55. Prescribed Punishments (3/5)
٥٥۔ كِتَابُ الْحُدُودِ ص ٣
The Jews brought a man and a woman of them who had committed fornication. He said: Bring me two learned men or yours. So they brought the two sons of Suriya. He adjured them and said: How do you think about the matter if these two persons bear witness to the effect that they have seen his sexual organ in her female organ (penetrated) like a collyrium stick when enclosed in its case, they will be stoned to death. He asked: What is there which prevents you from stoning them: They replied : Our rule has gone, so we disapproved of killing. The Messenger of Allah ﷺ then called four witnesses. They brought four witnesses. Who testified that they had seen his sexual organ (penetrated) in her female organ like a collyrium stick when enclosed in its case. The Prophet ﷺ then gave orders for stoning them. (Using translation from Abū Dāʾūd 4452)
ائْتُونِي بِأَعْلَمِ رَجُلَيْنِ مِنْكُمْ فَأَتَوْهُ بِابْنَيْ صُورِيَا فَنَشَدَهُمَا كَيْفَ تَجِدَانِ أَمْرَ هَذَيْنِ فِي التَّوْرَاةِ؟ قَالَا نَجِدُ فِي التَّوْرَاةِ إِذَا شَهِدَ أَرْبَعَةٌ أَنَّهُمْ رَأَوْا ذَكَرَهُ فِي فَرْجِهَا مِثْلَ الْمِيلِ فِي الْمُكْحُلَةِ رُجِمَا قَالَ فَمَا يَمْنَعُكُمْ أَنْ تَرْجُمُوهُمَا؟ قَالَا ذَهَبَ سُلْطَانُنَا فَكَرِهْنَا الْقَتْلَ فَدَعَا رَسُولُ اللهِ ﷺ بِالشُّهُودِ فَجَاءُوا أَرْبَعَةً فَشَهِدُوا أَنَّهُمْ رَأَوْا ذَكَرَهُ فِي فَرْجِهَا مِثْلَ الْمِيلِ فِي الْمُكْحُلَةِ فَأَمَرَ النَّبِيُّ ﷺ بِرَجْمِهِمَا 17014 وَأَخْبَرَنَا أَبُو عَلِيٍّ أنبأ مُحَمَّدُ بْنُ بَكْرٍ ثنا أَبُو دَاوُدَ ثنا وَهْبُ بْنُ بَقِيَّةَ عَنْ هُشَيْمٍ عَنْ مُغِيرَةَ عَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ عَنِ النَّبِيِّ ﷺ نَحْوَهُ لَمْ يَذْكُرْ فَدَعَا بِالشُّهُودِ فَشَهِدُوا 17015 قَالَ وَحَدَّثَنَا وَهْبُ بْنُ بَقِيَّةَ عَنْ هُشَيْمٍ عَنِ ابْنِ شُبْرُمَةَ عَنِ الشَّعْبِيِّ بِنَحْوٍ مِنْهُ
[Machine] That he inserted his index finger into his left finger and he contracted it ten times.
أَنَّهُ وَجَعَلَ يُدْخِلُ أُصْبُعَهُ السَّبَّابَةَ فِي أُصْبُعِهِ الْيُسْرَى وَقَدْ عَقَدَهَا عَشْرًا
55.24 [Machine] What is forbidden in regards to homosexuality and bestiality with a consensus on their prohibition. Allah, may He be glorified, said: "And [mention] Lot, when he said to his people, 'Do you commit such immorality as no one has preceded you with from among the worlds? Indeed, you approach men with desire, instead of women. Rather, you are a transgressing people.'" [Surah Al-A'raf, 7:81] And He said regarding the descent of the punishment upon them: "So when Our command came, We made the highest part [of the city] its lowest and rained upon them stones of layered hard clay, [which were] marked from your Lord. And Allah's punishment is never far from the wrongdoers." [Surah Hud, 11:82]
٥٥۔٢٤ بَابُ مَا جَاءَ فِي تَحْرِيمِ اللُّوَاطِ وَإِتْيَانِ الْبَهِيمَةِ مَعَ الْإِجْمَاعِ عَلَى تَحْرِيمِهِمَا قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {وَلُوطًا إِذْ قَالَ لِقَوْمِهِ أَتَأْتُونَ الْفَاحِشَةَ مَا سَبَقَكُمْ بِهَا مِنْ أَحَدٍ مِنَ الْعَالَمِينَ، إِنَّكُمْ لَتَأْتُونَ الرِّجَالَ شَهْوَةً مِنْ دُونِ النِّسَاءِ، بَلْ أَنْتُمْ قَوْمٌ مُسْرِفُونَ} [الأعراف: 81]، وَقَالَ فِي نُزُولِ الْعَذَابِ بِهِمْ: {فَلَمَّا جَاءَ أَمْرُنَا جَعَلْنَا عَالِيَهَا سَافِلَهَا وَأَمْطَرْنَا عَلَيْهَا حِجَارَةً مِنْ سِجِّيلٍ مَنْضُودٍ مُسَوَّمَةً عِنْدَ رَبِّكَ، وَمَا هِيَ مِنَ الظَّالِمِينَ بِبَعِيدٍ} [هود: 82]
[Machine] The Prophet ﷺ said, "May Allah curse those who support others besides their loyal ones, and may Allah curse those who alter the boundaries of land, and may Allah curse those who deceive the blind from the right path, and may Allah curse those who curse their parents, and may Allah curse those who slaughter for other than Allah, and may Allah curse those who engage in sexual acts with animals, and may Allah curse those who commit the same acts as the people of Prophet Lot, and may Allah curse those who commit the same acts as the people of Prophet Lot, and may Allah curse those who commit the same acts as the people of Prophet Lot." And Abu Al-Hassan informed us, and Ahmad informed us, and Ubaid bin Shareek informed us, and Ibn Abi Maryam informed us, and Ibn Abi Zanad and Ibn Ad-Darawardi said, "Amro bin Abi Amro mentioned it to us with the same chain of narrators except that he said, 'May Allah curse those who support others besides their loyal ones, and may Allah curse those who deceive the blind from the path,' and he did not mention those who curse their parents."
