66. Witnesses (8/13)
٦٦۔ كِتَابُ الشَّهَادَاتِ ص ٨
[Machine] I heard Al-Shafi'i say, "I have never seen anyone who bears false witness like the Shia Rafidah."
سَمِعْتُ الشَّافِعِيَّ يَقُولُ لَمْ أَرَ أَحَدًا أَشْهَدَ بِالزُّورِ مِنَ الرَّافِضَةِ كَذَلِكَ
[Machine] I heard Imam Shafi'i say, "I approve the testimony of all the people of desires except for the Rafidites, as some of them testify for each other." The sheikh, may Allah have mercy on him, said, "This also applies to whoever is known from among them to insult the companions who are the pillars of this nation and its chest. His testimony is not accepted whenever his insult to them is based on bigotry or ignorance, not on interpretation or uncertainty."
سَمِعْتُ الشَّافِعِيَّ يَقُولُ أُجِيزُ شَهَادَةَ أَهْلِ الْأَهْوَاءِ كُلِّهِمْ إِلَّا الرَّافِضَةَ فَإِنَّهُ يَشْهَدُ بَعْضُهُمْ لِبَعْضٍ قَالَ الشَّيْخُ رَحِمَهُ اللهُ وَكَذَلِكَ مَنْ عُرِفَ مِنْهُمْ بِسَبِّ الصَّحَابَةِ الَّذِينَ هُمْ سُرُجُ هَذِهِ الْأُمَّةِ وَصَدْرُهَا لَمْ تُقْبَلْ شَهَادَتُهُ مَتَى مَا كَانَ سَبُّهُ إِيَّاهُمْ عَلَى وَجْهِ الْعَصَبِيَّةِ أَوِ الْجَهَالَةِ لَا عَلَى تَأْوِيلٍ أَوْ شُبْهَةٍ
Do not revile my Companions; by him in whose hand my soul is, if one of you contributed the amount of gold equivalent to Uhud, it would not amount to as much as the mudd of one of them, or half of it. (Using translation from Abū Dāʾūd 4658)
قَالَ رَسُولُ اللهِ ﷺ لَا تَسُبُّوا أَصْحَابِي فَوَالَّذِي نَفْسِي بِيَدِهِ لَوْ أَنَّ أَحَدَكُمْ أَنْفَقَ مِثْلَ أُحُدٍ ذَهَبًا مَا بَلَغَ مُدَّ أَحَدِهِمْ وَلَا نَصِيفَهُ
[Machine] On the authority of the Prophet ﷺ, he said: "Insulting a Muslim is immorality, and fighting against him is disbelief."
عَنِ النَّبِيِّ ﷺ قَالَ سِبَابُ الْمُسْلِمِ فُسُوقٌ وَقِتَالُهُ كُفْرٌ
[Machine] A man testified before my father, and then he repeated his testimony. Later, my father asked him, "Did you retract your testimony?" He replied, "Yes." My father asked him, "Why?" He said, "Because I was informed that you either associate with or bear enmity towards the companions of the Prophet ﷺ ." My father said, "I only associate with 'Amr ibn Al-'As." He replied, "Yes." Then my father said, "Well, I will confine you until you make a sincere repentance."
شَهِدَ رَجُلٌ عِنْدَ أَبِي شَهَادَةً فَرَدَّ شَهَادَتَهُ فَأَتَاهُ بَعْدُ فَقَالَ رَدَدْتَ شَهَادَتِي؟ قَالَ نَعَمْ قَالَ وَلِمَ؟ قَالَ لِأَنَّهُ بَلَغَنِي أَنَّكَ تَتَنَاوَلُ أَوْ تَبْغَضُ أَصْحَابَ النَّبِيِّ ﷺ قَالَ مَا أَتَنَاوَلُ إِلَّا عَمْرَو بْنَ الْعَاصِ قَالَ نَعَمْ أَمَا إِنِّي أَزِيدُكَ حَبْسًا حَتَّى تُحْدِثَ تَوْبَةً
66.51 [Machine] The man of jurisprudence is asked about the man of hadith, and he says: refrain from his hadith, because he makes mistakes or narrates things he hasn't heard, or he lacks insight in issuing religious rulings. Al-Shafi'i, may Allah have mercy on him, said: "This is not enmity or slander, when he says it to someone who fears following him and making a mistake by his following. This is one of the meanings of testimony.
٦٦۔٥١ بَابُ: الرَّجُلُ مِنْ أَهْلِ الْفِقْهِ يُسْأَلُ عَنِ الرَّجُلِ مِنْ أَهْلِ الْحَدِيثِ فَيَقُولُ: كُفُّوا عَنْ حَدِيثِهِ , لِأَنَّهُ يَغْلِطُ أَوْ يُحَدِّثُ بِمَا لَمْ يَسْمَعْ , أَوْ أَنَّهُ لَا يُبْصِرُ الْفُتْيَا قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " لَيْسَ هَذَا بِعَدَاوَةٍ وَلَا غِيبَةٍ , إِذَا كَانَ يَقُولُهُ لِمَنْ يَخَافُ أَنْ يَتَّبِعَهُ فَيُخْطِئَ بِاتِّبَاعِهِ , وَهَذَا مِنْ مَعَانِي الشَّهَادَاتِ
[Machine] Anas passed by the Prophet ﷺ during a funeral and praised it. The Prophet ﷺ said, "It is due." He passed by another funeral and spoke ill of it. The Prophet ﷺ said, "It is also due." It was said, "O Messenger of Allah, you said 'due' for that one and for this one." The Prophet ﷺ said, "The testimony of the faithful people is the testimony of Allah on earth."
