٤٧۔ كِتَابُ الْعِدَدِ
[Machine] After the death of her husband, Subay'a al-Aslamiyya became restless at night. She went to the Messenger of Allah ﷺ seeking permission to remarry. He granted her permission. In another narration by Ja'far, it is mentioned that the husband of Subay'a al-Aslamiyya passed away, and she did not wait for long before she passed away herself. When she reached the end of her postpartum period, she informed the Messenger of Allah ﷺ about it, and he granted her permission to remarry.
أَنَّ سُبَيْعَةَ الْأَسْلَمِيَّةَ نُفِسَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَجَاءَتْ رَسُولَ اللهِ ﷺ فَاسْتَأْذَنَتْهُ فِي أَنْ تُنْكَحَ فَأَذِنَ لَهَا وَفِي رِوَايَةِ جَعْفَرٍ قَالَ تُوُفِّيَ زَوْجُ سُبَيْعَةَ الْأَسْلَمِيَّةِ فَلَمْ تَمْكُثْ إِلَّا لَيَالِيَ يَسِيرَةً حَتَّى نُفِسَتْ فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللهِ ﷺ فَأَذِنَ لَهَا فِيهِ فَنَكَحَتْ
‘Ubaid Allah bin ‘Abd Allah bin ‘Utbah said that his father wrote (a letter) to ‘Abd Allaah bin Al Arqam Al Zuhri asking him to visit Subai’ah daughter of Al Harith Al Aslamiyyah and ask her about her story and what the Apostle of Allaah ﷺ said to her when she asked his opinion (about her). So, ‘Umar bin Abd allah wrote in reply to ‘Abd Allah bin ‘Utbah informing him what she told him. She told that she was under (i.e., the wife of) Sa’d bin Khawlah who belonged to Banu Amir bin Luwayy. He was one of those who participated in the battle of Badr. He died at the Farwell Pilgrimage while she was pregnant. Soon after his death she gave birth to a child. When she was purified from her bleeding after child birth she adorned herself for seekers in marriage. Then Abu Al Sanabil bin Ba’kah a man from Banu Abd Al Dar entered upon her and said to her “What is the matter seeing you adorned, perhaps you are seeking marriage? I swear by Allah you cannot marry until four months and ten days pass away. Saubai’ah said “When she said this to me, I gathered my clothes on me when the evening came and I came to the Apostle of Allaah ﷺ and asked him about that. He told me that I became lawful when I had delivered a child. He suggested me to marry if I wished. Ibn Shihab said “I do not see any harm if she marries when she gives birth to the child, even though she had the bleeding after the child birth, but her husband should not have sexual intercourse till she is purified. لَهَا رَسُولُ اللهِ ﷺ حِينَ اسْتَفْتَتْهُ فَكَتَبَ عُمَرُ بْنُ عَبْدِ اللهِ إِلَى عَبْدِ اللهِ بْنِ عُتْبَةَ يُخْبِرُهُ أَنَّ سُبَيْعَةَ أَخْبَرَتْهُ أَنَّهَا كَانَتْ تَحْتَ سَعْدِ بْنِ خَوْلَةَ ؓ وَهُوَ مِنْ بَنِي عَامِرِ بْنِ لُؤَيٍّ وَكَانَ مِمَّنْ شَهِدَ بَدْرًا وَتُوُفِّيَ عَنْهَا فِي حَجَّةِ الْوَدَاعِ وَهِيَ حَامِلٌ فَلَمْ تَنْشَبْ أَنْ وَضَعَتْ حَمْلَهَا بَعْدَ وَفَاتِهِ فَلَمَّا تَعَلَّتْ مِنْ نِفَاسِهَا تَجَمَّلَتْ لِلْخُطَّابِ فَدَخَلَ عَلَيْهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ رَجُلٌ مِنْ بَنِي عَبْدِ الدَّارِ فَقَالَ لَهَا مَالِي