أَنَّ النَّبِيَّ ﷺ قَالَ لَعَنَ اللهُ مَنْ تَوَلَّى غَيْرَ مَوَالِيهِ وَلَعَنَ اللهُ مَنْ غَيَّرَ تُخُومَ الْأَرْضِ وَلَعَنَ اللهُ مَنْ كَمِهَ أَعْمَى عَنِ السَّبِيلِ وَلَعَنَ اللهُ مَنْ لَعَنَ وَالِدَهُ وَلَعَنَ اللهُ مَنْ ذَبَحَ لِغَيْرِ اللهِ وَلَعَنَ اللهُ مَنْ وَقَعَ عَلَى بَهِيمَةٍ وَلَعَنَ اللهُ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ وَلَعَنَ اللهُ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ وَلَعَنَ اللهُ مَنْ عَمِلَ عَمَلَ قَوْمِ لُوطٍ 17018 وَأَخْبَرَنَا أَبُو الْحَسَنِ أنبأ أَحْمَدُ ثنا عُبَيْدُ بْنُ شَرِيكٍ ثنا ابْنُ أَبِي مَرْيَمَ ثنا ابْنُ أَبِي الزِّنَادِ وَابْنُ الدَّرَاوَرْدِيِّ قَالَا ثنا عَمْرُو بْنُ أَبِي عَمْرٍو فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ إِلَّا أَنَّهُ قَالَ مَنْ وَالَى غَيْرَ مَوَالِيهِ وَقَالَ مَنْ خَبَّبَ أَعْمَى عَنِ الطَّرِيقِ وَلَمْ يَذْكُرْ مَنْ لَعَنَ وَالِدَيْهِ
55.25 [Machine] What is mentioned in the limit of the Lut people.
٥٥۔٢٥ بَابُ مَا جَاءَ فِي حَدِّ اللُّوطِيِّ
The Prophet ﷺ said: If you find anyone doing as Lot's people did, kill the one who does it, and the one to whom it is done. Abu Dawud said: A similar tradition has also been transmitted by Sulaiman b. Bilal from 'Amr b. Abi 'Umar. And 'Abbad b. Mansur transmitted it from 'Ikrimah on the authority of Ibn 'Abbas who transmitted it from the Prophet ﷺ. It has also been transmitted by Ibn Juraij from Ibrahim from Dawud b. Al-Husain from 'Ikrimah on the authority of Ibn 'Abbas who transmitted it from the Prophet ﷺ. (Using translation from Abū Dāʾūd 4462)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ وَجَدْتُمُوهُ يَعْمَلُ عَمَلَ قَوْمِ لُوطٍ فَاقْتُلُوا الْفَاعِلَ وَالْمَفْعُولَ بِهِ
[Machine] About the Prophet ﷺ regarding the one who commits the actions of the people of Lot, and regarding the one who brings harm upon himself, and regarding the one who engages in forbidden sexual relations, and regarding the one who engages in bestiality, he said, "He should be killed."
عَنِ النَّبِيِّ ﷺ فِي الَّذِي يَعْمَلُ عَمَلَ قَوْمِ لُوطٍ وَفِي الَّذِي يُؤْتَى فِي نَفْسِهِ وَفِي الَّذِي يَقَعُ عَلَى ذَاتِ مَحْرَمٍ وَفِي الَّذِي يَأْتِي الْبَهِيمَةَ قَالَ يُقْتَلُ
[Machine] The Messenger of Allah ﷺ said, "Whoever commits the act of homosexuality, kill him; meaning the people of Lot."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ وَقَعَ عَلَى الرَّجُلِ فَاقْتُلُوهُ يَعْنِي قَوْمَ لُوطٍ
[Machine] That the Prophet ﷺ said, "Kill the doer and the one who it is done to", meaning the one who does the same act that the people of Lut did, and the one who has sexual relations with an animal. And the animal is described as reddish by Abu Ahmad ibn Addi in his narrative.
أَنَّ النَّبِيَّ ﷺ قَالَ اقْتُلُوا الْفَاعِلَ وَالْمَفْعُولَ بِهِ يَعْنِي الَّذِي يَعْمَلُ عَمَلَ قَوْمِ لُوطٍ وَالَّذِي يَأْتِي الْبَهِيمَةَ وَالْبَهِيمَةَ أَوْرَدَهُ أَبُو أَحْمَدَ بْنُ عَدِيٍّ فِيمَا
يُرْجَمُ
[Machine] The highest building in the village is being looked at and then it is thrown down dejectedly, followed by the stones.
يُنْظَرُ أَعْلَى بِنَاءٍ فِي الْقَرْيَةِ فَيُرْمَى بِهِ مُنَكَّسًا ثُمَّ يُتْبَعُ الْحِجَارَةَ
أَنَّ عَلِيًّا ؓ رَجَمَ لُوطِيًّا
أَنَّهُ شَهِدَ عَلِيًّا ؓ رَجَمَ لُوطِيًّا
عَنِ النَّبِيِّ ﷺ يَعْنِي مَا ذَكَرْنَاهُ
[Machine] A man was found in some Arab regions who was getting married like a woman getting married. Abu Bakr gathered the people from the companions of the Messenger of Allah ﷺ and asked them about this. The strongest in his statement at that time was Ali ibn Abi Talib, who said: "Indeed, this is a sin that no nation has committed before except one nation. Allah has done with it what you know. We see that we should burn him with fire." The opinion of the companions of the Messenger of Allah ﷺ was unanimous that he should be burned with fire. Abu Bakr wrote to Khalid bin al-Walid, ordering him to burn him with fire. This is a sent message, and it was narrated from another source that Ja'far bin Muhammad narrated from his father, from Ali, that in a different story, he said: "He should be stoned and burned with fire." And it is mentioned from Ibn Abi Layla from a man from Hamdan that Ali stoned a man who was married in the manner of the people of Lot. This is how al-Thawri mentioned it from him, specifying it to adultery, and "Hisheemun" (the word is incomplete).
