26. The Found
٢٦۔ كِتَابُ اللُّقَطَةِ
'Abd al-Rahman b. 'Uthman al-Taimi reported that Messenger of Allah ﷺ forbade taking into custody the stray thing of the pilgrims. (Using translation from Muslim 1724)
أَنَّ رَسُولَ اللهِ ﷺ «نَهَى عَنْ لُقَطَةِ الْحَاجِّ»
[Machine] On the authority of the Messenger of Allah ﷺ , he said, "Whoever takes something found is considered lost until he identifies it."
عَنْ رَسُولِ اللهِ ﷺ قَالَ «مَنْ أَخَذَ لُقَطَةً فَهُوَ ضَالٌّ مَا لَمْ يُعَرِّفْهَا»
“When Mughirah bin Shu’bah fought alongside the Prophet ﷺ he would carry a spear, and when he would come back he would throw his spear down so that someone would pick it up and give it back to him.” ‘Ali said to him: “I will tell the Messenger of Allah ﷺ about that.” He (the Prophet ﷺ) said: “Do not do that, for it you do that it will not be picked up as a lost item to be returned.” (Using translation from Ibn Mājah 2809)
كَانَ الْمُغِيرَةُ بْنُ شُعْبَةَ إِذَا غَزَا مَعَ النَّبِيِّ ﷺ حَمَلَ مَعَهُ رُمْحًا فَإِذَا رَجَعَ طَرَحَهُ كَيْمَا يَحْمِلُ فَقَالَ لَهُ عَلِيٌّ لَأَذْكُرَنَّ هَذَا لِلنَّبِيِّ ﷺ فَقَالَ «لَا تَفْعَلْ فَإِنَّكَ إِذَا فَعَلْتَ بِهَا فَلَمْ تَحْمِلْ ضَالَّةً»
26.2 [Machine] The witness of the scene and mentioning the disagreement between Khalid Al-Hadda and Al-Jurairi over Yazid bin Abdullah in the narration of Ayyad bin Himar's hadith in it.
٢٦۔٢ الْإِشْهَادُ عَلَى اللُّقَطَةِ وَذِكْرُ اخْتِلَافِ خَالِدٍ الْحَذَّاءِ، وَالْجُرَيْرِيِّ عَلَى يَزِيدَ بْنِ عَبْدِ اللهِ فِي حَدِيثِ عِيَاضِ بْنِ حِمَارٍ فِيهِ
[Machine] The Messenger of Allah, ﷺ , said, "Whoever finds a lost item, should testify to its ownership, take care of its keys and locks, and not hide or conceal it. If the owner comes forward, then it should be returned to them. But if the owner does not come forward, then it will be considered as the property of Allah, who gives it to whomsoever He wills."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ «مَنْ أَخَذَ لُقَطَةً فَلْيُشْهِدْ ذَوِي عَدْلٍ وَلْيَحْفَظْ عِفَاصَهَا وَوِكَاءَهَا وَلَا يَكْتُمْ وَلَا يُغَيِّبْ فَإِنْ جَاءَ صَاحِبُهَا فَهُوَ أَحَقُّ بِهَا وَإِنْ لَمْ يَجِئْ صَاحِبُهَا فَهُوَ مَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ»
[Machine] The Messenger of Allah ﷺ was asked about lost property, and he said, "It should be announced and not hidden or kept secret. If its owner comes, then it belongs to him. Otherwise, it is the property of Allah, and He gives it to whom He wills."
أَنَّ رَسُولَ اللهِ ﷺ سُئِلَ عَنِ اللُّقَطَةِ فَقَالَ «تُعَرَّفُ وَلَا تُغَيَّبُ وَلَا تُكْتَمْ فَإِنْ جَاءَ صَاحِبُهَا فَهُوَ لَهُ وَإِلَّا فَهُوَ مَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ»
[Machine] While we were with the Messenger of Allah ﷺ during one of his journeys, there was a shortage of provisions. People were discussing the matter among themselves during midday, so I said, "O Messenger of Allah, I know what will suffice us for midday." He asked, "What will suffice us?" I replied, "Some barley bread that we can have with our meals so that we can have enough energy." He said, "Do not become infidels by burning yourselves with the fire. Do not approach it." He repeated this three times, then he said, "You will find some leftover food, so recite the appropriate supplication for it. If you know it, say it, and if not, then may Allah provide it to whoever He wills."
