنْ أَهْلِ الْمَدِينَةِ يَقُولُونَ قَدْ بَقِيَ مِنَ النِّسَاءِ مَا لَمْ يُذْكَرْ فِيهِ شَيْءٌ قَالَ وَمَا هُوَ؟ قَالَ الصِّغَارُ وَالْكِبَارُ ذَوَاتُ الْحَمْلِ قَالَ فَنَزَلَتْ {وَاللَّائِي يَئِسْنَ مِنَ الْمَحِيضِ مِنْ نِسَائِكُمْ إِنِ ارْتَبْتُمْ فَعِدَّتُهُنَّ ثَلَاثَةُ أَشْهُرٍ وَاللَّائِي لَمْ يَحِضْنَ وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ} [الطلاق 4]

٤٧۔٢ جُمَّاعُ أَبْوَابِ عِدَّةِ الْمَدْخُولِ بِهَا
47.3 [Machine] What is mentioned in His saying: {And divorced women must wait for three menstrual periods} [Quran 2:228] and whoever says: 'The pure readings' and what is indicated by the evidence.
٤٧۔٣ بَابُ مَا جَاءَ فِي قَوْلِهِ ﷻ: {وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلَاثَةَ قُرُوءٍ} [البقرة: 228] وَمَنْ قَالَ: الْأَقْرَاءُ الْأَطْهَارُ وَمَا دَلَّ عَلَيْهِ مِنَ الْآثَارِ
‘Abd Allah bin Umar said that he divorced his wife while she was menstruating during the time of the Apostle of Allaah ﷺ. So ‘Umar bin Al Khattab asked the Apostle of Allaah ﷺ about this matter. The Apostle of Allaah ﷺ said “Order him, he must take her back and keep her back till she is purified, then has another menstrual period and is purified. Thereafter if he desires he may divorce her before having intercourse with her, for that is the period of waiting which Allaah the Glorified has commanded for the divorce of women.” (Using translation from Abū Dāʾūd 2179)
أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ ؓ رَسُولَ اللهِ ﷺ عَنْ ذَلِكَ فَقَالَ رَسُولُ اللهِ ﷺ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لِيُمْسِكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدَ ذَلِكَ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللهُ أَنْ يُطَلَّقَ لَهَا النِّسَاءُ
What do you think if a man divorces his wife while she is menstruating? He said: Abdullah ibn Umar divorced his wife while she was menstruating during the time of the Messenger of Allah ﷺ.So Umar asked the Messenger of Allah ﷺ saying: Abdullah ibn Umar divorced his wife while she was menstruating. Abdullah said: He returned her to me and did not count it (the pronouncement) anything. He said: When she is purified, he may divorce her or keep her with him. Ibn Umar said: The Prophet ﷺ recited the Qur'anic verse: O Prophet, when you divorce women, divorce them in the beginning of their waiting period." Abu Dawud said: This tradition has been narrated by Yunus b. Jubair, Anas b. Sirin b. Jubair, Zaid b. Aslam, Abu al-Zubair and Mansur from Abu Wa'il on the authority of Ibn 'Umar. They all agreed on the theme that the Prophet ﷺ commanded him to take her back (and keep her) till she was purified. Then if he desired, he might divorce her or keep her with him if he wanted to do so. The version narrated by al-Zuhri from Salim from Nafi' on the authority of Ibn 'Umar has: The Prophet ﷺ commanded him to take her back (and keep her) till she is purified, and then has menstrual discharge, and then she is purified. Then if he desires, he may divorce her and if he desires he may keep her. Abu Dawud said: A version like that of Nafi' and al-Zuhri has also been transmitted by 'Ata al-Khurasani from al-Hasan on the authority of Ibn 'Umar. All the versions of this tradition contradict the one narrated by Abu al-Zubair. (Using translation from Abū Dāʾūd 2185)
طَلَّقَ ابْنُ عُمَرَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ فَسَأَلَ عُمَرُ ؓ رَسُولَ اللهِ ﷺ فَقَالَ إِنَّ عَبْدَ اللهِ بْنَ عُمَرَ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ فَقَالَ النَّبِيُّ ﷺ لِيُرَاجِعْهَا فَرَدَّهَا عَلَيَّ وَقَالَ إِذَا طَهُرَتْ فَلْيُطَلِّقْ أَوْ يُمْسِكْ قَالَ ابْنُ عُمَرَ قَرَأَ النَّبِيُّ ﷺ يَا أَيُّهَا النَّبِيُّ إِذَا طَلَّقْتُمُ النِّسَاءَ فَطَلِّقُوهُنَّ فِي قُبُلِ عِدَّتِهِنَّ
[Machine] Some argued with her about it and said, "Indeed, Allah, blessed and exalted, says, 'Three divorces.'" So Aisha said, "Do you know what 'Al-Aqra' means?" They said, "It refers to the pure ones." Aisha and I heard Ibn Shihab saying that he heard Abu Bakr ibn Abd al-Rahman saying, "I have not come across any of our scholars except that they say, 'This is what Aisha meant by the narration of Ibn Bukayr.'" And in the narration of Shafi'i, Aisha said, "You are correct. But do you know what 'Al-Aqra' means?" "Al-Aqra' means the pure ones."
جَادَلَهَا فِي ذَلِكَ أُنَاسٌ وَقَالُوا إِنَّ اللهَ تَبَارَكَ وَتَعَالَى يَقُولُ {ثَلَاثَةَ قُرُوءٍ} [البقرة 228] فَقَالَتْ عَائِشَةُ ؓ وَتَدْرُونَ مَا الْأَقْرَاءُ؟ إِنَّمَا الْأَقْرَاءُ الْأَطْهَارُ قَالَا وَأَنَا مَالِكٌ عَنِ ابْنِ شِهَابٍ أَنَّهُ قَالَ سَمِعْتُ أَبَا بَكْرِ بْنَ عَبْدِ الرَّحْمَنِ يَقُولُ مَا أَدْرَكْتُ أَحَدًا مِنْ فُقَهَائِنَا إِلَّا وَهُوَ يَقُولُ هَذَا يُرِيدُ الَّذِي قَالَتْ عَائِشَةُ ؓ لَفْظُ حَدِيثِ ابْنِ بُكَيْرٍ وَفِي رِوَايَةِ الشَّافِعِيِّ فَقَالَتْ عَائِشَةُ ؓ صَدَقْتُمْ وَهَلْ تَدْرُونَ مَا الْأَقْرَاءُ؟ الْأَقْرَاءُ الْأَطْهَارُ
الْأَقْرَاءُ الْأَطْهَارُ
[Machine] If the divorced woman enters her third menstruation cycle, she will be free from him.
