61. Sacrificial Animals (14/14)
٦١۔ كِتَابُ الضَّحَايَا ص ١٤
[Machine] In the name of Allah, the Most Gracious, the Most Merciful.
Allah, may He be praised, said: "So pray to your Lord and sacrifice." [Surah Al-Kawthar, verse 2].
بِسْمِ اللهِ الرَّحْمَنِ الرَّحِيمِ.
قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {فَصَلِّ لِرَبِّكَ وَانْحَرْ} [الكوثر: 2].
[Machine] I heard the Messenger of Allah ﷺ saying: "I saw Amr bin Amir Al-Khuza'i dragging his staff in the fire. He was the first to introduce something harmful. Sa'id said: "The harmful thing that is liable to harm does not carry anything on it." And the lake whose water the transgressors are prohibited from drawing, no one milks it. And the young she-camel that is the first to bring forth after the she-camel gives birth to a female, then it gives birth to another female, they used to cast it for the transgressors. They used to call it "Al-Wasilah" if one of them was connected with the other. And the stallion, the male of the camels, strikes ten times as much as the female camels. When he finishes his covering, they let him loose for the transgressors and he is exempted from carrying anything. So they called him "Al-Ham" and they mentioned it in the Sahih from the Hadith of Salih bin Kaysan and others, from Ibn Shihab. Al-Bukhari said: "And Ibn Al-Had."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ رَأَيْتُ عَمْرَو بْنَ عَامِرٍ الْخُزَاعِيَّ يَجُرُّ قُصْبَهُ فِي النَّارِ كَانَ أَوَّلَ مَنْ سَيَّبَ السَّوَائِبَ قَالَ سَعِيدٌ السَّائِبَةُ الَّتِي تُسَيَّبُ فَلَا يُحْمَلُ عَلَيْهَا شَيْءٌ وَالْبَحِيرَةُ الَّتِي يُمْنَعُ دَرُّهَا لِلطَّوَاغِيتِ فَلَا يَحْلِبُهَا أَحَدٌ وَالْوَصِيلَةُ النَّاقَةُ الْبِكْرُ تُبَكِّرُ فِي أَوَّلِ نِتَاجِ الْإِبِلِ بِأُنْثَى ثُمَّ تُثَنِّي بَعْدُ بِأُنْثَى فَكَانُوا يُسَيِّبُونَهَا لِلطَّوَاغِيتِ يَدْعُونَهَا الْوَصِيلَةَ إِنْ وَصَلَتْ إِحْدَاهُمَا بِالْأُخْرَى وَالْحَامُ فَحْلُ الْإِبِلِ يَضْرِبُ الْعَشْرَ مِنَ الْإِبِلِ فَإِذَا قَضَى ضِرَابَهُ جَدَعُوهُ لِلطَّوَاغِيتِ فَأَعْفَوْهُ مِنَ الْحَمْلِ فَلَمْ يَحْمِلُوا عَلَيْهِ شَيْئًا فَسَمَّوْهُ الْحَامَ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ صَالِحِ بْنِ كَيْسَانَ وَغَيْرِهِ عَنِ ابْنِ شِهَابٍ قَالَ الْبُخَارِيُّ وَرَوَاهُ ابْنُ الْهَادِ
[Machine] The Prophet ﷺ visited me and there were dates in front of me. He asked, "Do you have any wealth?" I replied, "Yes." He asked, "What kind of wealth?" I said, "Allah ﷻ has blessed me with wheat and camels." He advised, "Reflect on the blessings and generosity of Allah upon you." Then the Prophet ﷺ asked, "Do your camels produce offspring easily and their ears touch the ground?" I responded, "Yes, isn't it always the case?" The person was not a Muslim at that time, so the Prophet ﷺ suggested, "Perhaps you should take your spear and cut off a part of a camel's ear and say, 'This is a Bahir (sacrificial camel),' and then slit another camel's ear and say, 'This is Saurum (camel for personal use).'" I said, "Yes." He advised, "Don't do that because whatever Allah has given you is permissible, and Moses ﷺ is a servant of Allah but Allah aided him even more." The person then asked, "O Muhammad, what if I pass by a man who didn't help me and didn't invite me [to his house], and then I pass by him again. Should I still greet him?" The Prophet ﷺ said, "No, only greet him once."
