65. Etiquettes of Judements (3/7)
٦٥۔ كِتَابُ آدَابِ الْقَاضِي ص ٣
[Machine] Allah, may His praise be exalted, said: "Indeed, Allah commands you to render trusts to whom they are due and when you judge between people to judge with justice." (Quran 4:58) And He said to His Prophet, peace be upon him: "And judge between them by what Allah has revealed and do not follow their inclinations." (Quran 5:49) And the Messenger of Allah, peace be upon him, appointed workers and judges, and so did the caliphs after him. They serve as examples in the Sharia. Success and protection are from Allah alone.
قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {إِنَّ اللهَ يَأْمُرُكُمْ أَنْ تُؤَدُّوا الْأَمَانَاتِ إِلَى أَهْلِهَا وَإِذَا حَكَمْتُمْ بَيْنَ النَّاسِ أَنْ تَحْكُمُوا بِالْعَدْلِ} [النساء: 58] , وَقَالَ لِنَبِيِّهِ ﷺ: {وَأَنِ احْكُمْ بَيْنَهُمْ بِمَا أَنْزَلَ اللهُ وَلَا تَتَّبِعْ أَهْوَاءَهُمْ} [المائدة: 49] , وَبَعَثَ رَسُولُ اللهِ ﷺ الْعُمَّالَ وَالْقُضَاةَ , وَكَذَلِكَ الْخُلَفَاءُ بَعْدَهُ , وَبِهِمُ الْقُدْوَةُ فِي الشَّرِيعَةِ , وَبِاللهِ التَّوْفِيقُ وَالْعِصْمَةُ
[Machine] About a man from Palestine, known as Abu Maryam Al-Asadi, who came to Mu'awiyah. Mu'awiyah asked him, "What brings you here?" He replied, "I heard a hadith from the Messenger of Allah ﷺ , and when I saw your position, I came to inform you. I heard the Messenger of Allah ﷺ saying, 'Whoever Allah appoints as a leader over the affairs of the people, and he conceals himself from their needs, shortcomings, and concerns, Allah will conceal his needs, shortcomings, and concerns on the Day of Judgment.'"
عَنْ رَجُلٍ مِنْ أَهْلِ فِلَسْطِينَ يُكْنَى أَبَا مَرْيَمَ مِنَ الْأُسْدِ قَدِمَ عَلَى مُعَاوِيَةَ فَقَالَ لَهُ مُعَاوِيَةُ مَا أَقْدَمَكَ؟ قَالَ حَدِيثٌ سَمِعْتُهُ مِنْ رَسُولِ اللهِ ﷺ فَلَمَّا رَأَيْتُ مَوقِفَكَ جِئْتُ أُخْبِرُكَ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ وَلَّاهُ اللهُ مِنْ أَمْرِ النَّاسِ شَيْئًا فَاحْتَجَبَ عَنْ حَاجَاتِهِمْ وَخَلَّتِهِمْ وَفَاقَتِهِمْ احْتَجَبَ اللهُ يَوْمَ الْقِيَامَةِ عَنْ حَاجَتِهِ وَخَلَّتِهِ وَفَاقَتِهِ
65.7 [Machine] The license for wearing a face veil outside of court sessions, and during court sessions if there is a fear of overcrowding.
٦٥۔٧ بَابُ الرُّخْصَةِ فِي الِاحْتِجَابِ فِي غَيْرِ وَقْتِ الْقَضَاءِ , وَفِي وَقْتِ الْقَضَاءِ إِذَا خَشِيَ الِازْدِحَامَ عَلَيْهِ
[Machine] And I came to the drinking place where the Messenger of Allah ﷺ was. I said to a young boy with a black complexion, "Seek permission for Umar." The boy entered and spoke to the Messenger of Allah ﷺ , then returned to me and said, "I spoke to the Messenger of Allah ﷺ and mentioned you to him, but he remained silent." So I went and sat with the group of people near the pulpit. Then I became overwhelmed by something I couldn't find, so I went to the boy and said to him, "Seek permission for Umar ibn Al-Khattab." He entered and then came back to me and said, "The Messenger of Allah ﷺ has granted you permission." So I entered upon the Messenger of Allah ﷺ and found him lying on a bed made of palm leaves, without a mattress between him and it. The sand had left marks on his side, and he was reclining on a pillow filled with date fiber. And he mentioned the Hadith.
فَجِئْتُ الْمَشْرَبَةَ الَّتِي فِيهَا رَسُولُ اللهِ ﷺ فَقُلْتُ لِغُلَامٍ لَهُ أَسْوَدَ اسْتَأْذِنْ لِعُمَرَ فَدَخَلَ الْغُلَامُ فَكَلَّمَ رَسُولَ اللهِ ﷺ ثُمَّ رَجَعَ إِلِيَّ فَقَالَ كَلَّمْتُ رَسُولَ اللهِ ﷺ وَذَكَرْتُكَ لَهُ فَصَمَتَ فَرَجَعْتُ فَجَلَسْتُ مَعَ الرَّهْطِ الَّذِينَ عِنْدَ الْمِنْبَرِ ثُمَّ غَلَبَنِي مَا أَجِدُ فَجِئْتُ الْغُلَامَ فَقُلْتُ لَهُ اسْتَأْذِنْ لِعُمَرَ بْنِ الْخَطَّابِ فَدَخَلَ ثُمَّ رَجَعَ إِلِيَّ فَقَالَ قَدْ ذَكَرْتُكَ لَهُ فَصَمَتَ قَالَ فَلَمَّا وَلَّيْتُ مُنْصَرِفًا إِذَا الْغُلَامُ يَدْعُونِي فَقَالَ قَدْ أَذِنَ لَكَ رَسُولُ اللهِ ﷺ فَدَخَلْتُ عَلَى رَسُولِ اللهِ ﷺ فَإِذَا هُوَ مُضْطَجِعٌ عَلَى رِمَالِ حَصِيرٍ لَيْسَ بَيْنَهُ وَبَيْنَهُ فِرَاشٌ قَدْ أَثَّرَ الرِّمَالُ بِجَنْبِهِ مُتَّكِئٌ عَلَى وِسَادَةٍ مِنْ أَدَمٍ حَشْوُهَا اللِّيفُ وَذَكَرَ الْحَدِيثَ
[Machine] I sat among my family when the day was pleasant, and suddenly the messenger of Umar ibn al-Khattab came and said, "Answer the Commander of the Faithful." So I went with him until we entered upon Umar. There he was sitting on a bed of sand, with no mattress between him and the sand, reclining on a pillow made of leather. I greeted him, and then I sat down. He said to me, "Here, O Malik, O Malik, some people from your tribe, the Banu Abiyyat, have arrived, and you have been ordered to divide between them." I said, "O Commander of the Faithful, if you had ordered someone else to do it." He said, "Then take it, O man." So while I was sitting with him, his chamberlain came in and informed him. He said, "Do you have a matter concerning Uthman, Abdurrahman, Zubair, and Saad asking for your permission?"; he said, "Yes, give them permission." They entered and greeted him. He waited a little while, and then he said to Umar, "Do you have a matter concerning Ali and Abbas?" He said, "Yes, give them permission." When they entered, they greeted him and sat down. Abbas said, "O Commander of the Faithful, settle the matter between me and this man." Then Uthman and his companions said, "O Commander of the Faithful, settle the matter between them and relieve one of them from the other." And he mentioned the conversation.