أَرَاكِ مُتَجَمِّلَةً لَعَلَّكِ تُرِيدِينَ النِّكَاحَ إِنَّكِ وَاللهِ مَا أَنْتِ بِنَاكِحٍ حَتَّى يَمُرَّ عَلَيْكِ أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ قَالَتْ سُبَيْعَةُ فَلَمَّا قَالَ لِي ذَلِكَ جَمَعْتُ ثِيَابِي حِينَ أَمْسَيْتُ فَأَتَيْتُ رَسُولَ اللهِ ﷺ فَسَأَلْتُهُ عَنْ ذَلِكَ فَأَفْتَانِي بِأَنِّي قَدْ حَلَلْتُ حِينَ وَضَعْتُ حَمْلِي فَأَمَرَنِي بِالتَّزْوِيجِ إِنْ بَدَا لِي زَادَ أَبُو عَمْرٍو فِي رِوَايَتِهِ قَالَ ابْنُ شِهَابٍ فَلَا أَرَى بَأْسًا أَنْ تَتَزَوَّجَ حِينَ وَضَعَتْ وَإِنْ كَانَتْ فِي دَمِهَا غَيْرَ أَنَّهُ لَا يَقْرَبُهَا زَوْجُهَا حَتَّى تَطْهُرَ لَفْظُ حَدِيثِ حَرْمَلَةَ
[Machine] "He wrote to the son of Al-Arqam, Sal Subay'a Al-Aslamiyya, asking how the Messenger of Allah ﷺ gave her a fatwa when her husband passed away. She said, he gave me the permission to get married after I gave birth."
أَنَّهُ كَتَبَ إِلَى ابْنِ الْأَرْقَمِ سَلْ سُبَيْعَةَ الْأَسْلَمِيَّةَ كَيْفَ كَانَ رَسُولُ اللهِ ﷺ أَفْتَاهَا حِينَ تُوُفِّيَ زَوْجُهَا؟ قَالَتْ أَفْتَانِي إِذَا وَضَعْتُ أَنْ أَنْكِحَ
[Machine] There is a narration from Subayah the daughter of Harith, who waited for four months and ten days after the death of her husband. She informed the Messenger of Allah ﷺ about this, and he said, "Abu As-Sanabil has lied, or he did not understand what Abu As-Sanabil said. You are now free to marry." This statement is mentioned in the narration of Ash-Shafi'i and the narration of Sa'dan, which is summarized. The Messenger of Allah ﷺ ordered Subayah to marry. This narration is Mursal, and what precedes it is sufficient in terms of connected chains of narration.
قَدْ تَصَنَّعْتِ لِلْأَزْوَاجِ إِنَّهَا أَرْبَعَةُ أَشْهُرٍ وَعَشْرٌ فَذَكَرَتْ ذَلِكَ سُبَيْعَةُ لِرَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ كَذَبَ أَبُو السَّنَابِلِ أَوْ لَيْسَ كَمَا قَالَ أَبُو السَّنَابِلِ قَدْ حَلَلْتِ فَتَزَوَّجِي هَذَا لَفْظُ حَدِيثِ الشَّافِعِيِّ وَحَدِيثُ سَعْدَانَ مُخْتَصَرٌ أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِشَهْرٍ أَوْ أَقَلَّ فَأَمَرَهَا رَسُولُ اللهِ ﷺ أَنْ تَنْكِحَ وَهَذِهِ الرِّوَايَةُ مُرْسَلَةٌ وَفِيمَا قَبْلَهَا مِنَ الْمَوْصُولَةِ كِفَايَةٌ
[Machine] Ibn Abbas and Abu Huraira had a conversation about a man who dies and after his death his wife remarries after a short period. I said, "If she remarries, then she has become halal (permissible)." Ibn Abbas said, "Her waiting period is the end of the two waiting periods." So they both reconsidered their opinions. Abu Huraira said, "I am with the opinion of my nephew, Abu Salama." They sent Kuraib, the servant of Ibn Abbas, to Umm Salama, and she said, "Indeed, Subay'a remarried after the death of her husband after forty nights, and a man from the Banu Abd ad-Dar clan proposed to her and informed us that she has become halal. She wanted to marry someone else, so Abu as-Sanabil said to her, 'Indeed, you are not halal.' So Subay'a mentioned this to the Messenger of Allah, and he ordered her to get married."