رَآنِيَ النَّبِيُّ ﷺ وَعَلَيَّ أَطْمَارٌ فَقَالَ هَلْ لَكَ مِنْ مَالٍ؟ قَالَ قُلْتُ نَعَمْ قَالَ مِنْ أِيِّ الْمَالِ قَالَ قُلْتُ قَدْ آتَانِيَ اللهُ ﷻ مِنَ الشَّاءِ وَالْإِبِلِ قَالَ فَلْتُرَ نِعْمَةُ اللهِ وَكَرَامَتُهُ عَلَيْكَ ثُمَّ قَالَ النَّبِيُّ ﷺ هَلْ تُنْتَجُ إِبِلُكَ وَافِيَةً آذَانُهَا؟ قَالَ وَهَلْ تُنْتَجُ إِلَّا كَذَلِكَ؟ وَلَمْ يَكُنْ أَسْلَمَ يَوْمَئِذٍ قَالَ فَلَعَلَّكَ تَأْخُذُ مُوسَاكَ فَتَقْطَعُ أُذُنَ بَعْضِهَا فَتَقُولُ هَذِهِ بَحِيرٌ وَتَشُقُّ أُذُنَ أُخْرَى فَتَقُولُ هَذِهِ صُرُمٌ؟ قَالَ نَعَمْ قَالَ فَلَا تَفْعَلْ فَإِنَّ كُلَّ مَا آتَاكَ اللهُ حِلٌّ وَإِنَّ مُوسَى اللهِ أَحَدُّ وَسَاعِدَ اللهِ أَشَدُّ قَالَ يَا مُحَمَّدُ أَرَأَيْتَ إِنْ مَرَرْتُ بِرَجُلٍ فَلَمْ يَقْرِنِي وَلَمْ يُضَيِّفْنِي ثُمَّ مَرَّ بَعْدَ ذَلِكَ أَقْرِيهِ أَمْ أَجْزِيهِ؟ قَالَ بَلْ أَقْرِهِ
[Machine] In His saying {وَجَعَلُوا لِلَّهِ مِمَّا ذَرَأَ مِنَ الْحَرْثِ} [Al-An'am: 136], and they assigned a portion from their crops to Allah, as they claimed, and a portion for their partners, He said: "They made for Allah a part of what He created as crops and (appointed for) themselves sons and daughters; they made the son a part for Allah. They made for Him daughters. How idiotic is their assertion alone!" They assigned a share of their fruits and wealth to Allah, a part for Satan and idols. So if a portion of what they assigned to Allah falls, they abandon it to Satan's share, and if a portion of what they assigned to Satan falls, they pick it up, safeguard it, and return it to Satan's share. And likewise with watering animals. And He said: "God has not made for man from water any (drinkable) river or a means to access the water sources or a way to obtain it" [Al-Ma'idah: 103]. Al-Shafi'i, may Allah have mercy on him, said and it is said that it was revealed about them: "Say:" Let your witness come, who bears witness that Allah has forbidden this. If they testify, do not testify with them." [Al-An'am: 150]. He responded to them with what they had brought forth and informed them that He had not prohibited them from what they had prohibited by their prohibition, and He mentioned the rest of the verses that were revealed regarding that.