إِذَا دَخَلَتِ الْمُطَلَّقَةُ فِي الْحَيْضَةِ الثَّالِثَةِ فَقَدْ بَرِئَتْ مِنْهُ
[Machine] When it enters the bloodstream during the third menstrual period, it is considered clean from it and it does not inherit or being inherited by it. According to the narration of Al-Shafi'i, he divorced her and the rest is equal.
أَنَّهَا إِذَا دَخَلَتْ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ فَقَدْ بَرِئَتْ مِنْهُ وَبَرِئَ مِنْهَا وَلَا تَرِثُهُ وَلَا يَرِثُهَا وَفِي رِوَايَةِ الشَّافِعِيِّ وَقَدْ كَانَ طَلَّقَهَا وَالْبَاقِي سَوَاءٌ
[Machine] Muawiyah wrote to Zaid, then Zaid wrote: "If the divorced woman enters the third menstruation, then she is cleared from him."
كَتَبَ مُعَاوِيَةُ إِلَى زَيْدٍ فَكَتَبَ زَيْدٌ إِذَا دَخَلَتِ الْمُطَلَّقَةُ فِي الْحَيْضَةِ الثَّالِثَةِ فَقَدْ بَرِئَتْ مِنْهُ
[Machine] He used to say: If a man divorces his wife and she enters the third period of her menstrual cycle, then he is free from her and she is free from him. He does not inherit from her, and she does not inherit from him.
كَانَ يَقُولُ إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ فَدَخَلَتْ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ فَقَدْ بَرِئَتْ مِنْهُ وَبَرِئَ مِنْهَا وَلَا تَرِثُهُ وَلَا يَرِثُهَا
[Machine] "When she enters the third menstrual cycle, there is no going back for her."
إِذَا دَخَلَتْ فِي الْحَيْضَةِ الثَّالِثَةِ فَلَا رَجْعَةَ لَهُ عَلَيْهَا
[Machine] Zaid bin Thabit said, "If a drop of blood drops in the third period, then her waiting period is over."
قَالَ زَيْدُ بْنُ ثَابِتٍ إِذَا قُطِرَتْ مِنَ الْمُطَلَّقَةِ قَطْرَةٌ مِنَ الدَّمِ فِي الْحَيْضَةِ الثَّالِثَةِ فَقَدِ انْقَضَتْ عِدَّتُهَا
[Machine] About a woman, if she is divorced and enters her third period of menstrual bleeding, they say, "She has shown signs of ending and has become permissible."
عَنِ الْمَرْأَةِ إِذَا طُلِّقَتْ فَدَخَلَتْ فِي الدَّمِ مِنَ الْحَيْضَةِ الثَّالِثَةِ فَقَالَا قَدْ بَانَتْ مِنْهُ وَحَلَّتْ
[Machine] Malik (may Allah have mercy on him) and that is the matter that I have perceived among the people of knowledge in our country. And Allah knows best.
مَالِكٌ رَحِمَهُ اللهُ وَذَاكَ الْأَمْرُ الَّذِي أَدْرَكْتُ عَلَيْهِ أَهْلَ الْعِلْمِ بِبَلَدِنَا وَاللهُ أَعْلَمُ
47.4 [Machine] Who said the recitation of the Hayd?
٤٧۔٤ بَابُ مَنْ قَالَ الْأَقْرَاءُ الْحَيْضُ
[Machine] The daughter of Abu Hubaysh got her period and she asked the Prophet ﷺ or the Prophet ﷺ was asked about her, so he commanded her to stop praying during her menstrual days and to cleanse herself with something other than water and to seek forgiveness with a cloth, and she should continue praying. Sulaiman was asked if her husband can have sexual intercourse with her during her period, to which he replied, "We only say what we have heard, and that is the ruling."
بِنْتَ أَبِي حُبَيْشٍ اسْتُحِيضَتْ فَسَأَلْتِ النَّبِيَّ ﷺ أَوْ سُئِلَ لَهَا النَّبِيُّ ﷺ فَأَمَرَهَا أَنْ تَدَعَ الصَّلَاةَ أَيَّامَ أَقْرَائِهَا وَأَنْ تَغْتَسِلَ فِيمَا سِوَى ذَلِكَ وَتَسْتَدْفِرَ بِثَوْبٍ وَتُصَلِّيَ فَقِيلَ لِسُلَيْمَانَ أَيَغْشَاهَا زَوْجُهَا؟ فَقَالَ إِنَّمَا نَقُولُ فِيمَا سَمِعْنَا وَكَذَلِكَ
[Machine] Abi Hubayshah was experiencing istihaadah (irregular bleeding) so she asked Umm Salamah and the Messenger of Allah ﷺ. The Prophet ﷺ said, "It is not menstruation; rather, it is only a vein. He commanded her to refrain from praying during the days of her regular period and the days of her irregular bleeding. Then she should perform ghusl (ritual bath) and pray. If the bleeding overwhelms her, she should consider it as her regular period." This is what I found, and the correct opinion is that it could be either the days of her regular period or the days of her istihaadah, with doubt. And similarly...
أَبِي حُبَيْشٍ ؓ اسْتُحِيضَتْ فَسَأَلَتْ لَهَا أُمُّ سَلَمَةَ ؓ رَسُولَ اللهِ ﷺ فَقَالَ النَّبِيُّ ﷺ لَيْسَتْ بِالْحَيْضَةِ إِنَّمَا هُوَ عِرْقٌ فَأَمَرَهَا أَنْ تَدَعَ الصَّلَاةَ أَيَّامَ أَقْرَائِهَا وَأَيَّامَ حَيْضِهَا ثُمَّ تَغْتَسِلَ وَتُصَلِّيَ فَإِنْ غَلَبَهَا الدَّمُ اسْتَدْفَرَتْ كَذَا وَجَدْتُ وَالصَّوَابُ أَيَّامَ أَقْرَائِهَا أَوْ أَيَّامَ حَيْضِهَا بِالشَّكِّ وَكَذَلِكَ
[Machine] My husband divorced me, then he left me until I returned to my father's house, washed myself, and changed my clothes. He said, "I have taken you back, I have taken you back." Umar said to Ibn Mas'ood, who was beside him, "What do you say about this?" He replied, "I believe that he has more right to her until she purifies herself from the third menstrual cycle and prayer becomes permissible for her." Umar said, "And I see it that way too."
