٤٧۔ كِتَابُ الْعِدَدِ
أُمَيَّةَ بْنِ بِسْطَامٍ
The Qur’anic verse “Those of you who die and leave widows should bequeath for their widows a year’s maintenance and residence was abrogated by the verse containing the laws of succession, as one-fourth or one-eighth share was prescribed for them (i.e., the widows). The waiting period for one year was also repealed as a period of four months ten days was prescribed for them. (Using translation from Abū Dāʾūd 2298)
جَعَلَ أَجَلَهَا أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا
[Machine] The passage is in Arabic and it talks about the financial obligations of a man towards his wife after his death and the inheritance rights of the wife. It also mentions the duration of waiting period for a woman after her husband's death. The passage refers to verses from the Quran, specifically Surah Al-Baqarah (2:234) and Surah An-Nisa (4:12).
كَانَ الرَّجُلُ إِذَا مَاتَ وَتَرَكَ امْرَأَتَهُ اعْتَدَّتِ السَّنَةَ فِي بَيْتِهِ يُنْفِقُ عَلَيْهَا مِنْ مَالِهِ ثُمَّ أَنْزَلَ اللهُ بَعْدَ ذَلِكَ {وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا} [البقرة 234] فَهَذِهِ عِدَّةُ الْمُتَوَفَّى عَنْهَا زَوْجُهَا إِلَّا أَنْ تَكُونَ حَامِلًا فَعِدَّتُهَا أَنْ تَضَعَ مَا فِي بَطْنِهَا وَقَالَ فِي مِيرَاثِهَا {وَلَهُنَّ الرُّبُعُ مِمَّا تَرَكْتُمْ إِنْ لَمْ يَكُنْ لَكُمْ وَلَدٌ فَإِنْ كَانَ لَكُمْ وَلَدٌ فَلَهُنَّ الثُّمُنُ} [النساء 12] فَبَيَّنَ اللهُ مِيرَاثَ الْمَرْأَةِ وَتَرَكَ الْوَصِيَّةَ وَالنَّفَقَةَ
[Machine] He stood up and delivered a sermon to the people here. Then he recited Surah Al-Baqarah to them and explained some of it to them. He reached this verse: "If you leave good behind, the will is for the parents and close relatives" [Al-Baqarah 180]. He said, "This verse has been abrogated." Then he continued reciting until he reached this verse: "And those who are taken in death among you and leave wives behind" [Al-Baqarah 234] until his statement: "Without seclusion" [Al-Baqarah 240]. And he said, "And this verse..."
قَامَ فَخَطَبَ النَّاسَ هَاهُنَا فَقَرَأَ عَلَيْهِمْ سُورَةَ الْبَقَرَةِ وَبَيَّنَ لَهُمْ مِنْهَا فَأَتَى عَلَى هَذِهِ الْآيَةِ {إِنْ تَرَكَ خَيْرًا الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالْأَقْرَبِينَ} [البقرة 180] فَقَالَ نُسِخَتْ هَذِهِ الْآيَةُ ثُمَّ قَرَأَ حَتَّى أَتَى عَلَى هَذِهِ الْآيَةِ {وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا} [البقرة 234] إِلَى قَوْلِهِ {غَيْرَ إِخْرَاجٍ} [البقرة 240] فَقَالَ وَهَذِهِ الْآيَةُ
A woman was bereaved of her husband and her relatives worried about her eyes (which were diseased). They came to Messenger of Allah ﷺ, and asked him to allow them to treat her eyes with kohl, but he said, "She should not apply kohl to her eyes. (In the Pre-Islamic period of Ignorance) a widowed woman among you would stay in the worst of her clothes (or the worst part of her house) and when a year had elapsed, if a dog passed by her, she would throw a globe of dung, Nay, (she cannot use kohl) till four months and ten days have elapsed." أَنَّ امْرَأَةً تُوُفِّيَ عَنْهَا زَوْجُهَا فَرَمَدَتْ فَخَشَوْا عَلَى عَيْنِهَا فَأَتَوَا النَّبِيَّ ﷺ فَاسْتَأْذَنُوهُ فِي الْكُحْلِ فَقَالَ لَهُمُ النَّبِيُّ ﷺ لَا تَكْتَحِلْ قَدْ كَانَتْ إِحْدَاكُنَّ تَمْكُثُ فِي شَرِّ أَحْلَاسِهَا أَوْ فِي شَرِّ أَبْنِيَتِهَا فَإِذَا كَانَ حَوْلٌ فَمَرَّ كَلْبٌ رَمَتْ بِبَعْرَةٍ فَلَا حَتَّى تَمْضِيَ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ
[Machine] The Prophet ﷺ came and she mentioned that her son-in-law had passed away and complained about her eye. She asked if she should put kohl on it. Messenger of Allah ﷺ said, "One of you used to throw the pebble at the head of the hoop, but it is only four months and ten days."
أَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ أَنَّ زَوْجَ ابْنَتِهَا تُوُفِّيَ وَاشْتَكَتْ عَيْنَهَا أَفَأَكْحُلُهَا؟ فَقَالَ رَسُولُ اللهِ ﷺ قَدْ كَانَتْ إِحْدَاكُنَّ تَرْمِي بِالْبَعْرَةِ عِنْدَ رَأْسِ الْحَوْلِ فَإِنَّمَا هِيَ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ
