65. Etiquettes of Judements (2/7)
٦٥۔ كِتَابُ آدَابِ الْقَاضِي ص ٢
[Machine] Allah, may His praise be exalted, said: "Indeed, Allah commands you to render trusts to whom they are due and when you judge between people to judge with justice." (Quran 4:58) And He said to His Prophet, peace be upon him: "And judge between them by what Allah has revealed and do not follow their inclinations." (Quran 5:49) And the Messenger of Allah, peace be upon him, appointed workers and judges, and so did the caliphs after him. They serve as examples in the Sharia. Success and protection are from Allah alone.
قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {إِنَّ اللهَ يَأْمُرُكُمْ أَنْ تُؤَدُّوا الْأَمَانَاتِ إِلَى أَهْلِهَا وَإِذَا حَكَمْتُمْ بَيْنَ النَّاسِ أَنْ تَحْكُمُوا بِالْعَدْلِ} [النساء: 58] , وَقَالَ لِنَبِيِّهِ ﷺ: {وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ} [المائدة: 49] , وَبَعَثَ رَسُولُ اللهِ ﷺ الْعُمَّالَ وَالْقُضَاةَ , وَكَذَلِكَ الْخُلَفَاءُ بَعْدَهُ , وَبِهِمُ الْقُدْوَةُ فِي الشَّرِيعَةِ , وَبِاللهِ التَّوْفِيقُ وَالْعِصْمَةُ
The Prophet ﷺ said, 'Beware! Avoid sitting on the roads." They (the people) said, "O Allah s Apostle! We can't help sitting (on the roads) as these are (our places) here we have talks." The Prophet ﷺ said, ' l f you refuse but to sit, then pay the road its right ' They said, "What is the right of the road, O Allah's Apostle?" He said, 'Lowering your gaze, refraining from harming others, returning greeting, and enjoining what is good, and forbidding what is evil." (Using translation from Bukhārī 6229)
أَنَّ النَّبِيَّ ﷺ قَالَ إِيَّاكُمْ وَالْجُلُوسَ بِالطُّرُقَاتِ فَقَالُوا يَا رَسُولَ اللهِ مَا لَنَا مِنْ مَجَالِسِنَا بُدٌّ نَتَحَدَّثُ فِيهَا فَقَالَ رَسُولُ اللهِ ﷺ إِذَا أَبَيْتُمْ إِلَّا الْمَجْلِسَ فَأَعْطُوا الطَّرِيقَ حَقَّهُ قَالُوا وَمَا حَقُّ الطَّرِيقِ؟ قَالَ غَضُّ الْبَصَرِ وَكَفُّ الْأَذَى وَرَدُّ السَّلَامِ وَالْأَمْرُ بِالْمَعْرُوفِ وَالنَّهْيُ عَنِ الْمُنْكَرِ
"Indeed you shall be aided, capturing, and victorious; so whoever among you sees that, then let him have Taqwa of Allah, and let him command the good and forbid the evil, and whoever lies about me on purpose, then let him take his seat in the Fire." (Using translation from Tirmidhī 2257)
أَنَّهُ سَمِعَ النَّبِيَّ ﷺ يَقُولُ إِنَّكُمْ مُصِيبُونَ وَمَنْصُورُونَ وَمَفْتُوحٌ لَكُمْ فَمَنْ أَدْرَكَ ذَلِكَ مِنْكُمْ فَلْيَتَّقِ اللهَ وَلْيَأْمُرْ بِالْمَعْرُوفِ وَلْيَنْهَ عَنِ الْمُنْكَرِ
[Machine] The Prophet ﷺ said, "For every Muslim, there is a charity to be given every day." They said, "O Messenger of Allah, what if one cannot find something to give?" He said, "Let him work with his hands to benefit himself and give in charity." They said, "O Messenger of Allah, what if he is unable to do that?" He said, "Let him help someone in need who is struggling." They said, "And what if he is unable to do that?" He said, "Let him command what is good and forbid what is evil." They said, "And what if he is unable to do that?" He said, "Let him refrain from doing evil, for that will be a charity for him." This hadith is reported by Abu Dawood and is not mentioned in the narration of Sulayman in every day, nor is his statement "command what is good and forbid what is evil." It is mentioned in the authentic hadith, as mentioned previously.
أَنَّ النَّبِيَّ ﷺ قَالَ عَلَى كُلِّ مُسْلِمٍ صَدَقَةٌ فِي كُلِّ يَوْمٍ قَالُوا يَا رَسُولَ اللهِ فَإِنْ لَمْ يَجِدْ؟ قَالَ لَيَعْتَمِلُ بِيَدِهِ فَيَنْفَعُ نَفْسَهُ وَيَتَصَدَّقُ قَالُوا يَا رَسُولَ اللهِ فَإِنْ لَمْ يَفْعَلْ؟ قَالَ يُعِينُ ذَا الْحَاجَةِ الْمَلْهُوفَ قَالُوا فَإِنْ لَمْ يَسْتَطِعْ؟ قَالَ يَأْمُرُ بِالْمَعْرُوفِ وَيَنْهَى عَنِ الْمُنْكَرِ قَالُوا فَإِنْ لَمْ يَسْتَطِعْ قَالَ لِيُمْسِكْ عَنِ الشَّرِّ فَإِنَّ ذَلِكَ لَهُ صَدَقَةٌ لَفْظُ حَدِيثِ أَبِي دَاوُدَ وَلَيْسَ فِي رِوَايَةِ سُلَيْمَانَ فِي كُلِّ يَوْمٍ وَلَا قَوْلُهُ وَيَنْهَى عَنِ الْمُنْكَرِ أَخْرَجَاهُ فِي الصَّحِيحِ كَمَا مَضَى
In the morning charity is due from every bone in the body of every one of you. Every utterance of Allah's glorification is an act of charity. Every utterance of praise of Him is an act of charity, every utterance of profession of His Oneness is an act of charity, every utterance of profession of His Greatness is an act of charity, enjoining good is an act of charity, forbidding what is distreputable is an act of charity, and two rak'ahs which one prays in the forenoon will suffice. قَالَ النَّبِيُّ ﷺ عَلَى كُلِّ مُسْلِمٍ مِنْكُمْ صَدَقَةٌ فَكُلُّ تَسْبِيحَةٍ صَدَقَةٌ وَكُلُّ تَحْمِيدَةٍ صَدَقَةٌ وَكُلُّ تَهْلِيلَةٍ صَدَقَةٌ وَكُلُّ تَكْبِيرَةٍ صَدَقَةٌ وَأَمْرٌ بِالْمَعْرُوفِ صَدَقَةٌ وَنَهْيٌ عَنِ الْمُنْكَرِ صَدَقَةٌ وَيُجْزِئُ عَنْ ذَلِكَ رَكْعَتَانِ تَرْكَعُهُمَا مِنَ الضُّحَى
[Machine] "And I swear by Allah, I would never say to a man, 'Indeed, you are the best of people,' even if he were to be a ruler, after I heard the Messenger of Allah ﷺ saying, 'They will be brought the man on the Day of Judgment, and he will be thrown into the fire, so his entrails will fall out, and he will revolve in the fire as a donkey revolves around a millstone. The people of the Fire will gather around him, and they will say, 'O so-and-so, what is wrong with you? What befell you? Did you not command us with good and forbid us from evil?' He will say, 'I used to command you with good, but I did not do it, and I used to forbid you from evil, but I did it myself.'"
