65. Etiquettes of Judements

٦٥۔ كِتَابُ آدَابِ الْقَاضِي

65.53 [Machine] It is not permissible for a judge to summon the opponent except when his opponent is present in order to settle the matter between them, and it has been narrated that there is a weakness in the chain of narration.

٦٥۔٥٣ بَابُ لَا يَنْبَغِي لِلْقَاضِي أَنْ يُضِيفَ الْخَصْمَ إِلَّا وَخَصْمُهُ مَعَهُ لِمَا مَضَى مِنَ الْأَمْرِ بِالتَّسْوِيَةِ بَيْنَهُمَا وَرُوِيَ فِيهِ أَثَرٌ بِإِسْنَادٍ فِيهِ ضَعْفٌ

[Machine] A man came to Ali while he was in Kufa, and he claimed to be his opponent. Ali asked him, "Are you my opponent?" The man affirmed, and Ali said, "Then let us go to the arbitrator, for the Messenger of Allah forbade us from accepting an opponent unless his opponent is also present." Abu Muawiya and others related this story to Isma'il in the same manner.  

البيهقي:٢٠٤٧٠أَخْبَرَنَا أَبُو عَلِيٍّ الرُّوذْبَارِيُّ ثنا عَبْدُ اللهِ بْنُ عُمَرَ بْنِ شَوْذَبٍ الْوَاسِطِيُّ ثنا شُعَيْبُ بْنُ أَيُّوبَ ثنا إِسْمَاعِيلُ بْنُ عَبْدِ اللهِ بْنِ بِشْرٍ عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ عَنِ الْحَسَنِ قَالَ

نَزَلَ عَلَى عَلِيٍّ ؓ رَجُلٌ وَهُوَ بِالْكُوفَةِ ثُمَّ قَدِمَ خَصْمًا لَهُ فَقَالَ لَهُ عَلِيٌّ ؓ أَخَصْمٌ أَنْتَ؟ قَالَ نَعَمْ قَالَ فَتَحَوَّلْ فَإِنَّ رَسُولَ اللهِ ﷺ نَهَانَا أَنْ نُضِيفَ الْخَصْمَ إِلَّا وَخَصْمُهُ مَعَهُ تَابَعَهُ أَبُو مُعَاوِيَةَ وَغَيْرُهُ عَنْ إِسْمَاعِيلَ بِمَعْنَاهُ هَكَذَا

[Machine] A man narrated to us that he came to stay with Ali in Kufa for some days. Then he mentioned a dispute he had. So Ali told him, "Leave my abode for the Messenger of Allah ﷺ forbade that a disputant should stay except with his opponent."  

البيهقي:٢٠٤٧١وَأَخْبَرَنَا الشَّرِيفُ أَبُو الْفَتْحِ الْعُمَرِيُّ أنبأ عَبْدُ الرَّحْمَنِ الشُّرَيْحِيُّ ثنا أَبُو الْقَاسِمِ الْبَغَوِيُّ ثنا مُحَمَّدُ بْنُ بَكَّارٍ ثنا قَيْسُ بْنُ الرَّبِيعِ عَنْ إِسْمَاعِيلَ بْنِ مُسْلِمٍ عَنِ الْحَسَنِ قَالَ

حَدَّثَنَا رَجُلٌ نَزَلَ عَلَى عَلِيٍّ ؓ بِالْكُوفَةِ فَأَقَامَ عِنْدَهُ أَيَّامًا ثُمَّ ذَكَرَ خُصُومَةً لَهُ فَقَالَ لَهُ عَلِيٌّ ؓ تَحَوَّلْ عَنْ مَنْزِلِي فَإِنَّ رَسُولَ اللهِ ﷺ نَهَى أَنْ يَنْزِلَ الْخَصْمُ إِلَّا وَخَصْمُهُ مَعَهُ

[Machine] The Prophet ﷺ used to not invite his opponent unless his opponent was accompanied by him.  

البيهقي:٢٠٤٧٢وَقَرَأْتُ فِي كِتَابِ ابْنِ خُزَيْمَةَ عَنْ مُوسَى بْنِ سَهْلٍ الرَّمْلِيِّ عَنْ مُحَمَّدِ بْنِ عَبْدِ الْعَزِيزِ الرَّمْلِيِّ عَنِ الْقَاسِمِ بْنِ غُصْنٍ عَنْ دَاوُدَ بْنِ أَبِي هِنْدَ عَنْ أَبِي حَرْبِ بْنِ الْأَسْوَدِ الدِّيلِيِّ عَنْ أَبِيهِ عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ ؓ قَالَ

كَانَ النَّبِيُّ ﷺ لَا يُضِيفُ الْخَصْمَ إِلَّا وَخَصْمُهُ مَعَهُ