إِنَّ زَوْجِي طَلَّقَنِي ثُمَّ تَرَكَنِي حَتَّى رَدَدْتُ أَبِي وَوَضَعْتُ مَائِي وَخَلَعْتُ ثِيَابِي فَقَالَ قَدْ رَاجَعْتُكِ قَدْ رَاجَعْتُكِ فَقَالَ عُمَرُ ؓ لِابْنِ مَسْعُودٍ ؓ وَهُوَ إِلَى جَنْبِهِ مَا تَقُولُ فِيهَا؟ قَالَ أَرَى أَنَّهُ أَحَقُّ بِهَا حَتَّى تَغْتَسِلَ مِنَ الْحَيْضَةِ الثَّالِثَةِ وَتَحِلُّ لَهَا الصَّلَاةُ فَقَالَ عُمَرُ ؓ وَأَنَا أَرَى ذَلِكَ
[Machine] If a man divorces his wife, he has the right to her until she completes three menstrual cycles.
إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ فَهُوَ أَحَقُّ بِهَا حَتَّى تَغْتَسِلَ مِنَ الْحَيْضَةِ الثَّالِثَةِ فِي الْوَاحِدَةِ وَالثِّنْتَيْنِ
[Machine] "Uthman sent a message to Abu asking him about a man who divorced his wife and then took her back during her third menstrual cycle. He said, 'I believe that he has more right to her as long as she has not yet purified herself from the third menstrual cycle and the prayer becomes lawful for her.' Uthman replied, 'I don't know except that.'"
أَرْسَلَ عُثْمَانُ ؓ إِلَى أَبِي ؓ يَسْأَلُهُ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ ثُمَّ رَاجَعَهَا حِينَ دَخَلَتْ فِي الْحَيْضَةِ الثَّالِثَةِ قَالَ إِنِّي أَرَى أَنَّهُ أَحَقُّ بِهَا مَا لَمْ تَغْتَسِلْ مِنَ الْحَيْضَةِ الثَّالِثَةِ وَتَحِلُّ لَهَا الصَّلَاةُ قَالَ لَا أَعْلَمُ عُثْمَانَ ؓ إِلَّا أَخَذَ بِذَلِكَ
[Machine] "And Abdullah and Abu Musa (may Allah be pleased with them) reported that a man divorced his wife and she experienced three menstrual cycles. He then reconciled with her before she had performed the ritual bath (ghusl). Abdullah said that he had more right to her as long as she had not performed the ritual bath after the third menstrual cycle. 15398: Abu Abdullah Al-Hafiz reported to us, Abu Al-Abbas Muhammad ibn Ya'qub reported to us, Muhammad ibn Ishaq reported to us, Hujjaj narrated, Ibn Jurayj said: Three different recitations (qira'at) were narrated by Ibn Jurayj from 'Ata' Al-Khurasani from Ibn Abbas, who said: There are three menstrual cycles."
وَعَبْدِ اللهِ وَأَبِي مُوسَى ؓ فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ فَتَحِيضُ ثَلَاثَ حِيَضٍ فَيُرَاجِعُهَا قَبْلَ أَنْ تَغْتَسِلَ قَالَ هُوَ أَحَقُّ بِهَا مَا لَمْ تَغْتَسِلْ مِنَ الْحَيْضَةِ الثَّالِثَةِ 15398 أَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ نا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ نا مُحَمَّدُ بْنُ إِسْحَاقَ نا حَجَّاجٌ قَالَ قَالَ ابْنُ جُرَيْجٍ ثَلَاثَةُ قُرُوءٍ ابْنُ جُرَيْجٍ عَنْ عَطَاءٍ الْخُرَاسَانِيِّ عَنِ ابْنِ عَبَّاسٍ قَالَ ثَلَاثُ حِيَضٍ
[Machine] The woman should recite when her menstruation approaches, and should recite when her purity approaches. Abu 'Ubaid said: "The time of recitation is when the act is present." Al-A'sha praised a man for a battle in which he inherited wealth, and in the mention of him, there is an elevation for what was lost in it from the recitation of your women. So, the recitation here refers to purification, because women are not approached except in a state of purity.
قَدْ أَقْرَأَتِ الْمَرْأَةُ إِذَا دَنَا حَيْضُهَا وَأَقْرَأَتْ إِذَا دَنَا طُهْرُهَا قَالَ قَالَ أَبُو عُبَيْدٍ فَاصِلُ الْأَقْرَاءِ إِنَّمَا هِيَ وَقْتُ الشَّيْءِ إِذَا حَضَرَ قَالَ الْأَعْشَى يَمْدَحُ رَجُلًا بِغَزْوَةٍ غَزَاهَا [البحر الطويل] مُوَرِّثُهُ مَالًا وَفِي الذِّكْرِ رِفْعَةٌ لِمَا ضَاعَ فِيهَا مِنْ قُرُوءِ نِسَائِكَا فَالْقُرُوءُ هَاهُنَا الْأَطْهَارُ لِأَنَّ النِّسَاءَ لَا يُوطَأْنَ إِلَّا فِيهَا
47.5 [Machine] Do not count the divorce that occurred during menstruation
٤٧۔٥ بَابٌ لَا تَعْتَدُّ بِالْحَيْضَةِ الَّتِي وَقَعَ فِيهَا الطَّلَاقُ
[Machine] "Yahya and this is strange, no one talks about it except Abdul Wahhab Al Thaqafi. The sheikh said and its meaning was narrated by Yahya bin Ayyub Al Misri from Ubaidullah, and we were narrated from Zaid bin Thabit that he said, when a man divorces his wife and she is not pregnant, she does not observe her waiting period (iddah) for postnatal bleeding."
