47. Chapter
٤٧۔ كِتَابُ الْعِدَدِ
[Machine] "He said, 'A slave man may marry two women and divorce two times. A slave woman must observe two periods of menstruation. If she does not menstruate, then it will be two months or one month or half a month.' Sufyan said, and he was a reliable narrator."
أَنَّهُ قَالَ يَنْكِحُ الْعَبْدُ امْرَأَتَيْنِ وَيُطَلِّقُ تَطْلِيقَتَيْنِ وَتَعْتَدُّ الْأَمَةُ حَيْضَتَيْنِ فَإِنْ لَمْ تَكُنْ تَحِيضُ فَشَهْرَيْنِ أَوْ شَهْرًا أَوْ نِصْفًا قَالَ سُفْيَانُ وَكَانَ ثِقَةً
[Machine] The waiting period of a woman if she does not menstruate for two months, and if she menstruates twice. We have narrated from Al-Hasan from Ali that he said: "The waiting period of a woman is two menstrual cycles. If she does not menstruate, then it is one month and a half."
عِدَّةُ الْأَمَةِ إِذَا لَمْ تَحِضْ شَهْرَيْنِ وَإِذَا حَاضَتْ حَيْضَتَيْنِ وَرُوِّينَا عَنِ الْحَسَنِ عَنْ عَلِيٍّ ؓ قَالَ عِدَّةُ الْأَمَةِ حَيْضَتَانِ فَإِنْ لَمْ تَكُنْ تَحِيضُ فَشَهْرٌ وَنِصْفٌ
[Machine] A man, make it a month and a half, and Umar remained silent.
رَجُلٌ فَاجْعَلْهَا شَهْرًا وَنِصْفًا فَسَكَتَ عُمَرُ ؓ
فَسَكَتَ
[Machine] He used to say that the waiting period for a free woman is three menstrual periods and the waiting period for a slave woman is two menstrual periods. The scholar said, and it has been narrated by someone other than Ibn Umar, and it is not considered authentic.
أَنَّهُ كَانَ يَقُولُ عِدَّةُ الْحُرَّةِ ثَلَاثُ حِيَضٍ وَعِدَّةُ الْأَمَةِ حَيْضَتَانِ قَالَ الشَّيْخُ وَقَدْ رَفَعَهُ غَيْرُهُ عَنِ ابْنِ عُمَرَ ؓ وَلَيْسَ بِصَحِيحٍ
[Machine] The female slave shall be divorced twice and shall observe two menstrual cycles. 15457. Hatim reported to me from Musa bin Al-Sindiyy, from Dahhak bin Makhlad, from Ibn Jurayj, from Al-Muzahir, from Al-Qasim, from Aisha, who narrated from the Prophet ﷺ with a similar hadith. Dahhak said, "I met Al-Muzahir and asked him about Al-Qasim, who then narrated from Aisha about the Prophet ﷺ." The Sheikh, may Allah have mercy on him, said, "This is a hadith that is unique to Al-Muzahir bin Aslam, who is an unknown man known for this hadith. The authentic narration from Al-Qasim bin Muhammad is that he was asked about the waiting period of female slaves, to which he said, "People say it is two menstrual periods."
ﷺ تُطَلَّقُ الْأَمَةُ تَطْلِيقَتَيْنِ وَتَعْتَدُّ حَيْضَتَيْنِ 15457 قَالَ وَنا حَاتِمٌ نا مُوسَى بْنُ السِّنْدِيِّ نا الضَّحَّاكُ بْنُ مَخْلَدٍ نا ابْنُ جُرَيْجٍ نا الْمُظَاهِرُ نا الْقَاسِمُ عَنْ عَائِشَةَ ؓ عَنِ النَّبِيِّ ﷺ بِمِثْلِهِ قَالَ الضَّحَّاكُ فَلَقِيتُ الْمُظَاهِرَ فَسَأَلْتُهُ فَحَدَّثَنِي عَنِ الْقَاسِمِ عَنْ عَائِشَةَ ؓ عَنِ النَّبِيِّ ﷺ قَالَ الشَّيْخُ رَحِمَهُ اللهُ هَذَا حَدِيثٌ تَفَرَّدَ بِهِ مُظَاهِرُ بْنُ أَسْلَمَ وَهُوَ رَجُلٌ مَجْهُولٌ يُعْرَفُ بِهَذَا الْحَدِيثِ وَالصَّحِيحُ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ أَنَّهُ سُئِلَ عَنْ عِدَّةِ الْأَمَةِ فَقَالَ النَّاسُ يَقُولُونَ حَيْضَتَانِ
[Machine] About Sa'id ibn al-Musayyib, al-Hasan, and ash-Sha'bi, may Allah have mercy upon them, and Allah knows best.