وَابْنُ عَبَّاسٍ وَأَبُو هُرَيْرَةَ فَتَذَاكَرْنَا الرَّجُلَ يَمُوتُ عَنِ الْمَرْأَةِ فَتَضَعُ بَعْدَ وَفَاتِهِ بِيَسِيرٍ فَقُلْتُ إِذَا وَضَعَتْ فَقَدْ حَلَّتْ وَقَالَ ابْنُ عَبَّاسٍ ؓ أَجَلُهَا آخِرُ الْأَجَلَيْنِ فَتَرَاجَعَا بِذَلِكَ فَقَالَ أَبُو هُرَيْرَةَ أَنَا مَعَ ابْنِ أَخِي يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى ابْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ ؓ فَقَالَتْ إِنَّ سُبَيْعَةَ وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِأَرْبَعِينَ لَيْلَةً وَأَنَّ رَجُلًا مِنْ بَنِي عَبْدِ الدَّارِ يُكَنَّى أَبَا السَّنَابِلِ خَطَبَهَا وَأَخْبَرَنَا أَنَّهَا قَدْ حَلَّتْ فَأَرَادَتْ أَنْ تَتَزَوَّجَ غَيْرَهُ فَقَالَ لَهَا أَبُو السَّنَابِلِ إِنَّكِ لَمْ تَحِلِّينَ فَذَكَرَتْ ذَلِكَ سُبَيْعَةُ لِرَسُولِ اللهِ ﷺ فَأَمَرَهَا أَنْ تُزَوَّجَ
[Machine] "From her mother, Umm Salamah, the wife of the Prophet ﷺ , it is narrated that there was a woman called Subay'ah who was under the guardianship of her husband. He passed away while she was pregnant, and Abu As-Sanabil ibn Ba'akkak proposed to her for marriage. She refused to marry him, so he said, 'By Allah, you will not get married until you have completed your waiting period.' She stayed close to twenty nights, then had a miscarriage. The Messenger of Allah ﷺ came to her and said, 'Get married.' So, Fatimah bint Qays narrated that the Messenger of Allah ﷺ ordered her to move to the house of Ibn Umm Maktum, who was blind, and that she should lay her clothes with him before her waiting period ended. Muhammad ibn Usamah ibn Zaid says, 'Whenever Fatimah is mentioned, Usamah ibn Zaid used to throw away whatever he had in his hand.'"
عَنْ أُمِّهَا أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ ﷺ أَنَّ امْرَأَةً يُقَالُ لَهَا سُبَيْعَةُ كَانَتْ تَحْتَ زَوْجِهَا فَتُوُفِّيَ عَنْهَا وَهِيَ حُبْلَى فَخَطَبَهَا أَبُو السَّنَابِلِ بْنُ بَعْكَكٍ فَأَبَتْ أَنْ تُنْكِحَ فَقَالَ وَاللهِ لَا يَصْلُحُ أَنْ تَنْكِحِي حَتَّى تَعْتَدِّي آخِرَ الْأَجَلَيْنِ فَمَكَثَتْ قَرِيبًا مِنْ عِشْرِينَ لَيْلَةً ثُمَّ نُفِسَتْ فَجَاءَتْ رَسُولَ اللهِ ﷺ فَقَالَ انْكِحِي فَكَانَتْ فَاطِمَةُ بِنْتُ قَيْسٍ تُحَدِّثُ عَنْ رَسُولِ اللهِ ﷺ حِينَ طُلِّقَتِ الْبَتَّةَ أَنَّهُ أَمَرَهَا أَنْ تَنْتَقِلَ إِلَى ابْنِ أُمِّ مَكْتُومٍ فَإِنَّهُ أَعْمَى تَضَعِينَ ثِيَابَكِ عِنْدَهُ قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا فَكَانَ مُحَمَّدُ بْنُ أُسَامَةَ بْنِ زَيْدٍ يَقُولُ كَانَ أُسَامَةُ بْنُ زَيْدٍ إِذَا ذَكَرَتْ فَاطِمَةُ شَيْئًا مِنْ ذَلِكَ رَمَاهَا بِمَا كَانَ فِي يَدِهِ
[Machine] Did you see if she has passed four months and ten [days] before she gives birth? We said, "Wait until she gives birth." He said, "Did you see if the four months and ten [days] have passed before she gives birth?" We said, "Wait until she gives birth." He said, "So he said, 'Do you make [the period of waiting] difficult for her and do not give her permission?' Then Surah An-Nisa Al-Qusra was revealed after At-Tulah [the long period], and the wives who are pregnant, their term is that they give birth."