بَيْنَا نَحْنُ مَعَ رَسُولِ اللهِ ﷺ فِي بَعْضِ أَسْفَارِهِ وَفِي الظَّهْرِ قِلَّةٌ تَذَاكَرَ الْقَوْمُ الظَّهْرَ بَيْنَهُمْ قُلْتُ يَا رَسُولَ اللهِ لَقَدْ عَلِمْتُ مَا يَكْفِينَا مِنَ الظَّهْرِ قَالَ «مَا يَكْفِينَا؟» قُلْتُ ذَوْدٌ يَعْنِي نَأْتِي عَلَيْهِنَّ فَنَتَوَسَّعُ بِظُهُورِهِنَّ فَقَالَ «لَا ضَالَّةُ الْمُسْلِمِ حَرَقُ النَّارِ فَلَا تَقْرَبَنَّهَا» ثَلَاثًا قَالَ «اللُّقَطَةُ وَالضَّالَّةُ تَجِدُهَا فَأَنْشِدْهَا فَإِنْ عَرَفْتَ فَأَدِّهَا وَإِلَّا فَمَالُ اللهِ يُؤْتِيهِ مَنْ يَشَاءُ»

٢٦۔٣ الْأَمْرُ بِتَعْرِيفِ اللُّقَطَةِ، وَذِكْرُ اخْتِلَافِ النَّاقِلِينَ لِلْخَبَرِ فِي ذَلِكَ
[Machine] The Messenger of Allah ﷺ was asked about lost property. He said, "Identify it for a year. If it is not identified, then identify its rope and container. Then consume it, but if its owner comes, give it back to him." [346] 5780 narrated by Harun bin Abdullah, narrated by Ibn Abi Fudayk and Abu Bakr Al-Hanafi, both narrated by Ad-Dhahak bin Uthman bin Jabir.
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ قَالَ «عَرِّفْهَا سَنَةً فَإِنْ لَمْ تَعْرِفْ فَاعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ كُلْهَا فَإِنْ جَاءَ صَاحِبُهَا فَأَدِّهَا إِلَيْهِ» [346] 5780 عَنْ هَارُونَ بْنِ عَبْدِ اللهِ عَنْ ابْنِ أَبِي فُدَيْكٍ وَأَبِي بَكْرٍ الْحَنَفِيِّ كِلَاهُمَا عَنِ الضَّحَّاكِ بْنِ عُثْمَانَ بِهِ
[Machine] A man asked the Prophet ﷺ about the lost camel and asked him about the found camel. He said, "Know its humps, its bridle, and its number. Then describe it publicly for a year. If its owner comes, and he describes its humps, its bridle, and its number, then give it to him."
أَنَّ رَجُلًا سَأَلَ النَّبِيَّ ﷺ عَنْ ضَالَّةِ الْإِبِلِ وَسَأَلَهُ عَنِ اللُّقَطَةِ قَالَ «اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا وَعَدَدَهَا ثُمَّ عَرِّفْهَا عَامًا فَإِنْ جَاءَ صَاحِبُهَا فَعَرَفَ عِفَاصَهَا وَعَدَدَهَا وَوِكَاءَهَا فَأَعْطِهِ إِيَّاهَا»
[Machine] "The Prophet ﷺ was asked about the found item, so he said, 'Identify its container and its tie, and announce it for a year. If it is claimed, give it back to its owner; otherwise, mix it with your own property.'"
أَنَّ النَّبِيَّ ﷺ سُئِلَ عَنِ اللُّقَطَةِ فَقَالَ «اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا وَعَرِّفْهَا سَنَةً فَإِنِ اعْتُرِفَتْ وَإِلَّا فَاخْلِطْهَا بِمَالِكَ»
[Machine] A man came to the Messenger of Allah ﷺ and asked him about "lukata" (a lost item). He said, "Recognize its strap and its tied knot, then describe it for a year. If its owner comes, give it back to him, otherwise, it is yours."
جَاءَ رَجُلٌ إِلَى رَسُولِ اللهِ ﷺ فَسَأَلَهُ عَنِ اللُّقَطَةِ فَقَالَ «اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ عَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَشَأْنُكَ بِهَا»
[Machine] A man asked the Messenger of Allah ﷺ about Luqata (lost and found items), so he said, "Announce it for a year, then recognize its description and features, then spend it. If its owner comes, give it back to him." Abu Abdul Rahman told us, and this hadith was narrated from Ismail bin Umayyah from Rabee'ah from Abdullah bin Yazid from a man sent with another wording.
