47. Chapter
٤٧۔ كِتَابُ الْعِدَدِ
[Machine] In His saying, exalted be He, "Except in the case of an evident immorality" [Quran 4:19], Allah says, "If they both [the husband and wife] desire reconciliation, Allah will cause it between them. Indeed, Allah is ever Knowing and Acquainted [with all things]."
فِي قَوْلِهِ تَعَالَى {إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ} [النساء 19] قَالَ إِنْ تَبْذُو عَلَى أَهْلِهَا فَإِذَا بَذَتْ عَلَيْهِمْ فَقَدْ حَلَّ لَهُمْ إِخْرَاجُهَا
[Machine] "Do not drive them out of their homes, nor shall they leave, unless they commit a clear act of indecency." (Surah At-Talaq, 1)
Ibn Abbas said, "The clear act of indecency means that a woman commits adultery with the husband of another woman and harms them." Ash-Shafi'i, may Allah have mercy on him, said, "It is the Sunnah of the Messenger of Allah ﷺ in the Hadith of Fatimah bint Qays, which indicates that the interpretation of Ibn Abbas in the saying of Allah (except when they commit a clear act of indecency)" (Surah An-Nisa, 19) is the offensive behavior towards the husband's family, as Allah wills."
{لَا تُخْرِجُوهُنَّ مِنْ بُيُوتِهِنَّ وَلَا يَخْرُجْنَ إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ} [الطلاق 1] فَقَالَ ابْنُ عَبَّاسٍ ؓ الْفَاحِشَةُ الْمُبَيِّنَةُ أَنْ تَفْحَشَ الْمَرْأَةُ عَلَى أَهْلِ الرَّجُلِ وَتُؤْذِيَهُمْ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ سُنَّةُ رَسُولِ اللهِ ﷺ فِي حَدِيثِ فَاطِمَةَ بِنْتِ قَيْسٍ تَدُلُّ عَلَى أَنَّ مَا تَأَوَّلَ ابْنُ عَبَّاسٍ ؓ فِي قَوْلِ اللهِ ﷻ {إِلَّا أَنْ يَأْتِينَ بِفَاحِشَةٍ مُبَيِّنَةٍ} [النساء 19] هُوَ الْبَذَاءُ عَلَى أَهْلِ زَوْجِهَا كَمَا تَأَوَّلَ إِنْ شَاءَ اللهُ تَعَالَى
[Machine] And Allah knows that you are not responsible for anything. Then the Messenger of Allah ﷺ came and she mentioned that to him, so he said, "You are not obligated to spend on him." And he commanded her to reside in the house of Sharik's mother. Then he said, "That woman is a temptation for my companions, so reside with the son of Umm Makhtum, for he is a blind man and you will be safe there."
وَاللهِ مَا لَكِ عَلَيْنَا مِنْ شَيْءٍ فَجَاءَتْ رَسُولَ اللهِ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ لَيْسَ لَكِ عَلَيْهِ نَفَقَةٌ وَأَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ أُمِّ شَرِيكٍ ثُمَّ قَالَ تِلْكَ امْرَأَةٌ يَغْشَاهَا أَصْحَابِي فَاعْتَدِّي عِنْدَ ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ رَجُلٌ أَعْمَى تَضَعِينَ ثِيَابَكِ
Aisha objected to Fatimah daughter of Qays. Abu Dawud said: Salih b. Kaisan, Ibn Juraij, and Shu'aib b. Abi Hamzah -- all of them narrated on the authority of al-Zuhru in a similar way. Abu Dawud said: Shu'aibn b. Abi Hamzah the name of Abu Hamzah is Dinar. He is a client of Ziyad. (Using translation from Abū Dāʾūd 2289)
إِلَى رَسُولِ اللهِ ﷺ فِي خُرُوجِهَا مِنْ بَيْتِهَا فَأَمَرَهَا أَنْ تَنْتَقِلَ إِلَى ابْنِ أُمِّ مَكْتُومٍ الْأَعْمَى فَأَبَى مَرْوَانُ أَنْ يُصْدِقَ فَاطِمَةَ فِي خُرُوجِ الْمُطَلَّقَةِ مِنْ بَيْتِهَا وَقَالَ عُرْوَةُ إِنَّ عَائِشَةَ ؓ أَنْكَرَتْ ذَلِكَ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ

إِلَى رَسُولِ اللهِ ﷺ فَاسْتَفْتَتْهُ فِي خُرُوجِهَا مِنْ بَيْتِهَا فَأَمَرَهَا أَنْ تَنْتَقِلَ إِلَى ابْنِ أُمِّ مَكْتُومٍ الْأَعْمَى وَأَبَى مَرْوَانُ أَنْ يُصَدِّقَ حَدِيثَ فَاطِمَةَ فِي خُرُوجِ الْمُطَلَّقَةِ وَقَالَ عُرْوَةُ وَأَنْكَرَتْ عَائِشَةُ ؓ عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ
[Machine] "Don't you see that it is only Fulanah, daughter of Al-Hakam, who has been divorced by her husband and then went out? She said, 'What a terrible thing I have done.' I said, 'Don't you see what Fatimah, daughter of Qays, said?' She said, 'Indeed, there is no good for her in mentioning that.'"
