55. Prescribed Punishments (4/5)
٥٥۔ كِتَابُ الْحُدُودِ ص ٤
[Machine] "I will settle the matter of the Messenger of Allah ﷺ . If she made it permissible for you, I will flog you a hundred times, and if she did not make it permissible for you, I will stone you with rocks. But they found out that she made it permissible for him, so they flogged him a hundred times." Qatada said: "I wrote to Habib ibn Salim, and he wrote back to me saying such and such."
لَأَقْضِيَنَّ بِقَضِيَّةِ رَسُولِ اللهِ ﷺ إِنْ كَانَتْ أَحَلَّتْهَا لَكَ جَلَدْتُكَ مِائَةً وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَكَ رَجَمْتُكَ بِالْحِجَارَةِ فَوَجَدُوهُ أَحَلَّتْهَا لَهُ فَجَلَدَهُ مِائَةً قَالَ قَتَادَةُ كَتَبْتُ إِلَى حَبِيبِ بْنِ سَالِمٍ فَكَتَبَ إِلِيَّ بِهَذَا كَذَا
[Machine] "I will decree in it with the decree of the Messenger of Allah ﷺ . If it is lawful for him, I will flog him, and if it is not lawful for him, I will stone him." 17071 And Abu al-Hasan Ali ibn Muhammad al-Muqri narrated to us, informed us al-Hasan ibn Muhammad ibn Ishaq, told us Yusuf ibn Ya'qub, told us Hudbah ibn Khalid, told us Hammam, told us Qatadah, from Habib ibn Salim, from Khubayb ibn Yasaf, that a man had relations with his neighbor's slave girl, so it was brought to Nu'man ibn Bashir, and he mentioned it like this. I found them in the book." Abu Isa al-Tirmidhi said, "I asked Muhammad ibn Isma'il al-Bukhari about this hadith, and he said, 'I fear this hadith and I narrate it only as it has come to me.'"
لَأَقْضِيَنَّ فِيهَا بِقَضَاءِ رَسُولِ اللهِ ﷺ إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جَلَدْتُهُ وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ رَجَمْتُهُ 17071 وَأَخْبَرَنَا أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدٍ الْمُقْرِئُ أنبأ الْحَسَنُ بْنُ مُحَمَّدِ بْنِ إِسْحَاقَ ثنا يُوسُفُ بْنُ يَعْقُوبَ ثنا هُدْبَةُ بْنُ خَالِدٍ ثنا هَمَّامٌ ثنا قَتَادَةُ عَنْ حَبِيبِ بْنِ سَالِمٍ عَنْ خُبَيْبِ بْنِ يَسَافٍ أَنَّ رَجُلًا وَطِئَ جَارِيَةَ امْرَأَتِهِ فَرُفِعَ إِلَى النُّعْمَانِ بْنِ بَشِيرٍ فَذَكَرَهُ كَذَا وَجَدْتُهُمَا فِي الْكِتَابِ قَالَ أَبُو عِيسَى التِّرْمِذِيُّ سَأَلْتُ مُحَمَّدَ بْنَ إِسْمَاعِيلَ الْبُخَارِيَّ عَنْ هَذَا الْحَدِيثِ فَقَالَ أَنَا أَتَّقِي هَذَا الْحَدِيثَ وَإِنَّمَا
[Machine] A man had an intimate encounter with a woman who was married to him. They were brought to the Prophet ﷺ and he said, "If she did it willingly, then she belongs to him and he must give something of equal value in compensation. But if she was unwilling, then she is free and he must give something of equal value in compensation."
أَنَّ رَجُلًا وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ فَرُفِعُوا إِلَى النَّبِيِّ ﷺ فَقَالَ إِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ مِثْلُهَا وَإِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ مِثْلُهَا كَذَا
[Machine] About the Prophet ﷺ regarding a man who had sexual intercourse with his wife's slave-girl, he said: "If he forced her to do so, then she is free, and he must free a slave-girl like her. But if she willingly agreed, then she is a slave-girl and he must free a slave-girl like her." This was narrated by Ma'mar from Qatadah.
عَنِ النَّبِيِّ ﷺ فِي رَجُلٍ وَطِئَ جَارِيَةَ امْرَأَتِهِ فَقَالَ إِنِ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَلَهَا عَلَيْهِ مِثْلُهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ أَمَةٌ وَلَهَا عَلَيْهِ مِثْلُهَا وَرَوَاهُ مَعْمَرٌ عَنْ قَتَادَةَ
[Machine] The Messenger of Allah ﷺ ruled in a case where a man had sexual intercourse with the slave girl of his wife. In another narration by Al-Ramadi, the ruling was regarding a man who had sexual intercourse with his wife's slave girl. If he forced her, then she is free and the man's wife has the same status as her. And if she willingly obeyed him, then she belongs to him and his wife has the same status as her. And likewise...
أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِي رَجُلٍ وَقَعَ عَلَى جَارِيَةِ امْرَأَتِهِ وَفِي رِوَايَةِ الرَّمَادِيِّ قَضَى فِي الرَّجُلِ يُصِيبُ جَارِيَةَ امْرَأَتِهِ إِنِ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا وَإِنْ طَاوَعَتْهُ فَهِيَ لَهُ وَعَلَيْهِ لِسَيِّدَتِهَا مِثْلُهَا وَكَذَلِكَ
[Machine] A man from among the companions of the Prophet ﷺ used to constantly travel and engage in warfare, and his wife sent a maid with him. She said, "She will wash your head, serve you, and take care of your belongings, but she will not be for you as a wife." And indeed, his journey was extended. Because of that, he had a relationship with the maid. When it was over, the maid informed her mistress about it. Out of extreme jealousy and anger, she went to the Messenger of Allah ﷺ and informed him of what had happened. The Messenger of Allah ﷺ said to her, "If she was forced, then she is to be freed and he has to free a slave like her. But if it was done willingly and out of her own desire, then she belongs to him and he has to pay her the equal of her worth." And he did not establish a punishment for him. Al-Bukhari said, according to what I have heard, the most authentic narration of this incident is from the narration of Qabeesah.
أَنَّ رَجُلًا مِنْ أَصْحَابِ النَّبِيِّ ﷺ كَانَ لَا يَزَالُ يُسَافَرُ وَيَغْزُو وَإِنَّ امْرَأَتَهُ بَعَثَتْ مَعَهُ جَارِيَةً لَهَا فَقَالَتْ تَغْسِلُ رَأْسَكَ وَتَخْدِمُكَ وَتَحْفَظُ رَحْلَكَ وَلَمْ تَجْعَلْهَا لَهُ وَأَنَّهُ طَالَ سَفَرُهُ فِي وَجْهِهِ ذَلِكَ فَوَقَعَ بِالْجَارِيَةِ فَلَمَّا قَفَلَ أَخْبَرَتِ الْجَارِيَةُ مَوْلَاتَهَا بِذَلِكَ فَغَارَتْ غَيْرَةً شَدِيدَةً وَغَضِبَتْ فَأَتَتْ رَسُولَ اللهِ ﷺ فَأَخْبَرَتْهُ بِالَّذِي صَنَعَ فَقَالَ لَهَا رَسُولُ اللهِ ﷺ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ عَتِيقَةٌ وَعَلَيْهِ مِثْلُهَا وَإِنْ كَانَ أَتَاهَا عَنْ طِيبَةِ نَفْسٍ مِنْهَا وَرِضًى فَهِيَ لَهُ وَعَلَيْهِ مِثْلُ ثَمَنِهَا لَكِ وَلَمْ يُقِمْ فِيهِ حَدًّا قَالَ الْبُخَارِيُّ فِيمَا بَلَغَنِي عَنْهُ لَحَدِيثُ قَبِيصَةَ هَذَا أَصَحُّ يَعْنِي مِنْ رِوَايَةِ مَنْ
[Machine] He said, "Seek forgiveness from Allah and do not repeat it."
أَنَّهُ قَالَ اسْتَغْفِرِ اللهَ وَلَا تَعُدْ
[Machine] Indeed, the son of a mother of a slave does not know what will happen after him. If I bring him, I will stone him.
إِنَّ ابْنَ أُمِّ عَبْدٍ لَا يَدْرِي مَا حَدَثَ بَعْدَهُ لَوْ أَتَيْتُ بِهِ لَرَجَمْتُهُ
[Machine] The statement of the Sheikh, may Allah have mercy on him, is that the son of the mother of a slave, meaning Ibn Mas'ood, does not know what happened after him. This is evidence of abrogation and contradicts what was previously ruled.
الشَّيْخُ رَحِمَهُ اللهُ قَوْلُهُ إِنَّ ابْنَ أُمِّ عَبْدٍ يَعْنِي ابْنَ مَسْعُودٍ لَا يَدْرِي مَا حَدَثَ بَعْدَهُ دَلِيلٌ عَلَى نَسْخٍ وَرَدٍّ عَلَى مَا أَفْتَى بِهِ
[Machine] She said: "If you are truthful, then we will stone your husband. And if you lie, we will whip you." He said: "Take her back to her house, to her house." Shu'bah narrated it with his chain of narration, and he added: "She said: Take me back to my family, other than them, it means that her anger and jealousy were boiling inside her."