فِي قَوْلِهِ تَعَالَى {وَجَعَلُوا لِلَّهِ مِمَّا ذَرَأَ مِنَ الْحَرْثِ} [الأنعام 136] وَالْأَنْعَامِ نَصِيبًا فَقَالُوا هَذَا لِلَّهِ بِزَعْمِهِمْ وَهَذَا لِشُرَكَائِنَا قَالَ جَعَلُوا لِلَّهِ مِنْ ثَمَرَاتِهِمْ وَمَالِهِمْ نَصِيبًا وَلِلشَّيْطَانِ وَالْأَوْثَانِ نَصِيبًا فَإِنْ سَقَطَ مِنْ ثَمَرِ مَا جَعَلُوا لِلَّهِ فِي نَصِيبِ الشَّيْطَانِ تَرَكُوهُ وَإِنْ سَقَطَ مِمَّا جَعَلُوا لِلشَّيْطَانِ فِي نَصِيبِ اللهِ الْتَقَطُوهُ وَحَفِظُوهُ وَرَدُّوهُ إِلَى نَصِيبِ الشَّيْطَانِ وَهَكَذَا فِي سَقْيِ الْمَاءِ قَالَ وَأَمَّا مَا جَعَلُوا لِلشَّيْطَانِ مِنَ الْأَنْعَامِ فَهُوَ فِي قَوْلِ اللهِ ﷻ {مَا جَعَلَ اللهُ مِنْ بَحِيرَةٍ وَلَا سَائِبَةٍ وَلَا وَصِيلَةٍ وَلَا حَامٍ} [المائدة 103] قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَيُقَالُ نَزَلَ فِيهِمْ {قُلْ هَلُمَّ شُهَدَاءَكُمُ الَّذِينَ يَشْهَدُونَ أَنَّ اللهَ حَرَّمَ هَذَا فَإِنْ شَهِدُوا فَلَا تَشْهَدْ مَعَهُمْ} [الأنعام 150] فَرَدَّ عَلَيْهِمْ مَا أَخْرَجُوا وَأَعْلَمَهُمْ أَنَّهُ لَمْ يَحْرُمْ عَلَيْهِمْ مَا حَرَّمُوا بِتَحْرِيمِهِمْ وَذَكَرَ سَائِرَ الْآيَاتِ الَّتِي وَرَدَتْ فِي ذَلِكَ
61.118 [Machine] Use of the utensils of the polytheists and eating from their food.
٦١۔١١٨ بَابُ اسْتِعْمَالِ أَوَانِي الْمُشْرِكِينَ، وَالْأَكْلِ مِنْ طَعَامِهِمْ
I came to Messenger of Allah ﷺ and said, "O Messenger of Allah ﷺ! We are living in the land of the people of the Scripture and we take our meals in their utensils, and in the land there is game and I hunt with my bow and trained or untrained hounds; please tell me what is lawful for us of that." He said, "As for your saying that you are living in the land of the people of the Scripture and that you eat in their utensils, if you can get utensils other than theirs, do not eat in their utensils, but if you do not find (other than theirs), then wash their utensils and eat in them. As for your saying that you are in the land of game, if you hung something with your bow, and have mentioned Allah's Name while hunting, then you can eat (the game). And if you hunt something with your trained hound, and have mentioned Allah's Name on sending it for hunting then you can eat (the game). But if you hunt something with your untrained hound and you were able to slaughter it before its death, you can eat of it." (Using translation from Bukhārī 5488)