لِي مَالِكٌ بَيْنَا أَنَا جَالِسٌ فِي أَهْلِي حِينَ مَتَعَ النَّهَارُ إِذَا رَسُولُ عُمَرَ بْنِ الْخَطَّابِ ؓ قَالَ أَجِبْ أَمِيرَ الْمُؤْمِنِينَ فَانْطَلَقْتُ مَعَهُ حَتَّى إِذَا دَخَلْتُ عَلَى عُمَرَ فَإِذَا هُوَ جَالِسٌ عَلَى رِمَالِ سَرِيرٍ لَيْسَ بَيْنَهُ وَبَيْنَهُ فِرَاشٌ مُتَّكِئٌ عَلَى وِسَادَةٍ مِنْ أَدَمٍ فَسَلَّمْتُ عَلَيْهِ ثُمَّ جَلَسْتُ فَقَالَ لِي هَهُنَا يَا مَالِ يَعْنِي يَا مَالِكُ إِنَّهُ قَدْ قَدِمَ أَهْلُ أَبْيَاتٍ مِنْ قَوْمِكَ وَقَدْ أُمِّرْتَ لَهُمْ فَاقْسِمْ بَيْنَهُمْ قَالَ فَقُلْتُ يَا أَمِيرَ الْمُؤْمِنِينَ لَوْ أَمَّرْتَ بِهِ غَيْرِي قَالَ فَاقْبِضْهُ أَيُّهَا الْمَرْءُ قَالَ فَبَيْنَا أَنَا جَالِسٌ عِنْدَهُ إِذْ جَاءَهُ حَاجِبُهُ يَرْفَأُ فَقَالَ هَلْ لَكَ فِي عُثْمَانَ وَعَبْدِ الرَّحْمَنِ وَالزُّبَيْرِ وَسَعْدٍ يَسْتَأْذِنُونَ عَلَيْكَ؟ قَالَ نَعَمْ فَأَذِنَ لَهُمْ قَالَ فَدَخَلُوا فَسَلَّمُوا قَالَ ثُمَّ لَبِثَ يَرْفَأُ قَلِيلًا فَقَالَ لِعُمَرَ هَلْ لَكَ فِي عَلِيٍّ وَالْعَبَّاسِ؟ قَالَ نَعَمْ ائْذَنْ لَهُمَا فَلَمَّا دَخَلَا سَلَّمَا وَجَلَسَا فَقَالَ الْعَبَّاسُ يَا أَمِيرَ الْمُؤْمِنِينَ اقْضِ بَيْنِي وَبَيْنَ هَذَا فَقَالَ الرَّهْطُ عُثْمَانُ وَأَصْحَابُهُ يَا أَمِيرَ الْمُؤْمِنِينَ اقْضِ بَيْنَهُمَا وَأَرِحْ أَحَدَهُمَا مِنَ الْآخَرِ وَذَكَرَ الْحَدِيثَ
[Machine] There was a man named Shurayh who used to enter an empty house every Friday, and people did not know what he did inside.
كَانَ شُرَيْحٌ يَدْخُلُ يَوْمَ الْجُمُعَةِ بَيْتًا يَخْلُو فِيهِ لَا يَدْرِي النَّاسُ مَا يَصْنَعُ فِيهِ
65.8 [Machine] What is recommended for the judge to not have his court sessions in the mosque? Al-Shafi'i said: May Allah have mercy on him, due to the abundance of distractions that mosques are not meant for.
٦٥۔٨ بَابُ مَا يُسْتَحَبُّ لِلْقَاضِي مِنْ أَنْ لَا يَكُونَ قَضَاؤُهُ فِي الْمَسْجِدِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: لِكَثْرَةِ مَنْ يَغْشَاهُ لِغَيْرِ مَا بُنِيَتْ لَهُ الْمَسَاجِدُ
I heard the Messenger of Allah (May peace be upon him) as saying; if anyone hears a man crying out in the mosque about something he has lost, he should say: May Allah not restore it to you, for the mosque were not built for this. (Using translation from Abū Dāʾūd 473)
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَنْ سَمِعَ رَجُلًا يَنْشُدُ ضَالَّةً فِي الْمَسْجِدِ فَلْيَقُلْ لَا أَدَّاهَا اللهُ إِلَيْكَ فَإِنَّ الْمَسَاجِدَ لَمْ تُبْنَ لِهَذَا
[Machine] The Prophet ﷺ heard an Arab or a man saying, "Whoever invites me to the red camel?" So the Prophet ﷺ said, "No, you will not find them except that these mosques were built for what they were built for."
أَنَّ النَّبِيَّ ﷺ سَمِعَ أَعْرَابِيًّا أَوْ رَجُلًا يَقُولُ مَنْ دَعَا إِلَيَّ الْجَمَلِ الْأَحْمَرِ؟ فَقَالَ النَّبِيُّ ﷺ لَا وَجَدْتَ إِنَّمَا بُنِيَتْ هَذِهِ الْمَسَاجِدُ لِمَا بُنِيَتْ لَهُ
[Machine] The companions of the Prophet ﷺ saw a dog, so the Prophet ﷺ said, "Don't let it be harmed." After they finished, the Prophet ﷺ called him and said, "These mosques were not built for filth, urine, and feces, but rather for reciting the Quran and remembering Allah." Then he commanded one of his companions to fill a bucket with water and pour it over the area.
أَصْحَابُ النَّبِيِّ ﷺ مَهْ مَهْ فَقَالَ النَّبِيُّ ﷺ لَا تُزْرِمُوهُ قَالَ فَلَمَّا فَرَغَ دَعَاهُ النَّبِيُّ ﷺ فَقَالَ إِنَّ هَذِهِ الْمَسَاجِدَ لَمْ تُتَّخَذْ لِهَذَا الْقَذَرِ وَالْبَوْلِ وَالْخَلَاءِ إِنَّمَا تُتَّخَذُ لِقِرَاءَةِ الْقُرْآنِ وَلِذِكْرِ اللهِ ثُمَّ أَمَرَ بَعْضَ أَصْحَابِهِ بِدَلْوٍ مِنْ مَاءٍ فَصَبَّهُ عَلَيْهِ
[Machine] Go to these two men and bring them to me. So I went and met them and 'Umar said to them, "From whom are you? Or from where are you?" They replied, "From the people of Ta'if." He said, "If you were from the people of this city, I would have severely beaten you and made you raise your voices in the mosque of the Messenger of Allah ﷺ ."
اذْهَبْ إِلَى هَذَيْنِ الرَّجُلَيْنِ فَائْتِنِي بِهِمَا فَذَهَبْتُ فَأَتَيْتُهُ بِهِمَا فَقَالَ لَهُمَا عُمَرُ مِمَّنْ أَنْتُمَا؟ أَوْ مِنْ أَيْنَ أَنْتُمَا؟ قَالَا مِنْ أَهْلِ الطَّائِفِ قَالَ لَوْ كُنْتُمَا مِنْ أَهْلِ هَذَا الْبَلَدِ لَأَوْجَعْتُكُمَا ضَرْبًا تَرْفَعَانِ أَصْوَاتَكُمَا فِي مَسْجِدِ رَسُولِ اللهِ ﷺ
[Machine] If he starts to stutter or recite poetry or raise his voice, let him leave to this open area.
أَنْ يَلْغَطَ أَوْ يُنْشِدَ شِعْرًا أَوْ يَرْفَعَ صَوْتًا فَلْيَخْرُجْ إِلَى هَذِهِ الرَّحَبَةِ
The Messenger of Allah ﷺ forbade to take retaliation in the mosque, to recite verses in it and to inflict the prescribed punishments in it. (Using translation from Abū Dāʾūd 4490)
نَهَى رَسُولُ اللهِ ﷺ أَنْ يُسْتَقَادَ فِي الْمَسْجِدِ أَوْ يُنْشَدَ فِيهِ أَوْ تُقَامَ فِيهِ الْحُدُودُ
[Machine] "The Messenger of Allah ﷺ while on the pulpit said: Keep your mosques clear of your children, madmen, and disputes, and lower your voices. Unsheathe your swords and establish your limits, and preserve them in the community. Place at the doors of your mosques the pure ones, Al-Ala' bin Kathir. He is a Syrian, discredited in hadith. It is also said it was reported by Mak'hul, from Yahya bin Al-Ala, from Mu'adh, in a raised narration, but it is not considered authentic."