لَهَا عَلِيٌّ ؓ إِنْ تَكُونِي صَادِقَةً نَرْجُمْ زَوْجَكِ وَإِنْ تَكُونِي كَاذِبَةً نَجْلِدْكِ قَالَ فَقَالَتْ رُدُّونِي إِلَى بَيْتِي إِلَى بَيْتِي وَرَوَاهُ شُعْبَةُ بِإِسْنَادِهِ وَزَادَ فَقَالَتْ رُدُّونِي إِلَى أَهْلِي غَيْرَى نَغِرَةٌ وَمَعْنَاهُ أَنَّ جَوْفَهَا يَغْلِي مِنَ الْغَيْظِ وَالْغَيْرَةِ وَقَدْ
[Machine] I have sent a servant with my husband to serve and attend to him. I was informed that she has become pregnant. When the man arrived, Umar sent for him and asked, "Did you impregnate the servant, so-and-so?" He said, "Yes." Umar asked, "Did you marry her?" He said, "No." Umar asked, "Did she give herself to you as a gift?" He said, "Yes." Umar asked, "Do you have any proof for that?" He said, "No." Umar said, "You must bring me proof, or I will stone you." The woman was told that her husband would be stoned, so she went to Umar and admitted that she had given herself to him as a gift. Umar had her flogged. I believe the prescribed punishment in this case is the punishment for zina (unlawful sexual intercourse). Imam Shafi'i, may Allah have mercy on him, said, "If he is from the ignorant people, and I used to consider it permissible for me because we avert the prescribed punishment from him and reprimand him."
إِنِّي بَعَثْتُ مَعَ زَوْجِي بِجَارِيَةٍ تَخْدُمُهُ وَتَقُومُ عَلَيْهِ فَبَلَغَنِي أَنَّهَا قَدْ حَبِلَتْ قَالَ فَلَمَّا قَدِمَ الرَّجُلُ أَرْسَلَ إِلَيْهِ عُمَرُ ؓ قَالَ مَا فَعَلَتِ الْجَارِيَةُ فُلَانَةٌ أَأَحْبَلْتَهَا؟ قَالَ نَعَمْ قَالَ أَأَبْتَعْتَهَا؟ قَالَ لَا قَالَ فَوَهَبَتْهَا لَكَ؟ قَالَ نَعَمْ قَالَ فَلَكَ بَيِّنَةٌ عَلَى ذَلِكَ؟ قَالَ لَا فَقَالَ لَتَأْتِيَنِّي بِالْبَيِّنَةِ أَوْ لَأَرْجُمَنَّكَ فَقِيلَ لِلْمَرْأَةِ إِنَّ زَوْجَكِ يُرْجَمُ فَأَتَتْ عُمَرَ ؓ فَأَقَرَّتْ أَنَّهَا وَهَبَتْهَا لَهُ فَجَلَدَهَا عُمَرُ ؓ الْحَدَّ أُرَاهُ حَدَّ الْقَذْفِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فَإِنْ كَانَ مِنْ أَهْلِ الْجَهَالَةِ وَقَالَ كُنْتُ أَرَى أَنَّهَا حَلَالٌ لِي فَإِنَّا نَدْرَأُ عَنْهُ الْحَدَّ وَعَزَّرْنَاهُ
[Machine] Abu Bakr Al-Ardistani informed us that Abu Nasr Al-Iraqi informed us that Sufyan Al-Jawhari narrated to us from Ali bin Al-Hasan, who narrated from Abdullah bin Al-Walid, who narrated from Sufyan from Al-Mughirah from Harkoos Al-Dhabi that a woman came to Ali and said, "My husband had sexual intercourse with my slave girl." Her husband said, "She is telling the truth, and her belongings are lawful for me." Ali said, "Go, do not come back."
أَخْبَرَنَا أَبُو بَكْرٍ الْأَرْدَسْتَانِيُّ أنبأ أَبُو نَصْرٍ الْعِرَاقِيُّ أنبأ سُفْيَانُ الْجَوْهَرِيُّ ثنا عَلِيُّ بْنُ الْحَسَنِ ثنا عَبْدُ اللهِ بْنُ الْوَلِيدِ ثنا سُفْيَانُ عَنِ الْمُغِيرَةِ عَنِ الْهَيْثَمِ بْنِ بَدْرٍ عَنْ حَرْقُوصٍ الضَّبِّيِّ أَنَّ امْرَأَةً أَتَتْ عَلِيًّا ؓ فَقَالَتْ إِنَّ زَوْجِي أَصَابَ جَارِيَتِي فَقَالَ زَوْجُهَا صَدَقَتْ هِيَ وَمَالُهَا حِلٌّ لِي فَقَالَ عَلِيٌّ ؓ اذْهَبْ لَا تَعُودَنَّ
[Machine] And as if when he claimed his ignorance, he reinforced it, and Allah knows best.
وَكَأَنَّهُ إِنْ صَحَّ ادَّعَى جَهَالَةً فَعَزَّرَهُ وَلَمْ يَرْجُمْهُ وَاللهُ أَعْلَمُ
55.33 [Machine] Who commits a sin without the prescribed punishment, then repents and seeks guidance.
٥٥۔٣٣ بَابُ مَنْ أَصَابَ ذَنْبًا دُونَ الْحَدِّ ثُمَّ تَابَ وَجَاءَ مُسْتَفْتِيًا
A man kissed a woman and then came to Messenger of Allah ﷺ and told him of that, so this Divine Inspiration was revealed to the Prophet ﷺ 'And offer Prayers perfectly at the two ends of the day, and in some hours of the night; (i.e. (five) compulsory prayers). Verily, the good deeds remove the evil deeds (small sins) That is a reminder for the mindful.' (11.114) The man said, Is this instruction for me only?' The Prophet ﷺ said, "It is for all those of my followers who encounter a similar situation." (Using translation from Bukhārī 4687)
أَنَّ رَجُلًا أَصَابَ مِنِ امْرَأَةٍ قُبْلَةً فَأَتَى النَّبِيَّ ﷺ فَذَكَرَ ذَلِكَ لَهُ فَأُنْزِلَتْ {أَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ إِنَّ الْحَسَنَاتِ يُذْهِبْنَ السَّيِّئَاتِ ذَلِكَ ذِكْرَى لِلذَّاكِرِينَ} [هود 114] قَالَ الرَّجُلُ يَا رَسُولَ اللهِ إِلِيَّ هَذِهِ؟ قَالَ لِمَنْ عَمِلَ بِهَا مِنْ أُمَّتِي
A man came to the Prophet ﷺ and said: I contacted directly a women at the furthest part of the city (i.e., Medina), and I did with her everything except sexual intercourse. So here I am; inflict any punishment you wish. Thereupon ‘Umar said: Allah has concealed your fault; it would have been better if you also had concealed it yourself. The Prophet ﷺ sent a men after him. (When he came) he recited the verse: “And establish regular prayers at the two ends of the day and at the approaches of the night. . .” up to the end of the verse. A man from the people got up and asked: Is it particular to him, Messenger of Allah, or for the people in general? He replied: It is all the people. (Using translation from Abū Dāʾūd 4468)
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ إِنِّي عَالَجْتُ امْرَأَةً فِي أَقْصَى الْمَدِينَةِ وَإِنِّي أَصَبْتُ مِنْهَا مَا دُونَ أَنْ أَمَسَّهَا فَأَنَا هَذَا فَاقْضِ فِيَّ مَا شِئْتَ فَقَالَ لَهُ عُمَرُ ؓ لَقَدْ سَتَرَكَ اللهُ لَوْ سَتَرْتَ نَفْسَكَ قَالَ وَلَمْ يَرُدَّ عَلَيْهِ النَّبِيُّ ﷺ شَيْئًا فَقَامَ الرَّجُلُ فَانْطَلَقَ فَأَتْبَعَهُ النَّبِيُّ ﷺ رَجُلًا دَعَاهُ فَتَلَا عَلَيْهِ هَذِهِ الْآيَةَ {أَقِمِ الصَّلَاةَ طَرَفَيِ النَّهَارِ وَزُلَفًا مِنَ اللَّيْلِ إِنَّ الْحَسَنَاتِ يُذْهِبْنَ السَّيِّئَاتِ ذَلِكَ ذِكْرَى لِلذَّاكِرِينَ} [هود 114] فَقَالَ رَجُلٌ مِنَ الْقَوْمِ يَا نَبِيَّ اللهِ هَذَا لَهُ خَاصَّةً؟ قَالَ بَلْ لِلنَّاسِ كَافَّةً
55.34 [Machine] What is mentioned in the ruling of the Mamalik Allah, blessed and exalted be He, said regarding slave women: "But when they are fully mature, if you find in them sound judgment, then make a contract with them and give them their due compensation according to the customary manner. And if you should be in doubt, then [keep] them abstained from [sexual relations] until they come to a new [life] period. And if they should be pregnant, then spend on them until they give birth. And if they breastfeed for you, then give them their payment and confer among yourselves in the acceptable manner; but if you are in discord, then there may breastfeed for the father another woman." [Quran 65:6] Shafi'i said: "The half is only in the flogging that causes the skin to bruise, as for stoning [adulterers to death], it has no half." He also said: "The Messenger of Allah, ﷺ , said: 'If any of you finds his slave girl committing illegal sexual intercourse, let him flog her.'" But he did not say: "Let him stone her.
