65. Etiquettes of Judements
٦٥۔ كِتَابُ آدَابِ الْقَاضِي
[Machine] In His statement, "And (mention) David and Solomon, when they judged concerning the field – when the sheep of a people overran it [at night], and We were witnesses to their judgement. And We gave understanding of the case to Solomon, and to each (of them) We gave judgement and knowledge." (Quran 21: 79), it is narrated from Masrooq and Mujahid the meaning of this (verse). And Allah (swt) returned the judgement in this incident and similar incidents to what the Messenger of Allah ﷺ ruled in the case of the camel of Bara' ibn Azib when it entered the farmland of some of the Ansar and caused damage. He ruled that during the day, the owners are responsible for safeguarding their wealth, and during the night, the owners of the livestock are responsible for any damage caused by the livestock. Ash-Shafi'i said, al-Hasan ibn Abi al-Hasan said, "If it were not for this verse, I would have thought that the judges have perished. However, Allah praised this (judgement) for its correctness and commended it for its effort."
فِي قَوْلِهِ ﷻ {وَدَاوُدَ وَسُلَيْمَانَ إِذْ يَحْكُمَانِ فِي الْحَرْثِ إِذْ نَفَشَتْ فِيهِ غَنْمُ الْقَوْمِ} قَالَ كَرْمٌ وَقَدْ أَنْبَتَتْ عَنَاقِيدُهُ فَأَفْسَدَتْهُ قَالَ فَقَضَى دَاوُدُ عَلَيْهِ السَّلَامُ بِالْغَنَمِ لِصَاحِبِ الْكَرْمِ فَقَالَ سُلَيْمَانُ غَيْرَ هَذَا يَا نَبِيَّ اللهِ ﷺ قَالَ وَمَا ذَاكَ؟ قَالَ تَدْفَعُ الْكَرْمَ إِلَى صَاحِبِ الْغَنَمِ فَيَقُومُ عَلَيْهِ حَتَّى يَعُودَ كَمَا كَانَ وَتَدْفَعُ الْغَنَمَ إِلَى صَاحِبِ الْكَرْمِ فَيُصِيبُ مِنْهَا حَتَّى إِذَا كَانَ الْكَرْمُ كَمَا كَانَ دَفَعْتَ الْكَرْمَ إِلَى صَاحِبِهِ وَدَفَعْتَ الْغَنَمَ إِلَى صَاحِبِهَا قَالَ اللهُ ﷻ {فَفَهَّمْنَاهَا سُلَيْمَانَ وَكُلًّا آتَيْنَا حُكْمًا وَعِلْمًا} [الأنبياء 79] وَرُوِّينَا عَنْ مَسْرُوقٍ وَمُجَاهِدٍ مَعْنَى هَذَا وَقَدْ رَدَّ اللهُ تَعَالَى الْحُكْمَ فِي هَذِهِ الْحَادَثةِ وَأَشْبَاهِهَا إِلَى مَا حَكَمَ بِهِ رَسُولُ اللهِ ﷺ فِي نَاقَةِ الْبَرَاءِ بْنِ عَازِبٍ حِينَ دَخَلَتْ حَائِطًا لِقَوْمٍ مِنَ الْأَنْصَارِ فَأَفْسَدَتْ فَقَضَى أَنَّ حِفْظَ الْأَمْوَالِ عَلَى أَهْلِهَا بِالنَّهَارِ وَعَلَى أَهْلِ الْمَوَاشِي مَا أَفْسَدَتِ الْمَوَاشِي بِاللَّيْلِ قَالَ الشَّافِعِيُّ قَالَ الْحَسَنُ بْنُ أَبِي الْحَسَنِ لَوْلَا هَذِهِ الْآيَةُ لَرَأَيْتُ أَنَّ الْحُكَّامَ قَدْ هَلَكُوا وَلَكِنَّ اللهَ حَمِدَ هَذَا بِصَوَابِهِ وَأَثْنَى عَلَى هَذَا بِاجْتِهَادِهِ
[Machine] He heard the Messenger of Allah ﷺ say: "When the judge judges and makes an effort and is correct, he will have two rewards. And when the judge judges and makes an effort and makes a mistake, he will have one reward." Ibn Al-Hadd said: I narrated this Hadith to Abu Bakr bin Muhammad bin Amr bin Hazm, and he said: Thus Abu Salamah bin Abdur-Rahman narrated to me from Abu Hurairah from the Prophet ﷺ .
