[Machine] "Age in something that matters in a woman is the woman who is absent until she is certain of his death or divorce, and she has compensation for this from what he has permitted of her private parts, and their marriage is invalid. We have narrated from Sa'id bin Jubayr from Ali, who said: she is the first woman who was entered by the latter or was not entered by him, and this is the statement of Al-Nakha'i and Al-Hakam bin 'Utaybah and others."  

البيهقي:١٥٥٦٣أَخْبَرَنَا أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو نا أَبُو الْعَبَّاسِ الْأَصَمُّ ثنا الْحَسَنُ بْنُ عَلِيِّ بْنِ عَفَّانَ نا أَبُو أُسَامَةَ عَنْ زَائِدَةَ بْنِ قُدَامَةَ ثنا سِمَاكٌ عَنْ حَنَشٍ قَالَ قَالَ عَلِيٌّ ؓ لَيْسَ الَّذِي قَالَ

عُمَرُ ؓ بِشَيْءٍ يَعْنِي فِي امْرَأَةِ الْمَفْقُودِ هِيَ امْرَأَةُ الْغَائِبِ حَتَّى يَأْتِيَهَا يَقِينُ مَوْتِهِ أَوْ طَلَاقُهَا وَلَهَا الصَّدَاقُ مِنْ هَذَا بِمَا اسْتَحَلَّ مِنْ فَرْجِهَا وَنِكَاحُهُ بَاطِلٌ وَرُوِّينَا عَنْ سَعِيدِ بْنِ جُبَيْرٍ عَنْ عَلِيٍّ ؓ قَالَ هِيَ امْرَأَةُ الْأَوَّلِ دَخَلَ بِهَا الْآخَرُ أَوْ لَمْ يَدْخُلْ بِهَا وَهُوَ قَوْلُ النَّخَعِيِّ وَالْحَكَمِ بْنِ عُتَيْبَةَ وَغَيْرِهِمَا

"عَنْ حنشٍ قَالَ: قَالَ عَلِىٌّ: لَيْسَ الَّذِى قَالَ عُمرُ بشيءٍ (*) يَعْنِى فِى امْرَأَةِ الْمَفْقُودِ هِىَ امْرَأَةُ الْغَائِبِ حَتَّى يَأتِيَها يقين (* *) مَوْتِهِ أو طَلاقُهَا ولها الصَّداقُ مِنْ هُنَا بِمَا اِسْتَحَلَّ من فَرْجِها وَنِكِاحُها باطِلُ".