أَنَّ رَجُلًا سَأَلَ رَسُولَ اللهِ ﷺ عَنِ اللُّقَطَةِ فَقَالَ «عَرِّفْهَا سَنَةً ثُمَّ اعْرِفْ وِكَاءَهَا وَعِفَاصَهَا ثُمَّ اسْتَنْفِقْ فَإِنْ جَاءَ صَاحِبُهَا فَأَدِّهَا إِلَيْهِ» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ وَقَدْ رُوِيَ هَذَا الْحَدِيثُ عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ عَنْ رَبِيعَةَ عَنْ عَبْدِ اللهِ بْنِ يَزِيدَ عَنْ رَجُلٍ مُرْسَلٍ بِلَفْظٍ آخَرَ
[Machine] About a man from the companions of the Prophet ﷺ , from the Prophet ﷺ , that he was asked about a lost item, so he said: "Recognize its strap and its pouch, and then announce it for three days at the door of the mosque. If its owner comes, give it to him, and if he doesn't come, keep it for a year, and if its owner comes, give it to him, otherwise, it is up to you." Abu Abdul Rahman said to us, and this hadith was narrated by Abbad bin Ishaq from Abdullah bin Yazid from his father from Zaid bin Khalid.
عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ عَنِ النَّبِيِّ ﷺ أَنَّهُ سُئِلَ عَنِ الضَّالَّةِ فَقَالَ «اعْرِفْ عِفَاصَهَا وَوِكَاءَهَا ثُمَّ عَرِّفْهَا ثَلَاثَةَ أَيَّامٍ عَلَى بَابِ الْمَسْجِدِ فَإِنْ جَاءَ صَاحِبُهَا فَادْفَعْهَا إِلَيْهِ وَإِنْ لَمْ يَأْتِ فَعَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَشَأْنُكَ بِهَا» قَالَ لَنَا أَبُو عَبْدِ الرَّحْمَنِ وَقَدْ رَوَى هَذَا الْحَدِيثَ عَبَّادُ بْنُ إِسْحَاقَ عَنْ عَبْدِ اللهِ بْنِ يَزِيدَ عَنْ أَبِيهِ عَنْ زَيْدِ بْنِ خَالِدٍ
The Messenger of Allah (SWAS) was asked about a find. He replied : Make the matter known for a year; if its owner comes, give it to him, otherwise note its string and its container and have it along with your property. If its owner comes, deliver it to him. (Using translation from Abū Dāʾūd 1707)
أَنَّهُ قَالَ سُئِلَ رَسُولُ اللهِ ﷺ عَنِ الشَّاةِ الضَّالَّةِ وَسُئِلَ عَنِ اللُّقَطَةِ فَقَالَ تُعَرِّفُهَا حَوْلًا فَإِنْ جَاءَ صَاحِبُهَا دَفَعْتَهَا إِلَيْهِ وَإِلَّا عَرَفَتْ وِكَاءَهَا أَوْ قَالَ عِفَاصَهَا ثُمَّ أفضها فِي مَالِكَ فَإِنْ جَاءَ صَاحِبُهَا دَفَعْتَهَا إِلَيْهِ
26.4 [Machine] The mention of differences regarding Al-Walid ibn Kathir in the news of Sufyan ibn Abdullah in defining the excerpt.
٢٦۔٤ ذِكْرُ الِاخْتِلَافِ عَلَى الْوَلِيدِ بْنِ كَثِيرٍ فِي خَبَرِ سُفْيَانَ بْنِ عَبْدِ اللهِ فِي تَعْرِيفِ اللُّقَطَةِ
[Machine] To recognize her, I traveled around until I met her at the turn of the century. I said to her, "I have recognized you," but she did not acknowledge me. She then said to me, "It belongs to you, for the messenger of Allah ﷺ has commanded us to do so." I replied, "I have no need for it." However, he insisted, so she was thrown into the treasury.