عَنْ أَنَسٍ مُرَّ عَلَى النَّبِيِّ ﷺ بِجِنَازَةٍ فَأُثْنِيَ عَلَيْهَا خَيْرًا فَقَالَ النَّبِيُّ ﷺ وَجَبَتْ قَالَ وَمُرَّ عَلَيْهِ بِجِنَازَةٍ أُخْرَى فَأُثْنِيَ عَلَيْهَا شَرًّا فَقَالَ النَّبِيُّ ﷺ وَجَبَتْ فَقِيلَ يَا رَسُولَ اللهِ قُلْتَ لِذَلِكَ وَجَبَتْ وَقُلْتَ لِهَذِهِ وَجَبَتْ فَقَالَ شَهَادَةُ الْقَوْمِ الْمُؤْمِنُونَ شُهَدَاءُ اللهِ فِي الْأَرْضِ
[Machine] The Messenger of Allah ﷺ said, "This knowledge is inherited from every generation. Its sincere adherents ward off the misinterpretations of the ignorant, the distortions of the false claimants, and the distortions of the extremists." And Abu Sa'd al-Malini narrated to us, and Abu Ahmad ibn Adiy informed us, and Al-Hasan ibn Sufyan narrated to us, and Ibrahim ibn Ayyub al-Dimashqi narrated to us, and Al-Walid ibn Muslim reported to us, and Ibrahim ibn Abdul Rahman narrated to us, and the trustworthy one among our teachers narrated to us, he said, "The Messenger of Allah ﷺ said something similar to this."
قَالَ رَسُولُ اللهِ ﷺ يَرِثُ هَذَا الْعِلْمَ مِنْ كُلِّ خَلَفٍ عُدُولُهُ يَنْفُونَ عَنْهُ تَأْوِيلَ الْجَاهِلِينَ وَانْتِحَالَ الْمُبْطِلِينَ وَتَحْرِيفَ الْغَالِينَ 20912 وَأَخْبَرَنَا أَبُو سَعْدٍ الْمَالِينِيُّ أنبأ أَبُو أَحْمَدَ بْنُ عَدِيٍّ ثنا الْحَسَنُ بْنُ سُفْيَانَ ثنا إِبْرَاهِيمُ يَعْنِي ابْنَ أَيُّوبَ الدِّمَشْقِيَّ ثنا الْوَلِيدُ يَعْنِي ابْنَ مُسْلِمٍ ثنا إِبْرَاهِيمُ بْنُ عَبْدِ الرَّحْمَنِ ثنا الثِّقَةُ مِنْ أَشْيَاخِنَا قَالَ قَالَ رَسُولُ اللهِ ﷺ نَحْوَهُ
[Machine] Sabea bint Al-Harith gave birth fifteen days after the death of her husband. Abu As-Sanabil passed by her and said, "It seems like you want to marry?" She replied, "Yes," or as she said. He said, "Not until four months and ten days have passed." She came to the Prophet ﷺ and mentioned this to him. He said, "Abu As-Sanabil has lied. If someone comes to you who you are pleased with, then inform me. This is a trustworthy messenger with evidence, and we have narrated it from a group of companions and followers to clarify the condition of someone who is found with something that would warrant the rejection of their news. However, this is not the place for it, except that Ash-Shafi'i, may Allah have mercy on him, included this matter within the issue of witness testimony of people of desires. We have mentioned some of its evidence, and with Allah is the facilitation."
أَنَّ سُبَيْعَةَ بِنْتَ الْحَارِثِ وَضَعَتْ بَعْدَ وَفَاةِ زَوْجِهَا بِخَمْسَةَ عَشَرَ يَوْمًا فَمَرَّ بِهَا أَبُو السَّنَابِلِ فَقَالَ كَأَنَّكِ تُرِيدِينَ الزَّوْجَ؟ فَقَالَتْ نَعَمْ أَوْ كَمَا قَالَتْ قَالَ لَا حَتَّى تَمْضِي أَرْبَعَةُ أَشْهُرٍ وَعَشْرًا فَأَتَتِ النَّبِيَّ ﷺ فَذَكَرَتْ ذَلِكَ لَهُ فَقَالَ كَذَبَ أَبُو السَّنَابِلِ إِذَا أَتَاكِ مَنْ تَرْضَيْنَ فَأَخْبِرِينِي هَذَا مُرْسَلٌ حَسَنٌ وَلَهُ شَوَاهِدُ وَقَدْ رُوِّينَا عَنْ جَمَاعَةٍ مِنَ الصَّحَابَةِ وَالتَّابِعِينَ تَبْيِينَ حَالِ مَنْ وُجِدَ مِنْهُ مَا يُوجِبُ رَدَّ خَبَرِهِ لَيْسَ هَهُنَا مَوْضِعُهُ إِلَّا أَنَّ الشَّافِعِيَّ رَحِمَهُ اللهُ أَدْخَلَ هَذِهِ الْمَسْأَلَةَ خِلَالَ مَسْأَلَةِ شَهَادَةِ أَهْلِ الْأَهْوَاءِ فَأَشَرْنَا إِلَى بَعْضِ أَدِلَّتِهَا وَبِاللهِ التَّوْفِيقُ
[Machine] The Messenger of Allah ﷺ said, "Do you not prevent the mention of the wicked? Mention him for what is in him, so that the people may recognize him and be cautious of him." This is a hadith that is attributed to Jarud ibn Yazid al-Naysaburi, and the people of knowledge criticized it. I heard Aba Abdullah al-Hafiz say, "I heard Aba Abdullah Muhammad ibn Ya'qub al-Hafiz, more than once, say, 'When Abu Bakr al-Jarudi passed by the grave of his grandfather in the burial place of Husayn ibn Mu'adh, he would say, 'Oh father, if you had not narrated a hadith from Bahz ibn Hakim, I would have visited you.'" The sheikh said, "And a group of weak people have stolen it from him and attributed it to Bahz ibn Hakim, but it is not authentic."
قَالَ رَسُولُ اللهِ ﷺ أَتَرْعَوُونَ عَنْ ذِكْرِ الْفَاجِرِ؟ اذْكُرُوهُ بِمَا فِيهِ كَيْ يَعْرِفَهُ النَّاسُ وَيَحْذَرَهُ النَّاسُ فَهَذَا حَدِيثُ يُعْرَفُ بِالْجَارُودِ بْنِ يَزِيدَ النَّيْسَابُورِيِّ وَأَنْكَرَهُ عَلَيْهِ أَهْلُ الْعِلْمِ بِالْحَدِيثِ سَمِعْتُ أَبَا عَبْدِ اللهِ الْحَافِظَ يَقُولُ سَمِعْتُ أَبَا عَبْدِ اللهِ مُحَمَّدَ بْنَ يَعْقُوبَ الْحَافِظَ غَيْرَ مَرَّةٍ يَقُولُ كَانَ أَبُو بَكْرٍ الْجَارُودِيُّ إِذَا مَرَّ بِقَبْرِ جَدِّهِ فِي مَقْبَرَةِ الْحُسَيْنِ بْنِ مُعَاذٍ يَقُولُ يَا أَبَةِ لَوْ لَمْ تُحَدِّثْ بِحَدِيثِ بَهْزِ بْنِ حَكِيمٍ لَزُرْتُكَ قَالَ الشَّيْخُ وَقَدْ سَرَقَهُ عَنْهُ جَمَاعَةٌ مِنَ الضُّعَفَاءِ فَرَوَوْهُ عَنْ بَهْزِ بْنِ حَكِيمٍ وَلَمْ يَصِحَّ فِيهِ شَيْءٌ
[Machine] The Messenger of Allah ﷺ said: "Whoever wears the garment of modesty will have no need for gossiping, and this is also not the trait of a strong person. And Allah knows best."
