٤٧۔ كِتَابُ الْعِدَدِ
[Machine] In the mother of the child, her master dies who abuses her with menstruation.
فِي أُمِّ الْوَلَدِ يُتَوَفَّى عَنْهَا سَيِّدُهَا تَعْتَدُّ بِحَيْضَةٍ
[Machine] The passage translates to: "The waiting period for the mother of the child is one menstrual cycle."
عِدَّةُ أُمِّ الْوَلَدِ بِحَيْضَةٍ
[Machine] He used to say that when the mother of a child passes away, her master's obligation (to her) is the waiting period (Iddah). Malik said, may Allah have mercy on him, and that is the matter according to us.
أَنَّهُ كَانَ يَقُولُ عِدَّةُ أُمِّ الْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا حَيْضَةٌ قَالَ مَالِكٌ رَحِمَهُ اللهُ وَذَلِكَ الْأَمْرُ عِنْدَنَا
[Machine] About the jurists from the people of Madinah, they used to say that the number of a slave woman's children is emancipated by her master or her menstruation ends from her.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ عِدَّةُ أُمِّ الْوَلَدِ يُعْتِقُهَا سَيِّدُهَا أَوْ يُتَوَفَّى عَنْهَا حَيْضَةٌ
[Machine] "Do not impose on us the tradition of our Prophet, ﷺ , whose waiting period is four months and ten days. In another narration, it was mentioned that the waiting period for the mother of the child is four months and ten days. Abu Bakr ibn al-Harith al-Faqih informed us that Abu al-Hasan al-Daraqutni al-Hafiz said: Qabisa did not hear from Amr. And the correct statement is: Do not impose on us our suspended religion."
لَا تُلْبِسُوا عَلَيْنَا سُنَّةَ نَبِيِّنَا ﷺ عِدَّتُهَا عِدَّةُ الْمُتَوَفَّى عَنْهَا زَوْجُهَا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا وَفِي رِوَايَةِ يَزِيدَ عِدَّةُ أُمِّ الْوَلَدِ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا وَأَخْبَرَنَا أَبُو بَكْرِ بْنُ الْحَارِثِ الْفَقِيهُ قَالَ قَالَ أَبُو الْحَسَنِ الدَّارَقُطْنِيُّ الْحَافِظُ قَبِيصَةُ لَمْ يَسْمَعْ مِنْ عَمْرٍو وَالصَّوَابُ لَا تُلْبِسُوا عَلَيْنَا دِينَنَا مَوْقُوفٌ
أَبِي هَذَا حَدِيثٌ مُنْكَرٌ
[Machine] The 'iddah of the mother of the child is the 'iddah of the free woman.
عِدَّةُ أُمِّ الْوَلَدِ عِدَّةُ الْحُرَّةِ
[Machine] The waiting period of a woman after the death of her husband is four months and ten days, and if she is divorced, her waiting period is three menstrual cycles. Abu Abdur-Rahman As-Sulami and Abu Bakr bin Al-Harith have informed us about this. They said: I am Ali bin Umar Al-Hafidh, narrated by Muhammad bin Al-Hasan bin Ali Al-Yaqtini, narrated by Al-Husain bin Abdullah bin Yazid Al-Qattan, narrated by Abbas bin Al-Walid Al-Khallal Ad-Dimashqi, narrated by Zaid bin Yahya bin Ubaid, narrated by Abu Ma'bad. He mentioned it and said: Ali is the one speaking and he is correct, and it is a Mursal (a narration in which the Companion is skipped) because Qabisa did not hear it from Amr.
عِدَّةُ أُمِّ الْوَلَدِ إِذَا تُوُفِّيَ عَنْهَا سَيِّدُهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا وَإِذَا أُعْتِقَتْ فَعِدَّتُهَا ثَلَاثُ حِيَضٍ أَخْبَرَنَاهُ أَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ وَأَبُو بَكْرِ بْنُ الْحَارِثِ قَالَا أنا عَلِيُّ بْنُ عُمَرَ الْحَافِظُ نا مُحَمَّدُ بْنُ الْحَسَنِ بْنِ عَلِيٍّ الْيَقْطِينِيُّ نا الْحُسَيْنُ بْنُ عَبْدِ اللهِ بْنِ يَزِيدَ الْقَطَّانُ نا عَبَّاسُ بْنُ الْوَلِيدِ الْخَلَّالُ الدِّمَشْقِيُّ نا زَيْدُ بْنُ يَحْيَى بْنِ عُبَيْدٍ نا أَبُو مَعْبَدٍ فَذَكَرَهُ قَالَ عَلِيٌّ مَوْقُوفٌ وَهُوَ الصَّوَابُ وَهُوَ مُرْسَلٌ لِأَنَّ قَبِيصَةَ لَمْ يَسْمَعْ مِنْ عَمْرٍو
[Machine] That Maryam observed three menstruations after the Prophet ﷺ , meaning Umm Ibrahim, and this is weakly reported by Suwaid ibn Abd al-Aziz. The narration of the majority is attributed to Ata, and it is preferred over the other narration.
أَنَّ مَارِيَةَ اعْتَدَّتْ بِثَلَاثِ حِيَضٍ بَعْدَ النَّبِيِّ ﷺ يَعْنِي أُمَّ إِبْرَاهِيمَ وَهَذَا مُنْقَطِعٌ وَسُوَيْدُ بْنُ عَبْدِ الْعَزِيزِ ضَعِيفٌ وَرِوَايَةُ الْجَمَاعَةِ عَنْ عَطَاءٍ مُذْهَبَةٌ دُونَ الرِّوَايَةِ
[Machine] A man said, "Indeed, Uthman used to say three qualities: Uthman is the best among us, the most knowledgeable among us, and concerning this chain of narration, there is a weakness."
رَجُلٌ إِنَّ عُثْمَانَ ؓ كَانَ يَقُولُ ثَلَاثَةُ قُرُوءٍ فَقَالَ عُثْمَانُ ؓ خَيْرُنَا وَأَعْلَمُنَا وَفِي هَذَا الْإِسْنَادِ ضَعْفٌ
[Machine] About Ali, with the people of knowledge in Hadith, weak Hadith are said to be unreliable and feeble.
عَنْ عَلِيٍّ ؓ عِنْدَ أَهْلِ الْعِلْمِ بِالْحَدِيثِ غَيْرُ قَوِيَّةٍ يَقُولُونَ وَهِيَ مَحِيفَةٌ