٥٥۔٣٤ بَابُ مَا جَاءَ فِي حَدِّ الْمَمَالِيكِ قَالَ اللهُ تَبَارَكَ وَتَعَالَى فِي الْمَمْلُوكَاتِ: {فَإِذَا أُحْصِنَّ فَإِنْ أَتَيْنَ بِفَاحِشَةٍ فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ مِنَ الْعَذَابِ} [النساء: 25] قَالَ الشَّافِعِيُّ: وَالنِّصْفُ لَا يَكُونُ إِلَّا فِي الْجَلْدِ الَّذِي يَتَبَعَّضُ، فَأَمَّا الرَّجْمُ الَّذِي هُوَ قَتْلٌ فَلَا نِصْفَ لَهُ، قَالَ: وَقَالَ رَسُولُ اللهِ ﷺ: " إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا " وَلَمْ يَقُلْ: يَرْجُمْهَا
[Machine] I heard the Messenger of Allah ﷺ say: "If the slave woman of any of you commits adultery, then let him ascertain her adultery, then let him lash her with one hundred lashes and let there be no compassion for her. If she commits adultery again, then let him lash her with one hundred lashes and there be no compassion for her. If she commits adultery for the third time, then let him ascertain her adultery, then let him sell her, even for a rope of hair."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتْ فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ زَنَتِ الثَّالِثَةَ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ
[Machine] The Messenger of Allah ﷺ was asked about the slave woman who commits adultery and is not married. He said, "If she commits adultery, then flog her, and if she commits adultery again, then flog her, and if she commits adultery again, then flog her, and if she commits adultery again, then sell her, even if it is for a hair rope." Ibn Shihab said, "I do not know if it is after the third or fourth time." He said, "And the hair rope is a rope made of hair."
أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصَنْ قَالَ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ ابْنُ شِهَابٍ لَا أَدْرِي أَبْعَدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ قَالَ وَالضَّفِيرُ الْحَبْلُ
[Machine] Umar ibn al-Khattab commanded me regarding some young men from the Quraish, so we lashed them with fifty lashes each for committing adultery.
أَمَرَنِي عُمَرُ بْنُ الْخَطَّابِ ؓ فِي فِتْيَةٍ مِنْ قُرَيْشٍ فَجَلَدْنَا وَلَائِدَ مِنْ وَلَائِدِ الْإِمَارَةِ خَمْسِينَ خَمْسِينَ فِي الزِّنَا
[Machine] The Messenger of Allah ﷺ said: "If your female slaves commit adultery, then apply the prescribed punishment on them, whether they are married or not."
قَالَ رَسُولُ اللهِ ﷺ إِذَا زَنَتْ إِمَاؤُكُمْ فَأَقِيمُوا عَلَيْهِنَّ الْحُدُودَ أُحْصِنَّ أَوْ لَمْ يُحْصِنَّ
"Ali gave a Khutbah, and said: 'O people, establish the penalties upon your slaves, those married from them and those unmarried. A slave girl of the Prophet ﷺ committed illegal sexual intercourse so he ordered me to whip her. I went to her and she was just experiencing her post-natal bleeding, so I feared that if I were to whip her I would kill her' - or he said: 'She would die' - 'so I went to the Messenger of Allah ﷺ and I told that to him. So he said: 'You did well.'" (Using translation from Tirmidhī 1441)
يَا أَيُّهَا النَّاسُ أَقِيمُوا الْحُدُودَ عَلَى أَرِقَّائِكُمْ مَنْ أُحْصِنَ مِنْهُمْ وَمَنْ لَمْ يُحْصِنْ فَإِنَّ أَمَةً لِرَسُولِ اللهِ ﷺ زَنَتْ فَأَمَرَنِي أَنْ أَجْلِدَهَا فَإِذَا هِيَ حَدِيثَةُ عَهْدٍ بِالنِّفَاسِ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ تَمُوتَ فَأَتَيْتُ النَّبِيَّ ﷺ فَأَخْبَرْتُهُ قَالَ أَحْسَنْتَ لَفْظُ حَدِيثِ يُونُسَ وَفِي رِوَايَةِ الْمُقَدَّمِيِّ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ أَقْتُلَهَا فَذَكَرْتُ ذَلِكَ لِلنَّبِيِّ ﷺ فَقَالَ أَحْسَنْتَ
[Machine] I visited Ali and said to him, "Indeed, he committed an obscene act, so impose the punishment on him." He replied to me four times, then he said, "O Qanbar, go to him and strike him with one hundred lashes." I said, "Indeed, I am a slave." He said, "Strike him until he says to you to stop." So he struck him with fifty lashes. Al-Shafi'i, may Allah have mercy on him, said, "The protection of a slave's faith is established by evidence from the Sunnah and the consensus of most of the scholars."
أَتَيْتُ عَلِيًّا ؓ فَقُلْتُ لَهُ إِنَّهُ أَصَابَ فَاحِشَةً فَأَقِمْ عَلَيْهِ الْحَدَّ قَالَ فَرَدَّدَنِي أَرْبَعَ مَرَّاتٍ ثُمَّ قَالَ يَا قَنْبَرُ قُمْ إِلَيْهِ فَاضْرِبْهُ مِائَةَ سَوْطٍ فَقُلْتُ إِنِّي مَمْلُوكٌ قَالَ اضْرِبْهُ حَتَّى يَقُولَ لَكَ أَمْسِكْ فَضَرَبَهُ خَمْسِينَ سَوْطًا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَإِحْصَانُ الْأَمَةِ إِسْلَامُهَا اسْتِدْلَالًا بِالسُّنَّةِ وَإِجْمَاعِ أَكْثَرِ أَهْلِ الْعِلْمِ
وَقَالَ إِحْصَانُهَا إِسْلَامُهَا
[Machine] I witnessed Anas ibn Malik punishing his female slaves when they committed adultery, whether they were married or unmarried.
شَهِدْتُ أَنَسَ بْنَ مَالِكٍ يَضْرِبُ إِمَاءَهُ الْحَدَّ إِذَا زَنَيْنَ تَزَوَّجْنَ أَوْ لَمْ يَتَزَوَّجْنَ
[Machine] The security of a woman lies in her entering Islam and affirming it when she enters Islam and acknowledges it. If she then commits adultery, she is to be lashed fifty times. Sa'eed narrated to us, Hushaym informed us, from Mujahid, from Ibrahim, that he used to recite "Then when they are wedded" (Quran 4:25). He said: When they convert and if they are a mujahid, they recite "Then when they are wedded" (Quran 4:25) and they say: When you marry. If the woman does not marry, there is no punishment on her. Sa'eed narrated to us, Sufyan informed us, from Amr, from Mujahid, who said: Ibn Abbas said: There is no punishment on the woman until she is married. Sa'eed narrated to us, Hushaym informed us, from Hushayn, from Ikrimah, from Ibn Abbas, that he used to recite "Then when they are wedded" (Quran 4:25). He said: When they marry. This is what Ibn Abbas used to say. And we only left his statement due to what has passed from the authentic sunnah and the statements of the scholars. And with Allah is the success.
إِحْصَانُ الْأَمَةِ دُخُولُهَا فِي الْإِسْلَامِ وَإِقْرَارُهَا إِذَا دَخَلَتْ فِي الْإِسْلَامِ وَأَقَرَّتْ بِهِ ثُمَّ زَنَتْ فَعَلَيْهَا جَلْدُ خَمْسِينَ قَالَ وَحَدَّثَنَا سَعِيدٌ ثنا هُشَيْمٌ أنبأ مُغِيرَةُ عَنْ إِبْرَاهِيمَ أَنَّهُ كَانَ يَقْرَأُ {فَإِذَا أُحْصِنَّ} [النساء 25] قَالَ إِذَا أَسْلَمْنَ وَكَانَ مُجَاهِدٌ يَقْرَأُ {فَإِذَا أُحْصِنَّ} [النساء 25] يَقُولُ إِذَا تَزَوَّجْنَ فَإِذَا لَمْ تَتَزَوَّجِ الْأَمَةُ فَلَا حَدَّ عَلَيْهَا قَالَ وَحَدَّثَنَا سَعِيدٌ ثنا سُفْيَانُ عَنْ عَمْرٍو عَنْ مُجَاهِدٍ قَالَ قَالَ ابْنُ عَبَّاسٍ لَيْسَ عَلَى الْأَمَةِ حَدٌّ حَتَّى تُحْصَنَ قَالَ وَحَدَّثَنَا سَعِيدٌ ثنا هُشَيْمٌ أنبأ حُصَيْنٌ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ أَنَّهُ كَانَ يَقْرَأُ {فَإِذَا أُحْصِنَّ} [النساء 25] قَالَ إِذَا تَزَوَّجْنَ كَذَا كَانَ يَقُولُ ابْنُ عَبَّاسٍ وَإِنَّمَا تَرَكْنَا قَوْلَهُ بِمَا مَضَى مِنَ السُّنَّةِ الصَّحِيحَةِ وَأَقَاوِيلِ الْأَئِمَّةِ وَبِاللهِ التَّوْفِيقُ
55.35 [Machine] What is mentioned in the negation of the slave?
٥٥۔٣٥ بَابُ مَا جَاءَ فِي نَفْيِ الرَّقِيقِ
[Machine] That a man used to collect the khums, and he disliked a captive woman from that khums, so Umar lashed him and exiled him, but he did not lash the young girl because he disliked her. Abu Bakr ibn al-Mundhir, the companion of al-Khilafiyat, narrated from Abdullah ibn Umar that he had a female slave who committed adultery, so he exiled her to Fadak. We were also narrated from Hammad from Ibrahim that Ali said about a mother of a child who committed adultery, "She should be beaten but not exiled." And it was also narrated from Hammad from Ibrahim that Ibn Mas'ood said, "She should be beaten and exiled." Both of them are disconnected narrations. It was also narrated from Ali as it was narrated from Ibn Mas'ood, and Allah knows best.