قَالَ رَسُولُ اللهِ ﷺ مَنْ أَلْقَى جِلْبَابَ الْحَيَاءِ فَلَا غِيبَةَ لَهُ وَهَذَا أَيْضًا لَيْسَ بِالْقَوِيِّ وَاللهُ أَعْلَمُ
66.52 [Machine] What is permissible as the testimony of people of desires?
٦٦۔٥٢ بَابُ: مَا تَجُوزُ بِهِ شَهَادَةُ أَهْلِ الْأَهْوَاءِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " كُلُّ مَنْ تَأَوَّلَ فَأَتَى شَيْئًا مُسْتَحِلًّا كَانَ فِيهِ حَدٌّ أَوْ لَمْ يَكُنْ لَمْ تُرَدَّ شَهَادَتُهُ بِذَلِكَ , أَلَا تَرَى أَنَّ مِمَّنْ حُمِلَ عَنْهُ الدِّينُ , وَنُصِبَ عَلَمًا فِي الْبُلْدَانِ مَنْ قَدِ اسْتَحَلَّ الْمُتْعَةَ , وَمِنْهُمْ مَنْ يَسْتَحِلُّ الدِّينَارَ بِعَشَرَةِ دَنَانِيرَ , يَدًا بِيَدٍ , وَمِنْهُمْ مَنْ قَدْ تَأَوَّلَ فَاسْتَحَلَّ سَفْكَ الدِّمَاءِ , وَمِنْهُمْ مَنْ تَأَوَّلَ فَشَرِبَ كُلَّ مُسْكِرٍ غَيْرَ الْخَمْرِ , وَمِنْهُمْ مَنْ أَحَلَّ إِتْيَانَ النِّسَاءِ فِي أَدْبَارِهِنَّ , وَمِنْهُمْ مَنْ أَحَلَّ بُيُوعًا مُحَرَّمَةً عِنْدَ غَيْرِهِ , فَإِذَا كَانَ هَؤُلَاءِ - مَعَ مَا وَصَفْتُ - أَهْلَ ثِقَةٍ فِي دِينِهِمْ , وَقَنَاعَةٍ عِنْدَ مَنْ عَرَفَهُمْ , وَقَدْ تُرِكَ عَلَيْهِ مَا تَأَوَّلُوا فَأَخْطَئُوا فِيهِ , وَلَمْ يَخْرُجُوا بِعَظِيمِ الْخَطَأِ إِذَا كَانَ مِنْهُمْ عَلَى وَجْهِ الِاسْتِحْلَالِ كَانَ جَمِيعُ أَهْلِ الْأَهْوَاءِ فِي هَذِهِ الْمَنْزِلَةِ "
Whenever he (mu’adh b. jabal) sat in a meeting for preaching, he would say: Allah is a just arbiter; those who doubt would perish. One day Mu’adh b. jabal said: In the times after you there would be trails in which riches would be abundant. During these trails the Quran would be easy so much so that every believer, hypocrite, man, woman, young, grown up, slave and free man will learn it. Then a man might say: What happened with the people that they do not follow me while I read the Quran? They are not going to follow me until I introduce a novelty for them other than it. So avoid that which is innovated (in religion), for whichever is innovated is an error. I warn you of the deviation of a scholar from right guidance, for sometimes Satan utters a word of error through the tongue of a scholar; and sometimes a hypocrites may speak a word of truth. I said to Mu’adh b. jabal: I am at a loss to understand may Allah have mercy on you that a learned man sometimes may speak a word of error and a hypocrite may speak a word of truth. He replied: Yes, avoid the speech of a learned man on distract you from him (the learned), for it is possible that he may withdraw (from these well-known things), and you get the truth when you hear it, for truth has light. Abu Dawud said: In this tradition Ma’mar on the authority of al-Zuhrl said: The words “wa la yun iyannaka” instead of “wa la yuthniyannaka,” with the same meaning: “it may not distract you” salih b. Kaisan on the authority of al-Zurhrl said in this tradition the words “al-mushtaharat” (well-know things). He also said the word “La yuthniyannaka” as ‘Uqail mentioned. Ibn ishaq, on the authority of al-Zuhri, said: Yes, if you are doubtful about the speech of a scholar until you say: WHAT did he mean by this word? (Using translation from Abū Dāʾūd 4611)
أَنَّ مُعَاذًا ؓ كَانَ يَقُولُ كُلَّمَا جَلَسَ مَجْلِسَ ذِكْرٍ اللهُ حَكَمٌ عَدْلٌ وَقَالَ أَبُو الْيَمَانِ قِسْطٌ تَبَارَكَ اسْمُهُ هَلَكَ الْمُرْتَابُونَ فَقَالَ مُعَاذُ بْنُ جَبَلٍ يَوْمًا فِي مَجْلِسٍ جَلَسَهُ وَرَاءَكُمْ فِتَنٌ يَكْثُرُ فِيهَا الْمَالُ وَيُفْتَحُ فِيهَا الْقُرْآنُ حَتَّى يَأْخُذَهُ الْمُؤْمِنُ وَالْمُنَافِقُ وَالْحُرُّ وَالْعَبْدُ وَالرَّجُلُ وَالْمَرْأَةُ وَالْكَبِيرُ وَالصَّغِيرُ فَيُوشِكُ قَائِلٌ أَنْ يَقُولُ فَمَا لِلنَّاسِ لَا يَتَّبِعُونِي وَقَدْ قَرَأْتُ الْقُرْآنَ؟ واللهِ مَا هُمْ بِمُتَّبِعِيَّ حَتَّى أَبْتَدِعَ لَهُمْ غَيْرَهُ فَإِيَّاكُمْ وَمَا ابْتُدِعَ فَإِنَّ مَا ابْتُدِعَ ضَلَالَةٌ وَاحْذَرُوا زَيْغَةَ الْحَكِيمِ فَإِنَّ الشَّيْطَانَ قَدْ يَقُولُ كَلِمَةَ الضَّلَالِ عَلَى فَمِ الْحَكِيمِ وَقَدْ يَقُولُ الْمُنَافِقُ كَلِمَةَ الْحَقِّ قَالَ قُلْتُ لَهُ وَمَا يُدْرِينِي يَرْحَمُكَ اللهُ أَنَّ الْحَكِيمَ يَقُولُ كَلِمَةَ الضَّلَالَةِ وَأَنَّ الْمُنَافِقَ يَقُولُ كَلِمَةَ الْحَقِّ؟ قَالَ اجْتَنِبْ مِنْ كَلَامِ الْحَكِيمِ الْمُشْتَبِهَاتِ الَّتِي تَقُولُ مَا هَذِهِ؟ وَلَا يُنْئِيَنَّكَ ذَلِكَ مِنْهُ فَإِنَّهُ لَعَلَّهُ أَنْ يُرَاجِعَ وَيُلَقَّى الْحَقَّ إِذَا سَمِعَهُ فَإِنَّ عَلَى الْحَقِّ نُورًا وَفِي رِوَايَةِ الْقَاضِي وَلَا يُثْنِيَنَّكَ ذَلِكَ عَنْهُ وَرَوَاهُ عُقَيْلٌ عَنِ الزُّهْرِيِّ فَقَالَ فِي الْحَدِيثِ وَلَا يُثْنِيَنَّكَ ذَلِكَ عَنْهُ فَأَخْبَرَ مُعَاذُ بْنُ جَبَلٍ أَنَّ زَيْغَةَ الْحَكِيمِ لَا تُوجِبُ الْإِعْرَاضَ عَنْهُ وَلَكِنْ يُتْرَكُ مِنْ قَوْلِهِ مَا لَيْسَ عَلَيْهِ نُورٌ فَإِنَّ عَلَى الْحَقِّ نُورًا يَعْنِي وَاللهُ أَعْلَمُ دَلَالَةً مِنْ كِتَابٍ أَوْ سُنَّةٍ أَوْ إِجْمَاعٍ أَوْ قِيَاسٍ عَلَى بَعْضِ هَذَا
[Machine] That the Messenger of Allah ﷺ said: "Beware of the mistake of the scholar and wait for his arrival, and likewise..."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ اتَّقُوا زَلَّةَ الْعَالِمِ وَانْتَظِرُوا فَيْئَتَهُ وَكَذَلِكَ
[Machine] I heard al-Awzai say, "Whoever rejects the binding opinions of the scholars has left Islam."
سَمِعْتُ الْأَوْزَاعِيَّ يَقُولُ مَنْ أَخَذَ بِنَوَادِرِ الْعُلَمَاءِ خَرَجَ مِنَ الْإِسْلَامِ
[Machine] I heard Al-Awzai say that among the people of Makkah, it is permissible to engage in sexual pleasure and to exchange money, while among the people of Madinah, it is allowed to listen to women's voices and have relations with them from behind. In addition, among the people of Syria, it is accepted to use force and obedience, while among the people of Kufa, drinking wine and eating suhoor (pre-dawn meal) is allowed.
سَمِعْتُ الْأَوْزَاعِيَّ يَقُولُ يُتْرَكُ مِنْ قَوْلِ أَهْلِ مَكَّةَ الْمُتْعَةُ وَالصَّرْفُ وَمِنْ قَوْلِ أَهْلِ الْمَدِينَةِ السَّمَاعُ وَإِتْيَانُ النِّسَاءِ فِي أَدْبَارِهِنَّ وَمِنْ قَوْلِ أَهْلِ الشَّامِ الْجَبْرُ وَالطَّاعَةُ وَمِنْ قَوْلِ أَهْلِ الْكُوفَةِ النَّبِيذُ وَالسَّحُورُ
[Machine] I heard Al-Oza'i, may Allah have mercy on him, say: We avoid or refrain from five things that the people of Iraq say, and five things that the people of Hijaz say. From the sayings of the people of Iraq, they are drinking intoxicants, eating before dawn during Ramadan, except on seven specific days, delaying the Asr prayer until the shadow of everything becomes four times its length, fleeing on the day of battle, and from the sayings of the people of Hijaz, they are listening to music, combining prayers without excuse, enjoying women, exchanging one dinar for two, and approaching women from behind.
سَمِعْتُ الْأَوْزَاعِيَّ رَحِمَهُ اللهُ يَقُولُ نَجْتَنِبُ أَوْ نَتْرُكُ مِنْ قَوْلِ أَهْلِ الْعِرَاقِ خَمْسًا وَمِنْ قَوْلِ أَهْلِ الْحِجَازِ خَمْسًا مِنْ قَوْلِ أَهْلِ الْعِرَاقِ شُرْبَ الْمُسْكِرِ وَالْأَكْلَ فِي الْفَجْرِ فِي رَمَضَانَ وَلَا جُمُعَةَ إِلَّا فِي سَبْعَةِ أَمْصَارٍ وَتَأْخِيرَ صَلَاةِ الْعَصْرِ حَتَّى يَكُونَ ظِلُّ كُلِّ شَيْءٍ أَرْبَعَةَ أَمْثَالِهِ وَالْفِرَارَ يَوْمَ الزَّحْفِ وَمِنْ قَوْلِ أَهْلِ الْحِجَازِ اسْتِمَاعَ الْمَلَاهِي وَالْجَمْعَ بَيْنَ الصَّلَاتَيْنِ مِنْ غَيْرِ عُذْرٍ وَالْمُتْعَةَ بِالنِّسَاءِ وَالدِّرْهَمَ بِالدِّرْهَمَيْنِ وَالدِّينَارَ بِالدِّينَارَيْنِ يَدًا بِيَدٍ وَإِتْيَانَ النِّسَاءِ فِي أَدْبَارِهِنَّ
[Machine] Did you not verify these hadiths? I said the hadiths are reported as they were, but whoever permitted intoxication did not permit pleasure, and whoever permitted pleasure did not permit singing and intoxication. And no scholar is free from error, and whoever gathers the errors of scholars and adopts them, his religion will be lost. So Al-Mu'tadid commanded that the book be burned.