رَسُولَ اللهِ ﷺ وَهُوَ عَلَى الْمِنْبَرِ يَقُولُ جَنِّبُوا مَسَاجِدَكُمْ صِبْيَانَكُمْ وَمَجَانِينَكُمْ وَخُصُومَاتِكُمْ وَرَفْعَ أَصْوَاتِكُمْ وَسَلَّ سُيُوفِكُمْ وَإِقَامَةَ حُدُودِكُمْ وَأَجْمِرُوهَا فِي الْجُمَعِ وَاتَّخِذُوا عَلَى أَبْوَابِ مَسَاجِدِكُمْ مَطَاهِرَ الْعَلَاءُ بْنُ كَثِيرٍ هَذَا شَامِيٌّ مُنْكَرُ الْحَدِيثِ وَقِيلَ عَنْ مَكْحُولٍ عَنْ يَحْيَى بْنِ الْعَلَاءِ عَنْ مُعَاذٍ مَرْفُوعًا وَلَيْسَ بِصَحِيحٍ
[Machine] Not to spend time in the mosque, for there comes the Jew, the Christian, and the menstruating woman.
أَنْ لَا تَقْضِيَ فِي الْمَسْجِدِ فَإِنَّهُ يَأْتِيكَ الْيَهُودِيُّ وَالنَّصْرَانِيُّ وَالْحَائِضُ
65.9 [Machine] Verification in Judgment Allah, may He be glorified, said: "O you who have believed, if there comes to you a disobedient one with information, investigate, lest you harm a people out of ignorance and become, over what you have done, regretful." [Surah Al-Hujurat: 6] And He said: "When you go forth in the cause of Allah, investigate" [Surah An-Nisa: 94]
٦٥۔٩ بَابُ التَّثَبُّتِ فِي الْحُكْمِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ: {يَا أَيُّهَا الَّذِينَ آمَنُوا إِنْ جَاءَكُمْ فَاسِقٌ بِنَبَأٍ فَتَبَيَّنُوا أَنْ تُصِيبُوا قَوْمًا بِجَهَالَةٍ فَتُصْبِحُوا عَلَى مَا فَعَلْتُمْ نَادِمِينَ} [الحجرات: 6] وَقَالَ {إِذَا ضَرَبْتُمْ فِي سَبِيلِ اللهِ فَتَبَيَّنُوا} [النساء: 94]
"Deliberateness is from Allah, and haste is from the Ash-shaitan." (Using translation from Tirmidhī 2012)
أَنَّ النَّبِيَّ ﷺ قَالَ التَّأَنِّي مِنَ اللهِ وَالْعَجَلَةُ مِنَ الشَّيْطَانِ
[Machine] The Prophet ﷺ said, in the narration of Al-Mu'adhi, Al-Shu'aybi and Al-Harawi, "When you hesitate and when you contemplate, you will either be correct or nearly correct. And when you rush, you will make a mistake or nearly make a mistake."
قَالَ النَّبِيُّ ﷺ إِذَا تَأَنَّيْتَ وَفِي رِوَايَةِ الْمُعَاذِيِّ وَالشُّعَيْبِيِّ وَالْهَرَوِيِّ إِذَا تَبَيَّنْتَ أَصَبْتَ أَوْ كِدْتَ تُصِيبُ وَإِذَا اسْتَعْجَلْتَ أَخْطَأْتَ أَوْ كِدْتَ تُخْطِئُ
"Indeed there are two traits in you that Allah loves: Forbearance, and deliberateness." (Using translation from Tirmidhī 2011)
النَّبِيَّ ﷺ قَالَ لِلْأَشَجِّ أَشَجِّ عَبْدِ الْقَيْسِ إِنَّ فِيكَ لَخَلَّتَيْنِ يُحِبُّهُمَا اللهُ الْحِلْمُ وَالْأَنَاةُ
[Machine] When the delegation of Abd al-Qays came to the Messenger of Allah ﷺ , he mentioned a hadith in which he said, "Prophet of Allah ﷺ to Ashajj of Abd al-Qays, there are two qualities in you that Allah and His Messenger love: forbearance and steadfastness."
أَنَّ وَفْدَ عَبْدِ الْقَيْسِ لَمَّا قَدِمُوا عَلَى رَسُولِ اللهِ ﷺ فَذَكَرَ الْحَدِيثَ قَالَ فِيهِ ثُمَّ قَالَ نَبِيُّ اللهِ ﷺ لِأَشَجِّ عَبْدِ الْقَيْسِ إِنَّ فِيكَ خَصْلَتَيْنِ يُحِبُّهُمَا اللهُ ﷻ وَرَسُولُهُ الْحِلْمُ وَالْأَنَاةُ
[Machine] Abu Ubaid said in the hadith of Ali, in regards to the man who traveled with his companions and did not return when they did, so his family accused his companions of wrongdoing. They brought them to Shurayh and he asked them for proof of their claim of his murder. They then went to Ali and informed him of what Shurayh had said, and Ali responded: "The sea brings it forth." Saad and Saad both conveyed it. O Saad, do not relate with this camel. Then he said: "Verily, the easiest of the legislation is granting permission for water." He said: "Then he separated them and asked them, and they disagreed, then they affirmed his murder. So Ali considered him to be a killer, and he said: "Abu Ubaid narrated to me from a man whose name I do not remember, from Hisham bin Hassan, from Ibn Sirin, from Ali." Abu Ubaid said: His saying, "Saad and Saad both conveyed it." This is a simile that is said: Indeed, its origin is that a man brought water for his camel that could not reach it except by sucking it, then he contained it and slept, and left it. He said: "This action is not related by the camel." And his saying: "Verily, the easiest of the legislation is granting permission for water." is also a simile. He says: Indeed, the easiest thing that should be done for her is to enable her to access the Sharia or the basin. He says: Indeed, the easiest thing that Shurayh should do is to investigate the matter and examine and uncover the news of the man until he is excused in his request, and not to be limited to seeking evidence only.
قَالَ أَبُو عُبَيْدٍ فِي حَدِيثِ عَلِيٍّ ؓ فِي الرَّجُلِ الَّذِي سَافَرَ مَعَ أَصْحَابٍ لَهُ فَلَمْ يَرْجِعْ حِينَ رَجَعُوا فَاتَّهَمَ أَهْلُهُ أَصْحَابَهُ فَرَفَعُوهُمْ إِلَى شُرَيْحٍ فَسَأَلَهُمُ الْبَيِّنَةَ عَلَى قَتْلِهِ فَارْتَفَعُوا إِلَى عَلِيٍّ ؓ وَأَخْبَرُوهُ بِقَوْلِ شُرَيْحٍ فَقَالَ عَلِيٌّ ؓ [البحر الرجز] أَوْرَدَهَا سَعْدٌ وَسَعْدٌ مُشْتَمِلْ يَا سَعْدُ لَا تَرْوِي بِهَاذَاكَ الْإِبِلْ ثُمَّ قَالَ إِنَّ أَهْوَنَ السَّقْيِ التَّشْرِيعُ قَالَ ثُمَّ فَرَّقَ بَيْنَهُمْ وَسَأَلَهُمْ فَاخْتَلَفُوا ثُمَّ أَقَرُّوا بِقَتْلِهِ فَأَحْسِبُهُ قَالَ فَقَتَلَهُمْ بِهِ قَالَ أَبُو عُبَيْدٍ حَدَّثَنِيهِ رَجُلٌ لَا أَحْفَظُ اسْمَهُ عَنْ هِشَامِ بْنِ حَسَّانَ عَنِ ابْنِ سِيرِينَ عَنْ عَلِيٍّ ؓ قَالَ أَبُو عُبَيْدٍ قَوْلُهُ أَوْرَدَهَا سَعْدٌ وَسَعْدٌ مُشْتَمِلْ هَذَا مَثَلٌ يُقَالُ إِنَّ أَصْلَهُ أَنَّ رَجُلًا أَوْرَدَ إِبِلَهُ مَاءً لَا تَصِلُ إِلَى شُرْبِهِ إِلَّا بِالِاسْتِقَاءِ ثُمَّ اشْتَمَلَ وَنَامَ وَتَرَكَهَا يَقُولُ فَهَذَا الْفِعْلُ لَا تُرْوَى بِهِ الْإِبِلُ وَقَوْلُهُ إِنَّ أَهْوَنَ السَّقْيِ التَّشْرِيعُ هُوَ مَثَلٌ أَيْضًا يَقُولُ إِنَّ أَيْسَرَ مَا يَنْبَغِي أَنْ يَفْعَلَ بِهَا أَنْ يُمَكِّنَهَا مِنَ الشَّرِيعَةِ أَوِ الْحَوْضِ يَقُولُ إِنَّ أَهْوَنَ مَا كَانَ يَنْبَغِي لِشُرَيْحٍ أَنْ يَفْعَلَ أَنْ يَسْتَقْصِيَ فِي الْمَسْأَلَةِ وَالنَّظَرِ وَالْكَشْفِ عَنْ خَبَرِ الرَّجُلِ حَتَّى يُعْذَرَ فِي طَلَبِهِ وَلَا يَقْتَصِرَ عَلَى طَلَبِ الْبَيِّنَةِ فَقَطْ
65.10 [Machine] He does not decide while he is angry
٦٥۔١٠ بَابُ لَا يَقْضِي وَهُوْ غَضْبَانُ
[Machine] I heard the Messenger of Allah, ﷺ , saying, "A decision should not be made between two parties while the judge is angry."
سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ لَا يَقْضِي حَكَمٌ بَيْنَ اثْنَيْنِ وَهُوَ غَضْبَانُ
[Machine] My father wrote and I wrote for him with my own hand to his son 'Ubaidullah while he was in Sijistan, I do not know what judgment you have passed between two parties while you are angry. For I heard the Messenger of Allah ﷺ saying, "No judgment should be passed between two parties while one of them is angry."
كَتَبَ أَبِي وَكَتَبْتُ لَهُ بِيَدِي إِلَى ابْنِهِ عُبَيْدِ اللهِ وَهُوَ عَلَى سَجِسْتَانَ لَا أَعْرِفَنَّ مَا حَكَمْتَ بَيْنَ اثْنَيْنِ وَأَنْتَ غَضْبَانُ فَإِنِّي سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولَ لَا يَحْكُمَنَّ حَكَمٌ بَيْنَ اثْنَيْنِ وَهُوَ غَضْبَانُ
[Machine] Abu Asim Al-Nabil narrated that Sufyan, referring to Ath-Thawri, informed us. And Abu Abdullah Al-Hafiz, Abu Bakr Ahmad ibn Al-Hasan, Abu Zakariya ibn Abi Ishaq, and Abu Abdul Rahman Al-Sulami said: Abu al-Abbas Muhammad ibn Ya'qub narrated to us. And Rabia ibn Sulaiman informed Rabee, and Al-Shafi'i narrated from Sufyan, referring to Ibn Uyaynah. And Abu Abdullah Al-Hafiz informed us, and Abu Bakr Ahmad ibn Ishaq informed us, and Ismail ibn Qutaybah narrated, all of them from Yahya ibn Yahya, who narrated from Hushaym, all of them from Abdul-Malik ibn Umayr, from Abdullah ibn Abu Bakrah, from his father, that the Messenger of Allah ﷺ said: "A judge should not make a decision between two parties while he is angry. The meaning is one."
ثنا أَبُو عَاصِمٍ النَّبِيلُ أنبأ سُفْيَانُ يَعْنِي الثَّوْرِيَّ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ وَأَبُو بَكْرٍ أَحْمَدُ بْنُ الْحَسَنِ وَأَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ وَأَبُو عَبْدِ الرَّحْمَنِ السُّلَمِيُّ قَالُوا ثنا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ أنبأ الرَّبِيعُ بْنُ سُلَيْمَانَ أنبأ الشَّافِعِيُّ أنبأ سُفْيَانُ يَعْنِي ابْنَ عُيَيْنَةَ ح وَأَخْبَرَنَا أَبُو عَبْدِ اللهِ الْحَافِظُ أنبأ أَبُو بَكْرٍ أَحْمَدُ بْنُ إِسْحَاقَ أنبأ إِسْمَاعِيلُ بْنُ قُتَيْبَةَ ثنا يَحْيَى بْنُ يَحْيَى أنبأ هُشَيْمٌ كُلُّهُمْ عَنْ عَبْدِ الْمَلِكِ بْنِ عُمَيْرٍ عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرَةَ عَنْ أَبِيهِ أَنَّ رَسُولَ اللهِ ﷺ قَالَ لَا يَقْضِي الْقَاضِي بَيْنَ اثْنَيْنِ وَهُوَ غَضْبَانُ مَعْنَاهُمْ وَاحِدٌ
[Machine] A man from the companions of the Prophet ﷺ said, "A man asked the Prophet ﷺ to advise him, so he said, 'Do not become angry.' The man thought about what the Messenger of Allah ﷺ had said, and realized that anger gathers all evil together."
عَنْ رَجُلٍ مِنْ أَصْحَابِ النَّبِيِّ ﷺ قَالَ قَالَ رَجُلٌ أَوْصِنِي يَا رَسُولَ اللهِ قَالَ لَا تَغْضَبْ قَالَ الرَّجُلُ فَفَكَّرْتُ حِينَ قَالَ رَسُولُ اللهِ ﷺ مَا قَالَ فَإِذَا الْغَضَبُ يَجْمَعُ الشَّرَّ كُلَّهُ
[Machine] A man came to the Prophet ﷺ and said to him, "Advise me." The Prophet replied, "Do not get angry." He repeated this advice to him several times, saying, "Do not get angry."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ لَهُ أَوْصِنِي قَالَ لَا تَغْضَبْ فَتَرَدَّدَ إِلَيْهِ مِرَارًا لَا يَزِيدُ عَلَى أَنْ يَقُولَ لَا تَغْضَبْ
[Machine] A man came to the Prophet ﷺ and said, "O Messenger of Allah, teach me a deed through which I can enter Paradise and be saved from Hellfire." The Prophet ﷺ replied, "Do not become angry."
جَاءَ رَجُلٌ إِلَى النَّبِيِّ ﷺ فَقَالَ يَا رَسُولَ اللهِ عَلِّمْنِي عَمَلًا أَدْخُلُ بِهِ الْجَنَّةَ وَأَقْلِلْ لَعَلِّي أَعْقِلُ قَالَ لَا تَغْضَبْ
[Machine] The Prophet ﷺ once encountered a man who asked him, "O Messenger of Allah, teach me something that Allah will benefit me with and make it brief, for I fear that I may not comprehend what you say." The Prophet replied, "Do not get angry." The man repeated his request, and the Prophet again replied, "Do not get angry." This exchange occurred repeatedly. [Hadith narrated by Abu Abdullah al-Hafiz, al-Sayrafi, and Abu al-Abbas al-Asamm through the chain of narrators Ahmad ibn Abd al-Jabbar, Abu Mu'awiyah, and from another source, Ibn Umar, from the Prophet ﷺ ].
أَتَى النَّبِيَّ ﷺ رَجُلٌ فَقَالَ يَا رَسُولَ اللهِ عَلِّمْنِي شَيْئًا يَنْفَعُنِي اللهُ بِهِ وَأَقْلِلْ لَعَلِّي أَعِي مَا تَقُولُ قَالَ فَقَالَ لَهُ لَا تَغْضَبْ فَقَالَ يَا رَسُولَ اللهِ عَلِّمْنِي شَيْئًا يَنْفَعُنِي قَالَ فَأَعَادَ عَلَيْهِ مِرَارًا يَقُولُ لَهُ لَا تَغْضَبْ 20281 أَخْبَرَنَا أَبُو عَبْدُ اللهِ الْحَافِظُ وَالصَّيْرَفِيُّ قَالَا ثنا أَبُو الْعَبَّاسِ هُوَ الْأَصَمُّ ثنا أَحْمَدُ بْنُ عَبْدِ الْجَبَّارِ ثنا أَبُو مُعَاوِيَةَ وَرُوِيَ مِنْ وَجْهٍ آخَرَ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ ﷺ
65.11 [Machine] The judge does not pass judgment unless he is full (satisfied) and generous (generous)
٦٥۔١١ بَابُ لَا يَقْضِي الْقَاضِي إِلَّا وَهُوَ شَبْعَانُ رَيَّانُ
[Machine] The Messenger of Allah, ﷺ , said, "The judge should not decide except when he is satiated with food. This hadith is solely attributed to Al-Qasim Al-Umari, who is weak, and the authentic hadith on this matter comes before it, carrying its meaning."
