66. Witnesses
٦٦۔ كِتَابُ الشَّهَادَاتِ
[Machine] That Hudhayfah recognized a stolen camel, so he disputed it in front of the judge of the Muslims. The case was ruled in favor of Hudhayfah, so he wanted to buy his right. He said to him, "Ten dirhams." He refused. He said to him, "Twenty dirhams." He refused. He said to him, "Thirty dirhams." He refused. He said to him, "Forty dirhams." He refused. Hudhayfah said, "Will you leave my camel?" He swears that it is his camel and that he did not sell it or give it as a gift. It is mentioned that Jubayr ibn Mu'tim paid ten thousand dirhams as redemption for his right, and it is mentioned that Umar ibn Al-Khattab in a dispute between him and Mu'adh ibn 'Afra' over something, Umar swears and then says, "Do you see that I have proved it with my right? Go now, it's yours."
أَنَّ حُذَيْفَةَ عَرَفَ جَمَلًا لَهُ سُرِقَ فَخَاصَمَ فِيهِ إِلَى قَاضِي الْمُسْلِمِينَ فَصَارَتْ عَلَى حُذَيْفَةَ يَمِينٌ فِي الْقَضَاءِ فَأَرَادَ أَنْ يَشْتَرِيَ يَمِينَهُ فَقَالَ لَكَ عَشَرَةُ دَرَاهِمَ فَأَبَى فَقَالَ لَكَ عِشْرُونَ فَأَبَى فَقَالَ لَكَ ثَلَاثُونَ فَأَبَى فَقَالَ لَكَ أَرْبَعُونَ فَأَبَى فَقَالَ حُذَيْفَةُ أَتْرُكُ جَمَلِي؟ فَحَلَفَ أَنَّهُ جَمَلُهُ مَا بَاعَهُ وَلَا وَهَبَهُ وَيُذْكَرُ عَنْ جُبَيْرِ بْنِ مُطْعِمٍ أَنَّهُ فَدَى يَمِينَهُ بِعَشْرَةِ آلَافِ دِرْهَمٍ وَيُذْكَرُ عَنْ عُمَرَ بْنِ الْخَطَّابِ ؓ فِي خُصُومَةٍ كَانَتْ بَيْنَهُ وَبَيْنَ مُعَاذِ بْنِ عَفْرَاءَ فِي شَيْءٍ قَالَ فَحَلَفَ عُمَرُ ؓ ثُمَّ قَالَ أَتَرَانِي أَنِّي قَدِ اسْتَحْقَقْتُهَا بِيَمِينِي؟ اذْهَبِ الْآنَ فَهِيَ لَكَ