وَجَدَ رَجُلًا فِي بَعْضِ نَوَاحِي الْعَرَبِ يُنْكَحُ كَمَا تُنْكَحُ الْمَرْأَةُ وَأَنَّ أَبَا بَكْرٍ ؓ جَمَعَ النَّاسَ مِنْ أَصْحَابِ رَسُولِ اللهِ ﷺ فَسَأَلَهُمْ عَنْ ذَلِكَ فَكَانَ مِنْ أَشَدِّهِمْ يَوْمَئِذٍ قَوْلًا عَلِيُّ بْنُ أَبِي طَالِبٍ ؓ قَالَ إِنَّ هَذَا ذَنْبٌ لَمْ تَعْصِ بِهِ أُمَّةٌ مِنَ الْأُمَمِ إِلَّا أُمَّةٌ وَاحِدَةٌ صَنَعَ اللهُ بِهَا مَا قَدْ عَلِمْتُمْ نَرَى أَنْ نُحَرِّقَهُ بِالنَّارِ فَاجْتَمَعَ رَأْيُ أَصْحَابِ رَسُولِ اللهِ ﷺ عَلَى أَنْ يُحَرِّقَهُ بِالنَّارِ فَكَتَبَ أَبُو بَكْرٍ ؓ إِلَى خَالِدِ بْنِ الْوَلِيدِ يَأْمُرُهُ أَنْ يُحَرِّقَهُ بِالنَّارِ هَذَا مُرْسَلٌ وَرُوِي مِنْ وَجْهٍ آخَرَ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ عَنْ أَبِيهِ عَنْ عَلِيٍّ ؓ فِي غَيْرِ هَذِهِ الْقِصَّةِ قَالَ يُرْجَمُ وَيُحَرَّقُ بِالنَّارِ وَيُذْكَرُ عَنِ ابْنِ أَبِي لَيْلَى عَنْ رَجُلٍ مِنْ هَمْدَانَ أَنَّ عَلِيًّا ؓ رَجَمَ رَجُلًا مُحْصَنًا فِي عَمَلِ قَوْمِ لُوطٍ هَكَذَا ذَكَرَهُ الثَّوْرِيُّ عَنْهُ مُقَيَّدًا بِالْإِحْصَانِ وَهُشَيْمٌ
[Machine] I witnessed Ibn Zubayr's son brought in with seven men who were caught in a case of homosexuality. Four of them had already been married to women and three had not. He ordered the four to be taken out of the mosque and they were pelted with stones. He also ordered for the three to be punished with lashes. Ibn Umar and Ibn Abbas were present in the mosque.
شَهِدْتُ ابْنَ الزُّبَيْرِ أُتِيَ بِسَبْعَةٍ أُخِذُوا فِي لُوَاطَةٍ أَرْبَعَةٌ مِنْهُمْ قَدْ أَحْصَنُوا النِّسَاءَ وَثَلَاثَةٌ لَمْ يُحْصِنُوا فَأَمَرَ بِالْأَرْبَعَةِ فَأُخْرِجُوا مِنَ الْمَسْجِدِ فَرُضِحُوا بِالْحِجَارَةِ وَأَمَرَ بِالثَّلَاثَةِ فَضُرِبُوا الْحُدُودَ وَابْنُ عُمَرَ وَابْنُ عَبَّاسٍ فِي الْمَسْجِدِ
[Machine] About the man who engages in bestiality and commits the act of the people of Lot, he said he is in the position of an adulterer.
عَنِ الْحَسَنِ فِي الرَّجُلِ يَأْتِي الْبَهِيمَةَ وَيَعْمَلُ عَمَلَ قَوْمِ لُوطٍ قَالَ هُوَ بِمَنْزِلَةِ الزَّانِي
[Machine] The punishment for a married adulterer is stoning, while for an unmarried one it is flogging. This is what the scholar said and the Shafi'i scholar also agreed with this opinion, as claimed by Rabi' bin Sulaiman.
حَدُّ اللُّوطِيِّ حَدُّ الزَّانِي إِنْ كَانَ مُحْصَنًا رُجِمَ وَإِلَّا جُلِدَ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَإِلَى هَذَا رَجَعَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِيمَا زَعَمَ الرَّبِيعُ بْنُ سُلَيْمَانَ
[Machine] The Messenger of Allah ﷺ said, "When a man approaches another man, they are both committing adultery. And when a woman approaches another woman, they are both committing adultery." Abu Abdullah Al-Hafiz narrated to us, Abu Al-Abbas bin Ya'qub narrated to us, Yahya bin Abi Talib narrated to us, Abu Badr narrated to us, Muhammad bin Abdul Rahman mentioned it, saying, "The Shaykh and Muhammad bin Abdul Rahman, I do not know them, and this chain of narration is weak."
قَالَ رَسُولُ اللهِ ﷺ إِذَا أَتَى الرَّجُلُ الرَّجُلَ فَهُمَا زَانِيَانِ وَإِذَا أَتَتِ الْمَرْأَةُ الْمَرْأَةَ فَهُمَا زَانِيَتَانِ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ ثنا أَبُو الْعَبَّاسِ بْنُ يَعْقُوبَ ثنا يَحْيَى بْنُ أَبِي طَالِبٍ ثنا أَبُو بَدْرٍ ثنا مُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ فَذَكَرَهُ قَالَ الشَّيْخُ وَمُحَمَّدُ بْنُ عَبْدِ الرَّحْمَنِ هَذَا لَا أَعْرِفُهُ وَهُوَ مُنْكَرٌ بِهَذَا الْإِسْنَادِ
55.26 [Machine] Who brought the animal?
٥٥۔٢٦ بَابُ مَنْ أَتَى بَهِيمَةً
[Machine] Narrating from the Prophet, ﷺ , he said regarding the one who commits bestiality, "Kill the doer and the one it is done to."
عَنِ النَّبِيِّ ﷺ أَنَّهُ قَالَ فِي الَّذِي يَأْتِي الْبَهِيمَةَ اقْتُلُوا الْفَاعِلَ وَالْمَفْعُولَ بِهِ
That the Messenger of Allah ﷺ said: "Whomever you see having relations with an animal then kill him and kill animal." So it was said to Ibn 'Abbas: "What is the case of the animal?" He said: "I did not hear anything from the Messenger of Allah ﷺ about this, but I see that the Messenger of Allah ﷺ disliked eating its meat or using it, due to the fact that such a (heinous) thing has been done with that animal." قَالَ رَسُولُ اللهِ ﷺ مَنْ وَجَدْتُمُوهُ وَقَعَ عَلَى بَهِيمَةٍ فَاقْتُلُوهُ وَاقْتُلُوا الْبَهِيمَةَ مَعَهُ فَقِيلَ لِابْنِ عَبَّاسٍ مَا شَأْنُ الْبَهِيمَةِ؟ فَقَالَ مَا سَمِعْتُ مِنْ رَسُولِ اللهِ ﷺ فِي ذَلِكَ شَيْئًا وَلَكِنْ أَرَى رَسُولَ اللهِ ﷺ كَرِهَ أَنْ يُؤْكَلَ مِنْ لَحْمِهَا أَوْ يُنْتَفَعَ بِهَا بَعْدَ ذَلِكَ الْعَمَلِ
[Machine] "That the Prophet ﷺ said, 'Cursed is the one who has sexual intercourse with an animal and says, "Kill it, kill it," and it is not to be said that this one should be done to it in such and such a way.'"