لِي عَرِّفْهَا حَوْلًا فَلَمَّا كَانَ عِنْدَ قَرْنِ الْحَوْلِ لَقِيتُهُ بِهَا فَقُلْتُ إِنِّي قَدْ عَرَّفْتُهَا فَلَمْ تُعْتَرَفْ فَقَالَ هِيَ لَكَ إِنَّ رَسُولَ اللهِ ﷺ «أَمَرَنَا بِذَلِكَ» قُلْتُ لَا حَاجَةَ لِي بِهَا فَأَمَرَ بِهَا فَأُلْقِيَتْ فِي بَيْتِ الْمَالِ
[Machine] I introduced her as my wife for a year. If she is recognized, then it's fine, and if not, then she is yours. And since she was not recognized, I met him in the following year of the season, and I mentioned her to him. He said, "She is yours, as the Messenger of Allah ﷺ commanded us with that." I said, "I don't need her." So Umar took her and placed her in the treasury.
عَرِّفْهَا سَنَةً فَإِنْ عُرِفَتْ فَذَلِكَ وَإِلَّا فَهِيَ لَكَ فَلَمْ تُعْرَفْ فَلَقِيتُهُ مِنَ الْعَامِ الْمُقْبِلِ مِنَ الْمَوْسِمِ فَذَكَرْتُهَا لَهُ فَقَالَ هِيَ لَكَ إِنَّ رَسُولَ اللهِ ﷺ «أَمَرَنَا بِذَلِكَ» قَالَ لَا حَاجَةَ لِي بِهَا فَقَبَضَهَا عُمَرُ وَجَعَلَهَا فِي بَيْتِ الْمَالِ
26.5 [Machine] Mentioning the differences in wording by the narrators of the news of Ubayy ibn Ka'b in the statement.
٢٦۔٥ ذِكْرُ اخْتِلَافِ أَلْفَاظِ النَّاقِلِينَ لِخَبَرِ أُبَيِّ بْنِ كَعْبٍ فِي اللُّقَطَةِ
[Machine] "I enjoy it, and if its owner comes, I will give it to him; it is better than leaving it for wild animals to eat. Then Ubbay ibn Ka'b met him and mentioned this to him. He said, 'You have made a mistake and been correct.' Ubbay ibn Ka'b said, 'I found one hundred dinars at the time of the Messenger of Allah ﷺ so I brought them to him. He said, "Declare them publicly for one year." So I declared them publicly, but they were not claimed. So I returned, and he said, "Declare them publicly for one more year, declare them publicly for one more year." I did that two or three times, then the Messenger of Allah ﷺ said, "Determine its value, its container, and its cover, and mix it with your wealth. If its owner comes, give it to him."'
أَسْتَمْتِعْ بِهِ فَإِنْ جَاءَ صَاحِبُهُ أَدَّيْتُهُ إِلَيْهِ خَيْرٌ مِنْ أَنْ أَتْرُكَهُ لِتَأْكُلَهُ السِّبَاعُ فَلَقِيَ أُبَيَّ بْنَ كَعْبٍ فَذَكَرَ ذَلِكَ لَهُ فَقَالَ أَصَبْتَ وَأَخْطَأَ فَقَالَ أُبَيُّ بْنُ كَعْبٍ وَجَدْتُ مِائَةَ دِينَارٍ فِي زَمَنِ رَسُولِ اللهِ ﷺ فَجِئْتُ بِهَا إِلَيْهِ فَقَالَ «عَرِّفْهَا عَامًا» فَعَرَّفْتُهَا فَلَمْ تُعْرَفْ فَرَجَعْتُ فَقَالَ «عَرِّفْهَا عَامًا عَرِّفْهَا عَامًا» مَرَّتَيْنِ أَوْ ثَلَاثًا ثُمَّ قَالَ رَسُولُ اللهِ ﷺ «اعْرِفْ عِدَّتَهَا وَوِعَاءَهَا وَوِكَاءَهَا وَاخْلِطْهَا لِمَالِكِ فَإِنْ جَاءَ رَبُّهَا فَأَدِّهَا إِلَيْهِ»
[Machine] I picked up a purse that had one hundred dinars in it, so I brought it to the Prophet ﷺ and I mentioned it to him. He said, "Describe its container." So I described its container and said, "I have described its container." He said, "Describe it again next year." So I described it again next year. Then I came to him and said, "I have described it for a year." He said, "Describe it again next year." So I described it again next year. Then I came to him and said, "I have described it." He said, "Benefit from it, and recognize its strap and its openings, and count its number, if its owner comes." Jareer said, "I did not memorize this."