يَحْيَى وَهَذَا غَرِيبٌ لَيْسَ يُحَدِّثُ بِهِ إِلَّا عَبْدُ الْوَهَّابِ الثَّقَفِيُّ قَالَ الشَّيْخُ وَقَدْ رَوَى مَعْنَاهُ يَحْيَى بْنُ أَيُّوبَ الْمِصْرِيُّ عَنْ عُبَيْدِ اللهِ وَرُوِّينَا عَنْ زَيْدِ بْنِ ثَابِتٍ أَنَّهُ قَالَ إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ وَهِيَ نُفَسَاءُ لَمْ تَعْتَدَّ بِدَمِ نِفَاسِهَا فِي عِدَّتِهَا
[Machine] Regarding the jurists from the people of Al-Madina, they used to say that if a man divorces his wife while she is menstruating or in a state of postpartum bleeding, then she is required to observe three menstrual cycles in addition to the blood that she is currently experiencing.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ مَنْ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ أَوْ هِيَ نُفَسَاءُ فَعَلَيْهَا ثَلَاثُ حِيَضٍ سِوَى الدَّمِ الَّذِي هِيَ فِيهِ
47.6 [Machine] The woman's confirmation of the possibility of her waiting period expiring
٤٧۔٦ بَابُ تَصْدِيقِ الْمَرْأَةِ فِيمَا يُمْكِنُ فِيهِ انْقِضَاءُ عِدَّتِهَا
اؤْتُمِنَتِ الْمَرْأَةُ عَلَى فَرْجِهَا
[Machine] My tenure has ended and Ali possesses a share. He said: "Speak concerning it." He said: "And you are a witness, O Commander of the Faithful?" He said: "Yes." He said: "If she comes with a testimony from her relatives, the just ones, witnessing that she has completed three menstrual cycles, then she is telling the truth. Otherwise, she is lying." Ali said: "They say in the Roman way, 'Have you understood?'"
قَدِ انْقَضَتْ عِدَّتِي وَعِنْدَ عَلِيٍّ ؓ شُرَيْحٌ فَقَالَ قُلْ فِيهَا قَالَ وَأَنْتَ شَاهِدٌ يَا أَمِيرَ الْمُؤْمِنِينَ قَالَ نَعَمْ قَالَ إِنْ جَاءَتْ بِبِطَانَةٍ مِنْ أَهْلِهَا مِنَ الْعُدُولِ يَشْهَدُونَ أَنَّهَا حَاضَتْ ثَلَاثَ حِيَضٍ وَإِلَّا فَهِيَ كَاذِبَةٌ فَقَالَ عَلِيٌّ ؓ قَالُونُ بِالرُّومِيَّةِ أَيْ أَصَبْتَ
[Machine] They asked her neighbors about her, so if her menstrual cycle has ended, then her waiting period has expired, and he mentioned the conversation.
سَلُوا عَنْهَا جَارَاتِهَا فَإِنْ كَانَ حَيْضُهَا كَذَا انْقَضَتْ عِدَّتُهَا وَذَكَرَ الْحَدِيثَ
[Machine] The translation of the given passage "أَكْثَرُ الْحَيْضِ خَمْسَةَ عَشَرَ" into English is: "Most of the menstruation is fifteen."
أَكْثَرُ الْحَيْضِ خَمْسَةَ عَشَرَ
[Machine] Abu Ibrahim used to narrate these two hadiths. The Imam, the pious one, Imam Ahmad ibn Hanbal, may Allah exalt his mention, used to go to them.
أَبُو إِبْرَاهِيمَ إِلَى هَذَيْنِ الْحَدِيثَيْنِ كَانَ يَذْهَبُ الْإِمَامُ الْوَرِعُ الْإِمَامُ أَحْمَدُ بْنُ حَنْبَلٍ رَحِمَهُ اللهُ تَعَالَى
47.7 [Machine] The translation of the heading "عِدَّةِ مَنْ تَبَاعَدَ حَيْضُهَا" into English is "The waiting period of a woman who experiences irregular menstruation.
٤٧۔٧ بَابُ عِدَّةِ مَنْ تَبَاعَدَ حَيْضُهَا
[Machine] He said that there were two wives of his grandfather, one from the Hashemite tribe and one from the Ansari tribe. He divorced the Ansari wife while she was breastfeeding. She went through one year without menstruating and then died without experiencing it. She said, "I am entitled to inherit from him because I did not menstruate." So they went to Uthman to settle the matter, and Uthman ruled in her favor regarding inheritance. This angered the Hashemite wife, so Uthman said to her, "Your cousin, Ali, indicated to us about this."
أَنَّهُ قَالَ كَانَتْ عِنْدَ جَدِّهِ حَبَّانَ امْرَأَتَانِ لَهُ هَاشِمِيَّةٌ وَأَنْصَارِيَّةٌ فَطَلَّقَ الْأَنْصَارِيَّةَ وَهِيَ تُرْضِعُ فَمَرَّتْ بِهَا سَنَةٌ ثُمَّ هَلَكَ عَنْهَا وَلَمْ تَحِضْ فَقَالَتْ أَنَا أَرِثُهُ لَمْ أَحِضْ فَاخْتَصَمَا إِلَى عُثْمَانَ ؓ فَقَضَى لَهَا عُثْمَانُ ؓ بِالْمِيرَاثِ فَلَامَتِ الْهَاشِمِيَّةُ عُثْمَانَ ؓ فَقَالَ عُثْمَانُ ؓ ابْنُ عَمِّكِ هُوَ أَشَارَ إِلَيْنَا بِهَذَا يَعْنِي عَلِيًّا ؓ
[Machine] She inherits him if he dies, and she inherits her if she dies. Indeed, she is not among those women who despair of menstruation, nor is she among virgins who have not reached menstruation. Then she is on the waiting period of her menstruation, whether it was a little or a lot. So Habban returned to his people and took his daughter. When she lost her breastfeeding, she had one menstruation, then she had another menstruation, then Habban died before she had her third menstruation. So she observed the waiting period of the deceased husband and inherited.
تَرِثُهُ إِنْ مَاتَ وَيَرِثُهَا إِنْ مَاتَتْ فَإِنَّهَا لَيْسَتْ مِنَ الْقَوَاعِدِ اللَّاتِي قَدْ يَئِسْنَ مِنَ الْمَحِيضِ وَلَيْسَتْ مِنَ الْأَبْكَارِ اللَّاتِي لَمْ يَبْلُغْنَ الْمَحِيضَ ثُمَّ هِيَ عَلَى عِدَّةِ حَيْضِهَا مَا كَانَ مِنْ قَلِيلٍ أَوْ كَثِيرٍ فَرَجَعَ حَبَّانُ إِلَى أَهْلِهِ فَأَخَذَ ابْنَتَهُ فَلَمَّا فَقَدَتِ الرَّضَاعَ حَاضَتْ حَيْضَةً ثُمَّ حَاضَتْ حَيْضَةً أُخْرَى ثُمَّ تُوُفِّيَ حَبَّانُ قَبْلَ أَنْ تَحِيضَ الثَّالِثَةَ فَاعْتَدَّتْ عِدَّةَ الْمُتَوَفَّى عَنْهَا زَوْجُهَا وَوَرِثَتْ
[Machine] May God withhold her inheritance from you, and may He grant it to others.