سَمِعْتُ أَبَا ثَعْلَبَةَ الْخُشَنِيَّ ؓ يَقُولُ أَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ يَا رَسُولَ اللهِ إِنَّا بِأَرْضِ قَوْمٍ أَهْلِ كِتَابٍ نَأْكُلُ فِي آنِيَتِهِمْ وَأَرْضِ صَيْدٍ أَصِيدُ بِقَوْسِي وَأَصِيدُ بِكَلْبِي الْمُعَلَّمِ وَبِكَلْبِي الَّذِي لَيْسَ بِمُعَلَّمٍ أَخْبِرْنِي مَا الَّذِي يَحِلُّ لَنَا مِنْ ذَلِكَ؟ قَالَ أَمَّا مَا ذَكَرْتَ أَنَّكُمْ بِأَرْضِ قَوْمٍ أَهْلِ كِتَابٍ تَأْكُلُونَ فِي آنِيَتِهِمْ فَإِنْ وَجَدْتُمْ غَيْرَ آنِيَتِهِمْ فَلَا تَأْكُلُوا فِيهَا وَإِنْ لَمْ تَجِدُوا فَاغْسِلُوهَا ثُمَّ كُلُوا وَأَمَّا مَا ذَكَرْتَ أَنَّكَ بِأَرْضِ صَيْدٍ فَمَا أَصَبْتَ بِقَوْسِكَ فَاذْكُرِ اسْمَ اللهِ ثُمَّ كُلْ وَمَا اصْطَدْتَ بِكَلْبِكَ الْمُعَلَّمِ فَاذْكُرِ اسْمَ اللهِ ثُمَّ كُلْ وَمَا اصْطَدْتَ بِكَلْبِكَ الَّذِي لَيْسَ بِمُعَلَّمٍ فَأَدْرَكْتَ ذَكَاتَهُ فَكُلْ
[Machine] I came to the Messenger of Allah (PBUH) and said, "O Messenger of Allah, I shoot with my bow and sometimes I hit an animal and sometimes I miss. What is permissible for me to eat and what is forbidden?" We are in the land of the People of the Book and they eat pork in their dishes and drink wine in them. So can we eat and drink from them?" He said, "As long as you recite the name of Allah and your arrow reached its target, then eat. But if you find dishes of the People of the Book empty, do not eat from them. And if you do not find them empty, then wash them with water thoroughly and then eat from them. And in this, there is evidence that the requirement for washing is only when knowledge of its impurity is known. And Allah knows best."
أَتَيْتُ رَسُولَ اللهِ ﷺ فَقُلْتُ أَيْ رَسُولَ اللهِ إِنِّي أَرْمِي بِقَوْسِي فَمِنْهُ مَا أُدْرِكُ ذَكَاتَهُ وَمِنْهُ مَا لَا أُدْرِكُ فَمَاذَا يَحِلُّ لِي وَمَا يَحْرُمُ عَلَيَّ؟ إِنَّا فِي أَرْضِ أَهْلِ الْكِتَابِ وَهُمْ يَأْكُلُونَ فِي آنِيَتِهِمُ الْخِنْزِيرَ وَيَشْرَبُونَ فِيهَا الْخَمْرَ فَنَأْكُلُ فِيهَا وَنَشْرَبُ؟ قَالَ كُلْ مَا رَدَّ عَلَيْكَ قَوْسُكَ وَذَكَرْتَ اسْمَ اللهِ فَكُلْ وَإِنْ وَجَدْتَ عَنْ آنِيَةِ أَهْلِ الْكِتَابِ غِنًى فَلَا تَأْكُلْ وَإِنْ لَمْ تَجِدْ عَنْهَا غِنًى فَارْحَضُوهَا بِالْمَاءِ رَحْضًا شَدِيدًا ثُمَّ كُلُوا فِيهَا وَفِي هَذَا دَلَالَةٌ عَلَى أَنَّ الْأَمْرَ بِالْغَسْلِ إِنَّمَا وَقَعَ عِنْدَ الْعِلْمِ بِنَجَاسَتِهَا وَاللهُ أَعْلَمُ
I was on an expedition along with the Messenger of Allah ﷺ. We got the vessels and skins of the polytheists and used them. But he did not object to them (i.e. us) for that (action). (Using translation from Abū Dāʾūd 3838)
كُنَّا نَغْزُو مَعَ رَسُولِ اللهِ ﷺ فَنُصِيبُ مِنْ آنِيَةِ الْمُشْرِكِينَ وَأَسْقِيَتِهِمْ فَنَسْتَمْتِعُ بِهَا وَلَا نَعِيبُ ذَلِكَ عَلَيْهِمْ
[Machine] We used to raid and eat from the vessels of the polytheists and drink from their containers. Al-Shafi'i narrated from Harmala that she gave a Jewess a stolen sheep that she had branded on her arm, and the Prophet ﷺ ate from it, as did others. The Messenger of Allah ﷺ said, "The meal that I ate from the sheep has been recurring to me until now, and this is the moment when it cut my jugular vein."