لِي الْتَقَطْتُ صُرَّةً فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ بِهَا النَّبِيَّ ﷺ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ «عَرِّفْهَا حَوْلًا» فَعَرَّفْتُهَا حَوْلًا فَقُلْتُ قَدْ عَرَّفْتُهَا حَوْلًا فَقَالَ «عَرِّفْهَا سَنَةً أُخْرَى» فَعَرَّفْتُهَا سَنَةً أُخْرَى ثُمَّ أَتَيْتُهُ فَقُلْتُ عَرَّفْتُهَا سَنَةً فَقَالَ عَرِّفْهَا سَنَةً أُخْرَى ثُمَّ أَتَيْتُهُ فَقُلْتُ عَرَّفْتُهَا قَالَ «انْتَفِعْ بِهَا وَاعْرِفْ وِكَاءَهَا وَخِرَقتهَا وَأَحْصِ عَدَدَهَا فَإِنْ جَاءَ صَاحِبُهَا» قَالَ جَرِيرٌ لَمْ أَحْفَظْ بَعْدُ يَعْنِي هَذَا
[Machine] I came across a pouch during the time of the Prophet ﷺ that contained one hundred dinars. I brought it to the Prophet ﷺ and he said, "Describe its color." So I described it, but I couldn't find anyone who recognized it. I went to him again and he said, "Describe its color." So I described it, but again I couldn't find anyone who recognized it. I went to him a third time and he said, "Describe its color." So I described it, but still couldn't find anyone who recognized it. I went to him a fourth time and he said, "Keep its quantity, container, and mark it, and enjoy it." So I enjoyed it. Narrated 'Amr bin Yazid: Narrated Bahz: Narrated Shu'bah with this chain of narration similar to it. Shu'bah said: "So I heard it after ten years and he (the Prophet) said, 'Describe it as one year old.'" Narrated 'Amr bin 'Ali: Narrated Muhammad: Narrated Shu'bah with this chain of narration similar to it. He said: "So I met him (the Prophet) after that in Makkah and he said, 'I don't know if it was three conditions or one condition.'"
الْتَقَطْتُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ صُرَّةً فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ بِهَا النَّبِيَّ ﷺ فَقَالَ «عَرِّفْهَا حَوْلًا» فَعَرَّفْتُهَا فَلَمْ أَجِدْ أَحَدًا يَعْرِفُهَا فَأَتَيْتُهُ فَقَالَ «عَرِّفْهَا حَوْلًا» فَعَرَّفْتُهَا فَلَمْ أَجِدْ أَحَدًا يَعْرِفُهَا فَأَتَيْتُهُ فَقَالَ «عَرِّفْهَا حَوْلًا» فَعَرَّفْتُهَا فَلَمْ أَجِدْ أَحَدًا يَعْرِفُهَا فَأَتَيْتُهُ فَقَالَ «احْفَظْ عَدَدَهَا وَوِعَاءَهَا وَوِكَاءَهَا وَاسْتَمْتِعْ بِهَا» فَاسْتَمْتَعْتُ بِهَا 5792 أَخْبَرَنَا عَمْرُو بْنُ يَزِيدَ قَالَ حَدَّثَنَا بَهْزٌ قَالَ حَدَّثَنَا شُعْبَةُ بِهَذَا الْإِسْنَادِ نَحْوَهُ قَالَ شُعْبَةُ فَسَمِعْتُهُ بَعْدَ عَشْرِ سِنِينَ فَقَالَ عَرِّفْهَا عَامًا وَاحِدًا [351] 5793 أَخْبَرَنَا عَمْرُو بْنُ عَلِيٍّ قَالَ حَدَّثَنَا مُحَمَّدٌ قَالَ حَدَّثَنَا شُعْبَةُ بِهَذَا الْإِسْنَادِ نَحْوَهُ قَالَ فَلَقِيتُهُ بَعْدَ ذَلِكَ بِمَكَّةَ فَقَالَ لَا أَدْرِي ثَلَاثَةُ أَحْوَالٍ أَوْ حَوْلٌ وَاحِدٌ
26.6 [Machine] If the owner of the photo is informed of its nature, will they be compensated?