قَالَ رَسُولُ اللهِ ﷺ لَا يَقْضِي الْقَاضِي إِلَّا هُوَ شَبْعَانُ رَيَّانُ تَفَرَّدَ بِهِ الْقَاسِمُ الْعُمَرِيُّ وَهُوَ ضَعِيفٌ وَالْحَدِيثُ الصَّحِيحُ فِي الْبَابِ قَبْلَهُ يُؤَدِّي مَعْنَاهُ
[Machine] Then beware of boredom, anxiety, harming people, and pretending with enemies in places of truth that Allah obligates reward and earns wealth. Indeed, whoever corrects his relationship with his Lord, Allah will correct his relationship with people. And whoever adorns himself for people with what Allah knows of him contrary to that, Allah will disgrace him. So what do you think of the reward of someone other than Allah in this temporary world and the treasures of His mercy? And peace be upon you.
ثُمَّ إِيَّاكَ وَالضَّجَرَ وَالْقَلَقَ وَالتَّأَذِّيَ بِالنَّاسِ وَالتَّنَكُّرَ بِالْخُصُومِ فِي مَوَاطِنِ الْحَقِّ الَّتِي يُوجِبُ اللهُ تَعَالَى بِهَا الْأَجْرَ وَيُكْسِبُ بِهَا الذُّخْرَ فَإِنَّهُ مَنْ يُصْلِحْ سَرِيرَتَهُ فِيمَا بَيْنَهُ وَبَيْنَ رَبِّهِ أَصْلَحَ اللهُ مَا بَيْنَهُ وَبَيْنَ النَّاسِ وَمَنْ تَزَيَّنَ لِلنَّاسِ بِمَا يَعْلَمُ اللهُ مِنْهُ خِلَافَ ذَلِكَ يُشِنْهُ اللهُ فَمَا ظَنُّكَ بِثَوَابِ غَيْرِ اللهِ فِي عَاجِلِ الدُّنْيَا وَخَزَائِنِ رَحْمَتِهِ؟ وَالسَّلَامُ
[Machine] When he used to get angry or hungry, he would stand up and not settle any differences with anyone.
أَنَّهُ كَانَ إِذَا غَضِبَ أَوْ جَاعَ قَامَ فَلَمْ يَقْضِ بَيْنَ أَحَدٍ
[Machine] Ibn Abi Layla used to only sit for judgement when a dish was brought to him, and he would eat from it. Then a large loaf of bread would be brought to him, and he would wrap himself in it. And when it was a women's day, a man would sit with him.
كَانَ ابْنُ أَبِي لَيْلَى لَا يَقْعُدُ لِلْقَضَاءِ إِلَّا يُؤْتَى بِقَصْعَةٍ فَيَأْكُلُ ثُمَّ يُؤْتَى بِغَالِيَةٍ فَيَتَغَلَّفُ وَإِذَا كَانَ يَوْمُ النِّسَاءِ أَجْلَسَ مَعَهُ رَجُلًا
65.12 [Machine] The judge rules in his anger, so he agreed with the truth.
٦٥۔١٢ بَابُ الْقَاضِي يَقْضِي فِي حَالِ غَضَبِهِ , فَوَافَقَ الْحَقَّ
A man disputed with az-Zubayr about streamlets in the lava plain which was irrigated by them. The Ansari said: Release the water and let it run, but az-Zubayr refused. The Holy Prophet ﷺ said to az-Zubayr: Water (your ground), Zubayr, then let the water run to your neighbour. The Ansari then became angry and said: Messenger of Allah! it is because he is your cousin! Thereupon the face of the Messenger of Allah ﷺ changed colour and he said: Water (your ground), then keep back the water till it returns to the embankment. Az-Zubayr said: By Allah! I think this verse came down about that: "But no , by thy Lord! they can have no (real) faith, until they make thee judge....." (Using translation from Abū Dāʾūd 3637)
أَنَّ رَجُلًا مِنَ الْأَنْصَارِ خَاصَمَ الزُّبَيْرَ عِنْدَ رَسُولِ اللهِ ﷺ فِي شِرَاجِ الْحَرَّةِ الَّتِي يَسْقُونَ بِهَا النَّخْلَ فَقَالَ الْأَنْصَارِيُّ سَرِّحِ الْمَاءَ يَمُرُّ فَأَبَى عَلَيْهِ فَاخْتَصَمُوا عِنْدَ رَسُولِ اللهِ ﷺ فَقَالَ رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلْ إِلَى جَارِكَ فَغَضِبَ الْأَنْصَارِيُّ فَقَالَ إِنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ يَا زُبَيْرُ اسْقِ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ قَالَ فَقَالَ الزُّبَيْرُ وَاللهِ إِنِّي لَأَحْسَبُ هَذِهِ الْآيَةَ نَزَلَتْ فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ} [النساء 65] الْآيَةَ
Az-Zubair quarrelled with a man from the Ansar because of a natural mountainous stream at Al-Harra. The Prophet ﷺ said "O Zubair! Irrigate (your lands and the let the water flow to your neighbor The Ansar said, "O Messenger of Allah ﷺ (This is because) he (Zubair) is your cousin?" At that, the Prophet's face became red (with anger) and he said "O Zubair! Irrigate (your land) and then withhold the water till it fills the land up to the walls and then let it flow to your neighbor." So the Prophet ﷺ enabled Az- Zubair to take his full right after the Ansari provoked his anger. The Prophet ﷺ had previously given a order that was in favor of both of them Az-Zubair said, "I don't think but the Verse was revealed in this connection: "But no, by your Lord, they can have no faith, until they make you judge in all disputes between them." خَاصَمَ الزُّبَيْرُ ؓ رَجُلًا مِنَ الْأَنْصَارِ فِي شَرْجٍ مِنَ الْحَرَّةِ فَقَالَ النَّبِيُّ ﷺ اسْقِ يَا زُبَيْرُ ثُمَّ أَرْسِلِ الْمَاءَ إِلَى جَارِكَ فَقَالَ الْأَنْصَارِيُّ يَا رَسُولَ اللهِ إِنْ كَانَ ابْنَ عَمَّتِكَ فَتَلَوَّنَ وَجْهُ رَسُولِ اللهِ ﷺ ثُمَّ قَالَ اسْقِ يَا زُبَيْرُ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ الْمَاءُ إِلَى الْجَدْرِ ثُمَّ أَرْسِلْ إِلَى جَارِكَ قَالَ وَاسْتَوعَبَ رَسُولُ اللهِ ﷺ لِلزُّبَيْرِ حَقَّهُ فِي صَرِيحِ الْحُكْمِ حِينَ أَحْفَظَهُ الْأَنْصَارِيُّ قَالَ وَقَدْ كَانَ أَشَارَ عَلَيْهِمَا قَبْلَ ذَلِكَ بِأَمْرٍ كَانَ لَهُمَا فِيهِ سَعَةٌ قَالَ الزُّبَيْرُ فَمَا أَحْسَبُ هَذِهِ الْآيَةَ نَزَلَتْ إِلَّا فِي ذَلِكَ {فَلَا وَرَبِّكَ لَا يُؤْمِنُونَ حَتَّى يُحَكِّمُوكَ فِيمَا شَجَرَ بَيْنَهُمْ} [النساء 65] قَالَ فَسَمِعْتُ غَيْرَ الزُّهْرِيِّ يَقُولُ نَظَرْنَا فِي قَوْلِ النَّبِيِّ ﷺ ثُمَّ احْبِسِ الْمَاءَ حَتَّى يَرْجِعَ إِلَى الْجَدْرِ فَكَانَ ذَلِكَ إِلَى الْكَعْبَيْنِ
65.13 [Machine] What is prohibited for the judge from buying and selling, inspecting expenses for his family, and managing his property so as not to distract his understanding
٦٥۔١٣ بَابُ مَا يُكْرَهُ لِلْقَاضِي مِنَ الشِّرَاءِ وَالْبَيْعِ وَالنَّظَرِ فِي النَّفَقَةِ عَلَى أَهْلِهِ وَفِي ضَيْعَتِهِ لِئَلَّا يَشْغَلَ فَهْمَهُ
[Machine] When Abu Bakr was appointed as ruler, he said, "My people know that my profession is not incapable of providing for my family. I have been occupied with the affairs of the Muslims, and the family of Abu Bakr will eat from this wealth and I will dedicate it to the Muslims."