وَاللهِ لَا أَقُولُ لِرَجُلٍ إِنَّكَ خَيْرُ النَّاسِ وَإِنْ كَانَ عَلَيَّ أَمِيرًا بَعْدَ إِذْ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ قَالُوا وَمَا سَمِعْتَهُ يَقُولُ؟ قَالَ سَمِعْتُهُ يَقُولُ يُجَاءُ بِالرَّجُلِ يَوْمَ الْقِيَامَةِ فَيُلْقَى فِي النَّارِ فَتَنْدَلِقُ أَقْتَابُهُ فَيَدُورُ بِهَا فِي النَّارِ كَمَا يَدُورُ الْحِمَارُ بِرَحَاهُ فَيُطِيفُ بِهِ أَهْلُ النَّارِ فَيَقُولُونَ يَا فُلَانُ مَا لَكَ؟ مَا أَصَابَكَ؟ أَلَمْ تَكُنْ تَأْمُرُنَا بِالْمَعْرُوفِ وَتَنْهَانَا عَنِ الْمُنْكَرِ؟ فَيَقُولُ كُنْتُ آمُرُكُمْ بِالْمَعْرُوفِ وَلَا آتِيهِ وَأَنْهَاكُمْ عَنِ الْمُنْكَرِ وَآتِيهِ
[Machine] His grandfather was Umayr ibn Habib, and he had already pledged allegiance to the Prophet ﷺ . He advised his sons, saying, "O my sons, beware of associating with fools, for their companionship is a disease. Whoever is patient with them will be pleased with his patience, and whoever responds to them will regret it. And whoever does not agree with a little of what the fool brings, will agree with much. And when any of you wants to command good and forbid evil, let him strengthen himself before that against harm, and let him have certainty in the reward from Allah. For whoever has certainty in the reward from Allah, will not feel the harm."
أَنَّ جَدَّهُ عُمَيْرَ بْنَ حَبِيبٍ وَكَانَ قَدْ بَايَعَ النَّبِيَّ ﷺ أوَصَى بَنِيهِ قَالَ لَهُمْ أَيْ بَنِيَّ إِيَّاكُمْ وَمُخَالَطَةَ السُّفَهَاءِ فَإِنَّ مُجَالَسَتَهُمْ دَاءٌ وَإِنَّهُ مَنْ يَحْلُمْ عَنِ السَّفِيهِ يُسَرَّ بِحِلْمِهِ وَمَنْ يُجِبْهُ يَنْدَمْ وَمَنْ لَا يُقِرَّ بِقَلِيلِ مَا يَأْتِ بِهِ السَّفِيهُ يُقِرُّ بِالْكَثِيرِ وَإِذَا أَرَادَ أَحَدُكُمْ أَنْ يَأْمُرَ بِالْمَعْرُوفِ وَيَنْهَى عَنِ الْمُنْكَرِ فَلْيُوَطِّنْ نَفْسَهُ قَبْلَ ذَلِكَ عَلَى الْأَذَى وَلْيُوقِنْ بِالثَّوَابِ مِنَ اللهِ فَإِنَّهُ مَنْ يُوقِنْ بِالثَّوَابِ مِنَ اللهِ لَا يَجِدُ مَسَّ الْأَذَى
65.4 [Machine] Hatred towards monarchy, and hatred of delegating its affairs to someone who sees himself as weak, or someone who sees it as invalidating him/her without another person.
٦٥۔٤ بَابُ كَرَاهِيَةِ الْإِمَارَةِ , وَكَرَاهِيَةِ تَوَلِّي أَعْمَالِهَا لِمَنْ رَأَى مِنْ نَفْسِهِ ضَعْفًا , أَوْ رَأَى فَرْضَهَا عَنْهُ بِغَيْرِهِ سَاقِطًا
[Machine] "Indeed, the Messenger of Allah ﷺ said to me, 'O Abu Dharr, I love for you what I love for myself. I see you as weak, so do not take charge of two individuals or be entrusted with the wealth of an orphan.'"
أَنَّ رَسُولَ اللهِ ﷺ قَالَ لِي يَا أَبَا ذَرٍّ أُحِبُّ لَكَ مَا أُحِبُّ لِنَفْسِي إِنِّي أَرَاكَ ضَعِيفًا فَلَا تَأَمَّرَنَّ عَلَى اثْنَيْنِ وَلَا تَوَلَّيَنَّ مَالَ يَتِيمٍ
I said to the Prophet ﷺ: Messenger of Allah, will you not appoint me to a public office? He stroked my shoulder with his hand and said: Abu Dharr, thou art weak and authority is a trust. and on the Day of judgment it is a cause of humiliation and repentance except for one who fulfils its obligations and (properly) discharges the duties attendant thereon. قُلْتُ يَا رَسُولَ اللهِ اسْتَعْمِلْنِي قَالَ فَضَرَبَ بِيَدِهِ عَلَى مَنْكِبِي ثُمَّ قَالَ يَا أَبَا ذَرٍّ إِنَّكَ ضَعِيفٌ وَإِنَّهَا أَمَانَةٌ وَإِنَّهَا يَوْمَ الْقِيَامَةِ خِزْيٌ وَنَدَامَةٌ إِلَّا مَنْ أَخَذَهَا بِحَقِّهَا وَأَدَّى الَّذِي عَلَيْهِ فِيهَا
"You will become keen for positions of authority, but that will become a regret and loss. What a good life they will live, but how hard it will be for them when they die." (Using translation from Nasāʾī 4211)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ إِنَّكُمْ سَتَحْرِصُونَ عَلَى الْإِمَارَةِ وَإِنَّهَا سَتَكُونُ حَسْرَةً وَنَدَامَةً يَوْمَ الْقِيَامَةَ فَنِعْمَ الْمُرْضِعَةُ وَبِئْسَتِ الْفَاطِمَةُ
[Machine] The Messenger of Allah ﷺ said, "There is no leader of a group of ten except that he will be brought on the Day of Judgment with his hands tied to his neck."
قَالَ رَسُولُ اللهِ ﷺ مَا مِنْ أَمِيرِ عَشَرَةٍ إِلَّا يُؤْتَى بِهِ يَوْمَ الْقِيَامَةِ وَيَدُهُ مَغْلُولَةٌ إِلَى عُنُقِهِ
[Machine] The Messenger of Allah ﷺ said, "There is no ruler of a group of ten, except that he will be brought on the Day of Judgment in chains, until justice releases him or injustice destroys him."
قَالَ رَسُولُ اللهِ ﷺ مَا مِنْ أَمِيرِ عَشَرَةٍ إِلَّا وَهُوَ يُؤْتَى بِهِ يَوْمَ الْقِيَامَةِ مَغْلُولًا حَتَّى يَفُكَّهُ الْعَدْلُ أَوْ يُوبِقَهُ الْجَوْرُ
[Machine] Abbas said, "O Messenger of Allah, command me to do something that Allah has granted to you." The Prophet ﷺ replied, "O Abbas, O uncle of the Messenger of Allah, a soul that is saved is better than a leadership that cannot be counted. This is what is preserved and transmitted. It was reported from Ibn Al-Munkadir from Jabir Ibn Abdullah that Abbas Ibn Abdul-Muttalib said, 'O Messenger of Allah, will you not appoint me?' He mentioned it, and Abu Abdul-Allah Al-Hafiz informed us, Abu Abdul-Allah Ahmad Ibn Qan'i, the judge in Baghdad, narrated to us, Muhammad Ibn Ali Ibn Al-Walid Al-Sulami Al-Basri narrated to us, Nasr Ibn Ali narrated to us, from Abu Ahmad Al-Zubairi, from Sufyan Ibn Sa'id. He mentioned it connectedly, and the first narration is more authentic. This narration is mentioned exclusively by Al-Sulami Al-Basri."
قَالَ الْعَبَّاسُ ؓ يَا رَسُولَ اللهِ أَمِّرَنِي عَلَى بَعْضِ مَا وَلَّاكَ اللهُ فَقَالَ النَّبِيُّ ﷺ يَا عَبَّاسُ يَا عَمَّ رَسُولِ اللهِ نَفْسٌ تُنْجِيهَا خَيْرٌ مِنْ إِمَارَةٍ لَا تُحْصِيهَا هَذَا هُوَ الْمَحْفُوظُ مُرْسَلٌ وَقِيلَ عَنْهُ عَنِ ابْنِ الْمُنْكَدِرِ عَنْ جَابِرِ بْنِ عَبْدِ اللهِ قَالَ الْعَبَّاسُ بْنُ عَبْدِ الْمُطَّلِبِ يَا رَسُولَ اللهِ أَلَا تُوَلِّيَنِي فَذَكَرَهُ أَخْبَرَنَاهُ أَبُو عَبْدِ اللهِ الْحَافِظُ حَدَّثَنِي أَبُو عَبْدِ اللهِ أَحْمَدُ بْنُ قَانِعٍ الْقَاضِي بِبَغْدَادَ ثنا مُحَمَّدُ بْنُ عَلِيِّ بْنِ الْوَلِيدِ السُّلَمِيُّ الْبَصْرِيُّ ثنا نَصْرُ بْنُ عَلِيٍّ ثنا أَبُو أَحْمَدَ الزُّبَيْرِيُّ عَنْ سُفْيَانَ بْنِ سَعِيدٍ فَذَكَرَهُ مَوْصُولًا وَالْأَوَّلُ أَصَحُّ تَفَرَّدَ بِهِ هَذَا السُّلَمِيُّ الْبَصْرِيُّ
[Machine] I heard Ziyad ibn al-Harith al-Suda'i, a companion of the Messenger of Allah ﷺ , narrate: "I went to the Messenger of Allah ﷺ and pledged my allegiance to him upon Islam. He mentioned a lengthy narration in which he said: 'The Messenger of Allah ﷺ came across a house and its residents complained to him about their leader and said, 'He has taken something from us that was previously between us and his people during the time of ignorance (jahiliyyah).' The Messenger of Allah ﷺ asked, 'Did he really do that?' They replied, 'Yes.' So the Prophet ﷺ turned to his companions, and I was among them, and he said, 'There is no good in leadership for a believing man.'"
سَمِعْتُ زِيَادَ بْنَ الْحَارِثِ الصُّدَائِيَّ صَاحِبَ رَسُولِ اللهِ ﷺ يُحَدِّثُ قَالَ أَتَيْتُ رَسُولَ اللهِ ﷺ فَبَايَعْتُهُ عَلَى الْإِسْلَامِ وَذَكَرَ الْحَدِيثَ بِطُولِهِ قَالَ فِيهِ فَنَزَلَ رَسُولُ اللهِ ﷺ مَنْزِلًا فَأَتَاهُ أَهْلُ ذَلِكَ الْمَنْزِلِ يَشْكُونَ عَامِلَهُمْ وَيَقُولُونَ أَخَذَنَا بِشَيْءٍ كَانَ بَيْنَنَا وَبَيْنَ قَوْمِهِ فِي الْجَاهِلِيَّةِ فَقَالَ رَسُولُ اللهِ ﷺ أَوَ فَعَلَ ذَلِكَ؟ فَقَالُوا نَعَمْ فَالْتَفَتَ النَّبِيُّ ﷺ إِلَى أَصْحَابِهِ وَأَنَا فِيهِمْ فَقَالَ لَا خَيْرَ فِي الْإِمَارَةِ لِرَجُلٍ مُؤْمِنٍ
[Machine] The Messenger of Allah ﷺ said: "Whoever is put in charge of judicial matters, it is as if he has slaughtered himself without a knife." And Ibn Ayyub narrated in his narration from Uthman ibn Al-Akhnas.
قَالَ رَسُولُ اللهِ ﷺ مَنْ جُعِلَ عَلَى الْقَضَاءِ فَكَأَنَّمَا ذَبَحَ نَفْسَهُ بِغَيْرِ سِكِّينٍ وَقَالَ ابْنُ أَيُّوبَ فِي رِوَايَتِهِ عَنْ عُثْمَانَ بْنِ الْأَخْنَسِ
[Machine] Indeed, the Messenger of Allah ﷺ said, "Whoever sits as a judge among the Muslims has been slaughtered without a knife."
إِنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ قَعَدَ قَاضِيًا بَيْنَ الْمُسْلِمِينَ فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ
The Prophet ﷺ said: He who has been appointed a judge has been killed without a knife. (Using translation from Abū Dāʾūd 3571)
أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ وَلِيَ الْقَضَاءَ فَقَدْ ذُبِحَ بِغَيْرِ سِكِّينٍ
[Machine] Allah ﷺ says: "The just judge will be brought forth on the Day of Judgment, and because of the severity of the account, he will receive whatever he wishes he did not pass judgment on between two people over a date like this in my book. Umar ibn Al-A'laa informed us, and Ali ibn Ahmad ibn Abdan reported to us, narrating from Ahmad ibn Ubayd Al-Saffar, who narrated from Abu Bakr ibn Hajjah, who narrated from Abu Al-Walid, who narrated from Amr ibn Al-A'laa Al-Yashkuri, who narrated from Salih ibn Sarg, who narrated from Imran ibn Hittan, who narrated from Aisha, who said: The Messenger of Allah ﷺ said: 'The just judge will be brought forth, and he will be mentioned with his equivalent.'"
اللهِ ﷺ يَقُولَ يُؤْتَى بِالْقَاضِي الْعَدْلِ يَوْمَ الْقِيَامَةِ فَيَلْقَى مِنْ شِدَّةِ الْحِسَابِ مَا يَتَمَنَّى أَنَّهُ لَمْ يَقْضِ بَيْنَ اثْنَيْنِ فِي تَمْرَةٍ قَطُّ كَذَا فِي كِتَابِي عُمَرُ بْنُ الْعَلَاءِ 20222 وَأَخْبَرَنَا عَلِيُّ بْنُ أَحْمَدَ بْنِ عَبْدَانَ أنبأ أَحْمَدُ بْنُ عُبَيْدٍ الصَّفَّارُ ثنا أَبُو بَكْرِ بْنُ حَجَّةَ ثنا أَبُو الْوَلِيدِ ثنا عَمْرُو بْنُ الْعَلَاءِ الْيَشْكُرِيُّ عَنْ صَالِحِ بْنِ سَرْجٍ عَنْ عِمْرَانَ بْنِ حِطَّانَ عَنْ عَائِشَةَ ؓ قَالَتْ قَالَ رَسُولُ اللهِ ﷺ يُؤْتَى بِالْقَاضِي الْعَادِلِ فَذَكَرَهُ بِمِثْلِهِ
[Machine] Abdullah narrated that the Prophet ﷺ said, "Every judge who passes a judgement among the people, is entrusted with an angel holding his hair and dragging him until he stands at the edge of Hell. Then the angel will raise his head towards Allah, and if Allah commands him to throw the judge, he throws him into Hell, where he remains for forty autumns."
عَنْ عَبْدِ اللهِ رُبَّمَا ذَكَرَ النَّبِيَّ ﷺ قَالَ مَا مِنْ حَكَمٍ يَحْكُمُ بَيْنَ النَّاسِ إِلَّا وُكِّلَ بِهِ مَلَكٌ آخِذٌ بِقَفَاهُ حَتَّى يَقِفَ بِهِ عَلَى شَفِيرِ جَهَنَّمَ فَيَرْفَعُ رَأْسَهُ إِلَى اللهِ فَإِنْ أَمَرَهُ أَنْ يَقْذِفَهُ قَذَفَهُ فِي مَهْوًى أَرْبَعِينَ خَرِيفًا
[Machine] The Messenger of Allah ﷺ said, "Woe to the rulers, woe to the learned scholars, and woe to the trustees. People on the Day of Judgment will wish that their ankles were tied to their necks and that they were swinging between the sky and the earth, because they did not fulfill their duties. Abu Bakr ibn Furak (may Allah have mercy on him) informed us, who reported from Abdullah ibn Ja'far, who reported from Yunus ibn Habib, who reported from Abu Dawud, who reported from Hisham, who mentioned it with a similar chain of narration, except that he said their ankles were tied to the skies, and they were swinging."
