[Machine] The Messenger of Allah ﷺ separated the child from its mother after she weaned him. This is mentioned in the narration of Malik, where Al-Shafi'i (may Allah have mercy on him) said: "It is possible for him to divorce her three times." This means that in the narration of Sahal, it is possible for him to divorce her based on what he finds in himself, based on his knowledge of her truthfulness, lies, and her daring to go against his prohibition. He divorced her three times without realizing that a curse is a form of separation, just as a divorce is a form of separation. It is also like someone who stipulates a condition in a sale or guarantee in a loan, which he is bound by whether he stipulates it or not. Ibn 'Umar narrated from the Prophet ﷺ that he separated between two parties who curse each other, and the separation of the Prophet ﷺ is different from a husband's divorce. It is only a separation of ruling. Al-Shaykh (may Allah have mercy on him) said: "And we have narrated in the narration of 'Abbad ibn Mansur from 'Ikrimah from Ibn 'Abbas (may Allah be pleased with them) in the story of Hilal ibn Umayah that the Messenger of Allah ﷺ decided that she should not be stoned, and her child should not be stoned. And whoever stones her or stones her child, he is to be subjected to the hadd punishment, and she is not entitled to maintenance or residence, because they are separated without divorce or death. And this narration confirms what al-Shafi’i said.”
وَانْتَفَى مِنْ وَلَدِهَا فَفَرَّقَ رَسُولُ اللهِ ﷺ بَيْنَهُمَا وَأَلْحَقَ الْوَلَدَ بِالْمَرْأَةِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ مَالِكٍ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ يُحْتَمَلُ طَلَاقُهُ ثَلَاثًا يَعْنِي فِي حَدِيثِ سَهْلٍ أَنْ يَكُونَ بِمَا وَجَدَ فِي نَفْسِهِ بِعِلْمِهِ بِصِدْقِهِ وَكَذِبِهَا وَجُرْأَتِهَا عَلَى النَّهْيِ فَطَلَّقَهَا ثَلَاثًا جَاهِلًا بِأَنَّ اللِّعَانَ فُرْقَةٌ فَكَانَ كَمَنْ طَلَّقَ مَنْ طَلَّقَ عَلَيْهِ بِغَيْرِ طَلَاقِهِ وَكَمَنْ شَرَطَ الْعُهْدَةَ فِي الْبَيْعِ وَالضَّمَانَ فِي السَّلَفِ وَهُوَ يَلْزَمُهُ شَرَطَ أَوْ لَمْ يَشْرِطْ قَالَ وَزَادَ ابْنُ عُمَرَ عَنِ النَّبِيِّ ﷺ أَنَّهُ فَرَّقَ بَيْنَ الْمُتَلَاعِنَيْنِ وَتَفْرِيقُ النَّبِيِّ ﷺ غَيْرُ فُرْقَةِ الزَّوْجِ إِنَّمَا هُوَ تَفْرِيقُ حُكْمٍ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَقَدْ رَوَيْنَا فِي حَدِيثِ عَبَّادِ بْنِ مَنْصُورٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ ؓ فِي قِصَّةِ هِلَالِ بْنِ أُمَيَّةَ قَالَ وَقَضَى رَسُولُ اللهِ ﷺ أَنْ لَا تُرْمَى وَلَا يُرْمَى وَلَدُهَا وَمَنْ رَمَاهَا أَوْ رَمَى وَلَدَهَا جُلِدَ الْحَدَّ وَلَيْسَ لَهَا عَلَيْهِ قُوتٌ وَلَا سُكْنَى؛ مِنْ أَجْلِ أَنَّهُمَا يَتَفَرَّقَانِ بِغَيْرِ طَلَاقٍ وَلَا مُتَوَفًّى عَنْهَا وَهَذِهِ الرِّوَايَةُ تُؤَكِّدُ مَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ تَعَالَى