أَنَّ عَبْدًا كَانَ يَقُومُ عَلَى رَقِيقِ الْخُمُسِ وَإِنَّهُ اسْتَكْرَهَ جَارِيَةً مِنْ ذَلِكَ الرَّقِيقِ فَوَقَعَ بِهَا فَجَلَدَهُ عُمَرُ وَنَفَاهُ وَلَمْ يَجْلِدِ الْوَلِيدَةَ؛ لِأَنَّهُ اسْتَكْرَهَهَا وَرَوَى أَبُو بَكْرِ بْنُ الْمُنْذِرِ صَاحِبُ الْخِلَافِيَّاتِ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ أَنَّهُ حَدَّ مَمْلُوكَةً لَهُ فِي الزِّنَا وَنَفَاهَا إِلَى فَدَكٍ وَرُوِّينَا عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ أَنَّ عَلِيًّا ؓ قَالَ فِي أُمِّ وَلَدٍ بَغَتْ قَالَ تُضْرَبُ وَلَا نَفْيَ عَلَيْهَا وَعَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ أَنَّ ابْنَ مَسْعُودٍ ؓ قَالَ تُضْرَبُ وَتُنْفَى وَكِلَاهُمَا مُنْقَطِعٌ وَرُوِي عَنْ عَلِيٍّ كَمَا رُوِيَ عَنِ ابْنِ مَسْعُودٍ وَاللهُ أَعْلَمُ
[Machine] About the jurists from the people of Al-Madina, they used to say that if a male slave or a female slave commits adultery, then each of them should be punished with fifty lashes, and there should be no further punishment for a slave. They also used to say that if someone who is a slave commits a hadd crime, he should not be punished until he is freed, and then the punishment for a free person is applied to him.
عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ إِذَا زَنَى الْعَبْدُ أَوِ الْأَمَةُ فَعَلَى كُلِّ وَاحِدٍ مِنْهُمَا فَعَلَ ذَلِكَ جَلْدُ خَمْسِينَ وَلَا تَغْرِيبَ عَلَى مَمْلُوكٍ وَكَانُوا يَقُولُونَ مَنْ أَصَابَ حَدًّا وَهُوَ مَمْلُوكٌ فَلَمْ يُقَمْ عَلَيْهِ حَتَّى عَتَقَ فَعَلَيْهِ حَدُّ الْمَمْلُوكِ
55.36 [Machine] The limit of a man's life when she commits adultery
٥٥۔٣٦ بَابُ حَدِّ الرَّجُلِ أَمَتَهُ إِذَا زَنَتْ
[Machine] The Messenger of Allah ﷺ was asked about a female slave who commits adultery but is not married. He said, "If she commits adultery, flog her. If she commits adultery again, flog her. Then, sell her even if it is for a rope." Ibn Shihab said, "I do not know if the third or fourth time was meant." Abu Ali Ar-Rawzbary informed us that Abu Bakr ibn Dasa narrated to us from Abu Dawud, who narrated from Abdullah ibn Muslimah from Malik, who mentioned it with a similar chain of narration except that he said it was narrated from Abu Hurairah and Zaid ibn Khalid Al-Juhani. He added, "If she commits adultery again, sell her even if it is for a rope." Ibn Shihab said, "I do not know if it was meant for the third or fourth time. The rope refers to a piece of string."
أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ الْأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصَنْ قَالَ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا ثُمَّ بِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ ابْنُ شِهَابٍ لَا أَدْرِي أبَعْدَ الثَّالِثَةِ أَوِ الرَّابِعَةِ 17099 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا عَبْدُ اللهِ بْنُ مَسْلَمَةَ عَنْ مَالِكٍ فَذَكَرَهُ بِإِسْنَادِهِ مِثْلَهُ إِلَّا أَنَّهُ قَالَ عَنْ أَبِي هُرَيْرَةَ وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ زَادَ قَالَ ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ قَالَ ابْنُ شِهَابٍ لَا أَدْرِي فِي الثَّالِثَةِ أَوِ الرَّابِعَةِ وَالضَّفِيرُ الْحَبْلُ
[Machine] "From the Messenger of Allah ﷺ who said to Al-Walidah: When she commits adultery, then flog her. When she commits adultery again, then flog her. When she commits adultery again, then flog her. When she commits adultery again, then sell her, even if it is for a rope."
عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ قَالَ لِلْوَلِيدَةِ إِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ إِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ إِذَا زَنَتْ فَاجْلِدُوهَا ثُمَّ إِذَا زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ وَالضَّفِيرُ الْحَبْلُ كَذَا
[Machine] The Prophet ﷺ said: If any of you finds his slave woman committing adultery, he should ascertain her guilt and then inflict the prescribed punishment upon her, and not add to it anything new. But if she commits adultery again, he should ascertain her guilt and then inflict the prescribed punishment upon her, and not add to it anything new. But if she commits adultery for a third time, then he should sell her, even if it is for a hair string.
أَنَّ النَّبِيَّ ﷺ قَالَ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ عَادَتْ فَزَنَتْ فَتَبَيَّنَ زِنَاهَا فَلْيَجْلِدْهَا الْحَدَّ وَلَا يُثَرِّبْ عَلَيْهَا ثُمَّ إِنْ عَادَتْ فَزَنَتْ فَتَبَيَّنَ زِنَاهَا فَلْيَبِعْهَا وَلَوْ بِضَفِيرٍ مِنْ شَعْرٍ يَعْنِي الْحَبْلَ
[Machine] The Messenger of Allah ﷺ said: If one of you's slave woman commits adultery, then lash her without blaming her. If she does it again, then lash her without blaming her. If she does it a third time, then sell her, even if it is with a rope made of hair or a braid of hair.
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِذَا زَنَتْ أَمَةُ أَحَدِكُمْ فَلْيَجْلِدْهَا وَلَا يُعِيرْهَا فَإِنْ عَادَتْ فَلْيَجْلِدْهَا وَلَا يُعِيرْهَا فَإِنْ عَادَتْ فِي الرَّابِعَةِ فَلْيَبِعْهَا وَلَوْ بِحَبْلٍ مِنْ شَعْرٍ أَوْ ضَفِيرٍ مِنْ شَعْرٍ
[Machine] "O people, whichever male or female slave commits adultery, then punish them with the specified punishment. And if they commit adultery, then flog them with the specified punishment. Then he said, indeed a servant of the Messenger of Allah ﷺ had a child from adultery, so he sent me to flog her. And I found her recently delivered and I feared that I would kill her. So he said, you have done well, leave her until she delivers her child."
أَيُّهَا النَّاسُ أَيُّمَا عَبْدٍ وَأَمَةٍ فَجَرَا فَأَقِيمُوا عَلَيْهِمَا الْحَدَّ وَإِنْ زَنَيَا فَاجْلُدُوهُمَا الْحَدَّ ثُمَّ قَالَ إِنَّ خَادِمًا لِرَسُولِ اللهِ ﷺ وَلَدَتْ مِنَ الزِّنَا فَبَعَثَنِي لِأَجْلِدَهَا فَوَجَدْتُهَا حَدِيثَةَ عَهْدٍ بِنِفَاسِهَا فَخَشِيتُ أَنْ أَقْتُلَهَا فَقَالَ أَحْسَنْتَ اتْرُكْهَا حَتَّى تَمَاثَلَ
[Machine] The Prophet ﷺ was informed about a slave woman who had become pregnant. He said, "Enforce the punishment on her." So I went, and when I found her, her blood had not dried yet. So I returned and he asked me, "Did you carry out the punishment?" I said, "I found that her blood had not dried yet." He said, "When her blood has dried, then enforce the punishment on her." The Messenger of Allah ﷺ also said, "Enforce the prescribed punishments on those under your authority." (17106) And Al-Hasan narrated to us, Ali narrated to us, Shurayk narrated to us, from Abdul-A'la and Abdullah bin Abi Jameelah, from Abu Jameelah, from Ali that a slave woman gave birth to a child from one of the wives of the Messenger of Allah ﷺ . So the Prophet ﷺ said, "Enforce the punishment on her." He mentioned it in a similar way, and it has been narrated to us from At-Thuwri from Abdul-A'la.
أُخْبِرَ النَّبِيُّ ﷺ بِأَمَةٍ فَجَرَتْ فَقَالَ أَقِمْ عَلَيْهَا الْحَدَّ فَانْطَلَقْتُ فَوَجَدْتُهَا لَمْ تَجِفَّ مِنْ دِمَائِهَا فَرَجَعْتُ فَقَالَ أَفْرَغْتَ؟ فَقُلْتُ وَجَدْتُهَا لَمْ تَجِفَّ مِنْ دِمَائِهَا قَالَ فَإِذَا جَفَّتْ مِنْ دِمَائِهَا فَأَقِمْ عَلَيْهَا الْحَدَّ قَالَ وَقَالَ رَسُولُ اللهِ ﷺ أَقِيمُوا الْحُدُودَ عَلَى مَا مَلَكَتْ أَيْمَانُكُمْ 17106 قَالَ وَحَدَّثَنَا الْحَسَنُ ثنا عَلِيٌّ ثنا شَرِيكٌ عَنْ عَبْدِ الْأَعْلَى وَعَبْدِ اللهِ بْنِ أَبِي جَمِيلَةَ عَنْ أَبِي جَمِيلَةَ عَنْ عَلِيٍّ ؓ قَالَ وَلَدَتْ أَمَةٌ لِبَعْضِ أَزْوَاجِ رَسُولِ اللهِ ﷺ فَقَالَ النَّبِيُّ ﷺ أَقِمْ عَلَيْهَا الْحَدَّ فَذَكَرَ نَحْوَهُ وَرُوِّينَا فِيمَا مَضَى عَنِ الثَّوْرِيِّ عَنْ عَبْدِ الْأَعْلَى
[Machine] That Fatima, the daughter of the Messenger of Allah ﷺ , hired a maid who committed adultery.