عَنْ رَسُولِ اللهِ ﷺ قَالَ وَيْلٌ لِلْأُمَرَاءِ وَوَيْلٌ لِلْعُرَفَاءِ وَوَيْلٌ لِلْأُمَنَاءِ لَيَتَمَنَّيَنَّ أَقْوَامٌ يَوْمَ الْقِيَامَةِ أَنَّ نَوَاصِيَهُمْ مُعَلَّقَةٌ بِالثُّرَيَّا يَتَخَلْخَلُونَ بَيْنَ السَّمَاءِ وَالْأَرْضِ وَأَنَّهُمْ لَمْ يَلُوا عَمَلًا 20225 أَخْبَرَنَا أَبُو بَكْرِ بْنُ فُورَكٍ رَحِمَهُ اللهُ أنبأ عَبْدُ اللهِ بْنُ جَعْفَرٍ ثنا يُونُسُ بْنُ حَبِيبٍ ثنا أَبُو دَاوُدَ ثنا هِشَامٌ فَذَكَرَهُ بِإِسْنَادِهِ نَحْوَهُ إِلَّا أَنَّهُ قَالَ ذَوَائِبُهُمْ كَانَتْ مُعَلَّقَةً بِالثُّرَيَّا يَتَذَبْذَبُونَ
[Machine] I said, "O Abu Hurairah, except for those who fear Allah among them." He said, "I speak to you only as I have heard."
قُلْتُ يَا أَبَا هُرَيْرَةَ إِلَّا مَنِ اتَّقَى اللهَ مِنْهُمْ قَالَ إِنَّمَا أُحَدِّثُكَ كَمَا سَمِعْتُ
[Machine] "So we entered upon him and people began praising him. Then a young man came and said, 'Rejoice, O commander of the faithful, for Allah has given you glad tidings of the companionship of the Messenger of Allah ﷺ and being at the forefront in Islam, which you have learned, then you were appointed and you dealt with justice. Then the witness was brought forth. He said, 'O son of my brother, I wish that this matter were sufficient for neither you nor me.' When he turned away, his garment touched the ground and he said, 'Bring the boy back to me.' He said, 'O son of my brother, lift up your garment, for it is cleaner for your garment and more pious for your Lord.'"
فَدَخَلْنَا عَلَيْهِ وَجَاءَ النَّاسُ يُثْنُونَ عَلَيْهِ وَجَاءَ رَجُلٌ شَابٌّ فَقَالَ أَبْشِرْ يَا أَمِيرَ الْمُؤْمِنِينَ بِبُشْرَى اللهِ لَكَ مِنْ صُحْبَةِ رَسُولِ اللهِ ﷺ وَقَدَمٍ فِي الْإِسْلَامِ مَا قَدْ عَلِمْتَ ثُمَّ وُلِّيتَ فَعَدَلْتَ ثُمَّ الشَّهَادَةُ قَالَ يَا ابْنَ أَخِي وَدِدْتُ أَنَّ ذَلِكَ كَفَافٌ لَا عَلَيَّ وَلَا لِيَ فَلَمَّا أَدْبَرَ إِذَا إِزَارُهُ يَمَسُّ الْأَرْضَ فَقَالَ رُدُّوا عَلَيَّ الْغُلَامَ قَالَ يَا ابْنَ أَخِي ارْفَعْ ثَوْبَكَ فَإِنَّهُ أَنْقَى لِثَوْبِكَ وَأَتْقَى لِرَبِّكَ
[Machine] By the One in whose hand is my soul, I would have wished that I have left it as I entered it, with no reward or sin.
فَوَالَّذِي نَفْسِي بِيَدِهِ لَوَدِدْتُ أَنِّي خَرَجْتُ مِنْهَا كَمَا دَخَلْتُ فِيهَا لَا أَجْرَ وَلَا وِزْرَ
[Machine] He is happy. I see you are foolish. Go to the judge I appointed for this case. Do you think I was occupied with this? Or he said upon you...
لَهُ سَعِيدٌ أَرَاكَ أَحْمَقَ اذْهَبْ إِلَى الْقَاضِي الَّذِي أُجْلِسَ لِهَذَا أَتُرَانِي أَنِّي كُنْتُ أَشْغَلُ نَفْسِي بِهَذَا؟ أَوْ قَالَ بِكَ
[Machine] Job said: "I have found that the most knowledgeable among people regarding divine decree are the most frightened of it and the most divided by it." Then he said: "And I have not found anyone who is more knowledgeable about divine decree than Abu Qilaba. I do not know what to make of Muhammed ibn Sireen, as he used to escape to Syria once and then to Yemen another time whenever divine decree was mentioned. And when he arrived in Basra, he would remain inconspicuous until he left."
قَالَ أَيُّوبُ وَجَدْتُ أَعْلَمَ النَّاسِ بِالْقَضَاءِ أَشَدَّ النَّاسِ مِنْهُ فِرَارًا وَأَشَدَّهُمْ مِنْهُ فَرَقًا ثُمَّ قَالَ وَمَا أَدْرَكْتُ أَحَدًا كَانَ أَعْلَمَ بِالْقَضَاءِ مِنْ أَبِي قِلَابَةَ لَا أَدْرِي مَا مُحَمَّدُ بْنُ سِيرِينَ فَكَانَ يُرَادُ عَلَى الْقَضَاءِ فَيَفِرُّ إِلَى الشَّامِ مَرَّةً وَيَفِرُّ إِلَى الْيَمَامَةِ مَرَّةً وَكَانَ إِذَا قَدِمَ إِلَى الْبَصْرَةِ كَانَ كَالْمُسْتَخْفِي حَتَّى يَخْرُجَ
[Machine] The passage translates to: "The likeness of the judge is like a man swimming in the sea, how long can he swim before he drowns? Abu Qilabah was sought for judgment, but he fled."
إِنَّمَا مَثَلُ الْقَاضِي كَمَثَلِ رَجُلٍ يَسْبَحُ فِي الْبَحْرِ فَكَمْ عَسَى يَسْبَحُ حَتَّى يَغْرَقَ قَالَ وَطُلِبَ أَبُو قِلَابَةَ لِلْقَضَاءِ فَهَرَبَ
[Machine] I said, "No, rather, I am a Muslim." So the Messenger left and informed him. Then he came to me and said, "Stand up." He said, "I stood up and greeted him, and praised Allah and glorified Him." Then he said, "O Allah, You know that I did not sit in this gathering that You have put me to the test with, and that You have ordained for me, except that I hated it and detested it. So suffice me from the harm of its consequences." Then he took a clean piece of cloth and placed it on his face, and he continued to cry until I stood up. He said, "Then he stayed as long as Allah willed, and then Ibn Shubrumah was appointed after him." He said, "So I went, and there he was, standing and praying. When he saw me, he minimized the prayer. Then he sent me someone to dispute with me or someone to be conversed with, or is it a need?" He said, "I said, 'No, rather, I am a Muslim.'" So the Messenger left and informed him. Then he came to me and said, "Stand." So I stood up and greeted him, and I sat next to him. He said, "Tell me the narration of my brother, Mu'harib bin Dithar." So I narrated the narration to him. He said, "O Allah, You know that I did not sit in this gathering that You have put me to the test with, except that I loved it and yearned for it. So suffice me from the harm of its consequences." Then he took a clean piece of cloth and placed it on his face, and he continued to cry until I stood up.