٢٦۔٦ إِذَا أَخْبَرَ صَاحِبُ اللُّقَطَةِ بِصِفَتِهَا هَلْ تُدْفَعُ إِلَيْهِ؟
While I as in the company of Salman bin Rabiʿa and Suhan, in one of the holy battles, I found a whip. One of them told me to drop it but I refused to do so and said that I would give it to its owner if I found him, otherwise I would utilize it. On our return we performed Hajj and on passing by Medina, I asked Ubai bin Kaʿb about it. He said, "I found a bag containing a hundred Dinars in the lifetime of the Prophet ﷺ and took it to the Prophet ﷺ who said to me, 'Make public announcement about it for one year.' So, I announced it for one year and went to the Prophet ﷺ who said, 'Announce it publicly for another year.' So, I announced it for another year. I went to him again and he said, "Announce for an other year." So I announced for still another year. I went to the Prophet ﷺ for the fourth time, and he said, 'Remember the amount of money, the description of its container and the string it is tied with, and if the owner comes, give it to him; otherwise, utilize it.' أَحْسَنْتَ وَجَدْتُ عَلَى عَهْدِ رَسُولِ اللهِ ﷺ صُرَّةً فِيهَا مِائَةُ دِينَارٍ فَأَتَيْتُ رَسُولَ اللهِ ﷺ بِهَا فَقَالَ «عَرِّفْهَا حَوْلًا» فَعَرَّفْتُهَا حَوْلًا ثُمَّ أَتَيْتُهُ إِلَى الْحَوْلِ الثَّانِي فَقَالَ «عَرِّفْهَا» فَعَرَّفْتُهَا حَوْلًا ثُمَّ أَتَيْتُهُ فَقَالَ «عَرِّفْهَا» فَعَرَّفْتُهَا ثُمَّ أَتَيْتُهُ الثَّالِثَ فَقَالَ «اعْلَمْ عِدَّتَهَا وَوِعَاءَهَا وَوِكَاءَهَا فَإِنْ جَاءَ أَحَدٌ يُخْبِرُ بِعَدَدِهَا وَوِعَائِهَا وَوِكَائِهَا فَأَعْطِهَا إِيَّاهُ وَإِلَّا فَاسْتَنْفِعْ بِهَا»
26.7 [Machine] What was found in the university village?
٢٦۔٧ مَا وُجِدَ مِنَ اللُّقَطَةِ فِي الْقَرْيَةِ الْجَامِعَةِ
[Machine] On the authority of the Messenger of Allah ﷺ , he was asked about lost and found items. He said, "If it is found on the main road or in a populated village, then announce it for a year. If its owner comes forward, return it to them. If no one claims it, then it belongs to you. If it is found in ruins, then keep it. If it is found in a she-camel's saddlebag, give a fifth as charity."
عَنْ رَسُولِ اللهِ ﷺ وَسُئِلَ عَنِ اللُّقَطَةِ فَقَالَ «مَا كَانَ مِنْهَا فِي الطَّرِيقِ الْمِيتَاءِ وَالْقَرْيَةِ الْجَامِعَةِ فَعَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا فَادْفَعْهَا إِلَيْهِ وَإِنْ لَمْ يَأْتِ فَهِيَ لَكَ وَمَا كَانَ فِي الْخَرِبِ فَفِيهَا وَفِي الرِّكَازِ الْخُمُسُ»
26.8 [Machine] What was found in the village other than the deserted and uninhabited ones?
٢٦۔٨ مَا وُجِدَ مِنَ اللُّقَطَةِ فِي الْقَرْيَةِ غَيْرِ الْعَامِرَةِ، وَلَا الْمَسْكُونَةِ
[Machine] A man came to the Messenger of Allah ﷺ and said, "How should we act if we find something on the road or in an inhabited town?" He replied, "Announce it for a year, and if someone claims it, then give it to him. Otherwise, it is yours." The man asked, "What if the owner comes to claim it after a long time?" The Messenger of Allah ﷺ said, "Give it to him, but if it was found on the road or in an inhabited town, then it should be shared equally among the people."