أَنَّ النَّبِيَّ ﷺ قَالَ مَلْعُونٌ مَنْ وَقَعَ عَلَى بَهِيمَةٍ وَقَالَ اقْتُلُوهُ وَاقْتُلُوهَا لَا يُقَالُ هَذِهِ الَّتِي فُعِلَ بِهَا كَذَا وَكَذَا
[Machine] The Messenger of Allah said, "If someone commits an offense against a sacred entity, kill them. And if someone commits an offense against an animal, kill them and kill the animal. We were informed of this in a previous narration from Ibrahim bin Abi Yahya, from Dawood bin Al-Husayn."
قَالَ رَسُولُ اللهِ ﷺ مَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ فَاقْتُلُوهُ وَمَنْ وَقَعَ عَلَى بَهِيمَةٍ فَاقْتُلُوهُ وَاقْتُلُوا الْبَهِيمَةَ وَرُوِّينَاهُ فِي الْبَابِ قَبْلَهُ عَنْ إِبْرَاهِيمَ بْنِ أَبِي يَحْيَى عَنْ دَاوُدَ بْنِ الْحُصَيْنِ
[Machine] "From Asim ibn Bahdalat concerning the preservation, how was it, when a group followed him in his narration? And 'Ikrimah was considered by most of the scholars as trustworthy and reliable. And Allah knows best."
عَنْ عَاصِمِ ابْنِ بَهْدَلَةَ فِي الْحِفْظِ كَيْفَ وَقَدْ تَابَعَهُ عَلَى رِوَايَتِهِ جَمَاعَةٌ؟ وَعِكْرِمَةُ عِنْدَ أَكْثَرِ الْأَئِمَّةِ مِنَ الثِّقَاتِ الْأَثْبَاتِ وَاللهُ أَعْلَمُ
[Machine] Whoever commits bestiality will be subject to punishment.
مَنْ أَتَى الْبَهِيمَةَ أُقِيمَ عَلَيْهِ الْحَدُّ
هُوَ بِمَنْزِلَةِ الزَّانِي
55.27 [Machine] Witnesses of adultery if they do not complete four
٥٥۔٢٧ بَابُ شُهُودِ الزِّنَا إِذَا لَمْ يُكْمِلُوا أَرْبَعَةً
[Machine] When Omar witnessed these three, they differed with Omar. So when Ziyad stood up, he said, "If you testify, then by the will of Allah, testify with the truth." Ziyad said, "As for adultery, I do not testify to it, but I have seen something ugly." Omar said, "Allah is the greatest in their matter," so they whipped them. Abu Bakr then said, after he was beaten, "I testify that he committed adultery." Omar understood that he should be whipped again, so Ali forbade him and said, "If you whip him, then stone your companion." So he left him and did not whip him.
عُمَرُ ؓ حِينَ شَهِدَ هَؤُلَاءِ الثَّلَاثَةُ شَقَّ عَلَى عُمَرَ شَأْنُهُ فَلَمَّا قَامَ زِيَادٌ قَالَ إِنْ تَشْهَدْ إِنْ شَاءَ اللهُ إِلَّا بِحَقٍّ؟ قَالَ زِيَادٌ أَمَّا الزِّنَا فَلَا أَشْهَدُ بِهِ وَلَكِنْ قَدْ رَأَيْتُ أَمْرًا قَبِيحًا قَالَ عُمَرُ اللهُ أَكْبَرُ حُدُّوهُمْ فَجَلَدُوهُمْ قَالَ فَقَالَ أَبُو بَكْرَةَ بَعْدَمَا ضَرَبَهُ أَشْهَدُ أَنَّهُ زَانٍ فَهَمَّ عُمَرُ ؓ أَنْ يُعِيدَ عَلَيْهِ الْجَلْدَ فَنَهَاهُ عَلِيٌّ ؓ وَقَالَ إِنْ جَلَدْتَهُ فَارْجُمْ صَاحِبَكَ فَتَرَكَهُ وَلَمْ يَجْلِدْهُ
[Machine] When Umar saw Ziyad, he said, "I see a wise boy who speaks nothing but the truth and keeps no secrets from me." Ziyad replied, "I did not hear what they said, but I sensed doubt and heard a loud voice." Umar then punished them, except for Ziyad. In another narration, it is mentioned that Abu Bakrah, Ziyad, Nafi', and Shibl bin Ma'bad were in a room while Mughirah was downstairs. Suddenly, a wind blew, opening the door and lifting the curtain, revealing Mughirah between a woman's legs. Some of them said to others, "We have been tested." Abu Bakrah then narrated the story. Ziyad said, "I don't know if he married her or not." Umar punished only Ziyad and Abu Bakrah reminded Umar, "Didn't you punish us as well?" Umar replied, "Yes." Abu Bakrah then said, "I bear witness by Allah, he did it." Umar intended to punish him again, but Ali intervened, saying, "If the testimony of Abu Bakrah is considered equal to the testimony of two men, then stone your companion. Otherwise, you have already punished him by accusing him of adultery."