أَنَّ فَاطِمَةَ بِنْتَ رَسُولِ اللهِ ﷺ حَدَّتْ جَارِيَةً لَهَا زَنَتْ
[Machine] Anas ibn Malik, when his slave committed adultery, would order one of his sons to impose the punishment on him.
أَنَّ أَنَسَ بْنَ مَالِكٍ كَانَ إِذَا زَنَى مَمْلُوكُهُ أَمَرَ بَعْضَ بَنِيهِ فَأَقَامَ عَلَيْهِ الْحَدَّ
[Machine] So we said, "Where is the saying of Allah, 'And do not let their pleas in the religion of Allah ever be an excuse for you'"? He said, "I kill it, and the narration from Abdullah ibn Umar is in regards to his slave who stole something mentioned in the law of cutting off the hand when someone steals. When he stole, Al-Shafi'i (may Allah have mercy on him) said, 'And the Ansar and those who came after them used to apply it to their female slaves.'"
فَقُلْنَا أَيْنَ قَوْلُ اللهِ ﷻ {وَلَا تَأْخُذْكُمْ بِهِمَا رَأْفَةٌ فِي دِينِ اللهِ} [النور 2]؟ قَالَ أَنَا أَقْتُلُهَا وَالرِّوَايَةُ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ فِي قَطْعِهِ عَبْدًا لَهُ سَرَقَ مَذْكُورَةٌ فِي قَطْعِ الْآبِقِ إِذَا سَرَقَ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَكَانَ الْأَنْصَارُ وَمَنْ بَعْدَهُمْ يَحِدُّونَ إِمَاءَهُمْ
[Machine] I observed the remnants of the Ansar while they were striking their child from their laps in their gatherings when she misbehaves. Al-Shafi'i and Ibn Mas'ood would command that, and Abu Barza would discipline his child. The sheikh, may Allah have mercy on him, said, "The narration from Ibn Mas'ood has already passed in it."
أَدْرَكْتُ بَقَايَا الْأَنْصَارِ وَهُمْ يَضْرِبُونَ الْوَلِيدَةَ مِنْ وَلَائِدِهِمْ فِي مَجَالِسِهِمْ إِذَا زَنَتْ قَالَ الشَّافِعِيُّ وَابْنُ مَسْعُودٍ ؓ يَأْمُرُ بِهِ وَأَبُو بَرْزَةَ ؓ يَحُدُّ وَلِيدَتَهُ قَالَ الشَّيْخُ رَحِمَهُ اللهُ قَدْ مَضَتِ الرِّوَايَةُ فِيهِ عَنِ ابْنِ مَسْعُودٍ
[Machine] I witnessed Abu Barzah striking one of his servants, causing her to bleed.
شَهِدْتُ أَبَا بَرْزَةَ ضَرَبَ أَمَةً لَهُ فَجَرَتْ
أَنَّهُ حَدَّ جَارِيَةً لَهُ
[Machine] About the scholars who reach their conclusion from the people of Medina, they used to say that it is not appropriate for anyone to establish any of the prescribed punishments (hudud) without the authority (sultan), except that a man can establish the punishment of adultery on his male and female slaves.
عَنِ الْفُقَهَاءِ الَّذِينَ يَنْتَهِي إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ لَا يَنْبَغِي لِأَحَدٍ أَنْ يُقِيمَ شَيْئًا مِنَ الْحُدُودِ دُونَ السُّلْطَانِ إِلَّا أَنَّ لِلرَّجُلِ أَنْ يُقِيمَ حَدَّ الزِّنَا عَلَى عَبْدِهِ وَأَمَتِهِ
55.37 [Machine] What is stated in the limits of the dhimmis and whoever says that the imam has the option to judge between them, and if he judges, he judges according to what Allah has revealed, and whoever says that he must judge between them and he does not have the option, Al-Shafi'i, may Allah have mercy on him, said: Allah, may He be glorified and exalted, said to His Prophet, ﷺ , concerning the People of the Book: "So if they come to you, then judge between them or turn away from them." So in this verse there is a clear statement, and Allah knows best that Allah has given His Prophet, ﷺ , the option to judge between them or to turn away from them, and has imposed upon him if he judges to judge with justice. He said: And I have heard from the most satisfied of the people of knowledge who say about the saying of Allah, may He be glorified and exalted: "And judge between them by what Allah has revealed" [Al-Ma'idah: 49]: If you judge, there is no doubt that you will judge.
٥٥۔٣٧ بَابُ مَا جَاءَ فِي حَدِّ الذِّمِّيِّينَ وَمَنْ قَالَ: إِنَّ الْإِمَامَ مُخَيَّرٌ فِي الْحُكْمِ بَيْنَهُمْ، وَإِنْ حَكَمَ حَكَمَ بِمَا أَنْزَلَ اللهُ ﷻ، وَمَنْ قَالَ: عَلَيْهِ أَنْ يَحْكُمَ بَيْنَهُمْ وَلَيْسَ لَهُ الْخِيَارُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: قَالَ اللهُ ﷻ لِنَبِيِّهِ ﷺ فِي أَهْلِ الْكِتَابِ: {فَإِنْ جَاءُوكَ فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ}، فَفِي هَذِهِ الْآيَةِ بَيَانٌ وَاللهُ أَعْلَمُ أَنَّ اللهَ جَعَلَ لِنَبِيِّهِ ﷺ الْخِيَارَ فِي الْحُكْمِ بَيْنَهُمْ أَوْ يُعْرِضُ عَنْهُمْ، وَجَعَلَ عَلَيْهِ إِنْ حَكَمَ أَنْ يَحْكُمَ بَيْنَهُمْ بِالْقِسْطِ، قَالَ: وَسَمِعْتُ مَنْ أَرْضَى مِنْ أَهْلِ الْعِلْمِ يَقُولُ فِي قَوْلِ اللهِ ﷻ: {وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ} [المائدة: 49]: إِنْ حَكَمْتَ، لَا عَزْمًا أَنْ تَحْكُمَ
[Machine] Ibrahim and Sha'bi said, "When the people of the Book sought the judgement of the Muslim rulers, if they wished, they would judge between them, and if they wished, they would turn away from them. If they judged, they would judge according to what Allah revealed."
عَنْ إِبْرَاهِيمَ وَالشَّعْبِيِّ قَالَا إِذَا ارْتَفَعَ أَهْلُ الْكِتَابِ إِلَى حُكَّامِ الْمُسْلِمِينَ إِنْ شَاءَ حَكَمَ بَيْنَهُمْ وَإِنْ شَاءَ أَعْرَضَ عَنْهُمْ فَإِنْ حَكَمَ حَكَمَ بِمَا أَنْزَلَ اللهُ ﷻ
[Machine] About Ibrahim Al-Taimi in his saying "فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ" [Al-Ma'idah 42], he said by stoning.
عَنْ إِبْرَاهِيمَ التَّيْمِيِّ فِي قَوْلِهِ {فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ} [المائدة 42] قَالَ بِالرَّجْمِ
[Machine] Keep a distance between the people of the Book and their rulers, but if they come to you seeking assistance, then apply what is in your scripture upon them.
