47. Chapter
٤٧۔ كِتَابُ الْعِدَدِ
[Machine] In the woman who is missing, she does not get married.
فِي امْرَأَةِ الْمَفْقُودِ إِنَّهَا لَا تَتَزَوَّجُ
[Machine] Regarding the lost woman, when she is found and her husband has already married another woman, she is still considered his wife. He can either divorce her if he wishes or keep her, and he is not given a choice. This was narrated by Abu 'Ubaid from Hushaym from Sayyar from Sha'bi from Ali.
عَنْ عَلِيٍّ ؓ فِي امْرَأَةِ الْمَفْقُودِ إِذَا قَدِمَ وَقَدْ تَزَوَّجَتِ امْرَأَتُهُ هِيَ امْرَأَتُهُ إِنْ شَاءَ طَلَّقَ وَإِنْ شَاءَ أَمْسَكَ وَلَا تُخَيَّرُ وَرَوَاهُ أَبُو عُبَيْدٍ عَنْ هُشَيْمٍ عَنْ سَيَّارٍ عَنِ الشَّعْبِيِّ عَنْ عَلِيٍّ ؓ
[Machine] "Age in something that matters in a woman is the woman who is absent until she is certain of his death or divorce, and she has compensation for this from what he has permitted of her private parts, and their marriage is invalid. We have narrated from Sa'id bin Jubayr from Ali, who said: she is the first woman who was entered by the latter or was not entered by him, and this is the statement of Al-Nakha'i and Al-Hakam bin 'Utaybah and others."
عُمَرُ ؓ بِشَيْءٍ يَعْنِي فِي امْرَأَةِ الْمَفْقُودِ هِيَ امْرَأَةُ الْغَائِبِ حَتَّى يَأْتِيَهَا يَقِينُ مَوْتِهِ أَوْ طَلَاقُهَا وَلَهَا الصَّدَاقُ مِنْ هَذَا بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَنِكَاحُهُ بَاطِلٌ وَرُوِّينَا عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنْ عَلِيٍّ ؓ قَالَ هِيَ امْرَأَةُ الْأَوَّلِ دَخَلَ بِهَا الْآخَرُ أَوْ لَمْ يَدْخُلْ بِهَا وَهُوَ قَوْلُ النَّخَعِيِّ وَالْحَكَمِ بْنِ عُتَيْبَةَ وَغَيْرِهِمَا
[Machine] "And Abu Abdullah Al-Hafiz informed us, from Abu Al-Abbas Al-Asamm, from Al-Duri, he said: I heard Yahya bin Ma'een say: Abdurrahman bin Mahdi narrated to us, from Mansour bin Saad, from Ibn Shubruma, he said: Umar bin Abdul Aziz, may Allah have mercy on him, wrote about a missing woman who is to be blamed and patient, and a hadeeth with a connected chain of narrators was narrated in it, from whom his hadeeth is not to be relied upon."
وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ نا أَبُو الْعَبَّاسِ هُوَ الْأَصَمُّ نا الْعَبَّاسُ هُوَ الدُّورِيُّ قَالَ سَمِعْتُ يَحْيَى بْنَ مَعِينٍ قَالَ نا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ عَنْ مَنْصُورِ بْنِ سَعْدٍ عَنِ ابْنِ شُبْرُمَةَ قَالَ كَتَبَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ رَحِمَهُ اللهُ فِي امْرَأَةِ الْمَفْقُودِ تُلَوَّمُ وَتَصْبِرُ وَرُوِيَ فِيهِ حَدِيثٌ مُسْنَدٌ فِي إِسْنَادِهِ مَنْ لَا يُحْتَجُّ بِحَدِيثِهِ
[Machine] The Messenger of Allah ﷺ said, "The wife of the missing man is his wife until evidence comes to her (proving his death) and likewise."
قَالَ رَسُولُ اللهِ ﷺ امْرَأَةُ الْمَفْقُودِ امْرَأَتُهُ حَتَّى يَأْتِيَهَا الْبَيَانُ وَكَذَلِكَ