أَلَمْ تَصِحَّ هَذِهِ الْأَحَادِيثُ؟ قُلْتُ الْأَحَادِيثُ عَلَى مَا رُوِيَتْ وَلَكِنَّ مَنْ أَبَاحَ الْمُسْكِرَ لَمْ يُبِحِ الْمُتْعَةَ وَمَنْ أَبَاحَ الْمُتْعَةَ لَمْ يُبِحِ الْغِنَاءَ وَالْمُسْكِرَ وَمَا مِنْ عَالِمٍ إِلَّا وَلَهُ زَلَّةٌ وَمَنْ جَمَعَ زَلَلَ الْعُلَمَاءِ ثُمَّ أَخَذَ بِهَا ذَهَبَ دِينُهُ فَأَمَرَ الْمُعْتَضِدُ فَأُحْرِقَ ذَلِكَ الْكِتَابُ
66.53 [Machine] The Disagreement in Playing Chess Al-Shafi'i said: And if they are like this - meaning the people of desires, then the chess player, even if we dislike him, and the bath, even if we dislike it, is easier in condition than those with countless and immeasurable things. And he only said that because of the disagreement among the scholars.
٦٦۔٥٣ بَابُ: الِاخْتِلَافُ فِي اللَّعِبِ بِالشِّطْرَنْجِ قَالَ الشَّافِعِيُّ: وَإِذَا كَانُوا هَكَذَا - يَعْنِي: أَهْلَ الْأَهْوَاءِ , فَاللَّاعِبُ بِالشِّطْرَنْجِ وَإِنْ كَرِهْنَا لَهُ , وَبِالْحَمَامِ , وَإِنْ كَرِهْنَا لَهُ , أَخَفُّ حَالًا مِنْ هَؤُلَاءِ بِمَا لَا يُحْصَى وَلَا يُقَدَّرُ. وَإِنَّمَا قَالَ ذَلِكَ لِمَا فِيهِ أَيْضًا مِنَ اخْتِلَافِ الْعُلَمَاءِ.
ادْفَعْ بِكَذَا
[Machine] Muhammad ibn Sirin and Hisham ibn Urwah were playing chess competitively.
كَانَ مُحَمَّدُ بْنُ سِيرِينَ وَهِشَامُ بْنُ عُرْوَةَ يَلْعَبَانِ بِالشِّطْرَنْجِ اسْتِدْبَارًا
[Machine] That the commoner used to play chess and wear a headscarf and let his hair down, because he was hiding from the pilgrims.
أَنَّ الشَّعْبِيَّ كَانَ يَلْعَبُ بِالشِّطْرَنْجِ وَيَلْبَسُ مِلْحَفَةً وَيُرْخِي شَعْرَهُ وَذَلِكَ أَنَّهُ كَانَ مُتَوَارِيًا مِنَ الْحَجَّاجِ
[Machine] I exited the grand mosque, when suddenly I saw a man who had approached him with a mounted animal. A man asked him, "What did Al-Hasan used to say about chess?" He replied, "He did not see anything wrong with it and he disliked backgammon." So I asked, "Who is this?" They replied, "Ibn 'Awn," and he used to use a gold toothpick.
خَرَجْتُ مِنَ الْمَسْجِدِ الْجَامِعِ فَإِذَا رَجُلٌ قَدْ قُرِّبَتْ إِلَيْهِ دَابَّةٌ فَسَأَلَهُ رَجُلٌ مَا كَانَ الْحَسَنُ يَقُولُ فِي الشِّطْرَنْجِ؟ فَقَالَ كَانَ لَا يَرَى بِهَا بَأْسًا وَكَانَ يَكْرَهُ النَّرْدَشِيرَ فَقُلْتُ مَنْ هَذَا؟ فَقَالُوا ابْنُ عَوْنٍ وَكَانَ مُضَبِّبَ الْأَسْنَانِ بِالذَّهَبِ
[Machine] I came to Basra in search of hadith, so I met Bahz ibn Hakim and found him with a group playing chess.
أَتَيْتُ الْبَصْرَةَ فِي طَلَبِ الْحَدِيثِ فَأَتَيْتُ بَهْزَ بْنَ حَكِيمٍ فَوَجَدْتُهُ مَعَ قَوْمٍ يَلْعَبُ بِالشِّطْرَنْجِ
[Machine] I heard Sufyan say that he saw Ibrahim al-Hajari playing chess. Al-Shafi'i, may Allah have mercy on him, considered playing chess to be a disputed matter. It does not necessitate invalidating one's testimony, but he expressed his dislike for it, as mentioned earlier. This is the most similar and preferred opinion in his school of thought. Those who dislike it are the majority, and there are those who argue with his statement. And with Allah is the guidance.
سَمِعْتُ سُفْيَانَ يَقُولُ رَأَيْتُ إِبْرَاهِيمَ الْهَجَرِيَّ وَكَانَ يَلْعَبُ بِالشِّطْرَنْجِ فَجَعَلَ الشَّافِعِيُّ رَحِمَهُ اللهُ اللَّعِبَ بِالشِّطْرَنْجِ مِنَ الْمَسَائِلِ الْمُخْتَلَفِ فِيهَا فِي أَنَّهُ لَا يُوجِبُ رَدَّ الشَّهَادَةِ فَأَمَّا كَرَاهِيَةُ اللَّعِبِ بِهَا فَقَدْ صَرَّحَ بِهَا فِيمَا قَدَّمْنَا ذِكْرَهُ وَهُوَ الْأَشْبَهُ وَالْأُولَى بِمَذْهَبِهِ فَالَّذِينَ كَرِهُوا أَكْثَرُ وَمَعَهُمْ مَنْ يُحْتَجُّ بِقَوْلِهِ وَبِاللهِ التَّوْفِيقُ
[Machine] He used to say that chess is the easy game for non-Arabs, this is a message, but it has evidence.