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ إِذَا حَكْمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ وَإِذَا حَكْمَ الْحَاكِمُ فَاجْتَهَدَ فَأَخْطَأَ فَلَهُ أَجْرٌ قَالَ يَعْنِي ابْنَ الْهَادِ فَحَدَّثْتُ بِهَذَا الْحَدِيثِ أَبَا بَكْرِ بْنَ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ فَقَالَ هَكَذَا حَدَّثَنِي أَبُو سَلَمَةَ بْنُ عَبْدِ الرَّحْمَنِ عَنْ أَبِي هُرَيْرَةَ ؓ عَنِ النَّبِيِّ ﷺ
[Machine] About the Prophet ﷺ , he said: "When a judge makes a decision and strives hard, and he is correct, he will have two rewards. And if he makes a decision and strives hard, but he is mistaken, he will still have a reward. This is reported only by Ma'mar, who narrated it from Sufyan and no one else."
عَنِ النَّبِيِّ ﷺ قَالَ إِذَا حَكَمَ الْحَاكِمُ فَاجْتَهَدَ فَأَصَابَ فَلَهُ أَجْرَانِ وَإِذَا حَكَمَ فَاجْتَهَدَ فَأَخْطَأَ فَلَهُ أَجْرٌ لَمْ يَرْوِهِ عَنْ سُفْيَانَ إِلَّا مَعْمَرٌ تَفَرَّدَ بِهِ عَنْهُ عَبْدُ الرَّزَّاقِ
[Machine] The Messenger of Allah ﷺ said, "Whoever seeks knowledge and obtains it, he will have such and such reward. And if he does not obtain it, he will have such and such reward."
قَالَ رَسُولُ اللهِ ﷺ مَنْ طَلَبَ عِلْمًا فَأَدْرَكَهُ كَانَ لَهُ كِفْلَانِ مِنَ الْأَجْرِ فَإِنْ لَمْ يُدْرِكْهُ كَانَ لَهُ كِفْلٌ مِنَ الْأَجْرِ
On the day he returned from the Battle of Ahzab, the Messenger of Allah ﷺ made for us an announcement that nobody would say his Zuhr prayer but in the quarters of Banu Quraiza (Some) people, being afraid that the time for prayer would expire, said their prayers before reaching the street of Banu Quraiza. The others said: We will not say our prayer except where the Messenger of Allah ﷺ has ordered us to say it even if the time expires. When he learned of the difference in the view of the two groups of the people, the Messenger of Allah (may peace be tipon him) did not blame anyone from the two groups. نَادَى فِينَا رَسُولُ اللهِ ﷺ يَوْمَ انْصَرَفَ مِنَ الْأَحْزَابِ أَلَا لَا يُصَلِّيَنَّ أَحَدٌ الظُّهْرَ إِلَّا فِي بَنِي قُرَيْظَةَ قَالَ فَتَخَوَّفَ نَاسٌ فَوْتَ الْوَقْتِ فَصَلَّوْا دُونَ بَنِي قُرَيْظَةَ وَقَالَ آخَرُونَ لَا نُصَلِّي إِلَّا حَيْثُ أَمَرَنَا رَسُولُ اللهِ ﷺ وَإِنْ فَاتَنَا الْوَقْتُ قَالَ فَمَا عَنَّفَ وَاحِدًا مِنَ الْفَرِيقَيْنِ