خَلُّوا بَيْنَ أَهْلِ الْكِتَابِ وَبَيْنَ حُكَّامِهِمْ فَإِنِ ارْتَفَعُوا إِلَيْكُمْ فَأَقِيمُوا عَلَيْهِمْ مَا فِي كِتَابِكُمْ
The Jews brought to the Prophet ﷺ a man and a woman from among them who had committed illegal sexual intercourse. The Prophet ﷺ said to them, "How do you usually punish the one amongst you who has committed illegal sexual intercourse?" They replied, "We blacken their faces with coal and beat them," He said, "Don't you find the order of Ar-Rajm (i.e. stoning to death) in the Torah?" They replied, "We do not find anything in it." ʿAbdullah bin Salam (after hearing this conversation) said to them. "You have told a lie! Bring here the Torah and recite it if you are truthful." (So the Jews brought the Torah). And the religious teacher who was teaching it to them, put his hand over the Verse of Ar- Rajm and started reading what was written above and below the place hidden with his hand, but he did not read the Verse of Ar-Rajm. ʿAbdullah bin Salam removed his (i.e. the teacher's) hand from the Verse of Ar-Rajm and said, "What is this?" So when the Jews saw that Verse, they said, "This is the Verse of Ar-Rajm." So the Prophet ﷺ ordered the two adulterers to be stoned to death, and they were stoned to death near the place where biers used to be placed near the Mosque. I saw her companion (i.e. the adulterer) bowing over her so as to protect her from the stones. (Using translation from Bukhārī 4556)
أَنَّ الْيَهُودَ جَاءُوا إِلَى النَّبِيِّ ﷺ بِرَجُلٍ مِنْهُمْ وَامْرَأَةٍ زَنَيَا فَقَالَ كَيْفَ تَعْمَلُونَ بِمَنْ زَنَى مِنْكُمْ؟ قَالُوا نَضْرِبُهُمَا وَنُحَمِّمُهُمَا بِأَيْدِينَا فَقَالَ مَا تَجِدُونَ فِي التَّوْرَاةِ؟ قَالُوا لَا نَجْدُ فِيهَا شَيْئًا فَقَالَ عَبْدُ اللهِ بْنُ سَلَامٍ كَذَبْتُمْ فِي التَّوْرَاةِ الرَّجْمُ فَأْتُوا بِالتَّوْرَاةِ فَاتْلُوهَا إِنْ كُنْتُمْ صَادِقِينَ فَجَاءُوا بِالتَّوْرَاةِ فَوَضَعَ مِدْرَاسُهَا الَّذِي يَدْرُسُهَا كَفَّهُ عَلَى آيَةِ الرَّجْمِ فَطَفِقَ يَقْرَأُ مَا دُونَ يَدِهِ وَمَا وَرَاءَهَا وَلَا يَقْرَأُ آيَةَ الرَّجْمِ فَضَرَبَ عَبْدُ اللهِ بْنُ سَلَامٍ يَدَهُ فَقَالَ مَا هَذَا؟ قَالَ هِيَ آيَةُ الرَّجْمِ فَأَمَرَ بِهِمَا رَسُولُ اللهِ ﷺ فَرُجِمَا قَرِيبٌ مِنْ حَيْثُ تُوضَعُ الْجَنَائِزُ قَالَ عَبْدُ اللهِ فَرَأَيْتُ صَاحِبَهَا يَحْنِي عَلَيْهَا يَقِيهَا الْحِجَارَةَ
The people passed by the Messenger of Allah ﷺ with a Jew who was blackened with charcoal and who was being flogged. He called them and said: Is this the prescribed punishment for a fornicator? They said: Yes. He then called on a learned man among them and asked him: I adjure you by Allah Who revealed the Torah to Moses, do you find this prescribed punishment for a fornicator in your divine Book? He said: By Allah, no. If you had not adjured me about this, I should not have informed you. We find stoning to be prescribed punishment for a fornicator in our Divine Book. But it (fornication) became frequent in our people of rank; so when we seized a person of rank, we left him alone, and when we seized a weak person, we inflicted the prescribed punishment on him. So we said: Come, let us agree on something which may be enforced equally on people of higher and lower rank. So we agreed to blacken the face of a criminal with charcoal, and flog him, and we abandoned stoning. The Messenger of Allah ﷺ then said: O Allah, I am the first to give life to Thy command which they have killed. So he commanded regarding him (the Jew) and he was stoned to death. Allah Most High then sent down: "O Apostle, let not those who race one another into unbelief, make thee grieve..." up to "They say: If you are given this, take it, but if not, beware!...." up to "And if any do fail to judge by (the light of) what Allah hath revealed, they are (no better than) unbelievers," about Jews, up to "And if any do fail to judge by (the right of) what Allah hath revealed, they are no better than) wrong-doers" about Jews: and revealed the verses up to "And if any do fail to judge by (the light of) what Allah hath revealed, they are (no better than) those who rebel." About this he said: This whole verse was revealed about the infidels. (Using translation from Abū Dāʾūd 4448)
مُرَّ عَلَى النَّبِيِّ ﷺ بِيَهُودِيٍّ مُحَمَّمٍ مَجْذُومٍ فَدَعَاهُمْ فَقَالَ لَهُمْ هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ؟ قَالُوا نَعَمْ فَدَعَا رَجُلًا مِنْ عُلَمَائِهِمْ فَقَالَ أَنْشُدُكَ اللهَ الَّذِي أَنْزَلَ التَّوْرَاةَ عَلَى مُوسَى هَكَذَا تَجِدُونَ حَدَّ الزَّانِي فِي كِتَابِكُمْ؟ فَقَالَ اللهُمَّ لَا وَلَوْلَا أَنَّكَ نَشَدْتَنِي بِهَذَا لَمْ أُخْبِرْكَ نَجِدُ حَدَّ الزَّانِي فِي كِتَابِنَا الرَّجْمَ وَلَكِنَّهُ كَثُرَ فِي أَشْرَافِنَا فَكُنَّا إِذَا أَخَذْنَا الشَّرِيفَ تَرَكْنَاهُ وَإِذَا أَخَذْنَا الضَّعِيفَ أَقَمْنَا عَلَيْهِ الْحَدَّ فَقُلْنَا تَعَالَوْا فَلْنَجْتَمِعْ عَلَى شَيْءٍ نُقِيمُهُ عَلَى الشَّرِيفِ وَالضَّعِيفِ فَاجْتَمَعْنَا عَلَى التَّحْمِيمِ وَالْجَلْدِ مَكَانَ الرَّجْمِ فَقَالَ رَسُولُ اللهِ ﷺ اللهُمَّ إِنِّي أَوَّلُ مَنْ أَحْيَا أَمْرًا إِذْ أَمَاتُوهُ فَأَمَرَ بِهِ فَرُجِمَ فَأَنْزَلَ اللهُ ﷻ {يَا أَيُّهَا الرَّسُولُ لَا يَحْزُنْكَ الَّذِينَ يُسَارِعُونَ فِي الْكُفْرِ} [المائدة 41] إِلَى قَوْلِهِ {يَقُولُونَ إِنْ أُوتِيتُمْ هَذَا فَخُذُوهُ} [المائدة 41] يَقُولُونَ ائْتُوا مُحَمَّدًا فَإِنْ أَفْتَاكُمْ بِالتَّحْمِيمِ وَالْجَلْدِ فَخُذُوهُ وَإِنْ أَفْتَاكُمْ بِالرَّجْمِ فَاحْذَرُوا إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ} [المائدة 44] قَالَ فِي الْيَهُودِ إِلَى قَوْلِهِ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الظَّالِمُونَ} [المائدة 45] قَالَ فِي الْيَهُودِ قَالَ قَوْلُهُ {وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْزَلَ اللهُ فَأُولَئِكَ هُمُ الْفَاسِقُونَ} [المائدة 47] قَالَ فِي الْكُفَّارِ كُلُّهَا
[Machine] That the Jewish scholars gathered in the house of the school when the Messenger of Allah ﷺ arrived in the city, and one of them committed adultery with a woman from the Jews who had been chaste. They said, "Take this man and this woman to Muhammad and ask him how to judge them." So, they brought him to the Messenger of Allah ﷺ and said, "O Muhammad, this man has committed adultery with a woman whom you have declared chaste, so judge between them, as we have entrusted the judgment to you." The Messenger of Allah ﷺ went until he reached their Jewish scholars in the house of the school, and he said, "O Jewish people, bring forth your most knowledgeable person to me." They brought Abdullah ibn Suriyah al-Awar and some of the Banu Quraizah claimed that they also brought Abu Yasir ibn Akhtab and Wahb ibn Yahuda. They said, "These are our scholars." The Messenger of Allah ﷺ said to them when he found out about their deceptive intentions, "O Ibn Suriyah, I ask you by Allah and remind you of the days of Bani Israel, do you know that Allah has prescribed stoning as a punishment for those who commit adultery after being chaste according to the Torah?" Ibn Suriyah replied, "Yes, by Allah, O Aba Al-Qasim, they know that you are a sent prophet, but they envy you." So, the Messenger of Allah ﷺ ordered that they be stoned to death at the gate of his mosque in the house of Banu Ghannam bin Malik. After that, Ibn Suriyah apostatized. Then Allah revealed the verse, "O Messenger, let not those who hurry to disbelief grieve you - of those who say, 'We believe' with their mouths, but their hearts believe not, and from among the Jews. [They are] avid listeners to falsehood, listening to another people who have not come to you. They distort words beyond their [proper] usages, saying, 'If you are given this, take it; but if you are not given it, then beware.' And he for whom Allah intends fitnah - never will you possess [power to do] for him a thing against Allah. Those are the ones for whom Allah does not intend to purify their hearts. For them in this world is disgrace, and for them in the Hereafter is a great punishment." (Quran 5:41)