عُمَرُ ؓ حِينَ رَأَى زِيَادًا إِنِّي لَأَرَى غُلَامًا كَيِّسًا لَا يَقُولُ إِلَّا حَقًّا وَلَمْ يَكُنْ لِيَكْتُمَنِي شَيْئًا فَقَالَ زِيَادٌ لَمْ أَرَ مَا قَالَ هَؤُلَاءِ وَلَكِنِّي قَدْ رَأَيْتُ رِيبَةً وَسَمِعْتُ نَفَسًا عَالِيًا قَالَ فَجَلَدَهُمْ عُمَرُ ؓ وَخَلَّى عَنْ زِيَادٍ وَقَدْ رُوِّينَاهُ مِنْ وَجْهٍ آخَرَ مَوْصُولًا وَفِي رِوَايَةِ عَلِيِّ بْنِ زَيْدٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرَةَ أنَّ أَبَا بَكْرَةَ وَزِيَادًا وَنَافِعًا وَشِبْلَ بْنَ مَعْبَدٍ كَانُوا فِي غُرْفَةٍ وَالْمُغِيرَةُ فِي أَسْفَلِ الدَّارِ فَهَبَّتْ رِيحٌ فَفَتَحَتِ الْبَابَ وَرَفَعَتِ السِّتْرَ فَإِذَا الْمُغِيرَةُ بَيْنَ رِجْلَيْهَا فَقَالَ بَعْضُهُمْ لِبَعْضٍ قَدِ ابْتُلِينَا فَذَكَرَ الْقِصَّةَ قَالَ فَشَهِدَ أَبُو بَكْرَةَ وَنَافِعٌ وَشِبْلٌ وَقَالَ زِيَادٌ لَا أَدْرِي نَكَحَهَا أَمْ لَا فَجَلَدَهُمْ عُمَرُ ؓ إِلَّا زِيَادًا فَقَالَ أَبُو بَكْرَةَ ؓ أَلَيْسَ قَدْ جَلَدْتُمُونِي؟ قَالَ بَلَى قَالَ فَأَنَا أَشْهَدُ بِاللهِ لَقَدْ فَعَلَ فَأَرَادَ عُمَرُ أَنْ يَجْلِدَهُ أَيْضًا فَقَالَ عَلِيٌّ إِنْ كَانَتْ شَهَادَةُ أَبِي بَكْرَةَ شَهَادَةَ رَجُلَيْنِ فَارْجُمْ صَاحِبَكَ وَإِلَّا فَقَدْ جَلَدْتُمُوهُ يَعْنِي لَا يُجْلَدُ ثَانِيًا بِإِعَادَتِهِ الْقَذْفَ
[Machine] "So Umar raised his voice and called for Abu Bakrah and his companions, and he struck them. Abu Bakrah then said, 'By Allah, I am telling the truth, and he did exactly what he was witnessed doing.' Umar understood from his strike and Ali said, 'If you strike this one, then stone that one.'"
فَكَبَّرَ عُمَرُ ؓ وَدَعَا بِأَبِي بَكْرَةَ وَصَاحِبَيْهِ فَضَرَبَهُمْ قَالَ فَقَالَ أَبُو بَكْرَةَ يَعْنِي بَعْدَمَا حَدَّهُ وَاللهِ إِنِّي لَصَادِقٌ وَهُوَ فَعَلَ مَا شُهِدَ بِهِ فَهَمَّ عُمَرُ بِضَرْبِهِ فَقَالَ عَلِيٌّ لَئِنْ ضَرَبْتَ هَذَا فَارْجُمْ ذَاكَ
55.28 [Machine] The Witnesses of Adultery When They Do Not Agree on One Act, There is no Punishment for the One Witnessed.
٥٥۔٢٨ بَابُ شُهُودِ الزِّنَا إِذَا لَمْ يَجْتَمِعُوا عَلَى فِعْلٍ وَاحِدٍ فَلَا حَدَّ عَلَى الْمَشْهُودِ
[Machine] Daniel ﷺ was the first to question the witnesses. He said to one of them, "What did you see and what did you witness?" He replied, "I bear witness that I saw a lily committing adultery in the garden with a young man." Daniel asked, "In which place?" He answered, "Under the apricot tree." Then, he called upon the other witness and asked, "What do you testify?" He said, "I bear witness that I saw a lily committing adultery in the garden under the apple tree." Then, Daniel invoked God against both of them and a fire came from the sky and burned them, and God cleared the innocence of the lily.
كَانَ دَانْيَالُ عَلَيْهِ السَّلَامُ أَوَّلَ مَنْ فَرَّقَ بَيْنَ الشُّهُودِ فَقَالَ لِأَحَدِهِمَا مَا الَّذِي رَأَيْتَ وَمَا الَّذِي شَهِدْتَهُ؟ قَالَ أَشْهَدُ أَنِّي رَأَيْتُ سَوْسَنَ تَزْنِي فِي الْبُسْتَانِ بِرَجُلٍ شَابٍّ قَالَ فِي أِيِّ مَكَانٍ؟ قَالَ تَحْتَ شَجَرَةِ الْكُمَّثْرَى ثُمَّ دَعَا بِالْآخَرِ فَقَالَ مَا تَشْهَدُ؟ قَالَ أَشْهَدُ أَنِّي أَبْصَرْتُ سَوْسَنَ تَزْنِي فِي الْبُسْتَانِ تَحْتَ شَجَرَةِ التُّفَّاحِ قَالَ فَدَعَا اللهَ عَلَيْهِمَا فَجَاءَتْ مِنَ السَّمَاءِ نَارٌ فَأََحْرَقَتْهُمَا وَأَبْرَأَ اللهُ سَوْسَنَ
55.29 [Machine] Whoever has sexual intercourse with a coerced woman, has the narration passed from Ibn Abbas, from the Prophet Muhammad ﷺ: "Verily, Allah has pardoned for me and my nation mistakes, forgetfulness, and what they were forced to do.
٥٥۔٢٩ بَابُ مَنْ زَنَى بِامْرَأَةٍ مُسْتَكْرَهَةٍ قَدْ مَضَتِ الرِّوَايَةُ عَنِ ابْنِ عَبَّاسٍ، عَنِ النَّبِيِّ ﷺ: " إِنَّ اللهَ تَجَاوَزَ لِي عَنْ أُمَّتِي الْخَطَأَ وَالنِّسْيَانَ وَمَا اسْتُكْرِهُوَا عَلَيْهِ "
[Machine] A woman was forced during the time of the Prophet Muhammad ﷺ , and the punishment prescribed for her was waived. The Prophet Muhammad ﷺ upheld the decision that was in her favor and did not mention that he would give her a dowry. In this chain of narration, there is weakness from two aspects: one is that Al-Hajjaj did not hear from Abdul Jabbar, and the other is that Abdul Jabbar did not hear from his father. Al-Bukhari and others have reported this.
