66. Witnesses

٦٦۔ كِتَابُ الشَّهَادَاتِ

66.37 [Machine] The fair evidence is more deserving than the wicked right. It was narrated, from Umar ibn Al Khattab and Shurayh Al Qadi, may Allah have mercy on them.

٦٦۔٣٧ بَابُ الْبَيِّنَةُ الْعَادِلَةُ أَحَقُّ مِنَ الْيَمِينِ الْفَاجِرَةِ رُوِيَ ذَلِكَ , عَنْ عُمَرَ بْنِ الْخَطَّابِ وَشُرَيْحٍ الْقَاضِي رَحِمَهُ اللهُ

[Machine] "Whoever claims to be a judge, the burden of proof is upon him until he provides clear evidence. The truth is more deserving of my judgment. The truth is more deserving than an immoral oath."  

البيهقي:٢٠٧٣١أَخْبَرَنَا الشَّرِيفُ أَبُو الْفَتْحِ نَاصِرُ بْنُ الْحُسَيْنِ الْعُمَرِيُّ أنبأ عَبْدُ الرَّحْمَنِ بْنُ أَبِي شُرَيْحٍ حَدَّثَنَا أَبُو الْقَاسِمِ الْبَغَوِيُّ ثنا عَلِيُّ بْنُ الْجَعْدِ ثنا شَرِيكٌ عَنْ عَاصِمٍ عَنْ مُحَمَّدِ بْنِ سِيرِينَ عَنْ شُرَيْحٍ قَالَ

مَنِ ادَّعَى قَضَائِي فَهُوَ عَلَيْهِ حَتَّى يَأْتِيَ بِبَيِّنَةٍ الْحَقُّ أَحَقُّ مِنْ قَضَائِي الْحَقُّ أَحَقُّ مِنْ يَمِينٍ فَاجِرَةٍ