قُلْتُ لَا بَلْ مُسَلِّمٌ فَذَهَبَ الرَّسُولُ فَأَخْبَرَهُ ثُمَّ أَتَانِي فَقَالَ لِي قُمْ قَالَ فَسَلَّمْتُ عَلَيْهِ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ اللهُمَّ إِنَّكَ تَعْلَمُ أَنِّي لَمْ أَجْلِسْ لِهَذَا الْمَجْلِسِ الَّذِي ابْتَلَيْتَنِي بِهِ وقَدَّرْتَهُ عَلَيَّ إِلَّا وَأَنَا أَكْرَهُهُ وَأُبْغِضُهُ فَاكْفِنِي شَرَّ عَوَاقِبِهِ قَالَ ثُمَّ أَخْرَجَ خِرْقَةً نَظِيفَةً فَوَضَعَهَا عَلَى وَجْهِهِ فَلَمْ يَزَلْ يَبْكِي حَتَّى قُمْتُ قَالَ فَمَكَثَ مَا شَاءَ اللهُ ثُمَّ وُلِّيَ بَعْدَهُ ابْنُ شُبْرُمَةَ قَالَ فَجِئْتُ فَإِذَا هُوَ قَائِمٌ يُصَلِّي فَلَمَّا رَآنِي أَخَفَّ الصَّلَاةَ ثُمَّ بَعَثَ إِلِيَّ أَمُخَاصِمٌ أَوْ مُسَلِّمٌ أَوْ حَاجَةٌ؟ قَالَ قُلْتُ لَا بَلْ مُسَلِّمٌ فَذَهَبَ الرَّسُولُ فَأَخْبَرَهُ ثُمَّ أَتَانِي فَقَالَ لِي قُمْ فَقُمْتُ فَسَلَّمْتُ عَلَيْهِ وَجَلَسْتُ إِلَى جَنْبِهِ فَقَالَ حَدِّثْنِي حَدِيثَ أَخِي مُحَارِبِ بْنِ دِثَارٍ فَحَدَّثْتُهُ الْحَدِيثَ فَقَالَ اللهُمَّ إِنَّكَ تَعْلَمُ إِنِّي لَمْ أَجْلِسْ هَذَا الْمَجْلِسَ الَّذِي ابْتَلَيْتَنِي بِهِ إِلَّا وَأَنَا أُحِبُّهُ وَأَشْتَهِيهِ فَاكْفِنِي شَرَّ عَوَاقِبِهِ ثُمَّ أَخْرَجَ خِرْقَةً نَظِيفَةً فَوَضَعَهَا عَلَى وَجْهِهِ فَمَا زَالَ يَبْكِي حَتَّى قُمْتُ
[Machine] By Allah, neither have I attained any spoils of war for which I congratulate him nor has he suffered any calamity for which I console him. And I have not been his visitor before today, so why should I visit him today?
وَاللهِ مَا نَالَ عِنْدِي غَنِيمَةً فَأُهَنِّيَهُ عَلَيْهَا وَلَا أُصِيبَ عِنْدَ نَفْسِهِ بِمُصِيبَةٍ فَأُعَزِّيَهُ عَلَيْهَا وَمَا كُنْتُ زَوَّارًا لَهُ قَبْلَ الْيَوْمِ فَأَزُورُهُ الْيَوْمَ؟
[Machine] Abu Nuaim said: "Shuraikh went out from Ziyad's place and a man met him and said, 'You have aged, your bones have become weak, and your son has become poor.' Shuraikh then returned to him and informed him of what was said. The man asked him, 'Who told you?' Shuraikh replied, 'I do not know him, so forgive me.' The man said, 'I will not forgive you until you point me to a person.' So he pointed to Abu Burdah, and he was handed over to the judge."
قَالَ أَبُو نُعَيْمٍ خَرَجَ شُرَيْحٌ مِنْ عِنْدِ زِيَادٍ فَلَقِيَهُ رَجُلٌ فَقَالَ كَبِرَتْ سِنُّكَ وَرَقَّ عَظْمُكَ وَارْتَشَى ابْنُكَ قَالَ فَرَجَعَ إِلَيْهِ فَأَخْبَرَهُ فَقَالَ مَنْ قَالَ لَكَ؟ قَالَ لَا أَعْرِفُهُ فَاعْفِنِي قَالَ لَا أُعْفِيكَ حَتَّى تُشِيرَ عَلَيَّ بِرَجُلٍ فَأَشَارَ عَلَيْهِ بِأَبِي بُرْدَةَ فَوَلَّاهُ الْقَضَاءَ
[Machine] The Tamimi man, Qa'anab, had invited him and they were in a dispute, so he refused him and he continued with him until he accepted. When he left from him with his agreement, he threw it at him and hid. He said, "So the governor sent in search of him, and while they were searching for him, the house in which he was hiding fell on him. They did not realize until his funeral was held."
كَانَ قَعْنَبٌ التَّمِيمِيُّ قَدْ دَعَاهُ وَالٍ فَوَلَّاهُ الْقَضَاءَ فَأَبَى عَلَيْهِ فَلَمْ يَزَلْ بِهِ حَتَّى قَبِلَ فَلَمَّا خَرَجَ مِنْ عِنْدِهِ بِعَهْدِهِ رَمَى بِهِ وَتَوَارَى قَالَ فَأَرْسَلَ الْوَالِي فِي طَلَبِهِ فَبَيْنَمَا هُمْ يَطْلُبُونَهُ إِذْ سَقَطَ عَلَيْهِ الْبَيْتُ الَّذِي كَانَ فِيهِ مُتَوَارِيًا فَلَمْ يَشْعُرُوا إِلَّا وَقَدْ خُرِجَ عَلَيْهِمْ بِجِنَازَتِهِ
[Machine] I said, "O Amir al-Mu'minin, I am weaker than that and I am a man from the Mawali." He said, "You have no weakness with me, but your intention in work for me has weakened. Do you want a strength stronger than me and my work? If you want, then guide me to a man whom I can appoint as the ruler of Egypt." I said, "Uthman ibn al-Hakam al-Judhami is a man who is righteous and has a clan." He reached out to him and made a covenant with Allah not to speak to Layth ibn Sa'd.
لِي أَبُو جَعْفَرٍ تَلِي لِي مِصْرَ؟ قُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ إِنِّي أَضْعَفُ مِنْ ذَلِكَ وَإِنِّي رَجُلٌ مِنَ الْمَوَالِي فَقَالَ مَا بِكَ مِنْ ضَعْفٍ مَعِي وَلَكِنْ ضَعُفَتْ نِيَّتُكَ فِي الْعَمَلِ لِي عَلَى ذَلِكَ أَتُرِيدُ قُوَّةً أَقْوَى مِنِّي وَمِنْ عَمَلِي فَأَمَّا إِذَا أَبِيتَ فَدُلَّنِي عَلَى رَجُلٍ أُقَلِّدُهُ أَمْرَ مِصْرَ قُلْتُ عُثْمَانُ بْنُ الْحَكَمِ الْجُذَامِيُّ رَجُلٌ لَهُ صَلَاحٌ وَلَهُ عَشِيرَةٌ قَالَ فَبَلَغَهُ ذَلِكَ فَعَاهَدَ اللهَ أَنْ لَا يُكَلِّمَ اللَّيْثَ بْنَ سَعْدٍ
[Machine] When Sowwar, the judge of Basra, died, Abu Ja'far, meaning Al-Mansur, called upon Abu Hanifa and said to him, "Sowwar has died and someone must take his place as the judge. Accept the position as the judge of Basra, for I have appointed you as the judge." Abu Hanifa replied, "By Allah, the One besides whom there is no deity, I am not fit for the position of a judge. And by Allah, O Amir al-Mu'minin, if I am telling the truth, what prevents you from appointing a man who is not fit for the position of a judge? And if I am lying, what prevents you from appointing a man who is a liar, which is not suitable for this matter? Only a man from the tribe of Arabia is fit for this position, and I have become contrary to you." Abu Ja'far said to him, "You have spoken the truth. Indeed, you said that only a man like Abu Bakr and Umar is fit for this position, as Allah says in His book, 'Those are a nation who have passed away. Theirs is that which they earned.' (Quran 2:134) And as for your statement that only a man from the tribe of Arabia is fit for this position, then we adhere to what Allah Almighty says in His book, 'Indeed, the most noble of you in the sight of Allah is the most righteous of you.' (Quran 49:13) And we only exert effort with the people of our time. And as for your statement that I have become contrary to you, opinions differ. Accept this matter." Abu Hanifa said, "O Amir al-Mu'minin, if you do not remove me from this position, then I will respond to your request within the hour." So he left him after that.