اسْتُكْرِهَتِ امْرَأَةٌ عَلَى عَهْدِ النَّبِيِّ ﷺ فَدَرَأَ عَنْهَا الْحَدَّ زَادَ غَيْرُهُ فِيهِ وَأَقَامَهُ عَلَى الَّذِي أَصَابَهَا وَلَمْ يَذْكُرْ أَنَّهُ جَعَلَ لَهُ مَهْرًا وَفِي هَذَا الْإِسْنَادِ ضَعْفٌ مِنْ وَجْهَيْنِ أَحَدُهُمَا أَنَّ الْحَجَّاجَ لَمْ يَسْمَعْ مِنْ عَبْدِ الْجَبَّارِ وَالْآخَرُ أَنَّ عَبْدَ الْجَبَّارِ لَمْ يَسْمَعْ مِنْ أَبِيهِ قَالَهُ الْبُخَارِيُّ وَغَيْرُهُ
[Machine] I was sleeping and didn't wake up until a man threw himself at me like a shooting star. 'Umar said, "She is a Yemeni woman who is young and beautiful, so leave her and make her happy."
إِنِّي كُنْتُ نَائِمَةً فَلَمْ أَسْتَيْقِظْ إِلَّا بِرَجُلٍ رَمَى فِيَّ مِثْلَ الشِّهَابِ فَقَالَ عُمَرُ ؓ يَمَانِيَةٌ نَؤُومَةٌ شَابَّةٌ فَخَلَّى عَنْهَا وَمَتَّعَهَا
[Machine] We were in Mecca when people gathered around a woman, nearly killing her, while saying that she had committed adultery. Umar ibn al-Khattab came with his people, and they praised her. Umar asked her to tell him about her situation. She said, "O leader of the believers, I was a woman who was attacked last night. I performed the night prayer, then I slept. When I woke up, a man was between my legs and he threw something on me like a shooting star, then he left." Umar said, "If anyone had killed this man who was between the two mountains or between the two trees, Abu Khalid would have doubted and Allah would have punished them. He left her alone and wrote to all regions, 'Do not kill anyone except with my permission.'"
إِنَّا لَبِمَكَّةَ إِذْ نَحْنُ بِامْرَأَةٍ اجْتَمَعَ عَلَيْهَا النَّاسُ حَتَّى كَادَ أَنْ يَقْتُلُوهَا وَهُمْ يَقُولُونَ زَنَتْ زَنَتْ فَأَتَى بِهَا عُمَرُ بْنُ الْخَطَّابِ ؓ وَهِيَ حُبْلَى وَجَاءَ مَعَهَا قَوْمُهَا فَأَثْنَوْا عَلَيْهَا بِخَيْرٍ فَقَالَ عُمَرُ أَخْبِرِينِي عَنْ أَمْرِكِ قَالَتْ يَا أَمِيرَ الْمُؤْمِنِينَ كُنْتُ امْرَأَةً أُصِيبُ مِنْ هَذَا اللَّيْلِ فَصَلَّيْتُ ذَاتَ لَيْلَةٍ ثُمَّ نِمْتُ وَقُمْتُ وَرَجُلٌ بَيْنَ رِجْلِيَّ فَقَذَفَ فِيَّ مِثْلَ الشِّهَابِ ثُمَّ ذَهَبَ فَقَالَ عُمَرُ ؓ لَوْ قَتَلَ هَذِهِ مَنْ بَيْنَ الْجَبَلَيْنِ أَوْ قَالَ الْأَخْشَبَيْنِ شَكَّ أَبُو خَالِدٍ لَعَذَّبَهُمُ اللهُ فَخَلَّى سَبِيلَهَا وَكَتَبَ إِلَى الْآفَاقِ أَنْ لَا تَقْتُلُوا أَحَدًا إِلَّا بِإِذْنِي
عَنْ صَفِيَّةَ بِنْتِ أَبِي عُبَيْدٍ
أَنْ نُخْلِيَ سَبِيلَهَا فَفَعَلَ
[Machine] And on the authority of Az-Zuhri, may Allah be pleased with him, the truthfulness and accuracy (of a narration) is (also) required.
وَعَنِ الزُّهْرِيِّ عَلَيْهِ الصَّدَاقُ وَالْحَدُّ
55.30 [Machine] Anyone who encounters someone prohibited to them, or encounters someone's spouse, or someone who is in a waiting period after divorce or widowhood, with the knowledge of the prohibition.
٥٥۔٣٠ بَابُ مَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ لَهُ أَوْ عَلَى ذَاتِ زَوْجٍ، أَوْ مَنْ كَانَتْ فِي عِدَّةِ زَوْجٍ بِنِكَاحٍ أَوْ غَيْرِ نِكَاحٍ، مَعَ الْعِلْمِ بِالتَّحْرِيمِ
[Machine] I heard the Messenger of Allah ﷺ say about someone who commits adultery without being married, he should be lashed one hundred times and be exiled for a year.
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ فِيمَنْ زَنَى وَلَمْ يُحْصِنْ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ
[Machine] I heard Umar bin Al-Khattab saying that stoning is a prescribed punishment in the Book of Allah for those who commit adultery when they are married, whether they are men or women, and evidence is established or there is pregnancy or confession.
سَمِعْتُ عُمَرَ بْنَ الْخَطَّابِ ؓ يَقُولُ الرَّجْمُ فِي كِتَابِ اللهِ ﷻ حَقٌّ عَلَى مَنْ زَنَى إِذَا أُحْصِنَ مِنَ الرِّجَالِ وَالنِّسَاءِ إِذَا قَامَتِ الْبَيِّنَةُ أَوْ كَانَ الْحَبَلُ أَوِ الِاعْتِرَافُ
while I was wandering in search of my camels which had strayed, a caravan or some horsemen carrying a standard came forward. The bedouin began to go round me for my position with the Prophet ﷺ. They came to a domed structure, took out a man from it, and struck his neck. I asked about him. They told me that he had married his father's wife. (Using translation from Abū Dāʾūd 4456)
بَيْنَمَا أَنَا أَطُوفُ عَلَى إِبِلٍ لِي ضَلَّتْ إِذْ أَقْبَلَ رَكْبٌ أَوْ فَوَارِسُ مَعَهُمْ لِوَاءٌ فَجَعَلَ الْأَعْرَابُ يُطِيفُونَ بِي لِمَنْزِلَتِي مِنَ النَّبِيِّ ﷺ إِذْ أَتَوْا قُبَّةً فَاسْتَخْرَجُوا مِنْهَا رَجُلًا فَضَرَبُوا عُنُقَهُ فَسَأَلْتُ عَنْهُ فَذَكَرُوا أَنَّهُ أَعْرَسَ بِامْرَأَةِ أَبِيهِ
[Machine] Abu Khalid sent a message to him, so the Prophet ﷺ killed him.