أَنَّهُ كَانَ يَقُولُ الشِّطْرَنْجُ هُوَ مَيْسِرُ الْأَعَاجِمِ هَذَا مُرْسَلٌ وَلَكِنَّ لَهُ شَوَاهِدَ
[Machine] "What are these statues that you are devoted to?" [Surah Al-Anbiya' 52]
{مَا هَذِهِ التَّمَاثِيلُ الَّتِي أَنْتُمْ لَهَا عَاكِفُونَ} [الأنبياء 52]؟
[Machine] "What are these statues that you are devoted to?" [Quran 21:52]. It is better for him to touch a live coal until it turns cold than to touch them.
{مَا هَذِهِ التَّمَاثِيلُ الَّتِي أَنْتُمْ لَهَا عَاكِفُونَ} [الأنبياء 52]؟ لَأَنْ يَمَسَّ جَمْرًا حَتَّى يُطْفَأَ خَيْرٌ لَهُ مِنْ أَنْ يَمَسَّهَا
[Machine] Ali, the owner of the chess set, said, "The biggest liar is the one who claims, 'I killed, when they haven't killed anyone.'"
قَالَ عَلِيٌّ ؓ صَاحِبُ الشِّطْرَنْجِ أَكْذَبُ النَّاسِ يَقُولُ أَحَدُهُمْ قَتَلْتُ وَمَا قَتَلَ
[Machine] Ali passed by a gathering of the people of Taym while they were playing chess. He stood in front of them and said, "By Allah, you were not created for anything other than this? By Allah, if it were not for the Sunnah, I would have struck your faces with it."
مَرَّ عَلِيٌّ ؓ بِمَجْلِسٍ مِنْ مَجَالِسِ تَيْمِ اللهِ وَهُمْ يَلْعَبُونَ بِالشِّطْرَنْجِ فَوَقَفَ عَلَيْهِمْ فَقَالَ أَمَا وَاللهِ لِغَيْرِ هَذَا خُلِقْتُمْ أَمَا وَاللهِ لَوْلَا أَنْ تَكُونَ سُنَّةً لَضَرَبْتُ بِهَا وُجُوهَكُمْ
[Machine] He claimed that he was the guardian of an orphan child, so he burned it.
أَنَّهُ وَلِيَ مَالَ يَتِيمٍ فَأَحْرَقَهَا
هُوَ شَرٌّ مِنَ النَّرْدِ
لَا يَلْعَبُ بِالشِّطْرَنْجِ إِلَّا خَاطِئٌ
[Machine] Aisha, the wife of the Prophet ﷺ , disliked gambling, even if it was not played with money, and Abu Sa'eed Al-Khudri disliked playing chess.
كَانَتْ عَائِشَةُ زَوْجُ النَّبِيِّ ﷺ تَكْرَهُ الْكَبْلَ وَإِنْ لَمْ يُقَامَرْ عَلَيْهَا وَأَبُو سَعِيدٍ الْخُدْرِيُّ يَكْرَهُ أَنْ يُلْعَبَ بِالشِّطْرَنْجِ
هِيَ بَاطِلٌ وَلَا يُحِبُّ اللهُ الْبَاطِلَ
هِيَ مِنَ الْبَاطِلِ وَلَا أُحِبُّهَا
[Machine] It is from falsehood, and Allah does not love falsehood.
هِيَ مِنَ الْبَاطِلِ وَلَا يُحِبُّ اللهُ الْبَاطِلَ
[Machine] Let us stay away from this magic and let us be warned against playing with it, as advised by Yazid bin Abi Habib, Muhammad bin Sireen, Ibrahim al-Nakha'i, and Malik bin Anas.
دَعُونَا مِنْ هَذِهِ الْمَجُوسِيَّةِ وَرُوِّينَا فِي كَرَاهِيَةِ اللَّعِبِ بِهَا عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ وَمُحَمَّدِ بْنِ سِيرِينَ وَإِبْرَاهِيمَ النَّخَعِيِّ وَمَالِكِ بْنِ أَنَسٍ
66.54 [Machine] The dislike of playing with pigeons
٦٦۔٥٤ بَابُ: كَرَاهِيَةُ اللَّعِبِ بِالْحَمَامِ
The Messenger of Allah ﷺ saw a man pursuing a pigeon. He said: A devil is pursuing a female devil. (Using translation from Abū Dāʾūd 4940)
أَنَّ رَسُولَ اللهِ ﷺ رَأَى رَجُلًا يَتْبَعُ حَمَامَةً فَقَالَ شَيْطَانٌ يَتْبَعُ شَيْطَانَةً
[Machine] I witnessed Umar ibn Abdul Aziz ordering the slaughter of flying pigeons while leaving the scissors untouched.
شَهِدْتُ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ يَأْمُرُ بِالْحَمَامِ الطَّيَّارَاتِ فَيُذْبَحْنَ وَتُتْرَكُ الْمُقَصَّصَاتُ
66.55 [Machine] What indicates the invalidity of the testimony of someone who participated in gambling, playing chess, or any similar activity? Allah Almighty said: "Indeed, intoxicants, gambling," [Quran 5:90]
٦٦۔٥٥ بَابُ: مَا يَدُلُّ عَلَى رَدِّ شَهَادَةِ مَنْ قَامَرَ بِالْحَمَامِ أَوْ بِالشِّطْرَنْجِ, أَوْ بِغَيْرِهِمَا قَالَ اللهُ تَعَالَى: {إِنَّمَا الْخَمْرُ وَالْمَيْسِرُ} [المائدة: 90] الْآيَةَ
[Machine] The Messenger of Allah ﷺ said: Indeed, Allah has prohibited for you wine, gambling, and idolatrous practices, and he said: every intoxicating substance is forbidden.
رَسُولِ اللهِ ﷺ قَالَ إِنَّ اللهَ حَرَّمَ عَلَيْكُمُ الْخَمْرَ وَالْمَيْسِرَ وَالْكُوبَةَ وَقَالَ كُلُّ مُسْكِرٍ حَرَامٌ
[Machine] That Ibn Umar used to say "Al-Maysir is gambling".
أَنَّ ابْنَ عُمَرَ كَانَ يَقُولُ الْمَيْسِرُ الْقِمَارُ
[Machine] In His statement {al-Maisir} [Al-Baqarah 2:219], Ki'abu Faresa and Qidah al-Arab and all gambling is forbidden.