لَمَّا مَاتَ سَوَّارٌ قَاضِي أَهْلِ الْبَصْرَةِ دَعَا أَبُو جَعْفَرٍ يَعْنِي الْمَنْصُورَ أَبَا حَنِيفَةَ فَقَالَ لَهُ إِنَّ سَوَّارًا قَدْ مَاتَ وَإِنَّهُ لَا بُدَّ لِهَذَا الْمِصْرِ يَعْنِي مِنْ قَاضٍ فَاقْبَلِ الْقَضَاءَ فَقَدْ وَلَّيْتُكَ قَضَاءَ الْبَصْرَةِ فَقَالَ أَبُو حَنِيفَةَ وَاللهِ الَّذِي لَا إِلَهَ إِلَّا هُوَ إِنِّي لَا أَصْلِحُ لِلْقَضَاءِ وَوَاللهِ يَا أَمِيرَ الْمُؤْمِنِينَ لَئِنْ كُنْتُ صَادِقًا فَمَا يَسَعُكَ أَنْ تَسْتَقْضِيَ رَجُلًا لَا يَصْلُحُ لِلْقَضَاءِ وَلَئِنْ كُنْتُ كَاذِبًا فَمَا يَسَعُكُ أَنْ تَسْتَقْضِيَ رَجُلًا كَذَّابًا وَإِنَّهُ لَا يَصْلُحُ لِهَذَا الْأَمْرِ إِلَّا رَجُلٌ مِنَ الْعَرَبِ وَقَدْ أَصْبَحْتُ مُخَالِفًا لَكَ قَالَ فَقَالَ لَهُ أَبُو جَعْفَرٍ صَدَقْتَ إِنَّكَ قُلْتَ لَا يَصْلُحُ لِهَذَا الْأَمْرِ إِلَّا مِثْلُ أَبِي بَكْرٍ وَعُمَرَ فَ {تِلْكَ أُمَّةٌ قَدْ خَلَتْ لَهَا مَا كَسَبَتْ} [البقرة 134] الْآيَةُ وَأَمَّا قَوْلُكَ إِنَّهُ لَا يَصْلُحَ لِهَذَا الْأَمْرِ إِلَّا رَجُلٌ مِنَ الْعَرَبِ فَإِنَّا نَأْخُذُ بِمَا قَالَ اللهُ تَعَالَى فِي كِتَابِهِ {إِنَّ أَكْرَمَكُمْ عِنْدَ اللهِ أَتْقَاكُمْ} [الحجرات 13] وَلَيْسَ عَلَيْنَا إِلَّا الْجَهْدُ فِي أَهْلِ زَمَانِنِا وَأَمَّا قَوْلُكُ إِنَّكَ أَصْبَحْتَ مُخَالِفًا لِي فَإِنَّ الرَّأْيَ يُخَالِفُ الرَّأْيَ فَاقْبَلْ هَذَا الْأَمْرَ فَقَالَ أَبُو حَنِيفَةَ يَا أَمِيرَ الْمُؤْمِنِينَ لَئِنْ خَلَّيْتَ عَنِّي وَإِلَّا لَبَّيْتُ مَكَانِيَ السَّاعَةَ فَمَا يَسَعُكَ أَنْ تَحْبِسَ مُلَبِّيًا قَالَ فَخَلَّى عَنْهُ بَعْدَ ذَلِكَ
[Machine] I heard Al-Shafi'i saying that Sufyan al-Thawri entered upon the commander of the faithful, and he began touching his beard and brushing off the dust from his cloak, saying, "How beautiful it is, how beautiful it is with you! Where did you get this from?" Then he said, "The urine, the urine," until he was removed, meaning that he deceived them to distance himself from them and be saved from their affair.
سَمِعْتُ الشَّافِعِيَّ يَقُولُ دَخَلَ سُفْيَانُ الثَّوْرِيُّ عَلَى أَمِيرِ الْمُؤْمِنِينَ فَجَعَلَ يَتَجَانَنُ عَلَيْهِمْ وَيَمْسَحُ الْبِسَاطَ وَيَقُولُ مَا أَحْسَنَهُ مَا أَحْسَنَهُ بِكَمْ أَخَذْتُمْ هَذَا؟ ثُمَّ قَالَ الْبَوْلَ الْبَوْلَ حَتَّى أُخْرِجَ يَعْنِي أَنَّهُ احْتَالَ لِيَتَبَاعَدَ مِنْهُمْ وَيَسْلَمَ مِنْ أَمْرِهِمْ
[Machine] "And a man said, praising Sufyan Al-Bahri, 'Sufyan has excelled and defended his faith, and he has become a vigilant partner in guarding the money.'"
وَقَالَ رَجُلٌ يَمْدَحُ سُفْيَانَ [البحر الطويل] تَحَرَّزَ سُفْيَانُ وَفَرَّ بِدِينِهِ وَأَمْسَى شَرِيكٌ مُرْصِدًا للدَّرَاهِمِ
[Machine] O Abu Muhammad, why don't you go out to the people and judge among them according to what Allah and His Messenger have commanded? You have driven yourself crazy and confined yourself to the house. He raised his head and said, "Is your knowledge only limited to this point? Don't you know that the judges will be gathered with the rulers on the Day of Judgment, and the scholars will be gathered with the prophets and messengers?"
يَا أَبَا مُحَمَّدٍ أَلَا تَخْرُجُ إِلَى النَّاسِ فَتَحْكُمَ بَيْنَهُمْ بِمَا أَمَرَ اللهُ وَرَسُولُهُ؟ قَدْ جَنَّنْتَ نَفْسَكَ وَلَزِمْتَ الْبَيْتَ فَرَفَعَ رَأْسَهُ إِلَيْهِ وَقَالَ إِلَى هَهُنَا انْتَهَى عِلْمُكَ؟ أَلَمْ تَعْلَمْ أَنَّ الْقُضَاةَ يُحْشَرُونَ يَوْمَ الْقِيَامَةِ مَعَ السَّلَاطِينَ وَيُحْشَرُ الْعُلَمَاءُ مَعَ الْأَنْبِيَاءِ وَالْمُرْسَلِينَ؟
[Machine] Yahya bin Yahya, justice is only applied to one of them.
يَحْيَى بْنُ يَحْيَى إِنَّمَا الْعَدَالَةُ طُبَيْقٌ يُبْعَثُ إِلَى أَحَدِهِمْ
[Machine] Yes, you committed a crime and carried a great sin, so I asked what it is. He said, "Do you see when the caller calls on the Day of Resurrection, 'Where are the companions of Abdullah bin Tahir? Aren't you among those who will be held accountable?'" I said, "I seek forgiveness from Allah and repent to Him." He said, "Then he approached me, embraced me, and said, 'Now you are my brother.'"
بَلَى جَنَيْتَ جِنَايَةً وَرَكِبْتَ ذَنْبًا عَظِيمًا فَقُلْتُ مَا هِيَ؟ قَالَ أَرَأَيْتَ إِذَا نَادَى الْمُنَادِي يَوْمَ الْقِيَامَةِ أَيْنَ أَصْحَابُ عَبْدِ اللهِ بْنِ طَاهِرٍ؟ أَلَسْتَ مِمَّنْ يُؤْخَذُ فِي الْعَدَالَةِ؟ قَالَ فَقُلْتُ أَسْتَغْفِرُ اللهَ وَأَتُوبُ إِلَيْهِ قَالَ فَدَنَا مِنِّي وَعَانَقَنِي وَقَالَ الْآنَ أَنْتَ أَخِي
[Machine] Hussein ibn Mansour al-Naysaburi was praised, and he was presented with the opportunity to become a judge in Naysabur. He disappeared for three days and prayed to God, then he died on the third day.