أَبُو خَالِدٍ فَأَرْسَلَ إِلَيْهِ النَّبِيُّ ﷺ فَقَتَلَهُ
[Machine] The Messenger of Allah ﷺ said, "Whoever comes across a forbidden act, kill him." This hadith has been narrated from the narration of Abbad ibn Mansur, from Ikrimah, from Ibn Abbas, as a marfu' (elevated) hadith.
قَالَ رَسُولُ اللهِ ﷺ مَنْ وَقَعَ عَلَى ذَاتِ مَحْرَمٍ فَاقْتُلُوهُ وَقَدْ رُوِّينَاهُ مِنْ حَدِيثِ عَبَّادِ بْنِ مَنْصُورٍ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ مَرْفُوعًا
55.31 [Machine] What is mentioned in repelling doubts at the boundaries
٥٥۔٣١ بَابُ مَا جَاءَ فِي دَرْءِ الْحُدُودِ بِالشُّبُهَاتِ
[Machine] The Messenger of Allah ﷺ said, "Keep the limits away from the Muslims as much as you can. If you find a way out for the Muslim, then let him go. Indeed, it is better for the leader to make a mistake in forgiveness than to make a mistake in punishment." This was narrated by Wakee' from Yazid bin Ziyad, who reported it from Aisha. Abu Abdullah Al-Hafiz informed us that Abu Al-Walid Al-Faqih narrated to him from Muhammad bin Ahmad bin Zuheir, who reported it from Abdullah bin Hashim, who reported it from Wakee', who mentioned it from Yazid, and he narrated it in a way that was attributed to Yazid bin Ziyad Al-Shami, from Al-Zuhri. This narration has a weakness. The narration of Wakee' is closer to correctness, and Allah knows best. Rashdeen bin Saad narrated it from Aqeel, from Al-Zuhri, in a marfu' (elevated) form. Rashdeen is weak.
قَالَ رَسُولُ اللهِ ﷺ ادْرءُوا الْحُدُودَ عَنِ الْمُسْلِمِينَ مَا اسْتَطَعْتُمْ فَإِنْ وَجَدْتُمْ لِلْمُسْلِمِ مَخْرَجًا فَخَلُّوا سَبِيلَهُ فَإِنَّ الْإِمَامَ أَنْ يُخْطِئَ فِي الْعَفْوِ خَيْرٌ لَهُ مِنْ أَنْ يُخْطِيءَ فِي الْعُقُوبَةِ 17058 وَرَوَاهُ وَكِيعٌ عَنْ يَزِيدَ بْنِ زِيَادٍ مَوْقُوفًا عَلَى عَائِشَةَ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو الْوَلِيدِ الْفَقِيهُ ثنا مُحَمَّدُ بْنُ أَحْمَدَ بْنِ زُهَيْرٍ ثنا عَبْدُ اللهِ بْنُ هَاشِمٍ ثنا وَكِيعٌ عَنْ يَزِيدَ فَذَكَرَهُ مَوْقُوفًا تَفَرَّدَ بِهِ يَزِيدُ بْنُ زِيَادٍ الشَّامِيُّ عَنِ الزُّهْرِيِّ وَفِيهِ ضَعْفٌ وَرِوَايَةُ وَكِيعٍ أَقْرَبُ إِلَى الصَّوَابِ وَاللهُ أَعْلَمُ وَرَوَاهُ رِشْدِينُ بْنُ سَعْدٍ عَنْ عَقِيلٍ عَنِ الزُّهْرِيِّ مَرْفُوعًا وَرِشْدِينُ ضَعِيفٌ
[Machine] I heard the Messenger of Allah ﷺ saying, "Keep the boundaries in this chain weak."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ ادْرَءُوا الْحُدُودَ فِي هَذَا الْإِسْنَادِ ضَعْفٌ
[Machine] The Messenger of Allah ﷺ said "Prevent the violation of boundaries, and it is not appropriate for the leader to disregard the boundaries." Al-Bukhari said that Al-Mukhtar ibn Nafi' said "It is an invalid hadith."
قَالَ رَسُولُ اللهِ ﷺ ادْرَءُوا الْحُدُودَ وَلَا يَنْبَغِي لِلْإِمَامِ أَنْ يُعَطِّلَ الْحُدُودَ قَالَ الْبُخَارِيُّ الْمُخْتَارُ بْنُ نَافِعٍ مُنْكَرُ الْحَدِيثِ
[Machine] If you come to us, ask about your efforts in the covenant, for if I make a mistake in forgiveness, it is more beloved to me than making a mistake in punishment that is permanent and suspended.
إِذَا حَضَرْتُمُونَا فَاسْأَلُوا فِي الْعَهْدِ جَهْدَكُمْ فَإِنِّي إِنْ أُخْطِئْ فِي الْعَفْوِ أَحَبُّ إِلِيَّ مِنْ أَنْ أُخْطِئَ فِي الْعُقُوبَةِ مُنْقَطِعٌ وَمَوْقُوفٌ
[Machine] To make a mistake in punishment and when you find a way out for a Muslim, repel from him the severed and suspended punishment.
أَنْ تُخْطِئُوا فِي الْعُقُوبَةِ وَإِذَا وَجَدْتُمْ لِمُسْلِمٍ مَخْرَجًا فَادْرَءُوا عَنْهُ الْحَدَّ مُنْقَطِعٌ وَمَوْقُوفٌ
[Machine] "And Abdullah ibn Mas'ood and Uqbah ibn Aamir said, 'When there is doubt in the ruling, then ward it off with certainty.'"
وَعَبْدَ اللهِ بْنَ مَسْعُودٍ وَعُقْبَةَ بْنَ عَامِرٍ ؓ قَالُوا إِذَا اشْتُبِهَ الْحَدُّ فَادْرَءُوهُ مُنْقَطِعٌ
عَنِ الْمُسْلِمِينَ مَا اسْتَطَعْتُمْ هَذَا مَوْصُولٌ
[Machine] A man who used to gather firewood was freed by Omar bin Al-Khattab if he prayed, fasted, and owned a Nubian slave who also prayed and fasted but did not understand Arabic. She would only understand him through gestures. The man went to Omar and informed him of the situation, to which Omar replied, "You are not bringing any good to us." This scared the man, so Omar sent for the slave and asked her if she was pregnant. She confirmed and mentioned that it was from a man who paid her two silver coins. Upon hearing this, Omar called upon Ali, Uthman, and Abdur Rahman bin Awf and asked them to give their opinion. They were not present, so the slave asked them to make hand gestures. Ali and Abdur Rahman said that the punishment had already fallen upon her, and Uthman, who was sitting, agreed. She asked them to point towards her. Uthman replied, "Your brothers have already pointed at you," to which she requested Uthman to point at her. He responded by saying that he believed she acted as if she did not know. He also added that punishment is only applicable to those who are aware of the law. Omar agreed with this and thus, he flogged her a hundred times and then banished her for a year. The scholar (may Allah have mercy on him) commented that her punishment was stoning, but it was removed due to the suspicion of ignorance. Omar flogged and banished her as a form of punishment. And Allah knows best.