لَمَّا اسْتُخْلِفَ أَبُو بَكْرٍ ؓ قَالَ قَدْ عَلِمَ قَوْمِي أَنَّ حِرْفَتِي لَمْ تَكُنْ لِتَعْجَزَ عَنْ مُؤْنَةِ أَهْلِي وَقَدْ شُغِلْتُ بِأَمْرِ الْمُسْلِمِينَ فَسَيَأْكُلُ آلُ أَبِي بَكْرٍ مِنْ هَذَا الْمَالِ وَاحْتَرَفَ لِلْمُسْلِمِينَ فِيهِ
[Machine] The wife of the Prophet ﷺ said when Umar ibn al-Khattab was appointed as the caliph, "He and his family ate from the wealth and he became skilled in managing his own finances."
ؓ زَوْجِ النَّبِيِّ ﷺ قَالَتْ لَمَّا اسْتُخْلِفَ عُمَرُ بْنُ الْخَطَّابِ ؓ أَكَلَ هُوَ وَأَهْلُهُ مِنَ الْمَالِ وَاحْتَرَفَ فِي مَالِ نَفْسِهِ
[Machine] Umar ibn Al-Khattab wrote: "Indeed, the prince's trade in his emirate is a loss."
كَتَبَ عُمَرُ بْنُ الْخَطَّابِ ؓ إِنَّ تِجَارَةَ الْأَمِيرِ فِي إِمَارَتِهِ خَسَارَةٌ
[Machine] He worked me hard for one day, so imagine when two days' work is piled onto me in one day.
لَقَدْ كَدَحَنِي عَمَلُ يَوْمٍ وَاحِدٍ فَكَيْفَ إِذَا اجْتَمَعَ عَلَيَّ عَمَلُ يَوْمَيْنِ فِي يَوْمٍ وَاحِدٍ؟
[Machine] "He has the popular support, I cannot do this alone on one of the two matters, I cannot decide, and the night is passing."
لَهُ الشَّعْبِيُّ لَا أَسْتَطِيعُ هَذَا أَفْرِدْنِي بِأَحَدِ الْأَمْرَيْنِ لَا أَسْتَطِيعُ الْقَضَاءَ وَسَمَرَ اللَّيْلِ
65.14 [Machine] What is preferable for the judge and the governor is to entrust a reliable person with the buying and selling, who is not known to sell to them out of fear of favoritism, and in its meaning, there is an effect. Its credibility is not strong.
٦٥۔١٤ بَابُ مَا يُسْتَحَبُّ لِلْقَاضِي وَالْوَالِي مِنْ أَنْ يُوَلِّيَ الشِّرَاءَ لَهُ وَالْبَيْعَ رَجُلًا مَأْمُونًا , غَيْرَ مَشْهُورٍ بِأَنَّهُ يَبِيعُ لَهُ خَوْفَ الْمُحَابَاةِ وَفِي مَعْنَاهُ أَثَرٌ , إِسْنَادُهُ غَيْرُ قَوِيٍّ
[Machine] I left the mosque and then there was a man calling from behind me, "lift up your garment, for it is purer for your clothes and more pious for you, and take off your head covering if you are a Muslim." So, I walked behind him and I said, "Who is this?" And a man said to me, "This is Ali, the Commander of the Faithful," and he mentioned the hadith. Then he came to the market of Karamis and he said, "Oh sheikh, sell me a shirt for three dirhams." When the seller recognized him, he did not buy anything from him. Then he went to another person and when he recognized him, he did not buy anything from him. Then he came across a young boy and he bought a shirt from him for three dirhams and he wore it from his wrists to his ankles. So, the father of the boy, who was the owner of the shirt, came and it was said, "Oh so-and-so, your son sold a shirt today to the Commander of the Faithful for three dirhams." He said, "Why didn't you take two dirhams?" So, his father took one dirham and brought it to the Commander of the Faithful and said, "Hold onto this dirham, oh Commander of the Faithful." He said, "What is the matter with this dirham?" He said, "It was the price of a shirt, which was two dirhams." He said, "He bought me with his satisfaction, and he took my satisfaction."
خَرَجْتُ مِنَ الْمَسْجِدِ فَإِذَا رَجُلٌ يُنَادِي مِنْ خَلْفِي ارْفَعْ إِزَارَكَ فَإِنَّهُ أَنْقَى لِثَوْبِكَ وَأَتْقَى لَكَ وَخُذْ مِنْ رَأْسِكَ إِنْ كُنْتَ مُسْلِمًا فَمَشَيْتُ خَلْفَهُ فَقُلْتُ مَنْ هَذَا؟ فَقَالَ لِي رَجُلٌ هَذَا عَلِيٌّ أَمِيرُ الْمُؤْمِنِينَ فَذَكَرَ الْحَدِيثَ قَالَ ثُمَّ أَتَى دَارَ فُرَاتٍ وَهُوَ سُوقُ الْكَرَابِيسِ فَقَالَ يَا شَيْخُ أَحْسِنْ بَيْعِي فِي قَمِيصٍ بِثَلَاثَةِ دَرَاهِمَ فَلَمَّا عَرَفَهُ لَمْ يَشْتَرِ مِنْهُ شَيْئًا ثُمَّ أَتَى آخَرَ فَلَمَّا عَرَفَهُ لَمْ يَشْتَرِ مِنْهُ شَيْئًا فَأَتَى غُلَامًا حَدَثًا فَاشْتَرَى مِنْهُ قَمِيصًا بِثَلَاثَةِ دَرَاهِمَ وَلَبِسَهُ مَا بَيْنَ الرُّسْغَيْنِ إِلَى الْكَعْبَيْنِ قَالَ فَجَاءَ أَبُو الْغُلَامِ صَاحِبِ الثَّوْبِ فَقِيلَ يَا فُلَانُ قَدْ بَاعَ ابْنُكَ الْيَوْمَ مِنْ أَمِيرِ الْمُؤْمِنِينَ قَمِيصًا بِثَلَاثَةِ دَرَاهِمَ قَالَ أَفَلَا أَخَذْتَ دِرْهَمَيْنِ فَأَخَذَ أَبُوهُ دِرْهَمًا وَجَاءَ بِهِ إِلَى أَمِيرِ الْمُؤْمِنِينَ فَقَالَ أَمْسِكْ هَذَا الدِّرْهَمَ يَا أَمِيرَ الْمُؤْمِنِينَ قَالَ مَا شَأْنُ هَذَا الدِّرْهَمِ؟ قَالَ كَانَ قَمِيصًا ثَمَنُهُ دِرْهَمَيْنِ قَالَ بَاعَنِي بِرِضَايَ وَأَخَذَ بِرِضَاهُ
65.15 [Machine] The judge attends the wedding when invited, visits the sick, and witnesses funerals. Al-Bukhari said: Uthman answered a question from al-Mughirah ibn Shu'bah.