أَرَأَيْتُمْ إِنْ وَضَعَتْ مِنْ قَبْلِ الْأَرْبَعَةِ الْأَشْهُرِ وَعَشْرٍ قُلْنَا حَتَّى تَمْضِيَ قَالَ أَرَأَيْتُمْ إِنْ مَضَتِ الْأَرْبَعَةُ الْأَشْهُرُ وَعَشْرٌ قَبْلَ أَنْ تَضَعَ قَالَ قُلْنَا حَتَّى تَضَعَ قَالَ فَقَالَ تَجْعَلُونَ عَلَيْهَا التَّغْلِيظَ وَلَا تَجْعَلُونَ لَهَا الرُّخْصَةَ لَنَزَلَتْ سُورَةُ النِّسَاءِ الْقُصْرَى بَعْدَ الطُّولَى وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ
[Machine] Abdullah said, "By Allah, whoever I wish harm, I will curse him. Surely, Surah An-Nisa Al-Qasira would be revealed after four months and ten days." And Muslim bin Abi Dhuh said, "Ali used to say, 'I am the last of the two [of us] to reach the hereafter.'"
قَالَ عَبْدُ اللهِ وَاللهِ مَنْ شَاءَ لَاعَنْتُهُ لَأُنْزِلَتْ سُورَةُ النِّسَاءِ الْقُصْرَى بَعْدَ أَرْبَعَةِ أَشْهُرٍ وَعَشْرًا وَعَنْ مُسْلِمٍ أَبِي الضُّحَى قَالَ كَانَ عَلِيٌّ ؓ يَقُولُ آخِرَ الْأَجَلَيْنِ
[Machine] That they (widows) should wait [for] their waiting period. But if you fear that they will not be able to maintain [the limits of] Allah, then there is no blame upon them for what he ransoms her thereby. These are the limits of Allah, so do not transgress them. And whoever transgresses the limits of Allah, it is those who are the wrongdoers.
And those who are taken in death among you and leave wives behind - they, [the wives, shall] wait four months and ten [days].
أَنْ يَضَعْنَ حَمْلَهُنَّ} [الطلاق 4] إِلَّا بَعْدَ آيَةِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا إِذَا وَضَعَتِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا فَقَدْ حَلَّتْ يُرِيدُ بِآيَةِ الْمُتَوَفَّى عَنْهَا زَوْجُهَا {وَالَّذِينَ يُتَوَفَّوْنَ مِنْكُمْ وَيَذَرُونَ أَزْوَاجًا يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا} [البقرة 234]
[Machine] If she gave birth and her husband is on the bed, the baby would not be buried. Allah knows best.
لَوْ وَلَدَتْ وَزَوْجُهَا عَلَى السَّرِيرِ لَمْ يُدْفَنْ لَحَلَّتْ وَاللهُ أَعْلَمُ