أَنَّ أَحْبَارَ يَهُودَ اجْتَمَعُوا فِي بَيْتِ الْمِدْرَاسِ حِينَ قَدِمَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ وَقَدْ زَنَى مِنْهُمْ رَجُلٌ بَعْدَ إِحْصَانِهِ بِامْرَأَةٍ مِنَ الْيَهُودِ قَدْ أَحْصَنَتْ فَقَالَ انْطَلِقُوا بِهَذَا الرَّجُلِ وَبِهَذِهِ الْمَرْأَةِ إِلَى مُحَمَّدٍ فَسَلُوهُ كَيْفَ الْحَكَمُ فِيهِمَا؟ وَوَلُّوهُ الْحُكْمَ عَلَيْهِمَا فَإِنْ عَمِلَ بِعَمَلِكُمْ فِيهِمَا مِنَ التَّجْبِيَةِ وَهُوَ الْجَلْدُ بِحَبْلٍ مِنْ لِيفٍ مَطْلِيٍّ بِقَارٍ ثُمَّ يُسَوَّدُ وُجُوهُهُمَا ثُمَّ يُحْمَلَانِ عَلَى حِمَارَيْنِ وَيُحَوَّلُ وُجُوهُهُمَا مِنْ قُبُلٍ إِلَى دُبُرِ الْحِمَارِ فَاتَّبِعُوهُ وَصَدِّقُوهُ فَإِنَّمَا هُوَ مَلِكٌ وَإِنْ هُوَ حَكَمَ فِيهِمَا بِالرَّجْمِ فَاحْذَرُوا عَلَى مَا فِي أَيْدِيكُمْ أَنْ يَسْلُبَكُمُوهُ فَأَتَوْهُ فَقَالُوا يَا مُحَمَّدُ هَذَا الرَّجُلُ قَدْ زَنَى بَعْدَ إِحْصَانِهِ بِامْرَأَةٍ قَدْ أَحْصَنْتَ فَاحْكُمْ فِيهِمَا فَقَدْ وَلَّيْنَاكَ الْحُكْمَ فِيهِمَا فَمَشَى رَسُولُ اللهِ ﷺ حَتَّى أَتَى أَحْبَارَهُمْ فِي بَيْتِ الْمِدْرَاسِ فَقَالَ يَا مَعْشَرَ يَهُودَ أَخْرِجُوا إِلِيَّ أَعْلَمَكُمْ فَأَخْرَجُوا إِلَيْهِ عَبْدَ اللهِ بْنَ صُورِيَا الْأَعْوَرَ وَقَدْ رَوَى بَعْضُ بَنِي قُرَيْظَةَ أَنَّهُمْ أَخْرَجُوا إِلَيْهِ يَوْمَئِذٍ مَعَ ابْنِ صُورِيَا أَبَا يَاسِرِ بْنَ أَخْطَبَ وَوَهْبَ بْنَ يَهُوذَا فَقَالُوا هَؤُلَاءِ عُلَمَاؤُنَا فَقَالَ لَهُمْ رَسُولُ اللهِ ﷺ حِينَ خَطِلَ أَمْرُهُمْ إِلَى أَنْ قَالُوا لِابْنِ صُورِيَا هَذَا أَعْلَمُ مَنْ بَقِيَ بِالتَّوْرَاةِ فَخَلَا بِهِ رَسُولُ اللهِ ﷺ وَكَانَ غُلَامًا شَابًّا مِنْ أَحْدَثِهِمْ سِنًّا فَأَلَظَّ بِهِ الْمَسْأَلَةَ رَسُولُ اللهِ ﷺ يَقُولُ لَهُ يَا ابْنَ صُورِيَا أَنْشُدُكَ اللهَ وَأُذَكِّرُكَ أَيَّامَهُ عِنْدَ بَنِي إِسْرَائِيلَ هَلْ تَعْلَمُ أَنَّ اللهَ حَكَمَ فِيمَنْ زَنَى بَعْدَ إِحْصَانِهِ بِالرَّجْمِ فِي التَّوْرَاةِ؟ فَقَالَ اللهُمَّ نَعَمْ أَمَا وَاللهِ يَا أَبَا الْقَاسِمِ إِنَّهُمْ لَيَعْرِفُونَ أَنَّكَ نَبِيُّ مُرْسَلٌ وَلَكِنَّهُمْ يَحْسِدُونَكَ فَخَرَجَ رَسُولُ اللهِ ﷺ فَأَمَرَ بِهِمَا فَرُجِمَا عِنْدَ بَابِ مَسْجِدِهِ فِي بَنِي غَنْمِ بْنِ مَالِكِ بْنِ النَّجَّارِ ثُمَّ كَفَرَ بَعْدَ ذَلِكَ ابْنُ صُورِيَا فَأَنْزَلَ اللهُ ﷻ {يَا أَيُّهَا الرَّسُولُ لَا يَحْزُنْكَ الَّذِينَ يُسَارِعُونَ فِي الْكُفْرِ} [المائدة 41] إِلَى قَوْلِهِ {سَمَّاعُونَ لِقَوْمٍ آخَرِينَ لَمْ يَأْتُوكَ} [المائدة 41] يَعْنِي الَّذِينَ لَمْ يَأْتُوهُ وَبَعَثُوا وَتَخَلَّفُوا وَأَمَرُوهُمْ بِمَا أَمَرُوهُمْ بِهِ مِنْ تَحْرِيفِ الْحُكْمِ عَنْ مَوَاضِعِهِ قَالَ {يُحَرِّفُونَ الْكَلِمَ مِنْ بَعْدِ مَوَاضِعِهِ يَقُولُونَ إِنْ أُوتِيتُمْ هَذَا فَخُذُوهُ} [المائدة 41] لِلتَّجْبِيَةِ {وَإِنْ لَمْ تُؤْتَوْهُ} [المائدة 41] أَيِ الرَّجْمِ {فَاحْذَرُوا} [المائدة 41] إِلَى آخِرِ الْقِصَّةِ 17120 وَأَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ أنبأ أَبُو بَكْرِ بْنُ دَاسَةَ ثنا أَبُو دَاوُدَ ثنا عَبْدُ الْعَزِيزِ بْنُ يَحْيَى أَبُو الْأَصْبَغِ الْحَرَّانِيُّ حَدَّثَنِي مُحَمَّدُ بْنُ سَلَمَةَ عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ عَنِ الزُّهْرِيِّ قَالَ سَمِعْتُ رَجُلًا مِنْ مُزَيْنَةَ يُحَدِّثُ سَعِيدَ بْنَ الْمُسَيِّبِ عَنْ أَبِي هُرَيْرَةَ قَالَ زَنَى رَجُلٌ وَامْرَأَةٌ مِنَ الْيَهُودِ وَقَدْ أُحْصِنَا حِينَ قَدِمَ رَسُولُ اللهِ ﷺ الْمَدِينَةَ وَقَدْ كَانَ الرَّجْمُ مَكْتُوبًا عَلَيْهِمْ فِي التَّوْرَاةِ فَتَرَكُوهُ وَأَخَذُوا بِالتَّجْبِيَةِ يُضْرَبُ مِائَةً بِحَبْلٍ مَطْلِيٍّ بِقَارٍ يُحْمَلُ عَلَى حِمَارٍ وَوَجْهُهُ مِمَّا يَلِي دُبُرَ الْحِمَارِ فَاجْتَمَعَ أَحْبَارٌ مِنْ أَحْبَارِهِمْ فَبَعَثُوا قَوْمًا آخَرِينَ إِلَى رَسُولِ اللهِ ﷺ فَقَالُوا سَلُوهُ عَنْ حَدِّ الزَّانِي قَالَ وَسَاقَ الْحَدِيثَ قَالَ فِيهِ قَالَ وَلَمْ يَكُونُوا مِنْ أَهْلِ دِينِهِ فَيَحْكُمَ بَيْنَهُمْ فَخُيِّرَ فِي ذَلِكَ قَالَ {فَإِنْ جَاءُوكَ فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ}
[Machine] "To establish the punishment upon the Muslim and return the Christian to their religion," Al-Shafi'i said, "If this is confirmed for you, it indicates to you that the imam has the choice to rule between them or to leave the judgment to them, so he rejected the hadith of Bajalah."
أَنْ أَقِمِ الْحَدَّ عَلَى الْمُسْلِمِ وَادْفَعِ النَّصْرَانِيَّةَ إِلَى أَهْلِ دِينِهَا قَالَ الشَّافِعِيُّ فَإِنْ كَانَ هَذَا ثَابِتًا عِنْدَكَ فَهُوَ يَدُلُّكَ عَلَى أَنَّ الْإِمَامَ مُخَيَّرٌ فِي أَنْ يَحْكُمَ بَيْنَهُمْ أَوْ يَتْرُكَ الْحُكْمَ عَلَيْهِمْ فَعُورِضَ بِحَدِيثِ بَجَالَةَ
[Machine] That the Prophet ﷺ received it from the Magi of Hijar 17123. Abu Sa'id informed us, Abu al-Abbas informed us, Al-Rabi' said: Al-Shafi'i said: I said to him, "It is the narration of an unknown man who is not well-known, and we do not rely on the narration of an unknown person. We do not know that Jaziyyah ibn Mu'awiya was an agent of Umar ibn al-Khattab." Then he continued his speech until he said, "And we do not know anyone of the people of knowledge who narrated from the Messenger of Allah ﷺ except in the two incidents of the two stonings. And we do not know anyone among his companions who narrated from him except what Jaziyyah narrated that is in agreement with the ruling of Islam, and Simak ibn Harb narrated from Ali that is in agreement with our saying that the Imam does not have the right to rule except as he wants. And these two narrations, although they do not contradict us, are not well-known to us. And we hope not to be among those who use their arguments against those who disagree with them to accept the report of someone whose report is not confirmed according to their knowledge. Thus said al-Shafi'i, may Allah have mercy on him, in the book of Al-Hudud, and he mentioned in the book of Al-Jizyah that the Imam does not have the option in any of the treaties with Muslims who come to him in the punishment of Allah, and it is his duty to impose it, and he relied on the saying of Allah, "Until they give the Jizyah willingly, while they are humbled." (Surah At-Tawbah: 29). He said, "Thus, the adults, and Allah knows best, are subject to the ruling of Islam." He mentioned in this book the Hadith of Bajalah in Al-Jizyah and said that the Hadith of Bajalah is connected and proven, as he witnessed the time of Umar, and he was a man in his time writing for his workers. It is as if Al-Shafi'i, may Allah have mercy on him, did not know the status of Bajalah ibn Abd, and it is said Ibn Abdah when he wrote the book of Al-Hudud and then stood on it when he wrote the book of Al-Jizyah, if he wrote it after. The Hadith of Bajalah is one of the matters on which Al-Bukhari and Muslim differ, so Muslim left it, and Al-Bukhari included it in the Sahih, narrated by Ali ibn Abdullah al-Madini, from Sufyan ibn Uyaynah. And the Hadith of Ali is Mursal, and Qabous ibn Mukhariq is not used as evidence. And Allah knows best. Al-Shafi'i, may Allah have mercy on him, said in the old book of Al-Qada', and some of the scholars claimed that Awf al-Arabi narrated it from Al-Hasan.
