65. Etiquettes of Judements
٦٥۔ كِتَابُ آدَابِ الْقَاضِي
[Machine] In his statement, "and consult them in the matter" [Al-Imran 159], Abu Bakr and Umar said.
فِي قَوْلِهِ ﷻ {وَشَاوِرْهُمْ فِي الْأَمْرِ} [آل عمران 159] قَالَ أَبُو بَكْرٍ وَعُمَرُ ؓ
[Machine] The Prophet ﷺ said, "Tell me, do you think it is better for us to incline towards the weak and support them, so that they may benefit from us? Or do you think it is better for us to attack the Kaaba and whoever opposes us, we kill them?" Abu Bakr replied, "Allah and His Messenger know best. We have only come for pilgrimage and not to fight anyone. But if anyone stands between us and the Kaaba, we will fight them." The Prophet ﷺ said, "Alright then, go." Al-Zuhri said, Abu Huraira said, "I have never seen anyone consult with his companions more than the Messenger of Allah ﷺ ."
النَّبِيُّ ﷺ أَشِيرُوا عَلَيَّ أَتَرَوْنَ أَنْ نَمِيلَ إِلَى ذَرَارِيِّ هَؤُلَاءِ الَّذِينَ أَعَانُوهُمْ فَنُصِيبَهُمْ أَمْ تَرَوْنَ أَنْ نَؤُمَّ الْبَيْتَ فَمَنْ صَدَّنَا عَنْهُ قَاتَلْنَاهُ؟ قَالَ أَبُو بَكْرٍ ؓ اللهُ وَرَسُولُهُ أَعْلَمُ إِنَّمَا جِئْنَا مُعْتَمِرِينَ وَلَمْ نَجِئْ لِقِتَالِ أَحَدٍ وَلَكِنْ مَنْ حَالَ بَيْنَنَا وَبَيْنَ الْبَيْتِ قَاتَلْنَاهُ فَقَالَ النَّبِيُّ ﷺ فَرُوحُوا إِذًا قَالَ الزُّهْرِيُّ قَالَ أَبُو هُرَيْرَةَ مَا رَأَيْتُ أَحَدًا كَانَ أَكْثَرَ مُشَاوَرَةً لِأَصْحَابِهِ مِنْ رَسُولِ اللهِ ﷺ
[Machine] The Messenger of Allah ﷺ consulted the Muslims when he went to Badr. Abu Bakr pointed towards it first, then Umar pointed towards it. Then they consulted the Muslims and the Ansaar said, "O people of the Ansaar, beware! The Messenger of Allah ﷺ wants you." They said, "Then we will not say what the Children of Israel said to Musa, 'Go, you and your Lord, and fight; we are sitting here.'" And by the one who sent you with the truth, if you were to strike their livers until they reached the other side of the valley, we would still follow you."
أَنَّ رَسُولَ اللهِ ﷺ لَمَّا سَارَ إِلَى بَدْرٍ اسْتَشَارَ الْمُسْلِمِينَ فَأَشَارَ عَلَيْهِ أَبُو بَكْرٍ ؓ ثُمَّ اسْتَشَارَهُمْ فَأَشَارَ عَلَيْهِ عُمَرُ ؓ ثُمَّ اسْتَشَارَهُمْ فَقَالَتِ الْأَنْصَارُ يَا مَعْشَرَ الْأَنْصَارِ إِيَّاكُمْ يُرِيدُ رَسُولُ اللهِ ﷺ قَالُوا إِذًا لَا نَقُولُ كَمَا قَالَتْ بَنُو إِسْرَائِيلَ لِمُوسَى {اذْهَبْ أَنْتَ وَرَبُّكَ فَقَاتِلَا إِنَّا هَاهُنَا قَاعِدُونَ} وَالَّذِي بَعَثَكَ بِالْحَقِّ لَوْ ضَرَبْتَ أَكْبَادَهَا إِلَى بَرْكِ الْغِمَادِ لَاتَّبَعْنَاكَ