ثنا الْحُسَيْنُ بْنُ مَنْصُورٍ النَّيْسَابُورِيُّ وَعُرِضَ عَلَيْهِ قَضَاءُ نَيْسَابُورَ فَاخْتَفَى ثَلَاثَةَ أَيَّامٍ وَدَعَا اللهَ فَمَاتَ فِي الْيَوْمِ الثَّالِثِ
[Machine] I asked Abu Abdullah, "I have only been appointed to the Ribat, so that is why I joined it." He then started repeating to me, "Oh Ahmad, will it not be said on Judgment Day, 'Where is Abdullah ibn Taher and his followers?' Look where you will be among them."
قُلْتُ يَا أَبَا عَبْدِ اللهِ إِنَّمَا وَلَّانِي أَمْرَ الرِّبَاطِ لِذَاكَ دَخَلْتُ فِيهِ قَالَ فَجَعَلَ يُكَرِّرُ عَلَيَّ يَا أَحْمَدُ هَلْ بُدٌّ يَوْمَ الْقِيَامَةِ أَنْ يُقَالَ أَيْنَ عَبْدُ اللهِ بْنُ طَاهِرٍ وَأَتْبَاعُهُ؟ انْظُرْ أَيْنَ تَكُونُ أَنْتَ مِنْهُ
[Machine] I will consult myself tonight and inform you tomorrow, so we set off to him from tomorrow. When we arrived at his door, we found a coffin, so we asked, "What is this?" They said, "Nasr has died." So we asked his family about him, and they said, "He stayed up all night in prayer. When it was dawn, he prostrated and stayed in that position for a long time. We moved him and found him dead."
أُشَاوِرُ نَفْسِيَ اللَّيْلَةَ وَأُخْبِرُكُمْ غَدًا فَغَدَوْنَا إِلَيْهِ مِنَ الْغَدِ فَإِذَا عَلَى بَابِهِ نَعْشٌ فَقُلْنَا مَا هَذَا؟ قَالُوا مَاتَ نَصْرٌ فَسَأَلْنَا أَهْلَهُ عَنْهُ فَقَالُوا بَاتَ لَيْلَةً يُصَلِّي فَلَمَّا كَانَ فِي السَّحَرِ سَجَدَ فَأَطَالَ فَحَرَّكْنَاهُ فَوَجَدْنَاهُ مَيِّتًا ؓ
65.5 [Machine] The dislike of seeking authority and judgment, and what is disliked about being eager for them and hastening towards them, and that when one is tested with them without asking for them, the matter becomes easier, and closer to salvation.
٦٥۔٥ بَابُ كَرَاهِيَةِ طَلَبِ الْإِمَارَةِ وَالْقَضَاءِ وَمَا يُكْرَهُ مِنَ الْحِرْصِ عَلَيْهِمَا وَالتَّسَرُّعِ إِلَيْهِمَا , وَأَنَّهُ إِذَا ابْتُلِيَ بِهِمَا عَنْ غَيْرِ مَسْأَلَةٍ كَانَ الْأَمْرُ أَسْهَلَ , وَإِلَى النَّجَاةِ أَقْرَبَ
[Machine] The Messenger of Allah, ﷺ , said to me, "O Abu Abdullah, do not seek power, for if you are given it due to a request, you will be burdened with it, and if you are given it without asking, you will be held accountable for it. And if you swear an oath on something, and then see something better than it, then go to what is better and expiate for breaking your oath."
قَالَ لِي رَسُولُ 0 اللهِ ﷺ يَا أَبَا عَبْدِ الرَّحْمَنِ لَا تَسْأَلِ الْإِمَارَةَ فَإِنَّكَ إِنْ أُعْطِيتَهَا عَنْ مَسْأَلَةٍ وُكِلْتَ إِلَيْهَا وَإِنْ أُعْطِيتَهَا عَنْ غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا وَإِذَا حَلَفْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَائْتِ الَّذِي هُوَ خَيْرٌ وَكَفِّرْ عَنْ يَمِينِكَ
[Machine] The Messenger of Allah ﷺ said to me and Abu Abdullah narrated to us, Abu Bakr Ahmed bin Ishaq Al-Faqih informed me, Ismail bin Qutaybah narrated to us, Yahya bin Yahya informed us, Khaled bin Abdullah narrated from Yunus, from Al-Hassan, from Abdul Rahman bin Samurah, that the Messenger of Allah ﷺ said, "O Abdul Rahman, do not seek leadership, for if it is given to you due to your request, you will be responsible for it, and if it is given to you without your request, you will be helped with it. And if you swear an oath on something, then you see something better than it, go to what is better and expiate your oath."
قَالَ لِي رَسُولُ اللهِ ﷺ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ ثنا أَبُو بَكْرٍ أَحْمَدُ بْنُ إِسْحَاقَ الْفَقِيهُ أنبأ إِسْمَاعِيلُ بْنُ قُتَيْبَةَ ثنا يَحْيَى بْنُ يَحْيَى أنبأ خَالِدُ بْنُ عَبْدِ اللهِ عَنْ يُونُسَ عَنِ الْحَسَنِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ سَمُرَةَ ؓ أَنَّ رَسُولَ اللهِ ﷺ قَالَ يَا عَبْدَ الرَّحْمَنِ لَا تَسْأَلِ الْإِمَارَةَ فَإِنَّكَ إِنْ أُعْطِيتَهَا عَنْ مَسْأَلَةٍ وُكِلْتَ إِلَيْهَا وَإِنْ أُعْطِيتَهَا عَنْ غَيْرِ مَسْأَلَةٍ أُعِنْتَ عَلَيْهَا وَإِذَا حَلَفْتَ عَلَى يَمِينٍ فَرَأَيْتَ غَيْرَهَا خَيْرًا مِنْهَا فَائْتِ الَّذِي هُوَ خَيْرٌ وَكَفِّرَ عَنْ يَمِينِكَ
Two of my cousins and I entered the apartment of the Prophet ﷺ. One of them said: Messenger of Allah, appoint us rulers of some lands that the Almighty and Glorious God has entrusted to thy care. The other also said something similar. He said: We do not appoint to this position one who asks for it nor anyone who is covetous for the same. (Using translation from Muslim 1733c)
دَخَلْتُ عَلَى النَّبِيِّ ﷺ أَنَا وَرَجُلَانِ مِنْ بَنِي عَمِّي فَقَالَ أَحَدُ الرَّجُلَيْنِ يَا رَسُولَ اللهِ أَمِّرْنَا عَلَى بَعْضِ مَا وَلَّاكَ اللهُ وَقَالَ الْآخَرُ مِثْلَ ذَلِكَ فَقَالَ إِنَّا وَاللهِ لَا نُوَلِّي هَذَا الْعَمَلَ أَحَدًا سَأَلَهُ وَلَا أَحَدًا حِرَصَ عَلَيْهِ
The Prophet ﷺ said: If anyone desires the office of Judge and seeks help for it, he will be left to his own devices; if anyone does not desire it, nor does he seek help for it, Allah will send down an angel who will direct him aright. Waki' said: (This tradition has also been transmitted) by Isra'il, from 'Abd al-A'la, from Bilal bin Abi Musa, from Anas, from the Prophet ﷺ. Abu 'Awanah said: from 'Abd al-A'la, from Bilal bin Mirdas al-Fazari, from Khaithamah al-Basri from Anas. (Using translation from Abū Dāʾūd 3578)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنَ طَلَبَ الْقَضَاءَ وَاسْتَعَانَ عَلَيْهِ وُكِلَ إِلَيْهِ وَمَنْ لَمْ يَطْلُبْهُ وَلَمْ يَسْتَعِنْ عَلَيْهِ أَنْزَلَ اللهُ إِلَيْهِ مَلَكًا يُسَدِّدُهُ وَكَذَلِكَ
[Machine] The Prophet ﷺ said: "Whoever seeks justice and seeks intercession for it, it is entrusted to himself. And whoever is forced to it, Allah sends down an angel to guide him." Abu `Isa At-Tirmidhi said, according to what I have heard, this is a good and strange hadith, and it is more authentic than the hadith of Israel from Abdullah Ibn Athla.