أَنَّ النَّبِيَّ ﷺ أَخَذَهَا مِنْ مَجُوسِ هَجَرَ 17123 أَخْبَرَنَا أَبَو سَعِيدٍ ثنا أَبُو الْعَبَّاسِ ثنا الرَّبِيعُ قَالَ قَالَ الشَّافِعِيُّ فَقُلْتُ لَهُ بَجَالَةُ رَجُلٌ مَجْهُولٌ وَلَيْسَ بِالْمَشْهُوَرِ وَلَسْنَا نَحْتَجُّ بِرِوَايَةِ مَجْهُولٍ وَلَا نَعْرِفُ أَنْ جَزِيَّ بْنَ مُعَاوِيَةَ كَانَ عَامِلًا لِعُمَرَ بْنِ الْخَطَّابِ ؓ ثُمَّ سَاقَ الْكَلَامَ عَلَيْهِ إِلَى أَنْ قَالَ وَلَا نَعْلَمُ أَحَدًا مِنْ أَهْلِ الْعِلْمِ رَوَى عَنْ رَسُولِ اللهِ ﷺ الْحُكْمَ بَيْنَهُمْ إِلَّا فِي الْمُوَادَعَيْنِ اللَّذَيْنِ رُجِمَا وَلَا نَعْلَمُ عَنْ أَحَدٍ مِنْ أَصْحَابِهِ بَعْدَهُ إِلَّا مَا رَوَى بَجَالَةُ مِمَّا يُوَافِقُ حُكْمَ الْإِسْلَامِ وَسِمَاكُ بْنُ حَرْبٍ عَنْ عَلِيٍّ ؓ مِمَّا يُوَافِقُ قَوْلَنَا فِي أَنَّهُ لَيْسَ لِلْإِمَامِ أَنْ يَحْكُمَ إِلَّا أَنْ يَشَاءَ وَهَاتَانِ الرُّوَايَتَانِ وَإِنْ لَمْ تُخَالِفْنَا غَيْرُ مَعْرُوفَتَيْنِ عِنْدَنَا وَنَحْنُ نَرْجُو أَنْ لَا نَكُونَ مِمَّنْ تَدَعُوهُ الْحُجَّةُ عَلَى مَنْ خَالَفَهُ إِلَى قَبُولِ خَبَرِ مَنْ لَا يَثْبُتُ خَبَرُهُ بِمَعْرِفَتِهِ عِنْدَهُ كَذَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي كِتَابِ الْحُدُودِ وَنَصَّ فِي كِتَابِ الْجِزْيَةِ عَلَى أَنْ لَيْسَ لِلْإِمَامِ الْخِيَارُ فِي أَحَدٍ مِنَ الْمُعَاهِدِينَ الَّذِينَ يَجْرِي عَلَيْهِمُ الْحُكْمُ إِذَا جَاءُوهُ فِي حَدِّ اللهِ وَعَلَيْهِ أَنْ يُقِيمَهُ وَاحْتَجَّ بِقَوْلِ اللهِ ﷻ {حَتَّى يُعْطُوا الْجِزْيَةَ عَنْ يَدٍ وَهُمْ صَاغِرُونَ} [التوبة 29] قَالَ فَكَانَ الصَّغَارُ وَاللهُ أَعْلَمُ أَنْ يَجْرِيَ عَلَيْهِمْ حُكْمُ الْإِسْلَامِ وَذَكَرَ فِي هَذَا الْكِتَابِ حَدِيثَ بَجَالَةَ فِي الْجِزْيَةِ وَقَالَ حَدِيثُ بَجَالَةَ مُتَّصِلٌ ثَابِتٌ؛ لِأَنَّهُ أَدْرَكَ عُمَرَ ؓ وَكَانَ رَجُلًا فِي زَمَانِهِ كَاتِبًا لِعُمَّالِهِ وَكَأَنَّ الشَّافِعِيَّ رَحِمَهُ اللهُ لَمْ يَقِفْ عَلَى حَالِ بَجَالَةَ بْنِ عَبْدٍ وَيُقَالُ ابْنُ عَبْدَةَ حِينَ صَنَّفَ كِتَابَ الْحُدُودِ ثُمَّ وَقَفَ عَلَيْهِ حِينَ صَنَّفَ كِتَابَ الْجِزْيَةِ إِنْ كَانَ صَنَّفَهُ بَعْدَهُ وَحَدِيثُ بَجَالَةَ أَحَدُ مَا اخْتَلَفَ فِيهِ الْبُخَارِيُّ وَمُسْلِمٌ فَتَرَكَهُ مُسْلِمٌ وَأَخْرَجَهُ الْبُخَارِيُّ فِي الصَّحِيحِ عَنْ عَلِيِّ بْنِ عَبْدِ اللهِ الْمَدِينِيِّ عَنْ سُفْيَانَ بْنِ عُيَيْنَةَ وَحَدِيثُ عَلِيٍّ ؓ مُرْسَلٌ وَقَابُوسُ بْنُ مُخَارِقٍ غَيْرُ مُحْتَجٍّ بِهِ وَاللهُ أَعْلَمُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ فِي الْقَدِيمِ فِي كِتَابِ الْقَضَاءِ وَقَدْ زَعَمَ بَعْضُ الْمُحَدِّثِينَ عَنْ عَوْفٍ الْأَعْرَابِيِّ عَنِ الْحَسَنِ
[Machine] Between the Magi and what they have in common with the women who are not united by anyone from the people of different religions other than themselves? Adi asked Al-Hasan, who informed him that the Messenger of Allah ﷺ had accepted the jizyah from the Magi of the people of Bahrain and acknowledged their Magian beliefs. The Messenger of Allah ﷺ dealt with Al-‘Alā bin Al-Hadrami in Bahrain, and Abu Bakr (may Allah be pleased with him) after the Messenger of Allah ﷺ , and ‘Umar (may Allah be pleased with him) after Abu Bakr, and ‘Uthman (may Allah be pleased with him) after ‘Umar. The sheikh (may Allah have mercy on him) said, "This narrative only indicates that they are left alone and their affairs are left between them as long as they do not bring their disputes to us. But if they raise their dispute to us, we will judge among them according to what Allah has revealed. It has been narrated from Ibn Abbas that the verse of choice in judgment has been abrogated."
بَيْنَ الْمَجُوسِ وَبَيْنَ مَا يَجْمَعُونَ مِنَ النِّسَاءِ اللَّاتِي لَا يَجْمَعُهُنَّ أَحَدٌ مِنْ أَهْلِ الْمِلَلِ غَيْرُهُمْ؟ قَالَ فَسَأَلَ عَدِيٌّ الْحَسَنَ فَأَخْبَرَهُ أَنَّ رَسُولَ اللهِ ﷺ قَدْ قَبِلَ مِنْ مَجُوسِ أَهْلِ الْبَحْرَيْنِ الْجِزْيَةَ وَأَقَرَّهُمْ عَلَى مَجُوسِيَّتِهِمْ وَعَامِلُ رَسُولِ اللهِ ﷺ عَلَى الْبَحْرَيْنِ الْعَلَاءُ بْنُ الْحَضْرَمِيِّ وَأَقَرَّهُمْ أَبُو بَكْرٍ ؓ بَعْدَ رَسُولِ اللهِ ﷺ وَأَقَرَّهُمْ عُمَرُ بَعْدَ أَبِي بَكْرٍ ؓ وَأَقَرَّهُمْ عُثْمَانُ ؓ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَهَذَا الْأَثَرُ إِنَّمَا يَدُلُّ عَلَى أَنَّهُمْ يُتْرَكُونَ وَأَمْرَهُمْ فِيمَا بَيْنَهُمْ مَا لَمْ يَتَحَاكَمُوا إِلَيْنَا فَإِذَا تَرَافَعُوا إِلَيْنَا فِي حُكْمٍ حَكَمْنَا بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ ﷻ وَقَدْ رُوِيَ عَنِ ابْنِ عَبَّاسٍ ؓ مَا دَلَّ عَلَى أَنَّ آيَةَ التَّخْيِيرِ فِي الْحُكْمِ صَارَتْ مَنْسُوخَةً
[Machine] There are two verses in this Surah that have been abrogated, meaning Surah Al-Ma'idah, verse 42: "So judge between them or turn away from them." The Prophet ﷺ was given the choice to either judge between them or turn away from them and leave their affairs to their rulers. Then verse 49 was revealed: "And judge between them by what Allah has revealed and do not follow their inclinations." The Prophet ﷺ was commanded to judge between them by what was revealed in our Book. This was also narrated by 'Atiyyah al-'Awfi from Ibn 'Abbas in regards to ruling, and 'Ikrimah also mentioned it.
آيَتَانِ نُسِخَتَا مِنْ هَذِهِ السُّورَةِ يَعْنِي الْمَائِدَةَ آيَةُ الْقَلَائِدِ وَقَوْلُهُ {فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ} [المائدة 42] قَالَ فَكَانَ رَسُولُ اللهِ ﷺ مُخَيَّرًا إِنْ شَاءَ حَكَمَ بَيْنَهُمْ وَإِنْ شَاءَ أَعْرَضَ عَنْهُمْ فَرَدَّهُمْ إِلَى حُكَّامِهِمْ قَالَ ثُمَّ نَزَلَتْ {وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ} [المائدة 49] قَالَ فَأُمِرَ النَّبِيُّ ﷺ أَنْ يَحْكُمَ بَيْنَهُمْ بِمَا فِي كِتَابِنَا وَرَوَاهُ أَيْضًا عَطِيَّةُ الْعَوْفِيُّ عَنِ ابْنِ عَبَّاسٍ فِي الْحُكْمِ وَهُوَ قَوْلُ عِكْرِمَةَ
[Machine] "And judge between them by what Allah has revealed and do not follow their desires." [Al-Ma'idah 49]
{وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ} [المائدة 49]