٦٥۔١٥ بَابُ: الْقَاضِي يَأْتِي الْوَلِيمَةَ إِذَا دُعِيَ لَهَا, وَيَعُودُ الْمَرْضَى, وَيَشْهَدُ الْجَنَائِزَ قَالَ الْبُخَارِيُّ رَحِمَهُ اللهُ: قَدْ أَجَابَ عُثْمَانُ عَبْدًا لِلْمُغِيرَةِ بْنِ شُعْبَةَ
"The Messenger of Allah commanded us to do seven things: He commanded us to attend funerals, visit the sick, to reply (say: Yarhamuk Allah [may Allah have mercy on you]) to one who sneezes, to accept invitations, to support the oppressed, to fulfill oaths (when adjured by another) and to return greetings of Salaam." أَمَرَنَا رَسُولُ اللهِ ﷺ بِسَبْعٍ أَمَرَنَا بِاتِّبَاعِ الْجَنَائِزِ وَعِيَادَةِ الْمَرِيضِ وَتَشْمِيتِ الْعَاطِسِ وَنَصْرِ الْمَظْلُومِ وَإِفْشَاءِ السَّلَامِ وَإِجَابَةِ الدَّاعِي وَإِبْرَارِ الْمُقْسِمِ أَخْرَجَاهُ فِي الصَّحِيحِ مِنْ حَدِيثِ جَرِيرٍ
Six are the rights of a Muslim over another Muslim. It was said to him: Messenger of Allah, what are these? Thereupon he said: When you meet him, offer him greetings;when he invites you to a feast accept it. when he seeks your council give him, and when he sneezes and says:" All praise is due to Allah," you say Yarhamuk Allah (may Allah show mercy to you) ; and when he fails ill visit him; and when he dies follow his bier. (Using translation from Muslim 2162b)
أَنَّ رَسُولَ اللهِ ﷺ قَالَ حَقُّ الْمُسْلِمِ عَلَى الْمُسْلِمِ سِتٌّ قِيلَ مَا هُنَّ يَا رَسُولَ اللهِ؟ قَالَ إِذَا لَقِيتَهُ فَسَلِّمْ عَلَيْهِ وَإِذَا دَعَاكَ فَأَجِبْهُ وَإِذَا اسْتَنْصَحَكَ فَانْصَحْ لَهُ وَإِذَا عَطَسَ فَحَمِدَ اللهَ فَشَمِّتْهُ وَإِذَا مَرِضَ فَعُدْهُ وَإِذَا مَاتَ فَاتَّبِعْ جِنَازَتَهُ
[Machine] When the delegations came to Umar, he would ask them about their leader. "Has the sick person recovered? Does the servant answer? How is he doing? Who stands at his door? If they mentioned a particular trait, he would not remove him."
كَانَ عُمَرُ ؓ إِذَا قَدِمَ عَلَيْهِ الْوُفُودُ سَأَلَهُمْ عَنْ أَمِيرِهِمْ أَيَعُودُ الْمَرِيضَ؟ أَيُجِيبُ الْعَبْدَ؟ كَيْفَ صَنِيعُهُ؟ مَنْ يَقُومُ عَلَى بَابِهِ؟ فَإِنْ قَالُوا لِخَصْلَةٍ مِنْهَا لَا عَزَلَهُ
65.16 [Machine] When the judge realizes the seriousness of one of the disputants, he should prevent him from doing so.
٦٥۔١٦ بَابُ: الْقَاضِي إِذَا بَانَ لَهُ مِنْ أَحَدِ الْخَصْمَيْنِ اللَّدَدُ نَهَاهُ عَنْهُ
[Machine] The Prophet ﷺ said, "The most disliked of men to Allah is the argumentative and confrontational."
النَّبِيَّ ﷺ قَالَ أَبْغَضُ الرِّجَالِ إِلَى اللهِ الْأَلَدُّ الْخَصِمُ
[Machine] To Abu Musa, look into the case of Abu Maryam. He said, "I do not accuse Abu Maryam." He said, "And I do not accuse him. But if you see injustice from an opponent, punish him."
لِأَبِي مُوسَى ؓ انْظُرْ فِي قَضَاءِ أَبِي مَرْيَمَ قَالَ إِنِّي لَا أَتَّهِمُ أَبَا مَرْيَمَ قَالَ وَأَنَا لَا أَتَّهِمُهُ وَلَكِنْ إِذَا رَأَيْتَ مِنْ خَصْمٍ ظُلْمًا فَعْاقِبْهُ
[Machine] About justice, and I will certainly appoint a man to execute justice, when the evil-doer sees him, he will be scared away.
عَنِ الْقَضَاءِ وَلَأَسْتَعْمِلَنَّ عَلَى الْقَضَاءِ رَجُلًا إِذَا رَآهُ الْفَاجِرُ فَرَقَهُ
65.17 [Machine] Consultation between the Governor and the Judge in Matters Allah, the Exalted, says, "And consult them in the matter." [Al Imran: 159]
٦٥۔١٧ بَابُ مُشَاوَرَةِ الْوَالِي وَالْقَاضِي فِي الْأَمْرِ قَالَ اللهُ جَلَّ ثَنَاؤُهُ {وَشَاوِرْهُمْ فِي الْأَمْرِ} [آل عمران: 159]
[Machine] In his statement, "and consult them in the matter" [Al-Imran 159], Abu Bakr and Umar said.
فِي قَوْلِهِ ﷻ {وَشَاوِرْهُمْ فِي الْأَمْرِ} [آل عمران 159] قَالَ أَبُو بَكْرٍ وَعُمَرُ ؓ
[Machine] The Prophet ﷺ said, "Tell me, do you think it is better for us to incline towards the weak and support them, so that they may benefit from us? Or do you think it is better for us to attack the Kaaba and whoever opposes us, we kill them?" Abu Bakr replied, "Allah and His Messenger know best. We have only come for pilgrimage and not to fight anyone. But if anyone stands between us and the Kaaba, we will fight them." The Prophet ﷺ said, "Alright then, go." Al-Zuhri said, Abu Huraira said, "I have never seen anyone consult with his companions more than the Messenger of Allah ﷺ ."
النَّبِيُّ ﷺ أَشِيرُوا عَلَيَّ أَتَرَوْنَ أَنْ نَمِيلَ إِلَى ذَرَارِيِّ هَؤُلَاءِ الَّذِينَ أَعَانُوهُمْ فَنُصِيبَهُمْ أَمْ تَرَوْنَ أَنْ نَؤُمَّ الْبَيْتَ فَمَنْ صَدَّنَا عَنْهُ قَاتَلْنَاهُ؟ قَالَ أَبُو بَكْرٍ ؓ اللهُ وَرَسُولُهُ أَعْلَمُ إِنَّمَا جِئْنَا مُعْتَمِرِينَ وَلَمْ نَجِئْ لِقِتَالِ أَحَدٍ وَلَكِنْ مَنْ حَالَ بَيْنَنَا وَبَيْنَ الْبَيْتِ قَاتَلْنَاهُ فَقَالَ النَّبِيُّ ﷺ فَرُوحُوا إِذًا قَالَ الزُّهْرِيُّ قَالَ أَبُو هُرَيْرَةَ مَا رَأَيْتُ أَحَدًا كَانَ أَكْثَرَ مُشَاوَرَةً لِأَصْحَابِهِ مِنْ رَسُولِ اللهِ ﷺ
[Machine] The Messenger of Allah ﷺ consulted the Muslims when he went to Badr. Abu Bakr pointed towards it first, then Umar pointed towards it. Then they consulted the Muslims and the Ansaar said, "O people of the Ansaar, beware! The Messenger of Allah ﷺ wants you." They said, "Then we will not say what the Children of Israel said to Musa, 'Go, you and your Lord, and fight; we are sitting here.'" And by the one who sent you with the truth, if you were to strike their livers until they reached the other side of the valley, we would still follow you."