[Machine] On the day of the Battle of Badr, the Prophet asked, "What do you think of these prisoners?" Abu Bakr replied, "O Prophet of Allah, they are cousins, families, and brethren, but we take ransom from them to gain strength against the polytheists. It is possible that Allah may guide them to Islam and they may become our supporters." The Prophet asked, "What do you think, O Ibn Al-Khattab?" I replied, "O Prophet of Allah, I don't see what Abu Bakr sees, but they are the leaders of disbelief and their forelocks should be brought near and struck." The Messenger of Allah favored what Abu Bakr had said and did not show interest in what I had said, nor did he accept ransom from them. When it was morning, I went to the Messenger of Allah and found him and Abu Bakr sitting together and weeping. I said, "O Prophet of Allah, tell me why you and your companion are weeping. If I find reason to cry, I will cry; otherwise, I will pretend to cry." The Prophet said, "What was presented to me by your companions was an offer of ransom from you that is less than this tree and a nearby tree at that time." Then, Allah sent down the revelation: "It is not for a Prophet to have prisoners of war until he has made a great slaughter in the land. You desire the commodities of this world, but Allah desires the Hereafter. And Allah is Exalted in Might and Wise." [Quran 8:67]
لَمَّا كَانَ يَوْمُ بَدْرٍ قَالَ مَا تَرَوْنَ فِي هَؤُلَاءِ الْأَسْرَى؟ فَقَالَ أَبُو بَكْرٍ ؓ يَا نَبِيَّ اللهِ بَنُو الْعَمِّ وَالْعَشِيرَةُ وَالْإِخْوَانُ غَيْرَ أَنَّا نَأْخُذُ مِنْهُمُ الْفِدَاءَ لِيَكُونَ لَنَا قُوَّةً عَلَى الْمُشْرِكِينَ وَعَسَى اللهُ أَنْ يَهْدِيَهُمْ إِلَى الْإِسْلَامِ وَيَكُونُوا لَنَا عَضُدًا قَالَ فَمَاذَا تَرَى يَا ابْنَ الْخَطَّابِ؟ قُلْتُ يَا نَبِيَّ اللهِ مَا أَرَى الَّذِي رَأَى أَبُو بَكْرٍ وَلَكِنَّ هَؤُلَاءِ أَئِمَّةُ الْكُفْرِ وَصَنَادِيدُهُمْ فَقَرِّبْهُمْ فَاضْرِبْ أَعْنَاقَهُمْ قَالَ فَهَوَى رَسُولُ اللهِ ﷺ مَا قَالَ أَبُو بَكْرٍ ؓ وَلَمْ يَهْوَ مَا قُلْتُ أَنَا وَأَخَذَ مِنْهُمُ الْفِدَاءَ فَلَمَّا أَصْبَحْتُ غَدَوْتُ عَلَى رَسُولِ اللهِ ﷺ وَإِذَا هُوَ وَأَبُو بَكْرٍ ؓ قَاعِدَانِ يَبْكِيَانِ فَقُلْتُ يَا نَبِيَّ اللهِ أَخْبِرْنِي مِنْ أِيِّ شَيْءٍ تَبْكِي أَنْتَ وَصَاحِبُكَ فَإِنْ وَجَدْتُ بُكَاءً بَكَيْتُ وَإِلَّا تَبَاكَيْتُ لِبُكَائِكُمَا قَالَ الَّذِي عَرَضَ عَلَيَّ أَصْحَابُكَ لَقَدْ عُرِضَ عَلَيَّ عَذَابُكُمْ أَدْنَى مِنْ هَذِهِ الشَّجَرَةِ وَشَجَرَةٌ قَرِيبَةٌ حِينَئِذٍ فَأَنْزَلَ اللهُ ﷻ {مَا كَانَ لِنَبِيٍّ أَنْ يَكُونَ لَهُ أَسْرَى حَتَّى يُثْخِنَ فِي الْأَرْضِ تُرِيدُونَ عَرَضَ الدُّنْيَا وَاللهُ يُرِيدُ الْآخِرَةَ وَاللهُ عَزِيزٌ حَكِيمٌ} [الأنفال 67]
[Machine] About saying "and consult them in the matter" [Quran 3:159], Al-Hasan said: Allah, may He be exalted, taught him that he did not need anything from them, but he wanted to use it as an example for those who would come after him.