كُنَّا نَغْزُو فَنَأْكُلُ فِي أَوْعِيَةِ الْمُشْرِكِينَ وَنَشْرَبُ فِي أَسْقِيَتِهِمْ قَالَ الشَّافِعِيُّ فِي رِوَايَةِ حَرْمَلَةَ أَهْدَتْ لِلنَّبِيِّ ﷺ يَهُودِيَّةٌ شَاةً مَحْنُوذَةً سَمَّتْهَا فِي ذِرَاعِهَا فَأَكَلَ مِنْهَا هُوَ يَعْنِي وَغَيْرُهُ وَقَالَ رَسُولُ اللهِ ﷺ مَا زَالَتِ الْأَكْلَةُ الَّتِي أَكَلْتُ مِنَ الشَّاةِ تُعَاوِدُنِي حَتَّى كَانَ هَذَا أَوَانَ قَطَعَتْ أَبْهَرِي
A Jewess brought a poisoned sheep to the Messenger of Allah ﷺ, and he ate of it. She was then brought to the Messenger of Allah ﷺ who asked her about it. She said: I intended to kill you. He said: Allah will not give you control over it ; or he said : over me. They (the Companions) said: Should we not kill her ? He said: No. He (Anas) said: I always found it in the uvula of the Messenger of Allah ﷺ (Using translation from Abū Dāʾūd 4508)
أَنَّ امْرَأَةً يَهُودِيَّةً أَتَتْ رَسُولَ اللهِ ﷺ بِشَاةٍ مَسْمُومَةٍ فَأَكَلَ مِنْهَا فَجِيءَ بِهَا إِلَى رَسُولِ اللهِ ﷺ فَسَأَلَهَا عَنْ ذَلِكَ فَقَالَتْ أَرَدْتُ لِأَقْتُلَكَ قَالَ مَا كَانَ اللهُ لِيُسَلِّطَكِ عَلَى ذَلِكَ أَوْ قَالَ عَلَيَّ قَالَ فَقَالُوا أَلَا نَقْتُلُهَا قَالَ لَا قَالَ فَمَا زِلْتُ أَعْرِفُهَا فِي لَهَوَاتِ رَسُولِ اللهِ ﷺ
[Machine] Aisha said: "The Messenger of Allah ﷺ used to say during the illness in which he passed away, 'Oh Aisha, I feel the pain of the food that I ate in Khaibar. This is the time when the aorta from that poison is being cut off.'"
كَانَتْ عَائِشَةُ ؓ تَقُولُ كَانَ رَسُولُ اللهِ ﷺ يَقُولُ فِي مَرَضِهِ الَّذِي تُوُفِّيَ فِيهِ يَا عَائِشَةُ إِنِّي أَجِدُ أَلَمَ الطَّعَامِ الَّذِي أَكَلْتُ بِخَيْبَرَ فَهَذَا أَوَانُ انْقِطَاعِ أَبْهَرِي مِنْ ذَلِكَ السُّمِّ
61.119 [Machine] What is mentioned regarding the consumption of clay, as there are narrations about its prohibition in which nothing is considered valid.
٦١۔١١٩ بَابُ مَا جَاءَ فِي أَكْلِ الطِّينِ , قَدْ رُوِيَ فِي تَحْرِيمِهِ أَحَادِيثُ لَا يَصِحُّ شَيْءٌ مِنْهَا
[Machine] The Messenger of Allah, ﷺ , said: "Whoever indulges in eating clay has indeed caused harm to himself. Abdullah bin Marwan is the one who reported this, and it has also been narrated with another unknown chain of transmission."