أَنَّ رَسُولَ اللهِ ﷺ لَمَّا سَارَ إِلَى بَدْرٍ اسْتَشَارَ الْمُسْلِمِينَ فَأَشَارَ عَلَيْهِ أَبُو بَكْرٍ ؓ ثُمَّ اسْتَشَارَهُمْ فَأَشَارَ عَلَيْهِ عُمَرُ ؓ ثُمَّ اسْتَشَارَهُمْ فَقَالَتِ الْأَنْصَارُ يَا مَعْشَرَ الْأَنْصَارِ إِيَّاكُمْ يُرِيدُ رَسُولُ اللهِ ﷺ قَالُوا إِذًا لَا نَقُولُ كَمَا قَالَتْ بَنُو إِسْرَائِيلَ لِمُوسَى {اذْهَبْ أَنْتَ وَرَبُّكَ فَقَاتِلَا إِنَّا هَاهُنَا قَاعِدُونَ} وَالَّذِي بَعَثَكَ بِالْحَقِّ لَوْ ضَرَبْتَ أَكْبَادَهَا إِلَى بَرْكِ الْغِمَادِ لَاتَّبَعْنَاكَ
[Machine] On the day of the Battle of Badr, the Prophet asked, "What do you think of these prisoners?" Abu Bakr replied, "O Prophet of Allah, they are cousins, families, and brethren, but we take ransom from them to gain strength against the polytheists. It is possible that Allah may guide them to Islam and they may become our supporters." The Prophet asked, "What do you think, O Ibn Al-Khattab?" I replied, "O Prophet of Allah, I don't see what Abu Bakr sees, but they are the leaders of disbelief and their forelocks should be brought near and struck." The Messenger of Allah favored what Abu Bakr had said and did not show interest in what I had said, nor did he accept ransom from them. When it was morning, I went to the Messenger of Allah and found him and Abu Bakr sitting together and weeping. I said, "O Prophet of Allah, tell me why you and your companion are weeping. If I find reason to cry, I will cry; otherwise, I will pretend to cry." The Prophet said, "What was presented to me by your companions was an offer of ransom from you that is less than this tree and a nearby tree at that time." Then, Allah sent down the revelation: "It is not for a Prophet to have prisoners of war until he has made a great slaughter in the land. You desire the commodities of this world, but Allah desires the Hereafter. And Allah is Exalted in Might and Wise." [Quran 8:67]
لَمَّا كَانَ يَوْمُ بَدْرٍ قَالَ مَا تَرَوْنَ فِي هَؤُلَاءِ الْأَسْرَى؟ فَقَالَ أَبُو بَكْرٍ ؓ يَا نَبِيَّ اللهِ بَنُو الْعَمِّ وَالْعَشِيرَةُ وَالْإِخْوَانُ غَيْرَ أَنَّا نَأْخُذُ مِنْهُمُ الْفِدَاءَ لِيَكُونَ لَنَا قُوَّةً عَلَى الْمُشْرِكِينَ وَعَسَى اللهُ أَنْ يَهْدِيَهُمْ إِلَى الْإِسْلَامِ وَيَكُونُوا لَنَا عَضُدًا قَالَ فَمَاذَا تَرَى يَا ابْنَ الْخَطَّابِ؟ قُلْتُ يَا نَبِيَّ اللهِ مَا أَرَى الَّذِي رَأَى أَبُو بَكْرٍ وَلَكِنَّ هَؤُلَاءِ أَئِمَّةُ الْكُفْرِ وَصَنَادِيدُهُمْ فَقَرِّبْهُمْ فَاضْرِبْ أَعْنَاقَهُمْ قَالَ فَهَوَى رَسُولُ اللهِ ﷺ مَا قَالَ أَبُو بَكْرٍ ؓ وَلَمْ يَهْوَ مَا قُلْتُ أَنَا وَأَخَذَ مِنْهُمُ الْفِدَاءَ فَلَمَّا أَصْبَحْتُ غَدَوْتُ عَلَى رَسُولِ اللهِ ﷺ وَإِذَا هُوَ وَأَبُو بَكْرٍ ؓ قَاعِدَانِ يَبْكِيَانِ فَقُلْتُ يَا نَبِيَّ اللهِ أَخْبِرْنِي مِنْ أِيِّ شَيْءٍ تَبْكِي أَنْتَ وَصَاحِبُكَ فَإِنْ وَجَدْتُ بُكَاءً بَكَيْتُ وَإِلَّا تَبَاكَيْتُ لِبُكَائِكُمَا قَالَ الَّذِي عَرَضَ عَلَيَّ أَصْحَابُكَ لَقَدْ عُرِضَ عَلَيَّ عَذَابُكُمْ أَدْنَى مِنْ هَذِهِ الشَّجَرَةِ وَشَجَرَةٌ قَرِيبَةٌ حِينَئِذٍ فَأَنْزَلَ اللهُ ﷻ {مَا كَانَ لِنَبِيٍّ أَنْ يَكُونَ لَهُ أَسْرَى حَتَّى يُثْخِنَ فِي الْأَرْضِ تُرِيدُونَ عَرَضَ الدُّنْيَا وَاللهُ يُرِيدُ الْآخِرَةَ وَاللهُ عَزِيزٌ حَكِيمٌ} [الأنفال 67]
[Machine] About saying "and consult them in the matter" [Quran 3:159], Al-Hasan said: Allah, may He be exalted, taught him that he did not need anything from them, but he wanted to use it as an example for those who would come after him.
عَنِ الْحَسَنِ فِي قَوْلِهِ ﷻ {وَشَاوِرْهُمْ فِي الْأَمْرِ} [آل عمران 159] قَالَ عَلَّمَهُ اللهُ سُبْحَانَهُ أَنَّهُ مَا بِهِ إِلَيْهِمْ مِنْ حَاجَةٍ وَلَكِنْ أَرَادَ أَنْ يَسْتَنَّ بِهِ مَنْ بَعْدَهُ
[Machine] That he should follow the document from the judiciary, so he should follow the judgment of Umar, as he used to consult.
أَنْ يَأْخُذَ بِالْوَثِيقَةِ مِنَ الْقَضَاءِ فَلْيَأْخُذْ بِقَضَاءِ عُمَرَ فَإِنَّهُ كَانَ يَسْتَشِيرُ
[Machine] The Messenger of Allah ﷺ said: "The pinnacle of wisdom after belief in Allah is to show love and kindness towards people. No person can do without seeking consultation, and the people of good manners and morals in this world are the people of good manners and morals in the Hereafter. And indeed, the people of evil and vice in this world are the people of evil and vice in the Hereafter."
قَالَ رَسُولُ اللهِ ﷺ رَأْسُ الْعَقْلِ بَعْدَ الْإِيمَانِ بِاللهِ التَّوَدُّدُ إِلَى النَّاسِ وَمَا يَسْتَغْنِي رَجُلٌ عَنْ مَشُورَةٍ وَإِنَّ أَهْلَ الْمَعْرُوفِ فِي الدُّنْيَا هُمْ أَهْلُ الْمَعْرُوفِ فِي الْآخِرَةِ وَإِنَّ أَهْلَ الْمُنْكَرِ فِي الدُّنْيَا هُمْ أَهْلُ الْمُنْكَرِ فِي الْآخِرَةِ
[Machine] There are three men: one complete man who has an opinion and seeks advice, one half man who has no opinion but seeks advice, and one man who has neither an opinion nor seeks advice.
الرِّجَالُ ثَلَاثَةٌ فَرَجُلٌ وَنِصْفُ رَجُلٍ وَلَا شَيْءَ فَأَمَّا الرَّجُلُ التَّامُّ فَالَّذِي لَهُ رَأْيٌ وَهُوَ يَسْتَشِيرُ وَأَمَّا نِصْفُ رَجُلٍ فَالَّذِي لَيْسَ لَهُ رَأْيٌ وَهُوَ يَسْتَشِيرُ وَأَمَّا الَّذِي لَا شَيْءَ فَالَّذِي لَيْسَ لَهُ رَأْيٌ وَلَا يَسْتَشِيرُ