عَنِ الْحَسَنِ فِي قَوْلِهِ ﷻ {وَشَاوِرْهُمْ فِي الْأَمْرِ} [آل عمران 159] قَالَ عَلَّمَهُ اللهُ سُبْحَانَهُ أَنَّهُ مَا بِهِ إِلَيْهِمْ مِنْ حَاجَةٍ وَلَكِنْ أَرَادَ أَنْ يَسْتَنَّ بِهِ مَنْ بَعْدَهُ
[Machine] That he should follow the document from the judiciary, so he should follow the judgment of Umar, as he used to consult.
أَنْ يَأْخُذَ بِالْوَثِيقَةِ مِنَ الْقَضَاءِ فَلْيَأْخُذْ بِقَضَاءِ عُمَرَ فَإِنَّهُ كَانَ يَسْتَشِيرُ
[Machine] The Messenger of Allah ﷺ said: "The pinnacle of wisdom after belief in Allah is to show love and kindness towards people. No person can do without seeking consultation, and the people of good manners and morals in this world are the people of good manners and morals in the Hereafter. And indeed, the people of evil and vice in this world are the people of evil and vice in the Hereafter."
قَالَ رَسُولُ اللهِ ﷺ رَأْسُ الْعَقْلِ بَعْدَ الْإِيمَانِ بِاللهِ التَّوَدُّدُ إِلَى النَّاسِ وَمَا يَسْتَغْنِي رَجُلٌ عَنْ مَشُورَةٍ وَإِنَّ أَهْلَ الْمَعْرُوفِ فِي الدُّنْيَا هُمْ أَهْلُ الْمَعْرُوفِ فِي الْآخِرَةِ وَإِنَّ أَهْلَ الْمُنْكَرِ فِي الدُّنْيَا هُمْ أَهْلُ الْمُنْكَرِ فِي الْآخِرَةِ
[Machine] There are three men: one complete man who has an opinion and seeks advice, one half man who has no opinion but seeks advice, and one man who has neither an opinion nor seeks advice.
الرِّجَالُ ثَلَاثَةٌ فَرَجُلٌ وَنِصْفُ رَجُلٍ وَلَا شَيْءَ فَأَمَّا الرَّجُلُ التَّامُّ فَالَّذِي لَهُ رَأْيٌ وَهُوَ يَسْتَشِيرُ وَأَمَّا نِصْفُ رَجُلٍ فَالَّذِي لَيْسَ لَهُ رَأْيٌ وَهُوَ يَسْتَشِيرُ وَأَمَّا الَّذِي لَا شَيْءَ فَالَّذِي لَيْسَ لَهُ رَأْيٌ وَلَا يَسْتَشِيرُ
[Machine] To be a judge, one should possess five qualities: chastity, forbearance, knowledge of what came before, seeking the advice of knowledgeable people, and not caring about people's criticism.
أَنْ يَكُونَ قَاضِيًا حَتَّى يَكُونَ فِيهِ خَمْسُ خِصَالٍ عَفِيفٌ حَلِيمٌ عَالِمٌ بِمَا كَانَ قَبْلَهُ يَسْتَشِيرُ ذَوِي الْأَلْبَابِ لَا يُبَالِي بِمَلَامَةِ النَّاسِ
إِذَا شِئْتُمْ
[Machine] Sulaiman bin Dawud, ﷺ , said to his son, "O my son, do not make a decision until you consult a guide, for if you do that, you will not regret it."
قَالَ سُلَيْمَانُ بْنُ دَاوُدَ عَلَيْهِ السَّلَامُ لِابْنِهِ يَا بُنِيَّ لَا تَقْطَعْ أَمْرًا حَتَّى تُؤَامِرَ مُرْشِدًا فَإِنَّكَ إِذَا فَعَلْتَ ذَلِكَ لَمْ تَحْزَنْ عَلَيْهِ
[Machine] As for you, Salman, your characteristic is not to get angry. And as for you, Amr, it is part of your character to consult him in his ear.
أَمَّا أَنْتَ يَا سَلْمَانُ فَمَا كَانَ نَوْلُكَ تَغْضَبُ وَأَمَّا أَنْتَ يَا عَمْرُو فَكَانَ مِنْ نَوْلِكَ تُشَاوِرُهُ فِي أُذُنِهِ
