47. Chapter
٤٧۔ كِتَابُ الْعِدَدِ
[Machine] The man used to divorce his wife and then take her back. That is not the ultimate goal to be achieved. A man from the Ansar said to his wife, "By Allah, I will never shelter you again, nor will you be lawful for anyone else." She said, "How is that?" He said, "I will divorce you, and when your waiting period is near completion, I will take you back." She mentioned that to the Messenger of Allah ﷺ , complaining about it. So Allah revealed: The divorce is twice, after that either you retain her on reasonable terms or release her with kindness. Then the people accepted this from him as a Sunnah and acted accordingly. This has been narrated from the Prophet ﷺ in connection with the past and we have already transmitted it. It indicates that it used to be included in the 'Iddah of a second divorce. This is the view of Abu Ash-Sha'tha' and Tawus and 'Amr bin Dinar and others.
كَانَ الرَّجُلُ يُطَلِّقُ امْرَأَتَهُ ثُمَّ يُرَاجِعُهَا لَيْسَ لِذَلِكَ مُنْتَهًى يُنْتَهَى إِلَيْهِ فَقَالَ رَجُلٌ مِنَ الْأَنْصَارِ لِامْرَأَتِهِ وَاللهِ لَا آوِيكِ إِلِيَّ أَبَدًا وَلَا تَحِلِّينَ لِغَيْرِي قَالَ فَقَالَتْ كَيْفَ ذَاكَ؟ قَالَ أُطَلِّقُكِ فَإِذَا دَنَا أَجَلُكِ رَاجَعْتُكِ قَالَ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ تَشْكُو فَأَنْزَلَ اللهُ ﷻ الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ فَاسْتَقْبَلَهُ النَّاسُ جَدِيدًا مَنْ كَانَ طَلَّقَ وَمَنْ لَمْ يَكُنْ طَلَّقَ وَقَدْ رَوَيْنَا هَذَا فِيمَا مَضَى مَوْصُولًا وَفِيهِ كَالدَّلَالَةِ عَلَى أَنَّهَا كَانَتْ تَعْتَدُّ مِنَ الطَّلَاقِ الْآخَرِ عِدَّةً مُسْتَقْبِلَةً وَهَذَا قَوْلُ أَبِي الشَّعْثَاءِ وَطَاوُسٍ وَعَمْرِو بْنِ دِينَارٍ وَغَيْرِهِمْ