فِي قَوْلِهِ {الْمَيْسِرُ} [البقرة 219] قَالَ كِعَابُ فَارِسَ وَقِدَاحُ الْعَرَبِ وَالْقِمَارُ كُلُّهُ
[Machine] All gambling is prohibited, even the small nuts that children play with.
الْمَيْسِرُ الْقِمَارُ كُلُّهُ حَتَّى الْجَوْزُ الَّذِي يَلْعَبُ بِهِ الصِّبْيَانُ
66.56 [Machine] The Testimony of Drinkers
٦٦۔٥٦ بَابُ: شَهَادَةُ أَهْلِ الْأَشْرِبَةِ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ: " مَنْ شَرِبَ مِنَ الْخَمْرِ شَيْئًا وَهُوَ يَعْرِفُهَا خَمْرًا رُدَّتْ شَهَادَتُهُ , لِأَنَّ تَحْرِيمَهَا نَصٌّ فِي كِتَابِ اللهِ , سَكِرَ أَوْ لَمْ يَسْكَرْ , وَقَالَ فِيمَا سِوَاهَا مِنَ الْأَشْرِبَةِ الَّتِي يُسْكِرُ كَثِيرُهَا: فَهُوَ عِنْدَنَا مُخْطِئٌ بِشُرْبِهِ , آثِمٌ بِهِ , وَلَا تُرَدُّ بِهِ شَهَادَتُهُ " , يَعْنِي لِمَا فِيهِ مِنَ الْخِلَافِ , قَالَ الشَّافِعِيُّ: " مَا لَمْ يَسْكَرْ مِنْهُ , فَإِذَا سَكِرَ مِنْهُ فَشَهَادَتُهُ مَرْدُودَةٌ مِنْ قِبَلِ أَنَّ السُّكْرَ مُحَرَّمٌ عِنْدَ جَمِيعِ أَهْلِ الْإِسْلَامِ "
[Machine] Narrated by the Prophet ﷺ that he prohibited you from a little of what causes intoxication, as much of it being prohibited. He said that every intoxicant is considered wine, and every intoxicant is prohibited. It has been narrated in the hadith of Ibn Abbas that he said, "And the term 'intoxicant' applies to every drink."
عَنِ النَّبِيِّ ﷺ أَنْهَاكُمْ عَنْ قَلِيلِ مَا أَسْكَرَ كَثِيرُهُ وَقَالَ مَا أَسْكَرَ كَثِيرُهُ فَقَلِيلُهُ حَرَامٌ وَقَالَ كُلُّ مُسْكِرٍ خَمْرٌ وَكُلُّ مُسْكِرٍ حَرَامٌ وَرُوِّينَا فِي حَدِيثِ ابْنِ عَبَّاسٍ هَذَا أَنَّهُ قَالَ وَالْمُسْكِرُ مِنْ كُلِّ شَرَابٍ
[Machine] What is your situation? Whether you are in need, we will help you. And if you are afraid, we will protect you unless you have killed someone and are to be killed in return. And if you dislike the company of a certain group, we will turn you away from them. He said: I have drunk wine and I am from the tribe of Taym. And Abu Musa punished and shamed me, and he blackened my face and paraded me among the people, saying: Do not sit with him or eat with him. So I thought about three possibilities for myself: either I take a sword and strike Abu Musa with it, or I come to you and you turn me over to the people in Sham (Syria) because they do not know me, or I join the enemy and eat and drink with them. He said: So Umar wept and said, "What distresses me is not that you did what you did, or that Umar did such and such. Indeed, I used to drink wine with the people during pre-Islamic times, and it is not like adultery." Then he wrote to Abu Musa: Peace be upon you. After that, Fulan ibn Fulan al-Taymi informed me of this and that. By Allah, if you return, I will blacken your face again and parade you among the people. And if you wish to know the truth of what I say, then return and order the people to accompany and eat with him. And if he repents, then accept his testimony and carry out the punishment. And he gave him two hundred dirhams. So Umar was informed that his testimony was invalidated by his drinking wine, and that his testimony would only be accepted if he repented. Al-Shafi'i, may Allah have mercy on him, said: The seller of wine cannot give testimony, because there is no disagreement among any of the Muslims that the sale of it is prohibited. And the evidence for its prohibition has already passed in the consensus of the scholars in the book of transactions.
مَا شَأْنُكَ إِنْ كُنْتَ غَارِمًا أَعَنَّاكَ وَإِنْ كُنْتَ خَائِفًا أَمَّنَّاكَ إِلَّا أَنْ تَكُونَ قَتَلْتَ نَفْسًا فَتُقْتَلَ بِهَا وَإِنْ كُنْتَ كَرِهْتَ جِوَارَ قَوْمٍ حَوَّلْنَاكَ عَنْهُمْ قَالَ إِنِّي شَرِبْتُ الْخَمْرَ وَأَنَا أَحَدُ بَنِي تَيْمٍ وَإِنَّ أَبَا مُوسَى جَلَدَنِي وَحَلَقَنِي وَسَوَّدَ وَجْهِي وَطَافَ بِي فِي النَّاسِ وَقَالَ لَا تُجَالِسُوهُ وَلَا تُؤَاكِلُوهُ فَحَدَّثْتُ نَفْسِي بِإِحْدَى ثَلَاثٍ إِمَّا أَنْ أَتَّخِذَ سَيْفًا فَأَضْرِبَ بِهِ أَبَا مُوسَى وَإِمَّا أَنْ آتِيَكَ فَتُحَوِّلَنِي إِلَى الشَّامِ فَإِنَّهُمْ لَا يَعْرِفُونَنِي وَإِمَّا أنْ أَلْحَقَ بِالْعَدُوِّ وَآكُلَ مَعَهُمْ وَأَشْرَبَ قَالَ فَبَكَى عُمَرُ ؓ وَقَالَ مَا يَسُرُّنِي أَنَّكَ فَعَلْتَ وَأَنَّ لِعُمَرَ كَذَا وَكَذَا وَإِنِّي كُنْتُ لَأَشْرَبَ النَّاسِ لَهَا فِي الْجَاهِلِيَّةِ وَإِنَّهَا لَيْسَتْ كَالزِّنَا وَكَتَبَ إِلَى أَبِي مُوسَى سَلَامٌ عَلَيْكَ أَمَّا بَعْدُ فَإِنَّ فُلَانَ بْنَ فُلَانٍ التَّيْمِيَّ أَخْبَرَنِي بِكَذَا وَكَذَا وَايْمُ اللهِ لَئِنْ عُدْتَ لَأُسَوِّدَنَّ وَجْهَكَ وَلَأُطَوِّفَنَّ بِكَ فِي النَّاسِ فَإِنْ أَرَدْتَ أَنْ تَعْلَمَ حَقَّ مَا أَقُولُ لَكَ فَعُدْ فَأْمُرِ النَّاسَ أَنْ يُجَالِسُوهُ وَيُؤَاكِلُوهُ وَإِنْ تَابَ فَاقْبَلُوا شَهَادَتَهُ وَحَمَلَهُ وَأَعْطَاهُ مِائَتَيْ دِرْهَمٍ فَأَخْبَرَ عُمَرُ ؓ أَنَّ شَهَادَتَهُ تَسْقُطُ بِشُرْبِهِ الْخَمْرَ وَأَنَّهُ إِذَا تَابَ حِينَئِذٍ تُقْبَلُ شَهَادَتُهُ قَالَ الشَّافِعِيُّ رَحِمَهُ اللهُ وَبَائِعُ الْخَمْرِ مَرْدُودُ الشَّهَادَةِ لِأَنَّهُ لَا خِلَافَ بَيْنَ أَحَدٍ مِنَ الْمُسْلِمِينَ فِي أَنَّ بَيْعَهَا مُحَرَّمٌ قَالَ الشَّيْخُ وَقَدْ مَضَتِ الدَّلَالَةُ عَلَى تَحْرِيمِ بَيْعِهَا مَعَ الْإِجْمَاعِ فِي كِتَابِ الْبُيُوعِ
66.57 [Machine] The dislike of playing with dice more than the dislike of playing with toys due to the certainty and abundance of news in it.