حَبَسَ اللهُ عَلَيْكَ مِيرَاثَهَا فَوَرَّثَهُ مِنْهَا
[Machine] That women who have reached the age of menstruation should not be counted as being different from women who have reached it, according to the statement of Ibn Mas'ood. And that is our opinion, and Allah knows best.
أَنْ يَكُونَ فِي الْمَرْأَةِ قَدْ بَلَغَتِ السِّنَّ الَّتِي مَنْ بَلَغَهَا مِنْ نِسَائِهَا يَئِسْنَ مِنَ الْمَحِيضِ فَلَا يَكُونُ مُخَالِفًا لِقَوْلِ ابْنِ مَسْعُودٍ ؓ وَذَلِكَ وَجْهٌ عِنْدَنَا وَاللهُ أَعْلَمُ
47.8 [Machine] What Allah said about: "And it is not permissible for them to conceal what Allah has created in their wombs." [Al-Baqarah: 228] Al-Shafi'i, may Allah have mercy on him, said: it is evident in the verse by revelation that it is not permissible for a divorced woman to conceal what is in her womb from menstruation, and that implies the possibility of being pregnant during menstruation. It was narrated from Sa'id bin Salim from Ibn Jurayj from Mujahid who said about the saying of Allah: "And it is not permissible for them to conceal what Allah has created in their wombs." [Al-Baqarah: 228], the divorced woman is not allowed to say, "I am pregnant" when she is not pregnant, or "I am not pregnant" when she is pregnant, or "I am menstruating" when she is not menstruating, or "I am not menstruating" when she is menstruating.
٤٧۔٨ بَابُ مَا جَاءَ فِي قَوْلِ اللهِ ﷻ: {وَلَا يَحِلُّ لَهُنَّ أَنْ يَكْتُمْنَ مَا خَلَقَ اللهُ فِي أَرْحَامِهِنَّ} [البقرة: 228] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: وَكَانَ بَيِّنًا فِي الْآيَةِ بِالتَّنْزِيلِ أَنَّهُ لَا يَحِلُّ لِلْمُطَلَّقَةِ أَنْ تَكْتُمَ مَا فِي رَحِمِهَا مِنَ الْمَحِيضِ وَذَلِكَ يَحْتَمِلُ الْحَمْلَ مَعَ الْحَيْضِ , وَرُوِيَ عَنْ سَعِيدِ بْنِ سَالِمٍ عَنِ ابْنِ جُرَيْجٍ عَنْ مُجَاهِدٍ قَالَ فِي قَوْلِ اللهِ ﷻ -[690]-: {وَلَا يَحِلُّ لَهُنَّ أَنْ يَكْتُمْنَ مَا خَلَقَ اللهُ فِي أَرْحَامِهِنَّ} [البقرة: 228] الْمَرْأَةُ الْمُطَلَّقَةُ لَا يَحِلُّ لَهَا أَنْ تَقُولَ أَنَا حُبْلَى وَلَيْسَتْ بِحُبْلَى وَلَا لَسْتُ بِحُبْلَى وَهِيَ حُبْلَى وَلَا أَنَا حَائِضٌ وَلَيْسَتْ بِحَائِضٍ وَلَا لَسْتُ بِحَائِضٍ وَهِيَ حَائِضٌ
[Machine] In His saying, "And it is not lawful for them to conceal what Allah has created in their wombs" [Surah Al-Baqarah 228], He said, "The majority of what is concerned with it is menstruation."
فِي قَوْلِهِ {وَلَا يَحِلُّ لَهُنَّ أَنْ يَكْتُمْنَ مَا خَلَقَ اللهُ فِي أَرْحَامِهِنَّ} [البقرة 228] قَالَ أَكْثَرُ مَا عُنِيَ بِهِ الْحَيْضُ
الْحَيْضُ
[Machine] To say, "I am menstruating," while she is not menstruating, or to say, "I am not menstruating," while she is menstruating, or to say, "I am pregnant," while she is not pregnant, or to say, "I am not pregnant," while she is pregnant, all of these are disliked by the husband.
أَنْ تَقُولَ إِنِّي حَائِضٌ وَلَيْسَتْ بِحَائِضٍ أَوْ تَقُولَ إِنِّي لَسْتُ بِحَائِضٍ وَهِيَ حَائِضٌ أَوْ تَقُولَ إِنِّي حُبْلَى وَلَيْسَتْ بِحُبْلَى أَوْ تَقُولَ إِنِّي لَسْتُ بِحُبْلَى وَهِيَ حُبْلَى وَكُلُّ ذَلِكَ فِي بُغْضِ الْمَرْأَةِ زَوْجَهَا وَحُبِّهِ
47.9 [Machine] The equipment which is disappointed with menstruation and those who have not menstruated.
٤٧۔٩ بَابُ عِدَّةِ الَّتِي يَئِسَتْ مِنَ الْمَحِيضِ وَالَّتِي لَمْ تَحِضْ
[Machine] When this verse was revealed in Surah Al-Baqarah, some people said, "The number of women mentioned in the verse is less than the actual number of women, as it does not include young or elderly women who no longer experience menstruation, or pregnant women." So Allah revealed the following verse in Surah At-Talaq: "And those who no longer expect menstruation among your women - if you doubt, then their period is three months, and [also for] those who have not menstruated. And for those who are pregnant, their term is until they give birth." Ash-Shafi'i, may Allah have mercy on him, said regarding the statement "if you doubt" in Surah At-Talaq, "You do not know what would be the limit for other than the mature [women]."
لَمَّا نَزَلَتْ هَذِهِ الْآيَةُ الَّتِي فِي سُورَةِ الْبَقَرَةِ فِي عَدَدٍ مِنْ عِدَدِ النِّسَاءِ قَالُوا قَدْ بَقِيَ عَدَدٌ مِنْ عِدَدِ النِّسَاءِ لَمْ يَذْكُرْنَ الصِّغَارَ وَالْكِبَارَ اللَّائِي انْقَطَعَ عَنْهُنَّ الْحَيْضُ وَذَوَاتُ الْأَحْمَالِ فَأَنْزَلَ اللهُ ﷻ الْآيَةَ الَّتِي فِي النِّسَاءِ {وَاللَّائِي يَئِسْنَ مِنَ الْمَحِيضِ مِنْ نِسَائِكُمْ إِنِ ارْتَبْتُمْ فَعِدَّتُهُنَّ ثَلَاثَةُ أَشْهُرٍ وَاللَّائِي لَمْ يَحِضْنَ وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهَنَّ} [الطلاق 4] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَقَوْلُهُ {إِنِ ارْتَبْتُمْ} [الطلاق 4] فَلَمْ تَدْرُوا مَا تَعْتَدُّ غَيْرُ ذَوَاتِ الْأَقْرَاءِ
47.10 [Machine] The age at which a woman is permissible to menstruate, according to Imam Shafi'i.