رَسُولَ اللهِ ﷺ قَالَ مَنِ انْهَمَكَ فِي أَكْلِ الطِّينِ فَقَدْ أَعَانَ عَلَى نَفْسِهِ عَبْدُ اللهِ بْنُ مَرْوَانَ هَذَا مَجْهُولٌ وَرُوِيَ مَعْنَاهُ بِإِسْنَادٍ آخَرَ مَجْهُولٍ
[Machine] The Prophet ﷺ said, "Whoever eats clay, it is as if he is helping to kill himself." Abu Ahmad said, "I do not know anyone who narrates this except Suhail ibn Abi Salih, other than Abdul Malik, and he is unknown." The sheikh said, "If this is authentic, it does not indicate prohibition, but rather discouragement from consuming it excessively. Excessive consumption, whether of clay or other substances, that harms the body, is prohibited. And Allah knows best."
قَالَ النَّبِيُّ ﷺ مَنْ أَكَلَ الطِّينَ فَكَأَنَّمَا أَعَانَ عَلَى قَتْلِ نَفْسِهِ قَالَ أَبُو أَحْمَدَ وَهَذَا لَا أَعْلَمُ يَرْوِيهِ عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ غَيْرَ عَبْدِ الْمَلِكِ هَذَا وَهُوَ مَجْهُولٌ قَالَ الشَّيْخُ وَهَذَا لَوْ صَحَّ لَمْ يَدُلَّ عَلَى التَّحْرِيمِ وَإِنَّمَا دَلَّ عَلَى كَرَاهِيَةِ الْإِكْثَارِ مِنْهُ وَالِإكْثَارُ مِنْهُ وَمِنْ غَيْرِهِ حَتَّى يَضُرَّ بِبَدَنِهِ مَمْنُوعٌ وَاللهُ أَعْلَمُ
[Machine] "That the Messenger of Allah ﷺ said: I have shouldered his responsibility over my head, sight, hearing, and obedience."
أَنَّ رَسُولَ اللهِ ﷺ قَالَهُ لَحَمَلْتُهُ عَلَى الرَّأْسِ وَالْعَيْنِ وَالسَّمْعِ وَالطَّاعَةِ
[Machine] "Allah ﷻ says {They ask you, [O Muhammad], what has been made lawful for them. Say, "Lawful for you are [all] good foods."} [Al-Ma'idah 4]. Malik said, "I believe that the owner of the market has the right to prohibit them from selling that and to forbid it." Malik also said, "And this is also a rule of foolishness."
اللهُ ﷻ {يَسْأَلُونَكَ مَاذَا أُحِلَّ لَهُمْ قُلْ أُحِلَّ لَكُمُ الطَّيِّبَاتُ} [المائدة 4] قَالَ مَالِكٌ وَأَرَى لِصَاحِبِ السُّوقِ أَنْ يَمْنَعَهُمْ عَنْ بَيْعِ ذَلِكَ وَيَنْهَى عَنْهُ وَقَالَ مَالِكٌ وَهُوَ أَيْضًا مِنْ بَابِ السَّفَهِ
61.120 [Machine] Unless it is mentioned to be forbidden, and it is not within the meaning of what was mentioned to be forbidden from what is eaten or drank
٦١۔١٢٠ بَابُ مَا لَمْ يُذْكَرْ تَحْرِيمُهُ، وَلَا كَانَ فِي مَعْنَى مَا ذُكِرَ تَحْرِيمُهُ مِمَّا يُؤْكَلُ أَوْ يُشْرَبُ
[Machine] Indeed, Allah has made lawful what is lawful and forbidden what is forbidden. So whatever He has made lawful, it is lawful, and whatever He has forbidden, it is forbidden. And whatever He remains silent about, it is a sign of His forgiveness.
إِنَّ اللهَ ﷻ أَحَلَّ حَلَالًا وَحَرَّمَ حَرَامًا فَمَا أَحَلَّ فَهُوَ حَلَالٌ وَمَا حَرَّمَ فَهُوَ حَرَامٌ وَمَا سَكَتَ عَنْهُ فَهُوَ عَفْوٌ
[Machine] The Messenger of Allah, ﷺ , was asked about butter, cheese, and fur. He said, "Halal (lawful) is what Allah has made permissible in His book, and Haram (forbidden) is what Allah has made forbidden in His book, and what He has remained silent about is a pardon." We have narrated this from another aspect of the face of Salman, raised, and it has been narrated in this regard from Ibn Abbas and Abu Darda.