٦٦۔٥٧ بَابُ: كَرَاهِيَةُ اللَّعِبِ بِالنَّرْدِ أَكْثَرَ مِنْ كَرَاهِيَةِ اللَّعِبِ بِالشَّيْءِ مِنَ الْمَلَاهِي لِثُبُوتِ الْخَبَرِ فِيهِ وَكَثْرَتِهِ
[Machine] The Messenger of Allah, ﷺ , said: "Whoever plays backgammon is like one who plunges his hand in the flesh of a pig and its blood." This is the wording of Ishaq's hadith, and in the narration of Abdul Rahman it is said that the Prophet, ﷺ , said: "Whoever plays backgammon is like one who dips his hand in the flesh and blood of a pig."
قَالَ رَسُولُ اللهِ ﷺ مَنْ لَعِبَ بِالنَّرْدَشِيرِ فَهُوَ كَمَنْ غَمَسَ يَدَهُ فِي لَحْمِ الْخِنْزِيرِ وَدَمِهِ لَفْظُ حَدِيثِ إِسْحَاقَ وَفِي رِوَايَةِ عَبْدِ الرَّحْمَنِ أَنَّ النَّبِيَّ ﷺ قَالَ مَنْ لَعِبَ بِالنَّرْدَشِيرِ فَكَأَنَّمَا صَبَغَ يَدَهُ فِي لَحْمِ خِنْزِيرٍ وَدَمِهِ
[Machine] That the Messenger of Allah ﷺ said: "Whoever plays with dice has disobeyed Allah and His Messenger, and likewise..."
أَنَّ رَسُولَ اللهِ ﷺ قَالَ مَنْ لَعِبَ بِالنَّرْدِ فَقَدْ عَصَى اللهَ وَرَسُولَهُ وَكَذَلِكَ
[Machine] The Prophet ﷺ said, "Whoever plays with dice has indeed disobeyed Allah and His Messenger, and likewise."
قَالَ النَّبِيُّ ﷺ مَنْ لَعِبَ بِالنَّرْدِ فَقَدْ عَصَى اللهَ وَرَسُولَهُ وَكَذَلِكَ
[Machine] He heard the Messenger of Allah ﷺ say, "No one should intervene in her affairs, waiting to see what she brings, except that Allah and His Messenger will be angered."
أَنَّهُ سَمِعَ رَسُولَ اللهِ ﷺ يَقُولُ لَا يُقَلِّبُ كَعَبَاتِهَا أَحَدٌ يَنْتَظِرُ مَا تَأْتِي بِهِ إِلَّا عَصَى اللهَ وَرَسُولَهُ
[Machine] "Narrated Abdullah ibn Mas'ud: I heard my father saying that he heard the Prophet ﷺ saying: 'The example of the one who plays with dice and then prays is like the one who performs ablution with pus and blood from a swine, and then prays with it.'"
عَنْ رَسُولِ اللهِ ﷺ فَقَالَ عَبْدُ الرَّحْمَنِ سَمِعْتُ أَبِي يَقُولُ سَمِعْتُ رَسُولَ اللهِ ﷺ يَقُولُ مَثَلُ الَّذِي يَلْعَبُ بِالنَّرْدِ ثُمَّ يَقُومُ فَيُصَلِّي مَثَلُ الَّذِي يَتَوَضَّأُ بِالْقَيْحِ وَدَمِ الْخِنْزِيرِ ثُمَّ يَقُومُ فَيُصَلِّي بِهِ
[Machine] The Messenger of Allah ﷺ said, "Beware of these two marked Kaabahs that are being cursed. They are from the destruction of the non-Arabs." Al-Bakka'i reported it from Ibrahim and Suwaid reported it from Abu Muawiya from Ibrahim. And Al-Mahfudh is suspended.
قَالَ رَسُولُ اللهِ ﷺ اتَّقُوا هَاتَيْنِ الْكَعْبَتَيْنِ الْمَوْسُومَتَيْنِ اللَّتَيْنِ تُزْجَرَانِ زَجْرًا فَإِنَّهُمَا مِنْ مَيْسِرِ الْعَجَمِ رَفَعَهُ الْبَكَّائِيُّ عَنْ إِبْرَاهِيمَ وَسُوَيْدٍ عَنْ أَبِي مُعَاوِيَةَ عَنْ إِبْرَاهِيمَ وَالْمَحْفُوظُ مَوْقُوفٌ
عَنِ ابْنِ مَسْعُودٍ مَوْقُوفًا