حَاطِبٌ فَأُعْتِقَ مَنْ صَلَّى مِنْ رَقِيقِهِ وَصَامَ وَكَانَتْ لَهُ أَمَةٌ نُوبِيَّةٌ قَدْ صَلَّتْ وَصَامَتْ وَهِيَ أَعْجَمِيَّةٌ لَمْ تَفْقَهْ فَلَمْ تَرُعْهُ إِلَّا بِحَبَلِهَا وَكَانَتْ ثَيِّبًا فَذَهَبَ إِلَى عُمَرَ ؓ فَحَدَّثَهُ فَقَالَ لَأَنْتَ الرَّجُلُ لَا تَأْتِي بِخَيْرٍ فَأَفْزَعَهُ ذَلِكَ فَأَرْسَلَ إِلَيْهَا عُمَرُ ؓ فَقَالَ أَحَبَلْتِ؟ فَقَالَتْ نَعَمْ مِنْ مَرْغُوشٍ بِدِرْهَمَيْنِ فَإِذَا هِيَ تَسْتَهِلُّ بِذَلِكَ لَا تَكْتُمُهُ قَالَ وَصَادَفَ عَلِيًّا وَعُثْمَانَ وَعَبْدَ الرَّحْمَنِ بْنَ عَوْفٍ ؓ فَقَالَتْ أَشِيرُوا عَلَيَّ وَكَانَ عُثْمَانُ ؓ جَالِسًا فَاضْطَجَعَ فَقَالَ عَلِيٌّ وَعَبْدُ الرَّحْمَنِ قَدْ وَقَعَ عَلَيْهَا الْحَدُّ فَقَالَ أَشِرْ عَلَيَّ يَا عُثْمَانُ فَقَالَ قَدْ أَشَارَ عَلَيْكَ أَخَوَاكَ قَالَ أَشِرْ عَلَيَّ أَنْتَ قَالَ أُرَاهَا تَسْتَهِلُّ بِهِ كَأَنَّهَا لَا تَعْلَمُهُ وَلَيْسَ الْحَدُّ إِلَّا عَلَى مَنْ عَلِمَهُ فَقَالَ صَدَقْتَ وَالَّذِي نَفْسِي بِيَدِهِ مَا الْحَدُّ إِلَّا عَلَى مَنْ عَلِمَهُ فَجَلَدَهَا عُمَرُ ؓ مِائَةً وَغَرَّبَهَا عَامًا قَالَ الشَّيْخُ رَحِمَهُ اللهُ كَانَ حَدُّهَا الرَّجْمَ فَكَأَنَّهُ ؓ دَرَأَ عَنْهَا حَدَّهَا لِلشُّبْهَةِ بِالْجَهَالَةِ وَجَلَدَهَا وَغَرَّبَهَا تَعْزِيرًا وَاللهُ أَعْلَمُ
[Machine] It was written to him about a man who was asked, "When did you start dealing with women?" He said, "Yesterday." They asked, "With whom?" He said, "My mother." He was told, "You are already dead." He said, "I did not know that Allah had forbidden adultery." So Umar ibn al-Khattab wrote that he should be sworn to not pursue what he did not know Allah had forbidden, and then he should be freed.
أَنَّهُ كُتِبَ إِلَيْهِ فِي رَجُلٍ قِيلَ لَهُ مَتَى عَهْدُكَ بِالنِّسَاءِ؟ فَقَالَ الْبَارِحَةَ قِيلَ بِمَنْ؟ قَالَ أُمِّ مَثْوَايَ فَقِيلَ لَهُ قَدْ هَلَكْتَ قَالَ مَا عَلِمْتُ أَنَّ اللهَ حَرَّمَ الزِّنَا فَكَتَبَ عُمَرُ ؓ أَنْ يُسْتَحْلَفَ مَا عَلِمَ أَنَّ اللهَ حَرَّمَ الزِّنَا ثُمَّ يُخَلَّى سَبِيلُهُ
55.32 [Machine] What came from the person who visited his wife's neighbor?
٥٥۔٣٢ بَابُ مَا جَاءَ فِيمَنْ أَتَى جَارِيَةَ امْرَأَتِهِ
[Machine] The passage translates to: "On the authority of the Messenger of Allah ﷺ , he said: 'If you did not give permission, I would have stoned him. And if you had given permission, I would have flogged him a hundred times.' The people then said to her: 'Woe to you, Abu Walid's daughter! Is he going to be stoned?' So, she came and said: 'I had given him permission, but jealousy made me say what I said.' Then, Abu Bashir did not hear it from Habib."
عَنْ رَسُولِ اللهِ ﷺ إِنْ لَمْ تَكُونِي أَذِنْتِ لَهُ رَجَمْتُهُ وَإِنْ كُنْتِ أَذِنْتِ لَهُ جَلَدْتُهُ مِائَةً فَقَالَ لَهَا النَّاسُ وَيْحَكِ أَبُو وَلَدِكِ يُرْجَمُ؟ فَجَاءَتْ فَقَالَتْ قَدْ كُنْتُ أَذِنْتُ لَهُ وَلَكِنْ حَمَلَتْنِي الْغَيْرَةُ عَلَى مَا قُلْتُ فَجَلَدَهُ مِائَةً لَمْ يَسْمَعْهُ أَبُو بِشْرٍ عَنْ حَبِيبٍ إِنَّمَا
The Prophet ﷺ said: about a man who had (unlawful) intercourse with his wife's slave girl: If she made her lawful for him, he will be flogged one hundred lashes; if she did not make her lawful for him, I shall stone him. (Using translation from Abū Dāʾūd 4459)