أَنَّ رَجُلًا أَتَى رَسُولَ اللهِ ﷺ فَقَالَ كَيْفَ فِيمَا وُجِدَ فِي الطَّرِيقِ الْمِيتَاءِ أَوْ فِي الْقَرْيَةِ الْمَسْكُونَةِ؟ قَالَ «عَرِّفْ سَنَةً فَإِنْ جَاءَ بَاغِيَةٌ فَادْفَعْهُ إِلَيْهِ وَإِلَّا فَشَأْنُكَ بِهِ» قَالَ «فَإِنْ جَاءَ طَالِبُهَا يَوْمًا مِنَ الدَّهْرِ فَأَدِّهَا إِلَيْهِ وَمَا كَانَ فِي الطَّرِيقِ غَيْرِ الْمِيتَاءِ وَفِي الْقَرْيَةِ غَيْرِ الْمَسْكُونَةِ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ»
"The Messenger of Allah was asked about Al-Luqath.[2] He said: "That which is found on a much-traveled road or in an inhabited village, announce it for a year. If its owner comes (and takes it, well and good), otherwise it is yours. That which was not found on a much-traveled road or in an inhabited village is subject to the Khuns, as is Rikaz."'[1] (Using translation from Nasāʾī 2494)
سُئِلَ رَسُولُ اللهِ ﷺ عَنِ اللُّقَطَةِ فَقَالَ «مَا كَانَ فِي طَرِيقٍ مَأْتِيٍّ أَوْ فِي قَرْيَةٍ عَامِرَةٍ فَعَرِّفْهَا سَنَةً فَإِنْ جَاءَ صَاحِبُهَا وَإِلَّا فَلَكَ وَمَا لَمْ يَكُنْ فِي طَرِيقٍ مَأْتِيٍّ أَوْ فِي قَرْيَةٍ عَامِرَةٍ فَفِيهِ وَفِي الرِّكَازِ الْخُمُسُ» خَالَفَهُ مُحَمَّدُ بْنُ عَبْدِ اللهِ الْأَنْصَارِيُّ
[Machine] I said, "O Messenger of Allah, advise me regarding the found property." He said, "If you find it on a dead-end road or in an inhabited village, announce it for a year. If you do not find its owner, then you may keep it." And he narrated the hadith.
قُلْتُ يَا رَسُولَ اللهِ أَفْتِنِي فِي اللُّقَطَةِ قَالَ «مَا وَجَدْتَهُ فِي طَرِيقٍ مَيْتَاءٍ أَوْ فِي قَرْيَةٍ عَامِرَةٍ فَعَرِّفْهُ سَنَةً إِنْ لَمْ تَجِدْ صَاحِبَهُ» وَسَاقَ الْحَدِيثَ
If it were not of sadaqa I would have eaten it. (Using translation from Muslim 1071a)
مَرَّ النَّبِيُّ ﷺ بِتَمْرَةٍ فَقَالَ لَوْلَا أَنْ تَكُونَ مِنَ الصَّدَقَةِ لَأَكَلْتُهَا
26.9 [Machine] What was found in the sea from the snapshot
٢٦۔٩ مَا وُجِدَ مِنَ اللُّقَطَةِ فِي الْبَحْرِ
The Prophet ﷺ said, "An Israeli man asked another Israeli to lend him one thousand Dinars. The second man required witnesses. The former replied, 'Allah is sufficient as a witness.' The second said, 'I want a surety.' The former replied, 'Allah is sufficient as a surety.' The second said, 'You are right,' and lent him the money for a certain period. The debtor went across the sea. When he finished his job, he searched for a conveyance so that he might reach in time for the repayment of the debt, but he could not find any. So, he took a piece of wood and made a hole in it, inserted in it one thousand Dinars and a letter to the lender and then closed (i.e. sealed) the hole tightly. He took the piece of wood to the sea and said. 