ؓ أَلَا تَرَيْنَ إِلَّا فُلَانَةَ بِنْتَ الْحَكَمِ طُلِّقَتِ الْبَتَّةَ ثُمَّ خَرَجَتْ قَالَتْ بِئْسَ مَا صَنَعَتْ قُلْتُ أَلَا تَرَيْنَ إِلَى قَوْلِ فَاطِمَةَ بِنْتِ قَيْسٍ؟ قَالَتْ أَمَا إِنَّهُ لَا خَيْرَ لَهَا فِي ذِكْرِ ذَلِكَ
أَبِي كُرَيْبٍ
[Machine] You have been only evil, and your evil is only between these two evils.
كَانَ إِنَّمَا بِكِ الشَّرُّ فَحَسْبُكِ مَا بَيْنَ هَذَيْنِ مِنَ الشَّرِّ
[Machine] I said, "Did not the Messenger of Allah ﷺ command Fatimah bint Qays to reside in the house of Ibn Umm Maktum?" He said, "That was the woman who tempted the people by elongating her eyelashes with her tongue. So the Messenger of Allah ﷺ commanded her to reside in the house of Ibn Umm Maktum, who was a blind man." Ash-Shafi'i, may Allah have mercy on him, said, "A'ishah, Marwan, and Ibn Musayyib knew that Fatimah had reported that the Prophet ﷺ had commanded her to reside in the house of Ibn Umm Maktum, just as I have narrated. And they had a different understanding, believing that this was only for evil. Ibn Musayyib further clarifies her elongating her eyelashes, and Ibn Musayyib and others disapprove of her concealing the reason why the Messenger of Allah ﷺ commanded her to reside in a house other than that of her husband, out of fear that someone would hear it and think that it was permissible for a married woman to reside wherever she wished."
قُلْتُ أَلَيْسَ قَدْ أَمَرَ رَسُولُ اللهِ ﷺ فَاطِمَةَ بِنْتَ قَيْسٍ أَنْ تَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ؟ قَالَ تِلْكَ الْمَرْأَةُ الَّتِي فَتَنَتِ النَّاسَ إِنَّهَا اسْتَطَالَتْ عَلَى أَحْمَائِهَا بِلِسَانِهَا فَأَمَرَ رَسُولُ اللهِ ﷺ أَنْ تَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ وَكَانَ رَجُلًا مَكْفُوفَ الْبَصَرِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فَعَائِشَةُ وَمَرْوَانُ وَابْنُ الْمُسَيِّبِ يَعْرِفُونَ أَنَّ حَدِيثَ فَاطِمَةَ فِي أَنَّ النَّبِيَّ ﷺ أَمَرَهَا أَنْ تَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ كَمَا حَدَّثْتُ وَيَذْهَبُونَ إِلَى أَنَّ ذَلِكَ إِنَّمَا كَانَ لِلشَّرِّ وَيَزِيدُ ابْنُ الْمُسَيِّبِ تَبْيِينَ اسْتِطَالَتِهَا عَلَى أَحْمَائِهَا وَيَكْرَهُ لَهَا ابْنُ الْمُسَيِّبِ وَغَيْرُهُ أَنَّهَا كَتَمَتْ فِي حَدِيثِهَا السَّبَبَ الَّذِي بِهِ أَمَرَهَا رَسُولُ اللهِ ﷺ أَنْ تَعْتَدَّ فِي غَيْرِ بَيْتِ زَوْجِهَا خَوْفًا أَنْ يَسْمَعَ ذَلِكَ سَامِعٌ فَيَرَى أَنَّ لِلْمَبْتُوتَةِ أَنْ تَعْتَدَّ حَيْثُ شَاءَتْ
Sulaimah bin Yasar said about leaving the house by Fathimah “That was due to her bad manners.” (Using translation from Abū Dāʾūd 2294)
إِنَّمَا كَانَ ذَلِكَ مِنْ سُوءِ الْخُلُقِ
Aisha (Allah be pleased with her) severely objected to the tradition of Fatimah daughter of Qays. She said: Fatimah lived in a desolate house and she feared for her loneliness there. Hence the Messenger of Allah ﷺ accorded permission to her (to leave the place). (Using translation from Abū Dāʾūd 2292)
عَابَتْ ذَلِكَ عَائِشَةُ ؓ أَشَدَّ الْعَيْبِ يَعْنِي حَدِيثَ فَاطِمَةَ بِنْتِ قَيْسٍ وَقَالَتْ إِنَّ فَاطِمَةَ كَانَتْ فِي مَكَانٍ وَحْشٍ فَخِيفَ عَلَى نَاحِيَتِهَا فَلِذَلِكَ أَرْخَصَ لَهَا رَسُولُ اللهِ ﷺ
[Machine] I have said, O Messenger of Allah, my husband divorced me three times, and I am afraid that he will force himself upon me. He said, then instruct her and she should observe her 'Iddah (waiting period).
لَقَدْ قُلْتُ يَا رَسُولَ اللهِ زَوْجِي طَلَّقَنِي ثَلَاثًا فَأَخَافُ أَنْ يَقْتَحِمَ عَلَيَّ قَالَ فَأَمَرَهَا فَتَحَوَّلَتْ