٤٧۔١٠ بَابُ السِّنِّ الَّتِي يَجُوزُ أَنْ تَحِيضَ فِيهَا الْمَرْأَةُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: أَعْجَلُ مَنْ سَمِعْتُ بِهِ مِنَ النِّسَاءِ يَحِضْنَ نِسَاءُ تِهَامَةَ يَحِضْنَ لِتِسْعِ سِنِينَ
[Machine] I realized among us someone who became a grandmother, and she is the daughter of eighteen years old. She gave birth at the age of nine, and her daughter gave birth at the age of nine, so she became a grandmother while being eighteen years old.
أَدْرَكْتُ فِينَا يَعْنِي الْمَهَالِبَةَ امْرَأَةً صَارَتْ جَدَّةً وَهِيَ ابْنَةُ ثَمَانِ عَشْرَةَ وَلَدَتْ لِتِسْعِ سِنِينَ ابْنَةً فَوَلَدَتِ ابْنَتُهَا لِتِسْعِ سِنِينَ فَصَارَتْ جَدَّةً وَهِيَ ابْنَةُ ثَمَانِ عَشْرَةَ
[Machine] He informed him that his ten-year-old daughter is pregnant.
أَخْبَرَهُ أَنَّ ابْنَةً لَهُ حَمَلَتْ وَهِيَ ابْنَةُ عَشْرِ سِنِينَ
[Machine] That a woman in their neighborhood became pregnant while she was only nine years old, and we have mentioned all the details about it in the book of menstruation.
أَنَّ امْرَأَةً فِي جِوَارِهِمْ حَمَلَتْ وَهِيَ بِنْتُ تِسْعِ سِنِينَ وَقَدْ ذَكَرْنَا سَائِرَ الْحِكَايَاتِ فِيهِ فِي كِتَابِ الْحَيْضِ
47.11 [Machine] The Heading: The rights of divorced pregnant women
٤٧۔١١ بَابُ عِدَّةِ الْحَامِلِ الْمُطَلَّقَةِ قَالَ اللهُ تَبَارَكَ وَتَعَالَى فِي الْمُطَلَّقَاتِ: {وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ} [الطلاق: 4]
[Machine] Under Zubeir, she approached him while he was performing ablution and said, "I would like to satisfy myself with a divorce." So he did while she was pregnant. He went to the mosque and performed the prayers, and she had a miscarriage. He came to the Prophet Muhammad ﷺ and informed him of what he had done. The Prophet said, "The Book has specified its term, so marry her to herself." He said, "She deceived me, but Allah deceived her." This narration was reported from Abu al-Malih al-Raqqi from Abdul Malik ibn Abi al-Qasim from Umm Kulthum. Another narration with a similar meaning was reported from Aisha.
تَحْتَ الزُّبَيْرِ ؓ فَجَاءَتْهُ وَهُوَ يَتَوَضَّأُ فَقَالَتْ إِنِّي أُحِبُّ أَنْ تَطِيبَ نَفْسِي بِتَطْلِيقَةٍ فَفَعَلَ وَهِيَ حَامِلٌ فَذَهَبَ إِلَى الْمَسْجِدِ فَجَاءَ وَقَدْ وَضَعَتْ مَا فِي بَطْنِهَا فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ لَهُ مَا صَنَعَ فَقَالَ بَلَغَ الْكِتَابُ أَجَلَهُ فَاخْطُبْهَا إِلَى نَفْسِهَا فَقَالَ خَدَعَتْنِي خَدَعَهَا اللهُ وَرُوِيَ ذَلِكَ عَنْ أَبِي الْمَلِيحِ الرَّقِّيِّ عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي الْقَاسِمِ عَنْ أُمِّ كُلْثُومٍ وَرُوِيَ فِي مَعْنَاهُ مِنْ وَجْهٍ آخَرَ عَنْ عَائِشَةَ ؓ
47.12 [Machine] The woman miscarries
٤٧۔١٢ بَابُ الْمَرْأَةِ تَضَعُ سِقْطًا
Messenger of Allah ﷺ the true and truly inspired, narrated to us, "The creation of everyone of you starts with the process of collecting the material for his body within forty days and forty nights in the womb of his mother. Then he becomes a clot of thick blood for a similar period (40 days) and then he becomes like a piece of flesh for a similar period. Then an angel is sent to him (by Allah) and the angel is allowed (ordered) to write four things; his livelihood, his (date of) death, his deeds, and whether he will be a wretched one or a blessed one (in the Hereafter) and then the soul is breathed into him. So one of you may do (good) deeds characteristic of the people of Paradise so much that there is nothing except a cubit between him and Paradise but then what has been written for him decides his behavior and he starts doing (evil) deeds characteristic of the people of Hell (Fire) and (ultimately) enters Hell (Fire); and one of you may do (evil) deeds characteristic of the people of Hell (Fire) so much so that there is nothing except a cubit between him and Hell (Fire), then what has been written for him decides his behavior and he starts doing (good) deeds characteristic of the people of Paradise and ultimately) enters Paradise." أَنَّهُ قَالَ قَالَ رَسُولُ اللهِ ﷺ وَهُوَ الصَّادِقُ الْمَصْدُوقُ إِنَّ أَحَدَكُمْ يُجْمَعُ خَلْقُهُ فِي بَطْنِ أُمِّهِ أَرْبَعِينَ يَوْمًا ثُمَّ تَكُونُ عَلَقَةً مِثْلَ ذَلِكَ ثُمَّ تَكُونُ مُضْغَةً مِثْلَ ذَلِكَ ثُمَّ يَبْعَثُ اللهُ الْمَلَكَ فَيَنْفُخُ فِيهِ الرُّوحَ ثُمَّ يُؤْمَرُ بِأَرْبَعِ كَلِمَاتٍ كَتْبِ رِزْقِهِ وَعَمَلِهِ وَأَجَلِهِ وَشَقِيٍّ هُوَ أَمْ سَعِيدٍ فَوَالَّذِي لَا إِلَهَ غَيْرُهُ إِنَّ أَحَدَكُمْ لَيَعْمَلُ بِعَمَلِ أَهْلِ النَّارِ حَتَّى مَا يَكُونُ بَيْنَهُ وَبَيْنَهَا إِلَّا ذِرَاعٌ فَيَسْبِقُ عَلَيْهِ الْكِتَابُ فَيُخْتَمُ لَهُ بِعَمَلِ أَهْلِ الْجَنَّةِ فَيَدْخُلُهَا وَإِنَّ أَحَدَكُمْ لَيَعْمَلُ بِعَمَلِ أَهْلِ الْجَنَّةِ حَتَّى مَا يَكُونُ بَيْنَهُ وَبَيْنَهَا إِلَّا ذِرَاعٌ فَيَسْبِقُ عَلَيْهِ الْكِتَابُ فَيُخْتَمُ لَهُ بِعَمَلِ أَهْلِ النَّارِ فَيَدْخُلُهَا