أَنَّ النَّبِيَّ ﷺ قَالَ مَنِ ابْتَغَى الْقَضَاءَ وَسَأَلَ عَلَيْهِ الشُّفَعَاءَ وُكِلَ إِلَى نَفْسِهِ وَمَنْ أُكْرِهَ عَلَيْهِ أَنْزَلَ اللهُ عَلَيْهِ ﷻ مَلَكًا يُسَدِّدُهُ قَالَ أَبُو عِيسَى التِّرْمِذِيُّ فِيمَا بَلَغَنِي عَنْهُ هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ وَهُوَ أَصَحُّ مِنْ حَدِيثِ إِسْرَائِيلَ عَنْ عَبْدِ الْأَعْلَى
أَبُو مَسْعُودٍ لَا تُسَارِعُوا إِلَى الْحُكْمِ
Two men from the locality of Kindah came while AbuMas'ud al-Ansari was sitting n a circle. They said: Is there any man who decides between us. A man from the circle said: I, AbuMas'ud took a handful of pebbles and threw at him, saying: Hush! It is disapproved to make haste in decision. (Using translation from Abū Dāʾūd 3577)
دَخَلَ رَجُلَانِ مِنَ أَبْوَابِ كِنْدَةَ وَأَبُو مَسْعُودٍ الْأَنْصَارِيُّ جَالِسٌ فِي حَلْقَةٍ فَقَالَ أَلَا رَجُلٌ يَنْفُذُ بَيْنَنَا؟ فَقَالَ رَجُلٌ مِنَ الْحَلْقَةِ أَنَا قَالَ فَأَخَذَ أَبُو مَسْعُودٍ كَفًّا مِنْ حَصًى فَرَمَاهُ بِهِ وَقَالَ مَهْ إِنَّهُ كَانَ يُكْرَهُ التَّسَرُّعُ إِلَى الْحُكْمِ
[Machine] Whoever lives in the desert will suffer, and whoever follows hunting will be oblivious, and whoever goes to the ruler will be tempted. Abu Al-Qasim reported that Ibn Kaysan reported that Abu Hudhayfah reported that Sufyan narrated it from its chain of narration. He said, "The Messenger of Allah ﷺ said the same thing."
مَنْ سَكَنَ الْبَادِيَةَ جَفَا وَمَنْ تَبِعَ الصَّيْدَ غَفَلَ وَمَنْ أَتَى السُّلْطَانَ افْتُتِنْ 20254 قَالَ وَأنبأ أَبُو الْقَاسِمِ ثنا ابْنُ كَيْسَانَ ثنا أَبُو حُذَيْفَةَ ثنا سُفْيَانُ فَذَكَرَهُ بِإِسْنَادِهِ قَالَ قَالَ رَسُولُ اللهِ ﷺ مِثْلَهُ
[Machine] The Messenger of Allah ﷺ said: "Whoever starts a conflict, he is unjust, and whoever follows the game, he is heedless, and whoever approaches the doors of the ruler, he is tempted, and no servant increases in proximity to the ruler, except that he increases in distancing himself from Allah." And it was narrated by someone other than Al-Nakha'i, from 'Adi, from a Sheikh of the Ansar, from Abu Hurairah, from the Prophet ﷺ with its meaning.
قَالَ رَسُولُ اللهِ ﷺ مَنْ بَدَا جَفَا وَمَنِ اتَّبَعَ الصَّيْدَ غَفَلَ وَمَنْ أَتَى أَبْوَابَ السُّلْطَانِ يُفْتَتَنْ وَمَا ازْدَادَ عَبْدٌ مِنْ سُلْطَانٍ قُرْبًا إِلَّا ازْدَادَ مِنَ اللهِ بُعْدًا وَرَوَاهُ غَيْرُهُ عَنِ النَّخَعِيِّ عَنْ عَدِيٍّ عَنْ شَيْخٍ مِنَ الْأَنْصَارِ عَنْ أَبِي هُرَيْرَةَ ؓ عَنِ النَّبِيِّ ﷺ بِمَعْنَاهُ
65.6 [Machine] What is recommended for a judge to do in a prominent place for people, where there is no barrier, and to be in the middle of the courtroom.
٦٥۔٦ بَابُ مَا يُسْتَحَبُّ لِلْقَاضِي مِنْ أَنْ يَقْضِيَ فِي مَوْضِعٍ بَارِزٍ لِلنَّاسِ , لَا يَكُونُ دُونَهُ حِجَابٌ , وَأَنْ يَكُونَ مُتَوسِّطَ الْمِصْرِ
[Machine] Do you know so-and-so from among her people? For the Messenger of Allah ﷺ passed by her while she was weeping at a grave, and he said to her, "Fear Allah and be patient." She replied, "Leave me alone, for you do not care about my suffering." It was then said to her, "This is the Messenger of Allah ﷺ ." She became motionless like a dead person, and she hurriedly went to his door but did not find any doors. So, she entered upon him and said, "O Messenger of Allah, I did not recognize you." He said to her, "Patience is at the first strike."
لِبَعْضِ أَهْلِهِ أَتَعْرِفِينَ فُلَانَةَ؟ فَإِنَّ رَسُولَ اللهِ ﷺ مَرَّ بِهَا وَهِيَ عِنْدَ قَبْرٍ تَبْكِي فَقَالَ لَهَا اتَّقِي اللهَ وَاصْبِرِي فَقَالَتْ إِلَيْكَ عَنِّي فَإِنَّكَ لَا تُبَالِي بِمُصِيبَتِي فَقِيلَ لَهَا إِنَّهُ رَسُولُ اللهِ ﷺ فَأَخَذَهَا مِثْلُ الْمَوْتِ فَانْتَهَتْ إِلَى بَابِهِ فَلَمْ تَجِدْ بَوَّابِينَ فَدَخَلَتْ عَلَيْهِ فَقَالَتْ يَا رَسُولَ اللهِ إِنِّي لَمْ أَعْرِفْكَ فَقَالَ لَهَا الصَّبْرُ عِنْدَ أَوَّلِ صَدْمَةٍ
[Machine] The Messenger of Allah ﷺ did not have doors closed in front of him, nor did curtains stand in front of him, nor was food placed for him in dishes, nor did he recline on cushions. The Messenger of Allah ﷺ was outstanding. Whoever wanted to meet the Messenger of Allah ﷺ would meet him while he was sitting on the ground, and his food would be placed on the ground. He wore coarse wool and rode a donkey, and his companions followed him. And, by Allah, he would lick his fingers.
أَنَّ رَسُولَ اللهِ ﷺ كَانَ لَا يُغْلَقُ دُونَهُ الْأَبْوَابُ وَلَا يَقُومُ دُونَهُ الْحَجَبَةُ وَلَا يُغْدَى عَلَيْهِ بِالْجِفَانِ وَلَا يُرَاحُ عَلَيْهِ بِهَا كَانَ رَسُولُ اللهِ ﷺ بَارِزًا مَنْ أَرَادَ أَنْ يَلْقَى رَسُولَ اللهِ ﷺ لَقِيَهُ كَانَ يَجْلِسُ بِالْأَرْضِ وَيُوضَعُ طَعَامُهُ بِالْأَرْضِ وَيَلْبَسُ الْغَلِيظَ وَيَرْكَبُ الْحِمَارَ وَيُرْدِفُ خَلْفَهُ وَيَلْعَقُ وَاللهِ يَدَهُ