رَسُولَ اللهِ ﷺ عَنِ السَّمْنِ وَالْجُبْنِ وَالْفِرَاءِ فَقَالَ الْحَلَالُ مَا أَحَلَّ اللهُ فِي كِتَابِهِ وَالْحَرَامُ مَا حَرَّمَ اللهُ فِي كِتَابِهِ وَمَا سَكَتَ عَنْهُ فَهُوَ عَفْوٌ وَرَوَيْنَا ذَلِكَ فِيمَا مَضَى مِنْ وَجْهٍ آخَرَ عَنْ سَلْمَانَ مَرْفُوعًا وَرُوِيَ فِي ذَلِكَ عَنِ ابْنِ عَبَّاسٍ وَأَبِي الدَّرْدَاءِ ؓ
[Machine] "What Allah has made lawful in His book is halal (permissible), and what He has made unlawful is haram (forbidden), and what He has remained silent about is a matter of forgiveness. So accept from Allah His forgiveness, for indeed Allah is not forgetful. Then recite this verse: 'And your Lord is not forgetful' (Surah Maryam, 64)."
مَا أَحَلَّ اللهُ فِي كِتَابِهِ فَهُوَ حَلَالٌ وَمَا حَرَّمَ فَهُوَ حَرَامٌ وَمَا سَكَتَ عَنْهُ فَهُوَ عَافِيَةٌ فَاقْبَلُوا مِنَ اللهِ عَافِيَتَهُ فَإِنَّ اللهَ لَمْ يَكُنْ نَسِيًّا ثُمَّ تَلَا هَذِهِ الْآيَةَ {وَمَا كَانَ رَبُّكَ نَسِيًّا} [مريم 64]
[Machine] Indeed, Allah has ordained obligations, so do not neglect them. He has set limits, so do not exceed them. He has forbidden certain things, so do not violate them. And He has remained silent about certain matters as a mercy for you, not out of forgetfulness, so do not seek after them. This hadith is confined to the year 19726. Our Sheikh, Abu Abdullah Al-Hafiz, informed me of it in Al-Mustadrak, in a narration that he did not receive permission to read. Ali ibn Musa narrated to me from Muhammad ibn Amr Al-Harshi, who narrated from Al-Qa'nabiyyu, who narrated from Ali ibn Musahir, who narrated from Dawud ibn Abi Hind, who narrated from Mak'hul, who narrated from Abu Tha'labah Al-Khushani, who said: The Messenger of Allah ﷺ mentioned it in its meaning.
إِنَّ اللهَ فَرَضَ فَرَائِضَ فَلَا تُضَيِّعُوهَا وَحَّدَ حُدُودًا فَلَا تَعْتَدُوهَا وَنَهَى عَنْ أَشْيَاءَ فَلَا تَنْتَهِكُوهَا وَسَكَتَ عَنْ أَشْيَاءَ رُخْصَةً لَكُمْ لَيْسَ بِنِسْيَانٍ فَلَا تَبْحَثُوا عَنْهَا هَذَا مَوْقُوفٌ 19726 وَأَنْبَأَنِيهِ شَيْخُنَا أَبُو عَبْدِ اللهِ الْحَافِظُ فِي الْمُسْتَدْرَكِ فِيمَا لَمْ يُقْرَأْ عَلَيْهِ إِجَازَةً حَدَّثَنِي عَلِيُّ بْنُ عِيسَى ثنا مُحَمَّدُ بْنُ عَمْرٍو الْحَرَشِيُّ ثنا الْقَعْنَبِيُّ ثنا عَلِيُّ بْنُ مُسْهِرٍ عَنْ دَاوُدَ بْنِ أَبِي هِنْدٍ عَنْ مَكْحُولٍ عَنْ أَبِي ثَعْلَبَةَ الْخُشَنِيِّ ؓ قَالَ قَالَ رَسُولُ اللهِ ﷺ فَذَكَرَهُ بِمَعْنَاهُ