'O Allah! You know well that I took a loan of one thousand Dinars from so-and-so. He demanded a surety from me but I told him that Allah's Guarantee was sufficient and he accepted Your guarantee. He then asked for a witness and I told him that Allah was sufficient as a Witness, and he accepted You as a Witness. No doubt, I tried hard to find a conveyance so that I could pay his money but could not find, so I hand over this money to You.' Saying that, he threw the piece of wood into the sea till it went out far into it, and then he went away. Meanwhile he started searching for a conveyance in order to reach the creditor's country. One day the lender came out of his house to see whether a ship had arrived bringing his money, and all of a sudden he saw the piece of wood in which his money had been deposited. He took it home to use for fire. When he sawed it, he found his money and the letter inside it. Shortly after that, the debtor came bringing one thousand Dinars to him and said, 'By Allah, I had been trying hard to get a boat so that I could bring you your money, but failed to get one before the one I have come by.' The lender asked, 'Have you sent something to me?' The debtor replied, 'I have told you I could not get a boat other than the one I have come by.' The lender said, 'Allah has delivered on your behalf the money you sent in the piece of wood. So, you may keep your one thousand Dinars and depart guided on the right path.' عَنْ رَسُولِ اللهِ ﷺ أَنَّهُ ذَكَرَ أَنَّ رَجُلًا مِنْ بَنِي إِسْرَائِيلَ سَأَلَ بَعْضَ بَنِي إِسْرَائِيلَ أَنْ يُسْلِفَهُ أَلْفَ دِينَارٍ قَالَ ائْتِنِي بِشُهَدَاءَ أُشْهِدُهُمْ قَالَ كَفَى بِاللهِ شَهِيدًا قَالَ ائْتِنِي بِكَفِيلٍ قَالَ كَفَى بِاللهِ كَفِيلًا قَالَ صَدَقْتَ فَدَفَعَهَا إِلَيْهِ إِلَى أَجَلٍ مُسَمَّى فَخَرَجَ فِي الْبَحْرِ فَقَضَى حَاجَتَهُ ثُمَّ الْتَمَسَ مَرْكَبًا يَقْدُمُ عَلَيْهِ لِلْأَجَلِ الَّذِي أَجَّلَهُ فَلَمْ يَجِدْ مَرْكَبًا فَأَخَذَ خَشَبَةً فَنَقَرَهَا فَأَدْخَلَ فِيهَا أَلْفَ دِينَارٍ وَصَحِيفَةً مَعَهَا إِلَى صَاحِبِهَا ثُمَّ زَجَّجَ مَوْضِعَهَا ثُمَّ أَتَى بِهَا الْبَحْرَ ثُمَّ قَالَ اللهُمَّ إِنَّكَ قَدْ عَلِمْتَ أَنِّي اسْتَسْلَفْتُ فُلَانًا أَلْفَ دِينَارٍ فَسَأَلَنِي كَفِيلًا فَقُلْتُ كَفَى بِاللهِ كَفِيلًا فَرَضِيَ بِكَ وَسَأَلَنِي شَهِيدًا فَقُلْتُ كَفَى بِاللهِ شَهِيدًا فَرَضِىَ بِكَ وَإِنِّي قَدْ جَهِدْتُ أَنْ أَجِدَ مَرْكَبًا أَبْعَثُ إِلَيْهِ بِالَّذِي أَعْطَانِي فَلَمْ أَجِدْ مَرْكَبًا فَإِنِّي أَسْتَوْدِعَكَهَا فَرَمَى بِهَا الْبَحْرَ حَتَّى وَلِجَتْ فِيهِ ثُمَّ انْصَرَفَ وَهُوَ فِي ذَلِكَ يَطْلُبُ مَرْكَبًا يَخْرُجُ إِلَى بَلَدِهِ فَخَرَجَ الرَّجُلُ الَّذِي كَانَ أَسْلَفَهُ يَنْظُرُ لَعَلَّ مَرْكَبًا يَجِيئُهُ بِمَالِهِ فَإِذَا بِالْخَشَبَةِ الَّتِي فِيهَا الْمَالُ فَأَخَذَهَا لِأَهْلِهِ حَطَبًا فَلَمَّا كَسَرَهَا وَجَدَ الْمَالَ وَالصَّحِيفَةَ ثُمَّ قَدِمَ الرَّجُلُ الَّذِي كَانَ تَسَلَّفَ مِنْهُ فَأَتَاهُ بِأَلْفِ دِينَارٍ وَقَالَ وَاللهِ مَازِلْتُ جَاهِدًا فِي طَلَبِ مَرْكَبٍ لِآتِيَكَ بِمَالِكَ فَمَا وَجَدْتُ مَرْكَبًا قَبْلَ الَّذِي أَتَيْتُ فِيهِ قَالَ هَلْ كُنْتَ بَعَثْتَ إِلَيَّ بِشَيْءٍ؟ قَالَ أَلَمْ أُخْبِرْكَ أَنِّي لَمْ أَجِدْ مَرْكَبًا قَبْلَ هَذَا الَّذِي جِئْتُ فِيهِ؟ قَالَ فَإِنَّ اللهَ قَدْ أَدَّى عَنْكَ الَّذِي بَعَثْتَ بِهِ فِي الْخَشَبَةِ فَانْصَرَفْ بِأَلْفِكَ رَاشِدًا
