[Machine] That a man used to collect the khums, and he disliked a captive woman from that khums, so Umar lashed him and exiled him, but he did not lash the young girl because he disliked her. Abu Bakr ibn al-Mundhir, the companion of al-Khilafiyat, narrated from Abdullah ibn Umar that he had a female slave who committed adultery, so he exiled her to Fadak. We were also narrated from Hammad from Ibrahim that Ali said about a mother of a child who committed adultery, "She should be beaten but not exiled." And it was also narrated from Hammad from Ibrahim that Ibn Mas'ood said, "She should be beaten and exiled." Both of them are disconnected narrations. It was also narrated from Ali as it was narrated from Ibn Mas'ood, and Allah knows best.
أَنَّ عَبْدًا كَانَ يَقُومُ عَلَى رَقِيقِ الْخُمُسِ وَإِنَّهُ اسْتَكْرَهَ جَارِيَةً مِنْ ذَلِكَ الرَّقِيقِ فَوَقَعَ بِهَا فَجَلَدَهُ عُمَرُ وَنَفَاهُ وَلَمْ يَجْلِدِ الْوَلِيدَةَ؛ لِأَنَّهُ اسْتَكْرَهَهَا وَرَوَى أَبُو بَكْرِ بْنُ الْمُنْذِرِ صَاحِبُ الْخِلَافِيَّاتِ عَنْ عَبْدِ اللهِ بْنِ عُمَرَ أَنَّهُ حَدَّ مَمْلُوكَةً لَهُ فِي الزِّنَا وَنَفَاهَا إِلَى فَدَكٍ وَرُوِّينَا عَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ أَنَّ عَلِيًّا ؓ قَالَ فِي أُمِّ وَلَدٍ بَغَتْ قَالَ تُضْرَبُ وَلَا نَفْيَ عَلَيْهَا وَعَنْ حَمَّادٍ عَنْ إِبْرَاهِيمَ أَنَّ ابْنَ مَسْعُودٍ ؓ قَالَ تُضْرَبُ وَتُنْفَى وَكِلَاهُمَا مُنْقَطِعٌ وَرُوِي عَنْ عَلِيٍّ كَمَا رُوِيَ عَنِ ابْنِ مَسْعُودٍ وَاللهُ أَعْلَمُ