The Prophet ﷺ said, "Allah puts an angel in charge of the uterus and the angel says, 'O Lord, (it is) semen! O Lord, (it is now ) a clot! O Lord, (it is now) a piece of flesh.' And then, if Allah wishes to complete its creation, the angel asks, 'O Lord, (will it be) a male or a female? A wretched (an evil doer) or a blessed (doer of good)? How much will his provisions be? What will his age be?' So all that is written while the creature is still in the mother's womb." (Using translation from Bukhārī 6595)
قَالَ رَسُولُ اللهِ ﷺ إِنَّ اللهَ وَكَّلَ بِالرَّحِمِ مَلَكًا يَقُولُ أَيْ رَبِّ نُطْفَةٌ أَيْ رَبِّ عَلَقَةٌ أَيْ رَبِّ مُضْغَةٌ فَإِذَا أَرَادَ اللهُ أَنْ يَقْضِيَ خَلْقَهَا قَالَ يَا رَبِّ أَذَكَرٌ أَمْ أُنْثَى أَشَقِيٌّ أَمْ سَعِيدٌ فَمَا الرِّزْقُ فَمَا الْأَجَلُ فَيُكْتَبُ كَذَلِكَ فِي بَطْنِ أُمِّهِ
[Machine] The Prophet ﷺ said, "The angel is entrusted with the sperm after it settles in the womb for forty days or forty-five nights. Then he asks, 'O Lord, will it be miserable or happy?' And Allah replies, 'It will be written.' Then he asks, 'O Lord, will it be a male or a female?' And Allah replies, 'It will be written.' Then its deeds, lifespan, provisions, and influence are recorded. After that, the sheets are raised and nothing is added or subtracted from it."
النَّبِيَّ ﷺ قَالَ يُوَكَّلُ الْمَلَكُ عَلَى النُّطْفَةِ بَعْدَ مَا تَسْتَقِرُّ فِي الرَّحِمِ أَرْبَعِينَ يَوْمًا أَوْ خَمْسًا وَأَرْبَعِينَ لَيْلَةً فَيَقُولُ أَيْ رَبِّ مَاذَا أَشَقِيٌّ أَوْ سَعِيدٌ؟ فَيَقُولُ اللهُ ﷻ فَيُكْتَبَانِ ثُمَّ يَقُولُ أَيْ رَبِّ ذَكَرٌ أَمْ أُنْثَى؟ فَيَقُولُ اللهُ ﷻ فَيُكْتَبَانِ فَيُكْتَبُ عَمَلُهُ وَأَجَلُهُ وَرِزْقُهُ وَأَثَرُهُ ثُمَّ تُرْفَعُ الصُّحُفُ فَلَا يُزَادُ فِيهَا وَلَا يُنْقَصُ
Evil one is he who is evil in the womb of his mother and the good one is he who takes a lesson from the (fate of) others. The narrator came to a person from amongst the Companions of Messenger of Allah ﷺ who was called Hudhaifa b. Usaid Ghifari and said: How can a person be an evil one without (committing an evil) deed? Thereupon the person said to him: You are surprised at this, whereas I have heard Messenger of Allah ﷺ as saying: When forty-two nights pass after the semen gets into the womb, Allah sends the angel and gives him shape. Then he creates his sense of hearing, sense of sight, his skin, his flesh, his bones, and then says: My Lord, would he be male or female? And your Lord decides as He desires and the angel then puts down that also and then says: My Lord, what about his age? And your Lord decides as He likes it and the angel puts it down. Then he says: My Lord, what about his livelihood? And then the Lord decides as He likes and the angel writes it down, and then the angel gets out with his scroll of destiny in his hand and nothing is added to it and nothing is subtracted from it. أَنَّهُ سَمِعَ عَبْدَ اللهِ بْنَ مَسْعُودٍ يَقُولُ الشَّقِيُّ مَنْ شَقِيَ فِي بَطْنِ أُمِّهِ وَالسَّعِيدُ مَنْ وُعِظَ بِغَيْرِهِ فَأَتَى رَجُلٌ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ يُقَالُ لَهُ حُذَيْفَةُ بْنُ أَسِيدٍ الْغِفَارِيُّ فَحَدَّثَهُ بِذَلِكَ مِنْ قَوْلِ ابْنِ مَسْعُودٍ وَقَالَ كَيْفَ يَشْقَى رَجُلٌ يُغَيَّرُ عَمَلُهُ فَقَالَ لَهُ الرَّجُلُ أَتَعْجَبُ مِنْ ذَلِكَ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا مَرَّ بِالنُّطْفَةِ ثِنْتَانِ وَأَرْبَعُونَ لَيْلَةً بَعَثَ اللهُ إِلَيْهَا مَلَكًا فَصَوَّرَهَا وَخَلَقَ سَمْعَهَا وَبَصَرَهَا وَجِلْدَهَا وَلَحْمَهَا وَعَظْمَهَا ثُمَّ قَالَ يَا رَبِّ أَذَكَرٌ أَمْ أُنْثَى فَيَقْضِي رَبُّكَ مَا شَاءَ اللهُ وَيَكْتُبُ الْمَلَكُ فَيَقُولُ أَيْ رَبِّ أَجَلُهُ فَيَقُولُ رَبُّكَ مَا شَاءَ وَيَكْتُبُ الْمَلَكُ فَيَقُولُ أَيْ رَبِّ رِزْقُهُ فَيَقْضِي رَبُّكَ مَا شَاءَ وَيَكْتُبُ ثُمَّ يَخْرُجُ بِالصَّحِيفَةِ فِي يَدِهِ فَلَا يَزِيدُ عَلَى أَمْرِهِ وَلَا يَنْقُصُ

47.13 [Machine] Menstruation and Pregnancy
٤٧۔١٣ بَابُ الْحَيْضِ عَلَى الْحَمْلِ
[Machine] That a woman's husband died and a man proposed to her until she married him. She stayed with him for four and a half months, then she gave birth. Her affair became known to Umar ibn al-Khattab. He sent for the woman and asked her, and she said, "By Allah, he is his son." Umar asked about the woman, and he was only informed good things about her. Then he sent for the women of the pre-Islamic era and gathered them. He asked them about her affair and her reputation. One of them said, "Does she have her menstruation?" She said, "Yes." She asked, "When was your last contact with your husband?" She said, "Before he died." She said, "I will inform you of news about this woman. She became pregnant from her husband and she used to miscarry on him. But when she got married, and her husband's semen reached her, she became well and active, and at that time the bleeding ceased from her. When she gave birth, she completed six months." The women said, "You spoke the truth about her." Umar then separated between them.
