٤٧۔ كِتَابُ الْعِدَدِ
[Machine] The Sheikh is the statement of Sa'id ibn Musayyib, Sulayman ibn Yasar, Al-Zuhri, Al-Sha'bi, and the group.
الشَّيْخُ وَهُوَ قَوْلُ سَعِيدِ بْنِ الْمُسَيِّبِ وَسُلَيْمَانَ بْنِ يَسَارٍ وَالزُّهْرِيِّ وَالشَّعْبِيِّ وَالْجَمَاعَةِ
[Machine] The Prophet ﷺ made a divorcee named Thabit ibn Qais count her menstrual cycles.
امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ ؓ اخْتَلَعَتْ مِنْهُ فَجَعَلَ النَّبِيُّ ﷺ عِدَّتَهَا حَيْضَةً فَكَذَا
[Machine] That a woman from the tribe of Thabit ibn Qays divorced her husband, so the Prophet ﷺ made her waiting period (iddah) to be menstruation. And it is narrated from two other weaker narrators that it is not permissible to argue using their evidence.
أَنَّ امْرَأَةَ ثَابِتِ بْنِ قَيْسٍ اخْتَلَعَتْ مِنْهُ فَجَعَلَ النَّبِيُّ ﷺ عِدَّتَهَا حَيْضَةً وَرُوِيَ ذَلِكَ مِنْ وَجْهَيْنِ آخَرَيْنِ ضَعِيفَيْنِ لَا يَجُوزُ الِاحْتِجَاجُ بِمِثْلِهِمَا
that she got a Khul during the time of the Prophet. So the Prophet ordered her - or: she was ordered - that she observe an Iddah of a menstruation." (Using translation from Tirmidhī 1185)
اخْتَلَعَتْ عَلَى عَهْدِ النَّبِيِّ ﷺ فَأَمَرَهَا النَّبِيُّ ﷺ أَوْ أُمِرَتْ أَنْ تَعْتَدَّ بِحَيْضَةٍ
[Machine] "To divorce her during her menstruation is more appropriate, and it is not against her commandment nor the tradition of the Prophet ﷺ . We have narrated in the book of divorce that she was divorced by her husband during the time of Uthman ibn Affan."
أَنْ تَعْتَدَّ بِحَيْضَةٍ هَذَا أَصَحُّ وَلَيْسَ فِيهِ مِنْ أَمْرِهَا وَلَا عَلَى عَهْدِ النَّبِيِّ ﷺ وَقَدْ رَوَيْنَا فِي كِتَابِ الْخُلْعِ أَنَّهَا اخْتَلَعَتْ مِنْ زَوْجِهَا زَمَنَ عُثْمَانَ بْنِ عَفَّانَ ؓ
[Machine] The daughter of Muawwidh has separated from her husband today. Does she need to observe iddah? Uthman said, "She should observe iddah and there is no waiting period for her as she is not married until she has her first menstruation." Abdullah Uthman said, "He is the eldest and the most knowledgeable among us. This narration indicates that Uthman is the one who ordered her to do so. The apparent rule in the book regarding divorced women includes those who have separated and others, so he is more deserving. With Allah is success, and Allah knows best."
إِنَّ ابْنَةَ مُعَوِّذٍ قَدِ اخْتَلَعَتْ مِنْ زَوْجِهَا الْيَوْمَ أَفَتَنْتَقِلُ؟ فَقَالَ عُثْمَانُ ؓ تَنْتَقِلُ وَلَيْسَ عَلَيْهَا عِدَّةٌ أَنَّهَا لَا تُنْكَحُ حَتَّى تَحِيضَ حَيْضَةً وَاحِدَةً فَقَالَ عَبْدُ اللهِ عُثْمَانُ أَكْبَرُنَا وَأَعْلَمُنَا فَهَذِهِ الرِّوَايَةُ تُصَرِّحُ بِأَنَّ عُثْمَانَ ؓ هُوَ الَّذِي أَمَرَهَا بِذَلِكَ وَظَاهِرُ الْكِتَابِ فِي عِدَّةِ الْمُطَلَّقَاتِ يَتَنَاوَلُ الْمُخْتَلِعَةَ وَغَيْرَهَا فَهُوَ أَوْلَى وَبِاللهِ التَّوْفِيقُ وَاللهُ أَعْلَمُ