أَنَّ امْرَأَةً تُوُفِّيَ زَوْجُهَا فَعَرَّضَ لَهَا رَجُلٌ بِالْخِطْبَةِ حَتَّى إِذَا حَلَّتْ تَزَوَّجَهَا فَلَبِثَتْ أَرْبَعَةَ أَشْهُرٍ وَنِصْفًا ثُمَّ وَلَدَتْ فَبَلَغَ شَأْنُهَا عُمَرَ بْنَ الْخَطَّابِ ؓ فَأَرْسَلَ إِلَى الْمَرْأَةِ فَسَأَلَهَا فَقَالَتْ هُوَ وَاللهِ وَلَدُهُ فَسَأَلَ عُمَرُ عَنِ الْمَرْأَةِ فَلَمْ يُخْبِرْ عَنْهَا إِلَّا خَيْرًا ثُمَّ إِنَّهُ أَرْسَلَ إِلَى نِسَاءِ الْجَاهِلِيَّةِ فَجَمَعَهُنَّ ثُمَّ سَأَلَهُنَّ عَنْ شَأْنِهَا وَخَبَرِهَا فَقَالَتِ امْرَأَةٌ مِنْهُنَّ لَهَا هَلْ كُنْتِ تَحِيضِينَ؟ قَالَتْ نَعَمْ قَالَتْ مَتَى عَهْدُكِ بِزَوْجِكِ؟ قَالَتْ قَبْلَ أَنْ يَمُوتَ قَالَتْ أَنَا أُخْبِرُكَ خَبَرَ هَذِهِ الْمَرْأَةِ حَمَلَتْ مِنْ زَوْجِهَا وَكَانَتْ تُهَرَاقُ عَلَيْهِ فَحَشَّ وَلَدَهَا عَلَى الْهَرَاقَةِ حَتَّى إِذَا تَزَوَّجَتْ وَأَصَابَهُ الْمَاءُ مِنْ زَوْجِهَا انْتَعَشَ وَتَحَرَّكَ عِنْدَ ذَلِكَ فَانْقَطَعَ عَنْهَا الدَّمُ فَهِيَ حِينَ وَلَدَتْ وَلَدَتْهُ لِتَمَامِ سِتَّةِ أَشْهُرٍ قَالَتِ النِّسَاءُ صَدَقْتِ هَذَا شَأْنُهَا فَفَرَّقَ عُمَرُ ؓ بَيْنَهُمَا
[Machine] I was sitting spinning thread, and the Prophet (PBUH) was sewing his sandal, so his forehead began to sweat, and his sweat gave birth to light. I became amazed and looked at the Messenger of Allah (PBUH), and he said, "What is wrong, O Aisha? Are you amazed?" I said, "Your forehead is sweating and your sweat is giving birth to light, and if Abu Kabir Al-Huthaly saw you, he would know that you are more deserving of his poetry." He said, "And what does Abu Kabir say?" I said, "He says, '[The Perfect Sea] is immune from all impurity, not affected by menstruation, breastfeeding, or any illness causing impurity. When you look at the radiance of his face, it shines like the glittering lightning." She said, "So the Prophet (PBUH) stood up and kissed between my eyes and said, 'May Allah reward you, O Aisha, with the best of what delighted me from you.' And in this is an evidence that pregnancy can occur during the menstrual period, and the Prophet (PBUH) did not deny it."
كُنْتُ قَاعِدَةً أَغْزِلُ وَالنَّبِيُّ ﷺ يَخْصِفُ نَعْلَهُ فَجَعَلَ جَبِينُهُ يَعْرَقُ وَجَعَلَ عَرَقُهُ يَتَوَلَّدُ نُورًا فَبُهِتُّ فَنَظَرَ إِلِيَّ رَسُولُ اللهِ ﷺ فَقَالَ مَالَكِ يَا عَائِشَةُ بُهِتِّ؟ قُلْتُ جَعَلَ جَبِينُكَ يَعْرَقُ وَجَعَلَ عَرَقُكَ يَتَوَلَّدُ نُورًا وَلَوْ رَآكَ أَبُو كَبِيرٍ الْهُذَلِيُّ لَعَلِمَ أَنَّكَ أَحَقُّ بِشِعْرِهِ قَالَ وَمَا يَقُولُ أَبُو كَبِيرٍ؟ قَالَتْ قُلْتُ يَقُولُ [البحر الكامل] وَمُبَرَّأٌ مِنْ كُلِّ غَيْرِ حَيْضَةٍ وَفَسَادِ مُرْضِعَةٍ وَدَاءٍ مُغَيِّلِ فَإِذَا نَظَرْتَ إِلَى أَسِرَّةِ وَجْهِهِ بَرَقَتْ كَبَرْقِ الْعَارِضِ الْمُتَهَلِّلِ قَالَتْ فَقَامَ إِلِيَّ النَّبِيُّ ﷺ وَقَبَّلَ بَيْنَ عَيْنِيَّ وَقَالَ جَزَاكِ اللهُ يَا عَائِشَةُ عَنِّي خَيْرًا مَا سُرِرْتِ مِنِّي كَسُرُورِي مِنْكِ فَفِي هَذَا دَلَالَةٌ عَلَى أَنَّ ابْتِدَاءَ الْحَمْلِ قَدْ يَكُونُ فِي حَالِ الْحَيْضِ وَالنَّبِيُّ ﷺ لَمْ يُنْكِرْ
[Machine] About Aisha, the wife of the Prophet, ﷺ , she was asked about a pregnant woman who sees blood, does she pray? She said, no, until the blood goes away from her.
عَنْ عَائِشَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّهَا سُئِلَتْ عَنِ الْحَامِلِ تَرَى الدَّمَ أَتُصَلِّي؟ قَالَتْ لَا حَتَّى يَذْهَبَ عَنْهَا الدَّمُ
